Attorney General Holder and President Obama’s “Commitment” to Open Government

Attorney General Holder’s words are an empty promise. Judicial Watch reported on the Office of the Attorney General’s apparent inability or refusal to comply with FOIA as it pertains to Khalid Sheikh Mohammed. Unfortunately, this “practice” is not an isolated incident. The Associated Press reported statistics about the Freedom of Information Act that even Eric Holder recognizes as “troubling.” Nonetheless, his office continues to be one of the more egregious offenders of the spirit of transparency and the statutory requirements of the FOIA.
Despite the law requiring a response in 20 days, more than a year has passed and Holder’s office has refused to comply with Judicial Watch’s FOIA requests pertaining to firearms, including one on the unlawful transfer from the United States to Mexico, by simply ignoring the requests, phone calls, and letters. One particular request resulted in three mere pages of documents referred to the Attorney General’s Office nearly a year ago, but that Holder’s office has failed to disclose.
A second request pertaining to firearms seeks information on President Obama’s firearm policies and legal interpretation of the Second Amendment with respect to regulation and enforcement actions. During his campaign, President Obama touted himself as a Constitutional scholar who supported “institut[ing] some of the common-sense gun laws.”1 A year into his Presidency, the public may be wondering whether the clear refusal to make the policies transparent is a sign of incompetence, an inability to formulate a common sense policy, or obfuscation concerning his intentions with respect to the Second Amendment.
The third request pertains to the Administration’s estimation that the majority of firearms used in Mexico’s violence can be traced to the United States.2 Several organizations have disputed the estimate noting that the majority of the guns in fact cannot be traced.3 The Attorney General’s Office will not even respond as to whether records exist.
President Obama and Attorney General Holder’s rhetoric on matters pertaining to “transparency” and the FOIA have consistently failed to represent their actions and policies. The Obama administration may “talk a good game,” but the Administration’s documented performance as a trusted servant of the people has been abysmal.
