House Immigration Subcommittee Holds Hearing on HALT Act
On Tuesday, the House Judiciary’s Subcommittee on Immigration Policy and Enforcement held a hearing on H.R. 2497, the “Hinder the Administration’s Legalization Temptation” or “HALT” Act. The HALT Act, introduced by Judiciary Chairman Rep. Lamar Smith (R-TX), would suspend President Obama’s use of “prosecutorial discretion”—the ability of the executive branch to decline to enforce immigration law against individuals—by preventing him from:
  • Granting deferred action, parole, or extended voluntary departure to illegal aliens other than those being tried for a crime or acting as a witness at trial, those needed for significant law enforcement or national security purposes, or those whose life is imminently threatened (§§2(b), 2(f));
  • Waiving the three and ten year bars to admission for aliens who have been illegally present in the U.S. (§2(a));
  • Cancelling the removal and adjusting the status of illegal aliens ordered deported (§2(c));
  • Designating additional countries as qualifying for Temporary Protected Status (TPS) (§2(d)); and
  • Granting work authorization to illegal aliens (§§2(e), 2(g)).

Rep. Smith outlined the need for the HALT Act’s  restriction of the Obama Administration’s use of prosecutorial discretion in his opening statement. “What had once been rumor fueled by leaked administration memos is now official Department of Homeland Security (DHS) policy as of last month,” he said referencing two June 17th, 2011 memos issued by ICE Director, John Morton, authorizing ICE personnel to decline to enforce immigration laws against certain classes of illegal aliens, such as those who would qualify for amnesty under the failed DREAM Act. (See FAIR’s Legislative Update, June 27, 2011) “Unfortunately, the ICE memos make clear that DHS plans not to use but to abuse these [prosecutorial discretion] powers. If the Obama Administration has its way, millions of illegal immigrants will be able to live and work legally in the United States. This unilateral decision will saddle American communities with the costs of providing education and medical care to illegal immigrants.”
Several witnesses testifying before the Subcommittee agreed with Rep. Smith’s call for limiting the Administration’s authority, expressing concern that the President is bypassing Congress. Senator David Vitter (R-LA), author of the Senate version of the HALT Act (S.1380), asserted in his written testimony: “In 1996, Congress clearly limited the Administration’s parole authority to be used ‘only on a case-by-case basis for urgent humanitarian reasons or significant public benefit. However, these memos make clear that DHS plans to abuse these powers to grant mass legalization without any Congressional authorization.” (Testimony of Sen. David Vitter, July 26, 2011) Likewise, Jessica Vaughan, Director of Policy Studies at the Center for Immigration Studies, stated that forms of relief granted through the use of prosecutorial discretion is “designed to be used for exceptionally compelling cases, and were not intended as a way for the President, his appointees, or government staff to bypass Congress and its unique authority to make immigration law.” (Testimony of Jessica Vaughan, July 26, 2011)
Chris Crane, President of a national ICE union representing roughly 7,000 employees, also testified in support of the HALT Act, describing the problems caused by the latest string of Morton memos. “The purpose of this policy is to prohibit officers and agents from arresting individuals from certain groups... From an enforcement standpoint, the biggest dilemma facing officers and agents in the field may be how to apply the policy to the hundreds of thousands of aliens encountered each year.” (Testimony of Chris Crane, July 26, 2011) Last summer, the union Crane represents issued a vote of no-confidence in ICE Director John Morton, and former Assistant Director of the ICE Office of Detention and Policy and Planning, Phyllis Coven. (See FAIR Legislative Update, Aug. 9, 2010)
Margaret Stock, the only witness who opposed the HALT Act, alleged, “Our immigration system is dysfunctional and irrational, and the situation only promises to get worse without comprehensive action by Congress.” (Testimony of Margaret Stock, July 26, 2011) “Our nation’s ever more complex and restrictive legal immigration system makes it nearly impossible for most people to immigrate to the United States legally, and provides no means for people to enter or stay in the United States legally in many compelling circumstances,” she added. (Id.) Ms. Stock, an adjunct professor and retired army colonel, also testified before the Senate Judiciary Committee in support of the DREAM Act last month.

Obama’s 2012 budget deepens attack on public education

The proposed fiscal year 2012 federal education budget is an escalation of the Obama administration’s war on public education and teachers. The White House is expanding its policy of forcing states to compete for desperately needed funds, insisting that they remove caps on charter schools and attack the living standards and workplace rights of school employees in the name of “cost-effectiveness.”

The overall proposed education budget for FY 2012 is $77.4 billion, including what the White House is celebrating as a “significant increase for K-12 education” and “tough choices,” or rather cuts, “to put the Pell Grant program on a sustainable fiscal path.” The woefully inadequate increase will be distributed through competitive grants and, as the budget proposal states, to fund collaboration with for-profit businesses.

Highlights of the proposed budget include:

  • $26.8 billion to the Elementary and Secondary Education Act (ESEA), which will direct funds to “reform-oriented competitive initiatives,” consolidate dozens of programs, and cut programs that do not “demand results.” This includes $372 million for charter schools, and $300 million for the Investing in Innovation (i3) program, which rewards partnerships with the private sector.

In other words, the federal government is escalating its program of looting the public treasury to give money to powerful business and “philanthropic” interests that run charter schools. The proposal also continues the unfair use of standardized test scores to determine whether schools are deserving of federal funding.

  • Foster “productivity by encouraging states and districts to enact education reforms that are more cost-effective.”

The terms “productivity” and “cost-effective” are code words for the intensified exploitation of teachers and other school employees. States and districts that enforce mass layoffs of school personnel will be rewarded with funding for these cost-saving measures. Employees who are not laid off will be forced to do more with less, take on work once performed by their colleagues, and cope with larger class sizes.

Cost effectiveness is also achieved through school consolidations; districts desperate to save money close schools and move displaced students into buildings that are already filled to capacity. In cities across the country, teachers work in dangerously overcrowded classrooms, leading not only to impossible teaching conditions, but also an unsafe and unhealthy environment.

  • $2.5 billion investment in an overhauled teacher-quality formula grant and $500 million in the Teacher and Leader Innovation Fund. The latter is intended for districts “willing to implement bold approaches to improving the effectiveness of the education workforce in high-need schools by creating the conditions needed to identify, reward, retain, and advance effective teachers, principals, and school leadership teams.”

This program encourages schools to hire newer, less expensive teachers, driving better paid, more experienced teachers with seniority rights out of the classroom on the basis of false claims that they are “burnouts.” The inclusion of the concept of rewarding “effective” teachers is just another way of promoting merit pay for teachers whose students score well on standardized tests.

  • $600 million for School Improvement, or Turnaround, Grants (SIG) “to support the Administration’s commitment to helping states and districts turn around our nation’s lowest performing schools.” This represents a $54 million dollar increase from 2010 levels.

Turnaround grants are a ruthless means to punish schools in the nation’s poorest districts for failing to get students to score well on standardized tests. Schools that fall into this category are forced to choose a “turnaround model”: fire the principal and half the teaching staff, convert the school to a charter, or simply close. Only after implementing one of the first two options is the school provided with desperately needed funds to hire staff and purchase resources.

  • $90 million for a “new Advanced Research Projects Agency-Education (ARPA-ED)…that would promote dramatic breakthroughs in educational technology,” such as adaptive online tutors.

This will further the government’s agenda of promoting “cost-effectiveness” through the creation of software that will replace expensive human teachers with online education. It will also be another boondoggle for private businesses.

  • The Early Learning Challenge Fund, proposed in 2009, will be rolled into Race to the Top (RTTT) in the amount of $350 million in competitive grants in 2012. Eligibility requires that states be “ready to take dramatic steps to improve the quality of their early childhood programs,” including the development of uniform standards, a quality rating system, and a system of program review, monitoring, and improvement.

Just as in K-12, ECE educators will be forced to “teach to the test,” and program quality will be based on faulty test scores. Programs deemed failing under the flawed constraints of the system will be “reformed.”

  • $150 million for Promise Neighborhoods, an initiative that claims to support community and family services, and “rigorous comprehensive reforms to improve the educational and life outcomes for children and youth in high need communities.” Promise Neighborhoods was inspired by Geoffrey Canada’s Harlem Children’s Zone project, touted in the pseudo-documentary, Waiting for Superman. Nearly all Promise Neighborhoods fund charter school start-ups.

Officials from other capitalist regimes, who have come to tour Promise Neighborhoods, are exuberant over this funding model for poor communities. The far-right government of Hungary, for example, plans to replicate this model in oppressed and discriminated Roma communities, in an effort to starve their public schools of funds.

Obama’s 2012 budget claims to help “students with disabilities achieve their full potential.” One important aspect of this is a new $30 million pilot program—PROMISE—that will “develop and evaluate innovative approaches to improving outcomes of children receiving Supplemental Security Income [SSI] and their families.”

The program will divert public money from social services agencies to private companies that provide cheaper services. The claim that services provided by for-profit companies will lead to better chances for the disabled to live independently is absurd.

Pay for Success is modeled after the UK’s pilot program, Social Impact Bonds, which the British government describes as a means of attracting “private sector investment for interventions that will achieve better outcomes and lower government costs.” The goal of both the US and UK versions is to funnel public tax dollars into the hands of private profiteers, while simultaneously creating the rationale for stripping countless disabled people of SSI benefits.

The Obama budget will also drastically alter financing for public higher education, including extending competitive funding, imposing rules changes for teacher education programs that will result in the shutting down of countless education colleges, and enacting major cuts to the Pell Grant program, which provides poor and working class students with financial aid to attend college.

Both major political parties are exploiting the crisis in public education, which has been deliberately created through decades of financial starvation and punitive policies, in order to privatize America’s school system. In so doing, they reward their campaign contributors in the private sector with opportunities to make massive profits by giving them access to public educational funds that were previously outside of their reach.

For decades, Republican administrations have sought to enact draconian reforms in public education, but their policies were met with mass public resistance. Now, the Obama administration and the Democratic Party, with the collusion of the trade union apparatus in the American Federation of Teachers and the National Education Association, are successfully enacting these and even more right-wing policies.

Obama DOE: America’s Progress Depends On Latinos

America’s progress is “impossible” if Hispanics keep lagging in education because their success is of “immediate and long term importance” to the U.S. economy, according to a new Obama Administration report that vows to enhance opportunities for the “Latino community.”

Published this week by the Department of Education, the enlightening document (Winning the Future; Improving Education for the Latino Community) says that the success of Hispanics in education and in the labor market is crucial to the nation’s economy. The information comes as the president launches a full-throttle campaign pandering to immigrants and their liberal advocates. It was also conveniently released to coincide with Obama’s junior college commencement speech today in Miami Florida, which has an immense Hispanic population that includes many illegal immigrants.

Tragically, Hispanics have the lowest education attainment level of any group in the country, which means that the nation’s economy is at stake if you believe the Obama Administration’s argument. That’s because Hispanics face “persistent obstacles to educational attainment.” Those include low enrollment in early learning programs, dismal high school graduation rates and the fact that few Hispanics complete graduate or professional degree programs.

This is unacceptable since Latinos (the report uses Hispanics and Latinos interchangeably) are by far the largest minority group in the American public education system, according to the DOE. More than 12.4 million Hispanics are enrolled in U.S. elementary, middle and highs schools, which accounts for about 22% of all students in the taxpayer-funded system.

“Hispanic students have graduated at lower rates than the rest of the population for years, making America’s progress impossible if they continue to lag behind,” according to Juan Sepulveda, the community activist Obama appointed to run the White House Initiative on Educational Excellence for Hispanics. “Strengthening and improving educational excellence in this community isn’t just a Hispanic problem,” he added. “It’s a challenge to the entire country.”

Sepulveda, who claims that Latino education attainment is important in the global contest for jobs and industries, was rewarded with his cushy DOE job after serving as chair of Obama’s presidential campaign in Texas. Truth is that the DOE, created by Jimmy Carter, is largely viewed as an unnecessary federal agency that interferes with public education, which is supposed to be run by states.

Before joining the Obama Administration Sepulveda ran a well-funded Texas nonprofit that works to reduce “cultural tensions” by doing things like creating a “bi-national community” in the San Diego/Tijuana border area. Part of his education initiative includes developing the next generation of Latino teachers with “minority-serving institutions.”

"As you listen to the news about the student protests over illegal immigration, there are some things that you should be aware of:  I am in charge of the English-as-a-second-language department at a large southern California high school which is designated a Title 1 school, meaning that its students average lower socioeconomic and income levels.  Most of the schools you are hearing about, South Gate High, Bell Gardens, Huntington Park, etc., where these students are protesting, are also Title 1 schools.  Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll -- but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK)  I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK)  I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK)  I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears.  Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

Never underestimate Mexico’s or the Mexican’s contempt not only for our borders but for our laws.

The sad thing about the American people having to pay so much for the education of the illegals, is that this generous “gift” does not impact the racist attitudes of the Mexicans, or the notion instilled in them by their own government of entitlement. And then you have the Mexican contempt for English, and literacy.

Meanwhile there is no money left to properly education the children of Americans.

Mexican Kids Cross Border Daily For Free U.S. Education

The superintendent of a Texas public school district has deployed staff members to a nearby border crossing to intercept hundreds of Mexican children who enter the U.S. daily to receive a free public education at one of his schools.

For years, Mexican children from nearby Ciudad Acuna have crossed a bridge north to attend public schools in Del Rio Texas as administrators and immigration officials looked the other way. Meanwhile U.S. taxpayers pick up the nearly $3 million annual tab to educate the Mexican kids whose parents have no regard for the nation’s laws.

Finally, the new superintendent of the depleted district (Del Rio Consolidated Independent School District) is working to end the costly practice. He has sent district employees to monitor the border crossing that connects Del Rio with Mexico and inform Mexican parents that essentially the gravy train has come to an abrupt halt. 

The district has an enrollment of 10,232 students in 12 schools and more than 500 are believed to live south of the border. They used fake U.S. addresses to enroll illegally, according to district officials, and some walk over the border bridge while others simply have their parents drive them in vehicles with Mexican license plates. 

“I’ve seen van loads of kids with plates from Coahuila State (Mexico) pulling in front of the school,” Del Rio Superintendent Kelt Cooper told a major news organization. “Everyone knows what is going on. It’s real blatant.

Cooper decided to take action because immigration authorities recently submitted a report to the district revealing that about 540 school-age children cross the bridge every morning. Cooper dealt with a similar situation as the superintendant in the border town of Nogales Arizona where he once caught dozens of students who used the same vacant lot as a home address.

So far nearly 200 Del Rio students have been informed that they must prove residency to stay in school. In most cases parents were handed letters at the crossing bridge warning that their children will be expelled from school unless they immediately provide proof that they live in the United States.

ON EDUCATING THE ILLEGALS: Ever wonder why Mexico doesn’t educate their own people?

Worse public schools. America’s public schools already suffer under severe budget constraints, causing large class sizes, textbook shortages, and leaky ceilings. Yet, US law requires that all illegals receive free public education K-12. The Federation for American Immigration Reform estimates that this costs $7.4 billion dollars each year.

The birthrate among illegals is more than double that of legal US residents. The Pew Hispanic Center calculates that within seven years, the children of immigrants, legal and illegal, will account for one in nine school-age children in the US. The Urban Institute estimates that already, 15% of all school children in California are illegals, many of whom speak little English. These students are usually mainstreamed in classes with native English speakers. This means that teachers must slow down instruction, denying native English speakers their right to an appropriate-level education.

The challenge is even greater because not all those students’ native language is Spanish: For example, in my nearest major school district, San Francisco, it would not be unusual to find a class that had native speakers of Chinese, Russian, Tagalog, Spanish, and English. Imagine the challenge of trying to educate them all. If your child were in that class, would you be confident that he or she would receive a quality education?

Immigrant children pose less obvious challenges to the schools. Barbara Nemko, the Napa County Superintendent of Schools, points out examples: “Unless she speaks Spanish, we have a hard time justifying hiring an even an excellent teacher… So much of our staff development
time must now be allocated to dealing with the needs of ‘English Language Learners.’ Our immigrant kids also come to school with serious health problems that we must address. For example, dentists now visit our high-immigrant schools providing dental services at no
cost to the student.”

MALDEF and La Raza also pushed through legislation that allows, in 19 states, illegal immigrants to not only attend any public university in those states, but to pay in-state tuition, while legal residents of neighboring states must pay the out-of-state rate which is three to eight times more. It’s quite an injustice, for example, that a legal resident can be denied admission to taxpayer-supported Berkeley and must attend community college so an illegal foreign national can attend Berkeley—at in-state rates! And often, because of reverse discrimination admission
policies, the illegal is admitted with B grades while the rejected legal resident may have Agrades.

Senate’s DREAM Act is win-win for immigrants and the US

During a firefight in 2003, near Umm Qasr, Iraq, Lance Cpl. José Luis Gutierrez became one of the first American casualties of that war. Ironically, Cpl. Gutierrez was not an American citizen when he died. He was a lawful permanent resident, born in Guatemala, who came to the United States illegally a few years before.

Cpl. Gutierrez was not alone. Hundreds of thousands of non-citizens fight in our military. And hundreds of thousands more want to serve our nation, which they love as their own. But they can’t, because their parents brought them here illegally, and, unlike Cpl. Gutierrez, they aren’t fortunate to qualify for one of the very few routes to legalization that exist. Others dream of teaching children with disabilities or becoming doctors or entrepreneurs. But their immigration status won’t allow it. As a nation, we are also missing out on their vast potential to contribute.

Recently, I joined Sen. Dick Durbin (D-Ill.) to reintroduce the DREAM Act, which would give these young people the opportunity to serve under our flag as Cpl. Gutierrez did. If these young people came to the country before age 16, have lived here at least five years, graduate from high school, stay out of trouble and serve at least two years in the armed forces, or complete two years of college, they would be eligible to become lawful residents. This would apply only to those already here.

This is not a gift. These young people would have to earn their legal status by meeting very tough criteria. I also believe children should not be punished for the misdeeds of their parents; most Americans would agree with me. 

Some ask, why reintroduce the DREAM Act when House Republicans would never pass it? Even in the Senate, Republicans solidly oppose it. Well, giving up is not in my lexicon. There are hundreds of thousands of these young people, DREAMERS, as they rightly call themselves, who burn the midnight oil over a physics textbook, or are doing their drills at their high school’s ROTC. They are not tossing their books or their uniforms in the trash because Republicans say no. These kids aren’t giving up, and neither will I.

Many do not remember the country where they were born; many do not even speak the language of their native land. They are American in all but a passport, much like Cpl. Gutierrez, who was just a kid when he crossed the border.

We also introduced the DREAM Act because the only way to move forward is by having a proposal on the table. If my Republican colleagues have suggestions or concerns, Sen. Durbin and I have an open door. If they sympathize with the plight of these children and want to help, let’s talk, let’s improve the bill and work in a bipartisan fashion. Remember, this bill was originally co-authored by a man with solid conservative credentials, Sen. Orrin Hatch (R-Utah).

He saw the DREAM Act as sound policy. The Pentagon supports it because it would help meet recruitment objectives. Economically, DREAM Act students would contribute about $3.6 trillion to the U.S. economy over their working lives. There are other benefits: stable communities, role models, job creators. Economists who have looked at immigration know it is not a zero-sum game, as opponents inaccurately say, but a growth engine. Further, these young people are already here. Sending them back would actually cost us money, and we would lose talents that could be perfected to our nation’s benefit.

Republicans know all this. So I ask my colleagues who have voted for this bill in the past to show courage; to shake off their fear of the Tea Party and the extreme right. I ask courage from those Republican senators who represent states with large immigrant populations such as Nevada, Florida, Arizona and Texas. Last time we voted on this bill, 90 percent of Democrats supported it and only three brave Republicans out of 42 joined us. I don’t expect 100 percent Republican support, but how about 30 or 40 percent of their caucus? 

These young people are not afraid, and they are not giving up; neither should we. That is what our nation expects of us.

I've been at the immigration reform and enforcement table for about 20 years. I've worked with activists during all those years. But last week, in Los Angeles, I had a first-time-ever experience at an activist brain storming session.



Gathered for an update on Stop AB131, the petition drive to gather signatures to force a ballot initiative as to whether the California taxpayers should fund college grants to illegal aliens, I asked the top activist leaders from Southern California how the signature drive was going.



They started updating me with the positive response from California residents who signed the petitions, but then admitted about 500,000 more signatures were still needed. When I said there was only a little more than three weeks to go to meet the January 5th deadline, suddenly their faces dropped at once, and the room went completely silent.



It was easy to read on each of their faces; the task was nearly impossible! Without big money to pay signature gatherers or a tsunami of petitions flooding in, the taxpayers of California will be forced to give grant money to illegal aliens for college, on top of the $22 billion they are spending annually in California to support the illegal alien population.



While all of our minds were racing and searching for suggestions as to how to accomplish this daunting task of gathering signatures, Lupe Moreno, long time Hispanic leader from Santa Ana, said "Can we have a prayer?" Everyone agreed to pray.



As the prayer went around the table, people expressed their sorrow for the lack of leadership in the State of California and in the nation to protect the interest of American citizens, and asked for divine guidance in helping them understand the harm their policies are inflicting on millions of innocent people in the state. In all the years I have worked on this issue, I had not witnessed the sort of sincere emotion that was expressed in that room.

You see, the politicians in California are happy to give money the state doesn't have to illegal aliens to attend college, while they cut the budgets and slash programs for public safety, right and left. The American citizen's interests and safety are simply collateral damage for seeking and appealing to the illegal alien lobby.



These activists in California have already learned what the rest of the nation is about to learn. We the people. . . are the only ones looking out for the best interest of American citizens. With few exceptions, we have no national leadership on the issue of stopping the illegal migration flow into our nation.



American citizenship or the benefits thereof have become a commodity for politicians to pander and barter away. They will grant de facto citizenship through sanctuary policies, in-state tuition, non-compliance with Secure Communities, grants for college, etc., etc., etc. President Obama and most the Republican presidential hopefuls are peddling various versions of amnesty proposals if they are elected next year.



What do these politicians want in return? They are hoping to leverage enough votes in key states to put them over the top in 2012, no matter what it costs the American people. This is futures betting: The politicians are gambling the nation's future in hopes of winning the next election.



So while the state can't afford to pay its bills or provide decent services to citizens, these California activists watch their elected leaders lavish still more benefits for people who don't have a legal right to be in the country. And while their child might have to pay out-of-state tuition to go to college in another state, thousands of illegal aliens are going to college at in-state tuition rates in California that they are subsidizing.



In addition they know that millions of other illegal alien parents are receiving food stamps, Medicaid, housing assistance and dozens of other state and local benefits for their American-born children, while they have to decide which bills will be paid this month and which will have to wait.

Unless you commit a violent felony, the state leaves you alone. Los Angeles Special Order 40 – a sanctuary policy that sets the tone statewide - prevents local officers from inquiring about your immigration status.

Many “visitors” head straight for Central Valley, which depends on a combination of immigration and irrigation to produce almost 8 percent of America’s total agricultural output. You’ll be in good company because more than half of the farm workers in California have no work authorization.

Of course don’t forget in-state tuition for illegal aliens. Take advantage of the Dream Act in a place that can only be described as the Dream State for Illegal Aliens.

An illegal immigrant crossing the border anywhere between Nogales, Arizona and the hills east of San Diego is on a quest for "gold" far more substantial than the Spanish explorer Hernando Cortez's quest for gold five hundred years ago.  Cortez died broken and all dreams of gold died with him.

Contrast that with the illegal immigrant who is crossing over the border even as I write this.  Most likely, he's on his way to Los Angeles.  As he and his family traverse the coastal range from San Diego to Los Angeles the government has conveniently posted diamond-shaped yellow signs with the profile of two adults and a child; the sign warns drivers along the I-5 corridor to be courteous and not run them over, as they may be crossing the busy freeway in flight from a Border Patrol unit.  Note: It is far more likely that the illegal is being transported, as "cargo" behind a load of Mexican lettuce in a truck. Let's call that hypothetical family Juan, Juanita and little Jose.  Once they arrive in Los Angeles this illegal family will find a "welcome wagon" of bountiful government and community gifts just waiting for their arrival.  Their first stop will be a store front in a strip mall where, for less than a hundred bucks, they will be furnished with a fake Social Security card and a fake California Drivers license.  They will easily find housing because the Feds, championed by the ACLU, have dictated that it is "racist" to require proof of citizenship before renting your house or apartment.  Next stop will be to raid the local food bank meant to assist impoverished American citizens.  Now firmly established and "legal", Juan and Juanita, after registering little Jose in free public or charter schools, set out to secure employment, using some American citizen's Social Security number. (LA RAZA GOV JERRY BROWN NOW MAKES IT ILLEGAL FOR EMPLOYERS TO USE E-VERIFY!)


Juanita quickly finds a job as a hotel maid.  Her salary and tips amount to $2,000 dollars per month.  Juan, using his illegal contacts, quickly gets a construction job with a home remodeling contractor making $2,000 per month, all in cash, no benefits provided.  On his way home, Juan walks by a Home Depot and notes that illegal day workers are hanging out in the front of the store and learns that the "gringo" county government has mandated that Home Depot provide a restroom, water fountain and air conditioned picnic tables to ease the plight of illegal day laborers awaiting a "pickup".  (Google: Home Depots in Los Angeles ordered to install Day Labor rest facilities, I swear it is true!).  http://www.foxnews.com/story/0,2933,286944,00.html

As Juan and Juanita become more acclimated to their new home country, they quickly learn from their illegal neighbors that there are at least two dozen taxpayer funded financial assistance programs available where the question of citizenship is verboten.  Their neighbors also recommend that Juanita get pregnant right away for that is the route for the real "mother lode" of benefits (ANCHOR BABIES).  It gives the family access to the WIC program, welfare, free medical care under the Medicaid program, racial and economic preferences for low cost university tuition programs and a whole host of taxpayer give-aways. 

                                                          
Soon a year has passed and Juan and Juanita have raked in tens of thousands of good old American dollars.  While during a visit to a Western Union office to send money back to family in Mexico, Juan and Juanita learn from the Western Union operator that there is more "gold" to be had from Uncle Sam; "go over to that Hispanic owned tax office over there", they are urged.  "they will file your tax returns using a W7 (INIT) non-citizen tax filing".  The IRS will then return to you all of your payroll taxes and, as a bonus, will send you a check for thousands of dollars as a Child Tax Credit for little Jose.  You'll also get more money from an Earned Income Credit because the IRS only knows about Juanita's salary" (wink, wink).

Juan, a little cautious, says "won't the IRS report us to ICE?".  "No way!", says their advisor.  By federal law the IRS is not allowed to report tax information or your address to ICE". 

So Juan and Juanita and little Jose are living the good life indeed!  Between Juan's tax-free salary and Juanita's taxable salary and financial freebies from state programs and food banks and  other goody give-aways, Juan and Juanita and little Jose are pulling in over $5,000 dollars per month and don't know what to do with all the money!

After buying a late model SUV, Juan and Juanita are cruising in high style.  Oh sure, Juan's driving is a little erratic since he hails from a small Mexican village and has no driving experience.  His new found illegal neighbors advise him not to be crazy enough to waste money on car insurance.  Very expensive they warn!  So Juan drives L.A. and truly hopes he doesn't have an accident, or god forbid, run over someone due to his driving deficiencies.  But he has now been trained to drive away from any accident because he knows that will surely get his SUV impounded and he'll be pursued in court for human and property damages.

Soon Juanita is pregnant and, as the family awaits the "mother lode" of benefits awaiting them upon the arrival of a "real American citizen", they decide to buy a home.  Soon they learn that the State of California will actually give them $40,000 dollars toward the purchase of a home!  (Google it; it's true!)  Juan and Juanita carefully select a California city that has declared itself a "sanctuary city", which denotes city governments that refuse to comply with E-Verify laws, illegal federal arrest warrants, and vows to protect the poor "undocumented immigrant" at all costs!

Then, Juan and Juanita and little Jose hear about these "radical" gringos who are demanding that they be deported!  Juan and Juanita are very angry!  Who wouldn't be?  They have a huge investment in the continuance of the gravy train and their very wealthy quality of life is threatened!  "By God, we'll take to the streets!" cried Juan and Juanita.  "We'll march by the tens of thousands through the streets of L.A!"   "We'll scare the hell out of those gringos and we'll eventually get amnesty and the gravy train will roll on!" 

"And if that doesn't work, we'll just call anyone who opposes illegal immigration, a racist!"...that'll do the trick.  Their mind at ease, Juan and Juanita crank up the mariachi music another notch and lean back and smile.  Ah "California Dreamin!".
