Driven largely by layoffs of teachers, firefighters and other public sector workers, union membership fell by another 400,000 in 2012, to just 14.3 million, according to report released by the Bureau of Labor Statistics this week. The number of workers in unions dropped even as total employment rose by 2.4 million last year, largely through an expansion of low-paying retail, restaurant and manufacturing jobs.

Following a decades-long trend, the percentage of overall union membership fell to only 11.3 percent. This is the lowest level since 1916, the year after the US Supreme Court upheld “yellow dog” contracts that forbid workers from joining unions.

Private sector unionization, already at the lowest rate since 1901, fell to just 6.6 percent, down from 6.9 percent in 2011. Private sector unionization peaked at 30 percent in 1958 and was still at 20.8 percent as late as 1980.

In several industrial states, union membership fell even more sharply than the national average. This included Michigan, where the percentage fell to 16.6 percent, compared with 17.5 percent in 2011. The state lost 42,000 union workers last year, down to 629,000. In contrast, in 1970 Michigan had 1.2 million union workers representing 40 percent of the state’s workforce.

The number of public sector workers in unions fell by 234,000, down to 35.9 percent of the workforce, from 37 percent the previous year. There was a particularly sharp fall in states that adopted so-called right-to-work laws that bar contracts that make the payment of union or association fees a condition of employment.

The sharp falloff in membership in Wisconsin and Indiana, and the failure of the UAW and other unions to mount any serious opposition to the passage of right-to-work legislation in Michigan last year, is a measure of the deep alienation of workers from the unions, which are rightly seen as tools of management.

In the end, the unions only continue to stagger on at the behest of a section of big business and the government, which believe the attacks on the working class can be carried out more effectively by using the services of union apparatus than without them.

This is what lies behind the unions’ support for President Barack Obama and the Democratic Party, even as they collaborate with the Republicans to slash social services, dismantle public education and attack the jobs, living standards and social rights of the working class. A case in point is the 2009 auto bailout, where the UAW was handed a substantial ownership stake in GM and Chrysler in exchange for agreeing to a 50 percent wage cut for new hires, the elimination of the eight-hour day and other concessions.

Even as the membership of the UAW plummeted from 1.5 million in 1979 to less than 600,000 today, the assets of the union apparatus and the salaries and perks it dispenses to its bloated staff have increased.

Public sector unions, like the American Federation of State, County and Municipal Employees (AFSCME), the American Federation of Teachers (AFT) and the National Education Association (NEA), have likewise opposed any resistance to the austerity measures spearheaded by Obama and state and local governments led by both parties.

In a statement, AFL-CIO President Richard Trumka—who as former president of the United Mine Workers of America oversaw the virtual disappearance of the UMWA in the coalfields—blamed the collapse in union membership on “our still-struggling economy, weak laws and political as well as ideological assaults” on unions.

In fact, the shrinking of the unions to near extinction is the result of the decades-long degeneration. This is itself bound up with the anti-communist purges carried out in the postwar period and the bankruptcy of the unions’ program of economic nationalism in the face of the globalization of production.

The American trade unions, like nationally based trade unions all over the world, responded to globalization by suppressing any resistance by the working class to the destruction of jobs and living standards.

In the name of making US corporations more competitive and profitable, major strikes all but disappeared. Work stoppages involving 1,000 or more workers fell to a record low of five in 2009, and only 19 in 2011. This compares to 470 in 1952, 424 in 1974 and 145 as late as 1981, the year Reagan fired the striking air traffic controllers.

The artificial suppression of the class struggle by the unions has only led to a buildup of social anger, which sooner rather than later will come to the surface. The way forward for the working class is not trying to reform these rotten organizations, which are controlled by upper middle class union executives whose interests are hostile to those of the workers they allegedly represent. Instead, new organizations, controlled by rank-and-file workers and independent of the unions and the Democratic Party, must be built to spearhead an industrial and political struggle of the working class.

Chamber of Commerce Says It Supports Path 'To Legitimacy' for 12 Million Illegal Aliens

(CNSNews.com) - U.S. Chamber of Commerce President and CEO Tom Donohue, noting that 27 million Americans are unemployed, underemployed, or have given up on finding a job, said his organization supports a "way" "to legitimacy" for the estimated 12 to 14 million illegal aliens who are working in the United States.

“Unemployment had exceeded 9 percent for 20 consecutive months,” Donohue said in his annual State of American Business address at the Chamber’s headquarters in Washington, D.C., on Tuesday. “Some 27 million Americans are either unemployed, underemployed or have give up looking for work.”

“In fact,” Donohue said, “we must create 1.2 million jobs a year just to absorb the new entrants into our workforce.”

Later in his remarks, Donohue said the Chamber would continue its efforts in support of comprehensive immigration reform, which some conservative critics consider to be a form of amnesty.

“Almost all of us are sons, daughters, or descendents of immigrants,” Donohue said. “The Chamber will continue to pursue comprehensive immigration reform.” He also cited the "urgent" need to improve visa processing, oppose attempts to gut temporary worker programs, and increase the number of foreign worker visas.

At a press conference following his speech, Donohue was asked by CNSNews.com if comprehensive immigration reform included a so-called pathway to citizenship.

“We think the most important parts of comprehensive immigration reform would be, first of all, a way for the, shall we say 12 million here, to legitimacy so that they can easily participate in society, pay their taxes, drive cars and that sort of thing,” Donohue said. “Second we need a guest worker program,” he said. “People could easily come back and forth for work and some of that would be seasonally, for crops and for recreation organizations and so on.

“And third, we definitely need a way to deal with high-end, talented folks that are needed in this economy. Donohue called it "amazing" that after years of training in America, professionals such as Ph.Ds in chemical engineering are now finding it hard to stay here.

Donohue said citizenship for illegal aliens should not be the top priority. “I don’t think the citizenship thing is necessary right now,” said Donohue, adding that protecting the U.S. border was also important. “I think we ought to pick the four or five things that everybody needs and let’s get it done.”

Donohue also said that the United States should keep the promise it made to Mexico 15 years ago to allow “safe, carefully inspected” Mexican trucks to transport goods into the U.S., as called for in the North American Free Trade Agreement. Labor unions strongly oppose the plan.

Donohue said the U.S. economy is “in better shape than we found ourselves last year,” and he noted “a new tone coming out of the White House.”

One indication of warming relations between the White House and the Chamber, which represents 3 million mostly small businesses, includes a scheduled address by President Barack Obama at the group’s headquarters on Feb. 7.

Among the areas Donohue said the Chamber would concentrate on in 2011:

-- restraint and reform of the regulatory process, including stopping the EPA from enacting regulations to limit greenhouse gases – a task that should be left to Congress, he said.

--Expanding American trade, rebuilding the country’s infrastructure and developing U.S. energy resources, and reducing the federal debt and deficit also made the top four on Donohue’s to-do list.

Donohue concluded his remarks with his trademark line-in-the-sand approach while expressing optimism that the Chamber can “work together” with the Obama administration and Congress in the coming year.

“Our approach in Washington will be to call them as we see them,” Donohue said. ‘We’ll continue to have our differences with the White House on some issues but we’ll work together on other issues."

“We’ll support the new House leadership on many occasions, and we’ll work with Democratic legislators as well, but no one should expect the Chamber to march in lock step with anyone,” Donohue said.

“We have a clear mission and agenda of our own,” he said. “It’s to continue to win important policy victories for our members and the American business community. It’s to support, protect, and advance the free enterprise system that made this country great. And it’s to help create good jobs and promising opportunities for all the people of our country so that they can achieve the American dream."

At southern border, Obama calls immigration reform an 'economic imperative'

President Obama visited the southern border Tuesday to push for an overhaul of the immigration system, part of a renewed effort to shore up his standing among Latinos and paint Republicans as hostile to a minority group that is a growing force in U.S. politics.

In a speech at the Chamizal National Memorial, Obama also sought to link the challenge of illegal immigration with another major political concern: economic anxiety. He said immigration reform "is an economic imperative."

"One way to strengthen the middle class in America is to reform the immigration system so that there's no longer a massive underground economy that exploits a cheap source of labor while depressing wages for everybody else," he said.

The chances of passing an immigration bill are low, but the White House is taking high-visibility steps to show it is not abandoning a goal that has its roots in the 2008 campaign.

In his appearance, Obama said his administration has made great strides in stopping immigrants from illegally crossing the southern border, even as Republican critics say he can do more.

"We have strengthened border security beyond what many believed was possible," he said.

But he said that illegal immigration requires a "comprehensive" solution that would also provide a path to legal status for the 11 million people living illegally in the United States. He also made another pitch for the Dream Act, which failed in the lame-duck session of Congress in December.

The speech comes after a series of meetings between the president and various stakeholders and reform activists in the past months. It was heavily promoted by the White House on a range of social media platforms, and Obama made a campaign-like pitch for the crowd to visit the White House website to sign up in support of his call for reform.

With Obama actively running for reelection, Republicans have questioned the sincerity and timing of his immigration push.  House Speaker John A. Boehner's office said it hasn't even heard from the White House on the issue, evidence that immigration is not a serious legislative priority.

White House aides have not released a timetable for passing a bill, nor have they put forward a draft that could be the basis for congressional action.

Rep. Lamar Smith (R-Texas), chairman of the House Judiciary Committee, said in a statement: "It seems President Obama has once again put on his campaigner-in-chief hat. The president's push to legalize millions of illegal immigrants is purely political. The president wasn't able to pass his version of immigration reform when he had large Democratic majorities in the House and Senate because of bipartisan opposition."

Following the speech, Obama was to travel to Austin for a pair of fundraisers for his 2012 reelection campaign.

Dobbs: Democratic hacks embrace lunacy of amnesty

 

NEW YORK (CNN) -- This new Congress was supposed to be different. Instead, it is being led by a gaggle of partisan hacks pandering to the same special interests and corporate masters as the previous Republican-led Congress. So-called comprehensive immigration reform legislation is about to take a privileged position on the Democratic agenda in the Senate. It will likely succeed, just as it did in that august chamber last year, when 38 Democratic senators sided with the president to pass the bill and tried to slam amnesty down the throats of the House of Representatives and their 300 million constituents. And the now Democratic-controlled House is likely to embrace rather than combat the lunacy of amnesty. The same characters are already shoveling the same nonsense that overwhelmed reason in the Democratic Party and the Bush administration last year. Front and center in their march to madness: The bill's sponsor, Senator Ted Kennedy, Senate Majority Leader Harry Reid, Chair of the Congressional Hispanic Caucus Immigration Task Force Rep. Luis Gutierrez and House Judiciary Immigration Subcommittee Chairwoman Zoe Lofgren. Also meeting with Sen. Kennedy this week is the Archbishop of Los Angeles, Cardinal Roger Mahoney. The good senator is rounding up all of the usual suspects to lead the charge in advance of his introduction of the amnesty legislation, expected within the next week or two. Cardinal Mahoney has said point blank that his followers should disregard laws on immigration as a matter of Catholic conscience. This is the same Cardinal who fought all the way to the Supreme Court to keep secret all documents related to pedophilia among priests. But the Cardinal and other Catholic leaders are quick to embrace the laws of bankruptcy protection in order to not compensate victims of sexual abuse by members of the clergy and keep them out of the U.S. judicial system. So far, five such dioceses have done just that. The same corporate lobbyists and dominant special interests that drove last year's legislation are even more energetic this year, and they're enthusiastically helping Senator Kennedy write the new legislation. The biggest business lobby in the country, the U.S. Chamber of Commerce, and its associated organization, the Essential Worker Immigration Coalition, are actually writing parts of the bill, presumably so that none of our other senators would be unfairly burdened by actually doing their own work. Or perhaps in Senator Kennedy's estimation, they simply don't have the intellectual wherewithal to tackle the required mental heavy-lifting. Senator Kennedy and his staff claim they're not being secretive about the details of the so-called comprehensive immigration reform, but they're just not willing to tell the public or other senators how the bill is being constructed. Notable Republicans are growing increasingly frustrated by their exclusion from the process, taking some umbrage at the immigrant advocacy groups replacing them in that process.

And that's where the cleverly named Essential Worker Immigration Coalition comes in. Founded, staffed and supported by the Chamber itself, the coalition is made up of the same industries claiming they desperately need more workers. But there is a non-trivial disconnect here: In each of those industries, a labor shortage leads to higher wages. Unfortunately for the EWIC and the Chamber, and really for American workers, real wages in those industries have been declining, suggesting a very real surplus, not a deficit, of unskilled labor. Yet this President and this Congress continues to push the adoption of a guest-worker program. It's no wonder they have matching approval ratings in the low 30s. Real wages in the overall construction sector have fallen nearly 2 percent since the start of the decade and nearly 4 percent since the recent wage peak in 2003. Construction workers in 2006 were making the same per-hour salary as they did in 1965 (measured in 1982 dollars). Landscaping workers have also seen real wages fall by nearly 4 percent since 2001. For the leisure and hospitality sector, workers are making the same per-hour salary as they did in 1972. I've said for years that we cannot reform immigration if we cannot control it, and we cannot control it unless we secure our borders and ports. Once again it is clear that corporate America, special interests and the out-of-touch elites of the Senate have little regard for truth, working Americans, the common good and the national interest. The Democratic Party is now putting working Americans and their families in the exact same position as the Republicans: last. This Democratic-led Congress and this Republican President seem intent on pushing middle-class Americans, and truth, into the shadows. We asked for bipartisanship. But I don't think we can stand any more of it.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.

Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”

Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.

“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”

If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.

According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.

The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.

While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.

In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.

As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.

As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Obama Administration Challenges Arizona E-Verify Law

The Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hire illegal aliens, a law enacted by then-Governor Janet Napolitano.  (Solicitor General's Amicus Curiae Brief).  Called the “Legal Arizona Workers Act,” the law requires all employers in Arizona to use E-Verify and provides that the business licenses of those who hire illegal workers shall be repealed.  From the date of enactment, the Chamber of Commerce and other special interest groups have been trying to undo it, attacking it through a failed ballot initiative and also through a lawsuit. Now the Chamber is asking the United States Supreme Court to hear the case (Chamber of Commerce v. Candelaria), and the Obama Administration is weighing in against the law.

To date, Arizona’s E-Verify law has been upheld by all lower courts, including the Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as an exercise of a state’s traditional power to regulate businesses.  (San Francisco Chronicle, June 2, 2010).  Obama’s Justice Department, however, disagrees. Acting Solicitor General Neal Katyal said in his filing with the Supreme Court that the lower courts were wrong to uphold the statute because federal immigration law expressly preempts any state law imposing sanctions on employers hiring illegal immigrants.  Mr. Katyal argues that this is not a licensing law, but “a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction.”  (Solicitor General's Amicus Curiae Brief, p. 10).  This is the administration’s first court challenge to a state’s authority to act against illegal immigration, and could be a preview of the battle brewing over Arizona’s recent illegal immigration crackdown through SB 1070. 

Napolitano has made no comment on the Department of Justice’s decision to challenge the 2007 law, but federal officials said that she has taken an active part in the debate over whether to do so. (Politico, May 28, 2010).   As Governor of Arizona, Napolitano said she believed the state law was valid and became a defendant in the many lawsuits against it. (Id.).

We know illegal immigration is no longer really unlawful, but is it moral?

Usually Americans debate the fiscal costs of illegal immigration. Supporters of open borders rightly remind us that illegal immigrants pay sales taxes. Often their payroll-tax contributions are not later tapped by Social Security payouts.

Opponents counter that illegal immigrants are more likely to end up on state assistance, are less likely to report cash income, and cost the state more through the duplicate issuing of services and documents in both English and Spanish. Such to-and-fro talking points are endless.

So is the debate over beneficiaries of illegal immigration. Are profit-minded employers villains who want cheap labor in lieu of hiring more expensive Americans? Or is the culprit a cynical Mexican government that counts on billions of dollars in remittances from its expatriate poor that it otherwise ignored?

Two-thirds of those who have found employment under President Obama are immigrants, both legal and illegal, according to an analysis that suggests immigration has soaked up a large portion of what little job growth there has been over the past three years.

The Center for Immigration Studies is releasing the study Thursday morning, a day ahead of the final Labor Department unemployment report of the campaign season, which is expected to show a sluggish job market more than three years into the economic recovery.

That slow market, combined with the immigration numbers, could explain why Mr. Obama and Republican nominee Mitt Romney have struggled to find a winning jobs message in some of the country's hardest-hit postindustrial regions.

"It's extraordinary that most of the employment growth in the last four years has gone to the foreign-born, but what's even more extraordinary is the issue has not even come up during a presidential election that is so focused on jobs," said Steven A. Camarota, the center's research director, who wrote the report along with demographer Karen Zeigler.

His numbers are stark: Since the first quarter of 2009, the number of immigrants of working age (16 to 65) who are employed has risen 2 million, from 21.2 million to 23.2 million. During the same time, native-born employment has risen just 1 million, to reach 119.9 million.

It's a trend years in the making: Immigrants are working more, and native-born Americans are working less.

Amnesty for Immigrants?

To the Editor:

Jorge G. Castañeda and Douglas S. Massey (“Do-It-Yourself Immigration Reform,” Op-Ed, June 2) argue that we should grant amnesty to millions of illegal immigrants because illegal immigration from Mexico is down. But this conclusion is flawed.

First, they claim that Mexican illegal immigration is down because of decreased job opportunities. But this doesn’t mean that illegal immigrants won’t try to enter once the economy improves.

For this reason, we need to turn off the jobs magnet that encourages illegal immigration. We should expand E-Verify, a Web-based program that quickly identifies illegal immigrants working here and protects jobs for legal workers.

And since the Government Accountability Office has found that only 44 percent of the Southwest border is under the “operational control” of the Border Patrol, the border is still not secure and remains an open invitation to more illegal immigration.

Second, while illegal immigration has slightly diminished, it’s still a problem. Last year, more than 340,000 people were apprehended trying to enter the country illegally. But it’s estimated that there are two to three successful illegal crossings for every one thwarted. That means more than a million illegal immigrants could have entered last year.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

The administration says it has not been ignoring the border problems, noting that there now are airborne drones conducting surveillance flights; a full complement of 20,000 Border Patrol agents; a 653-mile border fence in place, and about $70 million sent in law-enforcement aid.

The governors say the border area remains unacceptably dangerous, citing the March murder of an Arizona rancher and the wounding of an Arizona deputy this month.

Attorney General Eric Holder says the Justice Department may sue Arizona over its new immigration law.


Washington (CNN) -- Attorney General Eric Holder said Sunday that the Justice Department was considering a federal lawsuit against Arizona's new immigration law.

"We are considering all of our options. One possibility is filing a lawsuit," Holder told NBC's "Meet the Press." Possible grounds for the lawsuit would be whether the Arizona law could lead to civil rights violations, he said.

The recently enacted Arizona law initially allowed police to ask anyone for proof of legal U.S. residency, based solely on a police officer's suspicion that the person might be in the country illegally. Arizona lawmakers soon amended the law so that officers could check a person's status only if the person had been stopped or arrested for another reason.

Critics say the law will lead to racial profiling, while supporters say it involves no racial profiling and is needed to crack down on increasing crime involving illegal immigrants.

In Arizona, the city councils of Tucson and Flagstaff have decided to challenge the new immigration law in court.

Holder told ABC's "This Week" program that one concern about the Arizona law is that "you'll end up in a situation where people are racially profiled, and that could lead to a wedge drawn between certain communities and law enforcement, which leads to the problem of people in those communities not willing to interact with people in law enforcement, not willing to share information, not willing to be witnesses where law enforcement needs them."

"I think we could potentially get on a slippery slope where people will be picked on because of how they look as opposed to what they have done, and that is, I think, something that we have to try to avoid at all costs," Holder added.

Holder said comprehensive federal immigration reform is the best approach for the problem of illegal immigrants crossing U.S. borders. His stance echoed the approach favored by President Obama, who last week criticized the Arizona law and said he wants Congress to work on the issue this year.

Comprehensive immigration reform would include continuing government efforts to secure borders from illegal immigrants, as well as steps to crack down on businesses that employ them, Obama said at a Cinco de Mayo celebration at the White House.

In addition, he said, those living illegally in the United States would have to pay a penalty and any taxes they owe, learn English and "make themselves right with the law" before starting the process of gaining U.S. citizenship.

The Chamber of Commerce is rolling out its "jobs and economy" political initiative today. As Politico reports, the blitz is "designed to drive voters toward '5 Questions to Ask Your Candidates', to be distributed by mail and online to millions of voters."

Here are the five, accompanied by five alternatives tied to reality rather than the Chamber's ideological phantasmagoria:

1. Do you believe that our free enterprise system is currently threatened?

Do you believe that entrenched corporate interests are blocking reforms vital to our country's future?

2. Do you believe that tax increases hurt job creation?

Do you believe that tax cuts to businesses already awash in cash and excess capacity will create jobs or waste money?

3. Do you think that the growth of government at all levels and the deficits that follow negatively impact job creation?

Do you think that deregulation of corporations and banks and the financial high that followed, crashing the economy, and doubling the national debt negatively impacted job creation?

4. Would you deal with the debt and deficit issues through increasing government revenue or decreasing government spending?

This country is struggling to respond to the worst downturn since the Great Depression, a direct result of the failed conservative policies that the Chamber of Commerce has advocated for decades. Over the last decade, we lost one in three manufacturing jobs. Inequality reached gilded age levels. CEOs and bankers pocketed million dollar bonuses while cooking the books and gambling on exotic securities, inflating the housing bubble until it burst. Health insurance companies kept a strangle hold on a health care system that costs twice as much as those in other industrial countries, leaves millions uninsured and provides worse health care. Catastrophic climate change went unaddressed. Big Oil and big coal insured that the US would forfeit the lead in the new green industrial revolution that is sweeping the world. Conservatives removed the cop on the corporate beat leading directly to the financial wilding and collapse, the horrors of Massey in West Virginia and BP in the Gulf, the risks of poisoned toys and infected eggs.

One would think that in the ruins, the Chamber of Commerce would have the common decency to reconsider its ideological positions. After all, they have not only been ruinous to workers and the country, they led directly to the economic free fall that devastated businesses. But no. Not one comma has been changed. Not a line changed in the stump speech. Mindless, without shame or sense, blind to the world around it, the Chamber gathers new millions from companies and peddles its poisonous nostrums.

Think of it as a parable for these grim economic times. On April 19th, McDonald's launched its first-ever national hiring day, signing up 62,000 new workers at stores throughout the country. For some context, that's more jobs created by one company in a single day than the net job creation of the entire U.S. economy in 2009. And if that boggles the mind, consider how many workers applied to local McDonald's franchises that day and left empty-handed: 938,000 of them. With a 6.2% acceptance rate in its spring hiring blitz, McDonald’s was more selective than the Princeton, Stanford, or Yale University admission offices.

It shouldn’t be surprising that a million souls flocked to McDonald's hoping for a steady paycheck, when nearly 14 million Americans are out of work and nearly a million more are too discouraged even to look for a job. At this point, it apparently made no difference to them that the fast-food industry pays some of the lowest wages around: on average, $8.89 an hour, or barely half the $15.95 hourly average across all American industries.

A federal judge barred the Bush administration yesterday from launching a planned crackdown on U.S. companies that employ illegal immigrants, warning of its potentially "staggering" impact on law-abiding workers and companies.

In a firm rebuke of the White House, U.S. District Judge Charles R. Breyer of San Francisco granted a preliminary injunction against the president's plan to press employers to fire as many as 8.7 million workers with suspect Social Security numbers, starting this fall.

President Bush made the effort the centerpiece of a re-energized enforcement drive against illegal immigration in August after the Senate rejected his proposal to overhaul immigration laws. But the court ruling -- sought by major American labor, business and farm organizations -- highlighted the chasm that the issue has opened between the Republican Party and its traditional business allies.

The case also called attention to the gulf between Washington rhetoric about the need to curtail illegal immigration and the economic reality that many U.S. employers rely on illegal labor, as well as to the government's inability for nearly three decades to develop adequate tools for identifying undocumented workers.

In a 22-page ruling, Breyer said the plaintiffs -- an unusual coalition that included the AFL-CIO, the American Civil Liberties Union and the U.S. Chamber of Commerce -- had raised serious questions about the legality of the administration's plan to mail Social Security "no-match" letters to 140,000 U.S. employers.

"There can be no doubt that the effects of the rule's implementation will be severe," Breyer wrote, resulting in "irreparable harm to innocent workers and employers."

The government letters are intended to warn employers for the first time that they must resolve questions about their employees' identities or fire them within 90 days. If they do not, employers could face "stiff penalties," including fines and even criminal prosecution, for violating a federal law that bars knowingly employing illegal workers, Homeland Security Secretary Michael Chertoff said when he announced the plan Aug. 10.

The plaintiffs convinced the judge that the Social Security Administration database includes so many errors -- incorporated in the records of about 9.5 million people in 2003 alone -- that its use in firings would unfairly discriminate against tens of thousands of legal workers, including native-born and naturalized U.S. citizens, and cause major workforce disruptions that would burden companies.

"The government's proposal to disseminate no-match letters affecting more than eight million workers will, under the mandated time line, result in the termination of employment to lawfully employed workers," the judge wrote. "Moreover the threat of criminal prosecution . . . reflects a major change in DHS policy."

Breyer also said that the government may have ignored a 1980 law, the Regulatory Flexibility Act, that requires it to weigh the cost of imposing new regulations that would significantly burden small-business owners. Randel K. Johnson, a vice president of the Chamber of Commerce, said the ruling shows that "the government cannot do anything it wants simply in the name of enforcement. They've got to be careful about building their record and complying with the law."

In a statement, AFL-CIO President John J. Sweeney said: "This is a significant step towards overturning this unlawful rule, which would give employers an even stronger way to keep workers from freely forming unions. . . . More than 70% of SSA discrepancies refer to U.S. citizens."

Chertoff expressed disappointment with the decision and said the administration will continue to aggressively enforce immigration laws while considering an appeal, which plaintiffs' attorneys said could take at least nine months.

"Today's ruling is yet another reminder of why we need Congress to enact comprehensive immigration reform," Chertoff said. "The American people have been loud and clear about their desire to see our nation's immigration laws enforced."

Several analysts said the Bush administration's plan appeared to be designed to push business interests back into the debate by demonstrating that the failure of legislative reform efforts would carry costs, and to reassure conservative lawmakers who oppose illegal immigration that the White House is able and willing to crack down on offenders.

Doris Meissner, former commissioner of the U.S. Immigration and Naturalization Service and now a senior fellow at the nonpartisan Migration Policy Institute in Washington, said the ruling "shows how ineffective the current laws are."

"It reinforces the opinion that many of us hold that until you have a better legal framework -- which requires new legislation -- we're stuck very much with the status quo," Meissner said.

In a statement, Rep. Brian P. Bilbray (R-Calif.), an opponent of Bush's approach who won election to the House last year on the issue, criticized the court. "What part of 'illegal' does Judge Breyer not understand?" he said. "At a time when the federal government is finally trying to enforce current immigration law, we cannot have activist judges stand in the way of doing what is right."

The scope of the problem is uncontested. A three-year government audit ending in 2001 found "widespread" misuse of Social Security numbers by illegal immigrants, who often present fake or fraudulent documents to obtain jobs. Overall, 7.2 million illegal immigrants account for at least 10 percent of low-skilled U.S. workers and 5 percent of the total U.S. workforce, according to a Pew Hispanic Center analysis of 2005 census data.

Illegal immigrants make up even greater portions of workers in specific industries, including 24 percent in farming, 17 percent in cleaning, 14 percent in construction and 12 percent in food preparation. But the government's record in developing tools to screen such workers is spotty, largely because of successful efforts by employers, labor unions and civil rights groups to water them down.

A government program to verify the validity of new hires' Social Security numbers, proposed in concept in 1981 and launched in 1996, remains voluntary and covers only about 23,000 of 8 million U.S. employers. It is also hampered by a high false-alarm rate and the limited ability to detect identity theft involving stolen or fraudulent numbers. Between June 2004 and May 2006, it erroneously rejected 11 percent of foreign-born U.S. citizens and 1.3 percent of authorized foreign-born noncitizens, according to a report provided to Congress.

In protest, Illinois Gov. Rod Blagojevich (D) signed legislation in August that bars companies in his state from participating in the program until it is 99 percent accurate.

The federal government has mailed Social Security no-match letters to employers since 1994, but such notices were generally silent about workers' immigration status and employers did not face liability. In June 2006, the Department of Homeland Security proposed using the letters to combat immigration fraud involving existing employees, and it finalized its plans this summer. The AFL-CIO and the ACLU filed suit to halt the Sept. 4 start of the mailings, and they were joined by the U.S. Chamber of Commerce and the trade associations for the agriculture, restaurant and construction industries.

On Aug. 31, U.S. District Judge Maxine M. Chesney issued a temporary restraining order pending an Oct. 1 hearing before Breyer, who was appointed by President Bill Clinton in 1997 and is the brother of Supreme Court Justice Stephen G. Breyer.

Big Business Takes a Look at Troubled Border  … and wants them opened wider for hordes more illegals!

The U.S. Chamber of Commerce, one of the nation’s largest business lobbies, released a report last week detailing its recommended “Steps to a 21st Century U.S.- Mexico Border.”  (U.S. Chamber of Commerce Press Release, June 8, 2011)  The report addresses border issues that most affect the Chamber’s members and recommends action on topics such as trade, security, travel and immigration.  (See Steps to a 21st Century U.S.-Mexico Border) The Chamber asserts that the U.S. and Mexico trade more than $1 billion worth of goods every day, and as such, building a strong and stable relationship with Mexico is of paramount importance to U.S. business.  (Id.

The Chamber of Commerce report makes clear that business industries in the U.S. are affected by the escalating violence and turmoil that have come to characterize our nation’s Southern border.  Drug cartel activity has made “extreme criminal behavior” a prominent threat to U.S. business trade with Mexico.  (Id.)  The report states that significant sums of money are being spent to secure employees and provide armored transportation.  Companies conducting business with Mexico must factor in the high costs of protecting both their employees and their product, a cost which is being passed on to the consumer. 

Despite these dangers, the Chamber’s report still promotes the controversial cross-border trucking provisions of NAFTA.  The report states that eighty percent of U.S. trade products with Mexico are carried across the border by truck.  (Steps to a 21st Century U.S.-Mexican Border, p. 5)  The report, however, does not address the many concerns which have delayed implementation of the program for well over a decade, including concerns about drug-related violence.  (See FAIR Legislative Update, March 7, 2011; FAIR Legislative Update, Jan. 10, 2011) 

The Chamber also promotes expanding the Merida Initiative.  The Merida Initiative is an agreement through which the U.S. has agreed to support the governments in Mexico, Central America, Dominican Republic, and Haiti in their respective battles against organized crime.  (See U.S. Department of State)  The purpose of providing funds and other resources to these countries is to promote the national security interest of the U.S.; prevent further violence from spilling over the border; and deter drug and gang-related transnational criminal organizations from coming into our country.  (See Merida Initiative Fact Sheet

Finally, the report agrees that “illegal immigration is one of the most significant problems facing our border today.”  (Steps to a 21st Century U.S.-Mexican Border, p. 20)  The Chamber calls for immigration reform to promote security in the U.S. and create economic growth, but argues that increasing legal immigration will actually decrease illegal immigration and the help ease the related security concerns hurting businesses.

Most Illegal Immigrant Families Collect Welfare

Surprise, surprise; Census Bureau data reveals that most U.S. families headed by illegal immigrants use taxpayer-funded welfare programs on behalf of their American-born anchor babies. Even before the recession, immigrant households with children used welfare programs at consistently higher rates than natives, according to the extensive census data collected and analyzed by a nonpartisan Washington D.C. group dedicated to researching legal and illegal immigration in the U.S. The results, published this month in a lengthy report, are hardly surprising. Basically, the majority of households across the country benefitting from publicly-funded welfare programs are headed by immigrants, both legal and illegal. States where immigrant households with children have the highest welfare use rates are Arizona (62%), Texas, California and New York with 61% each and Pennsylvania(59%).The study focused on eight major welfare programs that cost the government $517 billion the year they were examined. They include Supplemental Security Income (SSI) for the disabled, Temporary Assistance to Needy Families (TANF), a nutritional program known as Women, Infants and Children (WIC), food stamps, free/reduced school lunch, public housing and health insurance for the poor (Medicaid).Food assistance and Medicaid are the programs most commonly used by illegal immigrants, mainly on behalf of their American-born children who get automatic citizenship. On the other hand, legal immigrant households take advantage of every available welfare program, according to the study, which attributes it to low education level and resulting low income. The highest rate of welfare recipients come from the Dominican Republic (82 %), Mexico and Guatemala (75%) and Ecuador (70%), according to the report, which says welfare use tends to be high for both new arrivals and established residents.

Jose Herria emigrated illegally from Mexico to Stockton, Calif., in 1997 to work as a fruit picker. He brought with him his wife, Felipa, and three children, 19, 12 and 8 – all illegals. When Felipa gave birth to her fourth child, daughter Flor, the family had what is referred to as an "anchor baby" – an American citizen by birth who provided the entire Silverio clan a ticket to remain in the U.S. permanently. But Flor was born premature, spent three months in the neonatal incubator and cost the San Joaquin Hospital more than $300,000. Meanwhile, oldest daughter Lourdes married an illegal alien gave birth to a daughter, too. Her name is Esmeralda. And Felipa had yet another child, Cristian. The two Silverio anchor babies generate $1,000 per month in public welfare funding for the family. Flor gets $600 a month for asthma. Healthy Cristian gets $400. While the Silverios earned $18,000 last year picking fruit, they picked up another $12,000 for their two "anchor babies." While President Bush says the U.S. needs more "cheap labor" from south of the border to do jobs Americans aren't willing to do, the case of the Silverios shows there are indeed uncalculated costs involved in the importation of such labor – public support and uninsured medical costs. In fact, the increasing number of illegal aliens coming into the United States is forcing the closure of hospitals, spreading previously vanquished diseases and threatening to destroy America's prized health-care system, says a report in the spring issue of the Journal of American Physicians and Surgeons. "The influx of illegal aliens has serious hidden medical consequences," writes Madeleine Pelner Cosman, author of the report. "We judge reality primarily by what we see. But what we do not see can be more dangerous, more expensive, and more deadly than what is seen." According to her study, 84 California hospitals are closing their doors as a direct result of the rising number of illegal aliens and their non-reimbursed tax on the system. "Anchor babies," the author writes, "born to illegal aliens instantly qualify as Disability Income."citizens for welfare benefits and have caused enormous rises in Medicaid costs and stipends under Supplemental Security Income and

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.  

Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.

The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety. 

About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars. 

Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.

His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

Anchor Babies Grab One Quarter of Welfare Dollars in LA Co


The anchor baby scam has proven lucrative for illegal aliens in Los Angeles County, at considerable cost to our own poor and downtrodden legal citizenry.

The numbers show that more than $50 million in CalWORKS benefits and food stamps for January went to children born in the United States whose parents are in the country without documentation. This represents approximately 23 percent of the total benefits under the state welfare and food stamp programs, Antonovich said.


"When you add this to $350 million for public safety and nearly $500 million for health care, the total cost for illegal immigrants to county taxpayers far exceeds $1 billion a year -- not including the millions of dollars for education," Antonovich said.


I love children and I'm all for compassion -- smart, teach-them-to-fish compassion. But when laws, the Constitution, and enforcement allow illegal aliens (the operative word here being "illegal") to insinuate themselves into our nation and bleed us of our precious financial resources, then laws, the Constitution and enforcement need to be changed.

Anchor Baby Power

La Voz de Aztlan has produced a video in honor of the millions of babies that have been born as US citizens to Mexican undocumented parents. These babies are destined to transform America. The nativist CNN reporter Lou Dobbs estimates that there are over 200,000 "Anchor Babies" born every year whereas George Putnam, a radio reporter, says the figure is closer to 300,000. La Voz de Aztlan believes that the number is approximately 500,000 "Anchor Babies" born every year.

County’s Monthly Welfare Tab For Illegal Aliens $52 Million

As the mainstream media focuses on a study that reveals a sharp decline in the nation’s illegal immigrant population, monthly welfare payments to children of undocumented aliens increased to $52 million in one U.S. county alone.

The hoopla surrounding last week’s news that the annual flow of illegal immigrants into the U.S. dropped by two-thirds in the past decade overlooked an important matter; the cost of educating, incarcerating and medically treating illegal aliens hasn’t decreased along with it, but rather skyrocketed to the tune of tens of billions of dollars annually.

Those figures don’t even include the extra millions that local municipalities dish out on welfare payments to the U.S.-born children of illegal immigrants, commonly known as anchor babies. In Los Angeles County alone that figure increased by nearly $4 million in the last year, sticking taxpayers with a whopping $52 million tab to provide illegal immigrants’ offspring with food stamps and other welfare benefits for just one month.

That means the nation’s most populous county, in the midst of a dire financial crisis, will spend more than $600 million this year to provide families headed by illegal immigrants with welfare benefits. In each of the past two years Los Angeles County taxpayers have spent about half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants. Additionally, the county spends $550 million on public safety and nearly $500 million on healthcare for illegal aliens.
