House Freedom Caucus Praises Texas Judge’s Amnesty Injunction

(CNSNews.com) – A newly-formed group of conservative House Republicans led by Rep. Jim Jordan (R-OH) praised the injunction issued Monday by Texas District Judge Andrew Hanen blocking President Obama’s executive amnesty from going into effect today.
“President Obama said himself 22 times that he could not unilaterally change America’s immigration policy without congressional approval,” according to a press release by the House Freedom Caucus, which has about 40 conservative members.
“Thankfully a judge today stood up for the Constitution and temporarily stopped his unfair and unlawful executive actions.”
Rep. Raul Labrador (R-ID), another member of the caucus and one of 28 Hispanics serving in the House, issued a statement of his own praising the federal judge's injunction and chiding the president for bypassing Congress.
“President Obama has abandoned his fundamental constitutional duty to faithfully execute the laws of the United States and usurped the authority of Congress to make immigration law,” Labrador said. “Judge Hanen’s order is a step toward restoring the proper balance between our three branches of government.
"Stalling the president’s executive action will shield the states from being forced to deal with up to 5 million immigrants seeking government services and benefits,” he continued. "As the judge wrote, 'Once these services are provided, there will be no effective way of putting the toothpaste back in the tube'."
Obama’s executive orders would have forced the U.S. Citizenship and Immigration Services (USCIS) to stop deporting illegal immigrants provided they arrived in the country before the age of 16. It would also have allowed illegal immigrants whose children are U.S. citizens to obtain work authorizations beginning in May.
As of Wednesday, a banner on the USCIS homepage informed visitors: “A federal court has issued a preliminary injunction preventing USCIS from accepting requests for the expansion of DACA [Deferred Action for Childhood Arrivals] on February 18, as originally planned.”
Homeland Security Secretary Jeh Johnson issued his own statement, saying that even though the president’s amnesty program was put on hold by the ruling, he still had discretion regarding enforcement of the nation’s immigration laws.
“The Court’s order [does not] affect this Department’s ability to set and implement enforcement priorities,” the statement read.
“I am also pleased that, due in large part to our investments in and prioritization of border security, apprehensions at the southern border – a large indicator of total attempts to cross the border illegally -- are now at the lowest levels in years," Johnson said.
The House Freedom Caucus also called for congressional action, saying, “It’s time for Senate Democrats to follow the will of the American people and allow debate on the House-passed bill to fund the Department of Homeland Security.”
Funding for the department is set to expire on February 27 if a bill is not passed.
The House passed funding legislation for the department on January 14, but the bill does not allow DHS to use the money to implement the president's executive amnesty. Senate Democrats have blocked a vote on the legislation three times in their chamber, refusing to allow it to proceed unless it contains funding for the amnesty program.
The House Freedom Caucus was formed in January to offer conservative feedback on legislation proposed in Congress. In addition to Jordan and Labrador, it includes Representatives Justin Amash (R-MI), Scott Garrett (R-NJ), John Fleming (R-LA), Matt Salmon (R-AZ), Ron DeSantis (R-FL), Mick Mulvaney (R-SC), and Mark Meadows (R-NC).
