With respect to American immigration are these words no longer relevant? Has the current invasion of illegal immigration relegated Emma's words to that of empty slogan? Is the idea that America wants and needs a replenishing supply of immigrants to refresh the American ideal of freedom no longer valid.? Don't we need the immigrant to remind us how very special America is, so that we may not take her for granted?



I believe we do need the immigrant..but he must be of the same heart and soul of those who came before; he must truly believe that America is the land of opportunity and only asks that he be given a chance to work hard and succeed. Sadly, in the wake of massive illegal immigration, we must now ask how to best achieve that vital influx of new Americans.



Far too many of our neighbors to the south see America as a haven for receiving social welfare, free medical care, free public education and a means to pursue tax-free working salaries. That is true for the "best" of the illegal immigrant. The "worst" are those who head north with bales of pot, truck beds teeming with meth and cocaine and heroin and integrate with big city latino gangs to market their destructive wares.



Contrast that Mexican immigrant profile with those immigrants of fifty years ago. I grew up in the rich agricultural region of the San Joaquin Valley of California. I worked along side Mexican families in the grape and peach fields. The Mexican visitors from that time worked hard for what they earned. At the end of the summer they were content to return to their homes in Mexico and live on their earnings over the winter.



Then President Johnson began a series of legislation called "The Great Society". This legislation created generous welfare programs which the CBO approximates reflect several trillion dollars in government giveaways. Free public housing, free medical care, free food stamps, nutritional aid programs for infants, preferential quota for employment hiring and education grants, all on the public dime. Many of these programs are worthwhile and served a valuable purpose. But the unintended consequences of these programs was to create a "victim" mentality for at least three generations of us. Imagine, three generations of folks who believe it is not necessary to work, or be productive, to draw a check.



Unfortunately, many of these programs were not well administered and these costly benefits were dispensed to millions who were not eligible to receive them. Enter the illegal immigrant, lured by a national plethora of government freebies under programs poorly monitored.



Even by conservative estimates at least 50,000,000 illegals have entered the U.S. over the last three decades. Millions have created false or stolen ID and signed up for the free goodies! Aided by a misguided Supreme Court that mandated no state may deny free education to illegal children, hundreds of billions of federal and state money is expended each year to build thousands of new schools to house the millions of illegal children. Illegal parents, occupied with gaming the emergency rooms, food banks and welfare offices, show little interest in learning English or even seeing that their children do. The benefits got even more "choice" when the U.S. Supreme court ruled that no illegal can be turned away from a hospital emergency room so the ER has now become the "routine care" clinic for illegal families. Facing bankruptcy, many hospitals have closed their emergency rooms completely as a consequence.



Now, the Democrats and some 20,000,000 new illegals currently residing here are demanding "immigration reform" which is the tired old term for "amnesty". How many of you remember how the last "amnesty" went? We legalized millions of illegals and the federal government vowed "no mas", no more and would seal the border. The problem is now compounded by a bastardized interpretation of the 14th amendment which was meant to provide full citizenship to former slaves but is now used as justification for the legalization of any child born in the U.S., whether the parents are legal or not. How's that been working out? And how can we hope to get a handle on spiraling social spending costs when illegals can carry a copy of a U.S. birth certificate to any social welfare agency and apply and receive all applicable welfare programs based on that bogus birth certificate?



Perhaps, the worst consequence of the illegal invasion has been the failure of the illegal immigrant to assimilate to our core national beliefs, to develop a deep love of country, or even to learn our language. Again aided by the liberal courts, the U.S. mandated that ballots and official government documents be printed in the illegal's native language.



The key difference between the "Emma Lazarus" immigrant on Lady Liberty and the "immigrant" of today is that they choose to invade rather than ask permission to enter. The character of this affront is that they hold neither respect, admiration or love for a nation with a proud heritage of lifting up the downtrodden and protecting those who can't protect themselves. They vilify the notion that hard work and fair and open opportunities are to be honored.

Obama’s 2012 budget deepens attack on public education

The proposed fiscal year 2012 federal education budget is an escalation of the Obama administration’s war on public education and teachers. The White House is expanding its policy of forcing states to compete for desperately needed funds, insisting that they remove caps on charter schools and attack the living standards and workplace rights of school employees in the name of “cost-effectiveness.”

The overall proposed education budget for FY 2012 is $77.4 billion, including what the White House is celebrating as a “significant increase for K-12 education” and “tough choices,” or rather cuts, “to put the Pell Grant program on a sustainable fiscal path.” The woefully inadequate increase will be distributed through competitive grants and, as the budget proposal states, to fund collaboration with for-profit businesses.

Highlights of the proposed budget include:

• $26.8 billion to the Elementary and Secondary Education Act (ESEA), which will direct funds to “reform-oriented competitive initiatives,” consolidate dozens of programs, and cut programs that do not “demand results.” This includes $372 million for charter schools, and $300 million for the Investing in Innovation (i3) program, which rewards partnerships with the private sector.

In other words, the federal government is escalating its program of looting the public treasury to give money to powerful business and “philanthropic” interests that run charter schools. The proposal also continues the unfair use of standardized test scores to determine whether schools are deserving of federal funding.

• Foster “productivity by encouraging states and districts to enact education reforms that are more cost-effective.”

The terms “productivity” and “cost-effective” are code words for the intensified exploitation of teachers and other school employees. States and districts that enforce mass layoffs of school personnel will be rewarded with funding for these cost-saving measures. Employees who are not laid off will be forced to do more with less, take on work once performed by their colleagues, and cope with larger class sizes.

Cost effectiveness is also achieved through school consolidations; districts desperate to save money close schools and move displaced students into buildings that are already filled to capacity. In cities across the country, teachers work in dangerously overcrowded classrooms, leading not only to impossible teaching conditions, but also an unsafe and unhealthy environment.

• $2.5 billion investment in an overhauled teacher-quality formula grant and $500 million in the Teacher and Leader Innovation Fund. The latter is intended for districts “willing to implement bold approaches to improving the effectiveness of the education workforce in high-need schools by creating the conditions needed to identify, reward, retain, and advance effective teachers, principals, and school leadership teams.”

This program encourages schools to hire newer, less expensive teachers, driving better paid, more experienced teachers with seniority rights out of the classroom on the basis of false claims that they are “burnouts.” The inclusion of the concept of rewarding “effective” teachers is just another way of promoting merit pay for teachers whose students score well on standardized tests.

• $600 million for School Improvement, or Turnaround, Grants (SIG) “to support the Administration’s commitment to helping states and districts turn around our nation’s lowest performing schools.” This represents a $54 million dollar increase from 2010 levels.

Turnaround grants are a ruthless means to punish schools in the nation’s poorest districts for failing to get students to score well on standardized tests. Schools that fall into this category are forced to choose a “turnaround model”: fire the principal and half the teaching staff, convert the school to a charter, or simply close. Only after implementing one of the first two options is the school provided with desperately needed funds to hire staff and purchase resources.

• $90 million for a “new Advanced Research Projects Agency-Education (ARPA-ED)…that would promote dramatic breakthroughs in educational technology,” such as adaptive online tutors.

This will further the government’s agenda of promoting “cost-effectiveness” through the creation of software that will replace expensive human teachers with online education. It will also be another boondoggle for private businesses.

• The Early Learning Challenge Fund, proposed in 2009, will be rolled into Race to the Top (RTTT) in the amount of $350 million in competitive grants in 2012. Eligibility requires that states be “ready to take dramatic steps to improve the quality of their early childhood programs,” including the development of uniform standards, a quality rating system, and a system of program review, monitoring, and improvement.

Just as in K-12, ECE educators will be forced to “teach to the test,” and program quality will be based on faulty test scores. Programs deemed failing under the flawed constraints of the system will be “reformed.”

• $150 million for Promise Neighborhoods, an initiative that claims to support community and family services, and “rigorous comprehensive reforms to improve the educational and life outcomes for children and youth in high need communities.” Promise Neighborhoods was inspired by Geoffrey Canada’s Harlem Children’s Zone project, touted in the pseudo-documentary, Waiting for Superman. Nearly all Promise Neighborhoods fund charter school start-ups.

Officials from other capitalist regimes, who have come to tour Promise Neighborhoods, are exuberant over this funding model for poor communities. The far-right government of Hungary, for example, plans to replicate this model in oppressed and discriminated Roma communities, in an effort to starve their public schools of funds.

Obama’s 2012 budget claims to help “students with disabilities achieve their full potential.” One important aspect of this is a new $30 million pilot program—PROMISE—that will “develop and evaluate innovative approaches to improving outcomes of children receiving Supplemental Security Income [SSI] and their families.”

The program will divert public money from social services agencies to private companies that provide cheaper services. The claim that services provided by for-profit companies will lead to better chances for the disabled to live independently is absurd.

Pay for Success is modeled after the UK’s pilot program, Social Impact Bonds, which the British government describes as a means of attracting “private sector investment for interventions that will achieve better outcomes and lower government costs.” The goal of both the US and UK versions is to funnel public tax dollars into the hands of private profiteers, while simultaneously creating the rationale for stripping countless disabled people of SSI benefits.

The Obama budget will also drastically alter financing for public higher education, including extending competitive funding, imposing rules changes for teacher education programs that will result in the shutting down of countless education colleges, and enacting major cuts to the Pell Grant program, which provides poor and working class students with financial aid to attend college.

Both major political parties are exploiting the crisis in public education, which has been deliberately created through decades of financial starvation and punitive policies, in order to privatize America’s school system. In so doing, they reward their campaign contributors in the private sector with opportunities to make massive profits by giving them access to public educational funds that were previously outside of their reach.

For decades, Republican administrations have sought to enact draconian reforms in public education, but their policies were met with mass public resistance. Now, the Obama administration and the Democratic Party, with the collusion of the trade union apparatus in the American Federation of Teachers and the National Education Association, are successfully enacting these and even more right-wing policies.

Obama DOE: America’s Progress Depends On Latinos

America’s progress is “impossible” if Hispanics keep lagging in education because their success is of “immediate and long term importance” to the U.S. economy, according to a new Obama Administration report that vows to enhance opportunities for the “Latino community.”

Published this week by the Department of Education, the enlightening document (Winning the Future; Improving Education for the Latino Community) says that the success of Hispanics in education and in the labor market is crucial to the nation’s economy. The information comes as the president launches a full-throttle campaign pandering to immigrants and their liberal advocates. It was also conveniently released to coincide with Obama’s junior college commencement speech today in Miami Florida, which has an immense Hispanic population that includes many illegal immigrants.

Tragically, Hispanics have the lowest education attainment level of any group in the country, which means that the nation’s economy is at stake if you believe the Obama Administration’s argument. That’s because Hispanics face “persistent obstacles to educational attainment.” Those include low enrollment in early learning programs, dismal high school graduation rates and the fact that few Hispanics complete graduate or professional degree programs.

This is unacceptable since Latinos (the report uses Hispanics and Latinos interchangeably) are by far the largest minority group in the American public education system, according to the DOE. More than 12.4 million Hispanics are enrolled in U.S. elementary, middle and highs schools, which accounts for about 22% of all students in the taxpayer-funded system.

“Hispanic students have graduated at lower rates than the rest of the population for years, making America’s progress impossible if they continue to lag behind,” according to Juan Sepulveda, the community activist Obama appointed to run the White House Initiative on Educational Excellence for Hispanics. “Strengthening and improving educational excellence in this community isn’t just a Hispanic problem,” he added. “It’s a challenge to the entire country.”

Sepulveda, who claims that Latino education attainment is important in the global contest for jobs and industries, was rewarded with his cushy DOE job after serving as chair of Obama’s presidential campaign in Texas. Truth is that the DOE, created by Jimmy Carter, is largely viewed as an unnecessary federal agency that interferes with public education, which is supposed to be run by states.

Before joining the Obama Administration Sepulveda ran a well-funded Texas nonprofit that works to reduce “cultural tensions” by doing things like creating a “bi-national community” in the San Diego/Tijuana border area. Part of his education initiative includes developing the next generation of Latino teachers with “minority-serving institutions.”

"As you listen to the news about the student protests over illegal immigration, there are some things that you should be aware of: I am in charge of the English-as-a-second-language department at a large southern California high school which is designated a Title 1 school, meaning that its students average lower socioeconomic and income levels. Most of the schools you are hearing about, South Gate High, Bell Gardens, Huntington Park, etc., where these students are protesting, are also Title 1 schools. Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll -- but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK) I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK) I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK) I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears. Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.



Never underestimate Mexico’s or the Mexican’s contempt not only for our borders but for our laws.

The sad thing about the American people having to pay so much for the education of the illegals, is that this generous “gift” does not impact the racist attitudes of the Mexicans, or the notion instilled in them by their own government of entitlement. And then you have the Mexican contempt for English, and literacy.

Mexican Kids Cross Border Daily For Free U.S. Education

The superintendent of a Texas public school district has deployed staff members to a nearby border crossing to intercept hundreds of Mexican children who enter the U.S. daily to receive a free public education at one of his schools.

For years, Mexican children from nearby Ciudad Acuna have crossed a bridge north to attend public schools in Del Rio Texas as administrators and immigration officials looked the other way. Meanwhile U.S. taxpayers pick up the nearly $3 million annual tab to educate the Mexican kids whose parents have no regard for the nation’s laws.

Finally, the new superintendent of the depleted district (Del Rio Consolidated Independent School District) is working to end the costly practice. He has sent district employees to monitor the border crossing that connects Del Rio with Mexico and inform Mexican parents that essentially the gravy train has come to an abrupt halt.

The district has an enrollment of 10,232 students in 12 schools and more than 500 are believed to live south of the border. They used fake U.S. addresses to enroll illegally, according to district officials, and some walk over the border bridge while others simply have their parents drive them in vehicles with Mexican license plates.

“I’ve seen van loads of kids with plates from Coahuila State (Mexico) pulling in front of the school,” Del Rio Superintendent Kelt Cooper told a major news organization. “Everyone knows what is going on. It’s real blatant.

Cooper decided to take action because immigration authorities recently submitted a report to the district revealing that about 540 school-age children cross the bridge every morning. Cooper dealt with a similar situation as the superintendant in the border town of Nogales Arizona where he once caught dozens of students who used the same vacant lot as a home address.

So far nearly 200 Del Rio students have been informed that they must prove residency to stay in school. In most cases parents were handed letters at the crossing bridge warning that their children will be expelled from school unless they immediately provide proof that they live in the United States.

There are an estimated 1.5 million school-aged illegal immigrants in the United States and the government spends an estimated $12 billion annually to educate them. The biggest chunks are spent by California ($7.7 billion) and Texas ($3.9 billion), where the situation has become a public education crisis with no end in sight. The Lone Star State’s public schools have seen a huge increase in illegal immigrant Hispanic students with dismal Mexican and Central American education histories that are contributing to an overall lowering of academic standards across the board.

ON EDUCATING THE ILLEGALS: Ever wonder why Mexico doesn’t educate their own people?

Worse public schools. America’s public schools already suffer under severe budget constraints, causing large class sizes, textbook shortages, and leaky ceilings. Yet, US law requires that all illegals receive free public education K-12. The Federation for American Immigration Reform estimates that this costs $7.4 billion dollars each year.



The birthrate among illegals is more than double that of legal US residents. The Pew Hispanic Center calculates that within seven years, the children of immigrants, legal and illegal, will account for one in nine school-age children in the US. The Urban Institute estimates that already, 15% of all school children in California are illegals, many of whom speak little English. These students are usually mainstreamed in classes with native English speakers. This means that teachers must slow down instruction, denying native English speakers their right to an appropriate-level education.



The challenge is even greater because not all those students’ native language is Spanish: For example, in my nearest major school district, San Francisco, it would not be unusual to find a class that had native speakers of Chinese, Russian, Tagalog, Spanish, and English. Imagine the challenge of trying to educate them all. If your child were in that class, would you be confident that he or she would receive a quality education?



Immigrant children pose less obvious challenges to the schools. Barbara Nemko, the Napa County Superintendent of Schools, points out examples: “Unless she speaks Spanish, we have a hard time justifying hiring an even an excellent teacher… So much of our staff development

time must now be allocated to dealing with the needs of ‘English Language Learners.’ Our immigrant kids also come to school with serious health problems that we must address. For example, dentists now visit our high-immigrant schools providing dental services at no

cost to the student.”

MALDEF and La Raza also pushed through legislation that allows, in 19 states, illegal immigrants to not only attend any public university in those states, but to pay in-state tuition, while legal residents of neighboring states must pay the out-of-state rate which is three to eight times more. It’s quite an injustice, for example, that a legal resident can be denied admission to taxpayer-supported Berkeley and must attend community college so an illegal foreign national can attend Berkeley—at in-state rates! And often, because of reverse discrimination admission

policies, the illegal is admitted with B grades while the rejected legal resident may have Agrades.

Secret DOJ Group Monitors Immigration Control Laws

The Obama Justice Department has created a secret group within the bloated civil rights division to monitor laws passed by states and local municipalities to control illegal immigration.

Because the measures are viewed as discriminatory and anti-immigrant by the administration, the Justice Department is spending valuable taxpayer dollars to track them and legally challenge them as it did in Arizona. The mission is being carried out by an undercover “National Origin Working Group” set up by Assistant Attorney General Thomas Perez, a renowned illegal immigrant advocate who once ran a taxpayer-funded day laborer center in Maryland.

This week the “National Origin Working Group” will hold a special training session at the agency’s Washington D.C. headquarters. Perez, who lied under oath to cover up the Black Panther voter intimidation scandal, will headline the workshop to discuss the division’s “monitoring of anti-immigrant laws,” according to inside information obtained by a Justice Department whistleblower. Laws prohibiting national origin discrimination will also be addressed at the powwow and so will discrimination against Muslims in the ever-so-hostile, post 9/11 era.

The most “transparent” administration in history doesn’t want the public to know about this special taskforce so Americans must depend on leaked information. In this case, a special thanks to J. Christian Adams, a former Justice Department lawyer who worked on the Black Panther case and denounced the “corrupt nature of the dismissal” by Obama political appointees. Adams has exposed the administration’s racial double standard in which DOJ attorneys are instructed to ignore cases that involve black defendants and white victims.

A career DOJ attorney, Adams resigned over the administration’s handling of the voter intimidation case against members of the radical black revolutionary group known as the New Black Panther Party. Clad in military fatigues and armed with batons, Black Panther thugs were captured on video bullying voters in Philadelphia during the 2008 presidential election. Career government attorneys determined that they should be prosecuted, but were ordered to drop the complaint by Obama political appointees.

Those same officials are masterminding this campaign against measures to curb illegal immigration. Adams points out that no law empowers the federal government to monitor this imaginary, anti-immigrant legislative movement. That’s why the administration is doing it “behind closed doors, in secret, where nobody is paying attention.”

Judicial Watch Forces New Jersey School to Abandon Discounted Tuition for Illegal Aliens

In a dramatic and clear-cut victory for the rule of law, Judicial Watch forced the County College of Morris (CCM) in New Jersey to reverse an unlawful policy which allowed illegal aliens discounted tuition at the school! As expected, the decision came down last Thursday. The headline of a New Jersey Daily Record article the following day tells the whole story: “Lawsuit Worries Prompted Reversal on College Tuition for Illegal Immigrants.”

As reported by the Daily Record:

One County College of Morris trustee mentioned the prospect of being sued and paying hundreds of thousands of dollars in legal bills. Others said legal considerations played a part in their deliberations over tuition rates for illegal immigrants.

In the weeks leading up to their vote…CCM's trustees had received letters from freeholders and a national conservative group called Judicial Watch saying they were violating federal laws. Concerns about those laws, and the possibility of lawsuits, seemed to spur a 9-2 vote to charge higher, out-of-state rates to undocumented students even if they live in the county.

Indeed, as I mentioned a couple of weeks ago, Judicial Watch sent a letter to the Chairman of the Board of Trustees for CCM challenging the school’s policy of providing discounted tuition for “undocumented” aliens. CCM immediately informed Judicial Watch that it had commenced a review of its tuition policy. And one week later, the school’s trustees voted to overturn a policy they had established just two months prior.

The chair of the Board of Trustees suggested Judicial Watch had “bullied” the poor Board into reversing itself. My colleague, attorney Paul Orfanedes, answered this charge directly in the media:

‘If you think encouraging people to follow the law is bullying, then we are bullying,’ he said after being told Johnson had used the term ‘bullying’ to describe some of the reaction to CCM's February policy change.

As you can see, sometimes even the threat of a lawsuit can work wonders! This is a tremendous victory for Judicial Watch and its supporters. And we are thrilled CCM’s Board of Trustees made the right decision to bring its tuition policy in line with federal law, even if some trustees may have been reluctant (to say the least).

You may recall Judicial Watch was tipped off to CCM’s illegal policy by the February 18, 2011, edition of The New Jersey Star-Ledger:

For the first time in nearly a decade, illegal immigrants will be allowed to take classes at the County College of Morris in a policy change that is drawing praise from some education officials and sharp criticism from immigration policy activists.

The trustees at the Randolph-based college voted 7-1 earlier this week to reverse a rule barring undocumented students, school officials said. Starting this summer, the public two-year college will be one of the first schools in New Jersey to openly acknowledge it is enrolling illegal immigrants and allowing them to pay the same tuition rate as other county residents.

(Prior to the policy change CCM had barred illegal aliens from admission to the school, so this was quite a switch.)

The article piqued the interest of JW’s lawyers and investigators, who obtained a copy of the CCM admissions policy. And sure enough, it clearly stated that any illegal alien who graduated from an American high school (or possesses a GED equivalent), was under the age of 35, and had lived in the U.S. for five consecutive years, would be eligible for admission. And the policy further stipulated that illegal alien students could pay a discounted in-county tuition rate!

As Judicial Watch noted in its letter, illegal aliens are ineligible for state and local public benefits, such as discounted tuition, under federal law:

There is no way to reconcile CCM’s policy with federal law. The policy provides a public benefit to individuals who are clearly ineligible for benefits [under federal law], and New Jersey has not authorized the provision of such benefits…CCM may not ignore federal laws when those laws are not consistent with its own policy preferences. We hope that CCM will reevaluate its new policy and conform it to the requirements of federal law.

And that’s exactly what happened.

This is not our first attempt to stop institutions of higher education from giving preferential treatment to illegal aliens.

One County College of Morris trustee mentioned the prospect of being sued and paying hundreds of thousands of dollars in legal bills. Others said legal considerations played a part in their deliberations over tuition rates for illegal immigrants.

In the weeks leading up to their vote on Wednesday night, CCM's trustees had received letters from freeholders and a national conservative group called Judicial Watch saying they were violating federal laws. Concerns about those laws, and the possibility of lawsuits, seemed to spur a 9-2 vote to charge higher, out-of-state rates to undocumented students even if they live in the county.

The vote came at the end of a meeting in front of more than 200 people that lasted almost four hours and included emotional testimony from dozens of people on both sides of the issue.

After the vote, some undocumented students who said they could not afford out of state tuition rates had tears in their eyes. The vote reversed part of a policy that the same board approved, 7-1, just two months ago.

"I'm not in favor of defending in court a vote of ours that might cost tens of thousands or hundreds of thousands of dollars in legal fees," trustee Alan Gordon said during the meeting.

Elaine Johnson, chairwoman of the trustees, voted with the minority and said she believed the trustees had been bullied, although she did not specify who was doing the bullying. She said the February vote to charge in-county tuition to undocumented students, many of whom have lived in the U.S. most of their lives, seemed simple at the time.

"Then the bigotry, hatred, threats and lies came," she said. "I realize bullying is so wrong. . . . There is no law that currently exists that makes the act we took (in February) illegal."

The CCM trustees voted on Feb. 26 to allow some undocumented students into the school — as long as they lived in the U.S. at least five years and were here before they were 16. They had been barred following the 9/11 terrorist attacks. The trustees also voted to charge in-county tuition to students who live in Morris County.

That gave CCM a written policy similar to what many other county colleges are doing across the state without writing it down. A recent New Jersey Press Media survey found most county colleges, without adopting policies, check only whether students reside in their counties and not whether they are documented.

Morris County freeholders, saying they didn't want to support tuition breaks for illegal immigrants with taxpayer money, asked the CCM trustees to reconsider the lower tuition rates.

"I was pleased with the (Wednesday night) vote, and I also was pleased with the process," said Margaret Nordstom, a freeholder liaison to CCM.

Edward Yaw, president of CCM, said college attorneys in recent weeks had taken a closer look at relevant laws and court cases related to them, and that "the legal aspect" had been a driving factor for many of the trustees' apparent change of heart. Yaw had been in favor of the February policy but didn't take a position on Wednesday's amendment, other than to say it allows undocumented students to get an education. He did say laws related to tuition breaks for undocumented students are ambiguous.

"I still believe there's no law that prohibits the actions (that the board) previously took," Yaw said. "We felt all along the potential was there to be sued by one side or the other."

About one week before the vote, Judicial Watch sent a letter to Johnson saying CCM's policy adopted in February violated a 1996 federal law barring illegal immigrants from receiving "local public benefits" unless they are provided by state law. Judicial Watch has sued a Maryland school over in-county rates for undocumented students.

Paul Orfanedes, director of litigation for Judicial Watch, said his group is considering whether to continue the lawsuit now that Maryland has passed a law that, once signed, would make it the 11th state to offer in-state tuition to undocumented students. He said the letter to CCM was meant to clarify the law.

Alina Das, a professor with the New York University Law School Immigrant Rights Clinic, said the federal law does not "specifically prohibit" lower tuition rates. The NYU clinic has been giving legal direction to Wind of the Spirit, a local immigrant rights group.

Yaw said CCM might revisit the issue if additional court cases clarify related federal laws.

A related federal statute prohibits providing postsecondary benefits to illegal immigrants based on state residency if the same benefit isn’t available to legal residents. County freeholders have argued that means CCM would have been required to charge in-county rates to students from other states.

However, the California State Supreme Court recently ruled that the federal law didn’t preempt a state law allowing in-state tuition for undocumented students who graduate from California high schools. Judges said in their ruling that the state law is based on where students go to school and not on “residence,” as specified in the federal law. The case is being appealed to the U.S. Supreme Court.

CCM’s admissions policy allows admitting undocumented students only if they have graduated from New Jersey high schools. Yaw said a U.S. Supreme Court ruling in the California case might offer some guidance and be “a trigger” for additional discussions about offering in-county rates for some illegal immigrants who live in the county.

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.

Politics: If there's one agency that's been made useless by its leaders, it's Immigration and Customs Enforcement. If, under a new policy, being here illegally is no longer reason enough for deportation, why does it still exist?

The Obama administration has effectively declared open borders to millions of would-be illegal immigrants — not through legislation, but with a sneaky policy move.

On Aug. 20, its man at ICE, John Morton, wrote a memo stating that being in the U.S. illegally is no longer sufficient reason to send someone home. An illegal immigrant now has to be a security threat or else commit a crime — and a violent one at that. To everyone else, ICE turns the blind eye.

Director Morton says it's a matter of priorities. But make no mistake: This is amnesty by another name.

Adding insult to injury, ICE will empty its costly, just-built detention centers of 17,000 existing deportation cases as long as an illegal can show that he or she has applied to become legal.

This, says the New York Times, will "pare huge case backlogs." And to ICE bureaucrats, it's proof they're doing their jobs.

In fact, it's an astonishing abrogation of duty. The policy turns ICE into a $6 billion border-jitney service for the subset of illegals who were picked up by other law enforcement agencies, convicted of violent crime and have served their time, and whose jailers didn't forget to put them on an "immigration hold" list.

Any others can make themselves at home.

That goes for the Mexican Zeta cartel members who are busy recruiting assassins in barrooms around Phoenix, as Fox News reported Friday.

Nothing violent about recruiting, you know — and that goes for illegal immigrants who've illegally voted in U.S. elections.

In the latter case, Fox reported that ICE itself helpfully sent a form letter to an illegal who admitted doing that, coaching him to take his name off the voter rolls first so his application could go through smoothly. ICE didn't mind that the man had admitted to committing a felony. The bureaucrats just wanted to issue him his U.S. citizenship so they could clear the backlog.

It also goes for the Mexican cartel members who may be buying off city governments like that of Cudahy, Calif., which is under FBI investigation. It also goes for illegal immigrants who invade rural properties at night in Arizona, terrifying ranchers.

Not surprisingly, there's no one angrier about this mission-nullification than ICE agents themselves. Last June their union issued a letter expressing a membership consensus of "no confidence" in Morton and Assistant Director Phyllis Coven.

They have "abandoned the agency's core mission of enforcing United States immigration laws and providing for public safety, and have instead directed their attention to campaigning for programs and policies related to amnesty," the agents declared.

By extension, no one's happier than the Mexican cartels that have muscled into the immigrant-smuggling business, making about a third of their income from fees charged for such assistance.

Morgan's no-deport policy is just the enticement they need to bring in new business that will fatten up the fee income they use to make war on the Mexican state.

Last Monday's discovery of a massacre of 72 would-be illegals in Tamaulipas, Mexico, on their way to Los Angeles makes clear what lies ahead. Human smuggling is an evil ICE should not encourage.

The cartels are monopolies that make $500,000 or so per human "load" into the U.S., but they also press many illegals into becoming foot soldiers. Some are forced into sex slavery, and others — as the sole survivor of the Tamaulipas massacre claimed — are ordered to become cartel assassins in the U.S. — or else.

The fact that the U.S. no longer enforces immigration laws for anyone except those with violent criminal or terrorist convictions will draw would-be immigrants into this racket like a magnet.

At a time when U.S. diplomats' families have been ordered to evacuate the consulate in Mexico's second-biggest city, Monterrey — as happened Friday — any encouragement of illegal immigration works at cross purposes to the real national security mission of defeating cartels.

ICE leaders talk smugly about "priorities," but they've effectively abandoned their agency's core law-enforcement mission and become servants of the immigration lobby. ICE should be allowed to do the job it's tasked with. Failing that, it should be disbanded.

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves – but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Labor Dept. Helps Illegal Alien Workers

The Department of Labor has launched a special program to assist and protect illegal immigrant workers in the U.S., referred to as “vulnerable” and “underpaid” by the presidential cabinet member who heads the agency.

Hundreds of new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees. Their message, in Spanish, is “we can help” bring workplace protections to the nation’s most vulnerable and underpaid workers, including those who have no legal right to live in the United States.

Labor Secretary Hilda Solis, a former California congresswoman with close ties to the influential La Raza movement, announced the “We Can Help” project with great fanfare a few days ago. A total of 1,000 investigators from her agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.

Solis told Latino workers that “your president, your secretary of labor and this department will not allow anyone to be denied his or her rightful pay, especially when so many in our nation are working long, hard and often dangerous hours.” She assured illegal immigrants that “if you work in this country, you are protected by our laws.”

The same day Solis publicly announced the Obama Administration’s new project, a Labor Department investigator visited a day laborer center in northern California to promote it. The federal employee actually chatted warmly with the illegal immigrants about how to find jobs without being exploited, according to a local newspaper report. “We’re the feds but the good ones,” he told the day laborers in Spanish. “We’re here to help workers.”

The agency has also launched a Spanish television advertising campaign to spread the word and created a web site. Workers in industries from construction to food service are urged to contact the Labor Department of wage and hour violations. An investigator may be deployed to the work site or the employer may be taken to court.

While in Congress, she opposed strengthening the border fence, supported expansion of illegal alien benefits (including driver's licenses and in–state tuition discounts), embraced sanctuary cities that refused to cooperate with federal homeland security officials to enforce immigration laws, and aggressively championed a mass amnesty. President Obama's Labor Secretary Hilda Solis is supposed to represent American workers. What you need to know is that this longtime open–borders sympathizer has always had a rather radical definition of "American." At a Latino voter registration project conference in Los Angeles many years ago, Solis asserted to thunderous applause, "We are all Americans, whether you are legalized or not."

That's right. The woman in charge of enforcing our employment laws doesn't give a hoot about our immigration laws –– or about the fundamental distinction between those who followed the rules in pursuit of the American dream and those who didn't.

While in Congress, she opposed strengthening the border fence, supported expansion of illegal alien benefits (including driver's licenses and in–state tuition discounts), embraced sanctuary cities that refused to cooperate with federal homeland security officials to enforce immigration laws, and aggressively championed a mass amnesty. Solis was steeped in the pro–illegal alien worker organizing movement in Southern California and was buoyed by amnesty–supporting Big Labor groups led by the Service Employees International Union. She has now caused a Capitol Hill firestorm over her new taxpayer–funded advertising and outreach campaign to illegal aliens regarding fair wages:

"I'm here to tell you that your president, your secretary of labor and this department will not allow anyone to be denied his or her rightful pay –– especially when so many in our nation are working long, hard and often dangerous hours," Solis says in the video pitch. "We can help, and we will help. If you work in this country, you are protected by our laws. And you can count on the U.S. Department of Labor to see to it that those protections work for you."

To be sure, no one should be scammed out of "fair wages." Employers that hire and exploit illegal immigrant workers deserve full sanctions and punishment. But it's the timing, tone–deafness and underlying blanket amnesty agenda of Solis' illegal alien outreach that has so many American workers and their representatives on Capitol Hill rightly upset.

With double–digit unemployment and a growing nationwide revolt over Washington's border security failures, why has Solis chosen now to hire 250 new government field investigators to bolster her illegal alien workers' rights campaign? (Hint: Leftists unhappy with Obama's lack of progress on "comprehensive immigration reform" need appeasing. This is a quick bone to distract them.)

Unfortunately, the federal government is not alone in lavishing attention and resources on workers who shouldn't be here in the first place. As of 2008, California, Florida, Nevada, New York, Texas and Utah all expressly included illegal aliens in their state workers' compensation plans –– and more than a dozen other states implicitly cover them.

Solis' public service announcement comes on the heels of little–noticed but far more troubling comments encouraging illegal alien workers in the Gulf Coast. Earlier this month, in the aftermath of the BP oil spill, according to Spanish language publication El Diario La Prensa, Solis signaled that her department was going out of its way to shield illegal immigrant laborers involved in cleanup efforts. "My purpose is to assist the workers with respect to safety and protection," she said. "We're protecting all workers regardless of migration status because that's the federal law." She told reporters that her department was in talks with local Immigration and Customs Enforcement (ICE) officials who had visited coastal worksites to try to verify that workers were legal.

No word yet on whether she gave ICE her "we are all Americans, whether you are legalized or not" lecture. But it's a safe bet.

Deportation Halted for Some Students as Lawmakers Seek New Policy

Olga Zanella, a Mexican-born college student in Texas, should have started months ago trying to figure out how she could make a life in Mexico, since American immigration authorities were working resolutely to deport her there.

But Ms. Zanella, 20, could not bring herself to make plans. She was paralyzed by fear of a violent country she could not remember, where she had no close family.

Ms. Zanella, who has been living illegally in the United States since her parents brought her here when she was 5, had been trying to fight her deportation for more than two years. She was pulled over by the local police in February 2009 as she was driving in her hometown, Irving, Tex., and did not have a driver’s license. The police handed her over to immigration agents.

Her case looked bleak, but in recent days everything changed. Last Thursday, an Immigration and Customs Enforcement official in Dallas summoned Ms. Zanella and told her she could remain in this country, under the agency’s supervision, if she stayed in school and out of trouble.

Encouraged by the surprising turnaround, Ms. Zanella’s parents and two siblings, who also had been living in the United States illegally, presented papers late Monday to ICE, as the agency is known, turning themselves in and requesting some form of legal immigration status.

“It’s an opportunity we are going to take,” Ms. Zanella said in a telephone interview from Dallas. “It’s better than being in the shadows.”

The about-face by ICE in Ms. Zanella’s case is an example of the kind of action Democratic lawmakers and Latino and immigrant groups have been demanding from the Obama administration to slow deportations of illegal immigrants who have not been convicted of crimes. In particular, pressure is increasing on President Obama to offer protection from deportation to illegal immigrant college students who might have been eligible for legal status under a bill in Congress known as the Dream Act.

In an April 13 letter, the top two Democrats in the Senate, Harry Reid of Nevada and Richard Durbin of Illinois, asked the president to suspend deportations for those students. But short of that, the senators asked Mr. Obama to set guidelines by which those students could come forward individually to ask to be spared deportation and to obtain some authorization to remain in the United States. The letter was signed by 20 other Senate Democrats. The Dream Act passed the House but failed in the Senate in December.

Homeland Security officials have said their focus is increasingly on removing immigrants who are convicted criminals. That, in fact, is what an ICE official told Ms. Zanella in explaining the new decision in her case.

The agent said ICE “was supposed to be concentrating on criminals, not on Dream students,” said Ralph Isenberg, a Dallas businessman who advocates for immigrants and made it his cause to prevent Ms. Zanella from being deported. Mr. Isenberg’s challenges to ICE had kept Ms. Zanella in the country even after the final date for her deportation in February.

“As long as I do well in school and stay out of trouble, I will be out of trouble with ICE,” Ms. Zanella said she was told. She has to report to ICE every month.

ICE officials declined to comment on the case, citing privacy policies.

ICE officials in central Florida recently invited immigration lawyers to bring forward illegal immigrants facing deportation who did not have criminal records, offering provisional authorization for them to remain here and work legally.

On Tuesday, immigration authorities suspended the deportation of Mariano Cardoso, 23, a Mexican student at Capital Community College in Connecticut, according to Senator Richard Blumenthal, a Democrat, who had pressed Mr. Cardoso’s cause. ICE’s decision ended a two-year battle against deportation for Mr. Cardoso.

But nationwide the administration’s deportations policy remains confused and erratically implemented, immigration lawyers said, with many students and immigrants without criminal records being deported.

“The administration needs to make it clear to the public and to the rank and file within ICE that it has a firm and clear policy of enforcing the law within its priorities and discouraging going after cases that are not within its priorities,” said Gregory Chen, director of advocacy for the American Immigration Lawyers Association. “But that is just not happening consistently.”

Ms. Zanella is studying at North Lake College in Irving to become a dentist. The police in Irving never explained why they stopped her and never issued any traffic ticket, Mr. Isenberg said.

ICE agents made no promises to Ms. Zanella’s family. Her father, José Victor Zanella, said: “We are ready to trust in the system.”

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.

Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”

Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.

“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”

If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.

According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.

The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.

While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.

In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.

As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.

As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Estimate for Deporting Illegal Immigrants: $94 Billion

“Stop the madness! DEPORT,” one of many like-minded comments in a previous post on illegal immigration, is an opinion that has always lacked a price tag. Another figure — the estimated 12 million foreigners in the United States right now without permission — hinted that it would not be cheap. And others doubted whether it was even possible.

So it fell to Senator Susan M. Collins, Republican of Maine, to try popping the question on Thursday.

During a hearing with Julie L. Myers, chief of Immigrations and Customs Enforcement, she asked, “Could you give us some idea of what the cost of trying to locate, detain and deport all of the 12 million people who are here illegally would be?”

Lo and behold, an answer shot back with ease: “Our agency has estimated that it would cost at least $94 billion.”



She emphasized that it was a “very rough” estimate, not taking into account the likely deterrent effects of a nationwide hunt for evey illegal immigrant. Many may choose to return home on their own and avoid the average month-long stay in a holding cell.

In fact, detaining the illegal immigrants would be one of the most significant costs of the round-up, according to a spokesman for the agency who did the math for CNN:

He said the amount was calculated by multiplying the estimated 12 million people by the average cost of detaining people for a day: $97. That was multiplied by the average length of detention: 32 days.

ICE officials also considered transportation costs, which average $1,000 per person.

But that amount can vary widely, the spokesman said. Some deportees are simply driven by bus across the border, while others must take charter planes to distant countries, he said.

Finally, the department looked at personnel costs, bringing the total to roughly $94 billion.

With the budget deficit standing at $205 billion for the fiscal year, according to the Congressional Budget Office, the $94 billion would require Congress to go deeper into the red or deeply cut the budgets of other programs.

In any event, pack this factoid away in the immigration debate folder of your brain. You’ll probably be hearing it again in the future.

GAO: Criminal Aliens Continue to Burden Taxpayers


On Thursday, the Government Accountability Office (GAO) released a report detailing the fiscal and

social costs that criminal aliens bear on the American people. (GAO-11-187, Mar. 2011) According

to the report, the federal government spent at least $1.5 to $1.6 billion annually from fiscal years

2005 to 2009 to incarcerate criminal aliens. (Id. at 34) Criminal aliens are aliens who are in the U.S.

legally or illegally and have been convicted of a crime.




The GAO’s cost estimate, however, is substantially lower than the
actual costs of incarceration to taxpayers because data limitations only allowed GAO to incorporate a portion of the state and local costs. That is, because the GAO found that there was no reliable data on the number and costs of all criminal aliens in state and local jails, the GAO used a number it felt was reliable: state and local incarceration costs reimbursed by the federal government through the State Criminal Alien Assistance Program (SCAAP). However, it is important to note that SCAAP reimbursements to state and local governments cover only a fraction of the full costs to state and local governments. This is because: 1) SCAAP does not reimburse state and locals for criminal aliens with lawful status (i.e. legal aliens who are convicted of a crime); and 2) SCAAP only reimburses state and locals for criminal illegal aliens meeting certain criteria. (Id. at 1-2) Even then, SCAAP may not pay for the incarceration of all eligible criminal aliens. For example, in California alone in 2008, the total estimated cost of incarcerating SCAAP aliens was over $1 billion, yet SCAAP only reimbursed percent (from 146,327 to 204,136). (Id. at 10) Signifithe state $112 million. (Id. at 41)



The GAO also found that from 2003 to 2009, the cost of SCAAP criminal aliens to state prisons increased by 25 percent (from 73,751 to 91,823) and their burden on local jails increased by 40 cantly, the report revealed that six states—all of which have a substantial illegal alien population—bear nearly 70 percent of the costs of incarcerating criminal aliens. (Id. at 11-12) These states include Arizona, California, Florida, Illinois, New York, and Texas. (Id. at 12)


Other key findings of the report include:


States were only reimbursed for 23% of the cost of incarcerating criminal aliens. (Id. at 37)

50% of the criminal aliens in the GAO’s study population were arrested at least once for homicide, a sex offense, kidnapping, robbery, or assault. (Id. at 19)

65% of criminal aliens in the GAO’s study population were arrested at least once for an immigration violation. (Id.)

As of 2009, Mexico is the country of birth of 70% of SCAAP criminal aliens (again, only a fraction of criminal aliens) in local jails and 66% of SCAAP criminal aliens in state prisons. (Id. at 13-15)

The GAO report was requested by House Immigration Subcommittee Vice-Chairman, Rep. Steve King (R-IA), who used the report’s findings to renew his call to complete the border fence. In a statement, Rep. King said that the GAO’s findings “prov[e] that we have to secure our southern border with a fence, a wall, and a fence. That would drastically reduce the ability of criminal aliens to enter the United States, providing needed relief to overburdened state prison systems and to taxpayers.” (Rep. Steven King Press Release, Apr. 21, 2011) He continued, “We also have to do a better job of removing criminal aliens who are apprehended, and of preventing the re-entry into the country of those who are removed.” (Id.)

In a flabbergasting request, a coalition of Mexican lawmakers has asked the United States to stop deporting illegal immigrants who have been convicted of serious crimes in American courts.

The preposterous demand was made at a recent southern California conference in which the mayors of four Mexican cities that border the U.S. gathered to discuss cross-border issues. The only American mayor who attended the biannual event was San Diego’s Jerry Sanders, evidently because his city hosted it this year at a fancy downtown hotel.

Among the cross-border topics that were addressed at the conference was the deportation of Mexican citizens who have committed violent crimes in the U.S. The felons are persona non grata in their communities, say the mayors of Tijuana, Ciudad Juarez, Nogales and Nuevo Laredo. They want U.S. officials to stem the deportation of such convicts to their cities, according to a local newspaper report that covered the conference.

To support the request, the mayor (Jose Reyes Ferriz) of Mexico’s most violent city, Ciudad Juarez, pointed out that of 80,000 people deported to his community in the past three years nearly 30,000 had committed serious crimes in the U.S. Around 7,000 had served sentences for rape and 2,000 for murder. The criminal deportees have contributed to the escalating drug-cartel violence in his city, Mayor Ferriz said, so he wants the U.S. to make other arrangements when prison sentences are completed.

If this seems unbelievable, consider that a few years ago Mexico’s government formally complained that too many Mexicans had been repatriated from the U.S. and that the entire country was overwhelmed with demands for housing, jobs and schools. Various Mexican legislators publicly chastised the U.S. for sending illegal immigrants back, explaining that the country could not accommodate the “repatriated.”

More than 11,000 gang members and their associates have been arrested over a three-year period thanks to a crackdown in immigration enforcement by the U.S. Immigration and Customs Enforcement.



(CNSNews.com) – U.S. taxpayers are spending at least $18.6 million per day to house an estimated 300,000 to 450,000 illegal immigrants who are incarcerated and eligible for deportation from the United States, according to data from the Department of Homeland Security (DHS) and the Department of Justice (DOJ).

The cost per day for these prisoners is based on Justice Department incarceration cost estimates from 2001 and on the lower-end figure of 300,000 incarcerated deportable aliens, which means the actual expense today could be substantially higher than $18.6 million per day.

The prisoners involved here are foreign national who have come into the United States, committed a crime, been captured, and imprisoned.

Half of the undocumented aliens who were removed from the United States in fiscal 2010 (which ended on Sept. 30) had been convicted of a crime in the United States.

On Wednesday, the office of the DHS Inspector General (IG) released its annual performance plan report for fiscal year 2011, which states that there are “approximately 300,000 to 450,000 criminal aliens incarcerated in federal, state, county, and local correctional facilities [who] are eligible for removal from the United States.”

In its March 2010 report, "Immigration Enforcement Actions: 2009," the DHS defines removal as "the compulsory and confirmed movement of an inadmissible or deportable alien out of the United States based on an order of removal. An alien who is removed has administrative or criminal consequences placed on subsequent reentry owing to the fact of the removal."

Kara McCarthy, a spokeswoman at the DOJ, told CNSNews.com that the latest data available show that “average annual operating costs per state inmate for Fiscal Year 2001 was $22,650; in the Federal Bureau of Prisons it was $22,632.”

These annual operation costs exclude “capital expenditures, juvenile corrections, probation, parole, and most central office functions of corrections spending,” McCarthy told CNSNews.com

The cost of $22,650 per year to house just one inmate at the state level equals about $62 a day ($22,650 divided by 365 days). In the Federal Bureau of Prisons, it also averages out to $62 per day ($22,632 divided by 365 days).

Given this daily average expense (based on fiscal year 2001 costs), it can be estimated that the cost of housing 300,000 incarcerated illegal aliens in U.S. prisons would equal $18.6 million per day; the cost for housing 450,000 incarcerated illegal aliens would equal $27.9 million per day. If inflation in prison costs since 2001 were factored in, the expense would be even greater.

When CNSNews.com asked why incarcerated aliens who are eligible for removal have not been deported, a DHS spokesperson said, “It is because they are still serving their criminal sentence. ICE does not receive criminal aliens from state criminal justice systems until after they have completed their sentences.” (ICE is the acronym for Immigration and Customs Enforcement.)

On the same day the IG’s office released its performance plan report, DHS Secretary Janet Napolitano and ICE Director John Morton announced that half of the undocumented aliens who were removed from the United States in fiscal year 2010, which ended on Sept. 30, were convicted criminals.

“In fiscal year 2010, ICE set a record for overall removals of illegal aliens, with more than 392,000 removals nationwide,” says an Oct. 6 press release from the DHS. “Half of those removed--more than 195,000--were convicted criminals.”

“The fiscal year 2010 statistics represent increases of more than 23,000 removals overall and 81,000 criminal removals compared to fiscal year 2008--a more than 70 percent increase in removal of criminal aliens from the previous administration,” added the release.


It is uncertain whether the IG office’s estimate of 300,000 to 450,000 incarcerated criminal aliens who are eligible for removal takes into account the 195,000 criminal aliens removed in fiscal 2010. The IG office did not respond to CNSNews.com for a clarification on this point before this story was posted.

Nevertheless, the DHS did not deport all of the criminal illegal aliens who are eligible for removal and are currently sitting in U.S. correctional facilities.

The DOJ spokeswoman told CNSNews.com that, according to its latest figures, “In 2008 there were 785,556 inmates in the nation's [local and county] jails and 1,518,559 inmates in state and federal prisons.” That equals 2,304,115 inmates in total in the United States.

Given those numbers, 300,000 incarcerated criminal aliens would equal 13 percent of the entire inmate population of the United States, while 450,000 incarcerated criminal aliens would equal 19.5 percent of the entire inmate population.

According to the IG report from DHS, “The Immigration Reform and Control Act of 1986 requires ICE to initiate deportation proceedings for incarcerated criminal aliens as expeditiously as possible after the date of conviction. Criminal aliens who are eligible for deportation include illegal aliens in the United States who are convicted of any crime and lawful permanent residents who are convicted of a removable offense as defined in the Immigration and Nationality Act.
