Leading Senate Democrats Push Expansion of Backdoor Amnesty Program

Longtime amnesty advocates Senate Majority Whip, Dick Durbin (D-IL), and Senate Immigration Subcommittee Chair, Charles Schumer (D-NY), hosted a private meeting last week with U.S. Immigration and Customs Enforcement (ICE) Director John Morton to discuss expanding the Administration’s backdoor amnesty program aimed at administratively closing removal cases of illegal aliens. (CQ Today, Jan. 24, 2012; see also Morton Memos) The meeting took place in Sen. Durbin’s DC office, where Sens. Durbin and Schumer reportedly urged Morton to quickly implement the amnesty initiative nationwide and fix any problems encountered during the program’s pilot phase. (Id.)

In addition to calling for the program’s nationwide expansion, the Senators argued the Administration is not going far enough in executing its backdoor amnesty initiative. At the meeting, Sen. Schumer presented Director Morton with a letter requesting that the Administration grant deferred action and work authorization to illegal aliens whose cases are closed. . “The inability to work and support oneself and one’s family would make a favorable exercise of discretion a potentially hollow victory to the vast majority of those who may otherwise benefit from this discretionary exercise of law enforcement priorities,” wrote Schumer. (Read the letter here) Sen. Durbin echoed Sen. Schumer’s sentiments in a statement following the meeting: “I commend the Department of Homeland Security for the steps it is taking to implement it, but more needs to be done and it needs to be done quickly.” (CQ Today, Jan. 24, 2012)

Deferred action status is what DHS grants when it decides, by its own discretion, not to remove an illegal alien. Those who receive deferred action usually also receive work authorization. There is no statutory basis for deferred action status, as it is merely referred to in the federal regulations (See, e.g. USCIS Ombudsman memo, Apr. 6, 2007 (citing 8 C.F.R. 274a.12(c)(14)). Even more troubling, deferred action is not subject to judicial review. (Reno v. American-Arab Anti-Discrimination Comm., 525 U.S. 471, 484, 492 (1999)) (See FAIR Legislative Update, Mar. 14, 2011) In 2010, the Obama Administration granted deferred action to over 12,000 illegal aliens (FAIR Legislative Update, Apr. 25, 2011)

Ranking Member of the Senate Judiciary Committee, Sen. Charles Grassley (R-IA), opposed his colleagues’ proposal to grant illegal aliens deferred action and work authorization. “That would be amnesty,” Grassley said. “The power that the president has for parole is meant to be done on an individual-by-individual basis.” (Id.)

If the Administration grants the wishes of Sens. Durbin and Schumer, it would allow tens of thousands of illegal and otherwise deportable aliens to compete with the over 13 million unemployed Americans for scarce jobs. (Bureau of Labor Statistics, Jan. 6, 2012)

City Council Passes Resolution Supporting Obama Amnesty

Looking to join the ranks of cities like Chicago, IL and San Francisco, CA, the college town of Ann Arbor, MI passed a resolution last week praising President Obama’s backdoor amnesty initiative. (AnnArbor.com, Jan. 24, 2012; see FAIR Legislative Update, Oct. 24, 2011)

Specifically, the resolution passed by the Ann Arbor City Council asserts it:

Opposes policies to detain and/or deport aliens who do not fall within the Administration’s stated priorities;
Supports President Obama’s policy of circumventing Congress to remove only “serious criminal” aliens; and
Supports amnesty for illegal aliens.

Migrant trash piles up at remote U.S.-Mexico border areas

RIO RICO, Ariz (Reuters) - Picking her way into the desert brush, Raquel Martinez gathered scores of plastic water bottles tossed in an Arizona desert valley near the Mexico border, often by migrants making a risky trek into the United States across increasingly remote terrain.

"We need more bags ... there's so much trash," said Martinez, one of scores of volunteers helping clean up the dry bed of the Santa Cruz River about 10 miles north of the Mexico border on Saturday.

Trash tossed by thousands of illegal immigrants as they chase the American Dream has been a persistent problem for years in the rugged Arizona borderlands that lie on a main migration and smuggling route from Mexico.

The problem was compounded as immigrants and drug traffickers responded to ramped up vigilance on the U.S.-Mexico border by taking increasingly remote routes, leaving more waste behind in out-of-the way and hard-to-clean areas, authorities say.

"Migants used to follow the washes or follow the roads or utility poles," said Robin Hoover, founder of the Tucson-based non-profit Humane Borders.

"Now they're having to move farther and farther from the middle of the valleys," he added. "They end making more camp sites and cutting more trails when they do that, and, unfortunately ... leave more trash."

Those making the punishing march carry food, water and often a change of clothes on the trek through remote desert areas that can take several days.

Most is tossed before they pile into vehicles at pickup sites like the one getting attention on the outskirts of Rio Rico, from where they head on to the U.S. interior.

"One of the problems that we are facing is that these sites are becoming more and more remote as law enforcement steps up its efforts," Henry Darwin, director of the Arizona Department of Environmental Quality, said of the flourishing borderland garbage dumps.

"There's probably sites out there that we haven't encountered yet or don't know about because there's a lot of people out in those areas," added Darwin, who gave testimony on the issue to state lawmakers earlier this month.
BACKPACKS AND WATER BOTTLES
There are no numbers to show exactly how many would-be migrants or smugglers take the illegal and surreptitious trek across the border into Arizona from Mexico each year.

But in an indication of the scale of the migration, federal border police made nearly 130,000 arrests last year in Arizona, where hundreds of Border Patrol agents, miles of fencing and several unmanned surveillance drones have been added in recent years to tighten security along the porous border.

With limited funding for clean up, Arizona environmental authorities draw on volunteers to help in drives like the one near Rio Rico, where an estimated 140 volunteers including residents, community and youth groups took part on Saturday.
Clean up efforts since 2008 by the department of environmental quality have included pulling 42 tons of trash from 160 acres of Cocopah tribal lands in far western Arizona, and clean ups at least seven sites on ranches and public land in areas south of Tucson.
Signs of illegal immigrants and even drug traffickers making the circuitous foot journey abound in the mesquite-studded riverbed near Rio Rico, a vigorous day's walk north of the border.
"I've found about a trillion water bottles," said David Burkett, a lawyer from Scottsdale, who worked up a sweat as he filled his fourth 50-pound trash bag. Nearby are tossed backpacks, food containers, a blanket and a pair of shoes.
He points out that alongside the apparent migrant trash is a large amount of other waste including a couch, kitchen countertops and yard debris, likely tossed by residents and contractors. Still, it is a shock to those living locally.
"We don't realize how bad it is until we come down and see it," said Candy Lamar, a volunteer who lives in sprawling, low density Rio Rico, as she works to pick up trash.
HAZARDOUS CLEANUP
The area getting attention on Saturday lies a few miles from a remote spot where the bodies of three suspected drug traffickers were found shot to death "execution style" last November.
The area is not far from another out-of-the-way spot where Border Patrol agent Brian Terry was shot dead by suspected border bandits in December 2010. Volunteers working on Saturday were aware of the potential hazards.
As she stuffed a blue garbage sack with trash, retiree Sharon Christensen eyed discarded burlap sacking, blankets and cord -- the remains of a makeshift backpack of the type often used by drug traffickers walking marijuana loads up from Mexico.
"It would make me hesitant to come out here on my own, knowing that this kind of activity is going on ... It is a concern, and we need to be mindful," said Christensen, a retiree and hiking enthusiast.
Clean-up organizers liaise with Border Patrol and local police on security, in addition to warning volunteers of potential danger from snakes, scorpions or even bees that can swarm in discarded vehicle tires, and of potential hazards including medical waste and human excrement.
Equipped with gloves, volunteers such as Burkett, the Scottsdale lawyer, were glad to take part on Saturday.

"As an avid outdoors person in Arizona, I spend a lot of time using the desert," he said. "It's important to me personally to take the time to give back."

“Todaythere are approximately 11 million illegal aliens in the United States, makingillegal immigration one of the most serious issues facing our nation,” saidHostettler. “In May, the Senate passed legislation that would provide amnestyfor most of the illegal aliens currently in the U.S., in a way that is eerilysimilar to the amnesty Congress granted in 1986.

“Atthis hearing we have the opportunity to examine how the U.S. dealt with illegalimmigration 20 years ago, why that approach did not work, and the direction weshould take in light of our past failure. In 1986, there were approximately3-million illegal aliens in the U.S. Congress responded by passing theImmigration Reform and Control Act, or IRCA. There are several key features toIRCA. First, it provided amnesty to 2.7-million illegal aliens in severaldifferent categories.

“Alienswho had been illegally present since 1982 were granted a general amnesty, whileagricultural workers who arrived more recently were granted amnesty under theSpecial Agricultural Worker Program. The amnesty was accompanied by a plandesigned to stop employment of illegal aliens in the U.S. IRCA created anemployer sanctions scheme for employers who knowingly hired illegal aliens, andrequired employers to check the identity and work eligibility documents of allemployees, to ensure lawful immigration status.

“Atthe time, policy makers truly believed that it would be a one-time amnesty, andthe problem of illegal immigration would be solved. Congress rejectedrecommendations made by the Select Commission on Immigration and Refugee Policyin 1981, which stated, in part:

The Commission believes thata legalization program is a necessary part of enforcement, but it does notbelieve that the U.S. should begin the process of legalization until newenforcement measures have been instituted to make it clear that the U.S. isdetermined to curtail new flows of undocumented illegal aliens. Without moreeffective enforcement than the U.S. has had in the past, legalization couldserve as a stimulus to further illegal entry. The Select Commission is opposedto any program that could precipitate such movement.

“Then-SenatorAlan Simpson (R-WY), co-author of IRCA, affirmed his commitment to amnesty inexchange by stating, “I firmly believe that a one-time only legalizationprogram is not only good public policy, it is good sense, and it is fully inthe best interests of this country.” Time showed us that IRCA has utterly andcompletely failed, mainly due to the fact that Congress did not heed thewarning of the Select Commission regarding the need for real enforcement priorto any discussion of such legislation.

“Illegalimmigration has not been controlled, but has increased significantly in thepast two decades. Employer sanctions have been enforced in a farcical manner.Furthermore, the I-9 [Employment Eligibility Verification Form] system hasproved to be a failure, because an illegal alien can cheaply and easily obtaincounterfeit documents to show his or her employer. Employers, in a Catch 22situation, cannot require additional proof that the documents presented arelegitimate for fear of running afoul of discrimination laws.

“InMay [2006], the Senate passed the Reid-Kennedy Amnesty, which is remarkablysimilar to the 1986 amnesty. The Reid-Kennedy bill also provides severalcategories of amnesty, including a general amnesty for anyone who can show thathe has been in the country for more than five years, and including anagriculture amnesty. Again, proponents of the current proposals believe thatthis amnesty will solve the problem once and for all. But Congress and theadministration have no credibility with the American people.

“Whyshould Americans have any reason to believe that the supposed enhancedenforcement provisions in Reid-Kennedy will be effectively enforced by theadministration any more than successive administrations have enforced IRCA? Theadministration will probably implement amnesty for millions of illegal aliensquite quickly. Enforcement will likely lag behind, if it occurs at all.

“Wewill find ourselves in exactly the same place we found ourselves 20 years ago.Amnesty sends out the message that the U.S. is not serious about enforcing ourlaws. It is an affront to the millions of immigrants...who wait their turn anduse the legal immigration system. When the U.S. grants amnesty and forgives lawbreaking, it encourages more illegal immigration in the future. The grant ofamnesty in 1986 did nothing to resolve the illegal immigration problem; it madethe problem worse, as increased numbers of illegal aliens pour across theborder waiting for their turn.

“Withan amnesty, a new wave of illegal aliens will come to wait for theirs. Ibelieve that Benjamin Franklin once said that “The definition of insanity isdoing the same thing over and over again, expecting different results.” Wecannot expect to solve the problem of illegal aliens by encouraging lawbreaking through amnesty. It didn’t work in 1986, and it will certainly notwork in 2006.”

Itwon’t work in 2012. Our U.S Congress continues to dither while millions floodinto our country. We face ominous consequences as to numbers, languages,cultures and poverty. It is not possible to continue on our current immigrationpath.

Welfare and food stamp benefits soar $3 million higher than Septemberpayout. Moments later, former Colorado Governor Richard D. Lamm stood up and gave astunning speech on how to destroy America. "Here is how they do it," Lamm said: "First, to destroy America,turn America into a bilingual or multi-lingual and bicultural country."History shows that no nation can survive the tension, conflict, and antagonismof two or more competing languages and cultures. It is a blessing for anindividual to be bilingual; however, it is a curse for a society to bebilingual. The historical scholar, Seymour Lipset, put it this way: "Thehistories of bilingual and bi-cultural societies that do not assimilate arehistories of turmoil, tension, and tragedy." Canada, Belgium, Malaysia,and Lebanon all face crises of national existence in which minorities press forautonomy, if not independence. Pakistan and Cyprus have divided. Nigeriasuppressed an ethnic rebellion. France faces difficulties with Basques,Bretons, and Corsicans."

Lamm went on: Second, to destroy America, "Invent 'multiculturalism' andencourage immigrants to maintain their culture. I would make it an article ofbelief that all cultures are equal. That there are no cultural differences. Iwould make it an article of faith that the Black and Hispanic dropout rates aredue solely to prejudice and
discrimination by the majority. Every other explanation is out of bounds.

Third, "We could make the United States an 'Hispanic Quebec' without mucheffort. The key is to celebrate diversity rather than unity. As BenjaminSchwarz said in the Atlantic Monthly recently: "The apparent success ofour own multiethnic and multicultural experiment might have been achieved notby tolerance but by hegemony. "My fifth point for destroying America would be to get big foundations andbusiness to give these efforts lots of money. Obama’s Jobs Council promotespro-corporate policies

Thereport from the President’s Council on Jobs and Competitiveness, released inmid-January, is a blueprint for the subordination of every aspect of Americansociety to a single goal, boosting corporate profits.

Obamaappointed the panel last year, under the leadership of Jeffrey Immelt, CEO ofGeneral Electric. Among the companies represented on the council are Xerox,American Express, DuPont, Southwest Airlines, Procter & Gamble, Boeing,Intel, Citigroup, Comcast and UBS.

Twounion leaders, Richard Trumka of the AFL-CIO and Joseph T. Hansen of the UnitedFood and Commercial Workers, also were appointed. So reactionary andpro-corporate was the report that the two union executives had to issue apublic dissent in an effort to cover up their collaboration. This “opposition”is of course combined with all-out support for the Obama administration, whichcommissioned the report and now will implement its recommendations.

The“Road Map to Renewal” issued by the council details specific proposals foreducation, job training, tax credits and tax cuts for specific groups ofcorporations, and deregulation of business, many of which were incorporatedinto Obama’s State of the Union Address.

The report takes as itsstarting point that the jobs and living standards of working people are to beheld hostage to private profit. It declares flatly, “government-led initiatives will notcreate the jobs we need to reduce unemployment in a sustainable way. Theprivate sector must lead.”

Thereis no examination of why private sector employment is actually lower today thanin 2001—a full decade of standstill in what is routinely referred to in thecorporate-controlled media as the “engine” of the US economy. Instead, thereport calls for more of the tax cuts and deregulation already enacted by theBush administration and then continued under the Obama administration.

Thereport points to a consensus in the US ruling elite about “finally gettingtough minded about the barriers to competitiveness posed by our regulatory andtax regimes… To start, we need to cut corporate tax rates, eliminate loopholes,broaden the base and improve the competitiveness of our tax code.”

The call to “broaden thebase” is political code for increasing taxes on working people, particularlythose whose incomes are so low that they pay no federal income tax. Variousmethods have been proposed, including a regressive “flat tax” that would be thesame for paupers and millionaires, or a national sales tax or value-added tax,which would hit working class consumers the hardest because they spend nearlyall their income on consumer goods.

Afternoting the declining education and skill level in the United States, thebyproduct of decades of budget cutting by federal, state and local governments,the report calls for measures to “fundamentally realign workforce trainingaround the skills employers actually demand…”

Goneis the principle, which once animated public education in the United States,that a well-educated citizenry was a necessity for a democratic society, aswell as an inherent good in its own right. Instead, the council demands aneducation system tailored to the requirements of US corporations.

Thereport complains of “a postsecondary system that is frequently decoupled fromemployer needs” and declares that “business has an opportunity to be anessential voice in influencing the nation’s education policy, practice andinnovation” through “partnership between businesses and educationalinstitutions.”

Thereport calls for the federal and state governments, as well as universities, todiscourage students from choosing liberal arts programs rather than technology,science and engineering.

Thegoal is not an educated population, but “to effectively align labor demand withsupply.” In other words, the council proposes an education system that producesskilled engineers and technicians in the quantity required by business, withthe rest of the population consigned to low wage service and production jobsfor which education is, to use the business terminology, not “cost-effective.”

Inone chilling passage, the report proposes, “longer work-based training and conditionalemployment to displaced workers,” suggesting such programs “yield betteroutcomes, especially for low-income adults.” To put it bluntly, this is a planfor state-supported indentured servitude for laid-off and low-paid workers, whowill work as cheap labor for the corporations (“work-based training”), to behired and fired at will (“conditional employment”).

ForK-12 education, the report calls for stepped-up use of “performance metrics”and “teacher accountability,” buzzwords for accelerating the testing maniapromoted under the Bush administration’s No Child Left Behind program andcontinued under Obama’s Race to the Top initiative.

Whilepublic education will be straitjacketed to the requirements of business,corporate America would be showered with credits and tax cuts to subsidize UScompanies against their foreign rivals. The report complains of higher levelsof state funding for corporate research and development in Japan, China andSouth Korea. It demands “a competitive tax policy that incentivizes innovativecompanies to locate their R&D, production and employment in the UnitedStates…”

Thereport details a variety of changes in the tax code to benefit hedge funds andprivate equity firms, endorsing the bipartisan Senate bill proposed by DemocratMark Warner and Republican Jerry Moran to provide 100 percent corporate incometax exemption and 100 percent exclusion from capital gains taxes for variousforms of start-up companies funded by venture capital.

Itcalls for similar “performance-based tax policies” to promote energy efficiencyand development of so-called green energy companies. Among the proposals aremaking the research and development tax credit permanent and extendingproduction tax credits for new energy technologies.

Themanufacturing section of the report calls for an offensive on the world marketagainst the major rivals of American capitalism, particularly Germany andChina, a goal embraced enthusiastically in Obama’s State of the Union speech.Proposals include the inevitable tax credits and subsidies for exporters.

The report tacitly applaudsthe Obama administration’s bailout of the auto industry, which was accomplishedthrough cutting wages for newly hired workers by 50 percent, as well as cuttingpensions and medical benefits for workers and retirees. This is supplemented byanother section on how “controlling health-care costs can boost manufacturingcompetitiveness.”

Thereport also notes the significance of manufacturing for military purposes,calling for “retaining and bolstering a robust advanced manufacturingcapability in such key industries as airplanes, automobiles and biologics.”

Thatlast term is both ominous and revealing, since it suggests a commitment by theObama administration to developing biological warfare capabilities despite UStreaty obligations not to do so, and such debacles as the 2001 anthrax attackson US targets, allegedly carried out by a scientist at a US Army laboratory.

Anothersection of the report calls for sweeping regulatory “reform,” by which thecorporate CEOs mean eliminating many regulations and gutting the enforcement ofmost. It hails the effort already undertaken by the Obama administrationthrough Executive Order 13563, which Obama issued one year ago, directing everyagency of the executive branch to review regulations on business and scrap asmany as possible.

Thecouncil called for a particular focus on limiting “economically significantrules,” including retrospective review of past regulations on the “cost-benefitanalysis,” which presumes to weigh the cost in lives from anti-pollution andworkplace safety rules against the cost in dollars to corporate America.

Thereport concludes with a call for sweeping “tax reform,” claiming that theUnited States will soon “have the highest statutory corporate tax rate(including federal and state taxes) among the 34 OECD countries.” Here thecritical word is “statutory.” US corporations pay only a small fraction of theprescribed tax rate, because of the myriad loopholes and tax avoidance strategiesavailable to billion-dollar companies, but not to small businesses orworking-class taxpayers.

It was officially called the State of the Union Address, butwhat President Obama actually delivered on Tuesday night was a campaign speechtargeted directly at his base. The message went something like this: “Unions,environmentalists, teachers, Hispanicimmigrants, women, I’m your president…I’m your candidate.”

Consider the code words and messages sprinkled throughoutthe speech.

The president began with a shameless signal to the Code Pinkcrowd and anti-war left—the folks who fueled his rise and run for the WhiteHouse. “For the first time in nine years, there are no Americans fighting inIraq,” he declared, sidestepping the unraveling situation that has emerged as aresult. And he went on: “We’ve begun to wind down the war in Afghanistan. Tenthousand of our troops have come home. Twenty-three thousand more will leave bythe end of this summer.” Again, never mind what is left behind.

For Big Labor, he boasted about his efforts to get “workersand automakers to settle their differences” and get a government-owned,union-run General Motors “back on top as the world’s number one automaker.”

He gratuitously mentioned a “unionized plant in Milwaukee”and cited key union cities in key states for good measure: “Detroit and Toledoand Chicago…Cleveland and Pittsburgh.”

For the teachers’ unions, he lamented how “tight budgetshave forced states to lay off thousands of teachers” and called on Congress togive states “the resources to keep good teachers on the job.” Drifting intomeaningless platitudes, he promised that in exchange he would support programsto “replace teachers who just aren’t helping kids learn.”

While on the subject of meaningless platitudes, thepresident boasted that “there are fewer illegal crossings than when I tookoffice.” The reason for that, of course, is that he’s presiding over the worsteconomy in four decades. In other words,there are no jobs to entice immigrants to cross America’s southernborder—legally or illegally. (See Mitch Daniels’ sparkling rebuttal formore on why.)

But the president’smain message on immigration was for the amnesty lobby: “Hundreds of thousandsof talented, hardworking students in this country face another challenge: Thefact that they aren’t yet American citizens. Many were brought here as smallchildren, are American through and through, yet they live every day with thethreat of deportation,” he chided. “Let’s at least agree to stop expellingresponsible young people,” who, it pays to recall, are not responsible enoughto legalize their status. The president’s environmental bloc had to wadethrough some throw-away lines. For example, his boast that the country relies“less on foreign oil than in any of the past sixteen years” has a lot to dowith low demand caused by a beleaguered economy. And when he noted that “We don’thave to choose between our environment and our economy,” he failed to mentionthat when given the opportunity—in the form of the Keystone XL pipeline—hechose the environmental lobby rather than economic recovery.

When he finally got on message, he got on a roll. “Renewableenergy use has nearly doubled,” he declared. “I will not walk away from thepromise of clean energy,” he gushed. And putting our money where his mouth is,he unveiled plans to “allow the development of clean energy on enough public landto power three million homes.” He then announced his decision to dragoon theDepartment of Defense into the quixotic effort by directing it to “make one ofthe largest commitments to clean energy in history,” thus turning America’sshrinking Armed Forces into the R&D arm of his green agenda.

With lines that sounded strangely anachronistic, he ralliedanother important bloc of his coalition, declaring that “Women should earnequal pay for equal work.” He then vowed that he would not allow America to “goback to the days when health insurance companies had unchecked power to…chargewomen differently from men.”

That brings us to the crescendo of his State of the CampaignAddress: the obligatory class-warfare rhetoric.

In the span of about 40 minutes, the president took creditfor the automaker bailout that saved “a million jobs”—but happened to belaunched in the waning hours of the Bush presidency—and then lambasted the bankbailouts.

“No bailouts, no handouts and no copouts,” he said inripping into banks, Wall Street and a financial system that “was allowed toplay by its own set of rules.”

He spoke of giving banks “a chance to repay a deficit oftrust,” tried to shame Congress into ending the “tax break for the wealthiest 2percent of Americans” and decried “the corrosive influence of money inpolitics.”

In a speech full of eye-rollers, that last one may take theprize. After all, it was the Obama campaign that raised millions fromundisclosed donors in 2008. As Newsweek reported at the time, tens of thousandsof dollars poured into the Obama campaign from “individuals” with names like“Doodad Pro” of Nunda, New York, and “Good Will” of Austin, Texas. “Good Will,”Newsweek observed, “listed his employer as ‘Loving’ and his occupation as‘You,’ while supplying as his address 1015 Norwood Park Boulevard, which isshared by the Austin nonprofit Goodwill Industries.” Moreover, it is the Obamacampaign that’s now boasting about raising $1 billion dollars for 2012.

By this time next year, we’ll know if the president’spromises have held his coalition together.

In the discussion about the new law passed in Arizona directed at addressingthat state's problems associated with illegal immigrants from Mexico, theprotests concerning the legislation are directed at the wrong parties, in thewrong direction. The pro-immigration community, some church groups and manyCivil Rights leaders are all calling for a boycott of the State of Arizonabased on their belief that the new Arizona law is focused on "racialprofiling" as the method for identifying possible illegal Mexicanimmigrants.

We have the most sophisticatedsurveillance and monitoring technology in history, the most formidable militaryin the world, yet we are unable to stop the daily intrusion of illegalimmigrants from Mexico into the United States?

As an African-American who lived through and before the Civil RightsMovement, I'm no fan of assessing people based on their skin color. But holdinga struggling State's feet to the fire on tactics is missing the point . Why areprotests not being directed to our national government and the government ofMexico? Why aren't these groups demanding that our porous border with Mexico beclosed, once and for all? It's not impossible. We have the most sophisticated surveillance and monitoring technologyin history, the most formidable military in the world, yet we are unable tostop the daily intrusion of illegal immigrants from Mexico into the UnitedStates? This is a failure of policy, not one of capability.

Congress has been unwilling to pass an immigration bill, the first priorityof which is closing the border. Why does"immigration reform" now demand a higher national priority than thecrippling unemployment that is devastating the economic base and precipitatingwide spread home foreclosures in our communities? President Obama said thehealth reform was the first priority of his first term. Now, he is turning hisattention to financial reform of the banking system. Meanwhile, cities likePhoenix and many cities in the State of California and elsewhere are drowningin red ink with an ever-growing population demanding ever-more city services.

Arizona is now being depicted as the official state of "racialprofiling," with anti-Hispanic and anti-immigration swirling around itlike scarlet letters. But the passage of its bill to prevent the continuedinflux and presence of illegal immigrants in the State appears more like an actof desperation than racially motivated legislation.

WE ARE MEXICO’S WELFARE AND PRISON SYSTEM. THIS ENABLED THE RULINGBILLIONAIRE OLIGARCHY TO MAINTAIN THE ECONOMY IN THEIR GREEDY GRASPS. THINGSDON’T MUCH CHANGE IN SHAMELESS MEXICO; ANY MORE THAN SHAMELESS WALL ST. MOST OFTHE FORTUNE 500 ARE GENEROUS DONORS OF LA RAZA!

As such, it relieves the governmentof Mexico from any financial responsibility for the economic consequencesassociated with the cost of medical care, public education, public housing,welfare, police, and social services provided by the cities, counties andstates in which such initially illegal immigrants choose to reside.

The pro-illegal immigration amnesty movement shuns the classification"illegal" immigrant; preferring instead the term "undocumentedimmigrant." This is, of course, framing the debate. The"undocumented" immigrants entered into the United States illegally.When apprehended, deportation back to their country of origin is the customarylegal procedure. Now, however, an intermediary process is advocated in lieu ofdeportation: an undocumented immigrant who, after following certain prescribedprocedures, including the payment of taxes, will be permitted to remain in theUnited States. This constitutes de facto amnesty for the "undocumentedimmigrant." As such, it relieves thegovernment of Mexico from any financial responsibility for the economicconsequences associated with the cost of medical care, public education, publichousing, welfare, police, and social services provided by the cities, countiesand states in which such initially illegal immigrants choose to reside.

Well-intentioned people are quick to denounce Arizona and call for a boycottof business transactions or travel involving the state. Why are they not calling for a boycott of Mexico? The truth is thatMexico is exporting, or at the very least facilitating the export, of itspoverty in the form of illegal immigrants to the United States.

WHEN YOU HEAR OBAMA TALK ABOUT JOBS,WHICH IS SELDOM, YOU CAN BET THE RANCHERO HE MEANS JOBS FOR ILLEGALS!

Any version of amnesty for illegal immigrants and efforts to organize aboycott of Arizona will detract from the number one priority affectingsubstantial segment of the American people: unemployment. Moreover, it willblow a hole in the projected operating costs and budget deficit projections inthe new health care bill.

SHOULD MEXICO START PAYING FOR THEIR OWN WELFARE? HOW ABOUT THE AMERICANPEOPLE FINE ANY ILLEGAL THAT WAVES A MEX FLAG IN OUR FACES AND REFUSED TO SPEAKTHE GRINGO’S LANGUAGE? THAT ALONE WOULD BRING IN BILLIONS!

The annual cost of maintaining andproviding services to illegal or "undocumented" citizens should betabulated, assumed and paid by the Government of Mexico or credited against theannual cost of oil we import from them until such time as immigrants from theircountry become U.S. citizens.

Why don't the pro-amnesty undocumented immigrant leaders join forces withthe "anti-illegal immigration" leaders and bring the Government ofMexico to the table? The annual cost ofmaintaining and providing services to illegal or "undocumented"citizens should be tabulated, assumed and paid by the Government of Mexico orcredited against the annual cost of oil we import from them until such time asimmigrants from their country become U.S. citizens.

Let's face it: right or wrong, the Arizona legislation is treating thesymptoms of an international disease that needs much stronger medicine.

At the parleys this week with hisUS and Canadian counterparts in Cancún, Mexican President Vicente Fox willpress for more opportunities for his countrymen north of the Rio Grande.Specifically, he will argue for additional visas for Mexicans to enter theUnited States and Canada, the expansion of guest-worker schemes, and the"regularization" of illegal immigrants who reside throughout thecontinent. In a recent interview with CNN, the Mexican chief executiveexcoriated as "undemocratic" the extension of a wall on the US-Mexicoborder and called for the "orderly, safe, and legal" northbound flowof Mexicans, many of whom come from his home state of Guanajuato. Mexicanlegislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of theSenate Committee on Foreign Relations for North America, recently emphasizedthat the solution to the "structural phenomenon" of unlawfulmigration lies not with "walls or militarization" but with"understanding, cooperation, and joint responsibility." Such rhetoricwould be more convincing if Mexican officials were making a good faith effortto uplift the 50 percent of their 106 million people who live in poverty. Tohis credit, Fox's "Opportunities" initiative has improved slightlythe plight of the poorest of the poor. Still, neither he nor Mexico's lawmakershave advanced measures that would spur sustained growth, improve the quality ofthe workforce, curb unemployment, and obviate the flight of Mexicans abroad.Indeed, Mexico's leaders have turned hypocrisy from an art form into an exactscience as they shirk their obligations to fellow citizens, while decryingefforts by the US senators and representatives to crack down on illegalimmigration at the border and the workplace. What are some examples of thisfailure of responsibility? · When oil revenues are excluded, Mexico raises theequivalent of only 9 percent of its gross domestic product in taxes - a figureroughly equivalent to that of Haiti and far below the level of major LatinAmerican nations. Not only is Mexico's collection rate ridiculously low, itsfiscal regime is riddled with loopholes and exemptions, giving rise towidespread evasion. Congress has rebuffed efforts to reform the system.Insufficient revenues mean that Mexico spends relatively little on two keyelements of social mobility: Education commands just 5.3 percent of its GDP andhealthcare only 6.10 percent, according to the World Bank's last comparativestudy. · A venal, "come-back-tomorrow" bureaucracy explains the 58days it takes to open a business in Mexico compared with three days in Canada,five days in the US, nine days in Jamaica, and 27 days in Chile. Mexico'sprivate sector estimates that 34 percent of the firms in the country made"extra official" payments to functionaries and legislators in 2004.These bribes totaled $11.2 billion and equaled 12 percent of GDP. ·Transparency International, a nongovernmental organization, placed Mexico in atie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyedfor corruption. · Economic competition is constrained by the presence ofinefficient, overstaffed state oil and electricity monopolies, as well as asmall number of private corporations - closely linked to government big shots -that control telecommunications, television, food processing, transportation,construction, and cement. Politicians who talk about, much less propose,trust-busting measures are as rare as a snowfall in the Sonoran Desert.Geography, self-interests, and humanitarian concerns require North America'sneighbors to cooperate on myriad issues, not the least of which is immigration.However, Mexico's power brokers have failed to make the difficult decisionsnecessary to use their nation's bountiful wealth to benefit the masses.Washington and Ottawa have every right to insist that Mexico's pampered eliteact responsibly, rather than expecting US and Canadian taxpayers to shoulderburdens Mexico should assume.

Obama Administration ChallengesArizona E-Verify Law

TheObama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers whohire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's AmicusCuriae Brief). Called the “Legal Arizona Workers Act,” the law requires all employers inArizona to use E-Verify and provides that the business licenses of those whohire illegal workers shall be repealed. From the date of enactment, theChamber of Commerce and other special interest groups have been trying to undoit, attacking it through a failed ballot initiative and also through a lawsuit.Now the Chamber is asking the United States Supreme Court to hear the case (Chamberof Commerce v. Candelaria), and the Obama Administration is weighing inagainst the law.

Todate, Arizona’s E-Verify law has been upheld by all lower courts, including theNinth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it asan exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice Department, however, disagrees. Acting Solicitor General NealKatyal said in his filing with the Supreme Court that the lower courts werewrong to uphold the statute because federal immigration law expressly preemptsany state law imposing sanctions on employers hiring illegal immigrants. Mr. Katyal argues that this is not a licensing law, but “a statute thatprohibits the hiring of unauthorized aliens and uses suspension and revocationof all state-issued licenses as its ultimate sanction.” (Solicitor General's AmicusCuriae Brief,p. 10). This is the administration’s first court challenge to a state’sauthority to act against illegal immigration, and could be a preview of thebattle brewing over Arizona’s recent illegal immigration crackdown through SB1070.

Napolitanohas made no comment on the Department of Justice’s decision to challenge the2007 law, but federal officials said that she has taken an active part in thedebate over whether to do so. (Politico, May 28, 2010). As Governor of Arizona, Napolitano said she believed the state law was validand became a defendant in the many lawsuits against it. (Id.).

ObamaAdministration Challenges Arizona E-Verify Law

The Obamaadministration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hireillegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus Curiae Brief). Called the “Legal ArizonaWorkers Act,” the law requires all employers in Arizona to use E-Verify andprovides that the business licenses of those who hire illegal workers shall berepealed. From the date of enactment, the Chamber of Commerce and otherspecial interest groups have been trying to undo it, attacking it through afailed ballot initiative and also through a lawsuit. Now the Chamber is askingthe United States Supreme Court to hear the case (Chamber of Commerce v.Candelaria), and the Obama Administration is weighing in against the law.

To date, Arizona’sE-Verify law has been upheld by all lower courts, including the Ninth CircuitCourt of Appeals. The Ninth Circuit, in particular, viewed it as an exercise ofa state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s JusticeDepartment, however, disagrees. Acting Solicitor General Neal Katyal said inhis filing with the Supreme Court that the lower courts were wrong to upholdthe statute because federal immigration law expressly preempts any state lawimposing sanctions on employers hiring illegal immigrants. Mr. Katyalargues that this is not a licensing law, but “a statute that prohibits thehiring of unauthorized aliens and uses suspension and revocation of allstate-issued licenses as its ultimate sanction.” (Solicitor General's Amicus Curiae Brief, p. 10). This is theadministration’s first court challenge to a state’s authority to act againstillegal immigration, and could be a preview of the battle brewing overArizona’s recent illegal immigration crackdown through SB 1070.

Napolitano has madeno comment on the Department of Justice’s decision to challenge the 2007 law,but federal officials said that she has taken an active part in the debate overwhether to do so. Political correctness runs amuck again. It seems there is a new story involvingmisguided school officials every week.

This time, eighth grader Cody Alicea is learning a lesson that no parentexpects to be taught in an American school.

The latest story comes via KSBW from the Stanislaus School District in Denair,CA where a middle school student is not allowed to fly the American flag fromhis bicycle because other students have complained.

A Stanislaus County school is forcing a student to take an American flag off ofhis bike. Thirteen-year-old Cody Alicea put the flag there as a show of supportfor the veterans in his family. But officials at Denair Middle School told himhe couldn't fly it. He said he was told some students had complained.

Obviously, the appropriate response to this would have been for schoolofficials to tell the complainers that this is America, Old Glory is theAmerican flag and it will fly on American soil or even American bikes. Anyattempt to prevent it from flying should result in immediate discipline for thestudent who creates a disturbance or takes an action to interfere with privateproperty.

Thatdoes not happen because school officials are terrified of ACLU lawsuitswhich immediately follow any attempt to defend American traditions.

Who are the complainers who so dislike our flag? Let's see how SuperintendentEdward Parraz described them.

"Our Hispanic, you know, kids will, you know, bring their Mexican flagsand they'll display it, and then of course the kids would do the American flagsituation, and it does cause kind of a racial tension which we don't reallywant," Parraz said. "We want them to appreciate the cultures."

A California school has done a U-turn after it forced a student to remove anAmerican flag attached to his bike, saying the Stars and Stripes could spurracial tensions on campus.

TheDepartment of Labor has launched a special program to assist and protectillegal immigrant workers in the U.S., referred to as “vulnerable” and“underpaid” by the presidential cabinet member who heads the agency.

Hundredsof new field investigators have been deployed to reach out to Latino laborersin areas with large numbers of illegal alien employees. Their message, inSpanish, is “we can help” bring workplace protections to the nation’s mostvulnerable and underpaid workers, including those who have no legal right tolive in the Untied States.

A total of 1,000 investigators from her agency will focuson enforcing labor and wage laws in industries that typically hire lots ofillegal aliens without reporting anyone to federal immigration authorities.

Theagency has also launched a Spanish television advertising campaign to spreadthe word and created a web site. Workers in industries from construction tofood service are urged to contact the Labor Department of wage and hourviolations. An investigator may be deployed to the work site or the employermay be taken to court.

Labor Secretary Hilda Solis is defending President Barack Obama'sefforts to combat the recession and unemployment, saying his focus has been on helpingthe jobless and underemployed.

In a Labor Day appearance on ABC News'"Good MorningAmerica," Solis said Obama is doing a good job.

Solis says the Obama administration knows people are hurting fromthe weak economy. She pointed to last year's $814 billion economic recovery actand administration proposals for job training and hiring incentives forbusinesses.

On CBS'"Early Show," she said that over the last eightmonths, the U.S. economy has added some 90,000 private sector jobs each month.

Critics have cited persistent unemployment rates of nearly 10percent and only faint signs that businesses are rehiring workers.

PresidentObama's Labor Secretary Hilda Solis is supposed to represent American workers.What you need to know is that this longtime open-borders sympathizer has alwayshad a rather radical definition of "American." At a Latino voterregistration project conference in Los Angeles many years ago, Solis assertedto thunderous applause, "We are all Americans, whether you are legalizedor not."

That'sright. The woman in charge of enforcing our employment laws doesn't give a hootabout our immigration laws -- or about the fundamental distinction betweenthose who followed the rules in pursuit of the American dream and those whodidn't.

"I'mhere to tell you that your president, your secretary of labor and thisdepartment will not allow anyone to be denied his or her rightful pay --especially when so many in our nation are working long, hard and oftendangerous hours," Solis says in the video pitch. "We can help, and wewill help. If you work in this country, you are protected by our laws. And you cancount on the U.S. Department of Labor to see to it that those protections workfor you."

To besure, no one should be scammed out of "fair wages." Employers thathire and exploit illegal immigrant workers deserve full sanctions andpunishment. But it's the timing, tone-deafness and underlying blanket amnestyagenda of Solis' illegal alien outreach that has so many American workers andtheir representatives on Capitol Hill rightly upset.

Withdouble-digit unemployment and a growing nationwide revolt over Washington'sborder security failures, why has Solis chosen now to hire 250 new governmentfield investigators to bolster her illegal alien workers' rights campaign?(Hint: Leftists unhappy with Obama's lack of progress on "comprehensiveimmigration reform" need appeasing. This is a quick bone to distractthem.)

Unfortunately,the federal government is not alone in lavishing attention and resources onworkers who shouldn't be here in the first place. As of 2008, California,Florida, Nevada, New York, Texas and Utah all expressly included illegal aliensin their state workers' compensation plans -- and more than a dozen otherstates implicitly cover them.

Solis'public service announcement comes on the heels of little-noticed but far moretroubling comments encouraging illegal alien workers in the Gulf Coast. Earlierthis month, in the aftermath of the BP oil spill, according to Spanish languagepublication El Diario La Prensa, Solis signaled that her department was goingout of its way to shield illegal immigrant laborers involved in cleanupefforts. "My purpose is to assist the workers with respect to safety andprotection," she said. "We're protecting all workers regardless ofmigration status because that's the federal law." She told reporters thather department was in talks with local Immigration and Customs Enforcement(ICE) officials who had visited coastal worksites to try to verify that workerswere legal.

No wordyet on whether she gave ICE her "we are all Americans, whether you arelegalized or not" lecture. But it's a safe bet.

At the parleys this week with hisUS and Canadian counterparts in Cancún, Mexican President Vicente Fox willpress for more opportunities for his countrymen north of the Rio Grande.Specifically, he will argue for additional visas for Mexicans to enter theUnited States and Canada, the expansion of guest-worker schemes, and the"regularization" of illegal immigrants who reside throughout thecontinent. In a recent interview with CNN, the Mexican chief executiveexcoriated as "undemocratic" the extension of a wall on the US-Mexicoborder and called for the "orderly, safe, and legal" northbound flowof Mexicans, many of whom come from his home state of Guanajuato. Mexicanlegislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of the SenateCommittee on Foreign Relations for North America, recently emphasized that thesolution to the "structural phenomenon" of unlawful migration liesnot with "walls or militarization" but with "understanding,cooperation, and joint responsibility." Such rhetoric would be moreconvincing if Mexican officials were making a good faith effort to uplift the50 percent of their 106 million people who live in poverty. To his credit,Fox's "Opportunities" initiative has improved slightly the plight ofthe poorest of the poor. Still, neither he nor Mexico's lawmakers have advancedmeasures that would spur sustained growth, improve the quality of theworkforce, curb unemployment, and obviate the flight of Mexicans abroad.Indeed, Mexico's leaders have turned hypocrisy from an art form into an exactscience as they shirk their obligations to fellow citizens, while decryingefforts by the US senators and representatives to crack down on illegalimmigration at the border and the workplace. What are some examples of thisfailure of responsibility? · When oil revenues are excluded, Mexico raises theequivalent of only 9 percent of its gross domestic product in taxes - a figureroughly equivalent to that of Haiti and far below the level of major LatinAmerican nations. Not only is Mexico's collection rate ridiculously low, itsfiscal regime is riddled with loopholes and exemptions, giving rise towidespread evasion. Congress has rebuffed efforts to reform the system.Insufficient revenues mean that Mexico spends relatively little on two keyelements of social mobility: Education commands just 5.3 percent of its GDP andhealthcare only 6.10 percent, according to the World Bank's last comparativestudy. · A venal, "come-back-tomorrow" bureaucracy explains the 58days it takes to open a business in Mexico compared with three days in Canada,five days in the US, nine days in Jamaica, and 27 days in Chile. Mexico'sprivate sector estimates that 34 percent of the firms in the country made"extra official" payments to functionaries and legislators in 2004.These bribes totaled $11.2 billion and equaled 12 percent of GDP. ·Transparency International, a nongovernmental organization, placed Mexico in atie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyedfor corruption. · Economic competition is constrained by the presence ofinefficient, overstaffed state oil and electricity monopolies, as well as asmall number of private corporations - closely linked to government big shots -that control telecommunications, television, food processing, transportation,construction, and cement. Onceupon a time opposition to illegal immigration was championed by a few specialinterest groups and outspoken leaders like Tom Tancredo and Sheriff Joe Arpaio.Not so anymore. Regular sheriffs like Arizona’s Paul Babeu of Pinal County andLarry Dever of Cochise County are speaking up loudly about their frustrationsdealing with it.

TheObama administration gets credit for mainstreaming the issue. Obama moved thecountry backwards on fixing the problem by suing Arizona over SB 1070 and decreasing funding for enforcement. One federal prosecutor in Texas refuses toprosecute illegal immigrants until they have been arrested seven times. He willnot prosecute them with a felony until they have been caught 14 times. Evenmore egregiously, he does not prosecute coyotes smuggling fewer than sixillegal immigrants. These policies are in place throughout Texas.

Allthe progress Arizona has made the past few years reducing illegal immigrationand associated crime due to the efforts of Sheriff Arpaio, Senator RussellPearce and former Maricopa County Attorney Andrew Thomas is now being eroded.The Border Patrol reports that 219,300 illegal immigrants were apprehendedcoming through the Tucson Sector last year. But as many as 350,000 to 400,000were not caught, with many heading north through Sheriff Babeu’s Pinal County.It is a bad time to be decreasing enforcement efforts. According to SheriffDever, illegal immigration is getting worse. "The bottom line is the peoplewe’re battling are much more sinister and much more aggressive, much moredetermined than they have ever been,” Dever said on NPR. “When they used to run away, now they want tofight." The Yuma Sector is the only sector along the border that has“operational control” over its 126-mile section of the more than 3,000-mileborder with Mexico.

Morethan 50% of illegal immigrants enter the country through the Tucson sector.Arizona is hit harder by illegal immigration than any other state in the country.The Bureau of Land Management recently posted signs 70 miles north of the border in Sheriff Babeu’s PinalCounty warning citizens to stay out of certain areas due to the drug cartelsand coyotes. The violence on the border has moved north, with much of it takingplace 20-40 miles north of the border. Pinal County has become the number one pass through county in the nation for drug and humantrafficking. Sheriff Babeu says that parts of Arizona are now controlled by the drugcartels, a $40 billion dollar industry. He laments, “The criminals have takenover our country, and our government has become our enemy.”

Obama’sHomeland Security Secretary Janet Napolitano, formerly governor of Arizona,brazenly declared last year that the border “is assecure as it ever has been.” The Border Patrol is circulating a PowerPointpresentation showing that illegal immigration has decreased. But their chartcherry picks which years and figures to compare. Sheriff Dever objects to the skewed presentation, “Don’tdrink the Kool-Aid and buy into 'this border is secure' nonsense.” Dever resigned from the governmental Alliance toCombat Transnational Threats organization in February, calling it a charade.Sheriff Babeu accuses the federal government of trying tobrainwash the American people by saying the border is safe and secure, in orderto “lull us into a false sense of security.”

Outrageously,the federal government is instructing the Border Patrol to arrest fewer illegalimmigrants, as part of a “catch and release” scheme. This selective enforcementis apparently being done so the Obama administration can boast thatapprehensions of illegal immigrants have gone down while Obama has been inoffice. Sheriff Dever was so furious he testified to Congress last month about thepractice. He is concerned the Obama administration is protecting illegalimmigrants from prosecution, allowing many to get away with commit heinouscrimes.

Tofix our broken borders, Sheriff Babeu would like the 10-point border securityplan proposed by Arizona’s Senator Jon Kyl implemented. It calls for 6,000armed soldiers deployed along the border for up to two years, 3,000 of themlocated in Arizona. A double-barrier fence would be completed in key areas,along 700 miles of the 2,000-mile border. Currently, there are numerous milesalong the border where there is no fence, or it is easily passed through.Another key component of the plan would fully fund and enforce OperationStreamline in Arizona’s two Border Patrol sectors, which puts illegal bordercrossers behind bars for 60 days.

BothSheriffs Babeu and Dever have been named as defendants in the Obamaadministration’s lawsuit against Arizona over SB 1070, as well as in lawsuitsfiled by the ACLU and other radical activists. The ACLU has filed lawsuitsagainst every Sheriff and County Attorney in Arizona. The organization hasforced Babeu and Dever to form a Border Sheriffs’ legal defense fund to assist them in defending thelawsuits. Sheriff Dever calls the Ninth Circuit Court of Appeals decision inMay upholding the gutting of SB 1070 “judicially-imposed amnesty.” “We getfrustrated and disheartened when the White House, which has failed to securethe border for generations, sues us for trying to fill the legal vacuum.”

TheObama administration is using the race card to try and convince the courts tostrike down SB 1070 – even though there is language in SB 1070 specificallyprohibiting racial profiling. Sheriff Dever finds the accusations ridiculousthat law enforcement is profiling illegal immigrants based on their race. In anarticle for the New York Times entitled “Abandoned at the Border,” SheriffDever wrote, “It’s not really what they look like as much as what they do thatconcerns me. Among other things, they generally run off into the desert whenthey see our officers approach. Citizens and legal residents don’t normally dothat… In Cochise County, my deputies and I often have to travel many miles torespond to a resident’s call for assistance. The last thing we have time to dois harass law-abiding people.”

Theliberal Obama administration has revealed its desperation by resorting to therace card to defeat common sense policies on illegal immigration. Lacking anysubstantive arguments to refute reality, they resort to emotion. Even worse,unlike Sheriffs Dever and Babeu who formed a private legal defense fund tospare taxpayers the expense of defending their counties from the lawsuits,Obama is using our money to fund his race-baiting lawsuit. Obama has gone toofar by preventing regular sheriffs from doing their job.

Acting quietly, below theradar of U.S. public opinion and without congressional approval, the Obamaadministration is implementing a key policy objective of the Security andProsperity Partnership of North America, or SPP, to erase the border with Mexicoand Canada.

The administration isacting under a State Department-declared policy initiative described in a March23 fact sheet titled "United States-MexicoPartnership: A New Border Vision."

"Mexico and the UnitedStates have a shared interest in creating a 21st century border that promotesthe security and prosperity of both countries," the State Departmentdeclared. "The U.S. and Mexican governments have launched a range of initiativesthat challenge the traditional view of 'hold the line' and are developing aframework for a new vision of 21st century border management."

At the same time, CTV Newsin Canada has obtained a draft copy of a declaration between the U.S. andCanada entitled "Beyond the Border: A Shared Vision for Perimeter Securityand Competitiveness," to be implemented by a newly created Canadian-U.S."Beyond the Border Working Group."

TheAdministration's Phantom Immigration Enforcement Policy

The setting was notquite the flight deck of the U.S.S. Abraham Lincoln with a “MissionAccomplished” banner as the backdrop, but it was the next best thing. Speakingat the Center for American Progress (CAP) on Nov. 13, Homeland SecuritySecretary Janet Napolitano declared victory over illegal immigration andannounced that the Obama administration is ready to move forward with a massamnesty for the millions of illegal aliens already living in the United States.

Arguing the Obamaadministration’s case for amnesty, Napolitano laid out what she described asthe “three-legged stool” for immigration reform. As the administration viewsit, immigration reform must include “a commitment to serious and effectiveenforcement, improved legal flows for families and workers, and a firm but fairway to deal with those who are already here.”

Acknowledging that alack of confidence in the government’s ability and commitment to effectivelyenforce the immigration laws it passes proved to be the Waterloo of previousefforts to gain amnesty for illegal aliens, Napolitano was quick to reassurethe American public that those concerns could be put to rest.

“For starters, thesecurity of the Southwest border has been transformed from where it was in2007,” stated the secretary. Not only is the border locked up tight, shecontinued, but the situation is well in-hand in the interior of the country aswell. “We’ve also shown that the government is serious and strategic in itsapproach to enforcement by making changes in how we enforce the law in theinterior of the country and at worksites…Furthermore, we’ve transformedworksite enforcement to truly address the demand side of illegal immigration.”

If Rep. Joe Wilsonhad been in attendance to hear Secretary Napolitano’s CAP speech he might wellhave had a few choice comments to offer. But since he wasn’t, we will have torely on the Department of Homeland Security’s own data to assess the veracityof Napolitano’s claims.

According to DHS’sown reports, very little of our nation’s borders (Southwestern or otherwise) aresecure, and gaining control is not even a goal of the department. DHS claims tohave “effective control” over just 894 miles of border. That’s 894 out of 8,607miles they are charged with protecting. As for the other 7,713 miles? DHS’sstated border security goal for FY 2010 is the same 894 miles.

The administration’sstrategic approach to interior and worksite enforcement is just as chimericalas its strategy at the border, unless one considers shuffling paper to be astrategy. DHS data, released November 18, show that administrative arrests ofimmigration law violators fell by 68 percent between 2008 and 2009. Thedepartment also carried out 60 percent fewer arrests for criminal violations ofimmigration laws, 58 percent fewer criminal indictments, and won 63 percentfewer convictions.

While the officialunemployment rate has climbed from 7.6 percent when President Obama took officein January to 10 percent today, the administration’s worksite enforcementstrategy has amounted to a bureaucratic game of musical chairs. Theadministration has all but ended worksite enforcement actions and replaced themwith paperwork audits. When the audits determine that illegal aliens are on thepayroll, employers are given the opportunity to fire them with little or noadverse consequence to the company, while no action is taken to remove theillegal workers from the country. The illegal workers simply acquire a new setof fraudulent documents and move on to the next employer seeking workerswilling to accept substandard wages.

In Janet Napolitano’salternative reality a mere 10 percent of our borders under “effective control”and sharp declines in arrests and prosecutions of immigration lawbreakers maybe construed as confidence builders, but it is hard to imagine that theAmerican public is going to see it that way. If anything, the administration’srecord has left the public less confident that promises of future immigrationenforcement would be worth the government paper they’re printed on.

As Americansscrutinize the administration’s plans to overhaul immigration policy, they arelikely to find little in the “three-legged stool” being offered that they likeor trust. The first leg – enforcement – the administration has all but sawedoff. The second – increased admissions of extended family members and workers –makes little sense with some 25 million Americans either unemployed orrelegated to part-time work. And the third – amnesty for millions of illegalaliens – is anathema to their sense of justice and fair play.

As Americans wellknow, declaring “Mission Accomplished” and actually accomplishing a mission aretwo completely different things. When it comes to enforcing immigration laws,the only message the public is receiving from this administration is “MissionAborted.”
