Restrictive voting laws tied up in court

Stricter ID laws and other controversial voting restrictions, passed this year by several Republican-controlled legislatures, are hitting legal roadblocks that could keep many of the measures from taking effect before the November elections.

Curbs on early voting, new ID requirements and last-minute efforts to rid voter lists of noncitizens have been met with vigorous opposition from the Justice Department and civil rights groups, and in some cases, the provisions have been blocked by federal or state judges.

“There has been a real push-back by the courts to these widespread efforts to restrict the vote,” said Wendy Weiser, director of the Democracy Program at the Brennan Center for Justice at NYU School of Law, which opposes the new laws. “If those seeking to suppress the vote won round one, round two seems to be going to the voters.”

Supporters of the laws argue that they will ensure that elections are fair and will cut down on the potential for voter fraud. Democrats contend that the laws disproportionately affect people who tend to vote for their candidates.

Florida, viewed by both President Obama and Republican rival Mitt Romney as key to the election, passed several voting laws that have been challenged. Last week, a federal judge in Florida threw out a new state law that groups registering voters submit the registration cards within 48 hours or face steep fines, calling the mandate onerous. Justice Department officials have also challenged an effort by Florida’s Republican secretary of state to remove noncitizens from voter registration lists, saying it is illegal to conduct such a purge this close to an election.

Florida Gov. Rick Scott (R) defended the review of the lists.

“We need to be reviewing our voter rolls and making sure only those individuals who have the right to vote . . . are voting,” Scott told WNDB radio in Daytona Beach.

Last year, new ID measures were introduced in 34 states and passed in Kansas, Mississippi, Rhode Island and Wisconsin. Alabama, South Carolina, Tennessee and Texas tightened existing voter ID laws to require a photo ID. Legislation in five other states was vetoed by their governors, according to the National Council of State Legislatures.

Since then, two state judges in Wisconsin have ruled its voter ID law unconstitutional. A Missouri court threw out a ballot initiative that would have allowed voters to decide whether photo IDs should be required, calling the language “misleading.”

The Justice Department has challenged ID laws in South Carolina and Texas under Section 5 of the Voting Rights Act, which could keep those laws from taking effect before November. Speaking to a group of black politicians and church leaders last week, Attorney General Eric H. Holder Jr. said that his department is committed to “aggressively enforcing the Voting Rights Act” and that it opposed the ID laws in the two states because of their impact on minority voters. The Voting Rights Act requires some states or counties with a history of discrimination to receive federal approval before changing their voting laws.

Texas Attorney General Greg Abbott called Justice’s stance “quite stunning” and “obviously political.”

“In Texas we have been involved in cases where votes have been cast for dead people, alive people have voted twice and foreign nationals have been allowed to vote illegally,” said Abbott, whose office has won convictions in 50 cases of voter fraud in the past eight years. “It is the state’s right to protect the integrity of the ballot box.”

The law being contested in Texas is often cited as unfair because it allows gun permits as identification but not student IDs, with opponents arguing that gun owners are more likely to support Republicans while students may lean toward Democrats.

Penda Hair, co-director of the Advancement Project, which has filed lawsuits against the more-restrictive voting laws in several states, said she views the Texas law and others as a result of “politicians trying to pick the voters that will vote for them. . . . There is a coordinated, systematic assault on the voting rights of the most vulnerable voters, voters of color, young people and seniors.”Opponents say there have been few cases of voter fraud, given the millions of ballots cast and compared with the high number of poor and minority voters who would be affected.

Twenty-five percent of African American voters do not have a valid government-issued photo ID, compared with 8 percent of whites, according to a study by the Brennan Center. The report also found that 15 percent of voters earning less than $35,000 per year do not have such an ID.

But Abbott said the Supreme Court is on his side. Before the 2008 election, the high court upheld a voter ID law in Indiana. The Justice Department has said that the law in Texas, which must seek preclearance for its laws under the Voting Rights Act, would have a discriminatory impact on the state’s Hispanic population.

A trial to determine whether the Texas law can take effect is scheduled to begin July 9.

The ACLU and several other civil rights groups have also filed suit to stop the voter ID law in Pennsylvania. That trial is set for late July.

State Police Find Evidence of Voter Fraud in Virginia


Results of an ongoing Virginia State Police investigation of voter registration irregularities from the 2008 general election may signal a more significant voter fraud issue than some state lawmakers realized.

As Virginia legislators hotly debated a voter ID bill that narrowly passed the General Assembly, many were unaware of a state police investigation that, so far, has resulted in charges against 38 people statewide for voter fraud. Warrants have been obtained for a 39th person who can't be located.

A majority of those cases already have resulted in convictions, and 26 additional cases are still being actively investigated nearly 3-and-a-half years after the state Board of Elections forwarded more than 400 voter and election fraud allegations from 62 cities and counties to Virginia State Police for individual investigation.

(Importantly, investigators believe fraud may have actually occurred at polling places on Election Day 2008 in this critical battleground state.)

There is perhaps no other city in the country like Sunland Park, N.M. The dusty border town minutes from El Paso, Texas, has been called "a city in chaos" by the state auditor, because a slew of public officials are facing felony charges that they ran City Hall like a personal piggy bank, tried to steal an election in order to remain in power and ruled the 14,000 residents through intimidation and fear.

These, of course, are just a few of many examples of rampant voter registration fraud just months before the nation will go to the polls. If you've been reading this space for some time, you know that Judicial Watch does not support or endorse candidates. We just want to make sure the 2012 elections are free, fair, and clean.

And that's why we started our
2012 Election Integrity Project. Of course, one of the key components of this campaign is to clean up dirty registration rolls.

Judicial Watch's team analyzed voter registration data to determine which states have the dirtiest voter registration lists. According to this investigation, the worst offenders are Mississippi, Iowa, Indiana, Missouri, Texas, Ohio, Pennsylvania, West Virginia, Florida, Alabama, California, and Colorado.

Judicial Watch has put election officials on notice in these states that if they fail to clean up voter rolls in accordance with the law, Judicial Watch lawyers are preparing to file lawsuits to force them to do it.

There is no question that lawsuits are going to be necessary. But it is also true that sometimes the threat of a lawsuit can get action.

Take West Virginia as an example.

As noted by the
West Virginia Lincoln Journal: "The Lincoln County Commission...took steps in response to the threat of a lawsuit from the Washington D.C.-based organization Judicial Watch, regarding voter rolls in Lincoln County. Meeting last Thursday, March 15, 2012, the commissioners adopted a resolution supporting the county clerk's efforts to resolve the situation."

I believe the Obama machine is prepared to steal, if necessary, the elections this November. As evidence from the news reports from across the country, this is a fight that will have to be fought county by county and state by state.

Rep. Charles Gonzalez (D-Texas) raised doubts about the reporting, noting that the study itself said it was based on inconclusive data and that it was “impossible to provide precise numbers” on how many people who were registered to vote in the state were not citizens.



Gonzalez asked Gessler, a former prosecutor, if he would have pursued a court case on such evidence.



Gessler responded that the goal of the study was to expose voter registration issues and pursue administrative avenues to resolve them.



“We don’t have a screen for citizenship on the front end when people register to vote,” he said.

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.



Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.



“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.



Colorado Secretary of State Scott Gessler, a Republican, told the panel that his department’s study identified nearly 12,000 people who were not citizens but were still registered to vote in Colorado.



Of those non-citizen registered voters, nearly 5,000 took part in the 2010 general election in which Democratic Sen. Michael Bennet narrowly defeated Republican John Buck.

Illegal Immigrant Rapist Had Been Deported 9 Times

In what appears to be a growing national trend, an illegal immigrant with an extensive criminal record and multiple deportation orders remained in the U.S. long enough to commit yet another atrocious crime.

The tragic case in Washington State marks the latest of many examples illustrating the government’s inefficiency in keeping dangerous illegal aliens out of the United States, even when they have well-documented criminal histories and federal orders to leave the country.

In this case a Mexican national with an extensive criminal record and nine deportation orders raped a woman in Edmonds, a picturesque waterfront town famous for its views of the Olympic Mountains rising above Puget Sound. The illegal immigrant (Jose Lopez Madrigal) was first deported in California more than two decades ago and has since been convicted of a multitude of violent crimes, including armed theft, sexual assault and drug-related offenses.

The crimes were committed in different states—California and Colorado among them—and Madrigal had a staggering number of encounters with law enforcement in the last two decades, according to the local news report that broke the story of his multiple deportations. When he got arrested this last time, it took authorities longer than usual to learn his real identity because he had well over two dozen aliases.

The level of incompetence among federal immigration authorities in this case would be comical if Madrigal’s crimes weren’t so heinous. After the first deportation in 1989 for using a firearm to commit theft, Madrigal got deported several more times in the next few years. In 1999 he was deported three times in a four-month period after drug-related arrests. After a similar offense in 2000 he got deported yet again and in 2002 he got deported after pleading guilty to sexual assault in Denver. In 2003 Madrigal got deported three more times.

It would seem like a huge joke if the illegal immigrant didn’t brutally rape a woman last week. Evidently ashamed, officials at the Homeland Security agency (Immigration and Customs Enforcement—ICE) responsible for removing such thugs refuse to comment on the case. One criminal justice source quoted in the news report says Madrigal is a “poster boy” for the federal government’s ineffectiveness at keeping the most serious criminal aliens out of the United States.

It’s not like this is an isolated incident. In the last few years alone similar cases have rocked the nation. On Mothers’ Day last year a 17-year-old girl was murdered in Nevada by an admitted illegal alien gang member who had been convicted of a felony years earlier and deported.

A year earlier authorities in Arizona discovered that a serial rapist who targeted young girls was a twice deported Mexican who lived and worked in the U.S. despite his documented history of drug charges. He was caught only because the sheriff’s department in Arizona’s largest county (Maricopa) bothered to confirm his immigration status.

Reporting from Mexico City — A 14-year-old boy who says he's been killing or working for drug cartels since he was 11 has been captured by the Mexican army after a monthlong hunt, authorities said Friday.
Edgar Jimenez Lugo, who authorities said was born in San Diego, was wanted on suspicion of killing rivals — allegedly beheading some of them — as part of his work for an especially violent drug-trafficking cartel.
