With a $4.7 trillion bailout under their belts and no harm done to their billion-dollar bonuses, don't expect Wall Street bankers to be chastened by the 2008 financial crisis. Below we list eight things to watch out for in 2011 that threaten to rock the financial system and undermine any recovery.
1) The Demise of Bank of America WikiLeaks founder Julian Assange is promising to unleash a cache of secret documents from the troubled Bank of America (BofA). BofA is already under the gun, defending itself from multiple lawsuits demanding that the bank buy back billions worth of toxic mortgages it peddled to investors. The firm is also at the heart of the robo-signing scandal, having wrongfully kicked many American families to the curb. If Assange has emails showing that Countrywide or BofA knew they were recklessly abandoning underwriting standards and/or peddling toxic dreck to investors, the damage to the firm could be irreparable.
2) Robo-signers Wreaking Havoc With lawsuits abounding, new types of fraud in the foreclosure process are being uncovered daily, including accounting fraud, fake attorneys, destroyed promissory notes and false notarization. The crisis not only calls into question the legality of untold foreclosures, it also calls into question the value of trillions of dollars worth of mortgage-backed securities held by banks, pension funds, federal, state and local governments. The only government report on the topic by the feisty Congressional Oversight Panel for the TARP acknowledges that "it is possible that 'robo-signing' may have concealed deeper problems in the mortgage market that could potentially threaten financial stability."
3) MERS Madness
In addition to outright fraud, numerous state Supreme Courts have questioned the legal standing of the Mortgage Electronic Registration or "MERS" system. MERS is listed as the mortgagee for 60% of U.S. mortgages. It is an electronic clearinghouse created by industry to bypass the property registration system developed in precolonial days to ensure that the King could not easily rob the subjects of their land. Wall Street turned to MERS to speed securitizations (and now foreclosures), but its legal standing is now in doubt and its shoddy processing of documents has major ramifications for the securitization process as well. Look for a rotten "MERS fix" in the new Congress. Let's hope it gives consumer advocates some leverage to demand justice for Americans being robbed by the new Kings on Wall Street.
4) Flash Crash Calamity The "flash crash" of May 2010 rattled the markets and caused a stunning 700 point drop in the Dow within minutes. Regulators think they know what occurred, but they are moving too slowly to put the brakes on hair-trigger trading. Seventy percent of Wall Street trades take place in milliseconds, so it is no surprise that mini-flash crashes are becoming a constant. With traders now gearing up to trade on raw news feeds and Twitter, we can anticipate even more volatility. A small financial transaction tax targeting high-volume, high-speed trades is long overdue. It would throw sand in the roulette wheel and raise much needed revenue for the federal government.
5) Bigger Behemoth Banks The Federal Reserve is planning to "stress test" the big banks again. The same 19 banks that underwent the first stress tests in 2009 will be tested again, but this time the Fed says it won't release the results. Why not? Banks with toxic mortgages and mortgage-backed securities on their books and concomitant legal exposure to "put back" law suits are being kept afloat by accounting tricks, TARP and Fed loans. Honest stress tests of still weak financial institutions may well result in sales and buyouts that will further consolidate the already concentrated banking industry and create larger and more unwieldy "too big to fail" behemoths -- backed by the guarantee of the American taxpayer.
6) Foreclosure Tsunami Housing foreclosures may top nine million in 2011 and [[Goldman Sachs]] predicts the number will reach 12 million in the next few years. The result will be another significant drop in home prices in 2011 and even more families underwater. Civilized nations see the forcible migration of a city the size of New York as an economic and humanitarian catastrophe, but not the United States. The Obama administration and Congress have callously refused to take meaningful action to aid families facing foreclosure even in the face of widespread predatory lending and rampant foreclosure fraud. The only hope now for millions of American families is aggressive action by the 50 state Attorneys General who are actively investigating foreclosure fraud. Whether they have the guts to wrestle a settlement out of the big banks that slows the foreclosure machine and offers families meaningful options has yet to be seen.
7) Bankrupt Cities and States Meredith Whitney, a research analyst who correctly predicted the credit crunch, is now warning that over 100 American cities could go bust next year. She anticipates billions worth of municipal bond defaults and warns: "next to housing this is the single most important issue in the U.S. and certainly the biggest threat to the U.S. economy." States are also in dire straits. The economic shock of mass unemployment on top of years of population decline, deindustrialization and the like have left cities unable to meet their obligations to taxpayers and retirees. With the austerity nuts in charge of the House, it may take a bankruptcy of a major player to prod an appropriate federal response to this looming disaster.
8) Gas Prices above $4.00 The price of energy and other commodities shifted into high gear in late August when the Federal Reserve Chairman decided to stimulate the economy with quantitative easing. Speculators quickly began bidding up the value of asset classes like crude oil, metals and food commodities. In December, the Commodities Futures Trading Commission failed to apply position limits to these commodities, delaying rules that would crack down on speculators and aid consumers who are already seeing big price hikes at the pump. Without swift action, skyrocketing gas prices will further tank an already stalled economy.
As we hope for the best in 2011, let's prepare for the worst. The big banks are sure to deliver.

The big bankers are still free to create and trade the very derivatives that catapulted us into this global crisis. You'd think the billionaires would be praying on the altar of government and erecting statues on Capital Hill in honor of St. Bailout.

While 43.6 million Americans live in poverty, the richest men of finance sure are getting pissy. First Steve Schwartzman, head of the Blackrock private equity company, compares the Obama administration's effort to close billionaires' tax loopholes to "the Nazi invasion of Poland." Then hedge fund mogul David Loeb announces that he's abandoning the Democrats because they're violating "this country's core founding principles" -- including "non-punitive taxation, Constitutionally-guaranteed protections against persecution of the minority, and an inexorable right of self-determination." Instead of showing their outrage about the spread of poverty in the richest nation on Earth, the super-rich want us to pity them?
Why are Wall Street's billionaires so whiny? Is it really possible to make $900,000 an hour (not a typo -- that's what the top ten hedge fund managers take in), and still feel aggrieved about the way government is treating you? After you've been bailed out by the federal government to the tune of $10 trillion (also not a typo) in loans, asset swaps, liquidity and other guarantees, can you really still feel like an oppressed minority?

Instead, standing before us are these troubled souls, haunted by visions of persecution. Why?
The world changed. Before the bubble burst, these people walked on water. Their billions proved that they were the best and the brightest -- not just captains of the financial universe, but global elites who had earned a place in history. They donated serious money to worthy causes -- and political campaigns. No one wanted to mess with them.
But then came the crash. And the things changed for the big guys -- not so much financially as spiritually. Plebeians, including me, are asking pointed questions and sometimes even being heard, both on the Internet and in the mainstream media. For the first time in a generation, the public wants to know more about these emperors and their new clothes. For instance:
• What do these guys actually do that earns them such wealth?
• Is what they do productive and useful for society? Is there any connection between what they earn and what they produce for society?
• Did they help cause the crash?
• Did these billionaires benefit from the bailouts? If so, how much?
• Are they exacerbating the current unemployment and poverty crisis with their shenanigans?
• Why shouldn't we eliminate their tax loopholes (like carried interest)?
• Should their sky-high incomes be taxed at the same levels as during the Eisenhower years?
• Can we create the millions of jobs we need if the billionaires continue to skim off so much of our nation's wealth??
• Should we curb their wealth and political influence?
How dare we ask such questions! How dare we consider targeting them for special taxes? How dare we even think about redistributing THEIR incomes... even if at the moment much of their money comes directly from our bailouts and tax breaks?
It's true that the billionaires live in a hermetically sealed world. But that doesn't mean they don't notice the riffraff nipping at their heels. And they don't like it much. So they've gotten busy doing what billionaires do best: using their money to shield themselves. They're digging into their bottomless war chests, tapping their vast connections and using their considerable influence to shift the debate away from them and towards the rest of us.
We borrowed too much, not them. We get too much health care, not them. We retire too soon, not them. We need to tighten our belts while they pull in another $900,000 an hour. And if we want to cure poverty, we need to get the government to leave Wall Street alone. Sadly, their counter-offensive is starting to take hold.
How can this happen? Many Americans want to relate to billionaires. They believe that all of us are entitled to make as much as we can, pretty much by any means necessary. After all, maybe someday you or I will strike it rich. And when we do, we sure don't want government regulators or the taxman coming around!
Billionaires are symbols of American individual prowess and virility. And if we try to hold them back or slow them down, we're on the road to tyranny. Okay, the game is rigged in their favor. Okay, they got bailed out while the rest of us didn't -- especially the 29 million people who are jobless or forced into part-time work. But what matters most is that in America, nothing can interfere with individual money-making. That only a few of us actually make it into the big-time isn't a bad thing: It's what makes being rich so special. So beware: If we enact even the mildest of measures to rein in Wall Street billionaires, we're on the path to becoming North Korea.
Unfortunately, if we don't adjust our attitudes, we can expect continued high levels of unemployment and more people pushed below the poverty line. It's not clear that our economy will ever recover as long as the Wall Street billionaires keep siphoning off so much of our wealth. How can we create jobs for the many while the few are walking off with $900,000 an hour with almost no new jobs to show for it? In the old days, even robber barons built industries that employed people -- steel, oil, railroads. Now the robber barons build palaces out of fantasy finance. We can keep coddling our financial billionaires and let our economy spiral down, or we can make them pay their fair share so we can create real jobs. These guys crashed the economy, they killed billions of jobs, and now they're cashing in on our bailout. They owe us. They owe the unemployed. They owe the poor.
Dwight D. Eisenhower was no radical, but he accepted the reality: If America was going to prosper -- and pay for its costly Cold War -- the super-rich would have to pony up. It was common knowledge that when the rich grew too wealthy, they used their excess incomes to speculate. In the 1950s, memories of the Great Depression loomed large, and people knew that a skewed distribution of income only fueled speculative booms and disastrous busts. On Ike's watch, the effective marginal tax rate for those earning over $3 million (in today's dollars) was over 70 percent. The super-rich paid. As a nation we respected that other important American value: advancing the common good.
For the last thirty years we've been told that making as much as you can is just another way of advancing the common good. But the Great Recession erased that equation: The Wall Streeters who made as much as they could undermined the common good. It's time to balance the scales. This isn't just redistribution of income in pursuit of some egalitarian utopia. It's a way to use public policy to reattach billionaires to the common good.
It's time to take Eisenhower's cue and redeploy the excessive wealth Wall Street's high rollers have accumulated. If we leave it in their hands, they'll keep using it to construct speculative financial casinos. Instead, we could use that money to build a stronger, more prosperous nation. We could provide our people with free higher education at all our public colleges and universities -- just like we did for WWII vets under the GI Bill of Rights (a program that returned seven dollars in GDP for every dollar invested). We could fund a green energy Manhattan Project to wean us from fossil fuels. An added bonus: If we siphon some of the money off Wall Street, some of our brightest college graduates might even be attracted not to high finance but to jobs in science, education and healthcare, where we need them.
Of course, this pursuit of the common good won't be easy for the billionaires (and those who indentify with them.). But there's just no alternative for this oppressed minority: They're going to have to learn to live on less than $900,000 an hour.

Obama, where are those ‘hard truths’ you promised?

During the 2008 campaign, Barack Obama repeatedly said he would tell Americans the hard truths — not what “you want to hear but . . . what you need to hear.”
On the most vexing challenge facing the country — how not to go bankrupt — he hasn’t lived up to the promise.
I’m not talking about Exhibit A in the Republican indictment, which is the rapid rise in the deficit over the past two years. Given the economy he inherited, Obama would have been derelict not to increase spending.
But when it comes to what has to be said and done for long-term fiscal responsibility, the president has chosen easier politics over harder truths.
His signature achievement is a health-care bill that represents, happily, a major step toward universal health care and contains some hopeful seeds of cost control. But it is also the biggest new entitlement since Medicare with little new revenue to support it. The bill does include a watered-down version of a tax on high-priced employer-provided health-care plans, but even that won’t take effect until after a second Obama term would be over.
As Congress considered naming a bipartisan fiscal commission with statutory teeth, Obama was AWOL, though presidential lobbying might have made a difference. When the toothless commission that he subsequently appointed unexpectedly coalesced around a fiscal plan that managed to attract support ranging from Dick Durbin on the left to Tom Coburn on the right, Obama refused to lend it a hand.
When Republican Paul Ryan offered his own long-term plan, Obama responded with a speech that was more a prelude to the 2012 election than a plausible invitation to negotiation.
And throughout, the president has stuck to the position, belied by his own budget numbers, that his vision of government is affordable without raising taxes on anyone but the rich.
Now the conventional wisdom in Washington has it that the presidential campaign has begun and we shouldn’t expect any serious progress toward debt reduction until 2013.
And, as if on cue, Republican candidate Tim Pawlenty is promising, yes, hard truths.
“I could promise that we can eliminate a $14 trillion debt, create jobs for 10 million people, restructure Social Security and health care, all without making any tough decisions,” he said as he prepared to announce his campaign. “Or, I could try something different. I could just tell you the truth.”
That was less than a month ago. Last week, Pawlenty offered an economic plan that set a modern-day record for wishful thinking.
It counts on a rate of growth far higher than the U.S. economy has ever sustained in the modern era. It proposes flattening and lowering income tax rates, but without — as has always been the case with flat-tax proposals — taking away any of the special-interest subsidies and deductions built into the tax code. Altogether, as Ruth Marcus reported last week, the Pawlenty plan could cost more than $11 trillion over the next 10 years.
So much for “tough decisions.”
Pawlenty’s fictions are particularly disappointing because, as a former two-term governor of a purple state, he entered the race understanding the difference between governing and pandering. Now he has set a bar of irresponsibility to which his rivals will feel pressure to stoop.
And as the incumbent has discovered, irresponsible campaign promises don’t magically fade upon election. There’s no guarantee that Obama would have behaved differently as president had he not promised during the campaign never to raise taxes on the middle class or laced into John McCain’s sensible proposal to tax employer-provided health care. But there’s no doubt that both campaign stances limited his freedom in office.
There are meaningful philosophical divisions between the parties, and campaigns are important to draw distinctions and fight them out. But most Americans aren’t extreme left or right. They wouldn’t be satisfied with the services they would get from a government spending only 18 percent of GDP, as Pawlenty proposes, but they don’t want Obama’s 25 percent either.
The hard truth, in other words, is that there will have to be compromise. Should we be soothed by those who tell us it is likely to be achieved in 2013? When the time comes, the same people will be pointing out that Obama is a lame duck, or that the new Republican president is shackled by promises that saw him or her through the primaries. And the 2014 election will be looming.
We are always somewhere in the election cycle. Compromise will require a leader to put the national interest first, to take a chance on delivering hard truths, not just promising them. That will be no easier, and no less risky, in 2013 than it is today.

Mexican Drug War: U.S. Accused Of Laundering Drug Cartel Money

In the beginning there was Fast and Furious, a botched operation carried by the Phoenix office of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) between 2009 and 2010, where officials at the federal agency encouraged gun shops to sell up to 1,725 assault rifles and other weapons destined for Mexican drug cartels.
In Mexico, some of the weapons were used in murders. The feds said they were using the gun runners to track down ranking members of the drug cartels and other criminal enterprises.
The revelation prompted, first, a wave of denials and bitter accusations within the government; then, a series of investigations and an admission of wrongdoing by Attorney General Eric Holder.
Now, it's happened again: the federal government, in its rush to help Mexico fight the drug cartels, toed the line separating legal and illegal. This time, according to an investigation by Ginger Thompson in the New York Times, Drug Enforcement Agency (DEA) members "laundered or smuggled millions of dollars in drug proceeds."
All this occurred, according to the paper, in the quest for the identity of the cartel leaders.
This is an ambition that, while certainly laudable, has proven irrelevant in the six-year war on drugs declared by Mexican President Felipe Calderon Hinojosa.
Every few weeks, local news outlets announce dramatic drug seizures and the arrests of local, regional, and even national cartel leaders. The crime bosses are handcuffed and paraded for the news cameras, staring straight into the lens. Before them, mounds of drugs allegedly taken during their capture. Behind them, always masked and heavily armed, soldiers or police escort them.

Then, the suspects disappear. You seldom hear about judicial process or the charges filed. After the next raid, new reputed capos are paraded for the cameras.
And when those disappear, scores of new "leaders" take their places, sometimes peacefully, sometimes with bloodshed.
While trying to achieve what years of military confrontation with the armed wings of drug cartels failed to do, the operation unveiled by the New York Times emphasizes the blurring of "the line between surveillance and facilitating crime" because "as it launders drug money, the agency often allows cartels to continue their operations over months or even years before making seizures or arrests."
But what makes this story stand out is that fact that similar operations organized by American agencies occurred in other places. After all, people close to the DEA told the Times, the operation wasn't as dangerous as running guns.
In Mexico operation such as these were forbidden in 1998 after the government learned -- only after the fact -- that an American sting operation was illegally carried out on Mexican for three years, as Julia Preston reported in the New York Times:
"The three-year undercover operation, code-named Casablanca, was described by officials of the United States Customs Services as the largest and probably the most successful in American law enforcement history. According to indictments in Los Angeles stemming from the investigation, employees of 12 Mexican banks laundered at least $110 million for drug organizations based in Colombia and Mexico."
This time, though, the operation was apparently launched after an invitation from the highest echelons of the Mexican government. That is where President Felipe Calderon considers his legacy, with national elections to replace him next July, of success or failure in his war with the drug kingpins.
Critics claim that Calderon's stubborn assault on the cartels has unleashed an unnecessary bloodbath in which close to 50,000 were killed.
However, a measure of the urgency and importance of the latest operation is that it marks a frontal assault where it hurts most: in the deep pockets of the cartels, in their financial arm.
A recent article in the Los Angeles Times by Ken Ellingwood and Tracy Wilkinson, reported from Mexico, comments on a dirty little secret known to many there: drug money shines "in gleaming high-rises in beach resorts such as Cancun, in bustling casinos in Monterrey, in skyscrapers and restaurants in Mexico City that sit empty for months. It seeps into the construction sector, the night-life industry, even political campaigns."
Actually, according to the L.A. Times, the amount of laundered money could reach $50 billion, or around 3 percent of the national economy. Last year, only 37 people were arrested for that crime.
(Other sources mention different amounts for laundered money; the "Informador" placed it at $25 billion, while the N.Y. Times story reported an "estimated $18 billion to $39 billion in drug money that flows between the countries each year."
The Calderon administration has asked the congress for restrictions on dollar transactions in an attempt to curb the money laundering.
The latest revelation, in the New York Times, didn't cause the stir that followed news last February of the Fast and Furious debacle.
Perhaps it is because, as two former DEA agents told the N.Y. Times' Thompson, there is a difference between the operations. While F&F had to do with dangerous weapons still at the hands of criminals and possibly related to the death of an American agent, their own actions dealt with "just" money.
These operations are part of the regular work the U.S. conducts in several countries. According to the N.Y. Times, there are about 50 operations of this kind around the world at any given time.
Yesterday, it was announced that Republican Rep. Darrell Issa, chairman of the House Oversight and Government Reform Committee, will investigate the operation.
Attorney General Eric Holder will appear before the Judiciary Committee of the House of Representatives on Thursday.

The conservative blog Townhall, immediately unleashed a barrage on the Obama administration, accusing Washington of not only supplying the drug cartels with weapons but also money "to carry out their operations."

Other shots at the White House followed: "Breaking: Obama Administration Caught Laundering Money For Drug Cartels" in Godlike Productions.
In a popular right-wing blog, Freerepublic.com, the story prompted comments like this: "I am starting to wonder just how many elected officials and bureaucrats are on the cartel payrolls. My guess is, it is approaching 50 percent of that bunch in Washington. And even higher among officials along the border."

Obama Justice Department Laundered Millions of Dollars in Dirty, Bloody Mexican Cartel Profits

In the latest U.S.-Mexico Obama Justice Department corruption saga, the New York Times is reporting Drug Enforcement Administration undercover agents have been laundering millions of dollars in Mexican Cartel profits in an effort to "catch the big fish," just as they tried to do by allowing thousands of guns to walk during Operation Fast and Furious. 
Undercover American narcotics agents have laundered or smuggled millions of dollars in drug proceeds as part of Washington’s expanding role in Mexico’s fight against drug cartels, according to current and former federal law enforcement officials.

The agents, primarily with the Drug Enforcement Administration, have handled shipments of hundreds of thousands of dollars in illegal cash across borders, those officials said, to identify how criminal organizations move their money, where they keep their assets and, most important, who their leaders are.

They said agents had deposited the drug proceeds in accounts designated by traffickers, or in shell accounts set up by agents.

The officials said that while the D.E.A. conducted such operations in other countries, it began doing so in Mexico only in the past few years. The high-risk activities raise delicate questions about the agency’s effectiveness in bringing down drug kingpins, underscore diplomatic concerns about Mexican sovereignty, and blur the line between surveillance and facilitating crime. As it launders drug money, the agency often allows cartels to continue their operations over months or even years before making seizures or arrests.

At what point do operations like Fast and Furious and this DEA case stop being government operations and become full blown criminal enterprises? Not only has the Obama Justice Department given these cartels thousands of high powered weapons they use to murder people, but have also aided in getting them the cash they need to carry out operations.

Another former agency official, who asked not to be identified speaking publicly about delicate operations, said, “My rule was that if we are going to launder money, we better show results. Otherwise, the D.E.A. could wind up being the largest money launderer in the business, and that money results in violence and deaths.”

Those are precisely the kinds of concerns members of Congress have raised about a gun-smuggling operation known as Fast and Furious,

DOJ Lies About Immigration Courts To Hide Corruption

The Department of Justice distorts figures to hide from Congress pervasive corruption in the nation’s immigration court system, which allows deportable aliens to evade hearings without consequences and more than 1 million removal orders to be ignored.
Adding insult to injury, U.S. taxpayers finance the drove of appeals filed by illegal immigrants deported for criminal convictions and fraudulent marriages. From 2000 to 2007, Americans doled out $30 million for aliens’ court costs, according to a new report authored by a former immigration court judge (Mark H. Metcalf) in south Florida, considered a hotbed in the system.
The veteran jurist says the nation’s immigration courts, which are operated by the DOJ, are ruled by deception and disorder and are at the heart of a system that nurtures scandal. About 250 overwhelmed judges preside over hundreds of thousands of cases annually and rarely are their deportation orders enforced.
Even after the 2001 terrorist attacks, 50% of all aliens who were free pending trial disappeared, according to figures provided in the judge’s report. Between 2005 and 2006 the number of aliens who failed to appear at their court hearing grew to 59%.
The DOJ deceptively reported the figure as “only” 39% by combining aliens who were free pending trial with those in custody who were forced by authorities to appear in court. That allowed the so-called bail-jumpers to appear as a smaller part of a bigger overall figure.
The agency also told Congress that immigration courts rule in favor of aliens only 20% of the time when in fact its 60% and that aliens appeal deportation orders in only 8% of cases when the figure is actually 98%. Many more examples are included in the judge’s report, which refers to the DOJ’s findings as a sham.
“Accuracy, credibility, relevance, and timeliness elude this agency and the flow of believable statistics to the public,” it says. The judge suggests that Congress order its investigative arm, the Government Accountability Office (GAO) to conduct an in-depth probe.

Police say the 8-year-old, who was abducted Monday while playing outside her home, had been sexually assaulted. The suspect, Gregorio Gonzalez, 24, was on felony probation. An unemployed construction worker spotted Gonzalez's truck and gave chase.

An 8-year-old girl, kidnapped from her yard by a stranger — the object of an intensive overnight search — was returned to her mother alive Tuesday after a dramatic rescue by a quick-acting unemployed construction worker.

"It's truly a miracle of God that she is with us…we certainly beat the odds," said Fresno Police Chief Jerry Dyer.

The third-grader and a 6-year-old friend were playing in the driveway in front of their apartment complex about 8:30 Monday evening, when a man, whom police later identified as 24-year-old Gregorio Gonzalez, told them he would buy them gifts if they came with him.

Neighbors who saw the man talking to the children shouted at the girls to run. Gonzalez allegedly grabbed the 8-year-old and forced her into an older rust-colored Chevrolet pickup truck with white stripes.

The girl's mother and a neighbor, Enrique Miguel, followed in his car.

"I saw that same truck around here for days," Miguel said. "We chased and chased but lost him."

Authorities issued an Amber Alert, which quickly escalated to a statewide bulletin about a small girl last seen wearing a purple "Winnie the Pooh" sweatshirt. About 130 officers were put on the case, and helicopters scanned the city. Alerts flashed on freeway signs and appeared during television shows.

Everyone working through the night knew the clock was ticking. Dyer would later point out in a news conference that most kidnapping victims are killed within the first 24 hours.

Just down the street from where the girl was kidnapped, Victor Perez was discussing the story with his neighbor.

"He was saying, 'Man, what could we have done different to keep that from happening?' I was saying, 'We've just got to keep a lookout for that truck.' "

On Tuesday morning, the first thing Perez did was turn on the TV to see if there was anything new in the case. Police had released surveillance camera footage of the truck. As Perez and his cousin Flor Urias watched the grainy black-and-white images, Urias looked out their living room window and saw an old rust-colored pickup with stripes making a U-turn in front of their house.

"I was saying, 'Victor, that sure looks like that truck. Is that the truck? That is the truck,' " Urias said.

But Perez was already out the door giving chase in his 1988 Ford pickup, which he always backs into his driveway so he can leave quickly if he needs to.

The first time he caught up to Gonzalez, Perez waved and rolled down his window as though asking for directions.

"I told him, 'Hey man, let me ask you something.' He said he couldn't talk, his battery was about to die. I said 'I have [jumper] cables.' And I'm thinking, 'Maybe it's not him, he seems like a friendly guy.' Then while we were still talking he sped away."

Perez caught up and forced Gonzalez to the side of the road. Gonzalez threw his hands over his head in anger.

He had been holding the little girl down. When his hands shot up, her head popped up over the dashboard and Perez saw her.

"I made eye contact with her. And that's when I wasn't scared anymore," Perez said. "I won't kid you, until then I'd thought 'Does this guy have a gun?' But once I met her eyes, I just thought 'I've got to get that little girl out of there.' "

Gonzalez sped off, at one point driving on the sidewalk.

Perez kept trying to force Gonzalez to the side of the road, finally pulling his truck directly in Gonzalez's path. His plan was to rush the driver's door. But Gonzalez pushed the girl out the passenger-side door and fled.

The girl's first words to Perez were, "I'm scared."

"I said "You're OK now.' Oh, man, she was shaking so bad. She kept saying 'Am I going to be OK?' and I kept saying 'You're OK now.' "

Police say the girl told them Gonzalez took her to a wooded area near a canal where he sexually assaulted her and at one point threatened to "physically harm" her if she did not get back in the truck. Seven witnesses identified Gonzalez. Some witnessed the kidnapping; others witnessed an incident earlier Monday when he allegedly exposed himself to two young girls and then got away in the same truck.

Gonzalez, who lives with his grandparents, had previously been arrested on charges of possession of a sawed-off shotgun and domestic violence. He was on felony probation. About 40 minutes after he pushed the girl out of his truck, he was spotted in central Fresno by California Highway Patrol Officer Dustin Dimmer and taken into custody.

As Perez was chasing Gonzalez, her mother was home after a night at the police station, sobbing uncontrollably. Miguel, the neighbor who had helped her chase the kidnapper, could hear her through the thin walls.

Then, through the walls, he heard a phone ring. She came next door to tell him her daughter was alive.

"She was crying and crying all night," he said. "Then suddenly, hope. I was afraid there was no hope, but there was."

Officials call for California to withdraw from controversial illegal immigration enforcement program

Seven Democratic members of California's Congressional Delegation called on Gov. Jerry Brown Friday to suspend California's participation in the Secure Communities immigration enforcement program.

In recent weeks, governors in Illinois, New York and Massachusetts sought to suspend or declined to enter into Secure Communities participation agreements. Earlier this week, the Los Angeles City Council voted nearly unanimously to support legislation allowing communities to opt out of the program.

Gov. Brown "should side with both the officers who patrol our communities and the people they protect and end Secure Communities in California," said Rep. Lucille Roybal-Allard (D-Los Angeles).

Under the program, the fingerprints of all arrestees booked into local jails are forwarded to Immigration and Customs Enforcement for screening. It was touted as a way to target serious criminals for deportation but has generated controversy because many of those detained are either not convicted of crimes or are low-level offenders.

A California bill that seeks to modify Secure Communities and allow counties to opt out is making its way through the Legislature but whether states and counties can legally decline to participate is not clear.

In addition to Roybal-Allard, Reps. Judy Chu (D-Monterey Park), Maxine Waters (D-Los Angeles), Linda Sanchez (D-Lakewood), Grace Napolitano (D-Norwalk) and Karen Bass (D-Los Angeles) signed the letter. It was organized by Rep. Xavier Becerra (D-Los Angeles).

Dozens of Central Valley gang leaders arrested in one-day sweep

Police arrested 75 alleged gang leaders Tuesday in a one-day sweep in the Central Valley for offenses including attempted murder and drug trafficking, state Atty. Gen. Kamala Harris said Wednesday.

The raids, which involved helicopters and canine units, occurred at 50 locations in the cities of Madera, Los Banos, Livingston, Merced, Atwater and Dos Palos as part of the Operation Red Zone crackdown, Harris said.

It was aimed at "ruthless" and "lethal" gang leaders associated with Nuestra Familia, which was started at Folsom State Prison in 1968 and continues to be run out of the state prison system,
