An Invitation to Abuse and Chaos

Arizona’s
cold-blooded immigration statute was enacted in 2010 to bring about “attrition through enforcement” — to make
life so harsh for undocumented immigrants that they would be driven out of the
state. It invites unfettered racial profiling and the abuse of police
power. And, if allowed to stand, it opens the door to states’ writing their own
foreign policy, in defiance of the Constitution.
On
Wednesday, the Supreme Court is scheduled
to hear arguments on whether the state can enforce key parts of this
law, despite the federal government’s exclusive constitutional authority to
regulate foreign affairs, including immigration policy. Any sensible reading of
the statute, the Constitution and legal precedents going back to the nation’s
founding would say no.
The
Arizona statute, which has become a model for other states, makes a state crime
of being in the United States unlawfully and failing to register with the
federal government. Its enforcement provisions essentially turn all Hispanics,
including American citizens and legal residents, into criminal suspects. Both a
Federal District Court and the Court of Appeals for the
Ninth Circuit have blocked four parts of the statute from going into
effect because they so clearly usurp federal authority. The justices hearing
the case (Justice Elena Kagan is recused) should affirm that finding in the
strongest terms.
The legal
issue is whether federal immigration law pre-empts, or disallows, the state
regulations. Pre-emption doctrine enforces national standards when the federal
government has set them. Arizona argues that because federal law does not
explicitly prohibit the state provisions, they are valid unless Congress
implicitly intended to bar such measures. It contends there is no “clear
conflict” between any federal law and the state statute, which “simply uses
state resources to enforce federal rules.”
In
pre-emption cases, the Constitution’s supremacy clause ensures that when there
is a conflict, federal law prevails. But the constitutional threat in this
extraordinary case goes beyond routine pre-emption analysis. By the framers’
intent, foreign-policy
making is entrusted to the federal government through presidential and
Congressional powers. That authority is exclusive, barring any state intrusion.
As the Supreme Court said in a 2003
immigration case, “any policy toward aliens is vitally and intricately
interwoven with contemporaneous policies in regard to the conduct of foreign
relations, the war power, and the maintenance of a republican form of
government.”
While
Arizona says its law merely empowers law enforcement to work cooperatively with
federal officers, that is demonstrably false. The four
provisions at issue go far beyond federal law, turning federal guidelines into
state enforcement rules and violations of federal rules into state crimes. They
transform a federal policy that allows discretion in seeking serious criminals
among illegal immigrants into a state mandate to target everyone in Arizona
illegally. How the provisions overstep federal law is worth noting:
¶Law
enforcement officers are required to verify the immigration status of any
person they stop, arrest or detain if the officer has a “reasonable suspicion”
the person is in the country illegally. Any official who restricts enforcement
of the provision is subject to a fine of up to $5,000 a day. There is no such
mechanism in federal law.
¶Failure
to carry legal immigration papers is a crime in Arizona, though this is not a
crime under federal immigration law. The statute also interferes with the
discretion of federal officials, who under federal law have the power to put
off proceedings against undocumented immigrants or to allow their release from
custody.
¶It is a
state crime for an undocumented immigrant to apply for a job, solicit a job or
work in Arizona, though Congress does not criminalize such conduct.
¶Police
may arrest anyone without a warrant as long as an officer has “probable cause
to believe” that person has committed a crime that could make him subject to
deportation — even if that person is not wanted for the alleged offense and the
federal government may not want to deport or even detain him.
These provisions defy
federal law. The justices should forcefully repudiate Arizona’s
unconstitutional statute and send a clear message to other states following
Arizona’s pernicious lead.

Two immigrant workers
were killed last Sunday along the Arizona border. A truck was found near Eloy,
a town northwest of Tucson known for immigrant smuggling. There were 20 to 30 people in the truck when two men dressed in
paramilitary clothing opened fire, killing two migrants. While the motive
remains unknown and no arrests have been made, among the suspects are drug
smugglers and border vigilantes.
Gerardo Perez-Ruiz,
39, of Toluca, Mexico, was identified as one of the victims; the other victim
remains unidentified but is presumed to be from Guatemala. Most of the
undocumented immigrants fled into the desert. Five found hiding in bushes near
the truck were turned over to the border patrol.
According to Dawn
Barkman, Pima County sheriff’s deputy, this atrocity is similar to two attacks
in 2007 in which five immigrants were killed. In response to these attacks,
Pinal County Sheriff Paul Babeu, known for his anti-immigrant views, has called
for the formation of the Border Crimes Unit.
Eloy, a town of
10,375 with about three-quarters of its population Hispanic, has a median
household income of $26,518. Nearly a third of its population falls below the
poverty level, with youth and the elderly the hardest hit. These statistics
reflect the general social crisis that many working-class families confront,
and which affects immigrant families all the more severely. The state of
Arizona has a 15 percent overall poverty rate, one of the highest in the
country. About a quarter of the state’s children are living in poverty,
according to official figures.
Arizona is on the
verge of passing Senate Bill 1083 (Arizona Special Mission Unit, or ASMU),
which would create a government-funded volunteer armed militia. Sponsored by
Senator Sylvia Allen, over $1.9 million is to be allocated to the program.
According to Col. Luke Taylor, who drafted the bill, this unit is not only to
serve along the Mexican border, but would serve as a “statewide agency that can
operate anywhere within the state.”
The legislation would
allow militia volunteers to arrest and detain individuals, as well as seize
property. Although ostensibly obliged to cooperate with local law enforcement,
the ASMU, acting alongside the Arizona State Guard, would be accountable to the
governor through a commander confirmed by the state Senate. The bill was
actually opposed by 14 of 15 Arizona state sheriffs and supported solely by the
aforementioned Paul Babeu.
These events do not
occur in isolation, but in tandem with the Obama administration’s increasingly
draconian shift in rhetoric and policy in relation to immigration. The killings came a week after the six-day
Operation Cross Check, in which more than 3,100 immigrants were arrested under
the pretext of apprehending and deporting “immigration fugitives” and “criminal
aliens.” More than half of those rounded up either committed only minor
misdemeanors or had no criminal convictions whatsoever.
The Obama
administration has deported nearly 400,000 people in each of the past three
years, a record number. There are more patrol troops than ever along the
Mexican border, as well as plans for the creation of a three-tiered wall to be
built along the border under the pretext of “border safety.”
The Secure
Communities (S-Comm) immigration enforcement program, which is managed by the
US Immigration and Customs Enforcement agency (ICE) under the Department of
Homeland Security, was initiated in 2008 under the Bush administration. The
purpose of S-Comm is to build large databases of immigrants using biometric and
other technology aimed at increased deportation sweeps. The Obama
administration has expanded S-Comm to over 1,210 state and local jurisdictions
and is aiming to have all of 3,141 US jurisdictions in compliance with the
program by 2013.
Developments such as
S-Comm and Operation Cross Check are fully in keeping with the government’s
wider anti-immigrant agenda. They play a role in sustaining the social and
political climate in which the recent murders of immigrants in Arizona, as well
as other attacks on immigrant workers, take place.

From a Mexican kingpin to an FBI informant
After agents arrest a drug cartel chieftain named Jesus Audel Miramontes-Varela, he becomes one of the bureau's most valuable sources of information, according to confidential interview reports.

WASHINGTON — Police and federal agents pulled the car over in a suburb north of Denver. An FBI agent showed his badge. The driver appeared not startled at all. "My friend," he said, "I have been waiting for you."
And with that, Jesus Audel Miramontes-Varela stepped out of his white 2002 BMW X5 and into the arms of the Federal Bureau of Investigation.
Over the next several days at his ranch in Colorado and an FBI safe house in Albuquerque, the Mexican cartel chieftain — who had reputedly fed one of his victims to lions in Mexico — was transformed into one of the FBI's top informants on the Southwest border.
Around a dining room table in August 2010, an FBI camera whirring above, the 34-year-old Miramontes-Varela confessed his leadership in the Juarez cartel, according to 75 pages of confidential FBI interview reports obtained by The Times/Tribune Washington Bureau.
He told about marijuana and cocaine routes to California, New York and the Great Lakes. He described the shooting deaths of 30 people at a horse track in Mexico, and a hidden mass grave with 20 bodies, including two U.S. residents.
He told them about his African lions, which he had acquired as circus cubs. The story about feeding one of his enemies to them was false, he claimed, but he said he had seen plenty of "violence and suffering." He told agents he was desperate to trade his knowledge for government protection. He wanted a new life for himself and his wife and three daughters.
A week later Miramontes-Varela pleaded guilty in federal court in New Mexico to a minor felony as an illegal immigrant in possession of a firearm. Then he disappeared, almost certainly into the federal witness protection program.
FBI officials in Arizona and Washington declined to comment about Miramontes-Varela, citing bureau policy against discussing informants. But the documents tell plenty.
During the interview sessions, Miramontes-Varela "provided significant information about drug trafficking activity," the documents said, leading to several successful unnamed law enforcement operations in the U.S. and Mexico.

After Miramontes-Varela was stopped in Brighton, Colo., agents took him back to his ranch. They advised him and his wife, Mari, that he was "the subject of an FBI investigation for his involvement in drug trafficking, firearms trafficking, money laundering and the interstate transportation of stolen property."
In Spanish, they read him his Miranda rights. He called an attorney; they spoke quietly in Spanish. Miramontes-Varela hung up and turned to the agents. "Yes," he said. "He told me to do as much as I can for you."
Miramontes-Varela signed the Miranda waiver and looked up at the agents. He asked, "Where do you want to start?"
First, they said, any guns?
Miramontes-Varela mentioned a black 9-millimeter semiautomatic Glock pistol he said he bought after being shot at in El Paso. The agents asked to see it. "Yes, yes, no problem," he said. He walked to a floor safe in a far corner of the living room, unlocked it and handed the weapon over.
Agents drove the couple to the FBI safe house in Albuquerque. Inside, they pointed to two cameras. One was in the master bedroom, where Miramontes-Varela and his wife would stay. Agents showed that that it was unplugged and that they had covered it with a white plastic bag. "Very nice," Miramontes-Varela said.
Miramontes-Varela talked to them around the dining room table. That is where the other camera was. It stayed on.

His story poured out. He was born the third of 10 children in Terrero, Mexico, and grew up in Namiquipa, northern Mexico. He married when he was 18, his bride 15. They sneaked though Nogales, Ariz., coming to the U.S., he said, "to make money."
They settled in Denver. Miramontes-Varela installed drywall. But in the late 1990s a brother, Yovany, lost an arm in a tractor mishap, and Miramontes-Varela returned home. He grew apples and traded in cattle.
In early 2002, he said, the Juarez cartel came to Namiquipa. Pedro Sanchez, known as El Tigre, controlled things. He offered Miramontes-Varela a job collecting a monthly $35,000 "tax" from marijuana growers.
Every 15 days, growers carted 20 tons to a local warehouse. It was shipped north through El Paso, the proceeds funneled back to the cartel and the growers.
One day the military arrived and gunfire ensued. "The mayor and town treasurer were killed," Miramontes-Varela said. Later, El Tigre was arrested.
In 2008, Miramontes-Varela said, he fled with his family to El Paso. When he failed to return, the cartel burned his ranch and stole his cattle, all 120 cows. He was done with the violence, he said.

That part, according to the FBI, was not true. Miramontes-Varela shuffled between ranches in New Mexico and Colorado, they said, often in an armored car with bodyguards, and set up his own drug- and gun-smuggling operation.
When a courier was arrested with 18 kilos of cocaine, Miramontes-Varela offered the man's family the choice of one of his 16 homes in Mexico, including his "big house," according to telephone wiretaps outlined in the documents.
In March 2010, the FBI listed him as head of the "Miramontes-Varela Drug Trafficking Organization," tied to the Juarez, Sinaloa and Los Zetas cartels. From two confidential sources and two wiretaps, agents learned that his organization had stolen tractors in the U.S. and driven them to Mexico as payment for lost loads. One debt alone reached $670,000. They learned that one of Miramontes-Varela's bosses in Mexico, "Temoc," was tortured and killed by the Sinaloans.
The Bureau of Alcohol, Tobacco, Firearms and Explosives also wanted him arrested. It had tracked $250,000 in illegal gun purchases to Miramontes-Varela and his brother through its ill-fated Fast and Furious gun-smuggling surveillance operation in Arizona.
FBI agents rigged a 24-hour pole camera outside his ranch near Santa Teresa, N.M. But Miramontes-Varela figured it out. Five of his men in two vehicles followed a surveillance agent for 90 minutes, then slashed his tire.
More ominously, the FBI learned Miramontes-Varela and his organization had bribed U.S. officials in El Paso and New Mexico. They decided it was time to bring him in.
On Aug. 18, 2010, they followed him from his Colorado farm. He briefly visited a Walgreens, then the State Patrol pulled him over. The time was 11:20 a.m. They had him.

He filled in the cartel hierarchies too. One chieftain had arm and shoulder scars from bullet wounds. At the horse track murders, the chieftain wore a mask. Some switched sides; others died when loads went missing.
And he told them about that mass grave in Palomas, Mexico. Authorities dug up 20 decaying corpses. Miramontes-Varela, the FBI's new informant, was right.

Every 15 days, growers carted 20 tons to a local warehouse. It was shipped north through El Paso, the proceeds funneled back to the cartel and the growers.
One day the military arrived and gunfire ensued. "The mayor and town treasurer were killed," Miramontes-Varela said. Later, El Tigre was arrested.
In 2008, Miramontes-Varela said, he fled with his family to El Paso. When he failed to return, the cartel burned his ranch and stole his cattle, all 120 cows. He was done with the violence, he said.

That part, according to the FBI, was not true. Miramontes-Varela shuffled between ranches in New Mexico and Colorado, they said, often in an armored car with bodyguards, and set up his own drug- and gun-smuggling operation.
When a courier was arrested with 18 kilos of cocaine, Miramontes-Varela offered the man's family the choice of one of his 16 homes in Mexico, including his "big house," according to telephone wiretaps outlined in the documents.
In March 2010, the FBI listed him as head of the "Miramontes-Varela Drug Trafficking Organization," tied to the Juarez, Sinaloa and Los Zetas cartels. From two confidential sources and two wiretaps, agents learned that his organization had stolen tractors in the U.S. and driven them to Mexico as payment for lost loads. One debt alone reached $670,000. They learned that one of Miramontes-Varela's bosses in Mexico, "Temoc," was tortured and killed by the Sinaloans.
The Bureau of Alcohol, Tobacco, Firearms and Explosives also wanted him arrested. It had tracked $250,000 in illegal gun purchases to Miramontes-Varela and his brother through its ill-fated Fast and Furious gun-smuggling surveillance operation in Arizona.
FBI agents rigged a 24-hour pole camera outside his ranch near Santa Teresa, N.M. But Miramontes-Varela figured it out. Five of his men in two vehicles followed a surveillance agent for 90 minutes, then slashed his tire.
More ominously, the FBI learned Miramontes-Varela and his organization had bribed U.S. officials in El Paso and New Mexico. They decided it was time to bring him in.
On Aug. 18, 2010, they followed him from his Colorado farm. He briefly visited a Walgreens, then the State Patrol pulled him over. The time was 11:20 a.m. They had him.

In the safe house dining room, agents brought out maps, and Miramontes-Varela sketched in smuggling routes. He said weapons were easily acquired in this country, including .50-caliber rifles. "Good for long-range sniper fire," he said.
He filled in the cartel hierarchies too. One chieftain had arm and shoulder scars from bullet wounds. At the horse track murders, the chieftain wore a mask. Some switched sides; others died when loads went missing.
And he told them about that mass grave in Palomas, Mexico. Authorities dug up 20 decaying corpses. Miramontes-Varela, the FBI's new informant, was right.

Pinal County Sheriff: Mexican drug cartels now control parts of Arizona

CASA GRANDE, AZ - Two men shot earlier this week could be the result of the ongoing battle between Mexican drug cartels now spilling over deep into Arizona, officials say.
Pinal County investigators say an area known as the smuggling corridor now stretches from Mexico's border to metro Phoenix.
The area , once an area for family hiking and off road vehicles has government signs warning residents of the drug and human smugglers.
Night vision cameras have photographed military armed cartel members delivering drugs to vehicles along Highway 8.
"We are three counties deep. How is it that you see pictures like these, not American with semi and fully automatic rifles. How is that okay?" asked Pinal County Sheriff Paul Babeu.
Babeu said he no longer has control over parts of his county.
"We are outgunned, we are out manned and we don't have the resources here locally to fight this," he said at a Friday news conference.
Five weeks ago Deputy Louie Puroll was ambushed and shot as he tracked six drug smugglers.
Sheriff Babeu said the ambush mirrored military tactics.
Even more disturbing, Babeu said the man who called in to 911 operators for help seemed to know a lot about the sheriff deputy's case.
"He told operators they could find him where the deputy was shot and talked about our search helicopter. Things that were talked about on the news," Babeu said.
When operators asked the fatally wounded man how he knew the area, he claimed he sold cantelope near mile post 150.
Both men were found dead several hours later.
Detectives say next to them was a Bushmaster automatic rifle used by police officers for patrolling. It does not appear to be stolen.
Investigators also revealed that an autopsy showed strap marks on one of the men that likely came from hauling heavy loads, they suspect were drugs.
One of the men, deputies say, was voluntarily deported seven times.
Babeu said he doesn't believe the drug cartel problems will not be solved when SB 1070 becomes a law, or with President Obama's promise of 1,200 troops spread out among four border states.
"It will fall short. What is truly needed in 3,000 soldiers for Arizona alone," Babeu said.

Title 1 schools. Title 1 schools are on
the free breakfast and free lunch program. When I say free breakfast, I'm not
talking a glass of milk and roll -- but a full breakfast and cereal bar with
fruits and juices that would make a Marriott proud. The waste of this food is
monumental, with trays and trays of it being dumped in the trash uneaten. (OUR

About 75% or more DO have cell phones. The school also provides day care
centers for the unwed teenage pregnant girls (some as young as 13) so they can
attend class without the inconvenience of having to arrange for babysitters or
having family watch their kids.
I was ordered to spend $700,000 on my
department or risk losing funding for the upcoming year even though there was
little need for anything; my budget was already substantial. I ended up buying
new computers for the computer learning center, half of which, one month later,
have been carved with graffiti by the appreciative students who obviously feel humbled
and grateful to have a free education in America. (OUR TAX DOLLARS A T
WORK) I have had to intervene several
times for young and substitute teachers whose classes consist of many illegal
immigrant students here in the country less then 3 months who raised so much
hell with the female teachers, calling them "Putas" whores and
throwing things that the teachers were in tears. Free medical, free education, free food, day
care etc., etc., etc. Is it any wonder they feel entitled to not only be in
this country but to demand rights, privileges and entitlements? To those who
want to point out how much these illegal immigrants contribute to our society
because they LIKE their gardener and housekeeper and they like to pay less for
tomatoes: spend some time in the real world of illegal immigration and see the

In California, League of United Latin American Citizens has
adopted a resolution to declare "California Del Norte" a sanctuary
zone for immigrants. The declaration urges the Mexican government to invoke its
rights under the Treaty of Guadalupe Hidalgo "to seek third‑nation neutral
arbitration of ....disputes concerning immigration laws and their
enforcement." We’ll have the story.
Mexican President Felipe Calderon is in New York today on
the first leg his five‑day tour across America to meddle in immigration issues
in the United States. This is his first visit to the U.S. since he became
President in 2006, but he will not meet with President Bush or any of the
presidential candidates, who he has accused of spewing anti‑immigrant rhetoric.

Last summer, in Boulder,
Colorado, eight illegal aliens raped eight American woman. The aliens fled back
to Mexico. One was caught. In a nearby city of Longmont, a used car dealer was
driven out of business because he suffered so much theft from his lot that he
bankrupted. An illegal alien killed a California cop, John Marsh, last year.
Robberies and break-ins have become the norm in California. They’ve become the
pattern in Florida, Georgia, North Carolina and dozens of other states. But the
sobering realities concerning these crimes point to one fact--they are illegal
aliens. They are importing themselves into this country with a vengeance. They
are deadly, pernicious and organized. They represent the worst of what is
common in the Third World.
In
her recent scathing report, ‘THE ILLEGAL ALIEN CRIME WAVE’ by brilliant
investigative reporter, Heather MacDonald, our country is being assaulted by a
crime wave that grows steadily and viciously. A full 95% of all outstanding
warrants for homicide, which totaled 1,500 last year in Los Angeles, pointed to
illegal aliens. Soberingly, two thirds of all fugitive felony warrants,
totaling a horrifying 17,000, were for illegal aliens. To make matters worse,
in 1995 a report showed that 60% of the 20,000-strong 18th Street gang in
southern California was composed of illegal aliens. That gang collaborates with
the Mexican Mafia on drug distribution schemes, extortion and drive-by assassinations.
They commit assault and robberies every day of the week. A night of crime to
them is like a day of work for American citizens.
How
did it come about and why is it spreading? In 1979, Los Angeles Police
Department Chief Daryl Gates enacted Special Order 40. Astoundingly, as if
insanity took the front row seat in their minds, leaders of dozens of cities
from San Francisco to Miami and New York City—adopted this special order. This
law prohibits police officers from arresting illegal aliens. In reality, it’s a
carte blanche invitation for crime to grow in our country, putting citizens at
risk for their lives.
"If
I see a deportee from the Mara Salvatrucha prison in El Salvador crossing the
street in LA, I can’t touch him," said a Los Angeles police officer.
"I can’t arrest him for an immigration felony."
Boulder,
Colorado practices the same ‘sanctuary’ policy for illegal aliens. The mayor of
the city openly encourages illegal aliens by making sure the police chief does
not arrest illegals. Some of Boulder’s immigration lawyers were so bold as to
offer publicly announced classes for illegal aliens on how to avoid arrest,
detention and deportation by immigration agents. The result in that town shows
a tripling of the illegal alien population as well as jobs taken away from
citizens and the eight violent rapes.
Not
far away in Denver last week, an illegal alien, Javier Cruz-Caballero,
purposely ran down police officer, Robert Bryant, while the officer operated a
radar gun in a school walk zone. Witnesses saw the Mexican national rev up his
engine while taking dead-aim at the officer. Bryant flew 30 feet through the
air while suffering a broken leg and head lacerations. He could have easily
been killed.
At a
greater level, New York’s Mayor Bloomberg supports illegal alien crime by
maintaining a ‘sanctuary policy’ in that city. Last year, four illegals raped
and killed a New York jogger. That crime was one of thousands of crimes
committed by illegal aliens who are protected from the law. But more horrific
in impact of this loss of the rule-of-law, former Mayor Guiliana practiced
Special Order 40. Several illegal aliens protected by the Order participated in
9/11. The death toll reached 2,800, but the impact on our nation reverberates
today. Yet, Special Order 40 continues full force in protecting the estimated
10 million illegal aliens in our country.
However,
thousands of them are killing, raping, robbing and driving illegally in our
country. Over 400,000 deportees continue walking around free in our country.
The ones that commit crimes and are caught make up a full 29% of our prison
populations. They cost American taxpayers nearly $1 billion annually to feed,
house and care for them in our prisons. And, yet, Special Order 40, continues
as if it was a fig leaf for welcoming hardened alien criminals.

does that leave you? If you’re in California, you’re planning on moving to
Idaho or Montana because it’s already too late. With over 3.5 million illegals,
the crime wave is beyond stopping. If you’re in Georgia, you’re probably
stewing under your breath, but you don’t have a clue that it’s going to get
worse. In Chicago, they either take jobs or rob banks or set up drug,
prostitution and theft rings. If you’re in Florida, it is no longer an American
city. Houston is just as bad. It grows worse in every city in America.
It’s
called ‘THIRD WORLD MOMENTUM’. The key is to understand that in the Third
World--corruption, crime, child prostitution, bashing in peoples’ heads,
torture and worse is the norm. Why? Because the rule-of-law no longer applies.
Today, in America, concerning illegal immigration, our public officials who
were sworn to uphold the Constitution have abstained from their oaths of office.
We’re forced NOT to talk about it via being politically correct, yet we are the
victims of our own silence.
Because
the American public still hasn’t figured this crisis out or keeps thinking it
will go away on its own—IT IS GOING TO GET WORSE—and you or your loved ones
will become victims given enough time. With Special Order 40 in your city,
another 9/11 can’t be far off!

Less than a week after suing Arizona to block its immigration law, SB 1070, critics are pressing the Obama administration to go after “sanctuary cities” that deliberately look the other way when it comes to illegal immigration. The Department of Justice last week responded that it will not sue these cities, which prohibit local law enforcement from inquiring about an individual’s legal status or alerting immigration authorities when they encounter illegal immigrants, because it believes passive refusal to follow the law is not as egregious as Arizona’s passage of a law that “actively interferes” with federal law. Justice Department spokeswoman for Attorney General Eric Holder inexplicably argued, “There is a big difference between a state or locality saying they are not going to use their resources to enforce a federal law, as so-called sanctuary cities have done, and a state passing its own immigration policy that actively interferes with federal law.” (The Washington Times, July 14, 2010).
Representative Lamar Smith (R-TX), who authored the 1996 federal law which requires states and localities to cooperate with federal authorities on immigration enforcement, criticized the Justice Department’s politically convenient stance on sanctuary cities. "For the Justice Department to suggest that they won't take action against those who passively violate the law …. is absurd," said Rep. Smith. "Will they ignore individuals who fail to pay taxes? Will they ignore banking laws that require disclosure of transactions over $10,000? Of course not." (The Washington Times, July 14, 2010).
Arizona Governor Jan Brewer has also noted the irony of the Obama administration’s refusal to sue localities to strike down their sanctuary policies, which she said could also be considered a “patchwork” of immigration laws across the country. (Brewer Statement, July 6, 2010). Senator David Vitter (R-LA) similarly noted, “This administration’s idea of immigration enforcement is to go after the states and local officials actually trying to enforce the laws on the books. They are demonizing those that look to protect our border and end illegal immigration while giving a wink and nod of approval to sanctuary cities that don't enforce our laws.” (Vitter Press Release, July 15, 2010).

The economic recovery may be slow and uncertain. Immigration
remains a hot button political issue. But there's one positive trend that will
keep benefiting smaller cities in the years ahead: Their growing appeal to
immigrant poppulations.
Though New York, Los Angeles, Miami, Chicago and other large U.S. cities
remain hubs for immigrants, newcomers from abroad are increasingly settling in
smaller communities across the U.S., lured by a lower cost of living, more job
opportunities, and a support structure of fellow immigrants. In return, these
communities get a rejuvenated work force and a consumer base.
Here are eight rapidly emerging gateway communities for
immigrants. All are likely to remain popular with foreign newcomers, despite
stepped-up enforcement of federal immigration laws. Some may surprise you.
Benton/Washington Counties,
Ark.
Home to large employers such as Wal-Mart in Bentonville and Tyson Foods in nearby Springdale, these northwest Arkansas
counties have seen enormous growth in their immigrant populations over the past
decade.
Foreign born residents now make up more than 20% of Springdale's population. The area's
chicken farms, construction industry, corporate headquarters, and low cost of
housing remain a strong magnet.
With Hispanics accounting for most of the increase, the
region is seeing more ethnic bakeries, restaurants, media outlets, and other
businesses. The once nearly homogeneous local school districts have added
English as a second language to their curricula in addition to special programs
to help involve parents in their children's education.
Portland and Salem, Ore.
(Marion/Multnomah counties)
The growth of the area's technology industry draws
highly skilled immigrant workers to northwest Oregon, where they're joining
earlier arrivals -- refugees from Southeast Asia, Africa, eastern Europe and
Russia.
Fairfax County, Va.
In this large suburban county bordering Washington,
D.C.,
immigrants make up almost 30% of the population. The recession hasn't been felt
here as much as it has in other parts of the country and construction, and
service jobs are still plentiful. Fairfax County is across the Potomac
River from the nation's capital, which, along with other large cities, has long
been a draw for immigrants.
There's also a strong immigrant presence among service
workers, especially in health care, restaurants, and cleaning services. Nearly
40% of the region's immigrant population arrived within the past decade. Many
own their own businesses. And they are encouraging more family members and
friends from the old country to join them.
Shelbyville, Tenn. (Bedford
County)
Though the foreign born population in Shelbyville hovers around the national
average, the small city and its environs have become a mecca for refugees from
Egypt, Myanmar (formerly known as Burma), and Somalia. There are jobs in Shelbyville's food processing plants and
other factories.
Cape Coral, Fla. (Lee County)
Southwest Florida's Gulf Coast has strong
agriculture and service sectors. In 2000, Cape Coral's foreign born population was
8.7%, relatively low compared with national average of 11.1%. In the past
decade it has increased by about 250% -- putting it above the national average.
Boise, Id. (Ada County)
Attracted to the area by job opportunities in agriculture
and an affordable cost of living, Boise's immigrant population has
climbed by more than 50% over the past decade.
Gwinnett County, Ga.
The foreign born population in Gwinnett
County has
more than doubled since 2000, and now represents about 25% of the county's
total population. Drawn to the area by an abundance of jobs in the service
sector and the low cost of housing, the immigrants are mostly Hispanic. They
are carving out a livelihood in a region where blacks have traditionally been
the most visible minority. Gwinnett also has one of the highest rates of
illegal immigration in the U.S. -- authorities estimate that half of all
foreign born residents of the county are unauthorized.
Raleigh-Durham-Cary, N.C.
(Wake/Durham/Chatham Cos.)
North
Carolina's
394% immigrant growth rate in the 1990s was the fastest among Southern states,
and the trend has continued in the 21st century. The Raleigh-Durham area has been hub to much of
this growth.
The draw? Affordable
housing and
jobs at Research Triangle Park -- one of the country's largest technology
development centers -- as well as in the construction and service sectors. The
recession and stricter enforcement of immigration laws in the Tar Heel State
are slowing immigration growth -- at least for now. But many experts think
migration could pick up again as the economy recovers.

Casting a shadow on economic recovery efforts in the United States
is the cost of illegal immigration that consumes U.S. taxpayer dollars for
education, healthcare, social welfare benefits, and criminal justice. Illegal
aliens (or more politically correct, “undocumented immigrants”) with ties to
Mexican drug cartels are contributing to death and destruction on U.S. lands
along the southern border.
While the declining job market in the United States may be discouraging some would-be border crossers, a flow of illegal aliens continues unabated, with many entering the United States as drug-smuggling “mules.”
Increasingly vicious foot soldiers of the Mexican drug cartels are taking control of U.S. lands along the border, especially since U.S. Border Patrol units have been reassigned, some to offices 60 to 80 miles inland.
The U.S. Department of the Interior, Bureau of Land Management (BLM) early last year posted signs warning citizens to avoid Interstate 8 between Casa Grande and Gila Bend, Ariz., because of criminal activity in the area, an area that includes protected natural areas precious to the nation.
In reaction to public outrage over the signs, the BLM removed the offensive wording in October 2010, replacing it with the following: Visitor Information Update—Active Federal Law Enforcement Patrol Area.
As the liberal news media, far-left Democrats, and labor unions push for the “Hispanicazation” of U.S. culture, U.S. Department of Homeland Security Secretary Janet Napolitano says the U.S. border has never been more secure.
Perhaps she is basing this on the reduced number of apprehensions, which result, of course, from reassigning Border Patrol agents inland.
In a recent New York Times article, Nicholas Kristof criticized U.S. citizens for not speaking a foreign language and suggested that “Every child in the United States should learn Spanish.” He concluded that as the United States increasingly integrates economically with Latin America, Spanish will be crucial for the United States.
For decades, the liberal left has argued that Latin America is essential for U.S. business and trade. Kristof states that Latin America “is finally getting its act together” but fails to mention the Obama administration’s $2 billion loan of U.S. taxpayer money in 2009 to Brazil’s Petrobras oil company for deep off-shore oil drilling. Obama confidant George Soros, through the Soros Fund Management LLC, until recently owned millions of dollars of Petrobras stock.
Kristof suggests that one day Spanish-speaking Americans will be part of daily life in the United States and that workmen such as mechanics will be able to communicate easily with Spanish-speaking customers.
He fails to explain why these customers will not be speaking English. After all, the ability to speak, read, and write English remains a requirement for U.S. citizenship.
President Barack Obama gives lip service to increasing border control resources with limited funding and personnel. Many officials, including the governors of Texas and Arizona, are skeptical regarding the Obama administration’s resolve. They resent that the United States is being blamed for the killing fields on both sides of the Mexico-U.S. Border.
For instance, U.S. Secretary of State Hillary Clinton in March 2009, during her first official visit to Mexico, placed the blame for the Mexican drug cartels’ vicious murders on the United States.

The administration, which condones U.S. sanctuary cities and states, has no plans to file charges against them for violations of federal immigration law. Nor does the administration seem concerned about the environmental impact that illegal aliens have on the ecology of the United States.
Many national forests, parks, monuments, wilderness areas, and wildlife refuges — once the pride of the nation — are serving today as marijuana fields for illegal alien gangs.
Former Democratic Speaker of the House Nancy Pelosi reportedly said to a gathering of illegal aliens in California in 2009 that U.S. immigration laws were “un-American,” suggesting that they need not be obeyed. Concerned citizens can only trust that the new speaker of the House, John Boehner, as part of congressional oversight of federal agencies, will demand enforcement of existing immigration laws.
When will President Obama recognize that illegal immigration is slowing economic recovery? Can he resolve the chaos while still appeasing his Hispanic base?
