With
the support of 70 percent of its citizens, Arizona has ordered sheriffs and
police to secure the border and remove illegal aliens, half a million of whom
now reside there.
Arizona
acted because the U.S. government has abdicated its constitutional duty to protect
the states from invasion and refuses to enforce America's immigration laws.
"We
in Arizona have been more than patient waiting for Washington to act,"
said Gov. Jan Brewer. "But decades of inaction and misguided policy have
created an unacceptable situation."
We
have a crisis in Arizona because we have a failed state in Washington.
What is the response of
Barack Obama, who took an oath to see to it that federal laws are faithfully
executed?
He is siding with the
law-breakers. He is pandering to the ethnic lobbies. He is not berating a
Mexican regime that aids and abets this invasion of the country of which he is
commander in chief. Instead, he attacks the government of Arizona for trying to
fill a gaping hole in law enforcement left by his own dereliction of duty.
He
has denounced Arizona as "misguided." He has called on the Justice
Department to ensure that Arizona's sheriffs and police do not violate anyone's
civil rights. But he has said nothing about the rights of the people of Arizona
who must deal with the costs of having hundreds of thousands of lawbreakers in
their midst.
How's
that for Andrew Jackson-style leadership?
Obama
has done everything but his duty to enforce the law.
Undeniably,
making it a state as well as a federal crime to be in this country illegally,
and requiring police to check the immigration status of anyone they have a
"reasonable suspicion" is here illegally, is tough and burdensome.
But what choice did Arizona have?
The
state has a fiscal crisis caused in part by the burden of providing schooling
and social welfare for illegals and their families, who consume far more in
services than they pay in taxes and who continue to pour in. Even John McCain
is now calling for 3,000 troops on the border.
Police
officers and a prominent rancher have been murdered. There have been
kidnappings believed to be tied to the Mexican drug cartels. There are nightly
high-speed chases through the barrios where innocent people are constantly at
risk.
If
Arizona does not get control of the border and stop the invasion, U.S. citizens
will stop coming to Arizona and will begin to depart, as they are already
fleeing California.
A country that cannot control
its borders isn't really a country anymore, Ronald Reagan reminded us.
What
we are talking about here is the Balkanization and breakup of a nation into
ethnic enclaves. A country that cannot

The
tasks that Arizonans are themselves undertaking are ones that belong by right,
the Constitution and federal law to the Border Patrol, Immigration and Customs
Enforcement, and Homeland Security.
Arizona
has been compelled to assume the feds' role because the feds won't do their
job. And for that dereliction of duty the buck stops on the desk of the
president of the United States.
Why
is Obama paralyzed? Why does he not enforce the law, even if he dislikes it, by
punishing the businessmen who hire illegals and by sending the 12 million to 20
million illegals back home? President Eisenhower did it. Why won't he?

Obama soft on illegals enforcement
Arrests of
illegal immigrant workers have dropped precipitously under President Obama,
according to figures released Wednesday. Criminal arrests, administrative
arrests, indictments and convictions of illegal immigrants at work sites all
fell by more than 50 percent
from fiscal 2008 to fiscal 2009.
The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

What will
America stand for in 2050?
The US should
think long and hard about the high number of Latino immigrants.

President Obama
has encouraged Americans to start laying a new foundation for the country – on
a number of fronts. He has stressed that we'll need to have the courage to make
some hard choices. One of those hard choices is how to handle immigration. The US
must get serious about the tide of legal and illegal immigrants, above all from
Latin America.
It's not just a
short-run issue of immigrants competing with citizens for jobs as unemployment
approaches 10 percent or the number of uninsured straining the quality of
healthcare. Heavy immigration from Latin America threatens our cohesiveness as
a nation.
The political
realities of the rapidly growing Latino population are such that Mr. Obama may
be the last president who can avert the permanent, vast underclass implied by
the current Census Bureau projection for 2050.
Do I sound like a
right-wing "nativist"? I'm not. I'm a lifelong Democrat; an early and
avid supporter of Obama. I'm gratified by his nomination of Sonia Sotomayor to
the Supreme Court. I'm also the grandson of Eastern European Jewish immigrants;
and a member, along with several other Democrats, of the advisory boards of the
Federation for American Immigration Reform and Pro English. Similar concerns
preoccupied the distinguished Democrat Barbara Jordan when she chaired the
congressionally mandated US Commission on Immigration Reform in the 1990s.
Congresswoman
Jordan was worried about the adverse impact of high levels of legal and illegal
immigration on poor citizens, disproportionately Latinos and African-Americans.

The healthcare
cost of the illegal workforce is especially burdensome, and is subsidized by
taxpayers. To claim Medicaid, you must be legal, but as the Health and Human
Services inspector general found, 47 states allow self-declaration of status
for Medicaid. Many hospitals and clinics are going broke because of the
constant stream of uninsured, many of whom are the estimated 12 million to 15
million illegal immigrants. This translates into reduced services, particularly
for lower-income citizens.
The US population
totaled 281 million in 2000. About 35 million, or 12.5 percent, were Latino.
The Census Bureau projects that our population will reach 439 million in 2050,
a 56 percent increase over the 2000 census. The Hispanic population in 2050 is
projected at 133 million – 30 percent of the total and almost quadruple the
2000 level. Population growth is the principal threat to the environment via
natural resource use, sprawl, and pollution. And population growth is fueled
chiefly by immigration.
Consider what
this, combined with worrisome evidence that Latinos are not melting into our
cultural mainstream, means for the US. Latinos have contributed some positive
cultural attributes, such as multigenerational family bonds, to US society. But
the same traditional values that lie behind Latin America's difficulties in
achieving democratic stability, social justice, and prosperity are being
substantially perpetuated among Hispanic-Americans.
Prominent Latin
Americans have concluded that traditional values are at the root of the
region's development problems. Among those expressing that opinion: Peruvian
writer Mario Vargas Llosa; Nobelist author Octavio Paz, a Mexican; Teodoro
Moscoso, a Puerto Rican politician and US ambassador to Venezuela; and
Ecuador's former president, Osvaldo Hurtado.
Latin America's
cultural problem is apparent in the persistent Latino high school dropout rate
– 40 percent in California, according to a recent study – and the high
incidence of teenage pregnancy, single mothers, and crime. The perpetuation of
Latino culture is facilitated by the Spanish language's growing challenge to
English as our national language. It makes it easier for Latinos to avoid the
melting pot and for education to remain a low priority, as it is in Latin
America – a problem highlighted in recent books by former New York City deputy
mayor Herman Badillo, a Puerto Rican, and Mexican-Americans Lionel Sosa and
Ernesto Caravantes.
Language is the
conduit of culture. Consider: There is no word in Spanish for
"compromise" (compromiso means "commitment") nor for
"accountability," a problem that is compounded by a verb structure
that converts "I dropped (broke, forgot) something" into "it got
dropped" ("broken," "forgotten").
As the USAID
mission director during the first two years of the Sandinista regime in
Nicaragua, I had difficulty communicating "dissent" to a government
minister at a crucial moment in our efforts to convince the US Congress to
approve a special appropriation for Nicaragua.
I was later told
by a bilingual, bicultural Nicaraguan educator that when I used
"dissent" what my Nicaraguan counterparts understood was
"heresy." "We are, after all, children of the Inquisition,"
he added.
In a letter to me
in 1991, Mexican-American columnist Richard Estrada described the essence of
the problem of immigration as one of numbers. We should really worry, he wrote,
"when the numbers begin to favor not only the maintenance and
replenishment of the immigrants' source culture, but also its overall growth,
and in particular growth so large that the numbers not only impede assimilation
but go beyond to pose a challenge to the traditional culture of the American
nation."
Obama should
confront the challenges by enforcing immigration laws on employment to help end
illegal immigration. We should calibrate legal immigration annually to (1) the
needs of the economy, as Ms. Jordan urged, and (2) past performance of
immigrant groups with respect to acculturation.
We must declare
our national language to be English and discourage the proliferation of
Spanish- language media. We should limit citizenship by birth to the offspring
of citizens. And we should provide immigrants with easy-to-access educational
services that facilitate acculturation, including English language,
citizenship, and American values.

According a Gallup Poll, a full 62 per cent of the American people believe that stopping illegal immigration should be a top priority of the U.S. government. Unfortunately for the American people, Secretary of Homeland Security Janet Napolitano is not numbered among that 62%. And she is the person who is supposed to be enforcing the law. Last year, Napolitano opened the floodgates of illegal immigration by having the Department of Homeland Security review all cases then before the immigration courts with an eye towards halting the deportation of many illegal immigrants allegedly with no criminal backgrounds. (JW uncovered records demonstrating this to be an utter lie. Many of the illegals let off the hook were convicted of violent crimes.)
Not satisfied with skirting the law in 2011, Napolitano decided to abandon it altogether in 2012. Accordingly, on June 15, 2012, she announced: "By this memorandum, I am setting forth how, in the exercise of our prosecutorial discretion, the Department of Homeland Security (DHS) should enforce the Nation's immigration laws against certain young people who were brought to this country as children and know only this country as home."
In short, this amounted to blanket "temporary" amnesty for illegals under the age of 30. With her single statement, she simply declared upwards of one million illegal aliens entirely legal. Just like that. No legislation. No debate. No votes. No court rulings. The Constitution of the United States notwithstanding. And, in so doing, she violated the Oath of Office she had taken when sworn in as secretary of Homeland Security on January 21, 2009: "I, do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God."

Illegal immigrants in Colorado seize upon new visa waiver

Alejandro Esparza
texted his wife a smiley face Wednesday.
The occasion for
the momentous digital grin was a small change in a convoluted immigration
regulation. On paper, that change may seem like an insignificant reform, but
for American families of certain illegal immigrants such as Esparza, it
represents a new opportunity to obtain a green card without tearing loved ones
apart.
Under the old
rules, Esparza, who entered the United States illegally when he was 15 years
old, would have had to return to his home country of Mexico to apply for a
waiver from being barred re-entry to the United States. The waiver would be
based on the hardship his absence would create for his wife in Denver.
That process could
drag on for months or years — and it came with a great risk. If Esparza, now
27, was turned down for the waiver, he would be barred from returning to the
United States for three to 10 years because he had entered the country
illegally.
The
changed regulation, announced last week by Homeland Security Secretary Janet
Napolitano, makes it possible to apply for the waiver without leaving the
country. Immigrants still have to return to a home country to complete the
process and pick up a visa, but they can go with the waiver in hand and the
prospect that they will be away for weeks, not months or years.
"This is
really, really, really good news for us, said Esparza's wife, Magdalena
Mendoza.
It is so good the
family is now viewing the necessary trip back to Mexico as a vacation rather
than an anxiety-provoking separation. Mendoza and their three daughters will
accompany Esparza on the journey to complete what she calls "the
procedure."
When they return,
they will still have their home and jobs. Their girls can continue in their
schools.
All of that could
have been lost under the old regulations, which American Immigration Lawyers
Association president Laura Lichter calls "downright dangerous."
"This is a
really good interim solution to a problem that we shouldn't have anyway,"
Lichter said of the change to the waiver regulation.
There is no
estimate of how many illegal immigrants will be eligible for the new waivers,
which will open for applications March 4. Lichter, who practices immigration
law in Denver, said she has hundreds of clients who will be able to take
advantage of it.
To qualify, illegal
immigrants must have a citizen spouse or be under 21 and have citizen parents
in the United States. There must be proof that the citizen family members would
face extreme hardship due to the absence of the immigrant.
Many, including
Cesar Lopez of the Vail area, had been waiting for this change since it was
promised last spring as a step to keep families together in the absence of
comprehensive immigration reform.
Lopez has been
married to a citizen for five years and has two toddlers — one with a chronic
medical problem and another ready to enter kindergarten.
If he had to be
away in Mexico for an extended time, his wife, Rosa Martinez, said she didn't
know how she would have survived as the sole parent, breadwinner and part-time
college student.
"I was really
scared because it would be a horrible thing if he was gone," she said.
Moving the whole
family to Mexico was a feared option because of the crime and poverty rates
there and the fact that the elementary schools are behind U.S. schools,
Martinez said.
The relief some
families of illegal immigrants are feeling with the new rules is tempered by
what immigration lawyers and immigrant advocates are calling deficiencies in
the change.
Adult undocumented
children of U.S. citizens are not eligible for the hardship waivers even though
they might be important caregivers for parents. Brothers and sisters and other
immediate relatives are also not eligible.
"We are
disappointed that the rules change does not apply to spouses of legal permanent
residents and adult children of U.S. citizens, as they are often the caregivers.
We hope that, as the changes are implemented, the administration will see the
wisdom in expanding the hardship waivers to these critical family
members," said Eliseo Medina of Service Employees International Union.
Lichter was also
disappointed there is no provision in the new rules to help families that can't
pay the $585 filing fee.
She said she will
continue to warn her clients that the new rules do not come with any full
guarantee.
"There are
still risks. Nothing is ever 100 percent guaranteed," she said. "This
is just a way of removing one of the nonsensical roadblocks."
