Ethics Group Slams Elizabeth Warren, Kamala Harris for Brett Kavanaugh Fundraising
The Foundation for Accountability and Civic Trust (FACT) has released its list of Worst Ethics Violators of 2018, which includes 2020 presidential hopefuls Sens. Kamala Harris (D-CA) and Elizabeth Warren (D-MA).
Both Harris and Warren used their opposition of Brett Kavanaugh’s appointment to the Supreme Court as an opportunity to fundraise, according to FACT. The two Democratic Senators sent out emails claiming that the donation played a vital role in battling his confirmation. Shortly thereafter, FACT filed an ethics complaint against both senators.
Warren was caught off guard during a televised debate when her opponent mentioned that she was under investigation for an ethics complaint. At the time of the debate, Warren claimed she did not know about the invesitgation into the complaint.
Senators must conduct themselves according to the Senate Ethics rules. Under the Senate Ethics Manual’s Scope of The Authority, the Senate ‘may discipline a Member for any misconduct, including conduct or activity which does not directly relate to official duties, when such conduct unfavorably reflects on the institution as a whole.’ A Senator who solicits campaign contributions related to official action certainly casts an unfavorable reflection on the Senate. In addition, the use of official action for political fundraising is directly related to official duties.
In the complaint, FACT pointed to the following section of Senate Ethics rules:
Senate Ethics Rules prohibit Senators from solicitating campaign contributions based upon any action taken in their official capacity. By linking a promise of official action with campaign contributions, a Senator violates a ‘basic principle’ of Senate Ethics that guards against conflicts of interest. The Senate Ethics Manual is clear that a Senator “should never use the prestige or influence of a position in the Senate for personal gain. This provision was intended ‘as a broad prohibition against members, officers or employees deriving financial benefit, directly or indirectly, from the use of their official position.’” Moreover, Senators are to act based upon merit, not on partisan affiliation or for campaign contributions.
Several notable Republicans and Democrats made the list. House Speaker Paul Ryan (R-WI) and Senate Majority Leader Mitch McConnell (R-KY) sat at the top of the list for “failing to adequately protect congressional staff from sexual and other forms of harassment.”

It's that time of year again. Not just Santa, but for the press, lists, lots of lists, including a clickable one on a think-tank's assessment of who the most corrupt members of Congress were this year.
A conservative-leaning watchdog group says House Speaker Paul Ryan and Senate Majority Leader Mitch McConnell are the biggest congressional scofflaws of 2018, for their anemic handling of the settlement slush fund that used an unlimited pot of taxpayer money to pay off congressional staff in exchange for signing legal papers barring them from taking public their claims of sexual harassment and other mistreatment by their congressional employers.
Yes, agree, that was bad, and why the heck were they protecting the largely Democrats who engaged in this despicable behavior? The only reason why that doesn't quite resonate with a lot of us is because there were so many things guys like Ryan and McConnell did not do – such as get rid of Obamacare, scrap DACA, and build the wall, for starters. Ryan's out of a job for it, and McConnell's only saving grace has been his stellar performance in rebalancing the court system to reflect the values of the American people. In other words, he got conservative judges through – important, given that the judicial system would otherwise be a liberal monolith tag-teaming with lefty activists. Good riddance to Ryan.
What does resonate is the kind and quality of corruption that was on display in Congress this year from the list that followed from the think-tank that created the list, known as FACT. Here are the names:
Former Rep. Elizabeth Esty of Connecticut. Democrat, of course. Covered up for a sexually abusive staffer and then gave him a golden parachute. One hand washes the other, right?
Senators Elizabeth Warren and Kamala Harris, who illegally tried to rake in buku bucks as a direct result of their Senate activities harassing blameless Supreme Court nominee Brett Kavanaugh. Never let a crisis go to waste, right?
Harris can get an honorable mention note from me for not owning up to the fact that one of her closest aides was a pervert who forced a $400,000 sex harassment payoff to another staffer.
Then there's former congressional candidate Russell Taub, who operated a fake PAC, raised $1.5 million for it, and didn't ship the money where he said he would ship it: to GOP candidates. Not exactly a Republican, it seems, but OK, here's the one Republican famous for stiffing his fellow Republicans. Quite a guy.
Next up, Sen. Bill Nelson of Florida, who said the Russkis were tampering with voting machines. FACT says he either lied about that or else was disclosing classified information for his own political benefit. Creepy if true.
Then there's this one, who stands out: Rep. Yvette Clarke of New York. A huge part of her office budget went missing in a theft scheme involving her chief of staff and I.T. aide, Abid Awan. You know, that guy who got named in the scandal (but not charged) after the Democratic Party's emails
were hacked. One of his cohorts, also named Awan – what a coincidence – skipped the country. Clarke's chief of staff, whose last name also is Clarke (nepotism?), signed off on fake invoices and then went to the House inventory to erase items signed off for to suggest that they never existed. Clarke is one of the Congressional Black Caucus members who holds a committee seat that Alexandria Ocasio-Cortez seems to be hankering for. Such a lovely bunch we shall see come January.
What is most noteworthy about this list? The high presence of Democrats and the culture of impunity that allows them to go unpunished over and over. There it is, on display, and we haven't even heard any reports yet about the ones who "suddenly" found themselves millionaires on their congressional salaries after insider stock trading and other machinations described by Peter Schweizer in his superb book, Throw Them All Out.
Seriously, it's five of the six on the list, while the GOP leadership and the ex-candidate have corruption of other categories. These people are cover-up artists, pocket-liners, and political opportunists.
Is there any reason to expect these types of scandals to diminish now that the Democrats are taking power?

Is it a signal that she's
back in the game because she's selling her president-ability to the world's
global billionaire crowd and laying the groundwork for more

why she lost the 2016 election.

Judge Sullivan to Michael Flynn: ‘Arguably, You Sold Your Country Out’
Former National Security Advisor Michael Flynn refused to withdraw his guilty plea in a pre-sentencing hearing in a federal district court in Washington, DC, on Tuesday, despite the appearance that the FBI had entrapped him.
Judge Emmet G. Sullivan offered his view of the issues raised by Flynn’s defense team in their request for a light sentence, including the possibility of entrapment, the fact that the deputy director of the FBI had advised Flynn not to have counsel present when he was interviewed by the FBI, and that the agents who interviewed him later said that he did not appear to have lied.
Sullivan said: “I cannot recall any incident in which the court has accepted a plea of guilty from someone who maintained he was not guilty and I don’t intend to start today.”
Judge Sullivan said he had some "concerns" based on Flynn's pre-sentencing filing. ”I cannot recall any incident in which the court has accepted a plea of guilty from someone who maintained he was not guilty and I don’t intend to start today.”
According to reporter Ryan J. Reilly of HuffPost, Judge Sullivan asked Flynn whether he wished to challenge the unusual circumstances under which he was questioned by the FBI, or whether he wished to postpone sentencing, or to confer with his lawyers. Flynn declined and reiterated that he was guilty of the charge of lying to the FBI.
He said that he had been aware lying to the FBI was a crime — though he had not been advised as such by the agents. Flynn’s lawyer also denied that his client had been “entrapped by the FBI” when questioned by the judge.
Judge Sullivan, question Flynn lawyer: How is raising those contentions about the circumstances under which Mr. Flynn lied consistent with acceptance of responsibility?
Judge Sullivan noted, according to ABC News, that lying to the FBI — especially in the White House — was a “serious offense” and that Flynn had “sold out” the country. He even asked prosecutors whether Flynn should have been charged with treason.

Some observers had expected the judge to throw out the conviction, given the issues raised by Flynn’s defense team. But he may have wished to avoid prosecution on other charges, including the crime of failing to file as a foreign agent for Turkey, for which two of his business partners were indicted on Monday.
The prosecution noted those indictments and told the judge that Flynn would have been charged as well, had he not cooperated. The prosecution also noted that it was a possibility that Flynn would continue to cooperate with the Special Counsel.
Judge Sullivan said he would consider jail time, though prosecutors had asked him not to impose a jail term.
The court recessed for the morning without a sentence being handed down to Flynn.
