REPORTING FROM MEXICO CITY -- The Mexican economy is "hemorrhaging" billions of dollars annually because of money laundering, tax evasion and other forms of corruption, a new study has found.

Mexico lost $872 billion between 1970 and 2010, the Washington-based advocacy organization Global Financial Integrity said in an 80-page report released Monday. That averages a whopping 5.2% of gross domestic product, the group said.

“This is an enormously damaging reality for emerging markets and developing countries ... an enormously damaging drainage of resources," the group's director, Raymond W. Baker, said at a news conference.

It is money that could have been used to invest in education, to build roads or to fight the drug cartels, he noted, in a country with one of the largest gaps between rich and poor. "The negative ramifications are huge for everyday Mexicans,” he said.

One of the most common ways for money to flow illegally out of Mexico is trade manipulation or incorrect pricing, Baker said, when companies or individuals falsify invoices and undervalue or overvalue exports or imports. The Times recently reported that "trade-based" money laundering was fast becoming a favored method of powerful drug cartels.

"Trade-based laundering takes advantages of blind spots in international commerce," The Times said. "And the huge, and growing, volume of legitimate trade between Mexico and the U.S. — now nearly $400 billion a year — makes it extraordinarily hard to detect."

In its report, Global Financial Integrity said illicit cash outflows from Mexico soared after the 1994 North American Free Trade Agreement, or NAFTA, went into effect -- from an annual average in the 1980s of $10 billion to $50 billion after 2000.

"NAFTA freed up trade," Baker said. "But it also freed up the opportunity to abuse trade."

EDINBURG, Texas (AP) -- It was a jackpot weekend for U.S. Border Patrol agents in South Texas.

A Border Patrol statement says agents seized nearly 33,000 pounds -- or 16 1/2 tons -- of marijuana over the weekend in South Texas.

The biggest bust came Sunday, when agents and Starr County sheriff's deputies seized more than 3 1/2 tons of pot Sunday at a ranch house north of Garciasville, about 90 miles up the Rio Grande from Brownsville.

The patrol values the 640-plus bales of marijuana at more than $5.7 million.

Another seizure came Friday, when undercover agents seized 1,500 pounds of marijuana with an estimated value of more than $1.2 million from several people loading bundles of marijuana into a pickup truck near Escobares, 100 miles up the Rio Grande from Brownsville.

Authorities say they have captured an alleged member of the Zetas drug gang who confessed to killing at least 75 people in northern Mexico.

Nuevo Leon state Attorney General Adrian de la Garza says Enrique Elizondo Flores told investigators 36 of his victims were bus passengers traveling through the town of Cerralvo, near the border with Texas.

De la Garza said Monday that Elizondo was detained Jan. 20 but that authorities needed to verify details of his confession before announcing his arrest.

De la Garza says the 35-year-old suspect told investigators he was in charge of stopping the arrival of the rival Gulf drug cartel members to the towns of Cerralvo and General Trevino.

SAN DIEGO — A former high-ranking member of the Arellano Felix drug cartel has been sentenced to 16 years in prison in San Diego for coordinating the shipments of tons of cocaine from Colombia to Mexico and eventually to the U.S.

He had been in prison in Mexico awaiting trial since 2001. He was extradited to the U.S. to face federal charges in 2010 for narcotics trafficking, money laundering and organized crime-related offenses and pleaded guilty in July.

Federal prosecutors say Yanez was the chief operator of the cartel in Mexico City between 1995 and 2001. During that time, he allegedly orchestrated the shipments of 5 to 10 tons of cocaine that made its way to the U.S.

Latinos won't forget Romney's 'anti-immigrant' talk

We don't. We never forget a slight. And, in that respect, Romney has given us plenty to remember.
Miami, Florida (CNN) -- Responding angrily to a campaign ad from Newt Gingrich accusing him of being anti-immigrant, Mitt Romney insisted during last week's Republican debate at the University of North Florida in Jacksonville that he has no problem with immigrants.

Perhaps not. But the dishonest and cynical way in which the former governor of Massachusetts has dealt with the immigration issue on the campaign trail shows that he has a problem being consistent.

In Iowa, New Hampshire and South Carolina, Romney attacked Texas Gov. Rick Perry and former House Speaker Newt Gingrich for immigration proposals that Romney said amounted to "amnesty" for illegal immigrants.

But last week, in Florida, where Hispanics account for 22.5 percent of the population, we caught a glimpse of a kinder and gentler Romney. He told the Hispanic Leadership Network, a center-right group, that he would create a "temporary worker permit" for the estimated 11 million illegal immigrants in the United States.

However, Romney said, when the permit expires, workers wouldn't be forced to leave the United States. Instead, they would decide their next move themselves depending on their job prospects. His hope is that, at this point, many illegal immigrants would simply "self-deport."

Good luck with that. Like former Wyoming Sen. Al Simpson used to say: "There is nothing more permanent than a temporary worker." People fall in love. They get married. They have children. And it becomes harder to remove them, even if we wanted to. Besides, it's not clear that Romney wants to remove anyone. The idea of voluntary deportation is absurd.

I bet none of this is going over very well with the voters in the first three primary states who cast their lots for Romney, thinking he was going to be tough on illegal immigration only to find out that he doesn't even have the stomach to forcibly deport undocumented immigrants.

Maybe Romney should ask President Barack Obama for pointers. The Obama administration has deported more than 1.2 million illegal immigrants and offers no apologies.

Meanwhile, in a telenovela unique to the Florida primary, a group of Latinos who supports Romney called on Gingrich to yank a commercial labeling the frontrunner "anti-immigrant." A similar request came from Florida Sen. Marco Rubio, who while not endorsing Romney, defended him against the charge that he was anti-immigrant.

Who does Rubio think he is? His own history with the immigration issue is spotty at best.

In 2011, Rubio joined Rep. Lamar Smith of Texas in his efforts to require businesses to participate in a government-run "e-verify" program which is supposed to tell them if a Social Security number is authentic.

Rubio also supports the Arizona immigration law -- and presumably others like it around the country -- which forces local and state law officials to enforce federal immigration statutes. In addition, he opposes the DREAM Act, which would give legal status to illegal immigrants who go to college or serve in the military because he considers it "part of some broader effort to grant blanket amnesty."

Last week, in a good speech to the Hispanic Leadership Network, Rubio acknowledged that many Republicans -- including himself -- have been slow to condemn anti-immigrant rhetoric from other Republicans.

Still, I don't care what Rubio says. Romney has, in this campaign, advanced a tone that is "anti-immigrant."

It was Romney who -- bringing back a tactic he used in 2008 against Arizona Sen. John McCain -- painted Rick Perry as soft on illegal immigration. Romney attacked Perry for signing a bill in the Lone Star State that allowed undocumented students to attend state colleges and universities and pay in-state tuition rates. The narrative that Romney pushed was simple: "Illegal immigrants are takers. They take advantage of in-state tuition rates. They take spots in university campuses that should go to U.S. citizens. They take, take, and take some more." Never did Romney mention all that illegal immigrants contribute to society -- by paying taxes, increasing productivity, creating competition, and doing jobs that Americans won't do.

Later, with Perry vanquished into the single digits, Romney used the same line of attack against Gingrich, accusing him of advocating a kind of amnesty for illegal immigrants after Gingrich said that he wanted to provide undocumented workers with a "red card" that allowed them to work legally in the country. Romney accused Gingrich of letting illegal immigrants take jobs from American workers.

Now as he competes this week for Hispanic votes in Florida -- and, on Feb 4, in Nevada, where Latinos account for 26.5 percent of the population -- Romney must be hoping that Latinos have bad memories.

We don't. We never forget a slight. And, in that respect, Romney has given us plenty to remember.

WASHINGTON – Calling the nation’s immigration laws “sorely outdated and in need of revision,” Homeland Security Secretary Janet Napolitano pressed Monday for passage of the DREAM Act, saying it is the most-urgently needed change to immigration policy.

In response to another question after her second annual State of America’s Homeland Security address, Napolitano also acknowledged that “serious mistakes were made” in Operation Fast and Furious, the government’s botched gun-trafficking investigation.

But much of her speech was dedicated to the successes of her department and the challenges that remain, including threats of cyber-terrorism, the difficulties of responding to natural disasters and the need to balance fair trade with safe trade.
Napolitano touted the department’s use of a “risk-based, information-driven approach to security” in combating security threats.

She boasted about President Barack Obama’s commitment to securing the U.S.-Mexico border, pointing to a 53 percent decline in illegal immigrant attempts over the past three years as measured by Border Patrol apprehensions. She also cited an increase in seizures of illegal drugs and weapons along the border.

“We are also enforcing our immigration laws in smart, effective ways designed to protect communities while, to the greatest extent possible under current law, fostering legitimate employment and foreign investment,” Napolitano said.
But Rep. Jeff Flake, R-Mesa, called Napolitano’s assessment of the U.S.-Mexico border overly optimistic.

“In talking with ranchers and other residents near the border, and given the continued violence in the Tucson sector specifically, the approach to secure the border the Obama administration is pursuing is clearly insufficient,” Flake said in a prepared statement.

Napolitano, who was governor of Arizona before being appointed by President Obama to head the department, conceded much work was still needed along the border. But she said lawmakers need to adopt policy changes to solve the nation’s complex immigration problems.

“The bottom line is that our nation’s current immigration laws are sorely outdated and in need of revision,” she said. “President Obama views such a revision as both a matter of fairness and as an economic necessity.”
In a question-and-answer period immediately following her address, Napolitano pointed to passage of the DREAM Act when asked what one aspect of immigration reform was most necessary.

“If you have to take just one element out of the whole universe of immigration that needs to be fixed, should be fixed, and came very close to being fixed by the Congress … it would be that,” Napolitano said.

Napolitano conceded problems with Operation Fast and Furious, an investigation by Phoenix office of the Bureau of Alcohol, Tobacco, Firearms and Explosives in which agents let illegal gun-buyers go in hopes of tracing guns to larger gun-trafficking rings. The operation, begun in late 2009, lost track of about 2,000 guns and 10,000 rounds of ammunition.

U.S. Attorney General Eric Holder is scheduled to testify to a House committee Thursday about the operation.

“I think it was acknowledged that mistakes, serious mistakes were made there,” Napolitano said. “The key question is making sure those kinds of mistakes, from my standpoint, are never again repeated.”

That statement underwhelmed a spokesman for Arizona Gov. Jan Brewer, a prominent critic of the Obama administration’s border policies.

“To say that mistakes were made during Fast and Furious is the understatement of the year, but it’s nice that Secretary Napolitano has acknowledged as much,” said Matthew Benson, the spokesman.

Benson agreed that security along the Arizona border has increased during the past few years, but attributed that more to a weakened U.S. economy than effective border-security policy.

“Anyone can point to their own statistics, but I think if Secretary Napolitano spoke with some of the ranchers who lived along the border or law enforcement who deal with this on a weekly or daily basis, she would see it is not secure,” he said.

Alabama and Arizona are being sued by Barack Hussein Obama to farther his insidious plan to erase our borders and allow millions of potential new Democrat voters to flow in and snuff out our liberties.

Both states have taken strong measures to get their illegal alien problem under control and both are experiencing improvements in their unemployment rates, but the results in Alabama have been stunning.

Since putting its tough anti-illegal alien bill (H. B. 56) into effect last September Alabama has seen an overnight increase in the number of her citizens working and a drop in the percentage Alabamians collecting unemployment benefits.

The numbers tell the story and they are embarrassing for Obama. In the first month after H.B. 56 became law Alabama’s unemployment rate fell from 9.8 to 9.3 percent. Last month the number dropped to 8.1% which is .4% below the national average. Some quick math shows this is a 1.7% drop.

The real life Main Street result of what Alabama’s Republicans have done is visible across their state. Because of H.B. 56 an enraged Barack Obama is suing Alabama. The more than 41,000 Alabama families who now have a bread winner going off to work every day means nothing to Obama because they are not voting for Democrats anyway.

In just three months Alabama has moved up from being the 42^nd worst unemployment state to the 28^th on the national list.

The numbers from Alabama will continue to improve as more illegal aliens come to understand that the “Heart of Dixie” is not a place to sneak into. Those with minimal skills, now filling jobs Americans want, will continue to leave and sneak into neighboring states.

Both Georgia and Mississippi have unemployment rates substantially above the putative national average of 8.5%, and this promises to be a continuing pattern. As one state stands firmer against these illegal invaders its neighboring states will find them flooding their workplaces schools hospital and jails. Which part of this is hard to understand?

A new poll commissioned by the Federation for American Immigration Reform reveals that most Connecticut residents believe overall immigration to the U.S. should be reduced.

Two-thirds, or 66 percent, of Connecticut residents that participated in a recent nationwide poll believe illegal immigration is hurting the Nutmeg State, according to a statement released by the Federation for American Immigration Reform (FAIR).

The poll, which was commissioned by FAIR and conducted by Pulse Opinion Research last month, also reveals that 67 percent of Connecticut voters oppose in-state tuition aid for illegal aliens looking to attend public universities. There is a bill currently being considered by the state that would allow children of undocumented immigrant aliens to qualify for in-state tuition.

State Sen. Toni Boucher, a Republican who represents Bethel, New Canaan, Redding, Ridgefield, Weston, Westport and Wilton in the 26^th Senate District, told Patch last year that passing the bill would take away spots from citizens and legal aliens.

The poll also revealed that:
68 percent believe the state should be involved in immigration enforcement
39 percent believe illegal immigrants take jobs from American citizens, while 35 percent believe they fill jobs American workers will not do.
51 percent support reducing overall immigration to the U.S.
"It is clear that elected officials in Connecticut and most of the state's congressional delegation in Washington are out of step with the views of the people who put them in office," Dan Stein, president of FAIR, said in the statement.

According to FAIR, there are 120,000 illegal aliens currently living in Connecticut with 85,680 of them in the workforce.

Sheriff's deputies have arrested an illegal immigrant on suspicion of molesting at least three children, including a 7-year-old Big Bear Lake girl.

Jorge Hernandez-Oropeza, 34, was arrested Thursday by Crimes Against Children detectives from the San Bernardino County Sheriff's Department.

Deputies began their investigation Jan. 6 when they received a report of a girl who was molested by Hernandez numerous times in 2010 and 2011 in the 4000 block of Forest Drive in Big Bear Lake. The incidents occurred while Hernandez's mother was baby sitting the child, sheriff's officials said.

Investigators learned there were two other victims who had been molested by Hernandez in 2001.

Hernandez was booked in jail in lieu of $250,000 bail. Officials say he is
also in custody on an immigration hold.

ATLANTA — Immigration authorities say they've arrested 20 foreign nationals convicted of sex offenses in Georgia and the Carolinas this week.

U.S. Immigration and Customs Enforcement said Friday that the arrests came Monday through Wednesday as part of Operation Sex Offender Alien Removal, or SOAR, which targets foreign nationals who are targets for deportation because of convictions for sexual offenses.

Six arrests were made in the metro Atlanta area, while the remaining 14 arrests were made in South Carolina and North Carolina.

ICE says the enforcement initiative was part of ongoing operations in the region to find foreign nationals who have committed crimes and pose a threat to public safety.

In fiscal year 2011, ICE deported a total of 5,849 sex offenders.

MIDVALE, Utah (ABC 4 News) - A raid at a Midvale apartment Friday shut down a fraudulent identification card mill and drug operation, according to the Utah Attorney General's SECURE Strike Force.

Six undocumented men from Mexico were arrested after a lengthy investigation. Authorities said the men were selling methamphetamine and false Social Security cards, driver licenses and alien registration cards ("green cards"). A cache of fraudulent documents and methamphetamine packaged for sale were discovered.

A resident of the apartment complex who wished to remain anonymous said many people are fearful to talk about the illegal activity because it is so prevalent in their community.

Francisco Javier Manenche-Bracamontes, 25, is charged with possession of controlled substances with intent to distribute, possession of fraudulent identification and obstruction of justice.

Juan Zacapala-Bacho, 22, is charged with possession of forged writing

Joel Pineda-Prudente, 27, is charged with possession of forged writing.

Flavio Sorroza-Vasquez, 31, is charged with false information to police (prior deportation).

Jose Larios-Lopez, 44, is charged with aggravated felon/prior deportation and aggravated re-entry.

Cesar Cirino Manenche-Torres, 34, is charged with prior deportation and re-entry.

According to the attorney general's office, residents of the apartment complex applauded the law enforcement officers after they removed the alleged drug traffickers.
This is the 29th fraudulent document production mill shut down by the SECURE Strike Force since it was started just more than 2 years ago. The Strike Force targets major crimes by undocumented aliens.

Although deportations have risen under the Obama administration, Judicial Watch accused the White House of secretly implementing a "stealth amnesty" program toward undocumented immigrants.

The conservative watchdog group cites as evidence a June 3, 2010, memo by Immigration and Customs Enforcement Director John Morton urging field officers, special agents and chief counsel to use "prosecutorial discretion" in deportation cases, particularly with victims of domestic violence and military veterans.

The four-page memo stated, in part, that customs could only afford to deport 4 percent of undocumented immigrants in the United States.

"In light of the large number of administrative violations the agency is charged with addressing and the limited enforcement resources the agency has available, ICE must prioritize the use of its enforcement personnel, detention space, and removal resources to ensure that the removals the agency does conduct promote the agencies highest enforcement priorities, namely national security, public safety and border security," the memo stated.

Gary Goldman, ICE's chief counsel in Houston, passed on the memo to his office, with further instructions, on Aug. 16, 2010. Two weeks later, Judicial Watch sent Homeland Security a Freedom of Information Act request. It filed a lawsuit the following May.

Homeland Security eventually released 237 pages of documents, 191 of which were redacted.

U.S. District Judge Colleen Kollar-Kotelly allowed Judicial Watch to try to expose the undisclosed information on Jan. 27, pointing to three "egregious examples" of Homeland Security's extreme secrecy.

In one document, "apart from the subject line, which reads 'Prosecutorial Discretion,' everything substantive has been redacted," the decision states.

Another document does not disclose the author or recipient.

A third is completely blacked out under a statement that says: "This is how various presenters presented their messages to us."

"In the end, DHS's generalized and non-specific showing fails to satisfy the Court that the attorney-client privilege has been properly invoked in connection with the information withheld from Judicial Watch," the order states.

Homeland Security can redact three spreadsheets under work-product privilege, and the agency can to try to defend the other disclosures in future hearings, Kollar-Kotelly said.

"As before, the court shall afford DHS a further and final opportunity to establish that the deliberative process privilege applies to the information withheld from these documents and that all reasonably segregable information has been released to Judicial Watch," the order states.

Deportation rates have reportedly risen steadily since Obama took office.

"Of the 396,906 deportations from October 2010 through September of this year, more than half were illegal immigrants with felony or misdemeanor convictions, a percentage that has increased steadily since the end of the George W. Bush administration," according to a Los Angeles Times article.

The Electronic Frontier Foundation made the same finding about government secrecy.

"A study released in December of this year by Citizens for Responsibility and Ethics in Washington (CREW) and OpenTheGovernment.org found the administration was withholding information using nine of the most common exemptions 33% more than George Bush's last full year in office," the foundation said.

Judicial Watch and the agency must file a joint status report by Feb. 8 to schedule further proceedings.

Versions of two illegal immigration bills rejected last year by the Arizona Senate have been reintroduced for possible consideration this year.

One bill would require the state to collect school district data on numbers of students who are illegal immigrants.

The other would require hospitals to notify immigration authorities if patients without insurance cannot provide proof of legal status.

Both bills are sponsored by Republican Sen. Steve Smith of Maricopa.

Versions were among five illegal immigration measures rejected last March by the Senate.

Business groups had urged state lawmakers to take a timeout on the controversial illegal immigration issue after the 2010 enactment of an enforcement law known as SB1070.

This year's version of the school data bill omits a provision to withhold funding of districts that don't cooperate.

Mitt Romney has become a moving target for the Service Employees International Union, which Wednesday began airing ads against the GOP front-runner in Nevada.

The new Spanish-language radio ad largely mirrors the one SEIU ran in Florida ahead of the Sunshine State’s Tuesday primary, but it puts new focus on the gap between Mr. Romney’s effective tax rate and that of most Americans, including many Latinos.

“On the one hand, Romney is a multimillionaire who pays an unfairly low tax rate. But on the other hand, he accuses hard working immigrants of being opportunistic, declaring that they’re just here looking for handouts,” says the ad, which is airing in Reno and Las Vegas ahead of Nevada’s nominating caucuses on Saturday.

As Mr. Romney “heads into states with more Latinos, his ‘dos caras’ (Spanish for “two faces”) with our community will become even more evident,” SEIU Secretary-Treasurer Eliseo Medina said in a statement. Officials at SEIU, whose membership is one-fourth Hispanic, accuse Mr. Romney of reaching out to Latinos while pushing for tough curbs on illegal immigration, among other things.

Romney campaign spokeswoman Amanda Henneberg called the ads “a dishonest smear from President Obama’s liberal allies and a desperate attempt to distract from his abysmal record. It will do nothing to help the millions of Hispanics who have been hit especially hard as a result of the Obama economy. “

On Thursday, a committee in the New Mexico House of Representatives rejected legislation that would help prevent illegal aliens from receiving state driver’s licenses. (Associated Press, Jan. 26, 2012) The bill, H.B. 103, failed on a party-line vote in the House Labor and Human Relations Committee, with 5 Democrats voting against and 4 Republicans voting for the measure. (Alamogordo Daily News, Jan. 26, 2012)

H.B. 103 proposes changing New Mexico’s law in several important ways. First, it would strike existing language that allows a driver’s license applicant to submit an Individual Taxpayer Identification Number (ITIN) instead of a Social Security Number on the application. (See H.B. 103 § 1) Because the IRS issues ITINs to illegal aliens for the purposes of filing tax returns, this loophole has allowed illegal aliens to easily get driver’s licenses in New Mexico. (See IRS Publication 1915 (Rev. 1-2012) p. 10)

Second, H.B. 103 requires foreign nationals who apply for a driver’s license to submit the unique identifying number of the alien’s passport or visa plus the expiration date of the alien’s authorized period of admission. Under the bill, a driver’s license issued to a foreign national shall expire on the date the alien’s authorized stay expires.

(H.B. 103 § 3) Finally, H.B. 103 makes similar changes to New Mexico’s laws regulating applications for state identification cards. (See H.B. 103 §§4-7)

Remarkably, the New Mexico legislators rejected H.B. 103 despite new and compelling evidence that the State’s process for issuing driver’s licenses is riddled with fraud. Just days before the vote, the Associated Press revealed that its investigation into the New Mexico driver’s license applications showed that dozens of people used the same business and residential addresses to obtain driver’s licenses. (Associated Press, Jan. 25, 2012)

This is particularly significant as applicants without Social Security Numbers must provide the state documents that establish residency. In one instance, the Associated Press wrote, “48 foreign nationals claimed to live at a smoke shop in Albuquerque to get a license. In another case, more than a dozen claimed to live at an automotive repair shop over a one-year period.” (Id.)

Members of the House Labor and Human Relations Committee, however, ignored this evidence during the committee hearing Thursday. Instead, the Democratic members stripped H.B. 103 of its original language and replaced it with language that would still allow illegal aliens to obtain driver’s licenses, but only for a two-year duration. They also added language that would increase the penalties for fraudulently trying to obtain a driver’s license. (Id.) House Majority Leader Ken Martinez said these provisions will “really hit the bad guys hard.” (Associated Press, Jan. 26, 2012)

Representative Andy Nunez, author of H.B. 103, said he wasn’t surprised that the House Committee rejected his bill. (Id.) However, he also said that if the bill could reach the House floor, he felt confident that he had the votes needed for it to pass. (Associated Press, Jan. 26, 2012) Whether it will pass the Democratically-controlled Senate is uncertain. (Id.)

New Mexico Governor Susana Martinez has been a strong advocate for ending the state’s practice of issuing driver’s licenses to illegal aliens. (See FAIR Legislative Update, Sept. 6, 2011)

During her State of the State speech last week, she urged legislators to support repealing current law, citing polls in her favor. (Associated Press, Jan. 24 2012) “This issue has been debated thoroughly,” said Martinez. “The desire of New Mexicans is clear. And it’s time to vote to repeal this law.” (Id.)

VERACRUZ, Mexico (AP) — A Mexican state official was detained as he got off a government-owned plane with $1.9 million crammed into a briefcase and a backpack, prosecutors announced Monday, touching off allegations of campaign finance violations tied to the upcoming presidential election.

Tomas Ruiz, treasury secretary for Veracruz state, said there was nothing illicit about the money the official was carrying. He said the cash, from state coffers, was destined for a Mexico City advertising firm that agreed to promote festivals to attract tourists to the eastern coastal state, including a well-known carnival in the port city of Veracruz.

Ruiz said the Veracruz government had state official Miguel Morales Robles carry the cash payment on a special flight to Toluca airport outside Mexico City because the advertising work needed to be delivered quickly.

Federal prosecutors said a second state official, Said Zepeda, was briefly detained Friday when he showed up at the airport to demand the release of his colleague and the money.

The two officials were released because there was no evidence they violated any law, but the money remains in prosecutors' custody.

Federal prosecutors said they were trying to confirm the money was from state coffers as part of the investigation. Ruiz said he had sent them documentation.

Veracruz state is governed by the Institutional Revolutionary Party, whose presumptive presidential candidate is considered the front-runner in the July election.

The Democratic Revolution Party, one of the PRI's two main competitors, charged that the money was meant to fuel a secret advertising budget for PRI candidate Enrique Pena Nieto.

The PRI has made strenuous efforts to rebrand itself as a law-abiding and transparent party that has left behind the legacy of corruption that marked much of its seven decades of autocratic rule, which ended with the 2000 presidential election.

Mexico has strict limits on the amounts of money that can be spent on political campaigns — the PRI's presidential candidate will be limited to spending 495 million pesos ($38.4 million) for the entire campaign.

Political rivals routinely accuse each other of violating the limits, but electoral regulators rarely bring cases to prosecutors.

"We have before us, without a doubt, a diversion of state resources for the presidential candidate of the Institutional Revolutionary Party, Enrique Pena Nieto," the national leadership committee of the Democratic Revolution party said in a statement.

Ruiz strenuously denied that.

"The payment was in cash because of the rush," he told the news station Radio Formula when asked why he hadn't sent an electronic transfer.

With the start presidential campaign season in Mexico, government and party officials are warning about the potential for organized crime to get involved in campaigns and debating how to prevent that.

Prosecutors wouldn't say if the money from Veracruz could possibly be linked to drug trafficking.

President Felipe Calderon last fall said that Veracruz, a state racked by drug violence, had been left in the hands of the Zetas drug cartel before he sent federal troops to restore order.

The state now is the center of a fierce battle between the Zetas and the Sinaloa cartel, Mexico's two most power drug trafficking organizations. Former Gov. Fidel Herrera was acccused of being aligned with the Zetas, a charge he often denied.

CONCORD, N.H.—Illegal immigrants could see their tuition costs rise at the state's public colleges if a bill facing the New Hampshire House passes.

The House votes Wednesday on a bill requiring students to prove they are legal residents of the United States to receive in-state tuition rates. Proponents assume a student would have to sign an affidavit and provide documentation as they do to prove state residency.

Opponents argue any child who grew up in New Hampshire and graduated from its schools should be afforded in-state tuition.

The only current in-state tuition requirement is to have lived in New Hampshire for at least 12 months prior to registering.

Legislators killed two bills targeting illegal immigration in a House committee Wednesday.

The bills' sponsor, Rep. Stace Nelson, R-Fulton, said action is necessary because illegal immigration is contributing to depressed wages and crime.

"By having illegal immigrants here, it actually depresses the cost that law-abiding South Dakotans are paid to perform their jobs," Nelson said. "They're coming here to work, and they're taking money out of our communities and sending it out of our country."

One of the bills, House Bill 1139, would have revised identity theft rules to crack down on the use of stolen IDs by illegal immigrants. The House Commerce and Energy Committee killed it by a 9-4 vote.

The other, House Bill 1238, set up penalties for employers who hired illegal immigrants. It was tabled on a 7-5 vote.

Both bills had a number of opponents, including an aide to Gov. Dennis Daugaard, two members of the Catholic Presentation Sisters order and an array of business associations from around the state.

Lawmakers killed HB1139, saying it would simply duplicate work the federal government already does at extra cost to the state.

"By taking these steps, we're going to subject our state to further expense in prosecuting this type of case when it should be done at the hands of the federal government," said Rep. Mark Willadsen, R-Sioux Falls.

HB 1238 was criticized for its alleged extra cost, its negative impact on South Dakota businesses and the potential to be challenged in court.

Brenda Forman, a lobbyist for the South Dakota Dairy Producers, said the extra requirements would confuse businesses already trying to comply with federal laws.

Nelson shot back that businesses were simply trying to profit from cheap migrant labor, which he likened to slavery.

Despite the defeats of Nelson's two bills Wednesday, legislators aren't done dealing with illegal immigration. Sen. Craig Tieszen, R-Rapid City, is sponsoring Senate Bill 155, which also targets employers of illegal immigrants. It has yet to be scheduled for a hearing.

Illegal Responsible For Fire That Killed FIVE in NYC

The devil made him do it.

An illegal immigrant who allegedly set the Brooklyn fire that killed five neighbors told cops the demons in his head led him to torch the crowded building, sources said yesterday.

"He confessed to the arson," a police source said. "He didn't indicate any rational motive."

Daniel Ignacio, 27, a Guatemalan national, was charged yesterday with murder and arson. He was ordered held without bail at his arraignment last night.

Ignacio told cops that evil spirits led him to set off the blaze early Saturday in his Bensonhurst building, filled with deeply religious tenants.

"The demons made me do it," he said, according to a police source.

Ignacio also said he was drunk at the time and that he does "stupid things" when he drinks.

'FIEND' LIVED ON VICTIMS' CHARITY

He whined to cops that he had fallen into a deep depression in recent weeks -- ashamed about making a paltry $8 an hour as a day laborer and heartbroken he lived so far from his family.

Ignacio, who was deported seven years ago but managed to sneak back into the United States, tried to paint himself in a better light when he was walked from the 62nd Precinct.

"I'm not a monster!" he shouted in Spanish to reporters. "I have compassion!"

Ignacio told cops he used paint thinner to set a roll of toilet paper afire with a cigarette lighter in a baby carriage sitting in a hallway near the stairwell, police said.

After setting the blaze, he went upstairs to sleep off his drunken stupor. Flames quickly erupted near the building's front door, cutting off the building's main exit and blocking firefighters from getting upstairs.

Residents awakened to the roaring blaze, which ate through the staircase and collapsed a floor.

Five people perished, including a frantic mother who, with her husband's help, managed to get their two children out of the burning building.

Cops said that when Ignacio realized what he had done, he helped in the dramatic rescue of one of the kids, a 2-year-old boy.

Ignacio, a second-floor tenant, was inside the building as the fire spread. As smoke and flames swept through the structure, he grabbed the boy, Josias Chan, from his parents and safely handed him off to firefighters at a second-floor window. Ignacio then climbed down an FDNY ladder to safety.

Danielle Eaddy, a lawyer who represented Ignacio at the arraignment, praised his client's efforts in rescuing the child. "There are some holes in this case to say the least," she said outside court.

In the days after the fire, survivors, including the boy's widowed father, Miguel Chan, heaped praise on Ignacio.

But Ignacio quickly went from hero to hellion when surveillance video surfaced showing him leaving the 86th Street building, then returning shortly before the fire started.

Chan "feels very betrayed," said the Rev. Erick Salgado, pastor of the Jovenes Cristianos Church, where many of the tenants worship.

"The devil's always going to tell you to do so many things, but you are responsible to choose what to do and what not to do.

"I thanked [Ignacio] for saving Josias. Now I can't believe he's the one who was charged."

Chan's wife, Luisa OrdoÃ±ez, 33, died in her husband's arms. Their baby girl remains at a Queens children's hospital with a fractured skull.

Four other people, including Juan Barreno, 28, a construction worker from Guatemala, also died in the blaze.

"Anytime someone starts a fire in a stairwell, it's a deadly fire," an investigator told The Post. "It's the worst you can get. A fire [that starts in an apartment] isn't half as bad."

Cops said Ignacio has at least one prior arrest, for burglary, and was deported back to his native Guatemala in 2003. He sneaked back into the United States a short time later, officials said.

Residents said he moved in two months ago after showing up one day looking for a place to live.

Chan has retained a lawyer for a possible suit. The attorney, Ben Rubinowitz, said Chan wants to know if anyone else can be held responsible for his wife's death.

Officials from the Fire and Buildings departments are continuing to investigate if there were any other contributing factors, such as illegal subdivision, that would have made it more difficult for firefighters to navigate.

"All government business is done in English here. I don't need an official law saying that English is the de facto language. Everyone knows that already," said John Cook, mayor of El Paso, Texas -- a border city in which 73 percent of its 800,000 inhabitants say they speak Spanish at home.
As the House GOP closes in on making English the official language, some on the front lines of the debate, like Mayor Cook, say they don't quite see the point.

Last week, presidential hopefuls Newt Gingrich and Mitt Romney doubled down on their support for a bill that would require all official government functions to be conducted in English, at the same time as they attempted to appeal to Latino voters on TV and radio en Espanol. Both GOP candidates noted in a Florida debate that they'd like to see English become the official language.

"I believe English should be the official language of the United States, as it is. I also believe that in our schools, we should teach kids in English," Romney said.

And now some believe House Republicans are using language legislation as a wedge issue in the presidential race because President Barack Obama voted against such a measure as a senator, despite it having bipartisan support.

While the English-only movement gained popularity in the 1980s, and has come up various times during election years, federal legislation mandating English as the official language has never been passed. Supporters of the movement say making English the official language will advance political unity based on linguistic commonality, while critics say the movement is founded on irrational fears of immigration.

But for border towns with large Spanish-speaking populations, the debate is playing out in real terms.

Last week, a city council candidate in San Luis, Arizona, was barred from running for office when it was decided she couldn't speak English proficiently. Claiming that her language skills are adequate for her border city, which is 98.7 percent Hispanic, Alejandrina Cabrera vowed to appeal the judge's ruling.

Conversely, in an ongoing city commissioner race in El Paso, the incumbent candidate, Willie Gandara Jr., said his challenger was unfit to serve because he didn't know how to speak Spanish well enough. Gandara claimed that speaking Spanish was "of the utmost importance" for politicians in a border city like his own. In 2006, the tiny border town of El Cenizo, Texas, even declared Spanish its official language, sparking heated discussion on the issue nationally.

But Cook, the mayor of El Paso, says he doesn't see the point of declaring a language either way. According to Cook, the vast majority of El Paso residents are bilingual in both English and Spanish, switching between the two languages as needed. But, all government functions are conducted in English.

Cook, who is quadrilingual (in English, Spanish, Vietnamese and French), says he would like to see politicians spend more time thinking about how to teach students second languages, and less time legislating on something that already exists in practice.

The mayor believes that support for the bill comes from widespread fear that the U.S. is changing due to immigration.

"You have people who feel the status quo is being threatened," Cook said. "You see the growth of the Hispanic populations all across the U.S., and a lot of people feel uncomfortable with that," he added.

Republican Congressman Steve King (R-Iowa), who introduced the English Language Unity Act of 2011, said in a release that establishing English as the official language for government functions will, "encourage assimilation of all legal immigrants in each generation."

"A common language is the most powerful unifying force known throughout history," King said. Over 90 percent of nations have an official language, he noted, saying that it's time for the United States decide on English.

According to U.S. English, a group which advocates the passage of King's bill, 31 states have already passed their own legislation which promotes English as their official language in the absence of a federal law. Earlier this week Missouri's State House Committee passed legislation which will require all state drivers' tests be conducted in English.

On their website, U.S. English applauds these efforts and also calls for an end to the federal "bilingual ballot privision [sic]" which ensures that voting ballots be provided in non-English languages. King has also introduced a bill which would overturn bilingual provisions and another which would end the practice of birthright citizenship.

In Brownsville, Texas, a border town which is over 90 percent Latino, critics say making English the official language is both unnecessary and potentially detrimental to business.

Gil Salinas, the vice president of the Brownsville Economic Development Council, says the measure won't reflect well on the United States.

"We're sending the wrong message to the rest of the world," Salinas said in an interview with The Huffington Post. "We have a lot of business with Latin America down here in Brownsville and it'll get difficult to explain to prospective customers that now we only speak English officially."

Many in border towns say the debate is not so black and white as it is often portrayed in the rhetoric of politicians like former Massachusetts Gov. Romney and former House Speaker Gingrich (R-Ga.).

"We're a bicultural, binational, and bilingual city," Salinas said of his hometown, Brownsville. "Sure we'll use English in governmental capacities. But saying it's official language, and saying we can't throw in a little Spanish when we want, that doesn't make sense."

Villaraigosaseeks to build Latino support for Obama

Theeffort stands to benefit both the presidential candidate and the mayor, aformer Hillary Clinton supporter who has had an uneasy relationship with somein the black community.

When a Spanish-language radio ad slammed presidential hopeful Sen. Barack Obamafor just discovering the "importance of the Latino vote," hiscampaign called on Los Angeles Mayor Antonio Villaraigosa to knock the attackdown.

Villaraigosa issued a public statement praising Obama as a "champion ofthe Latino community" who was "fighting for our families" andthen delivered the same glowing message when he addressed two of the nation'smost prestigious Latino civil rights organizations.

The mayor's ascension as an Obama pitchman, while intriguing because ofVillaraigosa's support of rival Sen. Hillary Rodham Clinton during theDemocratic primary, is a move that promises to work to the political advantageof both men.

Whether reality or mere perception, the specter of a smoldering animositybetween blacks and Latinos is an issue that both Obama and Villaraigosa treatwith great care as they preside over the multiracial coalitions essential totheir political success.

Villaraigosa, one of the nation's most prominent Latino politicians, can helpObama by unleashing his bilingual charms to help win over a Latino electoratethat voted overwhelmingly for Clinton in the primaries.

With his historic candidacy and tight embrace from African American voters,Obama helps Villaraigosa cast himself as a coalition builder in the mold offive-term Los Angeles Mayor Tom Bradley, who was the city's first black mayorand was best known for his ability to unify the fractious city.

Villaraigosa's increased support among black voters was a critical factor inhis defeat of former Mayor James K. Hahn in 2005, but that support hasvacillated. Villaraigosa has been praised for the diversity of hisadministration, for a drop in violent crime and for working with communityleaders to stimulate the economy of South L.A.

But he was criticized by black leaders for the way he handled a raciallycharged lawsuit filed by a black firefighter who was fed dog food bycolleagues. And black leaders were leery of his attempted takeover of LosAngeles' public schools.

Those actions by the mayor rekindled doubts that some black voters had aboutVillaraigosa, who campaigned to unite the city as well as create jobs, improveschools and provide better city services to neglected black neighborhoods, saidJackie Dupont-Walker, a leader at Ward AME Church in South L.A.

"There was always some question on how he was going to deliver on thepromises. Will you show you are who you say you are?" Walker said.

Assembly Speaker Karen Bass said that Villaraigosa had devoted his life tofighting for civil rights and that his record as mayor reflected that. The LosAngeles Democrat noted, for instance, that the mayor went after constructioncompanies for failing to hire black workers and, in partnership with church andunion leaders, helped establish an apprenticeship program that has trainedhundreds of African Americans for the high-wage building trades.

'A set of values'

"He came into office with a set of values, and I believe he has beenconsistent with that set of values when he's been in office," said Bass, afriend of Villaraigosa for 30 years and the first African American woman tobecome speaker of the Assembly.

Villaraigosa, who thus far faces no serious challenger in his 2009 reelectionbid, is defensive when his support among African Americans is questioned. Hesays polls conducted by his campaign show that black voters are among his"strongest" supporters.

That popularity comes, he said, because he is devoted to "providingopportunities, regardless of race"; he has tripled the number of positionsoffered by the city's summer jobs program, with a third going to AfricanAmericans; and the number of locations that provide L.A.'s Best after-schoolprograms for at-risk youth has increased threefold.

African Americans account for 37% of the general managers he has hired and 22%of his appointments to the commissions that oversee the Fire Department, theairport agency and other departments.

"I'm very proud of the fact that last year in Watts, we went two monthswithout a homicide for the first time in 50 years and, importantly, brokeground on market-rate housing for the first time in 50 years,"Villaraigosa said. "So there's a real focus here on making sure, as I saidin the campaign, a great city is a city where we're growing and prosperingtogether, not leaving communities behind."

When Villaraigosa lost his first run for mayor in 2001, Hahn won 80% of theblack vote -- aided by the vast African American political base that hisfather, Kenneth, established as a county supervisor decades ago.

James Hahn lost that advantage, in part, because of his role in oustingthen-Police Chief Bernard C. Parks, an African American who is now on the CityCouncil. A large group of prominent black leaders who backed Hahn in 2001 threwtheir support behind Villaraigosa in 2005. Times exit polls showed thatVillaraigosa won 48% of the city's black vote, but the mayor contends that thefigure was closer to 59%.

"I would not be willing to say to you that it was such a big 'We love you,Antonio' as much as it said, 'We're [upset] and we're going to fix you, JimmyHahn, because of Bernie Parks,' " said Genethia Hudley-Hayes, a city firecommissioner who endorsed Villaraigosa in both 2001 and 2005.

Hudley-Hayes said Villaraigosa had done "some good things and some badthings." She credits him for a drop in violent crime, the addition of LAPDofficers and a successful crackdown on soot-spewing big-rigs at the Port of LosAngeles.

But she said many were still disturbed that Villaraigosa vetoed the city's$2.7-million settlement with Tennie Pierce, who sued for discrimination afterbeing fed dog food by fellow firefighters at the Westchester station.

Villaraigosa issued the veto after a public outcry about the size of thesettlement arose, fueled by news outlets publishing photos of Pierce alsoengaged in firehouse pranks. The case was eventually settled for $1.5 million.

'Still some acrimony'

"There is still some acrimony and suspicion about why he did that,"Hudley-Hayes said. "Was it racial, wasn't it racial? . . . And there was aportion of the community that was always suspicious of him, but that has to dowith African American and Latino politics in this town."

Amid the public outcry, Villaraigosa forced Fire Chief William Bamattre out andreplaced him with the city's first African American chief, Douglas L. Barry.

Villaraigosa defended the veto as the "right thing to do," saying thecase did not merit a $2.7-million settlement.

At the time, however, his decision added to concerns among some AfricanAmericans about his unsuccessful effort to take over the Los Angeles UnifiedSchool District, further stirring up anxieties about the increasing influenceof Latinos over their daily lives.

That was magnified again last year when Villaraigosa backed a slate of schoolboard candidates to increase his voice in the school system. African Americanboard member Marguerite Poindexter LaMotte was up for reelection and, althoughthe mayor denies it, many in the black community believed he worked behind thescenes to support her challenger, who failed to oust her.

"That was the perception," said political consultant Kerman Maddox, aVillaraigosa supporter, "and there were some people in the AfricanAmerican community who were offended."

Villaraigosa has overcome much of that animosity, he said, by buildinglong-standing relationships with community leaders, walking the neighborhoodsand visiting "every black church in L.A."

Maddox remembers when the massive May Day immigrant-rights rally in 2006 led toa lot of dinner-table conversations about whether continuing Latino immigrationwould start pushing blacks out of their jobs and neighborhoods. Villaraigosasat down with African American leaders to listen to those concerns, he said.

"I give him an A-plus on that because . . . if you have a city that's fullof racial tension and about to blow, it doesn't matter what kind oftransportation system you have or what type of school system you have. It's notgoing to matter," Maddox said.

New report released by GOP lawmakers suggests topJustice officials had extensive knowledge of Operation Fast and Furious

In the hours before Attorney General Eric Holder’s scheduled testimony beforethe House Oversight and Government Reform Committee, Republican lawmakers Rep. Darrell Issa (R-Calif.) and Sen. Charles Grassley (R-Iowa) released a new report suggesting topDepartment of Justice officials had extensive knowledge of and involvement inOperation Fast and Furious.

The memo, sent to Republican members ofthe Oversight Committee, was based upon interviews, documents and emailsinvolving key players of the operation run by the Bureau of Alcohol, Tobacco, Firearms and Explosives.The operation allowed some 2,000 weapons cross the border into Mexico and into the hands of cartelmembers.

Two of the weapons linked to theprogram were found at the murder scene of U.S. Border Patrol Agent Brian Terryin 2010, as well as numerous other crime scenes in Mexico. The memo claimsthere was coordination between the Justice Department in Washington and theATF in the early stages of the operation.

Emails released show that KennethMelson, former Acting Director of the ATF contacted Assistant Attorney GeneralLanny Breuer and told him that his organization wanted to take a “differentapproach” to seizing guns going to Mexico.

Breuer responded that it was a“terrific idea” and the Department assigned a prosecutor from its CriminalDivision to work with the ATF in early 2010.

Republicans say attorney Joe Cooleyattended key briefings on the program and should have alerted the JusticeDepartment to what was going on. The memo also alleges that there was a lack ofmanagement by both the ATF and Justice Department with the use of federalwiretaps.

According to the memo, “Both JusticeDepartment and ATF leaders in Washington, D.C. claimed they were unaware of thegunwalking that occurred during Fast and Furious, yet both could have andshould have reviewed the Wiretap Affidavits.”

Congressional investigators also claimthat the Criminal Division of Justice Department had knowledge of a previousgun trafficking operation named Wide Receiver and should have drawn a parallelbetween the two. Officials in that department have claimed that they did raiseconcerns about Operation Wide Receiver and alerted the ATF.

Thursday’s report goes on to criticizeHolder’s current chief of staff Gary Grindler, who served as Acting DeputyAttorney General during part of Operation Fast and Furious. According toGrindler’s testimony, he says he knew little about Fast and Furious andassigned oversight of the ATF to two deputies. Grindler told investigators thathe expected his associates to bring any problems to his attention.

The memo also repeated claims that theJustice Department was “managing the congressional investigation in order toprotect the political appointees at the Department.”

In his testimony prepared forThursday's hearing, the attorney general said that prior administrations haverecognized that robust internal communications would be chilled, and theexecutive branch's ability to respond to oversight requests impeded, ifinternal communications concerning responses to congressional oversight weredisclosed to Congress.

These jobs that onceafforded a middle class life style now only offer illegal alien workers povertylevel wages, resulting in the shrinkage of the "American MiddleClass" and the enormous growth of an ever‑increasing"underclass" dependent on government entitlements.

Lie #3: Illegal aliens contribute more to the economy andtax base than they take.

Truth: A large portion of illegal aliens work for cash"under the table" paying no taxes. The great majority of illegalsmake $6‑$8 per hour, ($12,480 ‑ $16,640 per year). At such income levels, notonly is there no tax due, but they also qualify for the "earned income taxcredit". In California, public education alone costs over $7,500 per pupil.Multiply that times 2‑4 children, add the costs of free school breakfast andlunch, free medical care, food stamps, housing subsidies, and other entitlement"give‑aways". Harvard Professor George Borjas estimates illegalimmigration costs the U.S. 70 billion dollars per year and Californians $1,300per household annually in additional taxes. The Center for Immigration Studiesestimate that the average Mexican illegal alien will use $55,200 more in publicservices during his lifetime than he pays in taxes.

Lie #4: Without illegal alien farm labor, a head of lettucewould cost $3.00.

Truth: It already costs $3.00. You just make a $1.00 downpayment at the grocery store. The government finances the other two dollarsuntil tax time, when the additional $2.00 balance is extracted from your walletin the form of higher taxes. The Agriculture industry gets cheap labor andhigher profits, while shifting all the social costs of illegal immigrant laborto the American tax payer.

Lie #5: Most illegal aliens come here only to seek work andare law‑abiding "citizens".

Truth: In Los Angeles, as of January, 2004, 95 percent ofall outstanding warrants for homicide (which total 1,200 to 1,500) targetillegal aliens. Up to two‑thirds of all fugitive felony warrants (17,000) arefor illegal aliens. A confidential California Department of Justice studyreported in 1995 that 60 percent of the 20,000‑strong 18th Street Gang insouthern California is illegal; police officers say the proportion is actuallymuch greater. The bloody gang collaborates with the Mexican Mafia, the dominantforce in California prisons, on complex drug‑distribution schemes, extortion,and drive‑by assassinations, and commits an assault or robbery every day inL.A. County. The gang has grown dramatically over the last two decades byrecruiting recently arrived youngsters, most of them illegal, from CentralAmerica and Mexico.

The New York Times reported that current"Race" president Janet Murguia believes "hate speech"should "not be tolerated, even if such censorship were a violation ofFirst Amendment rights."

3. "The Race" sponsorsmilitant ethnic nationalist charter schools subsidized by your public taxdollars (at least $8 million in federal education grants). The schools includeAztlan Academy in Tucson, Ariz., the Mexicayotl Academy in Nogales, Ariz.,Academia Cesar Chavez Charter School in St. Paul, Minn., and La AcademiaSemillas del Pueblo in Los Angeles, whose principal inveighed: "We don'twant to drink from a White water fountain, we have our own wells and ournatural reservoirs and our way of collecting rain in our aqueducts. We don'tneed a White water fountain … ultimately the White way, the American way, theneo liberal, capitalist way of life will eventually lead to our owndestruction."

"The Race" hasperfected the art of the PC shakedown at taxpayer expense, pushing relentlesslyto lower home loan standards for Hispanic borrowers, reaping millions infederal "mortgage counseling" grants, seeking specialmultimillion-dollar earmarks and partnering with banks that do business withillegal aliens.

1. "The Race" thrives onethnic supremacy -- and the elite sheeple's unwillingness to call it what itis. As historian Victor Davis Hanson observes: "[The] organization's verynomenclature 'The National Council of La Raza' is hate speech to the core.Despite all the contortions of the group, Raza (as its Latin cognate suggests)reflects the meaning of 'race' in Spanish, not 'the people' -- and that'sprecisely why we don't hear of something like 'The National Council of thePeople,' which would not confer the buzz notion of ethnic, racial and tribalchauvinism."

The fringe is the center. Thecenter is the fringe. Viva La Raza.

The National Council of La Raza(NCLR) is not only one of the wealthiest and most politically powerful militantorganizations in the country, it is also notoriously racist and subversive.The group's name, "La Raza," means "The Race," by whichthey are referring to ethnic Mexicans, or more broadly to "hispanics"or "latinos." And it is quite clear from their decades of vitriolicrhetoric — both spoken and written — that the La Raza activists are trying toengender not only race consciousness amongst hispanic U.S. citizens and Mexicanmigrants, but also racial militancy and animosity toward "GringoAmerica."

The NCLR grew out of the LaRaza Unida (The Race United) Party and the Southwest Council of La Raza in thelate 1960s and early 1970s. The key leaders were Marxist-Leninist followers ofFidel Castro and Che Guevarra.

The radical student group MEChA(Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closelyallied for several decades, is even more explicitly and militantly, havingadopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," whichtranslated means: "For the Race, Everything; Outside the Race,Nothing."

MEChA's founding documents andliterature are replete with appeals to "La Raza de Bronce" (TheBronze Race) and condemnation of the "brutal gringo." MEChA, as itsname suggests, is also a leading promoter of the radical"reconquista" (reconquest) movement, a plan of to take over thestates of California, Arizona, New Mexico, Colorado, and Texas — a region theyrefer to as "Aztlan" — which they claim was stolen from the"Aztecan" peoples. NCLR provides major financial support to MEChA andmany of NCLR's leaders were MEChA leaders in their college days.

NCLR: Agents for the Government ofMexico?

Especially troubling is NCLR'sleading role in the Fundacion Solidaridad Mexicano Americana (Foundation forMexican-American Solidarity, FSMA), an organization founded and funded by thegovernment of Mexico and directed by the Mexican Ministry of Foreign Affairsand Ministry of Public Education. Both of these ministries have been engaged inefforts aimed at demanding full political rights for illegal aliens in the U.S.and indoctrinating America's Hispanic population in radical, racist La Razaideology.

TheDepartment of Labor has launched a special program to assist and protectillegal immigrant workers in the U.S., referred to as “vulnerable” and“underpaid” by the presidential cabinet member who heads the agency.

Hundredsof new field investigators have been deployed to reach out to Latino laborersin areas with large numbers of illegal alien employees. Their message, in Spanish,is “we can help” bring workplace protections to the nation’s most vulnerableand underpaid workers, including those who have no legal right to live in theUntied States.

Labor Secretary Hilda Solis,a former California congresswoman with close ties to the influential La Razamovement, announced the “We Can Help” project withgreat fanfare a few days ago. Thesame day Solis publicly announced the Obama Administration’s new project, aLabor Department investigator visited a day laborer center in northernCalifornia to promote it. The federal employee actually chatted warmly with theillegal immigrants about how to find jobswithout being exploited,according to a local newspaper report. “We’re the feds but the good ones,” hetold the day laborers in Spanish. “We’re here to help workers.”

Theagency has also launched a Spanish television advertising campaign to spreadthe word and created a web site. Workers in industries from construction tofood service are urged to contact the Labor Department of wage and hourviolations. An investigator may be deployed to the work site or the employermay be taken to court.

President Obama's Labor Secretary Hilda Solis is supposed to represent Americanworkers. What you need to know is that this longtime open–borders sympathizerhas always had a rather radical definition of "American." At a Latinovoter registration project conference in Los Angeles many years ago, Solisasserted to thunderous applause, "We are all Americans, whether you arelegalized or not."
That's right. The woman in charge of enforcing our employment laws doesn't givea hoot about our immigration laws –– or about the fundamental distinctionbetween those who followed the rules in pursuit of the American dream and thosewho didn't.
While in Congress, she opposed strengthening the border fence, supportedexpansion of illegal alien benefits (including driver's licenses and in–statetuition discounts), embraced sanctuary cities that refused to cooperate withfederal homeland security officials to enforce immigration laws, andaggressively championed a mass amnesty. Solis was steeped in the pro–illegalalien worker organizing movement in Southern California and was buoyed byamnesty–supporting Big Labor groups led by the Service Employees InternationalUnion. She has now caused a Capitol Hill firestorm over her new taxpayer–fundedadvertising and outreach campaign to illegal aliens regarding fair wages:
"I'm here to tell you that your president, your secretary of labor andthis department will not allow anyone to be denied his or her rightful pay ––especially when so many in our nation are working long, hard and oftendangerous hours," Solis says in the video pitch. "We can help, and wewill help. If you work in this country, you are protected by our laws. And youcan count on the U.S. Department of Labor to see to it that those protectionswork for you."
To be sure, no one should be scammed out of "fair wages." Employersthat hire and exploit illegal immigrant workers deserve full sanctions andpunishment. But it's the timing, tone–deafness and underlying blanket amnestyagenda of Solis' illegal alien outreach that has so many American workers andtheir representatives on Capitol Hill rightly upset.

With double–digit unemployment and a growing nationwide revolt overWashington's border security failures, why has Solis chosen now to hire 250 newgovernment field investigators to bolster her illegal alien workers' rightscampaign? (Hint: Leftists unhappy with Obama's lack of progress on"comprehensive immigration reform" need appeasing. This is a quickbone to distract them.)
Unfortunately, the federal government is not alone in lavishing attention andresources on workers who shouldn't be here in the first place. As of 2008,California, Florida, Nevada, New York, Texas and Utah all expressly includedillegal aliens in their state workers' compensation plans –– and more than adozen other states implicitly cover them.
Solis' public service announcement comes on the heels of little–noticed but farmore troubling comments encouraging illegal alien workers in the Gulf Coast.Earlier this month, in the aftermath of the BP oil spill, according to Spanishlanguage publication El Diario La Prensa, Solis signaled that her departmentwas going out of its way to shield illegal immigrant laborers involved incleanup efforts. "My purpose is to assist the workers with respect tosafety and protection," she said. "We're protecting all workersregardless of migration status because that's the federal law." She toldreporters that her department was in talks with local Immigration and CustomsEnforcement (ICE) officials who had visited coastal worksites to try to verifythat workers were legal.
No word yet on whether she gave ICE her "we are all Americans, whether youare legalized or not" lecture. But it's a safe bet.

Thesetting was not quite the flight deck of the U.S.S. Abraham Lincoln with a“Mission Accomplished” banner as the backdrop, but it was the next best thing.Speaking at the Center for American Progress (CAP) on Nov. 13, HomelandSecurity Secretary Janet Napolitano declared victory over illegal immigrationand announced that the Obama administration is ready to move forward with amass amnesty for the millions of illegal aliens already living in the UnitedStates.

Arguingthe Obama administration’s case for amnesty, Napolitano laid out what shedescribed as the “three-legged stool” for immigration reform. As theadministration views it, immigration reform must include “a commitment toserious and effective enforcement, improved legal flows for families andworkers, and a firm but fair way to deal with those who are already here.”

Acknowledgingthat a lack of confidence in the government’s ability and commitment toeffectively enforce the immigration laws it passes proved to be the Waterloo ofprevious efforts to gain amnesty for illegal aliens, Napolitano was quick toreassure the American public that those concerns could be put to rest.

“Forstarters, the security of the Southwest border has been transformed from whereit was in 2007,” stated the secretary. Not only is the border locked up tight,she continued, but the situation is well in-hand in the interior of the countryas well. “We’ve also shown that the government is serious and strategic in itsapproach to enforcement by making changes in how we enforce the law in theinterior of the country and at worksites…Furthermore, we’ve transformedworksite enforcement to truly address the demand side of illegal immigration.”

IfRep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAPspeech he might well have had a few choice comments to offer. But since hewasn’t, we will have to rely on the Department of Homeland Security’s own datato assess the veracity of Napolitano’s claims.

Accordingto DHS’s own reports, very little of our nation’s borders (Southwestern orotherwise) are secure, and gaining control is not even a goal of thedepartment. DHS claims to have “effective control” over just 894 miles ofborder. That’s 894 out of 8,607 miles they are charged with protecting. As forthe other 7,713 miles? DHS’s stated border security goal for FY 2010 is thesame 894 miles.

Theadministration’s strategic approach to interior and worksite enforcement isjust as chimerical as its strategy at the border, unless one considersshuffling paper to be a strategy. DHS data, released November 18, show thatadministrative arrests of immigration law violators fell by 68 percent between2008 and 2009. The department also carried out 60 percent fewer arrests forcriminal violations of immigration laws, 58 percent fewer criminal indictments,and won 63 percent fewer convictions.

Whilethe official unemployment rate has climbed from 7.6 percent when PresidentObama took office in January to 10 percent today, the administration’s worksiteenforcement strategy has amounted to a bureaucratic game of musical chairs. Theadministration has all but ended worksite enforcement actions and replaced themwith paperwork audits. When the audits determine that illegal aliens are on thepayroll, employers are given the opportunity to fire them with little or noadverse consequence to the company, while no action is taken to remove theillegal workers from the country. The illegal workers simply acquire a new setof fraudulent documents and move on to the next employer seeking workerswilling to accept substandard wages.

InJanet Napolitano’s alternative reality a mere 10 percent of our borders under“effective control” and sharp declines in arrests and prosecutions ofimmigration lawbreakers may be construed as confidence builders, but it is hardto imagine that the American public is going to see it that way. If anything,the administration’s record has left the public less confident that promises offuture immigration enforcement would be worth the government paper they’reprinted on.

AsAmericans scrutinize the administration’s plans to overhaul immigration policy,they are likely to find little in the “three-legged stool” being offered thatthey like or trust. The first leg – enforcement – the administration has allbut sawed off. The second – increased admissions of extended family members andworkers – makes little sense with some 25 million Americans either unemployedor relegated to part-time work. And the third – amnesty for millions of illegalaliens – is anathema to their sense of justice and fair play.

AsAmericans well know, declaring “Mission Accomplished” and actuallyaccomplishing a mission are two completely different things. When it comes toenforcing immigration laws, the only message the public is receiving from thisadministration is “Mission Aborted.”

In the discussion about the new law passed in Arizona directed at addressingthat state's problems associated with illegal immigrants from Mexico, theprotests concerning the legislation are directed at the wrong parties, in thewrong direction. The pro-immigration community, some church groups and manyCivil Rights leaders are all calling for a boycott of the State of Arizonabased on their belief that the new Arizona law is focused on "racialprofiling" as the method for identifying possible illegal Mexicanimmigrants.

We have the most sophisticatedsurveillance and monitoring technology in history, the most formidable militaryin the world, yet we are unable to stop the daily intrusion of illegalimmigrants from Mexico into the United States?

As an African-American who lived through and before the Civil RightsMovement, I'm no fan of assessing people based on their skin color. But holdinga struggling State's feet to the fire on tactics is missing the point . Why areprotests not being directed to our national government and the government ofMexico? Why aren't these groups demanding that our porous border with Mexico beclosed, once and for all? It's not impossible. We have the most sophisticated surveillance and monitoring technologyin history, the most formidable military in the world, yet we are unable tostop the daily intrusion of illegal immigrants from Mexico into the UnitedStates? This is a failure of policy, not one of capability.

Congress has been unwilling to pass an immigration bill, the first priorityof which is closing the border. Why does"immigration reform" now demand a higher national priority than thecrippling unemployment that is devastating the economic base and precipitatingwide spread home foreclosures in our communities? President Obama said thehealth reform was the first priority of his first term. Now, he is turning hisattention to financial reform of the banking system. Meanwhile, cities likePhoenix and many cities in the State of California and elsewhere are drowningin red ink with an ever-growing population demanding ever-more city services.

Arizona is now being depicted as the official state of "racialprofiling," with anti-Hispanic and anti-immigration swirling around itlike scarlet letters. But the passage of its bill to prevent the continuedinflux and presence of illegal immigrants in the State appears more like an actof desperation than racially motivated legislation.

WE ARE MEXICO’S WELFARE AND PRISON SYSTEM. THIS ENABLED THE RULINGBILLIONAIRE OLIGARCHY TO MAINTAIN THE ECONOMY IN THEIR GREEDY GRASPS. THINGSDON’T MUCH CHANGE IN SHAMELESS MEXICO; ANY MORE THAN SHAMELESS WALL ST. MOST OFTHE FORTUNE 500 ARE GENEROUS DONORS OF LA RAZA!

As such, it relieves the governmentof Mexico from any financial responsibility for the economic consequencesassociated with the cost of medical care, public education, public housing,welfare, police, and social services provided by the cities, counties andstates in which such initially illegal immigrants choose to reside.

The pro-illegal immigration amnesty movement shuns the classification"illegal" immigrant; preferring instead the term "undocumentedimmigrant." This is, of course, framing the debate. The"undocumented" immigrants entered into the United States illegally.When apprehended, deportation back to their country of origin is the customarylegal procedure. Now, however, an intermediary process is advocated in lieu ofdeportation: an undocumented immigrant who, after following certain prescribedprocedures, including the payment of taxes, will be permitted to remain in theUnited States. This constitutes de facto amnesty for the "undocumentedimmigrant." As such, it relievesthe government of Mexico from any financial responsibility for the economicconsequences associated with the cost of medical care, public education, publichousing, welfare, police, and social services provided by the cities, countiesand states in which such initially illegal immigrants choose to reside.

Well-intentioned people are quick to denounce Arizona and call for a boycottof business transactions or travel involving the state. Why are they not calling for a boycott of Mexico? The truth is thatMexico is exporting, or at the very least facilitating the export, of itspoverty in the form of illegal immigrants to the United States.

WHEN YOU HEAR OBAMA TALK ABOUT JOBS,WHICH IS SELDOM, YOU CAN BET THE RANCHERO HE MEANS JOBS FOR ILLEGALS!

Any version of amnesty for illegal immigrants and efforts to organize aboycott of Arizona will detract from the number one priority affectingsubstantial segment of the American people: unemployment. Moreover, it willblow a hole in the projected operating costs and budget deficit projections inthe new health care bill.

SHOULD MEXICO START PAYING FOR THEIR OWN WELFARE? HOW ABOUT THE AMERICANPEOPLE FINE ANY ILLEGAL THAT WAVES A MEX FLAG IN OUR FACES AND REFUSED TO SPEAKTHE GRINGO’S LANGUAGE? THAT ALONE WOULD BRING IN BILLIONS!

The annual cost of maintaining andproviding services to illegal or "undocumented" citizens should betabulated, assumed and paid by the Government of Mexico or credited against theannual cost of oil we import from them until such time as immigrants from theircountry become U.S. citizens.

Why don't the pro-amnesty undocumented immigrant leaders join forces withthe "anti-illegal immigration" leaders and bring the Government ofMexico to the table? The annual cost ofmaintaining and providing services to illegal or "undocumented"citizens should be tabulated, assumed and paid by the Government of Mexico orcredited against the annual cost of oil we import from them until such time asimmigrants from their country become U.S. citizens.

Let's face it: right or wrong, the Arizona legislation is treating thesymptoms of an international disease that needs much stronger medicine.

At the parleys this week with hisUS and Canadian counterparts in Cancún, Mexican President Vicente Fox willpress for more opportunities for his countrymen north of the Rio Grande.Specifically, he will argue for additional visas for Mexicans to enter theUnited States and Canada, the expansion of guest-worker schemes, and the"regularization" of illegal immigrants who reside throughout thecontinent. In a recent interview with CNN, the Mexican chief executiveexcoriated as "undemocratic" the extension of a wall on the US-Mexicoborder and called for the "orderly, safe, and legal" northbound flowof Mexicans, many of whom come from his home state of Guanajuato. Mexicanlegislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of the SenateCommittee on Foreign Relations for North America, recently emphasized that thesolution to the "structural phenomenon" of unlawful migration liesnot with "walls or militarization" but with "understanding,cooperation, and joint responsibility." Such rhetoric would be moreconvincing if Mexican officials were making a good faith effort to uplift the50 percent of their 106 million people who live in poverty. To his credit,Fox's "Opportunities" initiative has improved slightly the plight ofthe poorest of the poor. Still, neither he nor Mexico's lawmakers have advancedmeasures that would spur sustained growth, improve the quality of theworkforce, curb unemployment, and obviate the flight of Mexicans abroad.Indeed, Mexico's leaders have turned hypocrisy from an art form into an exactscience as they shirk their obligations to fellow citizens, while decryingefforts by the US senators and representatives to crack down on illegalimmigration at the border and the workplace. What are some examples of thisfailure of responsibility? · When oil revenues are excluded, Mexico raises theequivalent of only 9 percent of its gross domestic product in taxes - a figureroughly equivalent to that of Haiti and far below the level of major LatinAmerican nations. Not only is Mexico's collection rate ridiculously low, itsfiscal regime is riddled with loopholes and exemptions, giving rise towidespread evasion. Congress has rebuffed efforts to reform the system.Insufficient revenues mean that Mexico spends relatively little on two keyelements of social mobility: Education commands just 5.3 percent of its GDP andhealthcare only 6.10 percent, according to the World Bank's last comparativestudy. · A venal, "come-back-tomorrow" bureaucracy explains the 58days it takes to open a business in Mexico compared with three days in Canada,five days in the US, nine days in Jamaica, and 27 days in Chile. Mexico'sprivate sector estimates that 34 percent of the firms in the country made"extra official" payments to functionaries and legislators in 2004.These bribes totaled $11.2 billion and equaled 12 percent of GDP. ·Transparency International, a nongovernmental organization, placed Mexico in atie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyedfor corruption. · Economic competition is constrained by the presence ofinefficient, overstaffed state oil and electricity monopolies, as well as asmall number of private corporations - closely linked to government big shots -that control telecommunications, television, food processing, transportation,construction, and cement. Politicians who talk about, much less propose,trust-busting measures are as rare as a snowfall in the Sonoran Desert.Geography, self-interests, and humanitarian concerns require North America's neighborsto cooperate on myriad issues, not the least of which is immigration. However,Mexico's power brokers have failed to make the difficult decisions necessary touse their nation's bountiful wealth to benefit the masses. A gallon of regular gasoline the day Obama was inaugurated was $1.79
on average in the U.S. Today that price is $3.59, a 100.6% increase.

The number of food stamp recipients has risen since Obama took office
from 31,983,716 to 43,200,878, a 35.1% jump. Long term unemployment
soared 146.2% during the same 32 month period from 2,600,000 to
6,400,000. Staggering hope and change isn't it?

American citizens living in poverty have risen 9.5% from 39,800,000 to
43,600,000, and the number of unemployed has jumped almost 25% from
11,616,000 to 14,485,000 as of August 31, 2011. The number of
unemployed blacks has risen from 12.6% at the end of George Bush's
term to 15.8% today, a 25.4% increase, and finally, our national debt
is up 34.4% from 10.627 trillion to 14,278 trillion *

Keep these figures in mind as we recount the number of firsts for this
presidency:
First President to refuse to show a valid birth certificate.
First President to apply for college aid as a foreign student, then
deny he was a foreigner.
First President to have a social security number from a state he has
never lived in.
First President to preside over a cut to the credit rating of the

First President to violate the War Powers Act.
First President to be held in contempt of court for illegally
obstructing oil drilling in the Gulf of Mexico .

Records show that four out of Obama's top five contributors areemployees of financial industry giants - Goldman Sachs ($571,330), UBS AG($364,806), JPMorgan Chase ($362,207) and Citigroup ($358,054).

There was some pressspeculation that Daley’s departure was related to Obama’s decision to base hisreelection campaign on attacking congressional Republicans for obstructing hissupposed jobs initiatives, combined with doses of populist rhetoric aboutdefending the middle class and fighting Wall Street. Whatever electoralcalculations may have been involved, however, the shift in White Housepersonnel does not reflect any change in the right-wing, pro-corporate policiesof the Obama administration.

On the contrary, theappointment of Lew underscores the incestuous relationship between the ObamaWhite House and Wall Street. All three of Obama’s chiefs of staff—Rahm Emanuel(2009-2010), Daley (2011-2012) and Lew—are multi-millionaires who made theirfortunes as top executives of major banks.

He was brought in, replacinginterim White House head Peter Rouse, to reassure the corporations and banksthat Obama would fully implement their agenda of deregulation and austerity andto conciliate the Republicans. His appointment signaled a further shift to theright by the Obama administration.

Daley resigns as White House chiefof staff

PresidentBarack Obama on Monday announced the resignation of his chief of staff, WilliamDaley, and the appointment of the current budget director, Jacob Lew, toreplace him. Daley is expected to becomeco-chair of Obama’s reelection campaign, where he will use his Wall Streetconnections to raise millions in campaign cash from the financial industry.

Accordingto numerous reports, Daley’s departure, coming after a bit less than a year atthe top White House post and at the start of an election year, took Obama bysurprise. Only last October Daley had said he would remain until after the 2012elections.

However,it had been widely reported that Daley was the focus of tensions within theWhite House, and last November, after the administration failed to secure a“grand bargain” deficit-cutting deal with the Republicans, Daley announced hewas giving up day-to-day management of White House affairs.

On the contrary, the appointment of Lewunderscores the incestuous relationship between the Obama White House and WallStreet. All three of Obama’s chiefs of staff—Rahm Emanuel (2009-2010), Daley(2011-2012) and Lew—are multi-millionaires who made their fortunes as top executivesof major banks.

Emanuel,who resigned in September 2010 to run for mayor of Chicago, made more than $18million in the two-and-a half years he spent at a Chicago investment firmbetween a stint in the Clinton White House and six years in the House ofRepresentatives. He left Congress in 2009 to run the Obama White House. Emanuelwas the top recipient in the House of Representatives of campaign contributionsfrom hedge funds, private equity firms and the broader investment industryduring the 2008 election cycle.

Daley, son and brother ofChicago’s longest-serving mayors, headed the Commerce Department under Clintonand then joined JPMorgan Chase, where he made millions as the bank’s Midwestchairman and head of its global lobbying department, where he worked to blockObama’s new consumer financial protection bureau.

Longconsidered a representative of the right wing of the Democratic Party, even asthe party as a whole lurched ever more to the right, Daley was tapped by Obamafollowing the Democratic rout in the 2010 congressional elections. He was brought in, replacing interim WhiteHouse head Peter Rouse, to reassure the corporations and banks that Obama wouldfully implement their agenda of deregulation and austerity and to conciliatethe Republicans. Lewis a longtime Washington insider, having served as a top adviser to the lateHouse Speaker Tip O’Neill in the 1980s and director of the Office of Managementand Budget (OMB) in the final years of the Clinton administration. He wasdeputy director of the State Department under Hillary Clinton in 2009 and 2010,until he left to become OMB director for Obama.

Priorto joining the Obama administration, Lew spent three years as a top executiveat Citigroup. (The man he replaced as budget director, Peter Orszag, accepted amulti-million-dollar position as a high-level Citigroup official within monthsof leaving his post in the Obama administration).

In2008, at the time of the financial crash, Lew was chief operating officer ofCitigroup Alternative Investments, an internal private equity, hedge fund andreal estate investing arm of the bank. Lew’s unit invested heavily andprofitably in the hedge fund managed by billionaire John Paulson, which madebillions of dollars by betting that the subprime housing market would collapse.

Paulsonwas named by the Senate Permanent Subcommittee on Investigations as well as theSecurities and Exchange Commission as playing a central role in securitiesfraud committed by Goldman Sachs. Both federal bodies charged that Goldman mademillions by selling subprime-backed securities to investors, without tellingthem that the underlying mortgages had been hand-picked by Paulson, who was,along with Goldman, betting that the securities would collapse.

Forhis contribution to the financial collapse, Lew received a salary of $1.1million. Two weeks before he joined the Obama State Department, and afterCitigroup had received $45 billion in taxpayer bailout money, Lew was awardedan additional $900,000 bonus by Citigroup.

Lewheaded up the Obama administration’s efforts to forge an agreement withcongressional Republicans over the spring and summer for $4 trillion indeficit-reduction over the next decade. The White House and the Republicanleadership created a crisis over the deadline for raising the federal debtlimit in order to push through unprecedented cuts in basic social programs.

UnderLew’s direction, the administration sought to outflank the Republicans from theright, including in its budget proposal cuts in Social Security as well asbillions in reductions in Medicare and Medicaid. The deal collapsed as a resultof Republican opposition. In the end, the two sides passed a scaled-down plan toslash $2.4 trillion, including sweeping cuts in food stamps, home heatingassistance, public health and housing. The agreement excluded any tax increaseon corporations or the rich.

Boththe Democrats and Republicans acknowledge the August 2011 deal to be a meredown payment on more massive cuts to be enacted after the November elections.

Obama's Regulatory Reform Sham Continues

PresidentObama's much-praised efforts at regulatory reform remain a sham. This pastweek, while the President traveled overseas, the Office of Management andBudget (OMB) in conjunction with rolled out its review of proposed changes to government regulations.

Thereform will affect at least 30 federal agencies and is designed to "alwaysconsider costs and ways to reduce burdens for American businesses whendeveloping rules; expand opportunities for public participation and publiccomment; and ensure that regulations are driven by real science." Anelegant White House web page, accompanied by an online, explanatory video,supported by an in-person appearances from OMB Director Jacob Lew and CassSunstein, and countless, premature victory laps around Washington cannot disguisethe emptiness of many of the proposed reforms. For, what has been released isjust the plan for the plan.

Accordingto the hype, after 120 days of effort, federal agencies have come forward with"groundbreaking" ideas--not for ways to cut costs to taxpayers byreducing regulations--but with ideas on how to generate ideas on how toimplement potential regulatory review and reform.

Whata lot of hullabaloo about something that hasn't happened, and which, if thetimelines identified in the 30 agency plans are anything to go by, willnot happen until 2012--long after the current debt ceiling has exploded and toolate to provide significant contributions to the federal budget and deficitdebate.

Anytalk from Sunstein about billions in savings is premature at best and possiblyconstitutes a deliberate attempt at fraud since changes will be proposed to beimplemented in 2012 or later--so that it will be difficult to measureaccountability and results until long after the November 2012 presidentialelection.

Readingsome of the agency plans housed on the White House website shows that much ofwhat the White House is calling an "unprecedented, government-widereview" is little more than a rehash of policies, planning and strategiesproposed during the Clinton and Bush Administrations. Many of those actions,which were identified by Obama's predecessors, have been left languishingduring the Obama Administration because they called for tough actions.

TheRegulations Review process is adding to the size of government by creating newreview committees, adding to the cost of government because none of thesereview bodies operate free of cost, and Sunstein and his team seem to bebanking on the fact that few will read the hollow reports, so that the ObamaAdministration can present their "savings" howsoever they choose.

Thenthere is the issue of transparency. For example, the Department of Education's report along with 29 others listedon the White House site can only be commented on by providing personal Facebookinformation, thus eliminating commenter anonymity, which will certainly affectthe content of the feedback, and forcing non-Facebook users to search foralternative means to provide comments to the Obama Administration.

Inanother example, the U.S. General Services Administration (GSA) report ofregulatory reform spends almost approximately 9 pages of its 12-page reportdiscussing the plan for the plan and spends less than three pages listingrecommended regulations considered for regulatory reform. Of the five reformslisted, three of the five comprise regulation reforms were begun and completedduring the Bush Administration.

Oneof the recommendations (#4, p.10) a review of the GSA Multiple Award Schedule(MAS) pricing clause was an idea conceived, a Blue ribbon commission formed and funded and with findingscompleted during the previous Administration. These findings from theindependent commission have been waiting for the current GSA Administrator toact upon for the past two years.

Instead,at no small expense to the American taxpayer, the current team at GSA seems tobe saying: let's just kick that can down the road because confronting thechallenges of this out-of-date, ineffective rule is just too scary. So, in thisplan for the plan, the current team at GSA promises to look at the pricingclause problem with a date uncertain in 2012 for possible resolution. In thecase of GSA's blatant misrepresentation, claiming credit for proposing new and"unprecedented" regulatory reform reviews based partly on arecommendation that the Obama Team will launch the Pricing Clause review isnothing other than a fraud, and an easily exposed one at that.

Bycontrast, the Department of Education report and the Department of HomelandSecurity report identify in their reports that much of the to-be-discussedregulatory reform was initiated during the Bush Administration.

Forthe Obama Administration to claim that the Regulatory Review chicanerycomprises a "defining moment" is an insult to the American taxpayerwho has to foot the bill, and the folks in government who have put their nameson these reports should be ashamed.

Aseries of articles published over the weekend, based on financial disclosurereports released by the Obama administration last Friday concerning top WhiteHouse officials, documents the extent to which the administration, in both itspersonnel and policies, is a political instrument of Wall Street.

Policiesthat are extraordinarily favorable to the financial elite that were put inplace over the past month by the Obama administration have fed a surge in sharevalues on Wall Street. These include the scheme to use hundreds of billions ofdollars in public funds to pay hedge funds to buy up the banks’ toxic assets atinflated prices, the Auto Task Force’s rejection of the recovery plans ofChrysler and General Motors and its demand for even more brutal layoffs, wagecuts and attacks on workers’ health benefits and pensions, and the decision bythe Financial Accounting Standards Board (FASB) to weaken “mark-to-market” accountingrules and permit banks to inflate the value of their toxic assets.

Atthe same time, Obama has campaigned against restrictions on bonuses paid toexecutives at insurance giant American International Group (AIG) and otherbailed-out firms, and repeatedly assured Wall Street that he will slash socialspending, including Medicare, Medicaid and Social Security.

Thenew financial disclosures reveal that top Obama advisors directly involved insetting these policies have received millions from Wall Street firms, includingthose that have received huge taxpayer bailouts.

Thecase of Lawrence Summers, director of the National Economic Council and Obama’stop economic adviser, highlights the politically incestuous character ofrelations between the Obama administration and the American financial elite.

Lastyear, Summers pocketed $5 million as a managing director of D.E. Shaw, one ofthe biggest hedge funds in the world, and another $2.7 million for speechesdelivered to Wall Street firms that have received government bailout money.This includes $45,000 from Citigroup and $67,500 each from JPMorgan Chase andthe now-liquidated Lehman Brothers.

Fora speech to Goldman Sachs executives, Summers walked away with $135,000. Thisis substantially more than double the earnings for an entire year ofhigh-seniority auto workers, who have been pilloried by the Obamaadministration and the media for their supposedly exorbitant and“unsustainable” wages.

Alludingdiplomatically to the flagrant conflict of interest revealed by thesedisclosures, the New York Times noted on Saturday: “Mr. Summers, thedirector of the National Economic Council, wields important influence over Mr.Obama’s policy decisions for the troubled financial industry, including firmsfrom which he recently received payments.”

Summers was a leadingadvocate of banking deregulation. As treasury secretary in the second Clintonadministration, he oversaw the lifting of basic financial regulations datingfrom the 1930s. The Times article notes that among his currentresponsibilities is deciding “whether—and how—to tighten regulation of hedgefunds.”

Summers is not an exception.He is rather typical of the Wall Street insiders who comprise a cabinet andWhite House team that is filled with multi-millionaires, presided over by apresident who parlayed his own political career into a multi-million-dollarfortune.

MichaelFroman, deputy national security adviser for international economic affairs,worked for Citigroup and received more than $7.4 million from the bank fromJanuary of 2008 until he entered the Obama administration this year. Thisincluded a $2.25 million year-end bonus handed him this past January, withinweeks of his joining the Obama administration.

Citigrouphas thus far been the beneficiary of $45 billion in cash and over $300 billionin government guarantees of its bad debts.

DavidAxelrod, the Obama campaign’s top strategist and now senior adviser to thepresident, was paid $1.55 million last year from two consulting firms hecontrols. He has agreed to buyouts that will garner him another $3 million overthe next five years. His disclosure claims personal assets of between $7 and$10 million.

Obama’sdeputy national security adviser, Thomas E. Donilon, was paid $3.9 million by aWashington law firm whose major clients include Citigroup, Goldman Sachs andthe private equity firm Apollo Management.

LouisCaldera, director of the White House Military Office, made $227,155 last yearfrom IndyMac Bancorp, the California bank that heavily promoted subprimemortgages. It collapsed last summer and was placed under federal receivership.

Thepresence of multi-millionaire Wall Street insiders extends to second- andthird-tier positions in the Obama administration as well. David Stevens, whohas been tapped by Obama to head the Federal Housing Administration, is thepresident and chief operating officer of Long and Foster Cos., a real estatebrokerage firm. From 1999 to 2005, Stevens served as a top executive forFreddie Mac, the federally-backed mortgage lending giant that was bailed outand seized by federal regulators in September.

NealWolin, Obama’s selection for deputy counsel to the president for economicpolicy, is a top executive at the insurance giant Hartford Financial Services,where his salary was $4.5 million.

Obama’sAuto Task Force has as its top advisers two investment bankers with a longresume in corporate downsizing and asset-stripping.

Itis not new for leading figures from finance to be named to high posts in a USadministration. However, there has traditionally been an effort to demonstratea degree of independence from Wall Street in the selection of cabinet officialsand high-ranking presidential aides, often through the appointment of figuresfrom academia or the public sector. In previous decades, moreover,representatives of the corporate elite were more likely to come from industrythan from finance.

Inthe Obama administration such considerations have largely been abandoned.

Thiswill not come as a surprise to those who critically followed Obama’s electioncampaign. While he postured before the electorate as a critic of the war inIraq and a quasi-populist force for “change,” he was from the first heavilydependent on the financial and political backing of powerful financiers in Chicago.Banks, hedge funds and other financialfirms lavishly backed his presidential bid, giving him considerably more thanthey gave to his Republican opponent, Senator John McCain.

AlongsideWall Street, the Obama cabinet is dominated by the military, including threerecently retired four-star military officers: former Marine General James Jonesas national security adviser; Admiral Dennis Blair as director of nationalintelligence, and former Army Chief of Staff Erik Shinseki as secretary ofveterans’ affairs.

Theseare the deeply reactionary political and class interests that are representedby the Obama administration.

Friday’sfinancial disclosures further expose the bankruptcy of American democracy.Elections have no real effect on government policy, which is determined by theinterests of the financial aristocracy that dominates both political parties.The working class can fight for its own interests—for jobs, decent livingstandards, health care, education, housing and an end to war—only through a breakwith the two parties of American capitalism and the development of a mass,independent socialist movement.

More than 5 million households had their wealth wiped outsince 2005

Thetypical US household lost 28 percent of its wealth during the economic crisis,with one third of these being totally wiped out, according to a recent analysisof Census Bureau data carried out by the Pew Research Center, “Wealth Gaps Riseto Record Highs Between Whites, Blacks and Hispanics”.

Whilethe study headlines racial disparities, the most striking findings concern thegeneral impoverishment of all sections of the population. The percent of UShouseholds who have a net worth of zero dollars or below—meaning they have moredebts than assets—grew from 15 percent in 2005, to 20 percent in 2009. Thismeans that 5.6 million households, or about 15 million people, had their wealthtotally wiped out during the first part of the economic downturn. These figurescome from an analysis of Census Bureau survey data for 2005 and 2009.

Thestudy found that, after adjusting for inflation, the median wealth of UShouseholds fell from $96,894 in 2005 to $70,000 in 2009, a drop of 28 percent.The majority of this is attributable to the precipitous fall in real estatevalues, by about 30 percent between 2006 and 2009 and even more since.

Thefall in home values has been compounded by falling wages. Between 2005 and2009, workers’ average hourly earnings fell, on an inflation-adjusted basis, by5 percent, according to the Labor Department.

Indebtednesshas grown as rapidly as wealth has fallen. Between 2005 and 2009, unsecuredliabilities grew 33 percent for the population as a whole, the study found.

Meanwhile,the share of household wealth held by the wealthiest ten percent of householdsgrew from 49 percent in 2005 to 56 percent in 2009.

Racialminorities have been particularly hard hit, including by the fall in housingvalues. The net worth of Hispanic households fell by a staggering 66 percent,from $12,124 in 2005 to $5,677 in 2009. The net worth of black households haslikewise tumbled 53 percent. Among Hispanics, unsecured debt grew by 47percent.

Thelevel of inequality between whites, blacks, and Hispanics is now at the highestlevel in 25 years, and no doubt longer. The racial differentiation is partlyattributable to geography. While whites saw the values of their own homes fallby 18 percent and blacks by 23 percent, the home values of Hispanics fell bymore than half.

Asthe report notes, “In 2005, more than two-in-five of the nation’s Hispanic andAsian households resided in Arizona, California, Florida, Michigan and Nevada,the five states with the steepest declines in home prices.” For Hispanicsliving in these states, the report noted, “median net worth tumbled from$51,464 in 2005 to $6,375 in 2009, a loss of 88 percent.”

Theseracial divergences, however, mask the more fundamental growth of inequalitybetween the working class and the wealthy of all races. The report notes thatthe wealthiest 10 percent of blacks now controls 67 percent of the wealth forthat group, compared to 59 percent before the downturn. For Hispanics,likewise, the wealthiest 10 percent controlled 72 percent of wealth in 2009, upfrom 59 percent in 2005.

Thenumber of unemployed, meanwhile, grew from 7.9 million to 15.2 million between2005 and 2009. Rising unemployment, too, has disproportionately affectedminorities. Unemployment has affected blacks and hispanics disproportionately,with the unemployment rate for blacks currently at 16.5 percent and 11.6percent for hispanics.

Thestaggering fall in wealth has had an transformative effect on American society,contributing to the millions of foreclosures and personal bankruptcies.According to figures from Realtytrac.com, there were 10 million foreclosuresbetween 2005 and 2009, the years covered by the survey.

As dozens of majorcorporations announced increased second-quarter profits this week, the USworking class was hit with a disastrous new round of mass layoffs.

OnMonday, book seller Borders announced that it would liquidate all of itsstores, laying off 10,700 workers. That same day, Cisco, the telecom equipmentmaker, said it would cut its workforce by 11,500. Within 24 hours, LockheedMartin, the aerospace company, announced that it would eliminate 6,500 jobs.

Atthe same time, Caterpillar, the maker of construction equipment, said itsprofits were up 44 percent in the second quarter compared to last year. Officeequipment maker Xerox saw its profits grow 41 percent in the same time.

GeneralElectric’s profits were up 17 percent, PepsiCo’s were up by 18 percent, andMcDonald’s, the fast food company, saw a 19 percent increase, reaching a newrecord.

Theenergy and mining companies did even better, benefiting from rising gas prices,which reduced the real incomes of American workers by billions of dollars.Halliburton, the oil contractor, said its profits were up by 53 percent in thesecond quarter compared to a year earlier, while fellow oil contractorSchlumberger said its profits were up by 64 percent.

Mostof the major banks likewise said their profits were up significantly in thesecond quarter. Goldman Sachs announced $1.09 billion in profits, up 57 percentfrom last year. But even this huge increase was considered a “disappointment”for traders.

JPMorgansaid its second-quarter profit was up by 13 percent, despite setting aside a$1.3 billion charge-off for lawsuits it expects in relation to its traffickingof fraudulent mortgages. Citigroup reported a profit of $3.34 billion, up 24percent from a year ago.

Thisrenewed growth in profits comes at the same time as the sharpest growth inunemployment since 2009. Between March and June, the unemployment rate grew by0.4 percentage points, to 9.2 percent. In the same period, the number ofunemployed people grew by 545,000.

Apple,the world’s largest music retailer and a leading manufacturer of mobileelectronics, announced a 95 percent increase in profitability. In its earningsstatement, the company said that it was sitting on a cash hoard of $76 billion.This staggering sum, amassed by a single company controlled by a few largeshareholders, could put two million people to work full-time for a year.

UScorporations have combined cash reserves of $2 trillion. That is enough moneyto put all the unemployed people in the United States to work for four years,even without any profit generated from their labor.

Butfresh off of what is for many a record-breaking second quarter, the companiesare refusing to use their newly accumulated cash to hire. In fact, planned masslayoffs have only accelerated.

Evenafter the disastrous second quarter, the jobs situation is getting worse.Challenger, Gray & Christmas, Inc, the executive placement company, saidearlier this week that the number of planned job cuts grew by 11.6 percent,reaching 41,432 last month. This was the second consecutive monthly increase inplanned mass layoffs.

Newclaims for unemployment benefits have likewise moved upwards. After dipping inApril to 385,000, the lowest level since 2007, they have steadily grown,reaching 418,000 last week.

Thedisastrous employment conditions in the private sector are only exacerbated bythe aggressive budget cutting carried out by state and local governments, underthe whip of cuts to federal assistance.

Stateand local governments have cut 165,000 jobs so far this year, on top of thequarter million workers they laid off in 2010. But this is only the beginning:analysts expect hundreds of thousands more layoffs this year as cuts in federalaid intensify.

Theseplanned layoffs will only be compounded by the massive federal spending cutscurrently being discussed between the Congress and the White House, which wouldeliminate between $3 and $4 trillion from federal spending. This would meanhundreds of thousands of federal job cuts.

Thefact that American corporations were able to accumulate record profits whilehundreds of thousands were thrown into the ranks of unemployment is not acoincidence. These profits were generated through the impoverishment ofworkers, who, desperate for any work available, have increasingly acceptedlower wages and worse conditions.

Despitethe abysmal employment conditions, mass joblessness has disappeared as apolitical issue in the United States, with the entire political establishmentpushing for cuts to government spending. This absurd and irrational setup is aproduct of the monopolization of political life in the United States by thesuper-rich, who are carrying out a full-scale assault on the social conditionsof the working class.

Incontrast to the ruling class’s anti-social and destructive policy, the workingclass must present its own political program. The trillions of dollars sittingon the balance sheets of the corporations must be expropriated and used toprovide jobs and desperately-needed social services.

Thisprogram requires a new mass political movement, completely independent of theDemocrats and Republicans, to break the political stranglehold of thecorporations, and reorganize society on the basis of social need, not privateprofit.

On Monday, the Obamaadministration released its proposed federal budget for fiscal year 2012. Aftercommitting trillions in federal bailouts to the banks and billionaires, theWhite House is demanding cuts that will devastate the working class, andparticularly its poorest and most vulnerable sections.

The$1.1 trillion in cuts for the next decade proposed by the White House is to beonly the starting point for further cuts, as spokesmen for both big businessparties acknowledge. Senate Budget Chairman Kent Conrad, a Democrat, declared,“We’ve got to do substantially more than $1 trillion worth of deficit reductionin the next decade.” Republican House Speaker John Boehner said, “There’s nolimit to the amount we’re willing to cut.”

Democratsand Republicans agree on gargantuan military spending, an uninterrupted flow offunds to the financial aristocracy, and continued tax breaks for corporateAmerica and the wealthy. As a top White House official told the press at abackground briefing on the budget, “The debate in Washington is not whether tocut or to spend. We both agree we should cut. The question is how we cut andwhat we cut.”

TheObama budget projects that the ten-year cumulative deficit will reach astaggering $10.4 trillion. By attempting to wring such vast sums from the hidesof the population, the ruling elite is trying to set American society back toconditions not seen for generations.

Programsto be cut include not only those targeted by Obama and the Republicans in thecurrent budget debate—home heating assistance, Pell Grants, WIC, Head Start,etc.—but the much larger entitlement programs, Social Security and Medicare,which will face cuts later in the budget process.

Thesocial impact will be incalculable. As hundreds of thousands of people face thebitter cold of winter without heat and gas, Obama is proposing halving thegrossly inadequate federal assistance that is available. As students graduatewith record debt and no job prospects, the administration is proposingsignificant cuts in government aid. Such gross indifference to social distressis repeated in every sphere.

Significantcuts to Social Security and Medicare—which amount to denying America’s elderlytheir right to pensions and health care—would have an even broader impact.

Behindthe “debate” in Washington and the media over the budget is a massive lie—theclaim that the budget deficits are a product of excessive social spending.Obama’s budget director Jacob Lew summed up this grotesque falsification anop-ed column published in the New York Times February 6, under theheadline, “The Easy Cuts Are Behind Us.” Lew claimed that the causes of theprojected budget deficits were “decisions to make two large tax cuts withoutoffsetting them and to create a Medicare prescription drug benefit withoutpaying for it, combined with the effects of the recession…”

Thislist is notable for what it leaves out: the cost of two wars, in Afghanistanand Iraq, which runs into the trillions; and the bank bailouts, where moretrillions in public funds were placed at the disposal of the financialaristocracy, with no questions asked. The military budget by itself accountsfor the lion’s share of the ten-year deficit: more than $7 trillion of theprojected $10 trillion.

Lew’smore fundamental omission, however, is the grotesque class inequality thatpervades American society. The top one percent of the US population owns overone third of the country’s wealth. The greatest wealth, however, isconcentrated in an even smaller layer. Indeed, the $1.1 trillion in proposedcuts—which will have a terrible impact on the lives of millions of people—issomewhat less than the combined wealth of only the 400 richest Americans.

Thearguments presented by the ruling elite for the cuts are staggeringlyhypocritical. As they drown in floods of cash, they insist that no money isavailable for workers’ most basic needs.

Workersmust reject this argument out of hand. They are not responsible for the orgy ofswindling and profiteering that produced the 2008 Wall Street crash and pushedthe world economy into the deepest slump since the Great Depression. On thecontrary, an essential feature of the speculative binge was that the share ofnational income received by workers has shrunk to the lowest level in nearly acentury.

Thesemeasures will provoke mass opposition. The revolutionary struggles in Egypt—inwhich protests and strikes of millions of workers and youth forced theresignation of a US-backed dictator that ruled the country for more than 30years—point to the forms of struggle that will spread worldwide in the comingperiod. Mass unemployment, record inequality, and the corruption of thepolitical system are common to Egypt and the United States, and are in factuniversal. At the foundation of this system is the principle that economic lifemust be subordinated to private profit and the maintenance of the wealth ofthose who control the giant banks and corporations.

Theworking class can secure its interests only through the overturn of thecapitalist system as a whole—that is, the reorganization of economic life tomeet social need. In every aspect of its policies and of its social being, theruling class itself makes the case for socialist revolution.

Thenow-abandoned Taj Mahal complex cost ordinary Americans more than $733 million.But billionaire Democratic donor and frequent White House guest George Kaiser,whose nonprofit foundation was Solyndra's biggest investor, is still sittingpretty. He and the other private investors of Solyndra will recoup their lossesahead of taxpayers. And while they blast their GOP opponents, double-standardDemocrats will remain AWOL on the glaring tax-avoidance strategies of thewealthy Kaiser Family Foundation.

BankruptBeacon Power, fat Democratic coffers. This green energy storage plant filed forbankruptcy last fall after a $43 million injection of Obama Department ofEnergy loan guarantees. Federal election record filings show that CEO WilliamCapp contributed to the 2008 Obama campaign, as well as several left-wing NewEngland Democratic candidates. Beacon Power lobbyist Steve Wolfe was a formeraide to the late Sen. Ted Kennedy. Beacon sought bankruptcy shelter two daysafter the White House responded to fiscal watchdogs' demands for a review ofthe DOE's shoddy loan monitoring programs.

BankruptSpectraWatt, red-faced Goldman Sachs. A solar cell company based in New York,SpectraWatt went belly up last August despite a half-million-dollar federalstimulus boost and lucrative backing from politically connected Goldman Sachs-- whose ties reach deep into the Obama Treasury Department, Commodity FuturesTrading Commission, White House National Economic Council and 1600 PennsylvaniaAve. itself. The eco-failure was dumped in a fire sale for less than $5million.

TeeteringNevada Geothermal, cheerleading Harry Reid. Despite $150 million in federal DOEand Treasury Department subsidies -- not to mention personal lobbying by SenateMajority Leader Harry Reid -- this alternative energy project is on the brinkof failure. A Deloitte and Touche audit grimly concludes that the company"has incurred net losses over the past several years, has an accumulateddeficit of $44.0 million and an anticipated inability to retire its long-termliabilities." According to CBS News, the company's latest SEC filings warnof multiple defaults.

Myscouring of White House visitor logs shows nine visits from another GreenRobber Baron, Illinois-based Exelon's CEO John Rowe, who met with the presidentand former chief of staff Rahm Emanuel multiple times. As Forbes magazinereported: The clean energy company "has very deep ties to the ObamaAdministration. Frank M. Clark, who runs ComEd, helped advise Obama before heran for president and is one of Obama's largest fundraisers. Obama's chiefpolitical strategist, David Axelrod, worked as a consultant to Exelon. Ariz. mayrequire hospitals to check citizenship

PHOENIX –Republican lawmakers want to widen Arizona's illegal immigration crackdown witha proposal to require hospitals to check on whether patients are in the countrylegally, causing outrage among medical professionals who fear becoming de factoimmigration agents under the law.

Themedical industry ripped the bill Monday as it was scheduled for a hearing bythe Senate Judiciary Committee. Doctors envisioned scenarios in whichimmigrants with contagious diseases such as tuberculosis would stay home fromthe clinic or hospital and put themselves and the public at a grave healthrisk.

"Thisis making us into a police state that will try to catch people when they aresick," said George Pauk, a retired doctor with an organization calledPhysicians for a National Health Program. "Do we want to stop sick peoplefrom coming in for health care?"

Arizonais the first Legislature to take up such a measure amid a national push inconservative states to crack down on illegal immigration, according to theNational Conference of State Legislatures. Arizona lawmakers ignited the debatea year ago when they passed a bill that required local police, while enforcingother laws, to question the immigration status of those they suspect are in thecountry illegally. A judge later put that provision on hold.

Thediscussion about the bill comes just days after an illegal immigrant in Texaswith a banana-size tumor in her spine said she was ousted from her hospitalbecause of her immigration status. She later found another hospital to gettreatment.

Supporterssay the hospital bill is necessary tool to fight illegal immigration at a timewhen hospitals lose tens of millions of dollars treating illegal immigrants inemergency rooms.

SenatePresident Russell Pearce, a Mesa Republican who was chief sponsor of lastyear's immigration law, says the hospitals bill is part of a broader effort tocrack down on illegal immigration. The hospitals bill wouldn't bar people fromgetting care, but it would put the onus on hospitals to "do duediligence," Pearce said. "We're going to enforce our laws withoutapology."

AddedPearce: "It's the law. It's a felony to (aid and) abet. We're going toenforce the law without apology."

Othersponsors of the bill did not immediately return calls seeking comment.Discussion of the bill in the committee was put on hold late Monday until alater date.

Thelegislation, known as Senate Bill 1405, would require hospitals, when admittingnonemergency cases, to confirm that a person seeking care is a U.S. citizen orin the country legally. In emergency cases where the patient isn't herelegally, the hospital would be required to call immigration authorities afterthe treatment is done. Hospitals in non-emergency situations would also berequired to contact federal immigration authorities, but they would have moreapparent discretion about whether to treat illegal immigrants.

Opponentssay the bill could pose serious health risks to those here legally andillegally. They believe the threat of deportation would keep some people fromseeking health care for everything from emergency situations to measures suchas vaccinations, potentially leading to preventable deaths. They also said itwould increase hospitals' already-strained workload.

"Youare now turning medical professionals into full-time INS agents," saidDemocratic state Sen. Steve Gallardo, speaking at a news conference Monday."Doctors that should be working to help treat ill patients are now turninginto ICE agents."

NicoleRussell is the mother of a 3-year-old daughter named Kira, and she could notenvision what it would be like for a parent to decide whether or not to taketheir child to the hospital for fear of being reported to the authorities.

"Ican't imagine putting the health care of my daughter in the hands ofpoliticians," she said.

AZ planning crackdown on tax fraud; new scrutiny mayaffect migrants most

PHOENIX - Armed with a new computerprogram, the Arizona Department of Revenue is cracking down on tax fraud thisyear.

And although administrators say illegalimmigrants aren't the target, they're likely to be the majority of those caughtup in the effort.

People whose federal tax-identificationnumbers doesn't match the information provided on their W-2 forms will not gettheir refunds unless they can prove they are the ones who did the work.

The state and the Internal RevenueService encourage illegal immigrants to file income-tax forms and comply withtax laws, which apply to individuals who earn money in the United Statesregardless of their legal status.

In Arizona, where it's a crime toknowingly hire an illegal immigrant, an immigrant will often work using eithera fake Social Security number or one that belongs to someone else. Theiremployer puts that Social Security number on his or her W-2 form.

For tax filing, illegal immigrants - oranyone in the United States legally who isn't eligible for a Social Securitynumber - must apply to the IRS for an Individual Tax Identification Number.They then file taxes under that number.

The Arizona Department of Revenue's newprogram will check all tax documents filed with tax ID numbers to make sure anylisted Social Security number and the tax ID number both belong to the employeenamed.

If they don't, the state will send outa letter asking the employee to prove he or she is the one who actually did thework.

Anthony Forschino, assistant directorat the Department of Revenue, said about 60,000 Arizona residents filed taxeslast year using a tax ID number, resulting in about $6 million in refunds.

He said the state sampled a"pretty good portion" of those returns and found that in 80 to 85percent of them, the ID number did not match information provided on anassociated W-2.

This year, the new program will allowthe state to go through all the returns.

"We have a responsibility to tryand stop fraudulent returns," Forschino said. Forschino said officialswant to give refunds to those who earned them, regardless of legal status.

He said his department is still tryingto work out details of what sort of documentation an individual could show toprove he or she is the one who did the work and paid the taxes.

The state’s new immigration law is perfectly reasonable, but you wouldn’tknow it from the New York Times.

Supporters ofArizona’s new law strengthening immigration enforcement in the state shouldtake heart from today’s New York Times editorial blasting it. “Stopping Arizona” containsso many blatant falsehoods that a reader can be fully confident that the law asactually written is a reasonable, lawful response to a pressing problem. Onlyby distorting the law’s provisions can the Times and the law’s manyother critics make it out to be a racist assault on fundamental Americanrights.

The law, SB 1070,empowers local police officers to check the immigration status of individualswhom they have encountered during a “lawful contact,” if an officer reasonablysuspects the person stopped of being in the country illegally, and if aninquiry into the person’s status is “practicable.” The officer may not base hissuspicion of illegality “solely [on] race, color or national origin.” (Arizonalawmakers recently amended the law to change the term “lawfulcontact” to “lawful stop, detention or arrest” and deleted the word “solely”from the phrase regarding race, color, and national origin. The governor isexpected to sign the amendments.) The law also requires aliens to carry theirimmigration documents, mirroring an identical federal requirement. Failure tocomply with the federal law on carrying immigration papers becomes a statemisdemeanor under the Arizona law.

Good luck finding anyof these provisions in the Times’s editorial. Leave aside for the momentthe sweeping conclusions with which the Times begins its screed—suchgems as the charge that the law “turns all of the state’s Latinos, even legalimmigrants and citizens, into criminal suspects” and is an act of “racialseparation.” Instead, let’s see how the Times characterizes the specificlegislative language, which is presumably the basis for its indictment.

The paper allegesthat the “statute requires police officers to stop and question anyone wholooks like an illegal immigrant.” False. The law gives an officer thediscretion, when practicable, to determine someone’s immigration status onlyafter the officer has otherwise made a lawful stop, detention, or arrest. Itdoes not allow, much less require, fishing expeditions for illegal aliens. Butif, say, after having stopped someone for running a red light, an officer discoversthat the driver does not have a driver’s license, does not speak English, andhas no other government identification on him, the officer may, if practicable,send an inquiry to his dispatcher to check the driver’s status with a federalimmigration clearinghouse.

The Times thenalleges that the law “empower[s] police officers to stop anyone they choose anddemand to see papers.” False again, for the reasons stated above. An officermust have a lawful, independent basis for a stop; he can only ask to see papersif he has “reasonable suspicion” to believe that the person is in the countryillegally. “Reasonable suspicion” is a legal concept of long-standing validity,rooted in the Constitution’s prohibition of “unreasonable searches andseizures.” It meaningfully constrains police activity; officers are trained inits contours, which have evolved through common-law precedents, as a matter ofcourse. If the New York Times now thinks that the concept isinsufficient as a check on police power, it will have to persuade every courtand every law enforcement agency in the country to throw out the phrase—and theConstitution with it—and come up with something that suits the Times’scontempt for police power.

On broader legalissues, the Times is just as misleading. The paper alleges that the“Supreme Court has consistently ruled that states cannot make their ownimmigration laws.” Actually, the law on preemption is almost impossibly murky.As the Times later notes in its editorial, the Justice Department ruledin 2002, after surveying the relevant Supreme Court and appellate precedents,that “state and local police had ‘inherent authority’ to make immigrationarrests.” The paper does not like that conclusion, but it has not been revokedas official legal advice. If states have inherent authority to make immigrationarrests, they can certainly do so under a state law that merely tracks thefederal law requiring that immigrants carry documentation.

The Times tipsits hand at the end of the editorial. It calls for the Obama administration toend a program that trains local law enforcement officials in relevant aspectsof immigration law and that deputizes them to act as full-fledged immigrationagents. The so-called 287(g) program acts as a “force multiplier,” as the Timespoints out, adding local resources to immigration law enforcement—just asArizona’s SB 1070 does. At heart, this force-multiplier effect is what thehysteria over Arizona’s law is all about: SB 1070 ups the chances that anillegal alien will actually be detected and—horror of horrors—deported. Theillegal-alien lobby, of which the New York Times is a charter member,does not believe that U.S. immigration laws should be enforced. Usuallyunwilling for political reasons to say so explicitly, the lobby comes up withsmoke screens—such as the Times’s demagogic charges about SB 1070 as anact of “racial separation”—to divert attention from the underlying issue.Playing the race card is the tactic of those unwilling to make arguments on themerits. (The Times’s other contribution today to the prevailing de factoamnesty for illegal aliens was to fail to disclose, in an article about a brutal 2007 schoolyard executionin Newark, that the suspected leader was an illegal alien and member of the predominantly illegal-alien gang MaraSalvatrucha.)

The Arizona law isnot about race; it’s not an attack on Latinos or legal immigrants. It’s aboutone thing and one thing only: making immigration enforcement a reality. It istime for a national debate: Do we or don’t we want to enforce the country’simmigration laws? If the answer is yes, the Arizona law is a necessary andlawful tool for doing so. If the answer is no, we should end the charade ofinadequate, half-hearted enforcement, enact an amnesty now, and remove futurepenalties for immigration violations.
