Obama Administration Challenges Arizona E-Verify Law
The Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hire illegal aliens, a law enacted by then-Governor Janet Napolitano.  (Solicitor General's Amicus Curiae Brief).  Called the “Legal Arizona Workers Act,” the law requires all employers in Arizona to use E-Verify and provides that the business licenses of those who hire illegal workers shall be repealed.  From the date of enactment, the Chamber of Commerce and other special interest groups have been trying to undo it, attacking it through a failed ballot initiative and also through a lawsuit. Now the Chamber is asking the United States Supreme Court to hear the case (Chamber of Commerce v. Candelaria), and the Obama Administration is weighing in against the law.
To date, Arizona’s E-Verify law has been upheld by all lower courts, including the Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as an exercise of a state’s traditional power to regulate businesses.  (San Francisco Chronicle, June 2, 2010).  Obama’s Justice Department, however, disagrees. Acting Solicitor General Neal Katyal said in his filing with the Supreme Court that the lower courts were wrong to uphold the statute because federal immigration law expressly preempts any state law imposing sanctions on employers hiring illegal immigrants.  Mr. Katyal argues that this is not a licensing law, but “a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction.”  (Solicitor General's Amicus Curiae Brief, p. 10).  This is the administration’s first court challenge to a state’s authority to act against illegal immigration, and could be a preview of the battle brewing over Arizona’s recent illegal immigration crackdown through SB 1070. 
Napolitano has made no comment on the Department of Justice’s decision to challenge the 2007 law, but federal officials said that she has taken an active part in the debate over whether to do so. (Politico, May 28, 2010).   As Governor of Arizona, Napolitano said she believed the state law was valid and became a defendant in the many lawsuits against it. (Id.).

Obama soft on illegals enforcement


Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Arizona shows pitfalls in Romney’s proposed national E-Verify program

At Wednesday night's GOP debate, Mitt Romney called Arizona a "model" for immigration enforcement, singling out the state's 2007 law mandating that all employers use the national E-Verify database when hiring workers. He promised to institute a national E-Verify law if elected. "You do that, and just as Arizona is finding out, you can stop illegal immigration," he said. Last May, the state defeated the Chamber of Commerce's suit against the law in the Supreme Court.
Kansas Secretary of State Kris Kobach, Romney's adviser on immigration issues, helped write Arizona's E-Verify law as well as Arizona's 2010 SB1070 law (Support Our Law Enforcement and Safe Neighborhoods Act). At the recent Conservative Political Action Conference in Washington, Kobach touted what's happened in Arizona as proof that "self-deportation"—Romney's chosen immigration strategy—is working. "People started self-deporting by the tens of thousands," after E-Verify passed, he said, according to the Hill.
Romney and Kobach are right that, on at least one level, the law has had a significant impact in Arizona. A study published last year by the Public Policy Institute of California shows that about 92,000, or 17 percent, of the Hispanic non-citizen population of Arizona left the state in the year after the state passed E-Verify legislation; most of those who moved were probably illegal immigrants. (THEY PROBABLY MOVED TO MEXIFORNIA!)  PPI researchers told Yahoo News that the law—not the recession, or highly-publicized raids targeting illegal immigrants—was the most likely cause of the exodus.
Yet while PPI's research helps predict what might happen if an E-Verify system were implemented nationally, as Romney hopes, it exposes some of the less-desirable side-effects of the law as well. In Arizona, the non-citizen Hispanic workers who did stay behind increasingly shifted into a shadow economy, said Magnus Lofstrom, a co-author of the study. The self-employment rate among non-citizen Hispanics in Arizona nearly doubled post-E-Verify, and a higher proportion of people who said they were self-employed lived in poverty and lacked health insurance.
Lofstrom told Yahoo News that the informal economy would grow significantly nationwide if a national E-Verify system were established. While illegal immigrants in Arizona were able to move to other states to find work, their choices would be significantly limited if E-Verify were implemented nationally; the only real (and unlikely) option would be to for undocumented workers to move to another country. In other words, we'd be much more likely to see an increase in informal employment rather than a massive movement among illegal immigrants to "self-deport."

What would that mean? An increase in informal employment among the nation's estimated 11 million illegal immigrants would result in lower tax revenues--since non-self employed illegal immigrants are more likely to have taxes withheld from their paychecks--higher poverty levels among illegal immigrants, and a higher potential for employer abuse, said Lofstrom. (Right now, America has a relatively small shadow economy compared to other developed countries, like Italy.)
Another snag with instituting a national E-Verify program is that the current system cannot detect identity fraud. A 2009 government-commissioned study found that E-Verify only flags illegal immigrants half the time, because it can't detect when a worker is using documents that belong to someone else. (Employers enter in Social Security or alien registration numbers, birthdates and names of employees into the database, which figures out whether they match the federal immigration and Social Security databases.) To combat this fraud, Romney has said he supports biometric ID cards for immigrants that would contain a fingerprint or other identifying device that clears them for work. Romney hasn't explicitly said that every person in America should have this card--an idea that many libertarians object to. But without being adopted universally, undocumented people could still use false documents. (The Romney team had not responded to requests for comment from Yahoo News by the time this article was published.) Mandatory national ID cards have played a starring role in failed bipartisan immigration reform proposals in Congress over the past few years.
In Arizona, there is no state-wide system to make sure businesses are using E-Verify. Rather, individual citizens are asked to expose employers that they suspect of hiring illegal immigrants to their local district attorneys. Yet district attorneys were not granted the power to subpoena businesses that are suspected of hiring illegal immigrants, and some DAs have complained that the law is an unfunded mandate for their offices, according to Judy Gans, immigration policy director at Arizona University's Udall Center. Only three businesses were prosecuted under the law in the first three years after it passed.
But business owners still worry that E-Verify's high error rate could leave them open to prosecution. Republicans in Arizona's state Senate are now moving to change the law at their request. Republican state senator Jerry Lewis, who defeated anti-illegal immigration hardliner Russell Pearce last year in a historic recall election, is co-sponsoring a bill with seven other Republican senators to provide "safe harbor" to businesses that use E-Verify but still accidentally hire unauthorized workers.
Lewis, who is backing Romney, told Yahoo News that he is not a fan of Kobach's draft immigration laws.
"Does Kobach's presence in Romney's campaign create a difficulty for him? I believe it does," Lewis said. "I think people want a real solution and I don't think the legislation that has been drafted by Kobach is a real solution." Lewis said the immigration laws "polarize people."
Lewis added that he thinks Romney will eventually agree with him that making all illegal immigrants leave the country is not a solution to the country's immigration problems.
"I think he'll realize that there is a place for a real solution to the issue, and it's not just let's get everybody that's undocumented out of the country," Lewis said.

With the support of 70 percent of its citizens, Arizona has ordered sheriffs and police to secure the border and remove illegal aliens, half a million of whom now reside there.
Arizona acted because the U.S. government has abdicated its constitutional duty to protect the states from invasion and refuses to enforce America's immigration laws.
"We in Arizona have been more than patient waiting for Washington to act," said Gov. Jan Brewer. "But decades of inaction and misguided policy have created an unacceptable situation."
We have a crisis in Arizona because we have a failed state in Washington.
What is the response of Barack Obama, who took an oath to see to it that federal laws are faithfully executed?
He is siding with the law-breakers. He is pandering to the ethnic lobbies. He is not berating a Mexican regime that aids and abets this invasion of the country of which he is commander in chief. Instead, he attacks the government of Arizona for trying to fill a gaping hole in law enforcement left by his own dereliction of duty.
He has denounced Arizona as "misguided." He has called on the Justice Department to ensure that Arizona's sheriffs and police do not violate anyone's civil rights. But he has said nothing about the rights of the people of Arizona who must deal with the costs of having hundreds of thousands of lawbreakers in their midst.
How's that for Andrew Jackson-style leadership?
Obama has done everything but his duty to enforce the law.
Undeniably, making it a state as well as a federal crime to be in this country illegally, and requiring police to check the immigration status of anyone they have a "reasonable suspicion" is here illegally, is tough and burdensome. But what choice did Arizona have?
The state has a fiscal crisis caused in part by the burden of providing schooling and social welfare for illegals and their families, who consume far more in services than they pay in taxes and who continue to pour in. Even John McCain is now calling for 3,000 troops on the border.
Police officers and a prominent rancher have been murdered. There have been kidnappings believed to be tied to the Mexican drug cartels. There are nightly high-speed chases through the barrios where innocent people are constantly at risk.
If Arizona does not get control of the border and stop the invasion, U.S. citizens will stop coming to Arizona and will begin to depart, as they are already fleeing California.
A country that cannot control its borders isn't really a country anymore, Ronald Reagan reminded us.
What we are talking about here is the Balkanization and breakup of a nation into ethnic enclaves. A country that cannot control its borders isn't really a country anymore, Ronald Reagan reminded us.
The tasks that Arizonans are themselves undertaking are ones that belong by right, the Constitution and federal law to the Border Patrol, Immigration and Customs Enforcement, and Homeland Security.
Arizona has been compelled to assume the feds' role because the feds won't do their job. And for that dereliction of duty the buck stops on the desk of the president of the United States.
Why is Obama paralyzed? Why does he not enforce the law, even if he dislikes it, by punishing the businessmen who hire illegals and by sending the 12 million to 20 million illegals back home? President Eisenhower did it. Why won't he?

Much more can be done on immigration before election

Congress doesn’t have to wait until Election Day to respond to what the American people care about. Poll after poll shows that the American people are overwhelmingly concerned about jobs and the economy. They also consider national security an important issue. By making some changes to our immigration system, Congress can take action now to address the issues Americans care about the most.
We could open up millions of jobs for unemployed American workers by requiring all U.S. employers to use E-Verify. Last year, the House Judiciary Committee approved a bipartisan bill that does just that, the Legal Workforce Act.
E-Verify is a Web-based program that quickly identifies illegal immigrants in the workforce and protects jobs for legal workers by checking the Social Security numbers of new hires. The program is free, quick and easy to use. It only takes about a minute to run a newly hired employee through E-Verify and persons eligible to work here are immediately confirmed 99.5 percent of the time. More than 375,000 employers already use E-Verify, and 2,200 new businesses sign up each week.
Considering its track record, it’s no surprise that a recent poll found 82 percent of Americans surveyed support the expansion of E-Verify. And with 13 million Americans unemployed and 7 million illegal immigrants working here, now is the time to expand this popular program.
We could also boost job creation and improve our economy by allowing the United States to retain some of the world’s best and brightest foreign graduates of American universities. Foreign students receive nearly 4 out of every 10 master’s degrees awarded in science, technology, engineering and math (STEM) fields and about the same percentage of all doctorates. These students have the potential to come up with an invention that could save thousands of lives or jump-start a whole new industry. They also have the ability to start a company that could provide jobs to tens of thousands of American workers.
Unfortunately, our immigration system does not always put American interests first — we select only 5 percent of our immigrants based on the skills and education they bring to the United States. Our immigration laws should not force the country to forfeit retaining some of the most talented students from around the world. We should make tweaks to our immigration system to allow more of the top foreign graduates of American universities to stay and work here.
Our immigration system should also better protect our country and citizens from foreign nationals who wish to do us harm. Recent events underscore the need to strengthen and improve visa security; we know terrorists use loopholes and weaknesses in our immigration system to enter the United States. In fact, all of the 9/11 terrorists entered the country legally on visas. And terrorists will continue coming to the United States legally if we do not improve and tighten our visa security process.
The Secure Visas Act, approved by the House Judiciary Committee last year, helps prevent terrorists from obtaining U.S. visas by expanding the number of visa security units overseas to areas designated as “highest risk” for terror threats. Visa security units ensure that thorough background checks are conducted on all visa applicants, not just a select few. The bill also allows U.S. officials to expedite the removal of terrorists who are in the United States on a visa. Visa security is critical to America’s national security.
The safety of all Americans could be further enhanced by enacting the Keep Our Communities Safe Act that was approved by the House Judiciary Committee last year. This bill is designed to prevent dangerous criminal immigrants from being released into our communities.
Recent Supreme Court decisions have ruled that under current law, illegal and criminal immigrants cannot be detained for more than six months when they cannot be removed to their home country in the near future. Because some countries refuse to take back their criminal immigrants, federal authorities have had no choice but to release thousands of dangerous criminal immigrants into our neighborhoods.
Tragically, there have been at least eight preventable deaths because of this loophole. We cannot continue to let dangerous criminal immigrants slip through the cracks of our legal justice system. We have a responsibility to make sure the laws of this land protect Americans rather than endanger them. The Keep Our Communities Safe Act provides a legislative remedy to this problem by allowing dangerous criminal immigrants to be detained beyond six months if they cannot be deported.
Election Day might be just five months away, but that shouldn’t stop Congress from doing its job now. Congress still has an opportunity to work across party lines and take up immigration bills that will help put Americans back to work and make our country safer.

Amnesty for Immigrants?

Jorge G. CastaƱeda and Douglas S. Massey (“Do-It-Yourself Immigration Reform,” Op-Ed, June 2) argue that we should grant amnesty to millions of illegal immigrants because illegal immigration from Mexico is down. But this conclusion is flawed.
First, they claim that Mexican illegal immigration is down because of decreased job opportunities. But this doesn’t mean that illegal immigrants won’t try to enter once the economy improves.
For this reason, we need to turn off the jobs magnet that encourages illegal immigration. We should expand E-Verify, a Web-based program that quickly identifies illegal immigrants working here and protects jobs for legal workers.
And since the Government Accountability Office has found that only 44 percent of the Southwest border is under the “operational control” of the Border Patrol, the border is still not secure and remains an open invitation to more illegal immigration.
Second, while illegal immigration has slightly diminished, it’s still a problem. Last year, more than 340,000 people were apprehended trying to enter the country illegally. But it’s estimated that there are two to three successful illegal crossings for every one thwarted. That means more than a million illegal immigrants could have entered last year.
Third, not all illegal immigrants are from Mexico. Each year, tens of thousands of illegal immigrants enter the United States from countries other than Mexico, including some countries with strong ties to terrorist organizations like Syria, Iran, Somalia, Nigeria and Pakistan. This means that if we grant amnesty to all illegal immigrants in the United States, it could also include those who wish to do us harm.
Granting amnesty to illegal immigrants is a shortsighted fix that will only encourage more illegal immigration.

What you need to know is that this longtime open-borders sympathizer has always had a rather radical definition of "American." At a Latino voter registration project conference in Los Angeles many years ago, Solis asserted to thunderous applause, "We are all Americans, whether you are legalized or not."

To be sure, no one should be scammed out of "fair wages." Employers that hire and exploit illegal immigrant workers deserve full sanctions and punishment. But it's the timing, tone-deafness and underlying blanket amnesty agenda of Solis' illegal alien outreach that has so many American workers and their representatives on Capitol Hill rightly upset.
With double-digit unemployment and a growing nationwide revolt over Washington's border security failures, why has Solis chosen now to hire 250 new government field investigators to bolster her illegal alien workers' rights campaign? (Hint: Leftists unhappy with Obama's lack of progress on "comprehensive immigration reform" need appeasing. This is a quick bone to distract them.)
Unfortunately, the federal government is not alone in lavishing attention and resources on workers who shouldn't be here in the first place. As of 2008, California, Florida, Nevada, New York, Texas and Utah all expressly included illegal aliens in their state workers' compensation plans -- and more than a dozen other states implicitly cover them.
Solis' public service announcement comes on the heels of little-noticed but far more troubling comments encouraging illegal alien workers in the Gulf Coast. Earlier this month, in the aftermath of the BP oil spill, according to Spanish language publication El Diario La Prensa, Solis signaled that her department was going out of its way to shield illegal immigrant laborers involved in cleanup efforts. "My purpose is to assist the workers with respect to safety and protection," she said. "We're protecting all workers regardless of migration status because that's the federal law." She told reporters that her department was in talks with local Immigration and Customs Enforcement (ICE) officials who had visited coastal worksites to try to verify that workers were legal.
No word yet on whether she gave ICE her "we are all Americans, whether you are legalized or not" lecture. But it's a safe bet.
