In Increments, Senate Revisits Immigration Bill By JULIA PRESTON WASHINGTON, Aug. 2

When a broad immigration bill failed in the Senate in June after a vitriolic national debate, many legislators said the issue was dead, perhaps until President Bush left office. But already some of the less contentious pieces of the bill are returning to life. Last week, the Senate approved $3 billion for border security as part of a Homeland Security Department spending bill. Democrats and Republicans have also begun laying ground for a bill to create a new temporary immigrant worker program for agriculture. Another bill, also with bipartisan support, would give a path to citizenship to high school graduates who are illegal immigrants if they complete two years of college or military service. Senator Richard J. Durbin, Democrat of Illinois and a sponsor of the bill, attached it as an amendment to the military authorization legislation that the Senate last month put off until September. Mr. Durbin said he would seek to move it again then. The agriculture and student measures “have a decent chance of passing this Congress because they have strong champions, broad bipartisan support and they have been around for a long time,” said Frank Sharry, executive director of the National Immigration Forum, which supported the broad bill. But he cautioned that they would have to overcome a “toxic” atmosphere on immigration in the wake of the defeated bill. The college bill attracted renewed interest this week because of Juan Sebastian Gomez, a student who just graduated with honors from Killian Senior High School in Miami. On July 25, immigration agents in Florida detained Mr. Gomez, 18, his brother and his parents, all illegal immigrants from Colombia, and prepared to deport them. Immigration officials delayed the deportation on Wednesday after a group of Mr. Gomez’s high school friends roused support in South Florida and then flew to Washington to pound on doors. The friends pointed to Mr. Gomez’s academic record — a near-perfect 3.96 grade-point average — and top scores on 11 Advanced Placement exams. They said he should not be punished for his illegal status because his parents brought him to the United States when he was 2. The sweeping Senate immigration bill, which included a path to citizenship for illegal immigrants, was defeated by opponents who said it would reward knowing lawbreakers and the employers who hired them. But many legislators, including some who opposed the broader bill, see the student measure differently because it would benefit immigrant teenagers who are illegal only because of decisions their parents made when the children were young. “It’s unfair to make these young people pay for the sins of their parents,” Mr. Durbin said. The Migration Policy Institute, a nonpartisan research organization in Washington, says nearly a million immigrant students across the country could gain legal status under the bill, whose backers call it the Dream Act. While the bill’s prospects seem favorable in the Senate, the outlook is not as bright in the House. “We call it the Nightmare Act,” said Representative Brian P. Bilbray, a Republican from California who leads the Immigration Reform Caucus in the House. “We’re giving status to immigrants based on the fact they are here illegally. It really sends a mixed signal to both legal and illegal immigrants.” Support has also re-emerged for the agricultural bill as labor shortages have hampered harvests this summer in states like California, Michigan and North Carolina. The bill’s supporters include growers, the United Farm Workers, conservative Republicans like Senator Larry E. Craig of Idaho, and Senator Dianne Feinstein, Democrat of California. At least 70 percent of the workers in agriculture are illegal immigrants, says the Agriculture Coalition for Immigration Reform, a national trade group. The bill’s supporters say they are looking for ways to bring it to a vote before the year’s end. In one effort last week, during the debate on financing the Department of Homeland Security, Senator Edward M. Kennedy, Democrat of Massachusetts, sought a vote on an amendment that would combine the agricultural bill and the illegal immigrant student measure, but he did not succeed. Mr. Gomez’s case has given Washington a vivid illustration of the issues behind the illegal immigrant student measure. An affable teenager who attracted friends at Killian High by tutoring classmates in subjects as diverse as European history and biochemistry, Mr. Gomez seemed likely to be an exceptional college candidate. A volunteer at a neighborhood homeless shelter, he often did his schoolwork on the computers of friends because his parents could not afford one. Mr. Gomez’s parents, Liliana and José Gomez, brought him and his brother, Alejandro, who is a year older than Juan, to the United States from Colombia on tourist visas in 1990. The parents stayed and started a small catering business in Miami, and the boys went to public school. Barbara Gonzalez, a spokeswoman for Immigration and Customs Enforcement, said Mr. Gomez’s parents applied for legal status but were denied in 2002. They have been facing deportation orders since then. Mr. Gomez, barred from applying for financial aid because of his illegal status, enrolled in a Miami community college for the fall. “All I’m hearing now is that I’m Colombian, but I’ve never really been there,” Mr. Gomez said in a telephone interview from Miami. He said he had no memories of the country where he was born and does not speak articulate Spanish. “They are taking me from my home in America,” he said. The family was arrested as part of a nationwide immigration agency operation to track down immigrants scheduled for deportation, agency officials said. From the vehicle that took Mr. Gomez to an immigration detention center, he made furtive cellphone calls to his high school friends. They opened a site on Facebook to signal his plight and contacted the news media. A week later, Mr. Gomez’s site had more than 2,000 members and seven of his friends were working the hallways on Capitol Hill. In interviews here, friends recalled Mr. Gomez’s spurring them through a three-day sleepless marathon of studying for an Advanced Placement exam in world history. “I truly see Juan pursuing a career that does America good,” said Andrew Dubbin, 17, a junior at Killian. “He could do anything. He’s just genuinely smart and sociable.” On Monday, Representative Lincoln Diaz-Balart, Republican of Florida, offered a private bill to the House Judiciary Committee asking for legal resident status for Mr. Gomez and his brother. Representative Ileana Ros-Lehtinen, Republican of Florida, delivered an appeal for the brothers to the White House, and Senator Bill Nelson, Democrat of Florida, called immigration authorities. On Wednesday, officials stayed the family’s deportation and released them for 45 days to give Congress time to consider their bill, Ms. Gonzalez, the immigration agency spokeswoman, said. On Friday, Representative Zoe Lofgren, Democrat of California and chairwoman of the House Judiciary immigration subcommittee, will hold a meeting to consider private bills for three other illegal immigrant students facing deportation. House Forms Special Panel Over Alleged Stolen Vote GOP Assails Decision on Food Aid for Immigrants By Jonathan Weisman and Elizabeth Williamson Washington Post Staff Writers Saturday, August 4, 2007; A02 The House last night unanimously agreed to create a special select committee, with subpoena powers, to investigate Republican allegations that Democratic leaders had stolen a victory from the House GOP on a parliamentary vote late Thursday night. The move capped a remarkable day that started with Republicans marching out of the House in protest near midnight Thursday, was punctuated by partisan bickering, and ended with Democratic hopes for a final legislative rush fading. Even a temporary blackout of the House chamber's vote tally board led to suspicions and accusations of skullduggery. While Democratic leaders hoped to leave for their August recess on a wave of legislative successes, the House instead slowed to an acrimonious crawl that threatened to stretch the legislative session into next week. The agreement to form a special committee was extraordinary. Such powerful investigative committees are usually reserved for issues such as the Watergate scandal and the funneling of profits from Iranian arms sales to the Nicaraguan contras in the 1980s. "I don't know when something like this has happened before," said House deputy historian Fred W. Beuttler. He called the decision "incredible." House Majority Leader Steny H. Hoyer (D-Md.) accepted GOP calls for an investigation. "I do not believe there was any wrongdoing by any member of the House. I do believe a mistake was made," he said. "And I regret it." "We are not irrelevant here," said House Minority Whip Roy Blunt (R-Mo.). "Just because we are in the minority doesn't mean we're irrelevant." GOP lawmakers had marched out of the House chamber about 11 p.m. Thursday, shouting "shame, shame" and saying that Democrats had "stolen" a vote on a parliamentary motion to pull an agriculture spending bill off the floor until it incorporated an explicit denial of federal benefits to illegal immigrants. The bill already would deny such benefits to illegal immigrants, and Democrats stressed that they won the vote fair and square. But a campaign has been launched, and the House has not fully recovered.

Anger-driven delaying tactics threw into uncertainty an agenda that was to include important votes on a huge energy bill, a defense spending bill and a terrorism surveillance measure before Congress's departure for its month-long summer recess. House Speaker Nancy Pelosi (D-Calif.) accused Republicans of blatant obstructionism. "They've just been deluged by the success of the Democrats on behalf of the American people," she said. After Rep. Patrick T. McHenry (R-N.C.) violated House rules by calling Democrats "cheaters" on the floor, Rep. Carol Shea-Porter (D-N.H.), a freshman and relative political neophyte, warned her colleagues that their mothers might be watching. Even the House hardware contributed to the disarray. Republicans had at last been coaxed back to the House floor yesterday afternoon, when a lawmaker moved to adjourn the House, a favorite GOP delaying tactic. As the votes were coming in, the electronic tally board suddenly went blank, leading to a new round of recriminations and another House recess. "I understand that everybody's sensibilities are taut," Hoyer pleaded, as Rep. David Dreier (R-Calif.) hinted darkly that perhaps the House had just voted to adjourn. "I regret what happened last night, but we do have business to do," Hoyer said. It started late Thursday, when GOP lawmakers moved to send the 2008 agriculture spending bill back to the House Appropriations Committee for members to add an explicit prohibition on illegal immigrants receiving food stamps. With so much on their plate, Democratic leaders were in no mood to comply. Democrats appeared to have won the vote, but with the voting time apparently having expired, GOP leaders persuaded three Latino Republicans who had voted with the Democrats to change their votes. At the same time, Democrats say, five Democratic lawmakers who had voted with Republicans were scrambling to change their votes as well. With two of the GOP votes changed, Democrats gaveled the vote shut, 214 to 214, and declared that they had won. But the public tally showed that the Republicans had won, 215 to 213, just as the vote was declared for the Democrats. The official final tally was 216 to 212 in the Democrats' favor. But House Minority Leader John A. Boehner (R-Ohio) said there were no Democrats seeking to change their votes at the time. Moreover, he charged, Hoyer had told a protesting parliamentarian, "We control, not the parliamentarians." And, he said, electronic records on the vote disappeared from the House's voting system and on the House clerk's Web site. "Many of my colleagues and I feel as though the vote was taken from us," Boehner said. In a raucous protest, Republicans walked out of the House en masse. Hoyer conceded that the gavel had fallen too quickly, but he said it had been an error. When he put the issue to a new vote, Republicans boycotted, demanding that their victorious tally stand. Pelosi (WHO HIRES ILLEGALS FOR HER 20 MILLION NAPA WINERY) was unsympathetic. "There was no mistake made last night," she said. "Apologies were made for the early announcement of the vote," but the early announcement would not have changed the outcome, she added. The select committee, to be made up of three Democrats and three Republicans, will deliver an interim report by Sept. 30, with the final report due by Sept. 15, 2008. "We will make this a priority and get it done," he said. Apparently, like most dem whores, Obama doesn’t get it. The American people elect Presidents, not illegals. But also like the dem whores, Obama, can’t do enough for the invaders. TED KENNEDY: Kennedy simply called in the US CHAMBER OF COMMERCE, AND LA RAZA to generate his OPEN BORDERS bill. Kennedy’s bill is so close to Bush’s heart, that Bush has already signaled that he will sign the bill. Last week Kennedy met with Los Angeles Cardinal Roger Mahoney, characterized as an “outspoken and controversial supporter of illegal aliens”. I wonder if Kennedy EVER met with Mahoney, or any other Catholic priest about the massive priest pedofile problem? The one that cost the Catholic Church billions in legal settlement? I also would wonder if Kennedy EVER met with the families of the victims of the people murdered by illegals, about 12 every day? BILL RICHARDSON, when he decided he was running for President from New Mexico, he turned PRO OPEN BORDERS.
