WASHINGTON -- The Obama administration will stop deporting and begin granting work permits to younger undocumented immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.
The policy change, described to The Associated Press by two senior administration officials, will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States without documents but who have attended college or served in the military.
Homeland Security Secretary Janet Napolitano was to announce the new policy Friday, one week before President Barack Obama plans to address the National Association of Latino Elected and Appointed Officials' annual conference in Orlando, Fla. Republican presidential challenger Mitt Romney is scheduled to speak to the group on Thursday.
Under the administration plan, undocumented immigrants will be immune from deportation if they were brought to the United States before they turned 16 and are younger than 30, have been in the country for at least five continuous years, have no criminal history, graduated from a U.S. high school or earned a GED, or served in the military. They also can apply for a work permit that will be good for two years with no limits on how many times it can be renewed. The officials who described the plan spoke on the condition of anonymity to discuss it in advance of the official announcement.
The policy will not lead toward citizenship but will remove the threat of deportation and grant the ability to work legally, leaving eligible immigrants able to remain in the United States for extended periods.
"Many of these young people have already contributed to our country in significant ways," Napolitano wrote in a memorandum describing the administration's action. "Prosecutorial discretion, which is used in so many other areas, is especially justified here."
The extraordinary move comes in an election year in which the Hispanic vote could be critical in swing states like Colorado, Nevada and Florida. While Obama enjoys support from a majority of Hispanic voters, Latino enthusiasm for the president has been tempered by the slow economic recovery, his inability to win congressional support for a broad overhaul of immigration laws and by his administration's aggressive deportation policy. Activists opposing his deportation policies last week mounted a hunger strike at an Obama campaign office in Denver, and other protests were planned for this weekend.
The change is likely to cause an outcry from congressional Republicans, who are sure to perceive Obama's actions as an end run around them. Republicans already have complained that previous administration uses of prosecutorial discretion in deportations amount to back-door amnesty. Romney and many Republican lawmakers want tighter border security measures before considering changes in immigration law. Romney opposes offering legal status to undocumented immigrants who attend college but has said he would do so for those who serve in the armed forces.
An NBC News/Wall Street Journal poll last month found Obama leading Romney among Hispanic voters 61 percent to 27 percent. But his administration's deportation policies have come under fire, and Latino leaders have raised the subject in private meetings with the president. In 2011, Immigration and Customs Enforcement deported a record 396,906 people and is expected to deport about 400,000 this year.
A December poll by the Pew Hispanic Center showed that 59 percent of Latinos disapproved of the president's handling of deportations.
The changes come a year after the administration announced plans to focus on deporting serious criminals, immigrants who pose threats to public safety and national security, and serious immigration law violators.
One of the officials said the latest policy change is just another step in the administration's evolving approach to immigration.
Under the plan, immigrants whose deportation cases are pending in immigration court will have to prove their eligibility for a reprieve to ICE, which will begin dealing with such cases in 60 days. Any immigrant who already has a deportation order and those who never have been encountered by immigration authorities will deal with the U.S. Citizenship and Immigration Services.
The exact details of how the program will work, including how much immigrants will have to pay to apply and what proof they will need, still are being worked out.
In making it harder to deport, the Obama administration is in essence employing the same eligibility requirements spelled out in the proposed DREAM Act.
The administration officials stopped short of calling the change an administrative DREAM Act – the name is an acronym for Development, Relief and Education for Alien Minors – but the qualifications meet those laid out in a 2010 version that failed in the Senate after passing in the House. They said the DREAM Act, in some form, and comprehensive overhaul of the immigration system remained an administration priority.

Congressional study shows illegal immigrants sap tax dollars

A study by the U.S. Congressional Budget Office released Tuesday backs up the view that undocumented immigrants sap more tax dollars than they provide, especially in education, health care and law enforcement.
The study pulled together reports from the past five years, using data from sources including the Pew Hispanic Center, the Rand Corp., the U.S. Department of Homeland Security and various universities. The Congressional study also incorporated facts from states, including Arizona, but its authors acknowledged there was no aggregate estimate that could be applied to the entire country.
The report says that in 1990, 90 percent of undocumented immigrants primarily were in six states: California, Florida, Illinois, New Jersey, New York and Texas.
By 2004, undocumented immigrants had increased tenfold in other states, most notably Arizona, Georgia, North Carolina and Tennessee, according to statistics from the Pew Hispanic Center.
The report estimates there are 12 million undocumented immigrants nationwide. Of those, 60 percent are uninsured and 50 percent of the children are uninsured. Again using 2004 statistics from the Pew Hispanic Center the average income of undocumented immigrants was $27,400 while Americans earned $47,800. The difference puts undocumented immigrants in a lower tax bracket, thus reducing the amount of federal and state income taxes generated.
The study also showed that while undocumented workers represented just 5 percent of state and federal service costs, their tax revenue did not offset the amount spent by government. The authors of the study stated that, "the general consensus is that unauthorized immigrants impose a net cost on state and local budgets. However, no agreement exists as to the size of, or even the best way of measuring, that cost at a national level."
In education, which the study notes is the largest single expenditure in state and local budgets, multiple states reported 20 to 40 percent higher costs educating non-English speaking students, many of whom come from the homes of undocumented immigrant parents. Using New Mexico statistics from 2004 as a model, education spending on undocumented immigrants comprised $67 million of the state's $3 billion education budget.
The study estimates there are 53.3 million school-age children in the U.S., 2 million of whom are undocumented immigrants and another 3 million who are legal citizens, but whose parents are not.
Undocumented immigrants are more likely to access emergency rooms and urgent care facilities because most do not have health care, the study said. In Arizona and other border areas, states paid nearly $190 million in health care costs for undocumented immigrants in 2000, the study reported. The amount, which the study says likely has risen since then, represented one-quarter of all uncompensated health care costs in those states that year.
While the report found that undocumented immigrants are less likely to be incarcerated than American natives, it said states still bear a large cost for the legal process. Based on a report from the U.S./Mexico Border Counties Coalition from 2001, counties from the four states that border Mexico spent more than $108 million on law enforcement activities involving undocumented immigrants. San Diego County in California spent nearly half of that, with more than $50 million going into law enforcement activities involving undocumented immigrants.
“In his state of the union address to the Mexican nation, Calderon established his imperialistic imperatives: "I have said that Mexico does not stop at its border, that wherever there is a Mexican, there is Mexico. And, for this reason, the government action on behalf of our countrymen is guided by principles, for the defense and protection of their rights."

So how in the world can illegal immigrants file tax returns without a Social Security number?
Well, the IRS says that everyone must file a tax return - even people that are making money illegally.
So illegal immigrants are given an Individual Taxpayer Identification Number (ITIN).
Like a Social Security number, it contains nine digits and it is used by U.S. employers to withhold taxes and it is used by illegal immigrants to file their tax returns.
You might be thinking that this sounds completely insane considering the fact that it is illegal for them to have jobs in the United States, and you would be right.
But this is how the system works.
And it turns out that illegal immigrants have been exploiting the additional child tax credit to receive absolutely huge tax refunds.
Recently, a tax preparer up in Indiana blew the whistle on this whole thing. A WorldNetDaily article about this scam contained some absolutely mind blowing quotes from this whistleblower....
“We’ve seen sometimes 10 or 12 dependents,
most times nieces and nephews, on these tax forms,” a tax
preparer-turned-whistleblower told WTHR News. “The more you put on there, the
more you get back.”
“Here’s a return right here: we’ve got a
$10,300 refund for nine nieces and nephews.”
“We’re getting an $11,000 refund on this
tax return. There’s seven nieces and nephews,” he said, pointing to another set
of documents. “I can bring out stacks and stacks. It’s just so easy it’s
ridiculous.”
Last year, the whistleblower alerted the IRS to dozens of examples of illegal immigrants using this scam.
So what happened?
Absolutely nothing.
The IRS took no action.
But they seem to have plenty of time to come after you and I, don't they?
The WTHR investigation mentioned above discovered one instance in which it was claimed that a total of 20 children lived in one trailer in Indiana.
Because of tax credits for those children, a total of $29,608 was paid out to several illegal immigrant workers.
But when a reporter from WTHR went to the trailer, he found that only one girl actually lived there.
What makes all of this even worse is that the IRS has known about this problem for years.
In fact, the IRS has not taken action on this problem despite report after report from the Inspector General.
Amazingly, the IRS seems to believe that there is not even a problem. The following is from a statement that the IRS issued to WTHR....
“The law has been clear for over a decade
that eligibility for these credits does not depend on work authorization status
or the type of taxpayer identification number used. Any suggestion that the IRS
shouldn’t be paying out these credits under current law to ITIN holders is
simply incorrect. The IRS administers the law impartially and applies it as it
is written. If the law were changed, the IRS would change its programs
accordingly.
“The IRS disagrees with TIGTA’s (inspector
general) recommendation on requiring additional documentation to verify
child-credit claims. As TIGTA acknowledges in this report, the IRS does not
currently have the legal authority to verify and disallow the Child Tax Credit
and the Additional Child Tax Credit during return processing simply because of
the lack of documentation.
“The IRS has procedures in place
specifically for the evaluation of questionable credit claims early in the
processing stream and prior to issuance of a refund. The IRS continues to work
to refine and improve our processes.”
Can you believe that?
So next year millions of illegal immigrants will once again rake in billions of dollars that they are not entitled to and the IRS will continue to look the other way.
This is yet another example of how the federal government has different rules for illegal immigrants than they have for the rest of us.
In fact, the Obama administration has now instructed government officials to use "prosecutorial discretion" in deportation cases. In essence what that means is that if an illegal immigrant has not been convicted of a crime, it will now be highly unlikely that he or she will be deported.
Over the past several decades, we have seen tens of millions of illegal immigrants come pouring into our country. They have taken our jobs and they have terrorized our communities. There are now 1.4 million gang members in the United States, and that number has increased by 40 percent since 2009. Most of that increase is due to illegal immigration.
Illegal immigration is one of the biggest national security threats that we face, and yet the federal government continues to look the other way.
