Obama DHS Delayed Deportation of Illegal Alien Sex Offender to Protect Democrat Senator

The Obama Homeland Security Department (DHS) took its "selective deportation" illegal alien amnesty scheme to a whole new level last November when it delayed deporting an illegal alien sex offender, Luis Abrahan Sanchez Zavaleta, just before the election. Now why would they do that? Because Sanchez worked for a powerful Democrat Senator and they did not want the embarrassing scandal to hit the news and jeopardize the re-election chances of the Senator and/or the president.

The Associated Press has been all over this story:


Federal immigration agents were prepared to arrest an illegal immigrant and registered sex offender days before the November elections but were ordered by Washington to hold off after officials warned of "significant interest" from Congress and news organizations because the suspect was a volunteer intern for Sen. Robert Menendez, according to internal agency documents provided to Congress.
 
(You will recall JW listed Menendez as one of its "Ten Most Wanted" corrupt politicians in Washington, for this scandal and a slew of others, including influence peddling for his staffer and girlfriend and for allegedly patronizing prostitutes.)

This Sanchez story first broke last December, when the AP, citing a source familiar with the situation, published a report indicating that DHS had delayed the deportation of Sanchez for political reasons. When the story hit the press, DHS officials huffed and puffed and dismissed the report as "categorically false."

But this was a lie. And now the AP has the documents to prove it: "U.S. Immigration and Customs Enforcement agents in Newark had arranged to arrest Sanchez at the local prosecutor's office on Oct. 25," the AP reported. "That was fewer than two weeks before the election."


Noting that Sanchez was a volunteer in Menendez's Senate office, ICE officials in New Jersey advised that the arrest "had the possibility of garnering significant congressional and media interest" and were "advised to postpone the arrest" until officials in Washington gave approval. The documents describe a conference call between officials Washington and New Jersey to "determine a way forward, given the potential sensitivities surrounding the case."

And who is this illegal alien criminal hired by Menendez and coddled by the Obama DHS? Sanchez was born in Peru and entered the country with a now-expired visa. In 2009 he was arrested for repeatedly sexually abusing an eight-year-old boy. Sanchez, 15 at the time, received two-year probation and the child molester was forced to register as a "sex offender."

Sanchez then landed a job with Menendez. Unsurprisingly, he also submitted an application to remain in the country under Obama's amnesty program! The Obama administration has repeatedly stated that it would arrest and deport illegal aliens who committed serious crimes. But when the administration found out about an illegal alien child molester, political appointees interfered with the legal process and delayed the arrest of an illegal alien who represented a clear threat to the public safety. 

Ultimately, with President Obama and Robert Menendez's re-elections secured, authorities finally arrested Sanchez on December 6, 2012. He is now scheduled for deportation.

Now, as you will recall, this isn't the first time politics has intervened and stopped the deportation of an illegal alien for political reasons. Remember Obama's illegal alien Aunt Zeituni Onyango? Just days before the 2008 election, the Bush administration's Immigration and Customs Enforcement issued an "unusual directive" that ultimately delayed Onyango's arrest so as to avoid precipitating an embarrassing scandal for then-candidate Obama.

The Menendez/DHS scandal is embarrassing for this administration, but I don't think for a minute it will stop the president from fast-tracking his plans to implement illegal alien amnesty for the 11 million individuals currently residing in the U.S. Fox News reported this week the president and Senate Democrats are planning to pass a slew of illegal immigration reform measures in one massive bill, as opposed to carefully considering the merits of each policy on a case-by-case basis.

The president's reforms, which are built on lies and lawlessness, will be sweeping, they will be aggressive, they will be fast, and they will most certainly lead to more victims of criminals like Sanchez, who should have been imprisoned and/or deported the moment he attacked an eight-year-old boy.

Determined not to be excluded from the post-election bipartisan talk of passing immigration legislation, the Congressional Hispanic Caucus on Wednesday rejected two Republican proposals while outlining its own priorities.

The mostly Democratic group denounced the STEM Jobs Act, delivering a swipe at Republicans on a bill expected to come before the House on Friday as the first test of the GOP's newfound embrace of an immigration overhaul.

The bill would increase the number of visas for foreign-born graduates with advanced degrees in science, technology, engineering and mathematics by eliminating another visa program for people from countries with low rates of immigration to the United States.

Hispanic caucus members criticized the bill because it would end one visa program and allow relatives of legal residents to come to the U.S. while awaiting their visas, but not authorize them to work.

The Hispanic caucus lawmakers support a version written by Democratic Rep. Zoe Lofgren of California that would, among other things, preserve the original visa program.

Hispanic lawmakers also criticized the first Republican bill proposed in the Senate following the elections. The ACHIEVE Act, introduced by Sens. Jon Kyl of Arizona and Kay Bailey Hutchison of Texas, is a pared-down version of the DREAM Act, which would offer legal status to young illegal immigrants who serve in the military or attend college.

"The problem with the ACHIEVE Act is it does not achieve the dream," said Sen. Bob Menendez, D-N.J., at a news conference on Wednesday. Menendez and 20 House members comprise the caucus.

In recent days, Republicans and Democrats in both chambers have begun discussing several immigration bills that could be introduced, potentially competing in the new Congress early next year.

On Wednesday, the Hispanic caucus, for which immigration has long been its signature issue, offered its own nine policy priorities in hopes of shaping negotiations.

It said legislation should require illegal immigrants to register with the federal government, undergo a criminal background check, learn English and pay taxes as conditions for obtaining legal status and eventual citizenship.

Caucus members endorsed conservative priorities such as securing U.S. borders and worker verification, but with carefully worded caveats: "smart and reasonable enforcement" on the borders; and "a workable employment verification system that prevents unlawful employment and rewards employers and employees who play by the rules."

They also called for full workplace rights and safer working conditions for immigrants, and a priority for reuniting legal residents with family members seeking U.S. entry.

"Let me be clear about this — we want to work with Republicans to find common ground, help the American people, and help America's immigrants," said caucus member Rep. Luis Gutierrez, D-Ill. "But common ground is based on common decency and common sense. These principles reflect that common decency."

Many Republicans in the House who have staunchly opposed citizenship for illegal immigrants have remained quiet on the issue in recent weeks. Conservatives and advocates of slowing the flow of immigration believe the caucus's goal of passing an omnibus bill is unlikely in either chamber.

"I don't think comprehensive immigration reform is going to happen, period," says Mark Krikorian, executive director of the Center for Immigration Studies, which advocates a lowering of immigration rates.

Krikorian says Republicans appear most likely to consider supporting a smaller, targeted bill such as the DREAM Act, because many Americans are "sympathetic" to young adults who had no choice in coming here as children.

The sticking point for Republicans, he says, will be their desire to add an enforcement provision to the DREAM Act so that the law wouldn't encourage an increase of more illegal immigrants. He recommends mandatory worker verification as one solution.

"I think at some point amnesty for some people is inevitable ... but we have to have in place the mechanisms to make sure we're not in the same boat years from now," says Krikorian. "That's really the public's problem with this issue."

Obama DREAM Amnesty to Cost At Least $585 Million

 

The Obama Administration's plan to grant deferred action status and work authorization to illegal aliens meeting criteria similar to the DREAM Act could cost over $585 million, internal Department of Homeland Security (DHS) documents reveal.  (Arizona Central, July 24, 2012)

The documents, leaked to the Associated Press last week, provide the first look at the Administration's cost projections for the amnesty program announced June 15. They include estimates that the federal government will need to hire over 1,400 new employees and contractors to process the more than one million anticipated applications. (Id.) In fact, U.S. Citizenship and Immigration Services (USCIS) — the agency that the Inspector General discovered earlier this year was pressuring its employees into rubber-stamping immigration benefits applications despite questions of fraud or ineligibility — estimates the amnesty will result in it processing more than 3,000 applications daily. (Id.; see also FAIR Legislative Update, Jan. 9, 2012 and OIG Report 12-24)

The documents also undermine the Administration's claims that the amnesty will be fee-driven and not cost U.S. taxpayers. While the internal documents show DHS is considering charging illegal aliens $465 per application, the documents also state that depending on how many applicants are granted a waiver or otherwise do not pay, the government could lose between $19 million and $121 million. (Arizona Central, July 24, 2012)Secretary Napolitano told Congress last week that DHS would release its plans for implementing the application process August 1 and that it would begin accepting applications August 15. (See Bloomberg Government Transcript, July 19, 2012; see also FAIR Legislative Update, July 23) The Department was scheduled to hold its second stakeholder conference call on the recently announced deferred action program July 26 (already rescheduled from July 9), but cancelled the call just hours before it was to occur.

“We should not forget that we are a nation of laws and a nation of immigrants,” Napolitano said.

The Obama administration has also cut worksite enforcement efforts by 70%, allowing illegal immigrants to continue working in jobs that rightfully belong to citizens and legal workers.

 


 

Illegal Alien Parents to Benefit from President's DREAM Act Decree


Lost in the media frenzy surrounding President Obama's decision to administratively implement the DREAM Act is the Administration's plans to also grant a reprieve to the illegal alien parents who brought them here in violation of U.S. immigration law. In doing so, the Administration is directly contradicting its own public relations campaign — and that of amnesty advocates nationwide — which has portrayed its new policy as a way to provide "a degree of relief" to "innocent young kids." (See White House transcript, June 15, 2012; to read more about the President's "deferred action" policy, see FAIR's Legislative Update, June 19, 2012)

The Administration's decision to not deport the illegal alien parents of so-called DREAMers was revealed by Homeland Security Secretary Janet Napolitano during a CNN interview. Here is the exchange between CNN Anchorman Wolf Blitzer and Secretary Napolitano:

BLITZER: What about the parents of these children? The children come forward now, they identify themselves. Should the parents be concerned that potentially they could be deported? They would now be identified as illegal immigrants.

NAPOLITANO: No. We are not going to do that. We have internally set it up so that the parents are not referred for immigration enforcement if the young person comes in for deferred action. However, the parents are not qualified for deferred action. This is for the young people who meet the criteria that we've set forth. (CNN transcript, June 15, 2012)

While Napolitano makes the distinction that the illegal alien parents will not qualify for "deferred action," the Administration's decision not to deport them essentially amounts to the same thing. The only major difference is that if the Department of Homeland Security simply administratively closes the parents' cases, it is uncertain whether it will grant the parents work authorization.

As if the President's new deferred action policy were not troubling enough itself, the decision not to deport the illegal alien parents of DREAMers could triple the number of illegal aliens who benefit from it. Excluding parents, the Pew Hispanic Center estimates that at least 1.4 million illegal aliens would qualify for deferred action under the President's new program. (See Pew Hispanic Center report, June 15, 2012) But with the Administration's acknowledgment that it will no longer deport the illegal alien parents of DREAMers, the size of the President's amnesty program could triple, or perhaps even quadruple, when fraudulent applications are taken into account.

"We could cut unemployment in half simply by reclaiming the jobs taken by illegal workers," said Representative Lamar Smith of Texas, co-chairman of the Reclaim American Jobs Caucus. "President Obama is on the wrong side of the American people on immigration. The president should support policies that help citizens and legal immigrants find the jobs they need and deserve rather than fail to enforce immigration laws."
