Mexico Promotes Free U.S. Healthcare For Illegal Immigrants



Time to wake up people! With unemployment at 12% and the state going broke, our tax dollars are going to pay for healthcare for hundreds of thousands of illegal aliens. To the tune of over a billion dollars a year!





Mexico's government operates programs in about a dozen American cities that refers its nationals--living in the U.S. illegally--to publicly funded health centers where they can get free medical care without being turned over to immigration authorities.



The program is called Ventanillas de Salud (Health Windows) in Spanish and its mission is to help illegal immigrants find U.S. hospitals, clinics and other government programs where they can get free services without being deported for violating federal immigration laws.



Chicago, Houston, Los Angeles, San Diego and Indiana are among the cities where Mexican consulates operate the health referral system which annually costs U.S. taxpayers billions of dollars. In Los Angeles County alone, illegal immigrants cost taxpayers nearly $440 million in health services annually and a whopping $1.1 billion statewide.



The Mexican consul in Los Angeles proudly announced that nearly 300,000 Mexicans in the area have benefited from his government's health referral program, which he says actually saves the county money by encouraging immigrants to seek preventive care rather than waiting for more expensive emergency treatment.



The Southern California operation promises to assess "consulate clients" for eligibility to government-funded health insurance and other primary care services and offers free legal assistance to those who are denied coverage. Its goal is to improve access to health services for immigrants of Mexican origin by formalizing a health education, medical home referral and insurance enrollment program.



In Chicago, the Mexican consul's Spanish-language web site heavily promotes the Illinois Department of Health's low-cost prescription medicine program for illegal aliens and various free medical services throughout the state. It encourages all Mexicans in the area to pursue the valuable U.S. government-financed services for their entire family.



The Indiana-based program boasts that it serves thousands of "Mexican nationals" living in that state as well as Ohio, Kentucky and southern Illinois. Mexican officials claim that its highly successful pro-health program sends out a clear message to other Mexican consulates throughout the country and the world.



Although these programs facilitate people to remain in the country illegally, Mexico is working hard to expand them to all 47 U.S. consulates to better serve its nationals. In the meantime, U.S. taxpayers will keep picking up the exorbitant tab of medically treating the millions who live in the country illegally.

Beleaguered Bay State and U.S. taxpayers coughed up a staggering $35.7 million this year in free emergency health care for more than 52,000 illegal aliens in Massachusetts, sparking outrage from candidates and critics who back a tougher line on immigration.

The figures — released by Gov. Deval Patrick’s administration under an order for the Secretary of State’s office and after more than a month of ducking questions — show illegal immigrants who belong to MassHealth Limited received $33.8 million in taxpayer-funded in-patient hospital care this year.

They also made 6,160 visits to the state’s overburdened emergency rooms in the fiscal year ending in June for an additional cost of $1.9 million, a Herald analysis shows.

The state should go after employers who hire them, curb taxpayer-funded benefits, deploy the National Guard to help the feds at the border and penalize 'sanctuary' cities.



Illegal immigration is another matter entirely. With the state budget in tatters, millions of residents out of work and a state prison system strained by massive overcrowding, California simply cannot continue to ignore the strain that illegal immigration puts on our budget and economy. The nativist CNN reporter Lou Dobbs estimates that there are over 200,000 "Anchor Babies" born every year whereas George Putnam, a radio reporter, says the figure is closer to 300,000. La Voz de Aztlan believes that the number is approximately 500,000 "Anchor Babies" born every year.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third nation neutral arbitration of disputes concerning immigration laws and their enforcement." The Inter-Press Sevice (IPS) is reporting that the head administrator of the Mexican Superintendency of Tax Administration, Raul Diaz, has confirmed that his government is building a wall in the state of Chiapas, along the Mexican/Guatemalan border.

The official reason is to stop contraband from coming into Mexico, but as Diaz admitted: “It could also prevent the free passage of illegal immigrants.”

According to Mexico's National Commission on Human Rights, 500,000 people from Central America cross into Mexico illegally every year.

Just as Mexican authorities have opposed the construction of a fence by the U.S., along our border with their country, Mexico is now receiving a great deal of criticism from the Guatemalan government.

The executive coordinator of the National Bureau for Migration in Guatemala, Marila de Prince, told a local newspaper: “It is not a correct measure being taken by the Mexican government.”

Erick Maldonado, executive secretary of Guatemala's National Council on Migrants said: “We are watching the Mexican government's initiative with concern because the migrants are in a situation of highest vulnerability, as demonstrated by the massacre in Tamaulipas, where five Guatemalans died.”

Maldonado said the wall “is going to make the migrants' situation worse, because to meet their needs they are always going to find blind points where there are no migration or security controls, which implies greater risks."

Vice-President of Guatemala, Rafael Espada, said: “The walls are not the solution to the problems.”

The Catholic Church has been highly critical of U.S. treatment of illegal aliens, and one priest in Central America used the news of the Mexican wall to take another shot at the American people.

Father Francisco Pellizari, of the Casa del Migrante told IPS: “The dramatic increase in the cost of 'polleros' (human traffickers) and the corruption of the authorities is the result of the walls the United States plans to build and has built along the border. We can transpose the Guatemala case to this situation and the results will be the same.”

Peliizari said border walls “are supposedly intended to halt migration, but that hasn't happened. Instead they have triggered an economic hemorrhage and a shift in the migratory flow to inhospitable routes that lead to thousands of deaths.”

Of course, the U.S. press has completely ignored the story…They excoriate Americans for their desire to simply defend their own borders, but give Mexico a pass for building a wall to keep out illegal aliens.

MEXICO CITY – Amnesty International called the abuse of migrants in Mexico a major human rights crisis Wednesday, and accused some officials of turning a blind eye or even participating in the kidnapping, rape and murder of migrants.

The group's report comes at a sensitive time for Mexico, which is protesting the passage of a law in Arizona that criminalizes undocumented migrants.

The Interior Department acknowledged in a statement that the mainly Central American migrants who pass through Mexico on their way to the United States suffer abuses, but attributed the problem to criminal gangs branching out into kidnapping and extortion of migrants.

Rupert Knox, Amnesty's Mexico researcher, said in the report that the failure by authorities to tackle abuses against migrants has made their trip through Mexico one of the most dangerous in the world.

"Migrants in Mexico are facing a major human rights crisis leaving them with virtually no access to justice, fearing reprisals and deportation if they complain of abuses," Knox said.

Central American migrants are frequently pulled off trains, kidnapped en masse, held at gang hideouts and forced to call relatives in the U.S. to pay off the kidnappers. Such kidnappings affect thousands of migrants each year in Mexico, the report says.

Many are beaten, raped or killed in the process.

One of the main issues, Amnesty says, is that migrants fear they will be deported if they complain to Mexican authorities about abuses.

At present, Article 67 of Mexico's Population Law says, "Authorities, whether federal, state or municipal ... are required to demand that foreigners prove their legal presence in the country, before attending to any issues."

The Interior Department said the government has taken some steps to combat abuses and Mexico's legislature is working to repeal Article 67 "so that no one can deny or restrict foreigners' access to justice and human rights, whatever their migratory status."

The Amnesty report said one female migrant told researchers that Mexican federal police had forced her group off a train and stolen their belongings. Forced to walk, she said, she was subsequently attacked by a gang and raped.

The Interior Department said it shares Amnesty's concern, and called the report "a valuable contribution."

Mexico has long been offended by mistreatment of its own migrants in the United States.

The Arizona law — slated to take effect in late July or early August — makes it a state crime to be in the U.S. illegally and allows police to question anyone they suspect of being an illegal immigrant. Mexico has complained that the law would lend itself to racial profiling and discrimination.

Migrants fall prey to kidnappers and worse while the Mexican government does little to protect them, rights groups say. However, others say the migrants are forming criminal bands and should be deported.

Gathered below an overpass on Independence Avenue, dressed in the multiple layers typical of homeless travelers, the migrants watched for the next northbound freight train through Tultitlan.



Many of them, mostly young men and boys, prepared to hop aboard, hobo-style, on an ever-more-precarious trip that might get them as far as the United States.



But fewer migrants are achieving that goal. Central Americans who for years have passed through Mexico en route to the U.S. are increasingly cutting their trips short as they run out of cash or become discouraged by fewer opportunities farther away from home.



The lingering presence of the migrants in this town, about an hour's drive outside Mexico City, is tearing the small community apart, with some residents providing migrants with food, clothes and aid and others complaining of their alleged crimes, plus a new local government maneuvering to get rid of them.

The Outrages of the Mexican Invasion

Illegal immigration is about much more than fighting terrorism. The fact is, illegal Mexican’s are pouring across our borders and as a result, American tax-paid services like education and healthcare are being pushed to the brink of collapse.



It is an incomprehensible arrogance exercised by both Mexican and American officials who, while promoting illegal immigration, see no problem in letting U.S. taxpayers foot the bill. Each new report of activities along the Mexican border appears to be more outrageous than the last.



The Mexican government of President Vincente Fox has basically demanded that the United States accept and care for citizens of his country who are sneaking in illegally. Fox has become increasingly vocal in demanding that the United States create an amnesty and work-visa programs to legalize more than three million illegal Mexicans now living in the United States.



In addition, apparently President Fox has decided to use his own version of Fidel Castro’s Muriel Boat Lift to rid his country of riff-raff he no longer wants. In 1978, Castro purged his prisons of murderers, thieves and drug dealers and put them in an armada of boats headed for America’s shore. The resulting crime wave flooded jails, overworked police and community budgets made living in Miami, Florida, almost unbearable for a time, and still inflicts the community’s culture. Much the same is now happening in Mexican border states, as crime rises and quality of life diminishes.



Meanwhile, American leaders seem to be encouraging such activity. As more than 10,000 illegal Mexicans flood into the nation every day, there is little concern on Capitol Hill and virtually no legislation pending to deal with the issue. Those like Congressman Tom Tancredo of Colorado, who vocally oppose the open border policy, are ignored. President Bush has again called for the amnesty that President Fox seeks. New U.S. Ambassador to Mexico, Tony Garza, assured Mexico that reaching an accord legalizing the status of Mexican immigrants – without giving them citizenship – continues to be a top Bush Administration priority.



The Fox Administration now appears to be working a strategy to recruit local American officials that will all but dissolve the border between the two nations, even before Congress can take legislative action.



Consider these actions by the Mexican government inside the United States in just the past few months.



Item: The Mexican government has issued more than 800,000 slick, pocket-sized identification cards to both legal and illegal immigrants. Those cards are being distributed through Mexican consulates all over the United States.



The cards list the holder’s birth date, place of birth, U.S. address and encoded information to prevent fraudulent duplication. Over the past year, Mexican officials have been openly lobbying local police departments, banks and local government agencies in the United States to accept the cards, making it easier for the holders to get jobs, open bank accounts get government services. The strategy is to work the system from the bottom up, making the cards acceptable on the local level before Congress can pass any legislation concerning the activity. That way, Mexico believes, the Congress will have no choice but to simply rubber stamp approval of the practice.



As a result of Mexico’s efforts, today more than 800 U.S. police departments, 15 cities and 13 states now accept the cards as valid ID. At least 66 U.S. banks, led by Wells Fargo and Bank of America, have also agreed to accept the cards, opening tens of thousands of new bank accounts in states across the country, from California to Georgia.



Why would Mexico spearhead such a program, losing its own citizens? Mexico is reaping a bonanza as immigrants send more than $10 billion per year back to relatives at home. That figure equals what Mexico earns in annual tourism dollars.



Item: Mexican ambulance drivers are transporting hospital patients unable to pay for medical care in Mexico to facilities in the United States. They know that the federal Emergency Medical Act mandates that U.S. hospitals with emergency-room services treat anyone who presents themselves for care, including illegal aliens. The ambulances are driving through unguarded portions of the border with "little resistance" at the instruction of Mexican officials.



The cost is being paid by the American taxpayers in more ways than money. Medical service in affected communities is being severely damaged as hospitals absorb more than $200 million in unreimbursed costs. Some emergency rooms have shut down because they cannot afford to stay open. That means local tax-paying Americans are either denied medical care or have to wait in long lines for service as the illegals flood the facilities.



The costs are staggering. The Cochise County, Arizona Health Department spends as much as 30 percent of its annual $9 million budget on illegal aliens. The Copper Queen Hospital in Bisbee, Arizona, has spent $200,000 in uncompensated services out of a net operating budget of $300,000.



The University Medical Center in Tucson may lose as much as $10 million and the Good Samaritan Regional Medical Center, also in Tucson, has lost $1 million in the first quarter of fiscal 2002. Rural hospital facilities face losing the use of routine helicopter transportation for patients who need further treatment in big city facilities because the cost of transporting illegals is eating up the budgets. If that happens, the quality of healthcare in those rural areas would be diminished back to1980 levels.



In California, the losses are calculated to be about $79 million, with $74 million in Texas, $31 million in Arizona, and $6 million in New Mexico. All of these costs are dumped on American taxpayers simply because the Mexican government, void of protest from the U.S. government, has decided to raid the American cookie jar.



Item: Schools are suffering the same fate as medical care as illegal aliens fill classrooms, bloat budgets, and rob taxpayers of decent facilities for American children. Federal law and an incredible Supreme Court ruling ban schools from denying free education to illegal aliens.



Moreover, state run colleges and universities are being forced to allow illegal aliens to receive in-state tuition discounts that are supposed to be reserved for residents of that state. In California, a new law (Assembly Bill 540) allows undocumented high school graduates who have been in residence in California for three years to enroll in community colleges and the California State University and University of California systems without paying nonresident tuition. The government is even opposed to allowing schools to report illegal aliens or to deny them enrollment.



Item: Several cities have declared themselves "safe haven" for illegal aliens and refuse to enforce immigration laws. Los Angeles, Chicago, San Francisco, Seattle, New York City and even Falls Church, Virginia (in sight of the Pentagon), have all declared to be sanctuaries for illegal aliens. New York Mayor Michael Bloomberg announced that, "people who are undocumented do not have to worry about city government going to the federal government." In other words, these city governments refuse to uphold federal law or defend American borders.



Item: On several occasions, heavily armed Mexican soldiers have actually crossed over into United Sates territory and fired on U.S. Border Patrol personnel. In one case, a Border Patrol helicopter over U.S. soil was fired upon by a 10-man unit of what appeared to be Mexican soldiers wearing tactical vests and carrying high-powered rifles. In another case, sixteen heavily armed Mexican soldiers in Humvee military vehicles chased American Border Patrol officers more than a mile into U.S. territory.



Why were the Mexican soldiers attacking U.S. agents? Border Patrol officials confirmed that the Juarez drug cartel has placed a bounty of $200,000 on U.S. lawmen.



Item: The U.S. Border Patrol is using tax dollars to advertise the establishment of eight "rescue beacons" along the border to help illegal aliens find they way. A strobe light is used to direct illegal aliens to the beacons to help with night crossings. During the day a reflective mirror guides the crossers.



The one minute commercials are expected to run in 2003 on TV stations in Mexico and in the border city of Yuma, Arizona. "Officials want to reach viewers in the interior parts of Mexico, where potential border crossers may know little about the treacherous terrain and nothing about the beacons," the Associated Press reported.



Officials of the United States who are required to defend our borders and uphold the Constitution and the laws of the federal government have chosen instead to ignore the fact that we even have a border with Mexico. So great is the Mexican invasion that the U.S. government has decided to accept illegal aliens as a economic fact instead of trying to stop it.



Meanwhile American society is suffering. Our standard of living is diminishing. Taxpayers are being robbed of the services they pay for as their plight is dismissed by arrogant officials from both Mexico and the United States.



If the United States would at least support an effort to stop the flood of illegal aliens; if the U.S. Government would file a protest to the Mexican government to demand that they stop the ambulance drivers; if the U.S. Government would stop allowing the use of the Mexican-created ID cards; if the U.S. Government would stop forcing schools and other government services to give free rides to illegal aliens – then the onslaught would begin to subside. All of those things would be easy to do and require no addition money.



They horrible truth is that there is no movement on Capitol Hill, no elected leader to rally troops to demand such actions, even though recent polls show overwhelming support by Americans for stronger action against illegal immigrants. It is up to the American taxpayers to apply pressure on our elected officials to demand an end to these outrageous policies.



The only alternative is for each taxpayer to understand that for every two dollars they earn, one may have to be set aside to pay for our free-loading Mexican cousins to live in our country with all of our benefits, yet free of our laws and our taxes.



This is our land, not Mexico’s. It’s high time we told that to our own leaders and especially to the government of Mexico.

More than a million immigrants land U.S. jobs

Stepped-up enforcement is not deterring trend of foreign-born employment

DALLAS — Over the past two years, as U.S. unemployment remained near double-digit levels and the economy shed jobs in the wake of the financial crisis, over a million foreign-born arrivals to America found work, many illegally.

Those are among the findings of a review of U.S. Bureau of Labor Statistics and Census Bureau data conducted exclusively for Reuters by researchers at the Center for Labor Market Studies at Northeastern University in Boston.

Often young and unskilled or semi-skilled, immigrants have taken jobs Americans could do in areas like construction, willing to work for less wages. Others land jobs that unemployed Americans turn up their noses at or lack the skills to do.

With a national unemployment rate of 9.4 percent, domestic job creation is at the top of President Barack Obama's agenda and such findings could add to calls to tighten up on illegal immigration. But much of it is Hispanic and the growing Latino vote is a key base for Obama's Democratic Party.

Many of the new arrivals, according to employers, brought with them skills required of the building trade and found work in sectors such as construction, where jobless rates are high.

"Employers have chosen to use new immigrants over native-born workers and have continued to displace large numbers of blue-collar workers and young adults without college degrees," said Andrew Sum, the director of the Center for Labor Market Studies.

"One of the advantages of hiring, particularly young, undocumented immigrants, is the fact that employers do not have to pay health benefits or basic payroll taxes," said Sum.

From 2008 to 2010, 1.1 million new migrants who have entered America since 2008 landed jobs, even as U.S. household employment declined by 6.26 million over that same period.

But in a sign of the times, the pace of job growth for new arrivals has also slowed, to an average of 550,000 a year from 2008 to 2010 from over 750,000 a year from 2000 to 2008.

Sum said it was fair to estimate that around 35 percent of these workers were undocumented or illegal.

Many immigrants acquired jobs in traditional low-wage work associated with foreign, undocumented and especially Mexican labor: hotels and food services, retail trade, sanitation, cleaning and construction.

There are a number of programs by which the United States lets foreign workers into the country to fill gaps in its domestic labor market but employer groups complain little is done in this area for legal, unskilled workers.

"There is basically no unskilled immigration that is legal. There are basically no provisions in the law for unskilled immigrants," said Bill Hammond, president of the Texas Association of Business.

Farm workers in particular argue that Americans would not do the tough field work that is rife with undocumented workers, titling one recent union campaign "Take Our Jobs". The slogan meant that if Americans wanted their jobs, then take them. But it is likely they don't.

Immigrant hiring also comes despite stepped-up workplace enforcement against companies that hire illegal immigrants and the rapid expansion of the online E-verify system used by employers to check immigration status.

Some of those who entered the country since 2008 were employed in sectors that generally require a high level of skills and education, such as finance and insurance.

But the 28,500 new arrivals since 2008 who found work in the finance and insurance sector only comprised 2.6 percent of the 1.1 million migrants. Over 90,000 of the newcomers since 2008 got work in health care and social services, a fast-growing sector where skills are in demand.

Young, educated and willing to work

But the demographic profile of the immigrants who are still landing jobs is slanted to the young, uneducated, unskilled or semi-skilled. Accommodations and food services, for example, was a sector that employed over 144,000 new arrivals -- the biggest group of employed new immigrants. These would be jobs such as hotel maids and dishwashers.

And 42 percent of the 1.1 million were under 30.

The unemployment rate for all Americans without a high school diploma in this age group is about 27 percent to 29 percent -- a level that Sum says is "Depression scale." And in sectors such as construction the unemployment rate is almost 21 percent.

Asked about hiring, industry sources say there is little.

"What hiring? Our guys laid off another 16,000 people in December," said Brian Turmail, spokesman for the Associated General Contractors of America.

Yet the analysis by Sum and his colleagues shows that over 86,000 foreign-born workers who arrived in America since 2008 have been employed in the construction sector.

Sum said the whole situation was creating a deeper domestic labor glut at the bottom of the workforce ladder, depressing wages and sharpening already widening income disparities.

But Ezequiel Arvizu, the compliance and diversity representative with federal contractor Sundt Construction in Arizona, said his company had hired new arrivals over the past three years simply because they often have experience that native-born Americans lack.

"People often think construction is unskilled but the trades are very skilled and we need cement masons, carpenters, equipment operators," he told Reuters in a phone interview.

"We are looking for qualified candidates and it just so happens that some of the candidates who we select are legal immigrants. It means they have the skills we are looking for," he said.

An analysis of pending legislation in dozens of US states makes clear that both the Republican and Democratic parties are pursuing an agenda whose central aim is to eradicate the ability of workers to resist wage and budget cutting. The primary difference is that the Democratic-sponsored legislation maintains a role for the union bureaucracies in implementing the cuts, while a number of Republican bills aim to weaken or destroy the unions outright.



The attacks on the rights of government workers arises from the fiscal crises in the states, which have been created, in an immediate sense, by declining tax revenue, higher demand for services, and the refusal of the Obama administration and Congress to provide adequate aid. In the longer term, these fiscal crises have been consciously created by tax policies that benefit the rich and the corporations. Now the state deficits are being seized upon as a means of establishing a new authoritarian legal framework for impoverishing millions of workers and their families.



The following is a partial analysis of anti-worker legislation under consideration in a number of states, based on a database compiled by the National Conference of State Legislatures.



If a series of laws in Arizona are passed into law, as is very likely, it is not an overstatement to say that the democratic rights of public workers will be no more advanced than in a police-state dictatorship.



Arizona Senate Bill 1350 strips from public employees some of their most basic political rights. Government employees may not, the bill asserts, “be a member of any national, state or local committee of a political party, an officer or chairman of a committee of a partisan political club, or a candidate for nomination or election to any paid public office, shall not hold any paid, elective public office or shall not take any part in the management or affairs of any political party or in the management of any partisan or nonpartisan campaign or recall effort.”



Arizona House Bill 2367 bans collective bargaining, forcing workers to approach the state as individuals. The bill “provides that [the state] or a political subdivision of this state shall not negotiate with a labor organization or employee association representing public employees concerning wages, hours of work, employee benefits or any other financial issue, includes public safety employees, probation officers or surveillance officers.”



Arizona Senate Bill 1363 is deemed an “employer protection law.” It would outlaw any sort of resistance to the corporations, including, “unlawful picketing, trespassory assembly, unlawful mass assembly, concerted interference with lawful exercise of business activity and a secondary boycott.” This would be enforced by the granting of “a temporary restraining order” and “injunction against harassment…defamation, fraud, duress, violence or breach of the peace.”



Arizona Senate Bill 1563 prohibits employees from engaging in a “sickout, work slowdown or strike that will disrupt delivery of services.”



It is significant that Arizona is the same state that last year passed the most far-reaching attack on the rights of immigrant workers—requiring local authorities to racially profile them, the carrying of documentation to prove residency, and prohibiting individuals or groups from aiding immigrants. The World Socialist Web Site warned at the time that the bill was a prelude to a far broader assault on the working class. This has already come to pass.



Legislation pending in Tennessee is equally draconian. Senate Bill 1033 would designate any form of resistance to corporations a criminal offense. Deemed a crime in Tennessee would be any activity that “Restricts a business, or the owners or employees of a business, from exercising their rights, which are protected under state and federal law, in an effort to obtain something of value for a union or employee organization....



“Any otherwise lawful activity, such as the participation in a union or employee organized event, may constitute a riot if the public peace is disturbed by tumultuous or threatening conduct...creating a hazardous or offensive condition that may include picketing, mass picketing, or the targeted picketing of a residential structure.



“It is no defense to prosecution [that an individual’s offense was undertaken] for purposes of an organizing campaign or any other lawful purpose.”



Another Tennessee bill bans groups of workers from giving money to any political party or candidate. “No labor organization shall use any of the funds, moneys, or credits of the labor organization for the purpose of making contributions to any candidate with respect to any election,” the bill states. “A violation of this section is a Class C misdemeanor.”



Tennessee Senate Bill 1032 outlaws not only strikes and any form of work stoppage or slowdown by state workers, it even proscribes discussing strikes among workers. Violators of the no-strike law would be levied fines of $1,000 per day. If it is determined that over 10 percent of any given state office or work site engaged in a strike, the union overseeing that site could be punished by having its right to collect dues revoked for the entire state.



Twin bills pending in the Tennessee House and the Senate proudly declare that they will “abolish teachers’ unions ability to negotiate terms and conditions of professional service with local boards of education,” according to their summaries.



A number of states are advancing or have passed legislation that will strip collective bargaining rights from most or all of the public sector workforce, among them Wisconsin, Ohio, Iowa, Idaho, Indiana, Florida, Kansas, Nebraska, Alaska, Arizona, and Oklahoma.



States dominated by Republican leadership are pushing bills that would decimate public sector unions (which now account for the majority of total US union membership) including Wisconsin, Iowa, Arizona, Florida, New Jersey, Tennessee, Pennsylvania, South Carolina, and Texas.



Among the legislative methods meant to achieve this are: outlawing or limiting the automatic dues-check off; requiring individual permission be gained for using union dues for political purposes; and by requiring regular recertification elections. Several states are also pushing laws that would mandate secret ballot-style elections for union certification, rather than card drives, the prevailing custom.



Meanwhile, in states dominated by the Democratic Party, attacks on workers’ rights are being directly linked to wage-cutting.



In Connecticut a pending House bill would outlaw any wage increase awards in binding arbitration whenever unemployment in the state exceeds seven percent. A second bill would limit binding arbitration wage-increase awards to no more than the Consumer Price Index. (Binding arbitration occurs when workers and employers reach an impasse in negotiations, at which point a federal or state mediator may dictate a settlement.)



Hawaii’s Senate has passed a bill out of committee that “makes employer contributions to the employer-union health benefits trust fund non-negotiable under collective bargaining.” A number of other bills are circulating in its House and Senate that would increase worker contributions to health care and pensions, and another passed out of House committee that would eliminate Medicare Plan B reimbursements for retired government workers and their spouses.



A number of state legislatures, including New York and Illinois—both dominated by Democrats—are advancing bills that would force arbitration panels to limit awards to workers based on “the ability of a public employer to pay an award,” according to the language used in the New York bill. The bill, versions of which are active in Albany in both the House and Senate, would force arbitrators to give this factor the highest priority in making decisions. Its transparent purpose is to give all levels of government, from the state to the schools, the ability to force dramatic pay cuts by claiming financial duress.



A similar measure being advanced in Republican-controlled Michigan would allow workers’ contracts to be torn up in government units that have gone into bankruptcy or receivership.



A bill pending in Washington’s legislature, also controlled by Democrats, “Amends the Constitution to allow salary reductions for public officials during an economic crisis.”
