Congress seems to have forgotten America's millions of unemployed

Congress seems focused on budget cuts rather than on programs to get the one-sixth of U.S. workers who are unemployed or underemployed back to work. Columnist Paul Krugman says a lack of jobs is the problem and the focus needs to be on creating them.

More than three years after we entered the worst economic slump since the 1930s, a strange and disturbing thing has happened to our political discourse: Washington has lost interest in the unemployed.

Jobs do get mentioned now and then — and a few political figures, notably Nancy Pelosi, the Democratic leader in the House, are still trying to get some kind of action. But no jobs bills have been introduced in Congress, no job-creation plans have been advanced by the White House, and all the policy focus seems to be on spending cuts.

So one-sixth of America's workers — all those who can't find any job or are stuck with part-time work when they want a full-time job — have, in effect, been abandoned.

It might not be so bad if the jobless could expect to find new employment fairly soon. But unemployment has become a trap, one that's very difficult to escape. There are almost five times as many unemployed workers as there are job openings; the average unemployed worker has been jobless for 37 weeks, a post-World War II record.

In short, we're well on the way to creating a permanent underclass of the jobless. Why doesn't Washington care?

Part of the answer may be that while those who are unemployed tend to stay unemployed, those who still have jobs are feeling more secure than they did a couple of years ago. Layoffs and discharges spiked during the crisis of 2008-2009 but have fallen sharply since then, perhaps reducing the sense of urgency. Put it this way: At this point, the U.S. economy is suffering from low hiring, not high firing, so things don't look so bad — as long as you're willing to write off the unemployed.

Yet polls indicate that voters still care much more about jobs than they do about the budget deficit. So it's quite remarkable that inside the Beltway, it's just the opposite.

What makes this even more remarkable is the fact that the economic arguments used to justify the D.C. deficit obsession have been repeatedly refuted by experience.

On one side, we've been warned, over and over again, that "bond vigilantes" will turn on the U.S. government unless we slash spending immediately. Yet interest rates remain low by historical standards; indeed, they're lower now than they were in the spring of 2009, when those dire warnings began.

On the other side, we've been assured that spending cuts would do wonders for business confidence. But that hasn't happened in any of the countries currently pursuing harsh austerity programs. Notably, when the Cameron government in Britain announced austerity measures last May, it received fawning praise from U.S. deficit hawks. But British business confidence plunged, and it has not recovered.

Yet the obsession with spending cuts flourishes all the same — unchallenged, it must be said, by the White House.

I still don't know why the Obama administration was so quick to accept defeat in the war of ideas, but the fact is that it surrendered very early in the game. In early 2009, John Boehner, now the speaker of the House, was widely and rightly mocked for declaring that since families were suffering, the government should tighten its own belt. That's Herbert Hoover economics, and it's as wrong now as it was in the 1930s. But, in the 2010 State of the Union address, President Barack Obama adopted exactly the same metaphor and began using it incessantly.

And earlier this week, the White House budget director declared: "There is an agreement that we should be reducing spending," suggesting that his only quarrel with Republicans is over whether we should be cutting taxes, too. No wonder, then, that according to a new Pew Research Center poll, a majority of Americans see "not much difference" between Obama's approach to the deficit and that of Republicans.

So who pays the price for this unfortunate bipartisanship? The increasingly hopeless unemployed, of course. And the worst hit will be young workers — a point made in 2009 by Peter Orszag, then the White House budget director. As he noted, young Americans who graduated during the severe recession of the early 1980s suffered permanent damage to their earnings. And if the average duration of unemployment is any indication, it's even harder for new graduates to find decent jobs now than it was in 1982 or 1983.

So the next time you hear some Republican declaring that he's concerned about deficits because he cares about his children — or, for that matter, the next time you hear Obama talk about winning the future — you should remember that the clear and present danger to the prospects of young Americans isn't the deficit. It's the absence of jobs.

But, as I said, these days Washington doesn't seem to care about any of that. And you have to wonder what it will take to get politicians caring again about America's forgotten millions.

Labor Dept. Helps Illegal Alien Workers

The Department of Labor has launched a special program to assist and protect illegal immigrant workers in the U.S., referred to as “vulnerable” and “underpaid” by the presidential cabinet member who heads the agency.

Hundreds of new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees. Their message, in Spanish, is “we can help” bring workplace protections to the nation’s most vulnerable and underpaid workers, including those who have no legal right to live in the United States.



Labor Secretary Hilda Solis, a former California congresswoman with close ties to the influential La Raza movement, announced the “We Can Help” project with great fanfare a few days ago. A total of 1,000 investigators from her agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.



Solis told Latino workers that “your president, your secretary of labor and this department will not allow anyone to be denied his or her rightful pay, especially when so many in our nation are working long, hard and often dangerous hours.” She assured illegal immigrants that “if you work in this country, you are protected by our laws.”

The same day Solis publicly announced the Obama Administration’s new project, a Labor Department investigator visited a day laborer center in northern California to promote it. The federal employee actually chatted warmly with the illegal immigrants about how to find jobs without being exploited, according to a local newspaper report. “We’re the feds but the good ones,” he told the day laborers in Spanish. “We’re here to help workers.”

The agency has also launched a Spanish television advertising campaign to spread the word and created a web site. Workers in industries from construction to food service are urged to contact the Labor Department of wage and hour violations. An investigator may be deployed to the work site or the employer may be taken to court.

While in Congress, she opposed strengthening the border fence, supported expansion of illegal alien benefits (including driver's licenses and in–state tuition discounts), embraced sanctuary cities that refused to cooperate with federal homeland security officials to enforce immigration laws, and aggressively championed a mass amnesty. Solis was steeped in the pro–illegal alien worker organizing movement in Southern California and was buoyed by amnesty–supporting Big Labor groups led by the Service Employees International Union. She has now caused a Capitol Hill firestorm over her new taxpayer–funded advertising and outreach campaign to illegal aliens regarding fair wages:

What you need to know is that this longtime open–borders sympathizer has always had a rather radical definition of "American." To be sure, no one should be scammed out of "fair wages." Employers that hire and exploit illegal immigrant workers deserve full sanctions and punishment. But it's the timing, tone–deafness and underlying blanket amnesty agenda of Solis' illegal alien outreach that has so many American workers and their representatives on Capitol Hill rightly upset.



With double–digit unemployment and a growing nationwide revolt over Washington's border security failures, why has Solis chosen now to hire 250 new government field investigators to bolster her illegal alien workers' rights campaign? (Hint: Leftists unhappy with Obama's lack of progress on "comprehensive immigration reform" need appeasing. This is a quick bone to distract them.)

Unfortunately, the federal government is not alone in lavishing attention and resources on workers who shouldn't be here in the first place. As of 2008, California, Florida, Nevada, New York, Texas and Utah all expressly included illegal aliens in their state workers' compensation plans –– and more than a dozen other states implicitly cover them.

Solis' public service announcement comes on the heels of little–noticed but far more troubling comments encouraging illegal alien workers in the Gulf Coast. Earlier this month, in the aftermath of the BP oil spill, according to Spanish language publication El Diario La Prensa, Solis signaled that her department was going out of its way to shield illegal immigrant laborers involved in cleanup efforts. "My purpose is to assist the workers with respect to safety and protection," she said. "We're protecting all workers regardless of migration status because that's the federal law." She told reporters that her department was in talks with local Immigration and Customs Enforcement (ICE) officials who had visited coastal worksites to try to verify that workers were legal.

No word yet on whether she gave ICE her "we are all Americans, whether you are legalized or not" lecture. But it's a safe bet.

MOST MEXICAN IMMIGRANTS IN NEW STUDY GAVE UP JOBS TO TAKE THEIR CHANCES IN U.S.

A report about the work lives of recent Mexican immigrants in seven cities across the United States suggests that they typically traded jobs in Mexico for the prospect of work here, despite serious bouts of unemployment, job instability and poor wages.

The report, released Tuesday by the Pew Hispanic Center, was based on surveys of nearly 5,000 Mexicans, most of them here illegally.

Those surveyed were seeking identity documents at Mexican consulates in New York, Atlanta and Raleigh, N.C., where recent arrivals have gravitated toward construction, hotel and restaurant jobs, and in Dallas, Chicago, Los Angeles, and Fresno, Calif., where they have been more likely to work in agriculture and manufacturing.

Unlike the stereotype of jobless Mexicans heading north, most of the immigrants had been employed in Mexico, the report found.

Once in the United States, they soon found that their illegal status was no barrier to being hired here. And though the jobs they landed, typically with help from relatives, were often unstable and their median earnings only $300 a week, that was enough to keep drawing newcomers because wages here far exceeded those in Mexico.

"We're getting a peek at a segment of the U.S. labor force that is large, that is growing by illegal migration, and that is bringing an entirely new set of issues into the U.S. labor market," said Rakesh Kochhar, associate director for research at the Pew Hispanic Center and author of the study.

The report suggested that policies intended to reduce migration pressures by improving the Mexican economy would have to look beyond employment to wages and perceptions of opportunity.

The survey found that the most recent to arrive were more likely to have worked in construction or commerce, rather than agriculture, in Mexico. Only 5 percent had been unemployed there; they were "drawn not from the fringes, but from the heart of Mexico's labor force," the report said.

After a difficult transition in their first six months in the United States about 15 percent of the respondents said they did not work during that time the rate of unemployment plummeted, to an average of 5 percent.

But in one of the most striking findings, 38 percent reported an unemployment spell lasting a month or more in the previous year, regardless of their location, legal status or length of time in the United States.

"These are workers with no safety net," Mr. Kochhar said. "The long run implication is a generation of workers without health or pension benefits, without any meaningful asset accumulation."

On the other hand, Mr. Kochhar and Roberto Suro, director of the Pew Hispanic Center, said the flexibility of this work force was a boon to certain industries like home construction, an important part of the nation's economic growth since the last recession.

Among respondents to the survey, those who settled in Atlanta and Dallas were the best off, with 56 percent in each city receiving a weekly wage higher than the $300 a week median. The worst off were in Fresno, where more than half of the survey respondents worked in agriculture and 60 percent reported earning less than $300 a week. The lowest wages were reported by women, people who spoke little or no English, and those without identification.

Former U.S. immigration attorney sentenced for taking more than $400,000 in bribes to help illegal immigrants

A former federal immigration attorney from Rancho Cucamonga was sentenced Monday to 17 years in prison for accepting more than $400,000 in bribes in exchange for helping illegal immigrants remain in the United States.



Constantine Peter Kallas, 40, was convicted last year of three dozen felony counts, including bribery, obstruction of justice, fraud, identity theft and tax evasion.



The former assistant chief council with U.S. Immigration and Customs Enforcement operated a far-reaching scheme in which he falsely represented himself to immigrants as a judge, illegally claimed worker's compensation benefits and misappropriated the identities of others, prosecutors said.



In a sentencing memorandum filed in court, prosecutors described the case as "an epic display of a public official's greed."



"Mr. Kallas has received one of the longest sentences ever seen in a public corruption case," U.S. Atty. Andre Birotte Jr. said in a statement.



He added that Kallas had obtained the money by "exploiting his knowledge of the immigration system." Kallas' attorney, Dean Steward, said that before the sentencing, his client expressed remorse in a statement to Judge Terry Hatter Jr. Kallas, who has been in custody since his arrest in 2008, planned to file an appeal this week, Steward said.



"We are deeply disappointed in the sentence -- for a white-collar case, it's a really lengthy period of time," Steward said Monday afternoon. "I have handled federal homicide cases where the defendant got less."



The U.S. attorney's office in Los Angeles also released a surveillance video showing Kallas accepting an envelope filled with $20,000 in cash from a government informant at the San Manuel Indian Bingo Casino in Highland.



Prosecutors used the video as evidence during Kallas' three-week trial last April. In the video recorded in June 2008, Kallas takes a manila envelope from the informant and says, "I'm going to put it in my pocket, OK? I'm not going to go anywhere."



Kallas was arrested about 10 minutes after the clip ends, said Thom Mrozek, a spokesman for the U.S. attorney's office in L.A.



"Certainly it was not a particularly bright idea to have a meeting at a casino where there are numerous surveillance cameras," Mrozek said. "It was the cameras installed at the facility that allowed us to get this high-quality tape that was shown to the jury."



In addition to his government salary, Kallas and his wife, Maria, deposited $950,000 into their bank accounts since 2000, said Assistant U.S. Atty. Raymond Aghaian.



Of that amount, at least $425,854 came in the form of payments from illegal immigrants. Investigators also found $177,000 in cash and more than two dozen official immigration files hidden in a floor safe at the Kallas' home, Aghaian said.



Prosecutors claimed that Kallas and his wife told illegal immigrants he was a high-ranking immigration official or judge who could obtain benefits for them in exchange for the bribes. Kallas even went so far as to appear in immigration court without authorization to defend his housekeeper's daughter in a 2006 deportation hearing, they said.



Kallas told the judge that the defendant was assisting other ICE investigations and successfully requested that her case be dismissed, Aghaian said.



The housekeeper had paid about $7,500 to Kallas and was working for him for free, Aghaian said.



"This is a corrupt public official who engaged in a conspiracy to commits crimes with the very people he was supposed to prosecute," Aghaian said. "He essentially put the entire integrity of our judicial system at risk by committing these acts."



In addition to his prison sentence, Kallas was ordered to pay $296,865 in restitution for worker's compensation benefits he had received fraudulently.



Kallas had joined ICE's predecessor agency in 1998. He has been on unpaid leave since January 2007.



Maria Kallas, 41, pleaded guilty to conspiracy charges in November 2009. She is set to be sentenced in May.

Obama: Now a Hero in Brazil, Too

Monday's “news analysis,” “President Underscores Similarities With Brazilians, but Sidesteps One,” found reporters Alexei Barrionuevo and Jackie Calmes with Obama in Rio de Janeiro highlighting the president’s positive reception in Brazil,inspiring the citizenry "because of his African heritage."

From a visit to this city’s most infamous slum to a national address amid the gilded elegance of a celebrated theater, President Obama on Sunday sought to underscore the shared histories and futures of the United States and Brazil, reaching out to the people of one of the most racially diverse countries in the Americas.



But Mr. Obama, on the second day of a five-day tour of Latin America, once again seemed to sidestep mentioning his own racial background in appearances here, even as Brazilians who gathered at a plaza trying to catch a glimpse of him said that he had inspired millions in this country because of his African heritage.



“Because he knows the reality of discrimination against blacks, it would be very important for him to pass on the message that it is possible to get somewhere, to be someone, in spite of all the difficulties,” said CĂ©lio Frias, a 46-year-old businessman. “He is an inspiration.”

Paris correspondent Scott Sayare previously engaged in foreign fawning in a September 23, 2010 story praising Obama’s magical abilities to transform world opinion by his very existence: “But anti-American sentiment, once pervasive in these neighborhoods, seems to have been all but erased since the election of Mr. Obama, who has proved to be a powerful symbol of hope here and a powerful diplomatic tool.”



Mr. Obama, characteristically, did not overtly address his race, or race in general, in several joint appearances with Ms. Rousseff on Saturday.



He came closest in their meeting with business executives from American and Brazilian corporations, but Mr. Obama spoke indirectly, more in terms of social and economic status than race. He hailed “the American dream” as appropriate for both the United States and Latin America, defining it as “the idea that no matter who you are, or where you come from, or how you start out, you can overcome the greatest obstacles and fulfill the greatest hopes.”



“I’m a testament to that dream,” he said.



Through his long presidential campaign and since, Mr. Obama has often seemed to address the issue only when forced to by outside events -- like the campaign controversy over racially divisive sermons by his former pastor, the Rev. Jeremiah A. Wright Jr., or a 2009 furor over the arrest of Henry Louis Gates Jr., a black Harvard professor and friend, as Mr. Gates tried to enter his own home.



Did anyone “force” Obama to make his ill-advised commentary on the Gates matter, in which he said that a white Cambridge police officer had “acted stupidly” before being forced to backtrack?



Barrionuevo and Calmes threw in polls from Latin America tho prove Obama’s election had improved America’s reputation in Latin America.

Opinion polls in the region show that Mr. Obama’s election has also improved Latin American countries’ opinion of the United States as a whole. Among Brazilians, those with a favorable view increased by 16 percentage points from 57 percent in 2008 to 73 percent in 2009, according to Latinobarometro, a polling company in Santiago, Chile. The increase was higher among blacks and those of mixed race surveyed than among whites.

House Republicans: Failing mortgage-aid programs should go

WASHINGTON — A handful of foreclosure prevention measures run by the Obama administration are so ineffectual, inefficient and complicated that, according to Republicans in the House of Representatives, the programs should be killed outright.

The House is scheduled to vote this week on getting rid of a refinance program for Federal Housing Administration loans and another program, scheduled to begin next month, that would help homeowners with delinquent payments.

The House Financial Services Committee is expected to vote Wednesday morning on ending two other measures: One of them is a massive effort that was designed to adjust up to 4 million mortgages but so far has tackled just half a million successfully. The other is the Neighborhood Stabilization Program, which steers money to communities hit hard by foreclosures.

The Treasury Department and many Democrats argue, though, that the programs — though flawed — are fixable, and consumer advocates say the measures offer the last, best hope for many struggling families.

"It's all we have," said Hazel Mack-Hilliard, the director of the mortgage foreclosure project with Legal Aid of North Carolina. "To have nothing and just say let the lenders do it, that's worse than nothing."

The bills' chances of becoming law are slight, because Democrats control the Senate and the Obama administration supports the programs. But Republicans say their effort will shine a light on inefficient programs that they say aren't working and, in the worst cases, do more harm than good.

Altogether, killing the programs could save the federal government a few billion dollars. But the real problem, said Rep. Patrick McHenry, R-N.C., is that families sometimes are hurt more than they're helped. McHenry will read from constituents' stories at Wednesday's committee meeting, telling of how homeowners were strung out on the hope of receiving mortgage modifications only to be told eventually that they didn't qualify.

In the meantime, he said, they've exhausted their savings, killed their credit and lost places to live.

"It's just heartbreaking stuff," McHenry said. He's sponsored the HAMP Termination Act, which aims to kill the Home Affordable Modification Program.

Through that program, the government pays banks and other servicers to adjust mortgages voluntarily. But of nearly $30 billion allocated to HAMP, only $1 billion has been spent.

Neil Barofsky, the special inspector general for the modification programs through the Troubled Asset Relief Program, told Congress last week that "HAMP has been beset by problems from the outset and, despite frequent retooling, continues to fall woefully short of meeting its original expectations."

He blamed the Treasury Department for refusing to adopt "meaningful goals and benchmarks" for the program, but he stopped short of saying the Home Affordable Modification Program should be shuttered altogether.

Treasury Secretary Timothy Geithner told Congress in separate testimony last week that he wants to keep the program.

The mortgage crisis isn't going away. Despite other signs of economic recovery, foreclosure filings across the country continue at a record pace. RealtyTrac, which tracks foreclosures around the U.S., predicts that filings will increase another 20 percent this year, topping 3 million, according to Barofsky's testimony.

Republicans' efforts to kill the assistance programs come as mortgage servicers are under congressional investigation for what Democrats describe as foreclosure fraud, robo-signing and other abuses.

At a hearing Tuesday in his home city of Baltimore, Rep. Elijah Cummings, the top Democrat on the House oversight committee, described the foreclosure crisis as a "wrecking ball" through the nation's communities.

Cummings said he was seeking documents from 10 mortgage-servicing companies: Bank of America, Wells Fargo & Co., JPMorgan Chase & Co., CitiMortgage Inc., Ally Bank/Residential Capital LLC, U.S. Bank Home Mortgage, SunTrust Bank, PHH Mortgage, PNC Mortgage/National City and MetLife Home Loans.

A report last month from the Congressional Research Service said servicers often had financial incentives to move ahead with foreclosures rather than modify mortgages, even when it wasn't in the best interests of the investors in the mortgages.

On Wednesday, the House is scheduled to begin debate on two measures: to kill the FHA Refinance Program and the Emergency Mortgage Relief Program.

The first, designed to refinance homes purchased under FHA loans, has resulted in the refinancings of just 22 homes as of the end of December, according to the Congressional Research Service. The second, meant to help homeowners who face delinquent payments, is scheduled to begin next month.

Votes in the full House are expected by the end of the week.

The other two bills — the HAMP Termination Act and the National Stabilization Program Termination Act — are expected to pass committee votes Wednesday. They could come to the House floor within a month.

The economic crisis was an 'inside job'

If you haven't been humming tunes from "Les Misérables," you haven't seen "Inside Job," the new documentary about how our economic crisis evolved.

The most forgiving American will want to seize a pitchfork and march on Wall Street. Or Harvard Square. Or in front of the White House. There are so many despicable parties, it's hard to pick a favorite. Is it time to reconsider the Axis of Evil?

The film, written and directed by Charles Ferguson (and narrated by Matt Damon), will be opening in select cities this week. Although much of the story is familiar, Ferguson manages to weave together decades of bits and pieces into a dramatic narrative that plays like a whodunit. Names have faces, and storytelling combined with graphic illustrations helps explain the complex series of events that led to the global meltdown. Here are a few takeaways:

One, trying to assign blame to either Democrats or Republicans is pointless. Everyone is culpable. From the early 1980s, when Ronald Reagan deregulated banks, through the two Bushes, Bill Clinton and now Barack Obama, each administration has endorsed -- and each Congress has helped tweak -- laws and rules that made systemic abuses and the meltdown not only possible but, looking back, inevitable.

Two, many investment bankers knew the mortgage loans they were packaging and selling were junk. They knew because their own analysts told them so. Tens of thousands of loans failed to meet basic underwriting standards, according to recent testimony before the Financial Crisis Inquiry Commission, a bipartisan group created to examine the causes of the meltdown. Not only that, Wall Street insiders were betting against their own customers and institutions.

Throughout the system, from the lending institutions to federal regulators to congressional overseers, those charged with protecting consumers averted their eyes.

Three, the cozy relationship between Wall Street and Ivy League academia, wherein economists push policies that benefit them financially, is eye-opening. In some cases, business professors and economists at America's top schools were shown to have conflicts of interest as they advanced policies for which they had been paid directly or that otherwise benefited them.

In other instances, we see that the same people who created policies that ultimately led to these abuses are still -- or were until recently -- running the show. Notably missing from the film, declining to be interviewed, are Larry Summers, Tim Geithner, Hank Paulson, Alan Greenspan and Robert Rubin.

This is not to say that what benefits Wall Street necessarily hurts average Americans or that all bankers are corrupt, but the system clearly enabled the abuses that have led to current circumstances. The attitude seemed to be that everyone was doing it.

When the big banks failed, of course, taxpayers were left holding the bag. Even though there was wide consensus that the bailouts were necessary to get credit moving again, there is simply no justification for the bonuses and golden parachutes that went to the very people who drove their institutions -- and us -- off a cliff. Reward for failure was the best gig in town.

Although most of what the movie highlights is familiar, there's something jarring about seeing the culprits up close in all their taxpayer-subsidized, suntanned splendor -- their multiple estates and private jets juxtaposed against shuttered homes and unemployed Americans living in tents. Obscene is the word that comes to mind.

I'm not one to advance class warfare, and most Americans still want to preserve a market system that leaves open the possibility that they, too, can work hard and achieve wealth. But it's clear from "Inside Job" that the game has been rigged so that only a few were in positions to get rich at the expense of the middle class, not just here but globally.

The movie isn't perfect. One wonders what was left on the editing floor. Some of those interviewed, who dodged questions or gave unacceptable answers, also looked stupid. None of these guys is stupid.

And, at the end, Ferguson couldn't resist making an editorial comment as the camera panned the Statue of Liberty. "Some things are worth fighting for."

We get it. The film is so well done and presented so factually that no Hollywood prodding was needed. Anyone who sees this movie will be furious. Thus, the only remaining question is why some of these people aren't being prosecuted for fraud or at least shirking fiduciary duty.

It would seem as never before that the White House should hire a special prosecutor. Ferguson's movie, which the president and his economic team had best watch -- and soon -- could use a sequel: "The Perp Walk."

Obama’s phony banking “reform”

Debate on the Senate version of the Obama administration’s bank regulatory overhaul is expected to begin shortly. The House of Representatives passed its banking bill last December.

Neither bill does anything to curb the power of the banks or limit their parasitic and socially destructive activities. What the media is calling the “most sweeping overhaul” of the banking system since the Great Depression in reality sanctions the ever greater monopolization of the financial system by a handful of Wall Street giants, imposes no limits on executive pay, and allows the banks and hedge funds to continue gambling on exotic and largely unregulated securities such as collateralized debt obligations and credit default swaps.

The so-called bank “reform” is an exercise in mass deception—an attempt to placate popular hostility to the banks and provide the government with political cover while it continues to do the bidding of Wall Street.

The bills have been drawn up in the closest consultation with bankers and bank lobbyists. This collusion has been widely reported in the press and presented as a perfectly normal and acceptable fact of political life. The front-page lead article in Monday’s Wall Street Journal describes the intensive lobbying being carried out by billionaire investor Warren Buffet to alter the Senate bill’s provisions on derivatives.

Buffet, an Obama supporter, wants to exempt existing derivatives deals from collateral requirements in the current language of the bill—a change that would save him billions on his $63 billion derivatives portfolio. Both senators from his home state of Nebraska, one Democrat and one Republican, are championing his cause.

This is just one example of the web of corruption and bribery that extends from Wall Street to the White House and Capitol Hill. The banks have thus far spent $455 million lobbying Congress on the overhaul and handed out $34 million in 2010 election campaign donations, most of it to Democrats.

The circle of corruption includes the ratings companies such as Moody’s and Standard & Poor’s, which blessed toxic subprime mortgage-backed securities with triple-A ratings in return for fees from the banks they were rating, and government regulators who move seamlessly from regulatory offices to lucrative posts at the banks they were supposedly overseeing.

The colossuses of Wall Street amass their huge profits by means of fraud and swindling. Over the past few weeks systematic accounting fraud at Lehman Brothers has been exposed and the Securities and Exchange Commission has indicted Goldman Sachs for defrauding its clients in the run-up to the subprime mortgage crash. This is only the tip of the iceberg.

Obama’s so-called reform will do nothing to hold accountable the criminals at the head of the banks and hedge funds or break up the financial behemoths that exert a stranglehold on the economy. Instead, it will set up a mechanism to institutionalize government rescue operations of big financial firms to protect the interests of bank executives, shareholders and creditors, ultimately at public expense.

The lawless and reckless actions of Wall Street CEOs have had devastating consequences for tens of millions of people in the US and around the world. The wreckage left in the wake of the financial tsunami of 2008 is registered in millions of lost jobs, home foreclosures, utility shutoffs, and rising hunger, disease and poverty.

With the help of trillions of dollars in taxpayer bailouts, the bankers are making more money today than ever, even as schools are closed, libraries disappear and museums and opera houses are shuttered. There is, the people are told, “no money” for jobs or basic social services.

There is plenty of money. The problem is that it is concentrated in the hands of a financial aristocracy. The immense concentration of wealth among these individuals is not only morally repugnant, it is a menace to society. It is the result of the plundering of the social wealth to feed criminal appetites, at the direct cost of the productive forces.

During the rise of American capitalism as an industrial power, the vast fortunes of the corporate elite, while achieved through ruthless exploitation of the working class, were associated with the expansion of industry and the production of useful products. That is not the case with today’s financial elite. Its wealth is amassed on the basis of financial manipulation and outright fraud, linked to the destruction of the social infrastructure and industry.

The Socialist Equality Party advocates a policy that proceeds from the needs of the people and society as a whole, not the personal fortunes of the bankers and big investors. We call for:

• The criminal prosecution of bankers and speculators whose illegal actions contributed to the deepest economic crisis since the Great Depression. They must be held legally accountable and given appropriate sentences to prevent a recurrence of such practices.

• The expropriation of the wealth of the top bankers, hedge fund managers, traders and speculators. This would immediately free up several trillion dollars, money that could go to a public works program to provide jobs and rebuild the social infrastructure—schools, housing, clinics, libraries, cultural facilities, the energy system. This money could also be used to help provide relief to the victims of the economic crisis—to maintain full wages for those laid off, put a stop to foreclosures and utility shutoffs, provide full medical coverage.

• The nationalization of the banks and major financial institutions and their transformation into public utilities under the democratic control of the working population. This is a prerequisite for the rational and planned development of the economy and the allocation of resources to rebuild the social infrastructure, end poverty, raise living standards and overcome social inequality.

Only such a socialist program can break the grip of the financial aristocracy and liberate the productive forces for the benefit of society as a whole. It can be achieved only through the independent political mobilization of the working class against Obama, the two parties and big business, and the capitalist system that they defend.

Hacked e-mails reveal plans for dirty-tricks campaign against U.S. Chamber foes

A feud between a security contracting firm and a group of guerrilla computer hackers has spilled over onto K Street, as stolen e-mails reveal plans for a dirty-tricks-style campaign against critics of the U.S. Chamber of Commerce.

The tale began this month when a global hackers collective known as Anonymous broke into the computers of HBGary Federal, a California security firm, and dumped tens of thousands of internal company e-mails onto the Internet.

The move was in retaliation for assertions by HBGary Federal chief executive Aaron Barr that he had identified leaders of the hackers' group, which has actively supported the efforts of anti-secrecy Web site WikiLeaks to obtain and disclose classified documents.

The e-mails revealed, among other things, a series of often-dubious counterintelligence proposals aimed at enemies of Bank of America and the chamber. The proposals included distributing fake documents and launching cyber-attacks.

The chamber has adamantly denied any knowledge of the "abhorrent" proposals, including some contained in a sample blueprint outlined for Hunton & Williams, a law and lobbying firm that works for the chamber. The business group said in a statement Monday that the proposal "was not requested by the Chamber, it was not delivered to the Chamber and it was never discussed with anyone at the Chamber."

Two other security firms named in the e-mails, Berico Technologies and Palantir Technologies, also have issued statements distancing themselves from the plans. HBGary Federal and Hunton & Williams declined to comment.

The hacked e-mails suggest that the three security firms worked with Hunton & Williams in hopes of landing a $2 million contract to assist the chamber. Some of the e-mails, which were highlighted by the liberal Web site ThinkProgress on Monday, seem to suggest that the chamber had been apprised of the efforts. The chamber denied any such knowledge.

(Bloomberg) -- President Barack Obama is considering naming William Daley, a JPMorgan Chase & Co. executive and former U.S. Commerce secretary, to a high-level administration post, possibly White House chief of staff, people familiar with the matter said.

Such a move, which is still under discussion, would bring a Washington veteran -- and someone with strong business ties -- into the administration as Obama sets out an agenda for the second half of his term while dealing with a Republican majority in the House of Representatives.

(CNSNews.com) - U.S. Chamber of Commerce President and CEO Tom Donohue, noting that 27 million Americans are unemployed, underemployed, or have given up on finding a job, said his organization supports a "way" "to legitimacy" for the estimated 12 to 14 million illegal aliens who are working in the United States.

“Unemployment had exceeded 9 percent for 20 consecutive months,” Donohue said in his annual State of American Business address at the Chamber’s headquarters in Washington, D.C., on Tuesday. “Some 27 million Americans are either unemployed, underemployed or have give up looking for work.”

“In fact,” Donohue said, “we must create 1.2 million jobs a year just to absorb the new entrants into our workforce.”

Later in his remarks, Donohue said the Chamber would continue its efforts in support of comprehensive immigration reform, which some conservative critics consider to be a form of amnesty.

“Almost all of us are sons, daughters, or descendents of immigrants,” Donohue said. “The Chamber will continue to pursue comprehensive immigration reform.” He also cited the "urgent" need to improve visa processing, oppose attempts to gut temporary worker programs, and increase the number of foreign worker visas.

At a press conference following his speech, Donohue was asked by CNSNews.com if comprehensive immigration reform included a so-called pathway to citizenship.

“We think the most important parts of comprehensive immigration reform would be, first of all, a way for the, shall we say 12 million here, to legitimacy so that they can easily participate in society, pay their taxes, drive cars and that sort of thing,” Donohue said. “Second we need a guest worker program,” he said. “People could easily come back and forth for work and some of that would be seasonally, for crops and for recreation organizations and so on.

“And third, we definitely need a way to deal with high-end, talented folks that are needed in this economy. Donohue called it "amazing" that after years of training in America, professionals such as Ph.Ds in chemical engineering are now finding it hard to stay here.

Donohue said citizenship for illegal aliens should not be the top priority. “I don’t think the citizenship thing is necessary right now,” said Donohue, adding that protecting the U.S. border was also important. “I think we ought to pick the four or five things that everybody needs and let’s get it done.”

Donohue also said that the United States should keep the promise it made to Mexico 15 years ago to allow “safe, carefully inspected” Mexican trucks to transport goods into the U.S., as called for in the North American Free Trade Agreement. Labor unions strongly oppose the plan.

Donohue said the U.S. economy is “in better shape than we found ourselves last year,” and he noted “a new tone coming out of the White House.”

One indication of warming relations between the White House and the Chamber, which represents 3 million mostly small businesses, includes a scheduled address by President Barack Obama at the group’s headquarters on Feb. 7.

Among the areas Donohue said the Chamber would concentrate on in 2011:

-- restraint and reform of the regulatory process, including stopping the EPA from enacting regulations to limit greenhouse gases – a task that should be left to Congress, he said.

--Expanding American trade, rebuilding the country’s infrastructure and developing U.S. energy resources, and reducing the federal debt and deficit also made the top four on Donohue’s to-do list.

Donohue concluded his remarks with his trademark line-in-the-sand approach while expressing optimism that the Chamber can “work together” with the Obama administration and Congress in the coming year.

“Our approach in Washington will be to call them as we see them,” Donohue said. ‘We’ll continue to have our differences with the White House on some issues but we’ll work together on other issues."

“We’ll support the new House leadership on many occasions, and we’ll work with Democratic legislators as well, but no one should expect the Chamber to march in lock step with anyone,” Donohue said.

“We have a clear mission and agenda of our own,” he said. “It’s to continue to win important policy victories for our members and the American business community. It’s to support, protect, and advance the free enterprise system that made this country great. And it’s to help create good jobs and promising opportunities for all the people of our country so that they can achieve the American dream."

Effort to Curb Illegal Workers' Hiring Blocked

A federal judge barred the Bush administration yesterday from launching a planned crackdown on U.S. companies that employ illegal immigrants, warning of its potentially "staggering" impact on law-abiding workers and companies.

In a firm rebuke of the White House, U.S. District Judge Charles R. Breyer of San Francisco granted a preliminary injunction against the president's plan to press employers to fire as many as 8.7 million workers with suspect Social Security numbers, starting this fall.

President Bush made the effort the centerpiece of a re-energized enforcement drive against illegal immigration in August after the Senate rejected his proposal to overhaul immigration laws. But the court ruling -- sought by major American labor, business and farm organizations -- highlighted the chasm that the issue has opened between the Republican Party and its traditional business allies.

The case also called attention to the gulf between Washington rhetoric about the need to curtail illegal immigration and the economic reality that many U.S. employers rely on illegal labor, as well as to the government's inability for nearly three decades to develop adequate tools for identifying undocumented workers.

In a 22-page ruling, Breyer said the plaintiffs -- an unusual coalition that included the AFL-CIO, the American Civil Liberties Union and the U.S. Chamber of Commerce -- had raised serious questions about the legality of the administration's plan to mail Social Security "no-match" letters to 140,000 U.S. employers.

"There can be no doubt that the effects of the rule's implementation will be severe," Breyer wrote, resulting in "irreparable harm to innocent workers and employers."

Immigrant Job Numbers Grow as American Employment Declines

On Thursday of last week, the House Judiciary Committee's Immigration Subcommittee met to hear testimony on the effect of immigration on the American job market. The hearing, entitled "New Jobs in Recession and Recovery: Who Are Getting Them and Who Are Not," is especially relevant given that many Americans are still struggling to find work in the midst of our nation's weak economy.

At the hearing, Dr. Rakesh Kochar, Associate Director for Research at the Pew Hispanic Center, testified that in the year following the official end of the recession (June 2009), foreign-born workers gained 656,000 jobs while native-born workers lost an additional 1.2 million jobs. Foreign born workers, he said represent 15.7% of the total American workforce and that the immigrant share of the U.S. working-age population is rising. Economist Heidi Shierholz, from the Economic Policy Institute, testified that despite the fact that economists have declared an official end to the recession, there are still 5.4 percent fewer jobs available than when the recession began in 2007. Shierholz argued that the immigration system is completely unresponsive to the economic cycle. "For example, in 2010, the unemployment rate in construction was over 20 percent, but the Department of Labor nevertheless certified thousands of H-2B visas for construction workers. This defies logic," she said. Part of immigration reform, she concluded, would take into account the actual needs of the economy and its ability to accept additional workers.

Additional testimony came from Steven Camarota, Director of Research for the Center for Immigration Studies, and Greg Serbon, State Director of Indiana Federation for Immigration Reform and Enforcement (IFIRE). Camarota voiced concern that jobs created over the past decade are primarily going to foreign-born workers, while the number of working-age natives with jobs has fallen dramatically. Mr. Serbon spoke out about against the plethora of visa programs which allow non-immigrants to work in America and the prevalence of non-immigrant temporary visa holders overstaying the authorized visa time.

Chairman of the Judiciary Committee, Congressman Lamar Smith (R-TX), stated that there is no more important issue that the subcommittee can address above how to preserve jobs for American workers. And when it comes to finding solutions for the unemployed and underemployed Americans who are still struggling, the Chairman made clear that the "answer is not to keep adding to the supply of low-skilled workers during a severe recession and its aftermath."

On Jan. 27, the Copley News Service reported that shortly after President Bush announced his plans to amnesty millions of illegal aliens in the U.S., more than half of the Mexicans trying to sneak into the U.S. through San Ysidro (search) told authorities they were doing so to position themselves for the amnesty.

As one member of the U.S. Border Patrol (search) told me, “They believe that they are only responding to an invitation.”

The percentage suggested by Copley probably does not come close to the actual number of people who are running for the American border as word of Bush’s immigration plan (search) spreads through Mexico -- and indeed throughout the world. Mexico, it seems, is now regarded the world over as the doorway to the United States.

In the last several weeks, a staggering 90 percent of all illegal aliens intercepted in one sector in southern Texas claim they’ve come for the amnesty.

Officers of the Border Patrol have now been directed to ask a set of questions of the illegal aliens they apprehend running across the border. One of those questions is: Is the person attempting to illegally enter the U.S. in response to the Bush amnesty proposal? To make arrests, Border Patrol officers often must dodge rocks being thrown at them by aliens as they cross. They then are told by all but 10 percent of the illegals they apprehend that it is the Bush amnesty (search) they've come for.

“The agents were soon told to stop collecting this information, presumably because it appeared as if the proposal was acting as a lure,” says my source within the Border Patrol.

Word of the 2000-mile wide open door between Mexico and the U.S. has spread far beyond Mexico. It is not just Mexicans who are flooding into our border states anymore. Along with the Nicaraguans, Brazilians, Venezuelans, Ecuadorians, and Chileans, agents of the Border Patrol now encounter Chinese, Pakistanis, and Indians. Nationals of countries other than Mexico are known, in Border Patrol parlance, as “OTMs.” (search) Because they cannot easily be returned to their home country (whereas a Mexican national might be driven right back across the border), OTMs are permitted to enter the U.S. and given a Notice to Appear, which is a piece of paper demanding their appearance before an Immigration Judge.

In Utah, the cheap-labor Chamber of Commerce lobby has taken over the Republican Party and is, in effect, blocking thousands of unemployed citizens and legal immigrants from jobs being held by illegal foreign workers.

Across the border in Arizona, though, the Republican Party has resisted the worst of corporate lobbying and put unemployed citizens and legal immigrants first, constantly trying to stop unscrupulous businesses from filling jobs with illegal aliens.

Channel 10 of Phoenix reported what happened when Sheriff Joe Arpaio raided a bunch of Pei Wei Asian Diners and led most of the workers there out in handcuffs because they were illegal aliens.

First, Pei Wei had to close its doors because it didn't have enough legal workers left.

Second, Pei Wei immediately started recruiting workers from among legal residents.

Finally, and triumphantly, as this newscast video so well shows, unemployed Americans created long lines to take the jobs.

How many times have you heard politicians, academic sophists and too many journalists facilely say that illegal aliens are just doing jobs Americans won't do? How many times have you heard that from a friend, co-worker or relative?

And how many times have you heard them specifically say that Americans are not going to lower themselves to wash the dishes in the restaurants you frequent?

Well, this video show all kinds of people willing to wash dishes for $8 an hour. You'll see Latino Americans say they are willing to do so. You'll see White Americans willing to do so. Young. Middle aged. One with a masters degree.

"I'm desperate," a young woman says. A middle-aged woman says if she were younger she would look for yard work but happy to wash dishes. "A job is a job," says Vince Flores, who refuses to be embarrassed about wanting a job that the elites of America sneer at.

Watch this video and renew your faith in the American people and their will to roll up their sleeves and do a job.

But in Utah, the Republican-led government has just decided that it is better to keep those kinds of Americans unemployed and keep the jobs in the hands of illegal aliens.

Across America, corporate American lobbyists are pushing the "Utah Compact" as the "compassionate" way to deal with immigration.

Yeah, right, compassionate to business owners who want to stiff unemployed Americans by hiring cheap illegal foreign labor.

Indiana and many other states are currently under great pressure by these Utah Compact Republicans to turn away from the compassionate immigration policies of Arizona and adopt Utah's meanspirited approach to unemployed Americans.

Mexicans Say Amnesty Will Boost Illegal Immigration

If President Obama keeps his promise of giving the nation’s 12 million illegal aliens amnesty it will encourage more Mexicans to enter the United States, according to residents of the struggling Latin American country who are undoubtedly rooting for the commander-in-chief’s plan.

The majority of illegal immigrants in the U.S. are from Mexico therefore the president’s reprieve project will greatly affect that nation. Two-thirds of Mexicans say they know someone living in the United States and around one-third have an immediate member of their household or close relative living in the U.S.

A majority of those residing south of the border say legalizing their undocumented countrymen will inspire more Mexicans to head north, according to a recent survey conducted by an internationally known polling and market research company. A vast majority of Mexicans with a relative in the United States said a legalization program would make people they know more likely to go to America illegally.

The results of the survey were made public this week by a research organization dedicated to studying the economic, social, fiscal and demographic impacts of immigration in the U.S. It reveals that nearly one-third of Mexican residents (nearly 40 million people) would like to live in the U.S. and if there was an amnesty a large number would come illegally with the hope of qualifying for a future exoneration.

An amnesty, therefore, would stimulate more illegal immigration which is the last thing this country needs. Furthermore, rewarding those who have violated our nation’s laws with coveted U.S. residency and possibly citizenship demeans the system, especially for those who follow the appropriate steps to come lawfully.

It’s bad enough that U.S. taxpayers annually dish out billions of dollars to educate, medically treat and incarcerate illegal aliens who are, in many cases, depleting local governments. Los Angeles County alone spends more than $1 billion a year, including $48 million a month in welfare costs, to provide services for illegal aliens. The crisis is hardly limited to border states, which have traditionally been the most impacted. Georgia’s skyrocketing illegal population costs taxpayers nearly $2 billion a year.

Labor Dept. Helps Illegal Alien Workers

The Department of Labor has launched a special program to assist and protect illegal immigrant workers in the U.S., referred to as “vulnerable” and “underpaid” by the presidential cabinet member who heads the agency.

Hundreds of new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees. Their message, in Spanish, is “we can help” bring workplace protections to the nation’s most vulnerable and underpaid workers, including those who have no legal right to live in the United States.



Labor Secretary Hilda Solis, a former California congresswoman with close ties to the influential La Raza movement, announced the “We Can Help” project with great fanfare a few days ago. A total of 1,000 investigators from her agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.



Solis told Latino workers that “your president, your secretary of labor and this department will not allow anyone to be denied his or her rightful pay, especially when so many in our nation are working long, hard and often dangerous hours.” She assured illegal immigrants that “if you work in this country, you are protected by our laws.”

The same day Solis publicly announced the Obama Administration’s new project, a Labor Department investigator visited a day laborer center in northern California to promote it. The federal employee actually chatted warmly with the illegal immigrants about how to find jobs without being exploited, according to a local newspaper report. “We’re the feds but the good ones,” he told the day laborers in Spanish. “We’re here to help workers.”

The agency has also launched a Spanish television advertising campaign to spread the word and created a web site. Workers in industries from construction to food service are urged to contact the Labor Department of wage and hour violations. An investigator may be deployed to the work site or the employer may be taken to court.

While in Congress, she opposed strengthening the border fence, supported expansion of illegal alien benefits (including driver's licenses and in–state tuition discounts), embraced sanctuary cities that refused to cooperate with federal homeland security officials to enforce immigration laws, and aggressively championed a mass amnesty. Solis was steeped in the pro–illegal alien worker organizing movement in Southern California and was buoyed by amnesty–supporting Big Labor groups led by the Service Employees International Union. She has now caused a Capitol Hill firestorm over her new taxpayer–funded advertising and outreach campaign to illegal aliens regarding fair wages:

Eight Out of Ten Illegal Aliens Apprehended in 2010 Never Prosecuted, Says Border Congressman

Washington (CNSNews.com) – An illegal alien apprehended by the U.S. Customs and Border Protection agency during the last fiscal year had an estimated 84 percent chance of never being prosecuted, according to figures compiled by the office of Rep. John Culberson (R-Texas).

Culberson submitted the figures for the record during a hearing Wednesday of the House Appropriations subcommittee on homeland security.



Of 447,731 illegal aliens apprehended by the U.S. Border Patrol during fiscal year 2010 (which ended last September), only 73,263 (16.4 percent) were prosecuted, according to the submitted data. That means that 374,468 illegal aliens that were taken into custody (83.6 percent) were never prosecuted

In case you are interested, that is 250 illegal alien child molesters. And that is just the tip of the iceberg.

When we talk about the costs to secure our borders, we need to ask "How many crimes against children is acceptable collateral damage?" Isn't that what it is all about? Cheap lettuce versus molested, raped and murdered children - a cost/benefit tradeoff.

Occasionally, the Federal Government decides to actually do something about some of the more violent illegal alien criminals - after they are already here and have committed mayhem! Operation Predator evolved out of ICE's mission to find and deport illegal aliens with the more heinous criminal records. The majority of the arrests under Operation Predator - roughly 85% - involved foreign nationals in this country whose child sex crimes made them removable from the United States. By matching immigration databases with state Megan's law directories, ICE agents have arrested more than 1,800 registered sex offenders.

Digressing for a moment, what the hell was a convicted, illegal alien sex offender even doing out of jail or not immediately deported – even if 63% do come right back - let alone roaming around the neighborhoods while on a registry! Has the judicial system in this country gone insane?

In any case, Operation Predator began on July 9, 2003, and resulted in 6,085 child predator arrests throughout the country - an average of roughly 250 arrests per month and eight arrests per day. While arrests have been made in every state, the most have occurred in these states: Arizona (207), California (1,578), Florida (255), Illinois (282), Michigan (153), Minnesota (190), New Jersey (423), New York (367), Oregon (148) and Texas (545).

While Operation Predator was a noble effort and ICE is to be commended, it only made a small dent in the criminal activity and number of horrific crimes being committed by illegal alien child sexual predators.

It is worth noting that some pedophile statistics report that each pedophile molests average of 148 children. If so, that could be as many as 900,580 victims from just the 6,085 illegal alien predators that were caught. Regardless, how many children being molested is acceptable collateral damage?

In fact, the criminal activity in the illegal alien community is now so bad that illegal aliens are being held for ransom and as slaves by other illegal aliens and smugglers are kidnapping illegal aliens from other smugglers! While it is a fact that most illegal aliens are law abiding, except for breaking immigration laws, it is also a fact that a significant percentage of illegal aliens have no respect for the rule of law and our legal customs. Many come with anti-American attitudes and philosophies that are totally alien to our culture, a subject addressed later in this paper. The end result is an ever-growing lawlessness among large portions of the illegal alien communities. It only makes sense that illegal alien criminals come to the United States - this is where the money is and our jails are a whole lot nicer than what they have in their home countries.

As previously noted, this report does not go into the property crimes being committed by illegal aliens. However, like the activities of other equal opportunity criminals, many property crimes are drug related, an activity that many illegal aliens, especially illegal alien gangs, are involved in. While violent crimes against one's person are the most serious, if your identity or car is stolen by an illegal alien you won't be too happy about it.

As a small example of property crimes, in 2003, according to the Arizona Department of Motor Vehicles, 57,600 cars were stolen in Phoenix alone. The owner losses are estimated to exceed $864 million. Most of the stolen cars ended up in Mexico and were never recovered. How many of those cars were stolen by illegal alien criminals versus resident criminals is unknown but you can rest assured that illegal aliens had a large part of it..

Government Data Imply High Immigrant Crime Rates; Findings Contradict Older Research Showing Low Rates

WASHINGTON, Nov. 19 /PRNewswire-USNewswire/ -- Center for Immigration Studies has published a detailed report on immigration and crime based on a variety of recently released data, including some obtained through Freedom of Information Act requests. The newer government data implies that immigrants have relatively high rates of crime. This contradicts older academic research that generally found low rates of crime. The overall picture of immigrants and crime remains confused due to conflicting information and a lack of good data.

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.

It is that policy alone which conflicts with SB 1070: Arizona wants to enforce the law; the Obama administration does not. Reasonable minds can differ on whether that conflict puts Arizona in violation of the Constitution's Supremacy Clause.

But what is indisputable is that the failure of the federal government to openly acknowledge the real ground for its opposition to SB 1070 has rendered incoherent not just its own public arguments against the law, but the judicial ruling which largely rubber stamps those arguments as well.

The Arizona statute affirms the power of a local police officer or sheriff's deputy to inquire into someone's immigration status, if the officer has reasonable suspicion that the person is in the country illegally, and if doing so is practicable. Under SB 1070, such an inquiry may occur only during a lawful stop to investigate a non-immigration offense.

Both the Justice Department and U.S. District Judge Susan Bolton, in striking down most of SB 1070, couched their opposition to the statute exclusively in terms of its effect on legal, as opposed to illegal, aliens. SB 1070, Judge Bolton wrote, would impermissibly burden legal immigrants already in the country by subjecting them to unwarranted immigration checks.

There are two problems with this line of argument: First, it ignores the fact that Congress has already anticipated and approved precisely the sort of local immigration inquiries that Judge Bolton now finds unconstitutional. Second, the argument would make all immigration enforcement impossible.

In 1996, Congress banned so-called sanctuary policies, by which cities and states prohibit their employees from working with federal immigration authorities regarding illegal aliens. It was in the federal interest, Congress declared, that local and federal authorities cooperate in the "apprehension, detention or removal of [illegal] aliens."

In pursuance of that mandate, the federal government operates an immigration clearinghouse, the Law Enforcement Support Center (LESC), to provide just the sort of immigration-status information to local and state law-enforcement officials that SB 1070 seeks.

It is therefore absurd to now claim, as Judge Bolton and the Obama Administration do, that such local inquiries conflict with the federal immigration scheme. It is even more absurd to argue that the risk that a legal alien will be questioned about his immigration status makes the alleged conflict unconstitutional.

Any immigration enforcement carries the possibility that a legal alien or U.S. citizen will be stopped and questioned. The only way to guarantee that legal aliens are never asked to present their immigration papers is to suspend immigration enforcement entirely. (The same possibility of stopping innocent people for questioning applies to law enforcement generally; that possibility has never been held to invalidate the police investigative power.)

If Congress intended to create such a blanket ban on asking legal aliens for proof of legal residency, it could have revoked the 1952 law requiring aliens to carry their certificate of alien registration. Such a requirement makes sense only on the assumption that legal aliens will upon occasion be asked to prove their legal status.

Such unpersuasive reasoning suggests that something else is going on. That something is the fact that SB 1070 would have put the Obama administration in the uncomfortable position of repeatedly telling Arizona's law enforcement officers that it is not interested in detaining or deporting the illegal aliens that they have encountered in the course of their duties; the law, in other words, would have exposed the administration's de facto amnesty policy.

And SB 1070 would have shown that immigration-law enforcement can work simply by creating a deterrent to illegal entry and presence. Even before it went into operation, the Arizona law was already inducing illegal aliens to leave the state, according to news reports.

Illegal aliens are virtually absent from the Justice Department's brief or from Judge Bolton's opinion. Despite this studied avoidance, it's time to have a public debate about how much immigration enforcement this country wants and which enforcement policies--the administration's or Arizona's -- best represent the public will.

Obama soft on illegals enforcement



Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.



The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.
