Texas Latinos poised for no House gains despite population boom, new districts

The boom in the number of Hispanic voters is radically changing the face of American politics, and there may be no better example than Texas, which picked up four new U.S. House seats after the 2010 Census.
But while Hispanics accounted for 65 percent of the state’s population growth between 2000 and 2010, Texas is poised to add no Latino lawmakers to its congressional delegation, after primary elections this week dealt a blow to those hopes.
Originally hailed by Latino leaders as a way to boost opportunities for their community, the newly redrawn Texas congressional map has led to a pair of white Democrats claiming the nominations in districts that were crafted with Latino majorities. The result could be that five of the state’s 36 congressional districts will be represented by Latinos when the 113th Congress convenes in January — exactly the number in the current 32-member delegation. The best-case scenario would have them claiming one-sixth of the state’s House seats.
Latino leaders are split on the developments. Some are dismayed that while Latinos account for 38 percent of Texas’s population, and were key to the expansion of the state’s House delegation, that may not be reflected in a larger Latino presence in the delegation.
“There’s the strong possibility we may get zero,” said Sylvia Romo, the tax collector for Bexar County, who lost her bid for the congressional nomination in a new district stretching from San Antonio to Austin. “We got four [new seats], and we Latinos could end up with zero.”
Others suggest that it is up to candidates and campaigns to take advantage of the new demographic reality. Nine of the 36 Texas seats next year will be from Latino-majority districts.
“The purpose of increasing Hispanic political opportunities is not about sending more Hispanics to Congress. I don’t know why people think that way,” said Nina Perales, a lawyer at the Mexican American Legal Defense and Educational Fund (MALDEF). “It’s about increasing the voice of Latino voters. They can elect whoever they want.”
That increased Hispanic voice could help former state solicitor general Ted Cruz, a Cuban American, who forced Lt. Gov. David Dewhurst into a July 31 runoff for the Republican nomination to the U.S. Senate. That race will probably determine the state’s next senator, given Texas’s GOP tilt. Cruz would be the first Hispanic senator from Texas.
However, Texas will probably send three white Democrats from House districts that have a majority of Latino voters, including the new 35th District, where Romo was trounced by nine-term congressman Lloyd Doggett, and the 16th District in El Paso, where Robert “Beto” O’Rourke defeated eight-term congressman Silvestre Reyes in Tuesday’s Democratic primary.
In the new 34th District in southern Texas, two Latino candidates face each other in the runoff, but that prospective gain has been offset by the Reyes loss.
In another majority-Latino district, in the Dallas-Fort Worth region, state Rep. Marc Veasey, an African American, was the top vote getter, with 37 percent, and heads into a runoff election against former state representative Domingo Garcia, who received 25 percent. If Veasey, the best fundraiser in the primary, wins the July 31 runoff, that will assure no net gain in the number of Latino lawmakers representing Texas next year.
Perales, who helped lead MALDEF’s legal efforts in redistricting disputes, said the issue was not the map but the quality of the campaigns by candidates such as Romo and Reyes. MALDEF fought the initial map offered by the state legislature and one drawn by a lower federal court. After the Supreme Court ordered the lower court to draw up another map, which provided for two additional majority Latino districts, MALDEF signaled its tentative support.
That map carved up Austin into several different districts, leaving Doggett with the decision of jumping into a GOP-leaning district or running in the 35th District, stretching down to San Antonio, with nearly 60 percent of the constituents being of Latino descent. With his $3 million campaign war chest, Doggett overwhelmed Romo and another Latina candidate, collecting more than 73 percent of the vote.
Doggett said he would have preferred the initial federal court map, which kept more of his Austin area intact and gave Democrats a better chance at more seats overall, but he said he intends to be a voice for all his constituents.
“They are opportunity seats for Hispanics to get their candidates of choice, to elect their candidate of choice,” Doggett said in an interview on the eve of his victory.
Ultimately, Perales said, the Texas Latino community must register more of its people to vote. Once the 13-percentage-point gap between the total Hispanic population and registered Hispanic voters closes, the issue will drift away, she said.
“The march is forward, slow and steady,” Perales said. “The redistricting litigation is trench warfare. People don’t want to give up power, but the march is forward.”





The Florida Secretary of State has discovered 53,000 dead voters registered to vote. The Secretary of State has also flagged thousands of potential non-citizens who are also registered to vote.

Judicial Watch's team analyzed voter registration data to determine which states have the dirtiest voter registration lists. According to this investigation, the worst offenders are Mississippi, Iowa, Indiana, Missouri, Texas, Ohio, Pennsylvania, West Virginia, Florida, Alabama, California, and Colorado.


We filed a taxpayer lawsuit in January against the Board of Trustees of Maryland’s Montgomery College for unlawfully allowing discounted “in-county” tuition rates for students graduating from Montgomery County public high schools, regardless of their place of residency or immigration status. The Florida Secretary of State has discovered 53,000 dead voters registered to vote. The Secretary of State has also flagged thousands of potential non-citizens who are also registered to vote. This discovery is indicative of a wider national problem with dead and ineligible voters on the rolls heading into the Presidential election.

State Police Find Evidence of Voter Fraud in Virginia

Results of an ongoing Virginia State Police investigation of voter registration irregularities from the 2008 general election may signal a more significant voter fraud issue than some state lawmakers realized.

As Virginia legislators hotly debated a voter ID bill that narrowly passed the General Assembly, many were unaware of a state police investigation that, so far, has resulted in charges against 38 people statewide for voter fraud. Warrants have been obtained for a 39th person who can't be located.

A majority of those cases already have resulted in convictions, and 26 additional cases are still being actively investigated nearly 3-and-a-half years after the state Board of Elections forwarded more than 400 voter and election fraud allegations from 62 cities and counties to Virginia State Police for individual investigation.


(Importantly, investigators believe fraud may have actually occurred at polling places on Election Day 2008 in this critical battleground state.)

There is perhaps no other city in the country like Sunland Park, N.M. The dusty border town minutes from El Paso, Texas, has been called "a city in chaos" by the state auditor, because a slew of public officials are facing felony charges that they ran City Hall like a personal piggy bank, tried to steal an election in order to remain in power and ruled the 14,000 residents through intimidation and fear.

The explosive case even involves Mexican prostitutes, strippers and an undercover video of a mayoral candidate getting a lap dance from a topless woman. The video allegedly was used to try to force him to drop out of the race. Authorities say the extortion investigation has revealed widespread voter fraud and public corruption in the small city just south of the Rio Grande.


These, of course, are just a few of many examples of rampant voter registration fraud just months before the nation will go to the polls. If you've been reading this space for some time, you know that Judicial Watch does not support or endorse candidates. We just want to make sure the 2012 elections are free, fair, and clean.

And that's why we started our
2012 Election Integrity Project. Of course, one of the key components of this campaign is to clean up dirty registration rolls.

Judicial Watch's team analyzed voter registration data to determine which states have the dirtiest voter registration lists. According to this investigation, the worst offenders are Mississippi, Iowa, Indiana, Missouri, Texas, Ohio, Pennsylvania, West Virginia, Florida, Alabama, California, and Colorado.

Judicial Watch has put election officials on notice in these states that if they fail to clean up voter rolls in accordance with the law, Judicial Watch lawyers are preparing to file lawsuits to force them to do it.

There is no question that lawsuits are going to be necessary. But it is also true that sometimes the threat of a lawsuit can get action.

Take West Virginia as an example.

As noted by the
West Virginia Lincoln Journal: "The Lincoln County Commission...took steps in response to the threat of a lawsuit from the Washington D.C.-based organization Judicial Watch, regarding voter rolls in Lincoln County. Meeting last Thursday, March 15, 2012, the commissioners adopted a resolution supporting the county clerk's efforts to resolve the situation."

I believe the Obama machine is prepared to steal, if necessary, the elections this November. As evidence from the news reports from across the country, this is a fight that will have to be fought county by county and state by state.

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.

Colorado Secretary of State Scott Gessler, a Republican, told the panel that his department’s study identified nearly 12,000 people who were not citizens but were still registered to vote in Colorado.
Of those non-citizen registered voters, nearly 5,000 took part in the 2010 general election in which Democratic Sen. Michael Bennet narrowly defeated Republican John Buck.

“We know we have a problem here. We don’t know the size of it,” Gessler said in testimony to Administration’s Elections subcommittee.

He told Harper that Colorado would look to create a registration system that would allow his department to ask that some people provide proof of their citizenship in writing.
If individuals did not respond to the request, their registration as voters would be suspended.

Rep. Charles Gonzalez (D-Texas) raised doubts about the reporting, noting that the study itself said it was based on inconclusive data and that it was “impossible to provide precise numbers” on how many people who were registered to vote in the state were not citizens.
Gonzalez asked Gessler, a former prosecutor, if he would have pursued a court case on such evidence.
Gessler responded that the goal of the study was to expose voter registration issues and pursue administrative avenues to resolve them.

 “We don’t have a screen for citizenship on the front end when people register to vote,” he said.
