Tina Griego, journalist for the Denver Rocky Mountain News wrote a column titled, 'Mexican Visitor's Lament' -- 10/25/07.
She interviewed Mexican journalist Evangelina Hernandez while visiting Denver last week. Hernandez said, 'They (The illegal aliens) pay rent, buy groceries, buy clothes...What Happens to your country's economy if 20 million people go away?' That's a good question - it deserves an answer. Over 80 percent of Americans demand secured borders and illegal migration stopped. But what would happen if all 20 million or more vacated America? The answers may surprise you! In California, if 3.5 million illegal aliens moved back to Mexico, it would leave an extra $10.2 billion to spend on overloaded school systems, bankrupt hospitals and overrun prisons. It would leave highways cleaner, safer and less congested. Everyone could understand one another as English became the dominant language again. In Colorado, 500,000 illegal migrants, plus their 300,000 kids and grand-kids - would move back 'home', mostly to Mexico. That would save Coloradans an estimated $2 billion (other experts say $7 billion) annually in taxes that pay for schooling, medical, social-services and incarceration costs. It means 12,000 gang members would vanish out of Denver alone. Colorado would save more than $20 million in prison costs, and the terror that those 7,300 alien criminals set upon local citizens. Denver Officer Don Young and hundreds of Colorado victims would not have suffered death, accidents, rapes and other crimes by illegals. Denver Public Schools would not suffer a 67 percent drop-out/flunk-out rate because of thousands of illegal alien students speaking 41 different languages. At least 200,000 vehicles would vanish from our gridlocked cities in Colorado. Denver 's four percent unemployment rate would vanish as our working poor would gain jobs at a living wage. In Florida, 1.5 million illegals would return the Sunshine State back to America, the rule of law, and English. In Chicago, Illinois, 2.1 million illegals would free up hospitals, schools, prisons and highways for a safer, cleaner and more crime-free experience. If 20 million illegal aliens returned 'home' the U.S. Economy would return to the rule of law. Employers would hire legal American citizens at a living wage. Everyone would pay their fair share of taxes because they wouldn't be working off the books. That would result in an additional $401 Billion in IRS income taxes collected annually, and an equal amount for local, state and city coffers.
No more push '1' for Spanish or '2' for English. No more confusion in American schools that now must contend with over 100 languages that degrade the educational system for American kids. Our overcrowded schools would lose more than two million illegal alien kids at a cost of billions in ESL and free breakfasts and lunches. We would lose 500,000 illegal criminal alien inmates at a cost of more than $1.6 billion annually. That includes 15,000 MS-13 gang members who distribute $130 billion in drugs annually would vacate our country. In cities like L.A., 20,000 members of the ' 18th Street Gang' would vanish from our nation. No more Mexican forgery gangs for ID theft from Americans! No more foreign rapists and child molesters! Losing more than 20 million people would clear up our crowded highways and gridlock. Cleaner air and less drinking and driving American deaths by illegal aliens! America's economy is drained. Taxpayers are harmed. Employers get rich. Over $80 billion annually wouldn't return to the aliens' home countries by cash transfers. Illegal migrants earned half that money untaxed, which further drains America's economy – which currently suffers an $8.7 trillion debt. At least 400,000 anchor babies would not be born in our country, costing us $109 billion per year per cycle. At least 86 hospitals in California, Georgia and Florida would still be operating instead of being bankrupt out of existence because illegals pay nothing via the EMTOLA Act. Americans wouldn't suffer thousands of TB and hepatitis cases rampant in our country-brought in by illegals unscreened at our borders. Our cities would see 20 million less people driving, polluting and grid locking our cities. It would also put the 'progressives' on the horns of a dilemma; illegal aliens and their family’s cause 11 percent of our greenhouse gases. Over one million of Mexico 's poorest citizens now live inside and along our border from Brownsville, Texas to San Diego, California in what the New York Times called, 'colonias' or new neighborhoods. Trouble is, those living areas resemble Bombay and Calcutta where grinding poverty, filth, diseases, drugs, crimes, no sanitation and worse. They live without sewage, clean water, streets, electricity, roads or any kind of sanitation. The New York Times reported them to be America’s new ' Third World ' inside our own country. Within 20 years, at their current growth rate, they expect 20 million residents of those colonias. (I've seen them personally in Texas and Arizona; it's sickening beyond anything you can imagine.) By enforcing our laws, we could repatriate them back to Mexico. We should invite 20 million aliens to go home, fix their own countries and/or make a better life in Mexico. We already invite a million people into our country legally more than all other countries combined annually. We cannot and must not allow anarchy at our borders, more anarchy within our borders and growing lawlessness at every level in our nation. It's time to stand up for our country, our culture, our civilization and our way of life. Interesting Statistics. Here are 14 reasons illegal aliens should vacate America, and I hope they are forwarded over and over again until they are read so many times that the reader gets sick of reading them: 1. $11 billion to $22 billion dollars are spent each year on welfare to illegal aliens.

What will America stand for in 2050?

The US should think long and hard about the high number of Latino immigrants.

President Obama has encouraged Americans to start laying a new foundation for the country – on a number of fronts. He has stressed that we'll need to have the courage to make some hard choices. One of those hard choices is how to handle immigration. The US must get serious about the tide of legal and illegal immigrants, above all from Latin America.
It's not just a short-run issue of immigrants competing with citizens for jobs as unemployment approaches 10 percent or the number of uninsured straining the quality of healthcare. Heavy immigration from Latin America threatens our cohesiveness as a nation.
The political realities of the rapidly growing Latino population are such that Mr. Obama may be the last president who can avert the permanent, vast underclass implied by the current Census Bureau projection for 2050.
Do I sound like a right-wing "nativist"? I'm not. I'm a lifelong Democrat; an early and avid supporter of Obama. I'm gratified by his nomination of Sonia Sotomayor to the Supreme Court. I'm also the grandson of Eastern European Jewish immigrants; and a member, along with several other Democrats, of the advisory boards of the Federation for American Immigration Reform and Pro English. Similar concerns preoccupied the distinguished Democrat Barbara Jordan when she chaired the congressionally mandated US Commission on Immigration Reform in the 1990s.
Congresswoman Jordan was worried about the adverse impact of high levels of legal and illegal immigration on poor citizens, disproportionately Latinos and African-Americans. The principal beneficiaries of our current immigration policy are affluent Americans who hire immigrants at substandard wages for low-end work. Harvard economist George Borjas estimates that American workers lose $190 billion annually in depressed wages caused by the constant flooding of the labor market at the low-wage end.
The healthcare cost of the illegal workforce is especially burdensome, and is subsidized by taxpayers. To claim Medicaid, you must be legal, but as the Health and Human Services inspector general found, 47 states allow self-declaration of status for Medicaid. Many hospitals and clinics are going broke because of the constant stream of uninsured, many of whom are the estimated 12 million to 15 million illegal immigrants. This translates into reduced services, particularly for lower-income citizens.
The US population totaled 281 million in 2000. About 35 million, or 12.5 percent, were Latino. The Census Bureau projects that our population will reach 439 million in 2050, a 56 percent increase over the 2000 census. The Hispanic population in 2050 is projected at 133 million – 30 percent of the total and almost quadruple the 2000 level. Population growth is the principal threat to the environment via natural resource use, sprawl, and pollution. And population growth is fueled chiefly by immigration.
Consider what this, combined with worrisome evidence that Latinos are not melting into our cultural mainstream, means for the US. Latinos have contributed some positive cultural attributes, such as multigenerational family bonds, to US society. But the same traditional values that lie behind Latin America's difficulties in achieving democratic stability, social justice, and prosperity are being substantially perpetuated among Hispanic-Americans.
Prominent Latin Americans have concluded that traditional values are at the root of the region's development problems. Among those expressing that opinion: Peruvian writer Mario Vargas Llosa; Nobelist author Octavio Paz, a Mexican; Teodoro Moscoso, a Puerto Rican politician and US ambassador to Venezuela; and Ecuador's former president, Osvaldo Hurtado.
Latin America's cultural problem is apparent in the persistent Latino high school dropout rate – 40 percent in California, according to a recent study – and the high incidence of teenage pregnancy, single mothers, and crime. The perpetuation of Latino culture is facilitated by the Spanish language's growing challenge to English as our national language. It makes it easier for Latinos to avoid the melting pot and for education to remain a low priority, as it is in Latin America – a problem highlighted in recent books by former New York City deputy mayor Herman Badillo, a Puerto Rican, and Mexican-Americans Lionel Sosa and Ernesto Caravantes.
Language is the conduit of culture. Consider: There is no word in Spanish for "compromise" (compromiso means "commitment") nor for "accountability," a problem that is compounded by a verb structure that converts "I dropped (broke, forgot) something" into "it got dropped" ("broken," "forgotten").
As the USAID mission director during the first two years of the Sandinista regime in Nicaragua, I had difficulty communicating "dissent" to a government minister at a crucial moment in our efforts to convince the US Congress to approve a special appropriation for Nicaragua.
I was later told by a bilingual, bicultural Nicaraguan educator that when I used "dissent" what my Nicaraguan counterparts understood was "heresy." "We are, after all, children of the Inquisition," he added.
In a letter to me in 1991, Mexican-American columnist Richard Estrada described the essence of the problem of immigration as one of numbers. We should really worry, he wrote, "when the numbers begin to favor not only the maintenance and replenishment of the immigrants' source culture, but also its overall growth, and in particular growth so large that the numbers not only impede assimilation but go beyond to pose a challenge to the traditional culture of the American nation."
Obama should confront the challenges by enforcing immigration laws on employment to help end illegal immigration. We should calibrate legal immigration annually to (1) the needs of the economy, as Ms. Jordan urged, and (2) past performance of immigrant groups with respect to acculturation.
We must declare our national language to be English and discourage the proliferation of Spanish- language media. We should limit citizenship by birth to the offspring of citizens. And we should provide immigrants with easy-to-access educational services that facilitate acculturation, including English language, citizenship, and American values.

Subject: Cheap Labor This should make everyone think, be you Democrat, Republican or Independent From a California school teacher - - -"As you listen to the news about the student protests over illegal immigration, there are some things that you should be aware of: I am in charge of the English-as-a-second-language department at a large southern California high school which is designated a Title 1 school, meaning that its students average lower socioeconomic and income levels. Most of the schools you are hearing about, South Gate High, Bell Gardens, Huntington Park, etc., where these students are protesting, are also Title 1 schools. Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll -- but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK) I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK) I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK) I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears. Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

Senators Tell DHS To Stop Ignoring Illegal Alien Sanctuaries

While the Justice Department focuses on taking action against state laws to combat illegal immigration, a group of U.S. Senators is asking the Obama Administration to stop ignoring local ordinances that undermine federal laws by offering undocumented aliens sanctuary.
In battling local immigration control measures nationwide, the DOJ has claimed that they conflict with federal immigration law [1]and undermine the government’s careful balance of immigration enforcement priorities and objectives. The Obama Administration has made this argument recently in cases against Arizona and Alabama.
But what is the administration doing about local governments that refuse to cooperate with federal immigration authorities and blatantly ignore the legal status of arrested individuals? A group of Senate Judiciary Committee members posed the question to Homeland Security Secretary Janet Napolitano this week.
They specifically mentioned Cook County Illinois where local authorities openly flip the finger at the feds by refusing to report illegal immigrants who come in contact with police, even dangerous criminals. In fact, in 2007 Judicial Watch took legal action [2] against the Chicago Police Department—which has a don’t-ask-don’t-tell immigration policy—after learning of an illegal immigrant sanctuary resolution that was being considered by Cook County’s Board of Commissioners at the time.
In a letter [3] to Napolitano this week, the Judiciary Committee members—senators Chuck Grassley (Iowa), John Cornyn (Texas), Tom Coburn (Oklahoma) and Jeff Sessions (Alabama)—cite a recent meeting with a high-ranking Immigration and Customs Enforcement (ICE) official who confirmed that Cook County creates a major problem for enforcement efforts. In fact, the ICE associate director of removal operations said Cook County’s egregious example of sanctuary city policies presents “an accident waiting to happen.”
So the senators ask Napolitano: “We would like to know what specific steps have been and will be taken by your Department to compel Cook County to reverse its policy of ignoring immigration detainers. In addition, we would request an overview of meetings held between federal officials and Cook County, including any emails or other documentation that exist, to understand how the federal government has been or is attempting to rectify the situation.”
Napolitano is urged to take a direct role in the matter by the lawmakers who remind the Homeland Security Secretary that Cook County’s ordinance creates a “serious threat to the public’s safety” that requires Napolitano’s “immediate and personal attention.” It’s a matter of national security, the veteran senators assert.
Americans shouldn’t hold their breath. The Obama Administration is too busy fighting local measures that are viewed as “discriminatory” and “anti-immigrant” by the open borders movement. In fact, the DOJ even created a secret group [4] within the bloated civil rights division to monitor laws passed by states and local municipalities to control illegal immigration.
Judicial Watch has been a frontrunner in the nationwide battle to combat illegal immigration and earlier this year filed a motion [5] on behalf of the Arizona State Legislature in the Obama Administration’s lawsuit challenging its tough law. JW has also sued police departments across the country for practicing don’t-ask-don’t-tell immigration policies and has led an effort to shut down taxpayer-funded day laborer centers. Less than a week after suing Arizona to block its immigration law, SB 1070, critics are pressing the Obama administration to go after “sanctuary cities” that deliberately look the other way when it comes to illegal immigration. The Department of Justice last week responded that it will not sue these cities, which prohibit local law enforcement from inquiring about an individual’s legal status or alerting immigration authorities when they encounter illegal immigrants, because it believes passive refusal to follow the law is not as egregious as Arizona’s passage of a law that “actively interferes” with federal law. Justice Department spokeswoman for Attorney General Eric Holder inexplicably argued, “There is a big difference between a state or locality saying they are not going to use their resources to enforce a federal law, as so-called sanctuary cities have done, and a state passing its own immigration policy that actively interferes with federal law.” (The Washington Times, July 14, 2010).

Representative Lamar Smith (R-TX), who authored the 1996 federal law which requires states and localities to cooperate with federal authorities on immigration enforcement, criticized the Justice Department’s politically convenient stance on sanctuary cities. "For the Justice Department to suggest that they won't take action against those who passively violate the law …. is absurd," said Rep. Smith. "Will they ignore individuals who fail to pay taxes? Will they ignore banking laws that require disclosure of transactions over $10,000? Of course not." (The Washington Times, July 14, 2010).

Arizona Governor Jan Brewer has also noted the irony of the Obama administration’s refusal to sue localities to strike down their sanctuary policies, which she said could also be considered a “patchwork” of immigration laws across the country. (Brewer Statement, July 6, 2010). Senator David Vitter (R-LA) similarly noted, “This administration’s idea of immigration enforcement is to go after the states and local officials actually trying to enforce the laws on the books. They are demonizing those that look to protect our border and end illegal immigration while giving a wink and nod of approval to sanctuary cities that don't enforce our laws.” (Vitter Press Release, July 15, 2010).

8 New American Gateways For Immigrants

The economic recovery may be slow and uncertain. Immigration remains a hot button political issue. But there's one positive trend that will keep benefiting smaller cities in the years ahead: Their growing appeal to immigrant poppulations.

Though New York, Los Angeles, Miami, Chicago and other large U.S. cities remain hubs for immigrants, newcomers from abroad are increasingly settling in smaller communities across the U.S., lured by a lower cost of living, more job opportunities, and a support structure of fellow immigrants. In return, these communities get a rejuvenated work force and a consumer base.
Here are eight rapidly emerging gateway communities for immigrants. All are likely to remain popular with foreign newcomers, despite stepped-up enforcement of federal immigration laws. Some may surprise you.
Benton/Washington Counties, Ark.

Home to large employers such as Wal-Mart in Bentonville and Tyson Foods in nearby Springdale, these northwest Arkansas counties have seen enormous growth in their immigrant populations over the past decade.
Foreign born residents now make up more than 20% of Springdale's population. The area's chicken farms, construction industry, corporate headquarters, and low cost of housing remain a strong magnet.
With Hispanics accounting for most of the increase, the region is seeing more ethnic bakeries, restaurants, media outlets, and other businesses. The once nearly homogeneous local school districts have added English as a second language to their curricula in addition to special programs to help involve parents in their children's education.
Portland and Salem, Ore. (Marion/Multnomah counties)

The growth of the area's technology industry draws highly skilled immigrant workers to northwest Oregon, where they're joining earlier arrivals -- refugees from Southeast Asia, Africa, eastern Europe and Russia.
Fairfax County, Va.
In this large suburban county bordering Washington, D.C., immigrants make up almost 30% of the population. The recession hasn't been felt here as much as it has in other parts of the country and construction, and service jobs are still plentiful. Fairfax County is across the Potomac River from the nation's capital, which, along with other large cities, has long been a draw for immigrants.
There's also a strong immigrant presence among service workers, especially in health care, restaurants, and cleaning services. Nearly 40% of the region's immigrant population arrived within the past decade. Many own their own businesses. And they are encouraging more family members and friends from the old country to join them.
Shelbyville, Tenn. (Bedford County)
Though the foreign born population in Shelbyville hovers around the national average, the small city and its environs have become a mecca for refugees from Egypt, Myanmar (formerly known as Burma), and Somalia. There are jobs in Shelbyville's food processing plants and other factories.
Cape Coral, Fla. (Lee County)
Southwest Florida's Gulf Coast has strong agriculture and service sectors. In 2000, Cape Coral's foreign born population was 8.7%, relatively low compared with national average of 11.1%. In the past decade it has increased by about 250% -- putting it above the national average.
Boise, Id. (Ada County)
Attracted to the area by job opportunities in agriculture and an affordable cost of living, Boise's immigrant population has climbed by more than 50% over the past decade.
Gwinnett County, Ga.
The foreign born population in Gwinnett County has more than doubled since 2000, and now represents about 25% of the county's total population. Drawn to the area by an abundance of jobs in the service sector and the low cost of housing, the immigrants are mostly Hispanic. They are carving out a livelihood in a region where blacks have traditionally been the most visible minority. Gwinnett also has one of the highest rates of illegal immigration in the U.S. -- authorities estimate that half of all foreign born residents of the county are unauthorized.
Raleigh-Durham-Cary, N.C. (Wake/Durham/Chatham Cos.)

North Carolina's 394% immigrant growth rate in the 1990s was the fastest among Southern states, and the trend has continued in the 21st century. The Raleigh-Durham area has been hub to much of this growth.
The draw? Affordable housing and jobs at Research Triangle Park -- one of the country's largest technology development centers -- as well as in the construction and service sectors. The recession and stricter enforcement of immigration laws in the Tar Heel State are slowing immigration growth -- at least for now. But many experts think migration could pick up again as the economy recovers.

There are currently over 400,000 unaccounted for illegal alien criminals with outstanding deportation orders. Those are just the ones apprehended. At least one fourth of these are hard core criminals. Nobody knows how many more there are, but they are numerous and roaming your neighborhoods, preying on you and your family. In case you are interested, that is 250 illegal alien child molesters. And that is just the tip of the iceberg.

When we talk about the costs to secure our borders, we need to ask "How many crimes against children is acceptable collateral damage?" Isn't that what it is all about? Cheap lettuce versus molested, raped and murdered children - a cost/benefit tradeoff.
Occasionally, the Federal Government decides to actually do something about some of the more violent illegal alien criminals - after they are already here and have committed mayhem! Operation Predator evolved out of ICE's mission to find and deport illegal aliens with the more heinous criminal records. The majority of the arrests under Operation Predator - roughly 85% - involved foreign nationals in this country whose child sex crimes made them removable from the United States. By matching immigration databases with state Megan's law directories, ICE agents have arrested more than 1,800 registered sex offenders.
Digressing for a moment, what the hell was a convicted, illegal alien sex offender even doing out of jail or not immediately deported – even if 63% do come right back - let alone roaming around the neighborhoods while on a registry! Has the judicial system in this country gone insane?
In any case, Operation Predator began on July 9, 2003, and resulted in 6,085 child predator arrests throughout the country - an average of roughly 250 arrests per month and eight arrests per day. While arrests have been made in every state, the most have occurred in these states: Arizona (207), California (1,578), Florida (255), Illinois (282), Michigan (153), Minnesota (190), New Jersey (423), New York (367), Oregon (148) and Texas (545).
While Operation Predator was a noble effort and ICE is to be commended, it only made a small dent in the criminal activity and number of horrific crimes being committed by illegal alien child sexual predators.
It is worth noting that some pedophile statistics report that each pedophile molests average of 148 children. If so, that could be as many as 900,580 victims from just the 6,085 illegal alien predators that were caught. Regardless, how many children being molested is acceptable collateral damage?
In fact, the criminal activity in the illegal alien community is now so bad that illegal aliens are being held for ransom and as slaves by other illegal aliens and smugglers are kidnapping illegal aliens from other smugglers! While it is a fact that most illegal aliens are law abiding, except for breaking immigration laws, it is also a fact that a significant percentage of illegal aliens have no respect for the rule of law and our legal customs. Many come with anti-American attitudes and philosophies that are totally alien to our culture, a subject addressed later in this paper. The end result is an ever-growing lawlessness among large portions of the illegal alien communities. It only makes sense that illegal alien criminals come to the United States - this is where the money is and our jails are a whole lot nicer than what they have in their home countries.
As previously noted, this report does not go into the property crimes being committed by illegal aliens. However, like the activities of other equal opportunity criminals, many property crimes are drug related, an activity that many illegal aliens, especially illegal alien gangs, are involved in. While violent crimes against one's person are the most serious, if your identity or car is stolen by an illegal alien you won't be too happy about it.
As a small example of property crimes, in 2003, according to the Arizona Department of Motor Vehicles, 57,600 cars were stolen in Phoenix alone. The owner losses are estimated to exceed $864 million. Most of the stolen cars ended up in Mexico and were never recovered. How many of those cars were stolen by illegal alien criminals versus resident criminals is unknown but you can rest assured that illegal aliens had a large part of it..

Illegal Alien At Center Of JW Probe Guilty Of Murder

An illegal immigrant at the center of a Judicial Watch investigation has been convicted of murder [1]in the drunk-driving accident that killed a Benedictine nun and critically injured two others in the Washington Metropolitan area last year.

Despite an extensive criminal history, the Bolivian man (Carlos Martinelly-Montano) had been released by federal immigration authorities on his own recognizance after being arrested. On the August 2010 night he killed the nun in Prince William County, Martinelly-Montano had a revoked license and was awaiting a deportation ruling. His car crossed a median and slammed head on into a vehicle carrying the three nuns.

Judicial Watched sued [2] the Department of Homeland Security last December for records related to the agency’s investigation of the case. A federal court ordered the files released and JW made them public in March. The DHS report [3]essentially details policies and actions of the Obama Administration and local governments that allowed Montano to remain on the streets despite being subject to deportation.

For instance the records show that as far back as 2007 Montano was convicted for driving under the influence (DIU) in Prince William County and was sentenced to 30 days in jail. However, a judge suspended the sentence and Montano walked because local police didn’t bother to determine his immigration status.

“Almost one year later, on October 4, 2008, Montano was booked into jail in Prince William County and charged with another misdemeanor DUI,” the DHS records obtained by JW say. “At the time of this arrest, the local authorities determined that Montano was an illegal alien. Thus, ICE (Immigration and Customs Enforcement) lodged an immigration detainer against him. As a result of the immigration detainer, immigration officers took him into custody. On October 7, 2008, Prince William County officials released him from custody.”

Instead of detaining Montano, “ICE agents determined that Montano was a candidate for the Alternatives to Detention (ATD) program,” which monitored his whereabouts using GPS technology. He was therefore released, the records reveal. While awaiting his deportation hearing, “Montano was charged on March 5, 2009, in Fairfax County, Virginia, with misdemeanor failure to appear related to driving without a license.”

Local officials dismissed this charge against Montano on May 5, 2009 and county officials did not contact ICE. On April 27, 2010, a Manassas Park Police officer cited Montano for misdemeanor reckless driving. There is no record indicating that Montano was booked or fingerprinted or that Manassas Park officials contacted ICE. On June 1, 2010, Montano was convicted for reckless driving and fined $500. Again, ICE was not contacted following the citation or conviction.

On April 27, 2009, as a result of the October 2008 DUI arrest, the Circuit Court of Prince William County convicted Montano and sentenced him to serve 12 months and 3 days in jail. However, the judge in Prince William County suspended 11 months and 13 days of Montano’s sentence. As a result of the judge’s decision, Montano served less than two weeks in Prince William County for his second DUI conviction, the DHS records show.

Here is one of the final entries in the DHS files obtained by JW: “On May 7, 2009, after Montano served the portion of his sentence that had not been suspended, ICE took him into custody. Based on Montano’s compliance during his prior participation in the ATD program, ICE officers released Montano on the prior order of supervision (dating back to 2008) with the condition that he report to ICE on a regular basis.”

Instead he got behind the wheel intoxicated, murdered an innocent woman and critically injured two others. Montano is scheduled to be sentenced in February and faces a maximum of 70 years in prison. His taxpayer-funded defense attorney has indicated that she plans to file an appeal.
