Amid bailouts, banks spent big to thwart foreclosure legislation

The $70 million spent in California on lobbying fees and political contributions came at the same time the banks were getting billions in federal taxpayer bailouts to keep them from collapsing.

Through the depths of the recession, major Wall Street banks and other financial institutions spent nearly $70 million in California to try to defeat or water down California legislation aimed at slowing real estate foreclosures.



The money, spent on lobbying fees and political contributions, came from 2007 to 2010 — at the same time the banks were getting billions of dollars in federal taxpayer bailouts to keep them from collapsing.



A report commissioned by the Alliance of Californians for Community Empowerment criticized the banks and mortgage lenders for spending the money in the political arena rather than working harder to keep people in their homes.



"There's no doubt that the banking industry is spending millions of dollars in an effort to advance its agenda in Sacramento," said Amy Schur, the alliance's executive director. "Too often, their agenda means less regulation for the banks and more freedom to operate at will.



Dustin Hobbs, a spokesman for the California Mortgage Bankers Assn., defended the lobbying and contributions by banks and their allies.



"Everyone has a right to have a voice in important policy discussions — both consumers and businesses," he said. "In California in recent years, we've seen a tremendous increase in the number of bills proposed that would have an impact on the real estate, finance industry."



The financial institutions included in the study were Bank of America Corp., JPMorgan Chase & Co., Citigroup Inc., Wells Fargo & Co., Goldman Sachs Group Inc. and Morgan Stanley, as well as the California Bankers Assn., the California Independent Bankers and the California Mortgage Bankers Assn.



Over the four-year period, banks and financial institutions spent $23.3 million on lobbying and $45.9 million on campaign contributions to candidates, initiative campaigns, political party organizations and other groups.



An example of a bill the banks were against, Schur said, was SB 1275, sponsored by Senate President Pro Tem Darrell Steinberg (D-Sacramento) and Sen. Mark Leno (D-San Francisco). It would have required mortgage servicers to complete negotiations aimed at modifying a loan before moving to foreclose.



The bill got only 30 out of 41 needed votes to pass the Assembly, with 12 Democrats failing to vote on the proposal even though Steinberg was a top caucus leader.



"The banking industry and their lobbyists worked very, very hard in killing it," Schur said. The bill has been re-introduced this year.



Hobbs said the California Mortgage Bankers Assn. has supported bills that helped homeowners, including a 2009 measure that required loan servicers and homeowners to talk directly with each other to try to prevent a foreclosure. The bill provided extra time for renters to stay in a house when a landlord had been foreclosed upon and gave cities tools to ensure that foreclosed properties were maintained.



Last year, the association supported a bill that allowed homeowners to sell their properties for less than the value of their original loan and not be required to still owe the difference to the bank, Hobbs said.



Another trade group, the California Bankers Assn., represents all the major banking institutions that operate in the state. Spokeswoman Beth Mills said that members of the group have participated in programs that "helped folks to stay in their homes whenever possible."



There were half a million foreclosures in the state in 2010, and that total isn't expected to change much this year, said Kevin Stein, associate director of the California Reinvestment Coalition, which advocates to bring equality in financial and housing services to low-income citizens.



"The reality is the banks are stronger in the Legislature than the consumer groups," Stein said. "In a time of unprecedented crisis in mortgage lending and foreclosures, we should have seen better and more legislation from the folks in Sacramento."



He said his group and its allies hope that the Democratic majorities in both houses of the Legislature and the new Democratic governor, Jerry Brown, will pass housing-related bills that previously died or were vetoed by former Republican Gov. Arnold Schwarzenegger.



"I think this year will be different because the problems have only gotten worse," Stein said.

“It was the best of times, and it was the worst of times.” Charles Dickens’ famous opening line to his fictional treatment of the French Revolution, A Tale of Two Cities, applies with equal force to contemporary America. A number of recent reports document how a tiny layer of the US population has monopolized society’s wealth to a degree that would have made the courtiers at Versailles blush.

A March 23 study by the Economic Policy Institute (EPI) concludes that the economic “recovery” has “proceeded on two tracks: one for typical families and workers, who continue to struggle against high rates of unemployment and continued foreclosures, and another track for the investor class and the wealthy.”

The recession, which officially lasted from December 2007 to June 2009, saw the share of total household wealth going to the bottom 80 percent of the population fall by 2.2 percentage points to 12.8 percent. The wealthiest 1 percent increased its net worth to 225 times that of the typical household, the highest ratio on record.

About one quarter of households have zero or negative wealth. With homeowners’ equity down 35 percent since 2007, the banking industry now owns the majority of the nation’s housing stock.

Data gathered by economist Emanuel Saez of the University of California, Berkeley reveals that in 2008 the top one-hundredth of one percent of households—1 in 10,000—took home an average of $27 million per household, while the average for the bottom 90 percent was $31,244. The average worker earned 1/185th of the amount taken in by a typical CEO.

According to the Congressional Budget Office, the top 1 percent of income tax filers, those who made nearly $2 million in 2007, saw their share of the national after-tax income increase by about 130 percent as compared to 1979. The bottom four quartiles saw their share decline by between 10 and 30 percent.

Also in 2007—before the catastrophic decline in home values, the major source of wealth for most families—1 percent of households controlled 34.6 percent of the national wealth, while the bottom 90 percent shared 26.9 percent.

As Karl Marx noted in Capital, “Accumulation of wealth at one pole is… at the same time accumulation of misery, agony of toil, slavery, ignorance, brutality, mental degradation at the opposite pole.” So it is in America in the second decade of the 21st Century.

A recent report from the Food Research and Action Center finds that a record 44.2 million people in the US, one in seven, relied on food stamp programs in January, up by more than 4.7 million in one year. One in five Americans struggled to find enough to eat in 2010, according to the group.

One in four US children live below the official poverty level, 16 million in all, and 1.5 million children experience homelessness each year. Untold millions of households subsist without heat, light or running water.

This immense accumulation of wealth by a tiny share of the population alongside the impoverishment of growing sections of the working class permeates every aspect of life—economics, politics and culture. In the political arena, it expresses itself in the drive by the entire political establishment—both the Democratic and Republican parties and every level of government—to accelerate the concentration of wealth in the hands of the financial aristocracy.

President Obama has ruled out any government jobs programs or serious relief for the unemployed, six million of whom have been without work for six months or longer. In December, he signed into law an extension of Bush-era income tax cuts for the wealthy and the lowering of estate taxes for multi-millionaires.

At the same time, he has vowed to freeze discretionary social spending and at the end of November signed an order freezing the pay of all federal workers for two years. This was followed by the announcement of a systematic drive to further weaken regulations on corporations—the very process that set the stage for the financial collapse of 2008 and the BP Gulf oil disaster of 2010.

Military and domestic security spending alone is spared the budget axe. Fiscal austerity is declared to be “job creation,” along with wage cutting to boost corporate profits and exports.

Obama’s oft-proclaimed devotion to “the private sector” and the “free market,” under conditions of the crisis and decay of American capitalism, translates into a historic rollback in workers’ wages and living standards toward those that prevailed prior to the mass struggles of the 1930s that established the CIO industrial unions and toward those that prevail today in cheap labor havens in Asia, Eastern Europe and Latin America.

The unions, based on their defense of the profit system, have been transformed into adjuncts of the corporations and the government for suppressing the working class and imposing ever more brutal cuts in wages, benefits and jobs.

All of this has merely laid the groundwork for a new stage in the ruling class offensive against working people. By refusing to provide financial assistance to deficit-ridden states and cities, the Obama administration is tacitly supporting unprecedented cuts by state governments in education, Medicaid and vital services and an attack on the basic democratic rights of the working class, including collective bargaining and the right to strike.

Mirroring Obama’s policy of military aggression overseas, the single-minded focus of his domestic policy has been to protect and expand the fortunes of the rich. In the midst of the worst social crisis since the Great Depression, corporate profits shattered records in 2010, climbing to $1.68 trillion, up 36.8 percent in a year. The stock market added $1 trillion in value in 2010, and CEO pay and bonuses have climbed back to the obscene heights of the pre-crash years, paced by hedge fund manager John Paulson’s $5 billion compensation last year.

Analyzing data on the staggering level of social inequality in America, Nobel Prize-winning economist Joseph Stiglitz recently warned of the dangers to the ruling class of a social explosion. In a Vanity Fair article entitled “Of the 1%, by the 1%, for the 1%,” he wrote: “In recent weeks we have watched people taking to the streets by the millions to protest political, economic and social conditions in the oppressive societies they inhabit. As we gaze out at the popular fervor in the streets, one question to ask ourselves is this: When will it come to America?”

The recent events in Wisconsin herald a new period of mass working class struggle in the US. But the sabotage of the movement in Wisconsin by the trade unions and their “left” allies shows just as sharply the need to break with the Democratic Party and advance a revolutionary program that not only rejects the ruling class demand that the working class pay for the failure of the capitalist system, but lays out the social rights of workers—to jobs at good pay, health care, education and housing—and the political fight for a workers’ government to secure those rights.

It is to discuss such a perspective that the Socialist Equality Party is holding a series of conferences this month on “The Fight for Socialism Today,” beginning this weekend in Ann Arbor, Michigan. Ford CEO Alan Mulally received a pay package worth $26.52 million in 2010, a 48 percent raise from the previous year, according to a Friday filing by the US auto company with the Securities and Exchange Commission. This is in addition to a stock bonus of $56.6 million the chief executive was awarded in March, bringing his total take for the year to more than $83 million.

Executive Chairman Bill Ford Jr. also received a hefty raise to $26.46 million on top of a stock award of $42.2 million, for a total of nearly $69 million.

These obscene sums were revealed only days after the United Auto Workers union announced that it would seek to expand the $14-an-hour wage for new-hires to more auto workers in upcoming contract talks. The aim of the union is to convince auto makers that they can make more money by shifting production to low-wage UAW plants, thereby increasing the UAW executives’ dues income.

The Ford bosses’ display of greed is not an aberration. The heads of major US corporations received their biggest raises in recent memory last year. Median CEO pay (not counting stock awards and other perks) jumped 27 percent to $9 million. The Detroit News reported Saturday that “$25 million is the pay level top companies performing well are paying their chief executives…”

Among the companies that have handed out huge executive bonuses is Transocean, the owner of the Deepwater Horizon rig that exploded nearly a year ago, killing 11 workers and sending oil gushing into the Gulf of Mexico. In a filing Friday, Transocean reported that it had awarded safety bonuses to its executives as a reward for the firm’s “best year in safety performance.” CEO Steve Newman’s safety bonus was over $374,000, part of a total compensation package of $5.8 million.

Two-and-a-half years after the Wall Street crash and taxpayer bailout of the banks, the corporate looting of America is accelerating. The executives are rewarding themselves for soaring profits and a corporate cash hoard in the trillions—achieved almost entirely through downsizing and cost cutting. Firms in the Standard & Poor’s 500 stock index registered a 47 percent growth of profits in 2010, while their revenues increased by only 7 percent.

To place the compensation of Ford’s two top executives in perspective, their combined payout of $152 million is equivalent to the annual wages of 5,241 hourly workers earning the coming industry benchmark of $14 an hour—i.e., the wage bill for a large auto plant.

These facts expose the fraud of the claims that “there is no money” for jobs, decent wages and vital social needs such as education, health care and housing. The Ford announcement came as the Obama administration and congressional Democrats were offering to cut a record $33 billion from social programs in the current year’s federal budget and as the Republicans were preparing to unveil a plan to slash trillions of dollars, gutting Medicaid and privatizing Medicare, beginning in fiscal year 2012.

At the state and local level, Democrats and Republicans alike are carrying out savage austerity measures—slashing public workers’ jobs and wages, closing schools and libraries, and reducing Medicaid benefits—even as they continue to cut taxes for corporations and the wealthy.

A significant factor in the fiscal crisis is the fact that US corporations pay little or no federal or state taxes. Just last month it was reported that General Electric, the largest US corporation, which took in $14.4 billion in profits in 2010, paid no income tax last year. In fact, it is expecting a $3.2 billion tax credit from the federal government.

GE is the rule, not the exception. A 2008 study by the Government Accountability Office showed that nearly 70 percent of American corporations paid no corporate income tax.

Meanwhile, with mass unemployment a permanent feature of economic life, workers’ wages are declining. According to the Labor Department’s employment report released Friday, average hourly wages for private-sector workers, including salaried employees, were only 1.7 percent higher last month than in March of 2010. But with the official inflation rate above 2 percent—and the prices of basic necessities such as fuel and food rising much faster—the real wages of American workers are falling.

That this trend is bound up with the policies of the Obama administration is indicated by the following anomaly: average hourly earnings rose over 3 percent annually during most of the 18-month official recession from December 2007 to June 2009. Then wage growth slowed sharply.

This shift corresponds to the bankruptcy and restructuring of General Motors and Chrysler carried out under the auspices of Obama’s Auto Task Force and with the full support of the UAW. The Obama administration insisted as a condition for loans to the auto companies the imposition of drastic cuts in auto workers’ benefits and a 50 percent wage cut—to $14 an hour—for new-hires. This was a signal for the corporate elite to launch a wage-cutting drive in every sector of the economy—a process that has now been expanded to encompass the public sector as well.

The working class is being impoverished in order to further enrich the financial aristocracy. A study released Friday by the nonprofit group Wider Opportunities for Women concluded that less than 13 percent of the jobs expected to be created by 2018 will provide economic security to a single parent raising two or more children. Only 43 percent of these jobs, according to the study, will pay wages sufficient to provide economic security for two workers raising two children.

The resources exist in abundance to provide a secure, good-paying job to all who want to work as well as quality education, housing, health care and a comfortable retirement. But under the capitalist system they are monopolized by a parasitic ruling elite that owns the means of production and controls both political parties and all of the levers of state power.

The month-long struggle in Wisconsin signaled the reemergence of the working class into mass struggle in America, after decades during which it was suppressed by the official trade unions. But the betrayal of that struggle by the unions, working in league with the Democratic Party, underscores the critical need for the development of a new, revolutionary leadership in the working class. This is the essential requirement for the independent mobilization of the working class and the development of a mass socialist movement.

The Socialist Equality Party, the International Students for Social Equality and the World Socialist Web Site are holding a series of conferences this month in Ann Arbor, Michigan, Los Angeles and New York City on “The Fight for Socialism Today,” beginning with the Ann Arbor conference this coming Saturday and Sunday.

These conferences will discuss a socialist program to secure the basic social rights of the working class, oppose imperialist war, and halt the assault on democratic rights.
