The state’s new immigration law is perfectly reasonable, but you wouldn’t know it from the New York Times.

Supporters of Arizona’s new law strengthening immigration enforcement in the state should take heart from today’s New York Times editorial blasting it. “Stopping Arizona” contains so many blatant falsehoods that a reader can be fully confident that the law as actually written is a reasonable, lawful response to a pressing problem. Only by distorting the law’s provisions can the Times and the law’s many other critics make it out to be a racist assault on fundamental American rights.

The law, SB 1070, empowers local police officers to check the immigration status of individuals whom they have encountered during a “lawful contact,” if an officer reasonably suspects the person stopped of being in the country illegally, and if an inquiry into the person’s status is “practicable.” The officer may not base his suspicion of illegality “solely [on] race, color or national origin.” (Arizona lawmakers recently amended the law to change the term “lawful contact” to “lawful stop, detention or arrest” and deleted the word “solely” from the phrase regarding race, color, and national origin. The governor is expected to sign the amendments.) The law also requires aliens to carry their immigration documents, mirroring an identical federal requirement. Failure to comply with the federal law on carrying immigration papers becomes a state misdemeanor under the Arizona law.

Good luck finding any of these provisions in the Times’s editorial. Leave aside for the moment the sweeping conclusions with which the Times begins its screed—such gems as the charge that the law “turns all of the state’s Latinos, even legal immigrants and citizens, into criminal suspects” and is an act of “racial separation.” Instead, let’s see how the Times characterizes the specific legislative language, which is presumably the basis for its indictment.

The paper alleges that the “statute requires police officers to stop and question anyone who looks like an illegal immigrant.” False. The law gives an officer the discretion, when practicable, to determine someone’s immigration status only after the officer has otherwise made a lawful stop, detention, or arrest. It does not allow, much less require, fishing expeditions for illegal aliens. But if, say, after having stopped someone for running a red light, an officer discovers that the driver does not have a driver’s license, does not speak English, and has no other government identification on him, the officer may, if practicable, send an inquiry to his dispatcher to check the driver’s status with a federal immigration clearinghouse.

The Times then alleges that the law “empower[s] police officers to stop anyone they choose and demand to see papers.” False again, for the reasons stated above. An officer must have a lawful, independent basis for a stop; he can only ask to see papers if he has “reasonable suspicion” to believe that the person is in the country illegally. “Reasonable suspicion” is a legal concept of long-standing validity, rooted in the Constitution’s prohibition of “unreasonable searches and seizures.” It meaningfully constrains police activity; officers are trained in its contours, which have evolved through common-law precedents, as a matter of course. If the New York Times now thinks that the concept is insufficient as a check on police power, it will have to persuade every court and every law enforcement agency in the country to throw out the phrase—and the Constitution with it—and come up with something that suits the Times’s contempt for police power.

On broader legal issues, the Times is just as misleading. The paper alleges that the “Supreme Court has consistently ruled that states cannot make their own immigration laws.” Actually, the law on preemption is almost impossibly murky. As the Times later notes in its editorial, the Justice Department ruled in 2002, after surveying the relevant Supreme Court and appellate precedents, that “state and local police had ‘inherent authority’ to make immigration arrests.” The paper does not like that conclusion, but it has not been revoked as official legal advice. If states have inherent authority to make immigration arrests, they can certainly do so under a state law that merely tracks the federal law requiring that immigrants carry documentation.

The Times tips its hand at the end of the editorial. It calls for the Obama administration to end a program that trains local law enforcement officials in relevant aspects of immigration law and that deputizes them to act as full-fledged immigration agents. The so-called 287(g) program acts as a “force multiplier,” as the Times points out, adding local resources to immigration law enforcement—just as Arizona’s SB 1070 does. At heart, this force-multiplier effect is what the hysteria over Arizona’s law is all about: SB 1070 ups the chances that an illegal alien will actually be detected and—horror of horrors—deported. The illegal-alien lobby, of which the New York Times is a charter member, does not believe that U.S. immigration laws should be enforced. Usually unwilling for political reasons to say so explicitly, the lobby comes up with smoke screens—such as the Times’s demagogic charges about SB 1070 as an act of “racial separation”—to divert attention from the underlying issue. Playing the race card is the tactic of those unwilling to make arguments on the merits. (The Times’s other contribution today to the prevailing de facto amnesty for illegal aliens was to fail to disclose, in an article about a brutal 2007 schoolyard execution in Newark, that the suspected leader was an illegal alien and member of the predominantly illegal-alien gang Mara Salvatrucha.)

The Arizona law is not about race; it’s not an attack on Latinos or legal immigrants. It’s about one thing and one thing only: making immigration enforcement a reality. It is time for a national debate: Do we or don’t we want to enforce the country’s immigration laws? If the answer is yes, the Arizona law is a necessary and lawful tool for doing so. If the answer is no, we should end the charade of inadequate, half-hearted enforcement, enact an amnesty now, and remove future penalties for immigration violations.

Survivor Recounts Horror of Attack in Newark Schoolyard

NEWARK — She lay face-down on the pavement, trying in terror to follow the orders of those who had already robbed and molested her. “Somebody had their knee on my back,” she said, when suddenly, “They pulled my hair up and was trying to chop my neck off with a machete.”

“I guess the knife was dull, because I just felt banging,” Natasha Aeriel told a jury here Thursday morning. “But then I saw a bunch of blood.” Screaming for mercy, she managed to push one attacker off her and rose to flee, when another shot her in the head.

The sole survivor of a notorious attack in a Newark schoolyard that left her brother and two friends dead almost three years ago, Ms. Aeriel told her story publicly for the first time in State Superior Court in Essex County. She recounted the horror of Aug. 4, 2007, in grim detail, in testimony that is at the heart of the prosecution’s case in the first trial of one of the six men accused in the slayings.

Despite partial facial paralysis from the shooting that forces her to talk from one side of her mouth, Ms. Aeriel, 22, spoke clearly in three and a half hours on the witness stand, pausing just once to regain her composure. But her left hand was in nervous motion much of the time, holding her chin or her cheek, playing with the collar of her light brown jacket or running through her braids.

More than 20 relatives and friends of the victims sat in the gallery, underlining her words with a few gasps, silent tears, even a little laughter and, at one point, a smattering of applause, which brought a rebuke from Judge Michael L. Ravin.

She calmly described her wounds, tugging at her gray blouse to reveal a machete scar on her right shoulder, and pointing to the spot where the bullet struck behind her left ear. She told of living in chronic pain and of multiple operations to remove bullet fragments from her head, reattach her ear and partially reconstruct her jaw.

But what she could not do was say much about the defendant in this trial, Rodolfo Godinez, 26. She identified another of the accused as the one who shot her and said a third hacked at her neck and shoulders. In the aftermath of the attack, she was able to identify some of the defendants from pictures, but not Mr. Godinez, whose lawyers have acknowledged that he was there but say he did not participate in the attack.

Investigators have described Mr. Godinez, a native of Nicaragua, as a recruiter for MS-13, or Mara Salvatrucha, a violent street gang composed mostly of Central Americans.

Mr. Godinez’s lawyer, Roy Greenman, repeatedly raised questions about possible gaps or inconsistencies in Ms. Aeriel’s memory of that night. Earlier in the investigation, for example, she said there were six or seven people in the group that attacked her and her friends, but on Thursday she testified that it was definitely six.

Mr. Greenman also had her recount how police detectives, after interviewing her in summer 2007, did not talk to her again for almost a year — and so were unaware that she had firmly identified a suspect she saw on television as the one who shot her.

Much of Ms. Aeriel’s testimony could have been lifted from a horror movie script, starting with an innocent gathering of four friends behind Mount Vernon School in the Ivy Hill neighborhood, relaxing and listening to music on their car radio on a hot summer night.

There was Ms. Aeriel, then 19; her brother, Terrance Aeriel, 18; Ms. Aeriel’s best friend, Iofemi Hightower, 20; and Dashon Harvey, 20, whom she remembered dancing to the rap song “Wipe Me Down.” Three were students at Delaware State University, and Ms. Hightower had planned to enroll there.

Mr. Godinez and a friend were already in the schoolyard, drinking beer, and a while later four more people — a mix of young men and teenage boys — joined them. At that point, Mr. Aeriel, who had stepped away from his friends to make a phone call, sensed that something was wrong. He sent his sister a text message saying that they should leave, she testified, and walked swiftly back to his friends with a serious expression.

They were preparing to get back in the car, Ms. Aeriel said Thursday, when the other group, at least two of them armed with guns, surrounded them and ordered them to lie face-down on the ground and to empty their pockets.

“They was checking our pockets, telling us if they find anything, we’re dead, don’t hold nothing back,” she said. Under questioning by Mr. Greenman, she insisted that each of the six was demanding their valuables and threatening them.

Mr. Harvey had a new cellphone that he tried to hide, she said, but it began ringing. “I was scared they were going to take my car,” she said. “I didn’t think they would start going crazy the way they did.”

“They was like, ‘Mama, you sexy,’ that kind of craziness,” Ms. Aeriel told the jury. Someone tried to pull down Ms. Hightower’s pants, but she was wearing a belt. Then someone yanked down Ms. Aeriel’s basketball shorts and touched her, she said, and “all I could keep doing was saying, ‘Jesus, Jesus, Jesus, Jesus.’ ”

Turning her head slightly, Ms. Aeriel said, she caught the last glimpse she would ever get of her brother and her friends. The attackers marched the other three to a different spot, and then Ms. Aeriel felt the machete.

As she fought off the attacker, “I was screaming, ‘Don’t do that, please don’t do that, why?’ ” she recalled. As she stood up, she heard gunshots, and she kept screaming. Moments later, she said, one of the group shot her.

Ms. Aeriel testified that she had repeatedly tried to get to her feet, crawled a short distance, and “then I’d fall in a pool of blood.” She finally blacked out.

Regaining consciousness in an ambulance, she testified, “I kept saying, ‘Leave me here, leave me here; it’s some kids behind that wall — go take care of them.’ ”

It is perhaps the best book available for those who desire to acquire a better understanding of this issue in a relatively short period of time. You need to especially read The Immigration Solution before voting in November.

The National Council of La Raza (NCLR) is not only one of the wealthiest and most politically powerful militant organizations in the country, it is also notoriously racist and subversive. The group's name, "La Raza," means "The Race," by which they are referring to ethnic Mexicans, or more broadly to "hispanics" or "latinos." And it is quite clear from their decades of vitriolic rhetoric — both spoken and written — that the La Raza activists are trying to engender not only race consciousness amongst hispanic U.S. citizens and Mexican migrants, but also racial militancy and animosity toward "Gringo America."

The NCLR grew out of the La Raza Unida (The Race United) Party and the Southwest Council of La Raza in the late 1960s and early 1970s. The key leaders were Marxist-Leninist followers of Fidel Castro and Che Guevarra.

In 1970, the California Senate Fact-Finding Subcommittee on Un-American Activities said this about La Raza Unida: "Its president is Maclovio Barraza. Mr. Barraza has been identified by the Subversive Activities Control Board as a member of the Communist Party, and presides over the Council which recently received a grant of $1,300,000 from the Ford Foundation."



Maclovio Barraza was the NCLR Board of Directors' founding Chairperson, and the NCLR continues to honor this hardcore Marxist by awarding the Moclavio Barraza Award to its top activist each year.

One of the early founders of La Raza was Professor Jose Angel Gutierrez, whose violent, extremist rhetoric has caused NCLR some public relations problems. Back in 1969, Gutierrez said: "We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him." He has continued to promote the same hateful "reconquista" ideology ever since. But that didn't stop NCLR from bestowing on him their "Hero Award" in 1994.

The radical student group MEChA (Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closely allied for several decades, is even more explicitly and militantly, having adopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," which translated means: "For the Race, Everything; Outside the Race, Nothing."

MEChA's founding documents and literature are replete with appeals to "La Raza de Bronce" (The Bronze Race) and condemnation of the "brutal gringo." MEChA, as its name suggests, is also a leading promoter of the radical "reconquista" (reconquest) movement, a plan of to take over the states of California, Arizona, New Mexico, Colorado, and Texas — a region they refer to as "Aztlan" — which they claim was stolen from the "Aztecan" peoples. NCLR provides major financial support to MEChA and many of NCLR's leaders were MEChA leaders in their college days.

NCLR: Agents for the Government of Mexico?

Especially troubling is NCLR's leading role in the Fundacion Solidaridad Mexicano Americana (Foundation for Mexican-American Solidarity, FSMA), an organization founded and funded by the government of Mexico and directed by the Mexican Ministry of Foreign Affairs and Ministry of Public Education. Both of these ministries have been engaged in efforts aimed at demanding full political rights for illegal aliens in the U.S. and indoctrinating America's Hispanic population in radical, racist La Raza ideology.

Washington (CNSNews.com) - Sen. John Cornyn (R-Texas), speaking at a conference on border issues Thursday, said 663 individuals arrested along the southwest border in 2010 were from countries designated as “special interest” or from countries known to have ties with terrorism.



“It’s not just that we’re seeing immigration across our southern border from countries like Mexico -- people seeking to work and provide for their families,” said Cornyn, a member of the Senate Judiciary subcommittee on homeland security and terrorism. “Indeed in the last year alone -- where 445,000 individuals were detained at the southwest border -- 59,000 came from countries other than Mexico.

“These included 663 individuals from special-interest countries like Afghanistan, Libya, Pakistan, Somalia, and Yemen and four countries that have been designated by the U.S. Department of State as state-sponsors of terror – Cuba, Iran, Syria, and Sudan,” Cornyn said.

Special interest countries are those whose citizens are subject to enhanced screening by the Transportation Security Administration on U.S.-bound flights as a result of the attempted Christmas Day bombing of Northwest Flight 253.

The U.S. Border Patrol, which falls under the Homeland Security Department, is charged with apprehending aliens attempting to illegally cross U.S. borders. As CNSNews.com previously reported, in fiscal year 2010, around 84 percent of the approximately 448,000 illegal aliens arrested by the U.S. Border Patrol were not prosecuted.

After delivering his remarks at the 15th annual U.S.-Mexico Congressional Border Issues Conference, Sen. Cornyn told reporters he asked the Director of National Intelligence whether the apprehension of the 663 individuals was national security vulnerability. “He said yes it was, so we need to do more,” Cornyn said.

What the Obama administration is doing to secure the border more is “obviously not enough,” he added.

During his speech, Cornyn criticized the Obama administration’s border security efforts, saying that Homeland Security Secretary Janet Napolitano talks about the resources that have been devoted to border areas -- the so called ‘inputs’ – “where I’m really more interested in what the results, or the outputs, are.”

Napolitano, who also spoke at the event, said “taken as whole, the manpower, the technology, the resources, represent the most serious and sustained action to secure the border in our nation’s history, and it’s clear from every statistical measure that the approach is working.”

Napolitano called Border Patrol apprehensions a “key indicator of illegal traffic” along the U.S. borders, and she noted the apprehensions have decreased 36 percent in the past two years and are less than one half of what they were at their peak.

Sen. Cornyn suggested that a border security strategy should have a coordinated “interagency approach,” where the various federal entities charged with security along the border are working together and complementing one another.

He also said that a “good” border security strategy “should be resourced appropriately.”

The annual border conference took place on Capitol Hill and was sponsored by the U.S.-Mexico Chamber of Commerce.

Washington (CNSNews.com) – An illegal alien apprehended by the U.S. Customs and Border Protection agency during the last fiscal year had an estimated 84 percent chance of never being prosecuted, according to figures compiled by the office of Rep. John Culberson (R-Texas).

Culberson submitted the figures for the record during a hearing Wednesday of the House Appropriations subcommittee on homeland security.



Of 447,731 illegal aliens apprehended by the U.S. Border Patrol during fiscal year 2010 (which ended last September), only 73,263 (16.4 percent) were prosecuted, according to the submitted data. That means that 374,468 illegal aliens that were taken into custody (83.6 percent) were never prosecuted

Border Patrol Union Blasts Napolitano

Federal agents who risk their lives to patrol the U.S. border are blasting their boss—Homeland Security Secretary Janet Napolitano—for giving Americans a “false sense of security” by assuring that the Mexican border is safe.

During a visit to El Paso a few days ago, Napolitano said that violence along the Mexican border is merely a mistaken “perception” because the area is better now than it ever has been thanks to the Obama Administration’s commitment to “fostering a secure and prosperous” region. In fact, Napolitano said that some of America’s safest communities are in the southwest border region.

Outraged Border Patrol agents on the front line of the escalating violence responded by reminding that three of their agents have been murdered by Mexican drug cartels in the last few years and ranchers have been gunned down in border communities. U.S. citizens are also being “kidnapped and killed” with regularity, according to the National Border Patrol Council, which represents more than 17,000 agents nationwide.

As an example of the impact on U.S. communities, the NBPC points out that the Phoenix area has become a “cartel-related crime hotspot.” Simply put, the U.S.-Mexico border is unsafe, the Border Patrol union assures. “It is time for the political games to stop for fear of insulting the government of Mexico,” the Border Patrol group says. “Mexico is hemorrhaging violence and we are being hit with the splatter.”

The Border Patrol agents are right. Mexican drug-cartel violence has reached epic proportions and routinely spills into the very towns Napolitano promotes as “America’s safest communities.” Federal agents have come under siege by heavily armed drug smugglers and local media has exposed record levels in crimes associated with illicit narcotics operations. In fact, more than 13,000 people were murdered across Mexico last year in disturbing and cruel ways not previously seen.

Regardless, last fall Napolitano declared that the region “is as secure as it has ever been.” The famous words, ridiculed in the press worldwide, came days after U.S. Border Patrol agents engaged in a violent gunshot battle with Mexican drug smugglers along the Rio Grande in Texas. The federal officers came under siege during a bust that netted half a ton of U.S.-bound marijuana.

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.

Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.



“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.



Colorado Secretary of State Scott Gessler, a Republican, told the panel that his department’s study identified nearly 12,000 people who were not citizens but were still registered to vote in Colorado.



Of those non-citizen registered voters, nearly 5,000 took part in the 2010 general election in which Democratic Sen. Michael Bennet narrowly defeated Republican John Buck.

Colorado conducted the study by comparing the state’s voter registration database with driver’s license records.



“We know we have a problem here. We don’t know the size of it,” Gessler said in testimony to Administration’s Elections subcommittee.



He told Harper that Colorado would look to create a registration system that would allow his department to ask that some people provide proof of their citizenship in writing.



If individuals did not respond to the request, their registration as voters would be suspended.



Rep. Charles Gonzalez (D-Texas) raised doubts about the reporting, noting that the study itself said it was based on inconclusive data and that it was “impossible to provide precise numbers” on how many people who were registered to vote in the state were not citizens.



Gonzalez asked Gessler, a former prosecutor, if he would have pursued a court case on such evidence.



Gessler responded that the goal of the study was to expose voter registration issues and pursue administrative avenues to resolve them.

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.



Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.



“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.



Colorado Secretary of State Scott Gessler, a Republican, told the panel that his department’s study identified nearly 12,000 people who were not citizens but were still registered to vote in Colorado.



Of those non-citizen registered voters, nearly 5,000 took part in the 2010 general election in which Democratic Sen. Michael Bennet narrowly defeated Republican John Buck.



Colorado conducted the study by comparing the state’s voter registration database with driver’s license records.



“We know we have a problem here. We don’t know the size of it,” Gessler said in testimony to Administration’s Elections subcommittee.



He told Harper that Colorado would look to create a registration system that would allow his department to ask that some people provide proof of their citizenship in writing.



If individuals did not respond to the request, their registration as voters would be suspended.



Rep. Charles Gonzalez (D-Texas) raised doubts about the reporting, noting that the study itself said it was based on inconclusive data and that it was “impossible to provide precise numbers” on how many people who were registered to vote in the state were not citizens.



Gonzalez asked Gessler, a former prosecutor, if he would have pursued a court case on such evidence.



Gessler responded that the goal of the study was to expose voter registration issues and pursue administrative avenues to resolve them.



“We don’t have a screen for citizenship on the front end when people register to vote,” he said.

When U.S. Air Force veteran Marcos Miranda had his identity stolen, he went from being a valued customer and employee to a government statistic — one of thousands of identity theft victims caught up each year in the crackdown on illegal immigrants.



Identity theft has been a growing worry in the United States, but a rise in federal prosecutions of immigrants offers a new wrinkle on the problem. As better systems are developed for verifying employment, illegal immigrants are assuming the names and government-issued ID numbers of Americans like Miranda to thwart detection at workplaces, get driver's licenses and obtain credit.



Miranda first learned someone else was using his identity in 2000 when he was arrested on a warrant for unpaid traffic tickets at the border after a visit to relatives in Mexico. The 24-year-old Texas man was released after paying a $340 fine for violations he never incurred. Although his money was eventually returned, his nightmare was just beginning.



The most common start to identity theft is for the perpetrator get hold of someone's Social Security number, which is part of the system used to record people's earnings for federal retirement benefits. Once a person takes a job in the U.S., the first thing his employer will likely ask for is his or her Social Security number.



In Miranda's case, that's why he has gotten repeated letters from the federal tax officials demanding thousands of dollars in back taxes for wages paid to someone using his name and Social Security number to work at a pork slaughterhouse in Holton, Kansas. Miranda watched his once-high credit rating plummet as creditors reported unpaid bills incurred by others.



"Even though I am Hispanic, I am against illegal immigration," Miranda said. "Even though a lot of them come to work, there are always bad apples. (Identity theft) has really made my perspective ... negative about immigration."



A Mexican national accused of stealing Miranda's identity pleaded guilty last month to one count of using fraudulent documents in a plea deal with federal prosecutors. Joel Rojas-Morales, 27, will be sentenced in March.



"That way he knows crime doesn't pay in America. Maybe in Mexico it does. But here, it may take some time, but the long arm of the law catches up to you," Miranda said.



Chris Joseph, the defense attorney representing Rojas-Morales, is sympathetic to identity theft victims like Miranda.



"I have no reason to doubt that is absolutely true. There is no question he is a victim of identity theft," Joseph said.

An illegal immigration link to identity theft

A massive sweep at Swift meat-processing plants this week could lead officials to 'document rings.'

The latest roundup of illegal immigrants caught working in the US with fraudulent identifications - the largest single such work-site action ever - raises new questions about a link between illegal immigration and the growing problem of identity theft.

Federal raids Tuesday at six meat-processing plants owned by Swift & Co. in six states resulted in the arrests of 1,282 people for immigration violation - with 65 also charged with identify theft or other criminal charges.

The investigation is continuing, say officials with US Immigration and Customs Enforcement (ICE), with the hope that some of the newly arrested workers will lead law officers to "document rings" that provided the stolen identities. The 10-month operation began in February, when ICE learned that "large numbers" of undocumented immigrants might be using Social Security numbers assigned to US citizens.

"We believe that the genuine identities of possibly hundreds of US citizens are being stolen or hijacked by criminal organizations and sold to illegal aliens in order to gain unlawful employment in this country," said Julie Myers, ICE assistant secretary. She called it "a disturbing front in the war against illegal immigration."

The fraudulent document business has long been a thorn in the side of immigration officials, making it hard for them to crack down on companies for knowingly hiring illegal workers. Indeed, even as ICE agents conducted Tuesday's raids at the Swift plants, a joint task force in Arizona - made up of state, federal, and local law- enforcement officials - was arresting 12 suspects and seized numerous fake drivers' licenses, resident alien cards, Social Security cards, and vehicle titles.

Metropolitan Phoenix, a major immigrant-smuggling hub, has become a place where the false ID business is thriving, law-enforcement officers say. They estimate that 1,000 to 1,500 "coyotes," or smugglers, stash thousands of undocumented immigrants in drop houses throughout the valley, where they wait until false identification and transportation can be arranged to places as far away as Seattle and Miami.

"I would say that 90 percent of the transactions dealing with the sale of human cargo, those smuggled across the [Arizona] border, occur right here," Angel Rascon-Rubio, an ICE special agent, testified at a federal court hearing last year.

The Phoenix area is ideal for smugglers, officials say, because it is fairly easy to reach from Mexico but far enough from the border to avoid border patrol enforcement. It has broad access to the rest of the country via air and car. Moreover, the large Hispanic neighborhoods provide cover for drop houses and new immigrants.

On one of Phoenix's quiet residential streets lined with stucco tract homes live two men who came to the US illegally but gained legal status - along with some 3 million others - under the federal 1986 amnesty program. David and Raul, who will give only first names, are in the business of helping newly arrived illegal immigrants acquire fake documents.

They are not part of an organized crime family, they say - just part of a network of established immigrants who help others attain what they've achieved. They are, in effect, the go-betweens from those who bring the immigrants and those who make the fake ID papers - a service they say they provide for free.

"A coyote will call and say, 'Does your boss need more workers?' or 'Can you help get this person some papers?' " says David, whose main job is as a landscaper. "It's easy. I'll have a number for a [document] guy and call him. We'll meet at the major intersection out here, say, in half an hour. I give him $50 or $100, whatever he's asking, a photo of the person, and a name," he adds. "About 45 minutes later, he'll call me to come meet him on the same corner with the papers - a Social Security card and a green card."

If that won't work, David adds, he drives to the nearest Food City, a chain that specializes in Hispanic goods. There, he says, he just asks around. "There are even guys there who'll hand you business cards - they're in the business of providing fake documents."

Raul, who works in construction, says it's not uncommon to get a call from a coyote in the morning and, by afternoon, have jobs and fake documents for the newly arrived illegals. The two won't tell how many illegal immigrants they help, but say they get called at least weekly.

All of the arrests at the Swift plants Tuesday targeted illegal immigrants who held actual - not fake - Social Security numbers. Many businesses that make use of immigrant labor participate in a national test program for employers called Basic Pilot, an online system to verify employees' Social Security numbers.

But the fake-documents manufacturers are wise to this, say David and Raul. In Arizona, they assign Social Security numbers that begin with 601 - numbers the government apparently assigns people from Arizona. Employers then don't readily recognize a fake document, and, the men say, it takes at least a year for the government to recognize a duplicate number. That means the illegal immigrant can work in the US for up to a year before being sent home.

Arizona Gov. Janet Napolitano set up an Arizona Fraudulent Identification Task Force in July 2005 as part of a crackdown on crime related to illegal immigration. Since then, the task force has focused in part on fraudulent documents. In doing so, it has issued more than 100 search warrants resulting in 178 defendants charged with 1,400 crimes, says Leesa Morrison, director of the Arizona Department of Liquor Licenses and Control.

"Most astounding," adds Ms. Morrison, "is that in this short period our undercover agents have purchased over 1,000 fraudulent immigration documents. What's frightening is that [they] are able to purchase a three-pack - a driver's license, a Social Security card, and a permanent-resident card - for about $160 on the street."

Crossing the ID border

Americans learned last week they can no longer look the other way when someone else hires an illegal worker. A federal raid on six Swift & Co. meatpacking plants in the US nabbed more than 1,250 "undocumented" migrants - and dozens were charged with using the IDs of real people, perhaps even of children.

The usual practice for many of the estimated 12 million illegal migrants living in the US has been to buy fake IDs with made-up numbers and names. But organized rings in at least 10 cities now sell authentic-looking Social Security cards and some 26 other types of IDs with real names.

These IDs make it even more difficult for employers to reject illegal workers - if employers even bother to check. Such forgery has reached an "epidemic," say federal officials, with illegal migrants and their handlers now violating both the privacy rights and economic rights of innocent Americans.

In one case, a man named Jason Smith found he owed $12,000 in back taxes because an illegal immigrant used his Social Security number to work at a chicken plant for three years.

To avoid detection, fake-ID rings often use a child's identity. Usually, only when the children reach 18 would they find out they have a record of bad credit or other financial complication. One Mexico-based ring's reach is so "breathtaking," a federal judge stated in one case, that it hits "at the heart of the sovereignty of the United States."

Most identity theft is done to steal money, not work in someone's name. But with about 1 in 30 Americans now having their financial identities stolen each year, and with illegal migrants making up nearly 1 in 20 workers, a dangerous link has been made between two massive violations of law. Government is cracking down on ID theft, but both states and Congress have only begun to come to grips with illegal migration - despite the threat of terrorists using fake IDs to hide in the US.

A federal system that allows employers to check Social Security IDs is flawed because it cannot detect cases where migrants use legitimate names and numbers. (Swift & Co. uses the system, but only a fraction of companies do.)

Even if this system is improved, ID thieves may find new ways around it. And expanding a guest-worker program for Mexicans may only be compromised by other ways of forging documents; in addition, that program may never be large enough to curb the flow of illegal migration.

Another offered solution - "earned amnesty" - would be difficult if illegals simply buy fake records to claim they've been in the US for years. And amnesty is hardly a reward to give those who knowingly commit the felony of identity theft.

Congress recently boosted border enforcement and raised fines on employers who hire illegals. Both measures are good first steps and need to be pursued effectively for years. Companies need to raise wages high enough to attract legal workers, while law enforcement needs to show a consistent record of cracking down on employers who knowingly hire illegals.

No one's true identity can ever be stolen. But Americans need to know that both their financial and border security are not at risk.



*The fake ID business: some previous busts

April 2005: In Florida, immigration agents arrested 52, including several state Department of Motor Vehicles officials, alleged to be part of a scheme to make and sell fake driver's licenses and hazmat licenses to more than 2,000 illegal immigrants. The same month, other sweeps revealed fraudulent license schemes in Michigan and Maryland.

May 2005: In Mississippi, Cedric Carpenter and Lamont Ranson pleaded guilty to conspiring to sell fake documents to members of Abu Sayyaf, a Philippines-based Islamist terrorist group.

February 2006: A lieutenant in the Mexican-based Castorena family organization, a fraudulent document outfit that controls cells in 33 states, was sentenced in Denver to 11 years in prison. More than 50 members of this international counterfeit operation have been prosecuted in Denver alone. Its leader, Pedro Castorena-Ibarra, was arrested in June by Mexican officers and is awaiting extradition to the US.

March 2006: Agents busted seven counterfeit-document labs in Los Angeles and charged 11 people with supplying fraudulent immigration and identity documents.

June 2006: In Boston, immigration agents arrested nine people accused of running a phony document ring. They seized document-forging tools and six computers at five homes. The sweeps led to the arrests of 13 undocumented Brazilian and Guatemalan nationals.

State budget cuts to be felt by illegal immigrants

As the state Legislature looks for ways to close a $5 billion budget shortfall, lawmakers are eyeing millions in cuts that could reduce or eliminate services used by illegal immigrants. Washington is projected to spend more than $300 million over the next two years on services illegal immigrants can tap, primarily welfare and health care for children, the seriously ill and pregnant women.

Washington state estimates it will spend more than $300 million over the next two years on services illegal immigrants can tap, not counting K-12 education. A breakdown:



*

$125 million on health care for 7,400 pregnant women ineligible for Medicaid because they can't prove they are here legally. This program can't be changed, because of federal restrictions.



*

$73 million on welfare for children. The federal government requires proof that the children are here legally, but not their parents. This program also can't be changed.

*

$59 million for medical and dental coverage for 25,000 children from low-income families ineligible for Medicaid because they can't prove they are here legally.

*

$24 million for kidney dialysis and cancer treatment for 1,300 low-income people ineligible for Medicaid because they can't prove they are here legally.

*

$15 million for in-state tuition subsidies for students who have lived in Washington for at least three years. The state does not check legal status.

$5.6 million in nursing-home care for low-income undocumented residents.

OLYMPIA — As the Legislature looks for ways to close a $5 billion budget shortfall, lawmakers are examining millions in cuts that could reduce or eliminate services used by illegal immigrants.

Lawmakers already have passed a law that effectively limits the state Basic Health Plan for the working poor to legal residents.

The state estimates around 10,000 people, roughly 18 percent of those on the plan, will lose state-subsidized insurance because they cannot prove they're here legally. It's expected to save $59 million over two years.

As part of a much broader budget-cutting plan, Democratic Gov. Chris Gregoire also has recommended eliminating a health-care program for children who can't prove they're here legally.

In both cases, Democrats say the moves were made to save money and were not related to who was using the program. Gregoire's office noted her proposed budget eliminated services used by everyone, regardless of legal status.

Overall, Washington is projected to spend more than $300 million over the next two years on services that illegal immigrants can tap, primarily welfare for children and health care for children, the seriously ill and pregnant women. However, programs that account for most of that spending are effectively off-limits to budget cuts, because of federal restrictions.

Sen. Joe Zarelli, ranking Republican on the Senate Ways and Means Committee, says the Legislature should take a closer look at spending on illegal immigrants.

"We've got to question whether we can afford to have state-only programs that only serve illegal-immigrant populations," said Zarelli, of Ridgefield, Clark County.

Some Republicans have proposed limiting services to people who can prove they are here legally. Democrats, who control the Legislature, say budget cuts should not single out anyone.

Senate Ways and Means Chairman Ed Murray, D-Seattle, said he'll oppose any efforts to target services used by illegal residents. But he noted the reality is "every program is going to be cut because of the fiscal crisis. Everybody gets cut."

Lawmakers over the years have set up several programs specifically for residents who have not or cannot prove legal residency. Exactly how much the state spends on illegal immigrants is not known because some people in these programs may be here legally, even though they haven't provided documentation.

Advocates for such programs contend eliminating health-care services for illegal immigrants could cost more in the long run, in part because they end up in emergency rooms where care is more expensive.

Fatima Morales, with the Washington Community Action network, said proposals that target illegal immigrants — aside from ignoring the fact that they do pay taxes — are immoral.

"Everyone deserves access to health care, to services, to have a decent life," she said. "It's the humane thing to do. It's the morally right thing to do."

Ricardo Sanchez, director of Sea Mar's Latino/a Educational Achievement Project, also argues that illegal immigrants are critical to the economy, particularly in agriculture.

"That's what's missing in this whole debate about all this 'don't serve illegal immigrants and keep them out of schools and don't let them have access to college,' " he said.

Some numbers not solid

The next two-year budget could affect all immigrants without documentation of legal status, although much of the discussion involves the impact on Hispanics — the state's largest and fastest-growing minority, with more than 755,000 residents, according to the 2010 census.

It's not known how many people of all nationalities and ethnicities are in Washington illegally.

There's also a dearth of comprehensive research comparing benefits states provide that illegal immigrants can tap. Services appear to vary by state. But Washington is not unique, at least in some of its offerings.

For example, Massachusetts, comparable to Washington in population, provides many of the same social services for illegal immigrants, including health care for children as well as kidney dialysis and cancer treatment for adults.

The Congressional Budget Office in 2007 published a report on the impact of "unauthorized immigrants" on state and local budgets nationally. The study concluded that a small proportion of spending on state and local services went to undocumented residents.

But the analysis, which reviewed 29 reports published over 15 years, also said tax revenues generated by those residents "do not offset the total cost of services provided to those immigrants."

Washington state has made only a quick estimate of state expenses. Roughly half of tax revenues are generated by the sales tax, which everyone pays, including illegal immigrants.

The state is expected to spend more than $100 million over two years on services the Legislature has the authority to change or eliminate, including $59 million for medical and dental care for more than 25,000 children from low-income families. The children are not eligible for Medicaid because there's no proof they're here legally.

An additional $24 million is expected to be spent for kidney dialysis and cancer treatment for about 1,300 people ineligible for Medicaid because they also can't prove they're legal residents.

Millions more will go to in-state tuition subsidies for college students and nursing-home care.

The state also expects to spend about $200 million over two years on two other programs that officials say the state can't change due to federal restrictions. Those programs receive federal matching dollars, and changing them could put overall federal Medicaid funding at risk, state officials said.

One program, projected to cost $125 million, provides health care to about 7,400 pregnant women ineligible for Medicaid because they have not shown they're here legally. The service is provided, in part, because their newborn children will be U.S. citizens. The other program provides welfare payments for children, estimated at $73 million. The federal government requires proof that the children are here legally, but not their parents.

When it comes to K-12 education, the state does not track how many undocumented children attend public schools, and federal case law requires states to provide an education to all children, despite citizenship status.

Lawmakers from both parties have said there are services used by illegal immigrants that would not be eliminated.

While Zarelli questions a lot of state spending on services for illegal immigrants, he said he would not cut funding for kidney dialysis and cancer treatment:

"That's something you shouldn't pull the plug on. It would be inhumane."

New Report Draws Direct Link Between Immigration and Unemployment for American Workers

While unemployment in the United States remains stubbornly high (officially 9.4%, but actually closer to 17% when discouraged workers and people relegated to part-time work are factored in), the picture for immigrants is much brighter. According to a forthcoming report from the Center for Labor Market Studies at Northeastern University, some 1.1 million legal and illegal immigrants entered the U.S. labor force between 2008 and 2010. Over the same period, employment for American workers declined by 6.26 million jobs.

In an interview with Reuters, the author of the study, Andrew Sum, makes it clear that the hiring boom for new immigrants - about 35% of whom are in the country illegally - has come directly at the expense of American workers. "Employers have chosen to use new immigrants over native-born workers and have continued to displace large numbers of blue-collar workers and young adults without college degrees," states Sum.

The study finds that employers favor immigrant workers - particularly illegal aliens - because they work for lower wages, do not demand health care and other benefits, and because businesses can avoid paying payroll taxes.

The majority of immigrant workers who entered the U.S. labor force between 2008 and 2010 took jobs that could be done by unemployed American workers. These include jobs in construction, hotels and food services, retail trade, sanitation and cleaning.

The report amounts to a devastating indictment of America's political leadership that has allowed millions of American workers and their families to suffer by maintaining immigration policies that prevent them from gaining access to jobs in their own country.

The state should go after employers who hire them, curb taxpayer-funded benefits, deploy the National Guard to help the feds at the border and penalize 'sanctuary' cities.



Illegal immigration is another matter entirely. With the state budget in tatters, millions of residents out of work and a state prison system strained by massive overcrowding, California simply cannot continue to ignore the strain that illegal immigration puts on our budget and economy. Edmonds rape suspect deported 4 times



EDMONDS, Wash. – The KING 5 Investigators have learned that an illegal immigrant accused of raping a woman in Edmonds Sunday has been deported nine times. That's much more than previously reported.



Immigrations and Customs Enforcement won't comment on the case of Jose Lopez Madrigal. But KING 5 got the information through confidential sources and documents.



Larry Klein was the man who heard the alleged victim's cries for help. Police say the suspect pulled the woman off the street to a dumpster and raped her.



"I could see the back of his head. I could see his pants were down. I could see her lying on the ground. I could hear her crying, but I couldn't really see her face," said Klein.

People who live near the scene of Sunday's alleged rape wonder how it could keep happening.



"Makes you wonder, what are we doing wrong? How is he getting back in here?" said Kirby Aumick.



"It’s troubling. I mean, if this man should not have been in this country, he should have been behind bars then, really, this is a senseless tragedy," said Klein.



According to our sources, Madrigal's last contact before Sunday was around 2003. So, it's not clear how much of that time Madrigal was in this country.



Immigration and Customs Enforcement has refused to comment on the case which started making national headlines when it was learned that Madrigal had been deported several times prior to the Edmonds case.



In reviewing records and talking with confidential sources, the KING 5 Investigators learned just how extensive Madrigal’s immigration and arrest record is.



They found he was first deported in California in 1989 and since then he’s returned from his Mexican homeland and been arrested for drug crimes, a sex assault in Colorado and other offenses.



One criminal justice source says Madrigal is a "poster boy" for the federal governments ineffectiveness at keeping the most serious "criminal aliens" – illegals who commit crimes – out of the United States.

Audit looks at migrant re-arrests

WASHINGTON - Some illegal immigrants are being released from prison only to be arrested on new charges despite government efforts to deport them and keep them out of the country.



The findings are part of an audit by Justice Department Inspector General Glenn Fine that suggest authorities are still struggling to deport illegal immigrants who commit crimes, even though most state and local authorities are notifying immigration authorities of the imminent release of prisoners.



Fine's office analyzed the cases of 100 immigrants who had served time in prison and found 73 of them were rearrested after being released.



On average, each immigrant was rearrested six times, ranging from traffic violations to assault.



Fine's office couldn't determine how many illegal immigrants had been rearrested overall because immigration authorities don't keep track.



If the sample was any indication, "The rate at which released criminal aliens are rearrested is extremely high," the report said.



Last year, Homeland Security's inspector general said immigration authorities expected that most of the 300,000 illegal and legal immigrants eligible to be deported would be released.



Federal officials said they would need 34,000 additional beds at a cost of $1.1 billion to detain and remove all of them.

The Justice findings by department Inspector General Glenn A. Fine examined the criminal histories of 100 illegal immigrants arrested and then released by local and state authorities in 2004, the latest complete data available. Of the sample group of 100, according to the audit, 73 immigrants were later arrested a collective 429 times - on charges ranging from traffic tickets to weapons and drug charges.



The data suggest "the rate at which released criminal aliens are re-arrested is extremely high," the audit noted. The report, parts of which were redacted, was required by Congress in 2005 and looked at how local and state authorities that receive Justice Department funding are working with the Homeland Security Department.



For years, the government was forced to release thousands of illegal immigrants who were caught in the United States because of not enough jail space and other resources. But last fall, with immigration as a key election-year priority, Homeland Security declared it would detain 99 percent of non-Mexican illegal immigrants until they could be returned to their home nations. The policy generally does not apply to Mexicans, who are almost immediately returned to Mexico after being stopped by Border Patrol agents.



The Justice audit, however, only looked at immigrants who were arrested and released by local and state authorities before they could be turned over to Homeland Security to be detained or deported. In all, 752 cities, counties and states participating in the program received $287 million in 2005, the audit noted.



Five states - California, New York, Texas, Florida and Arizona - received the bulk of the money, together pulling in more than $184 million.



Assistant Attorney General Regina B. Schofield, who oversees the Office of Justice Programs that controlled the funding, declined comment on the audit, noting that it does not contain any recommendations.



A separate report by the Transactional Records Access Clearinghouse at Syracuse University showed that the number of immigrants who were deported as "aggravated felons" doubled over the last 15 years, from 10,303 in 1992 to an estimated 23,065 in 2006.



But TRAC, which obtained the data from the Justice Department's Executive Office of Immigration Review, noted concerns that some of those immigrants never committed felonies.



"An individual can be declared an aggravated felon on the basis of a conviction on misdemeanor charges such as shoplifting," the TRAC report concluded.

Federal immigration authorities are crediting a crucial team effort with local law enforcement agencies nationwide for a substantial increase in the number of criminally convicted illegal aliens in the last year.

The Department of Homeland Security’s largest investigative agency, Immigration and Customs Enforcement (ICE), reports that agents assigned to find fugitives who have ignored deportation orders have increasingly apprehended illegal aliens with criminal records.

Nearly half of the 35,000 immigrants arrested by ICE during the 2009 fiscal year have been convicted of crimes in U.S. courts, according to the agency’s records. The figure marks an increase of 23% from the previous fiscal year and illustrates the operation’s success in ridding communities across the country of dangerous criminals who shouldn’t even be in the U.S.

ICE officials attribute the success to a closer working relationship with local police departments that notify immigration authorities when an illegal alien is arrested and help the feds develop leads. The local-federal partnership is known as 287(g) and is ardently opposed by Latino advocates who claim it instills fear in immigrant neighborhoods and gives local police a green light to commit racial profiling and civil rights abuses.

In fact, a few months ago a coalition of influential Latino and civil rights organizations demanded that the Obama Administration terminate the 287(g) program because it exacerbates racial profiling. In a stern two-page letter to the president the army of politically-connected immigrant rights groups said local law enforcement agencies nationwide are abusing the program to target communities of color.

Obama has caved in to the powerful La Raza movement by weakening 287(g) even though it has helped reduce violent crime in local communities and aided in the deportation of thousands of criminal illegal aliens who would otherwise fall through the cracks. To obtain details relating to the incomprehensible changes, Judicial Watch filed a Freedom of Information Act lawsuit against the Department of Homeland Security because the agency has exceeded the deadline on a July public records request.

WASHINGTON – While the military "quagmire" in Iraq was said to tip the scales of power in the U.S. midterm elections, most Americans have no idea more of their fellow citizens – men, women and children – were murdered this year by illegal aliens than the combined death toll of U.S. troops in Iraq and Afghanistan since those military campaigns began. Though no federal statistics are kept on murders or any other crimes committed by illegal aliens, a number of groups have produced estimates based on data collected from prisons, news reports and independent research. Twelve Americans are murdered every day by illegal aliens, according to statistics released by Rep. Steve King, R-Iowa. If those numbers are correct, it translates to 4,380 Americans murdered annually by illegal aliens. That's 21,900 since Sept. 11, 2001. Total U.S. troop deaths in Iraq as of last week were reported at 2,863. Total U.S. troop deaths in Afghanistan, Pakistan and Uzbekistan during the five years of the Afghan campaign are currently at 289, according to the Department of Defense. But the carnage wrought by illegal alien murderers represents only a fraction of the pool of blood spilled by American citizens as a result of an open border and un-enforced immigration laws. While King reports 12 Americans are murdered daily by illegal aliens, he says 13 are killed by drunk illegal alien drivers – for another annual death toll of 4,745. That's 23,725 since Sept. 11, 2001. While no one – in or out of government – tracks all U.S. accidents caused by illegal aliens, the statistical and anecdotal evidence suggests many of last year's 42,636 road deaths involved illegal aliens. A report by the AAA Foundation for Traffic Study found 20 percent of fatal accidents involve at least one driver who lacks a valid license. In California, another study showed that those who have never held a valid license are about five times more likely to be involved in a fatal road accident than licensed drivers. Statistically, that makes them an even greater danger on the road than drivers whose licenses have been suspended or revoked – and nearly as dangerous as drunk drivers. King also reports eight American children are victims of sexual abuse by illegal aliens every day – a total of 2,920 annually. Based on a one-year in-depth study, Deborah Schurman-Kauflin of the Violent Crimes Institute of Atlanta estimates there are about 240,000 illegal immigrant sex offenders in the United States who have had an average of four victims each. She analyzed 1,500 cases from January 1999 through April 2006 that included serial rapes, serial murders, sexual homicides and child molestation committed by illegal immigrants. As the number of illegal aliens in the U.S. increases, so does the number of American victims. According to Edwin Rubenstien, president of ESR Research Economic Consultants, in Indianapolis in 1980, federal and state correctional facilities held fewer than 9,000 criminal aliens. But at the end of 2003, approximately 267,000 illegal aliens were incarcerated in all U.S. jails and prisons. While the federal government doesn't track illegal alien murders, illegal alien rapes or illegal alien drunk driving deaths, it has studied illegal aliens incarcerated in U.S. prisons. In April 2005, the Government Accountability Office released a report on a study of 55,322 illegal aliens incarcerated in federal, state, and local facilities during 2003. It found the following: The 55,322 illegal aliens studied represented a total of 459,614 arrests – some eight arrests per illegal alien; Their arrests represented a total of about 700,000 criminal offenses – some 13 offenses per illegal alien; 36 percent had been arrested at least five times before. "While the vast majority of illegal aliens are decent people who work hard and are only trying to make a better life for themselves and their families, (something you or I would probably do if we were in their place), it is also a fact that a disproportionately high percentage of illegal aliens are criminals and sexual predators," states Peter Wagner, author of a new report called "The Dark Side of Illegal Immigration." "That is part of the dark side of illegal immigration and when we allow the 'good' in we get the 'bad' along with them. The question is, how much 'bad' is acceptable and at what price?"
