We need your help.



The Colorado Senate last week approved Senate Bill 11-126

to give in-state tuition rates to illegal alien students. The bill would give illegal aliens a financial advantage at the expense of American students whose families are struggling to put their children through school. There are only so many admissions, so each illegal alien admitted would displace a qualified American student.







The bill has been assigned to the Colorado House Education Committee .











ACTION ITEMS







The bill will be heard by the Education Committee on Monday, April 25, 2011, at 1:30 in the Old Supreme Court Chambers in the State Capitol.







1. Go there Monday and testify against the bill! Why? Your testimony will publicly oppose the bill. It will place on-record facts that clearly show the bill is in violation of Federal and Colorado law (more info below).







There are very few chances to make a difference in the legislature each year. This is one of them. The committee is the only place where testimony will be heard. You can make a difference.















2. Call and email. The House Education Committee consists of the following Representives. Do call and/or email them. But keep in mind that on this short notice, public testimony on the bill is really the best way to make your opinion known.

* SB11-126 violates current Colorado law - HB03-1224 and HB06S-1023 and also the spirit of SB06-090 by creating a new sanctuary for illegal aliens.







House Bill 1224, passed in 2003, is the Colorado Secure and Verifiable ID Act.



House Bill 1023, passed in 2006, requires each applicant who applies for public benefits to affirm that they are lawfully present in the county.



Senate Bill 90, passed in 2006, disallows sanctuary cities for illegal aliens.







* SB11-126 is dishonest in its title because there is no such thing as "unsubsidized in-state tuition." In fact, out of state tuition and foreign student tuition does not cover the full per-student cost of providing the buildings and support staff and support services of any one of our research universities. Full tuition at a two-year community college does not cover the full per-student costs of that institution. The hidden subsidy ranges from 20% to over 70%.







* The Fiscal Note attached to the bill is dishonest because it estimates that only 400 students may take advantage of the bill each year. Yet Pew Hispanic Center data reveals there are 228,000 Hispanic children in Colorado. If only 15% of them are illegal, there would be at least 34,000 illegal Hispanic children in K-12 education, plus at least 5,000 non-Hispanic illegal alien children. If only 60% of those 39,000 students complete high school and 50% of that group apply for college, there will be over 11,000 students taking advantage of this new public benefit over the next decade - not 400.







* SB11-126 would give illegal aliens a financial advantage at the expense of American students whose families are struggling to put their children through school. There are only so many admissions, so each illegal alien admitted would displace a qualified American student.







* Even with an in-state degree, it will still be illegal for illegal aliens to work in the United States.







* The bill says that for an illegal alien student to quality, they must first apply for legal status. Yet no federal law provides for such mass legalization of illegal aliens.







* SB11-126 clearly violates existing federal law, which stipulates that if you grant in-state tuition to an illegal alien, you must also grant that same tuition to all US citizens. Thus, the bill, if enacted, will be challenged not only in state courts but in federal courts.







* Open borders radicals oppose state-based immigration sanity legislation, saying "it's a Federal problem". Yet now they are trying to pass state-based educational benefits for illegal aliens.







* SB11-126 will encourage illegal aliens fleeing states like Arizona, Oklahoma and Georgia to come to Colorado for "entitlements" and benefits which citizens in Colorado would pay for.







* The bill penalizes those who have stood in line to become American citizens in favor of those who snuck into our country and evaded capture at our border. As such, it is inconsistent with representing the interests of the people of Colorado, and the interests of our Federal immigration laws.
