The people behind Arizona's new anti-immigrant statute have at least one thing right: This mean-spirited law was enacted because the federal government has abdicated its responsibility to address the immigration system's moral and functional failures.
On Sunday, the state's largest newspaper, the Arizona Republic, took the unprecedented step of giving its entire front page over to an editorial making exactly that point. "The federal government is abdicating its duty on the border. Arizona politicians are pandering to public fear," the Republic wrote. "The result is a state law that intimidates Latinos while doing nothing to curb illegal immigration."
Noting that President Obama has delegated his administration's immigration reform effort to Homeland Security Secretary Janet Napolitano, the paper correctly castigated the former Arizona governor for "failure to get the thing out of neutral." The editorial also severely criticized the state's two Republican senators, John McCain and Jon Kyl, for cynically abandoning their commitment to comprehensive reform — the former because he's in a tight reelection race; the latter because he's now a member of the GOP leadership in the Senate.
On Monday, Phoenix Mayor Phil Gordon also called for comprehensive federal action, while calling the measure's supporters "bitter, small-minded and filled with hate."
President George W. Bush tried, with the bipartisan support of McCain and the late Sen. Edward M. Kennedy, to enact comprehensive immigration reform. Obama campaigned on a promise to push the effort through to success, one of the reasons that Latino voters flocked to support him. Wary of further controversy though the Democrats' congressional majority may be, the country has more at stake here than a campaign promise. Like the catastrophic oil spill now spewing pollution into the Gulf of Mexico, Arizona's toxic political contaminant already is spreading.

Missouri and South Carolina are considering bills similar to Arizona's, and legislators in Texas, Ohio, Colorado, Georgia, Utah, Maryland and North Carolina say they plan to introduce such measures. Minnesota's presumptive Republican gubernatorial candidate, Tom Emmer, has called the new law "a wonderful first step."
It doesn't take much imagination to envision what Emmer, who also believes Minnesota should be exempt from any federal law not approved by two-thirds of the state's legislators, and his ilk envision as the next step, which makes it all the more imperative for the Obama administration to act.
In a major address at Fordham University on Monday night, Los Angeles Cardinal Roger Mahony, who has emerged as a national leader in the push for comprehensive reform, called it "a moral imperative."

The prelate argues persuasively that a rational and humane approach to the issue requires recognition of three facts: First, America needs immigrant labor. California's agricultural industry and that of most of the Southwest, and the South, as well as sectors like hospitality and food service, would collapse without it. Second, with or without papers, the overwhelming majority of immigrants come here to work. And, finally, most of the estimated 11 million to 12 million immigrants without papers now live in so-called blended families, at least some of whose members are citizens. An excessively punitive approach to enforcement risks tearing those families apart, at incalculable human cost.
A divisive debate over immigration without the finality of comprehensive reform has the potential to gnaw at the very foundations of our politics. To the extent our two parties continue to configure themselves ever more closely along racial and religious lines, it does insidious damage to the quality of our politics and to the governance they enable. Richard Nixon's successful "Southern strategy" had the unintended consequence of turning the party of Lincoln, in many voters' eyes, into the national white people's party. Democratic myopia concerning the growing economic distress of working-class white males, and to the social values engendered by their traditional religiosity, often has made the party of Roosevelt appear elitist and out of touch.

Legislative guerrilla warfare over immigration, fought out state by state, will further poison the superheated atmosphere leading to the midterm election in the fall. Even where it succeeds as a so-called wedge issue, immigration treated in the fashion of Arizona will alienate even greater numbers of Latinos from the GOP, much as Proposition 187 did in California 16 years ago.

Significant as such long-term political considerations may be, they're lesser matters when compared with the human costs of having 10 million or more of our workers labor and live as helots along society's margins, a place where there is neither safety nor security — or to the rampant discrimination against American Latinos that enforcement of Arizona's statute or its clones inevitably will entail.
Just as the disastrous Gulf of Mexico oil spill has to be contained at the wellhead, this is an issue that only can be addressed rationally and humanely in Washington. Comprehensive immigration reform is the Obama administration's unavoidable responsibility, and the president and those around him should be judged harshly if they fail to take it up now.

Napolitano: Spillover Violence in Arizona is Mere “Perception”
Testifying before the Senate Judiciary Committee last week, Homeland Security Secretary Janet Napolitano played down the violence along the border, stating that “[Arizona] is a place where there is a perception that there is spillover violence.” (Webcast, April 27, 2010, emphasis added). Remarkably, Napolitano made the statement just seconds after she noted that the drug cartels “literally have fingertips that go into communities all over the nation” and that Phoenix has been the center of “battles” between drug cartel distributors. (Id.) Still, Secretary Napolitano seemed to dismiss the seriousness of the violence, insisting that “the plain fact of the matter is from a numbers perspective, the numbers at the border have never been better.” (Webcast, April 27, 2010).
During the hearing, Senators from both sides of the aisle expressed serious concern about increasing border violence. Chairman Pat Leahy (D-VT) said, “[W]e are experiencing historic levels of drug related violence that must be brought under control – families being murdered, law enforcement being murdered, officials being murdered, and brazen shoot outs.” (Webcast, April 27, 2010; See also Leahy’s Written Statement, April 27, 2010). Committee Ranking Member Jeff Sessions (R-AL) echoed his words: “The violence…is increasing and is a serious threat to law abiding people. In Arizona and other places along our southern border, the power of these drug cartels is very real. The power of the coyotes who bring people in illegally is very real, and it’s got to be confronted in a very serious way.” (Webcast, April 27, 2010). And when pressed by Senator Sessions about the need to help local law enforcement officials combat this violence, Napolitano -- who has been an outward critic of Arizona’s new immigration law -- responded, “[I]n my judgment, what we need to be doing is working with local law enforcement so that you have combined and leveraged federal resources with local. (Id.)
Napolitano’s comments before the Judiciary Committee came after a string of violence near the border involving U.S. citizens. Just 45 days earlier, drug cartels executed a gruesome murder of three people with ties to the U.S. Consulate in the Mexican border city of Ciudad Juarez (FOX News, April 6, 2010); 36 days earlier her own department issued a safety alert to law enforcement officers in west Texas warning of retaliatory killings by Mexican “assassin teams” (See FAIR’s Legislative Update, April 12, 2010); and exactly one month prior, Arizona rancher Rob Krentz was murdered near the U.S.-Mexico border by a suspected illegal alien (See FAIR’s Legislative Update, April 5, 2010). Four days after the hearing, an Arizona sheriff’s deputy was ambushed and shot by illegal aliens with an AK-47 about 50 miles south of Phoenix. (The New York Times, May 1, 2010) The encounter led to a massive manhunt in which Arizona law enforcement deployed scores of officers and dispatched helicopters to search a 100 mile radius. (Id.)
Napolitano’s suggestion that the southwest border is more secure than ever was likely meant to lay the groundwork for a mass amnesty. In fact, her comments came in response to a question from Chairman Leahy in which he asked “Can we do both things? Secure our border, and have comprehensive immigration legislation?”(Webcast, April 27, 2010). Napolitano’s answer: “[C]omprehensive immigration reform should be in our sights.” (Id.).

WASHINGTON (AP) — The Obama administration has met many of the border security benchmarks Congress set in 2007 as a prerequisite to immigration reform and now it's time to change the law, Homeland Security Secretary Janet Napolitano said Friday.
Napolitano, designated by President Barack Obama to lead the administration's immigration reform efforts, said many members of Congress had said they could support immigration reform, but only after border security improved, Napolitano said.
"Fast forward to today, and many of the benchmarks these members of Congress set in 2007 have been met," she said in a speech to the Center for American Progress, a liberal think tank.
She cited construction of 600 miles of border fence and the hiring of more than 20,000 Border Patrol agents. Illegal immigration has also fallen sharply because of better enforcement and the economy.

"I've been dealing hands-on with immigration issues since 1993, so trust me: I know a major shift when I see one, and what I have seen makes reform far more attainable this time around," Napolitano said.

Congress passed tough immigration enforcement legislation in 2006 that called for building 700 miles of border fences and barriers. Immigration critics have said the fence has not been built with double layers as the law required and is not all fencing.

Napolitano Urges Action on Amnesty in 2010, Falsely Claims Progress in Fighting Illegal Immigration
In an address before the pro-amnesty Center for American Progress (CAP), Secretary of Homeland Security Janet Napolitano signaled the Obama administration’s support for legislation that would include amnesty for current illegal aliens and increases in the overall flow of immigration into the U.S. Napolitano also expressed support for improved immigration enforcement — despite actions taken by her department that have dramatically curtailed enforcement.
In her Nov. 13 speech, Napolitano described the administration’s vision of immigration reform as a “three-legged stool.” The legislation must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here,” she said.
Acknowledging that previous attempts to enact amnesty for illegal aliens have been hampered by a lack of public confidence that the government would act in any meaningful way to prevent future illegal immigration, Napolitano sought to assure the public that this time things would be different. She asserted that “the security of the Southwest border has been transformed from where it was in 2007.” Furthermore, the transformation has not been limited to the border, she claimed. “[W]e’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
Based on these claims of improved enforcement, Napolitano urged Congress to move ahead with amnesty for illegal aliens and increases in the admission of both family- and employment-based immigration. “We need Congress to create the legal foundation for bringing the millions of illegal immigrants in this country out of the shadows,” said Napolitano. “We need carefully crafted programs that allow American businesses to hire needed foreign workers,” she continued. “Our immigration system is outdated where families are concerned, and we need to modernize and streamline the laws governing this process.”
While amnesty for illegal aliens and increases in government regulated immigration would not be justified even if the administration actually were enforcing immigration laws as they claim, the facts demonstrate that they are not. In fact, as FAIR has repeatedly pointed out, the Obama administration has systematically weakened all aspects of immigration enforcement, and there is no reason for the public to feel confident that promises of future enforcement would be kept.
America’s borders are anything but secure. By the Department of Homeland Security’s (DHS) own admission, a mere 894 miles of border or coastline are under “effective control,” out of the total 8,607 miles that the department is charged with protecting. Moreover, DHS has no plans to secure even one additional mile during the current fiscal year.
There has also been dramatic regression in virtually all areas of interior immigration enforcement under Napolitano’s leadership. According to DHS data released on Nov. 18, arrests, indictments and convictions of immigration law violators have all fallen by more than half during 2009. [See sidebar story.]

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

E-Verify- the single most successful federal program aimed at keeping illegal immigrants out of the workforce- is once again threatened. This time, E-Verify was stripped from a Senate Amendment behind closed doors and without explanation. Instead of becoming a permanent program E-verify has been reduced to only three years. Another victory for American workers in Arizona. Yesterday, the Ninth Circuit Court of Appeals upheld the get-tough employer sanctions law in the state. The law hits employers who knowingly hire illegal aliens with strict penalties and in some cases even strips businesses of their licenses. A lower court upheld the same law in February. But open-borders and amnesty groups along with the business lobby are considering yet another appeal.

Construction of the 670 miles of border fence mandated by the Bush administration is almost complete. The Border Patrol says the new fencing, more agents and new technology
have reduced illegal alien apprehensions. But fence opponents are trying to stop the last few miles from being finished. We will have a full report, tonight.


Plus, even open border advocates agree that the most effective way of fighting illegal immigration is to crack down on the employment of illegal aliens. Yet, those same groups are
opposed to E-Verify, which has an initial accuracy rate of 99.6% making it one the most accurate programs ever. E-Verify was stripped from the stimulus bill but who stripped it out and who is opposed to verifying employment status is still not clear.
