Arizona and Interposition

An important verb appears on page 14 of the government’s brief in Arizona v. the United States, the case about four provisions of that state’s immigration law that will be argued on Wednesday in the Supreme Court. The government says Arizona is trying to “interpose” its own judgments on “national security, law enforcement, foreign policy, humanitarian considerations and the rights of law-abiding citizens and aliens.” It says the Constitution and Congress, in the Immigration and Nationality Act, give the executive branch authority to handle those issues.

The word “interpose” is a yellow flag in the history of state and federal relations. The southern states claimed a right of “interposition” as a basis for secession before the Civil War, and they resurrected the idea in the 1950s. Just as they claimed the right to interpose their power between the federal government and their populations over slavery and other issues in the 19th century, the southern states claimed the right to ignore the Supreme Court’s desegregation order in Brown v. Board of Education.

In 1958, in Cooper v. Aaron, the court scorched this idea and reaffirmed that Arkansas had a duty to follow federal law. The governor had contended he was not bound by the court decision and ordered the National Guard to bar nine African-American students from Little Rock’s Central High School, causing violence and disorder. In a unanimous opinion that they all signed, the nine justices said that the “chaos, bedlam and turmoil” caused by the governor’s disobedience was “intolerable.”

Arizona’s argument is somewhat different. Arizona contends that it has the power to make its own immigration policy even though the federal government has authority over immigration as part of foreign policy. It says its statute merely empowers law enforcement to cooperate with federal officers.

That is extremely disingenuous, to put it politely. The law transforms a federal policy that allows discretion in seeking serious criminals among illegal immigrants into a state mandate to single out everyone in Arizona illegally. The four provisions of the statute at issue essentially turn all Hispanics, including American citizens and legal residents, into criminal suspects. They require racial profiling, and, because their purpose is “attrition through enforcement,” their goal effectively is separation by race.

Just as racial equality was the law of the land during the desegregation era, it is the law of the land today. It is imperative that there be “a single, national approach” to immigration, as the government’s brief explains, and that any state law fulfills America’s hard-won commitment to racial equality. Arizona’s anti-immigrant statute emphatically does not.

In Washington, DC, several weeks ago, an immigration-overpopulation conference was filled to capacity by many of America’s finest minds and leaders. Writers, speakers, CEO's, representatives from Congress such as Tom Tancredo as well as former governors graced the podium. Bonnie Eggle, mother of the national parks ranger Kris Eggle, slain by Mexican drug runners last year on our unguarded southern border--gave a compelling speech that left not one dry eye in the place. Peter Gadiel, father of Jamie Gadiel, spoke powerfully on how the World Trade Center took his son and how nothing has been done since--to stop the flow of illegal immigration into the United States. Even with the facade of Tom Ridge's Homeland Security, 800,000 illegal aliens continue walking, crawling or tunneling across the Mexican border annually. Their accelerating numbers undermine America's ability to function.

During the conference, speaker after speaker astounded the audience with facts on how fast the present administration and congress continue dismantling the American Dream for average citizens. Mr. Rob Sanchez of Arizona, showed how H-1b and L-1 visas have ripped one million high tech jobs out of American worker's hands. Another speaker told a packed audience how 'offshoring' and 'outsourcing', fully supported by the president and congress have cost over three million American jobs in the past six years. His prediction was even more depressing: "In excess of three million more jobs will be 'outsourced' within four years. Those American jobs are headed to Mexico, India, China, Pakistan and Brazil."

Later, a brilliant college professor, Victor Davis Hansen, talked about his latest book, 'MEXIFORNIA', explaining how immigration, both legal and illegal, was destroying the entire State of California. He said it would march across the country until it destroyed all vestiges of the American Dream.

Moments later, former Colorado Governor Richard D. Lamm, stood up and gave a stunning speech on how to destroy America. The audience sat spellbound by the eight methods for destruction of the United States.

Lamm said, "If you believe that America is too smug, to self-satisfied, too rich, then let's destroy America. It is not that hard to do. No nation in history has survived the ravages of time. Arnold Toynbee observed that all great civilizations rise and fall, and that, "An autopsy of history would show that all great nations commit suicide."

"Here is how they destroyed their countries," Lamm said. "First, turn America into a bilingual or multi lingual and bicultural country. History shows that no nation can survive the tension, conflict and antagonism of two or more competing languages and cultures. It is a blessing for an individual to be bilingual; however, it is a curse for a society to be bilingual. The historical scholar Seymour Lipset put it this way, "The histories of bilingual and bicultural societies that do not assimilate are histories of turmoil, tension and tragedy. Canada, Belgium, Malaysia, Lebanon-all face crises of national existence in which minorities press for autonomy, if not independence. Pakistan and Cyprus have divided. Nigeria suppressed an ethnic rebellion. France faces difficulties with Basques, Bretons and Corsicans."

Lamm continued on how to destroy America, "Invent 'multiculturalism' and encourage immigrants to maintain their own culture. I would make it an article of belief that all cultures are equal. That there are no cultural differences. I would make it an article of faith that the Black and Hispanic dropout rates are due to prejudice and discrimination by the majority. Every other explanation is out of bounds."

"We could make the United States an 'Hispanic Quebec' without much effort. The key is to celebrate diversity rather than unity. As Benjamin Schwarz said in the ATLANTIC MONTHLY recently: " The apparent success of our own multi-ethnic and multi-cultural experiment might have been achieved not by tolerance but by hegemony. Without the dominance that once dictated ethnocentrically and what it meant to be an American, we are left with only tolerance and pluralism to hold us together."

Lamm added, "I would encourage all immigrants to keep their own language and culture. I would replace the melting pot metaphor with the salad bowl metaphor. It is important to ensure that we have various cultural sub-groups living in America reinforcing their differences rather than as Americans, emphasizing their similarities."

"Fourth, I would make our fastest growing demographic group the least educated. I would add a second underclass, unassimilated, undereducated and antagonistic to our population. I would have this second underclass have a 50% dropout rate from high school."

"My fifth point for destroying America would be to get big foundations and business to give these efforts lots of money. I would invest in ethnic identity, and I would establish the cult of 'Victimology'. I would get all minorities to think their lack of success was the fault of the majority. I would start a grievance industry blaming all minority failure on the majority population."

"My sixth plan for America's downfall would include dual citizenship and promote divided loyalties. I would celebrate diversity over unity. I would stress differences rather than similarities. Diverse people worldwide are mostly engaged in hating each other-that is, when they are not killing each other. A diverse, peaceful or stable society is against most historical precedent. People undervalue the unity it takes to keep a nation together. Look at the ancient Greeks: "The Greeks believed that they belonged to the same race; they possessed a common language and literature; and they worshipped the same gods. All Greece took part in the Olympic games. A common enemy Persia threatened their liberty. Yet, all these bonds were not strong enough to overcome two factors…local patriotism and geographical conditions that nurtured political divisions. Greece fell. In that historical reality, if we put the emphasis on the 'pluribus' instead of the 'unum, we can balkanize America as surely as Kosovo."

"Next to last, I would place all subjects off limits-make it taboo to talk about anything against the cult of 'diversity'. I would find a word similar to 'heretic' in the 16th century-that stopped discussion and paralyzed thinking. Words like 'racist' or 'xenophobe' halt discussion and debate."

"Having made America a bilingual--bicultural country, having established multiculturalism, having the large foundations fund the doctrine of 'Victimology', I would next make it impossible to enforce our immigration laws. I would develop a mantra: "That because immigration has been good for America, it must ALWAYS be good. I would make every individual immigrant sympatric and ignore the cumulative impact of millions of them."

In the last minute of his speech, Governor Lamm wiped his brow. A profound silence swept over the room. Finally, he said, "Lastly, I would censor Victor Davis Hansen's book 'MEXIFORNIA'. His book is dangerous. It exposes the plan to destroy America. If you feel America deserves to be destroyed, don't read that book."

There was no applause. A chilling fear quietly rose like an ominous cloud above every attendee at the conference. Every American in that room knew that everything Lamm enumerated was proceeding methodically, quietly, darkly, yet pervasively across the United States today. Every discussion is being suppressed. Over 100 languages are ripping the foundation of our educational system and national cohesiveness. Barbaric cultures that practice female genital mutilation are growing as we celebrate 'diversity'. American jobs are vanishing into the Third World as greedy corporations create a Third World in America-take note of California and other states-to date, 10 million illegal aliens and growing, fast.

It reminded me of George Orwell's book, '1984'. In that story, three slogans are engraved in the Ministry of Truth building: "War is peace," "Freedom is slavery," and "Ignorance is strength." I sat there as one of this country's most patriotic Americans, Governor Lamm, walked back to his seat. It dawned on everyone at the conference that our nation and the future of this great democracy, are deeply in trouble and worsening fast. An invasion of diseases, clashing cultures, languages, balkinization, mounting environmental dilemmas accelerate by the day. If this immigration monster isn't stopped within three years, it will rage across the United States like a California wildfire and destroy everything in its path, especially the American Dream.

Study: Illegal alien population may be as high as 38 million A new report finds the Homeland Security Department "grossly underestimates" the number of illegal aliens living in the U.S. Homeland Security's Office of Immigration Studies released a report August 31 that estimates the number of illegal aliens residing in the U.S. is between 8 and 12 million. But the group Californians for Population Stabilization, or CAPS, has unveiled a report estimating the illegal population is actually between 20 and 38 million. Four experts, all of whom contributed to the study prepared by CAPS, discussed their findings at a news conference at the National Press Club in Washington Wednesday. James Walsh, a former associate general counsel of the Immigration and Naturalization Service, said he is "appalled" that the Bush administration, lawyers on the Senate Judiciary Committee, and every Democratic presidential candidate, with the exception of Joe Biden, have no problem with sanctuary cities for illegal aliens. "Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. County Spends $600 Mil On Welfare For Illegal Immigrants

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.  

Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.

THE EXORBITANT FIGURE DOES NOT INCLUDE THE ENORMOUS COST OF EDUCATING, MEDICALLY TREATING, OR INCARCERATING ILLEGALS ALIENS. THIS COSTS THE COUNTY AN ADDITIONAL ONE BILLION DOLLARS.

The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety. 

About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars. 

Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.

His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

The Working Poor: 16% of All Workers

One-out-of-six working Americans (16%) consider themselves to be among the working poor.

A new Rasmussen Reports telephone survey of employed adults finds that 65% of employed adults still consider themselves part of the socio-economic “middle class.” Another 15% consider themselves part of the upper middle class and four percent (4%) consider themselves wealthy.

Showing a hint of optimism, 34% expect their earnings to be higher in a year than they are today and just 14% expect their income to decline. Overall, 44% expect little change and eight percent (8%) are not sure.

The Rasmussen Employment Index shows that confidence in the labor market is the lowest since January. Following last week’s government report on unemployment, consumer and investor confidence fell to 2010 lows.

Forty-six percent (46%) of all adults believe the job market is worse than one year ago. Thirty-eight percent (38%) feel it is the same, and just 14% believe it has improved.

Americans are evenly divided over whether anyone who wants to work can find a job in the United States.

The latest survey results show little change from November of 2009.

Most who earn between $40,000 and $75,000 fittingly classify themselves as middle class. So do a majority of those who earn more than $75,000 a year.

Among those who make more than $100,000 annually, 30% say they are upper middle class, and just 9% consider themselves wealthy.

Sixty-five percent (65%) of adults believe those in the middle class pay a larger share of their income in taxes than wealthy Americans do.

More than one in four employed adults (27%) now say they are looking for a job outside their current company.

Illegal alien migration into the United States costs American taxpayers $346 billion annually reported by the National Research Council. While employers of illegal aliens rake-in billions of dollars, the US citizens subsidize what may be called organized "Slavery in 21st Century America."

While Congress facilitates outsourcing, insourcing and offshoring of American jobs by the thousands weekly, that same Congress imports 182,000 legal immigrant monthly who need jobs. Another estimated 100,000 illegal aliens arrive each month without jobs. All those immigrants seize jobs from American citizens at slave wages.

What happens to the American taxpayer?

The NRC found that the average immigrant household receives $13,326 in federal welfare and pays $10,664.00 in federal taxes. Thus, American taxpayers shell out $2,682.00 for each immigrant household.

County Spends $600 Mil On Welfare For Illegal Immigrants

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.  

Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.

THE EXORBITANT FIGURE DOES NOT INCLUDE THE ENORMOUS COST OF EDUCATING, MEDICALLY TREATING, OR INCARCERATING ILLEGALS ALIENS. THIS COSTS THE COUNTY AN ADDITIONAL ONE BILLION DOLLARS.

The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety. 

About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars. 

Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.

His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

Anchor Babies Grab One Quarter of Welfare Dollars in LA Co

The anchor baby scam has proven lucrative for illegal aliens in Los Angeles County, at considerable cost to our own poor and downtrodden legal citizenry.

The numbers show that more than $50 million in CalWORKS benefits and food stamps for January went to children born in the United States whose parents are in the country without documentation. This represents approximately 23 percent of the total benefits under the state welfare and food stamp programs, Antonovich said.

"When you add this to $350 million for public safety and nearly $500 million for health care, the total cost for illegal immigrants to county taxpayers far exceeds $1 billion a year -- not including the millions of dollars for education," Antonovich said.

I love children and I'm all for compassion -- smart, teach-them-to-fish compassion. But when laws, the Constitution, and enforcement allow illegal aliens (the operative word here being "illegal") to insinuate themselves into our nation and bleed us of our precious financial resources, then laws, the Constitution and enforcement need to be changed.

Anchor Babies: Born in the USA -- The Abuse of the Fourteenth Amendment - Part I

My commute to work exceeds fifty miles but it gives me time to reflect. It is 1987 and I am an obstetrical nurse working in the crowded San Fernando Valley of California. Tonight I drive to my job in "Labor and Delivery," knowing the scenario before I arrive. Eight other nurses will battle through the night in this very busy obstetrical unit. Our patients are 99 percent pregnant illegal alien women who have broken United States immigration law to birth an American citizen child.

This will be their families' entry ticket into the United States. For them, no pesky visa applications and no waiting in line for several years like so many millions that enter this country through the front door. Pregnant Third World women have discovered that the only thing they have to do is cross the U.S.--Mexico border. The Fourteenth Amendment is their ticket.

It is now seventeen years later and things have worsened. The babies I helped deliver are older teenagers. When they turn 21, they will be eligible to bring their family members from Mexico, Central America and South America, i.e., chain migration on an ever-accelerating spinning wheel. Whole industries have now developed around abusing the Fourteenth Amendment. Pregnant Korean tourists come to the U.S. on travel visas to have their "anchor" babies. Coyotes dealing in human traffic are paid $1,500.00 to $25,000.00 per person to shuttle pregnant illegal aliens across our southern border. Our politicians and elites wink at this blatant law breaking and do nothing. The colonization of our country continues with the cooperation of our government. That means your senator and representative aid this illegal baby invasion. None dare call it treason. Most Americans mistakenly trust their politicians to do the right thing. Congressional members from every state betray that trust daily.

The Fourteenth Amendment: It's a simple document, a constitutional amendment drafted after the Civil War to assure that newly emancipated black slaves would never be denied citizenship by the States. The drafters had no idea that years later it would be used to make a mockery of our immigration laws. Alan Wall, an American journalist living in Mexico states, "An illegal alien can cross the border, have a baby five minutes later, and that baby is automatically declared a citizen of the USA automatically."

The illegal aliens don't have to go through any legal doors. They are exempt from that. They are, in fact, rewarded for disobeying U.S. laws by having their children granted automatic citizenship. In addition, the happy family is entitled to welfare benefits. And, illegal alien parents who have children born in the U.S. are seldom deported. That's why their children are called "anchor babies" - they anchor their families securely in the USA.

It doesn't have to be this way. Most European countries have done away with birthright citizenship because they experienced the same abuses we are seeing. The Irish Supreme Court recently ruled that immigrant parents could be deported even if they have an Irish child. "It was becoming common for 'single pregnant woman' to come to Ireland from countries outside the 15-nation EU, most frequently from Nigeria, to claim political asylum," states Shawn Pogatchnik, AP writer. Ireland saw a wave of immigration abuse and promptly put a stop to it. Recently, the Irish voted to end birthright citizenship. Britain and Australia both changed their citizenship laws in the 1980's for the same reasons. If you are born in Switzerland you will not automatically become a Swiss citizen. Why should Americans allow our country to be invaded by people who do not honor allegiance to our laws?

Allegiance is the key word. Senator Jacob Howard, co-author of the citizenship clause of the 14th Amendment, stated in 1866, "Every Person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons."

The Fourteenth Amendment states,"(A) Persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States." However a proviso limits foreigners who have babies in America. It couldn't be clearer, children of foreigners, aliens or diplomats, who are subject to the jurisdiction of their home country, are ineligible for citizenship. At the time the Fourteenth Amendment was ratified we didn't have immigration laws. One hundred and thirty eight years later we are paying for the misinterpretation of it.

Congress has the power to step in and correct this wrong, but don't hold your breath. There have been several bills dealing with this issue and most have died in committee. Except for a few brave individuals like Tom Tancredo of Colorado and Rep. Goode of Virginia, there isn't enough chutzpah on Capital Hill to fill a thimble. Where are the Thomas Jefferson's and Ben Franklin's when we need them? An important case, Hamdi vs Rumsfeld was recently heard by the U.S. Supreme Court. Yaser Hamdi was captured during the Afghanistan war fighting for the Taliban. It was later learned that he had been born in Louisiana to Saudi nationals when his father was employed as a chemical engineer on a work visa. The family subsequently moved back to Saudi Arabia where Hamdi was raised. Hamdi sued the U.S. government for holding him in a Navy stockade for two years. He demanded full rights of U.S. citizenship since by accident he happened to be born here. The U.S. government wanted Hamdi charged as a non-combatant and denied due process. Rumsfeld representing the U.S. government didn't raise this issue because he wanted to end birthright citizenship but other groups saw the possibility to finally challenge this fatal flaw in our immigration law that is wrecking havoc on our country.

One such group, Friends of Immigration Law Enforcement, submitted a 'friend of the court' or Amicus brief. They asked the Supreme Court to address the issue of whether Hamdi should be considered an American citizen at all, since at the time of his birth his parents were foreign nationals with no fealty to this nation.

The decision came down this week and just like the rest of the elite establishment in this country the U.S. Supreme Court ignored the issue of birthright citizenship except for a brief statement by Justices Scalia and Stevens stating Hamdi was a "presumed American citizen." So we live to fight another day. In the meantime the invasion/colonization of our country marches on.
