Arizona firm fined $600K and company director awaiting sentencing for (hiring illegal aliens)

PHOENIX (Reuters) - The United States' largest year-round grower of greenhouse tomatoes has pleaded guilty to knowingly hiring undocumented workers in Arizona and been fined $600,000, authorities said on Friday.

Eurofresh Inc, which grows hydroponic tomatoes at facilities in Willcox and Snowflake, Arizona, will also be required to remain on probation for five years, the U.S. Attorney's Office for the District of Arizona said.

The plea followed an investigation carried out in tandem with the U.S. Department of Homeland Security and the U.S. Immigration and Customs Enforcement agency, which are cracking down on employers who hire illegal immigrants.

"This judgment is a message to other employers who engage in illegal practices that there is a real cost to their actions," U.S. Attorney Dennis K. Burke said in a statement.

"We will continue to work with our partners at the Department of Homeland Security to ensure our nation's laws are followed," he added.

Eurofresh Farms says it is the leading year-round producer and marketer of greenhouse tomatoes in the United States, with more than 1,100 employees in southern Arizona, where the firm's two greenhouse facilities cover 318 acres.

The plea stated that from August 2000 through December 2006, Eurofresh hired and continued to employ at least 17 supervisory level employees despite the human resources director's knowledge they were not authorized to work in the United States.

The plea agreement noted that Eurofresh received $600,000 as direct proceeds from hiring the undocumented workers.

In a statement, Eurofresh said that a former human resources director at the company is currently awaiting sentencing by the U.S. District Court for allegedly allowing illegal immigrants to work at the facilities for short periods of time.

It said that upon discovering the wrongful hiring practices, the firm terminated the director and "self-reported the infraction to the U.S. Department of Justice."

"Eurofresh does not tolerate illegal activities and regrets that a former employee engaged in illegal conduct more than five years ago," Johan van den Berg, chief executive officer of Eurofresh Farms said in a statement.

"When Eurofresh discovered the activities, the company voluntarily reported the infraction to authorities, terminated the employee, and acted swiftly to implement new procedures that ensure full compliance with immigration laws."

OBAMA'S FLAUNTING OF RULE OF LAW

No doubt most have been exposed, during the non-stop coverage of Hurricane Irene as it traversed up the east coast, to Obama's furrowed brow and look of worry; to him being portrayed, both by his own words and the mainstream media cameras and reporters hanging on his every word, as someone oh so concerned for the American people as Hurricane Irene moved north.
As Judy McLeod of Canada Free Press put it, he's apparently been taking acting lessons from Tom Hanks. Most particularly like the photo-op showing Obama, complete with name plate (like we wouldn't know who he was otherwise) with the portrayal of Hurricane Irene lurking over his left shoulder, at the FEMA command and control center.
Why would McLeod say that; why would I concur?
Because actions speak louder than words.
And the actions of the man who has usurped the Oval Office, occupies the White House, are not those of a man who seeks freedom for the people of America; rather, they are those of a man who seeks control over the people of America.
Face it, Obama is a Marxist. His actions have been, and are those, of a Marxist – from deceit and deception to the John Morton Memo on prosecutorial discretion in the deporting of illegal aliens who become criminals when they enter the United States without permission to do so.
As a footnote to my last article, Cecelia Muñoz, who authored the prosecutorial discretion blog entry on the Whitehouse website, is a known La Raza (means "the race") operative working for Obama, being paid by the American taxpayers to promote the illegal alien cause within our nation as the White House Director of Intergovernmental Affairs.
Now a video has come to light, from a townhall meeting held by Senator John Kyl of Arizona, in 2009, in which Kyl explains to a constituent what Obama told him when Kyl met with Obama regarding securing the border.
And what Obama told Kyl is that there would be no securing of the border until Congress agreed to immigration reform inclusive of amnesty for the approximate 45,000,000 illegal aliens in this country.
What is the bottom-line outcome of Obama's words to Kyl?
Let us look at the reality of illegal aliens in the United States.

Are the majority of these people here to become American citizens? As so adequately proven by the "Reconquista" agenda of La Raza, they are not; they are here to destroy this nation by any means possible, to include:

6. Selling drugs on our streets.

9. Utilizing our education system, paid for by American taxpayers.

10. Utilizing our social systems; depleting them to the point that Americans in need have nowhere to turn.

11. Murdering our citizens; driving while intoxicated and killing Americans; committing arson; committing rape, sodomy and incest; kidnapping Americans for ransom; committing theft, burglary and other crimes against Americans.

12. Turning the American side of the border with Mexico into the largest garbage dump in the world; stringing their trash (inclusive of used condoms, used female menstrual products, and feces) all along the border.

13. Threatening American landowners along the border; cutting their fences; burglarizing their homes; killing their cattle.

Does Obama care that these crimes are being committed against the American people? Obviously, he does not because he has refused to secure the Mexican border with the United States.
Such is a direct violation of established law; it is also a violation of the charge of the United States government, under the United States Constitution to protect each of them [the states] against invasion. What else would you call 45,000,000 illegal aliens?
Also playing into Obama's refusal to secure the border, is the ability of branches of United States law enforcement and justice (including ATF, FBI, DEA and DOJ), to sell guns to the Mexican drug cartels and move those guns across the Mexican border in the hopes that such would give Obama the justification to claim that stricter laws are needed regarding the right of Americans to keep and bear arms.

It is of interest that John Morton, currently heading ICE, author of the Morton Memo on instruction from Obama, is very much entangled in the Gun Walker scandal.
So, while Obama stands before the cameras, with a look of worry on his face, is it for real or just more acting – trying to make the American people believe, in his run for a second term in the office he has usurped, that he really cares about Americans?
And the American people need to ask themselves why the Republicans have done nothing. A short time ago, I received an e-mail from my representative in Congress, telling me what all she had been doing on her August recess from her duties in Washington, DC. Quite an impressive list until one stopped to consider that, for all her travelling about the district, meeting with this and that group, nothing she had done would make one iota of difference until the man usurping the Oval Office, occupying the White House, is arrested and prosecuted for taking the oath of office on January 20, 2009 when he was not eligible to do so.
An e-mail, recently, directed me to the World Net Daily website, to an opinion piece by Tom Tancredo, States must fight Obama amnesty decree. In the responses to that opinion piece was one by a Pamela Woodard, and from which I quote,
As for the birth certificate issue, if your mother is a citizen, so are you even if you were born on Mars. I didn't hear all of this screeching when Arnold became Governor of California and the man still has an Austrian accent!! Get a grip. The birth certificate is a non-issue, relevant only to idiots who can't be bothered to learn civics.
Yes, Pamela, Americans definitely need to learn civics, and so do you.
Article II, Clause 5, United States Constitution, states that the president of the United States shall be a natural born citizen. If Obama was actually born in Hawaii, and the forged Certification of Live Birth (here, here, and here) and Certificate of Live Birth tend to refute that; while his father's immigration records tend to confirm it; the most Obama can be is a native-born American or naturalized American. If one parent is an American and you are born on American soil, you can be a native-born American. If you become an American citizen, as Arnold Schwarzenegger did, you are a naturalized American.
Both a native-born American and a naturalized American can be elected to any office in America, including the Governor of California; they cannot, however, be elected to the highest office in the land – the office of president of the United States.
When the Founding Fathers wrote Article II, Clause 5, United States Constitution, they used the definition of natural born citizen provided by Vattel's Law of Nations. That definition requires two American parents and born on American soil. Two out of three does not cut it. The only people exempted from this clause were those …

The Law of Nations is even referenced in the United States Constitution, Article I, Section 8, defining the Powers of Congress:

Obama's father, by Obama's own admission, was a British subject at the time of his birth. It is obvious that Obama was not eligible to the office of president when he announced his candidacy for president back in 2007/08. He is not made eligible by popular vote, the electoral college, the vote of Congress certifying the electoral college, or his inauguration on January 20, 2009.
To this day, Obama is not the legal president of the United States of America.
As he was not eligible, and will always and forever be ineligible to the office of president, he cannot be impeached; he must be removed by the Congress as is their sworn duty under Article I, Section 8, United States Constitution.
No law carrying the signature of Barack Obama, including those appropriating money, is lawful.

Those who have challenged Obama's eligibility are not fruitcakes, birthers, or any of the rest of the names thrown out by those who would subvert our Constitution. Those who have rightfully challenged Obama's right to sit in the Oval Office, occupy the White House, are right on target concerning the constitutional crisis that has been created in this country by the refusal of Congress to remove Obama. In the crimes that have been committed, both by the act itself and what has occurred as a result of it, every member of Congress who has refused to act is complicit.

President Barack Obama’s administration is quietly offering a quasi-amnesty for hundreds of thousands of illegal immigrants aiming to win reelection by mobilizing a wave of new Hispanic voters without alienating the populous at large, say supporters of stronger immigration law enforcement.

“We think it is an excellent step,” said Laura Vasquez, at the Hispanic-advocacy group, La Raza, which pushed for the policies, and which is working with other groups to register Hispanics to vote in 2012. “What’s very important is how the prosecutorial discretion memo is implemented” on the streets, she said.

In a Spanish-language public service announcement, Labor Secretary Hilda Solis assures that “every worker in America has a right to be paid fairly, whether documented or not.” Illegal aliens who are not getting fair wages are encouraged to call a new hotline set up by the agency on a new “Podemos Ayudar” (We Can Help) web page designed to administer worker protection laws and ensure that employees are properly paid “regardless of immigration status.”
In the short video, also posted in English, Solis tells illegal immigrants that it’s a “serious problem” when workers in this country are not paid fairly and that all workers have the right to receive their salary regardless of immigration status. She encourages those who are not to call the new hotline and assures it’s free and confidential. “Podemos ayudar,” (we can help), Solis guarantees at the end of the brief segment.
The Labor Secretary’s new message is part of a campaign launched a few months ago to help illegal immigrant workers in the U.S., who she refers to as “vulnerable” and “underpaid.” At least 1,000 new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees and the agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.
For a government agency to protect law breakers in this fashion may seem unbelievable but not if you consider the source. A Former California congresswoman, Solis has close ties to the influential La Raza movement that advocates open borders and rights for illegal immigrants. She made the protection of undocumented workers a major priority upon being named Labor Secretary, assuring illegal aliens that “if you work in this country, you are protected by our laws.”

Casting a shadow on economic recovery efforts in the United States is the cost of illegal immigration that consumes U.S. taxpayer dollars for education, healthcare, social welfare benefits, and criminal justice. Illegal aliens (or more politically correct, "undocumented immigrants") with ties to Mexican drug cartels are contributing to death and destruction on U.S. lands along the southern border.

While the declining job market in the United States may be discouraging some would-be border crossers, a flow of illegal aliens continues unabated, with many entering the United States as drug-smuggling "mules."

Increasingly vicious foot soldiers of the Mexican drug cartels are taking control of U.S. lands along the border, especially since U.S. Border Patrol units have been reassigned, some to offices 60 to 80 miles inland.

The U.S. Department of the Interior, Bureau of Land Management (BLM) early last year posted signs warning citizens to avoid Interstate 8 between Casa Grande and Gila Bend, Ariz., because of criminal activity in the area, an area that includes protected natural areas precious to the nation.

In reaction to public outrage over the signs, the BLM removed the offensive wording in October 2010, replacing it with the following: Visitor Information Update--Active Federal Law Enforcement Patrol Area.

As the liberal news media, far-left Democrats, and labor unions push for the "Hispanicazation" of U.S. culture, U.S. Department of Homeland Security Secretary Janet Napolitano says the U.S. border has never been more secure.

Perhaps she is basing this on the reduced number of apprehensions, which result, of course, from reassigning Border Patrol agents inland.

In a recent New York Times article, Nicholas Kristof criticized U.S. citizens for not speaking a foreign language and suggested that "Every child in the United States should learn Spanish." He concluded that as the United States increasingly integrates economically with Latin America, Spanish will be crucial for the United States.

For decades, the liberal left has argued that Latin America is essential for U.S. business and trade. Kristof states that Latin America "is finally getting its act together" but fails to mention the Obama administration's $2 billion loan of U.S. taxpayer money in 2009 to Brazil's Petrobras oil company for deep off-shore oil drilling. Obama confidant George Soros, through the Soros Fund Management LLC, until recently owned millions of dollars of Petrobras stock.

Kristof suggests that one day Spanish-speaking Americans will be part of daily life in the United States and that workmen such as mechanics will be able to communicate easily with Spanish-speaking customers.

He fails to explain why these customers will not be speaking English. After all, the ability to speak, read, and write English remains a requirement for U.S. citizenship.

President Barack Obama gives lip service to increasing border control resources with limited funding and personnel. Many officials, including the governors of Texas and Arizona, are skeptical regarding the Obama administration's resolve. They resent that the United States is being blamed for the killing fields on both sides of the Mexico-U.S. Border.

For instance, U.S. Secretary of State Hillary Clinton in March 2009, during her first official visit to Mexico, placed the blame for the Mexican drug cartels' vicious murders on the United States.

In Mexico City, she announced that the U.S. appetite for illegal drugs and the easy acquisition of guns from the United States by Mexicans are the root causes of the Mexican crime wave. "Blame America" has become the global agenda of the Democratic Party.

The Obama administration's plan to resolve the immigration chaos is to offer amnesty to all comers. President Obama re-affirms his support of a "pathway to citizenship" (amnesty) for illegal aliens in 2011.

The administration, however, has announced no plans to control the influx of future waves of illegal aliens or their skyrocketing costs to the nation. The administration, which condones U.S. sanctuary cities and states, has no plans to file charges against them for violations of federal immigration law. Nor does the administration seem concerned about the environmental impact that illegal aliens have on the ecology of the United States.

Many national forests, parks, monuments, wilderness areas, and wildlife refuges -- once the pride of the nation -- are serving today as marijuana fields for illegal alien gangs.

Former Democratic Speaker of the House Nancy Pelosi reportedly said to a gathering of illegal aliens in California in 2009 that U.S. immigration laws were "un-American," suggesting that they need not be obeyed. Concerned citizens can only trust that the new speaker of the House, John Boehner, as part of congressional oversight of federal agencies, will demand enforcement of existing immigration laws.

When will President Obama recognize that illegal immigration is slowing economic recovery? Can he resolve the chaos while still appeasing his Hispanic base?

To maintain his populist aura, the president is in the habit of saying one thing to one audience and the opposite to another.

One Obama apologist explained, "Campaign rhetoric is one thing," suggesting that governing is another. The deliberate Hispanicazation of the United States to secure a block of votes is quite another.

In this final entry of this series on Anchor Babies in America, we shall investigate the unbelievable but verifiable costs to American citizens. Additionally, we will explore ancillary problems created by illegal alien children within our classrooms across the country.

Do we blame the children? No! Do we blame their parents? Yes! (They know they are illegal aliens!)

Who do we blame? Simple! Our U.S. Congress and U.S. presidents from Bush 41, Clinton, Bush 43 and today, Obama! They must take responsibility for this fiscal/educational and linguistic fiasco. They failed to enforce our laws in the past 20 years, and Obama fails to enforce our immigration and labor laws in 2009. Thus, they allowed countless tens of thousands of employers within the United States to subvert our laws as to employment of unlawful immigrants. Our Congress allowed a new 21st century slave class to establish itself in excess of 20 million unlawful aliens-inside this country. The rich benefit and the rest of us subsidize and suffer from it.

While those 20 million enjoy employment, housing, welfare, food and medical care on U.S. taxpayer dollars, 15 million Americans cannot find a job. An astounding 32.2 million Americans subsist on food stamps. Our working poor and minorities languish in the streets and 13 million American children live below the poverty level.

EDUCATIONAL CHAOS:
Those 400,000 anchor babies cost taxpayers big time! At $6,000.00 per delivery in our hospitals where those pregnant alien mothers take themselves to birth their children X's 400,000 annually: $2.4 billion annually. Year after year after year! If the child suffers from autism, Down's Syndrome, myocardial septal defect (hole in heart), deformity, premature birth in ICU or other problems-the costs may hit $1 million and more.

Remember also, that the mother becomes a ward of the welfare rolls in assisted housing, food stamps, medical care, welfare payments-all on the taxpayer's dollar. Instead of 400,000 dependents, the actual number doubles to 900,000. Additionally, as that mother births more children, the costs rise dramatically.

Once the child reaches age five, it begins a 13 year educational journey that costs taxpayers on average $9,644.00 annually depending on school districts within the United States. When you add in 'free' breakfasts and lunches for those disadvantaged children, the costs rise into the billions of dollars. Finally, English as a Second Language costs taxpayers according to economist Edwin Rubenstein:

"The total additional per pupil costs for language assistance instruction was estimated to be in the range of $200 to $700 in 1981 dollars-equivalent to $460 to $1,600 in 2007 dollars. Using the average of the latter two amounts-$1,030-as our estimate of per pupil cost, the total cost of providing English Language Learning instruction to the 3.8 million students enrolled in those programs would equal about $3.9 billion. Other cities like L.A., Chicago and Houston hovered around 50 to 60 percent dropout rates.

Brian Williams reported that 1.2 million 'American' teens hit the streets annually "functionally illiterate."

Dan Stein at http://www.fairus.org published a report titled: "Breaking the Piggy Bank: How Illegal Immigration is Sending Schools into the Red". Estimated costs of educating illegal migrant children and anchor babies: $7.5 billion annually.

The report said, in California, the $2.2 billion spent educating illegal alien immigrants for one year could:
• Pay the salaries for 41,764 teachers.
• CA schools are threatened with a $1.5 billion cut next year. Eliminating illegals would pay for all needs.
• Pay for CA's class sizes to remain capped at 20 students for a year, with $300 million to spare.
• Buy books and computers to equip 346,689 classrooms or 79 percent of classrooms in California.
• Fully fund the state's free lunch program for poor American students for two years.

Instead, California dropped from the top five top school systems in the United States to the bottom five states. Teaches struggle teaching with 113 different languages in their classrooms. As a teacher, I can tell you that more than one language in a classroom causes educational tension, ethnic tension from lack of ability to communicate and racial separation.

Students become angry, stubborn, and overwhelmed as they 'drop out' from sheer frustration and inability to perform academically. Violence ensues or complete withdrawal! Thousands join gangs for their identity.

Finally, what about U.S. children? What about the quality of their educations? What about their well-being? What about our own poverty-stricken students and special needs across the country?

Today, one-third of all students graduating from high schools heavily impacted by mass immigration must take remedial courses in universities to bring their minds up to speed for college work. In thousands of schools, gangs, foreign languages, and strange customs usurp the educational experience for U.S. students.

At some point, and soon, we must stop 'birthright citizenship' as all other countries, including Ireland and New Zealand, have done.

This year, House member Nathan Deal introduced HR 1868: reintroduced his Birthright Citizenship bill that would eliminate automatic citizenship for children born in the United States to illegal aliens. The Birthright Citizenship Act of 2009 (H.R.1868) would amend the Immigration and Nationality Act to make it more difficult for children born in the U.S. to gain citizenship.

A U.S. citizen or national;

I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK) I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears. Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

Heritage.org | May 16, 2006This paper focuses on the net fiscal effects of immigration with particular emphasis on the fiscal effects of low skill immigration. The fiscal effects of immigration are only one aspect of the impact of immigration. Immigration also has social, political, and economic effects. In particular, the economic effects of immigration have been heavily researched with differing results. These economic effects lie beyond the scope of this paper.

Overall, immigration is a net fiscal positive to the government’s budget in the long run: the taxes immigrants pay exceed the costs of the services they receive. However, the fiscal impact of immigrants varies strongly according to immigrants’ education level. College-educated immigrants are likely to be strong contributors to the government’s finances, with their taxes exceeding the government’s costs. By contrast, immigrants with low education levels are likely to be a fiscal drain on other taxpayers. This is important because half of all adult illegal immigrants in the U.S. have less than a high school education. In addition, recent immigrants have high levels of out-of-wedlock childbearing, which increases welfare costs and poverty.

An immigration plan proposed by Senators Mel Martinez (R-FL) and Chuck Hagel (R-NE) would provide amnesty to 9 to 10 million illegal immigrants and put them on a path to citizenship. Once these individuals become citizens, the net additional cost to the federal government of benefits for these individuals will be around $16 billion per year. Further, once an illegal immigrant becomes a citizen, he has the right to bring his parents to live in the U.S. The parents, in turn, may become citizens. The long-term cost of government benefits to the parents of 10 million recipients of amnesty could be $30 billion per year or more. In the long run, the Hagel/Martinez bill, if enacted, would be the largest expansion of the welfare state in 35 years.

Current Trends in Immigration

Over the last 40 years, immigration into the United States has surged. Our nation is now experiencing a second “great migration” similar to the great waves of immigrants that transformed America in the late 19th and early 20th centuries. In 2004, an estimated 35.7 million foreign-born persons lived in the U.S. While in 1970 one person in twenty was foreign born, by 2004 the number had risen to one in eight.

About one-third of all foreign-born persons in the U.S. are illegal aliens. There are between 10 and 12 million illegal aliens currently living in the U.S.[1] Illegal aliens now comprise 3 to 4 percent of the total U.S. population. Each year approximately 1.3 million new immigrants enter the U.S.[2] Some 700,000 of these entrants are illegal.[3]

One third of all foreign-born persons in the U.S. are Mexican. Overall, the number of Mexicans in the U.S. has increased from 760,000 in 1970 to 10.6 million in 2004. Nine percent of all Mexicans now reside in the U.S.[4] Over half of all Mexicans in the U.S. are illegal immigrants,[5] and in the last decade 80 to 85 percent of the inflow of Mexicans into the U.S. has been illegal.[6]
The public generally perceives illegals to be unattached single men. This is, in fact, not the case.

Some 44 percent of adult illegals are women. While illegal men work slightly more than native-born men; illegal women work less. Among female illegals, some 56 percent work, compared to 73 percent among native-born women of comparable age.[7] As well, Mexican women emigrating to the U.S. have a considerably higher fertility rate than women remaining in Mexico.[8]

Immigrants and EducationOn average, immigrants have low education levels relative to native-born U.S. citizens. One-quarter of legal adult immigrants lack a high school degree, compared to 9 percent among the native-born population. However, there is a well educated sub-group within the legal immigrant population. Some 32 percent of legal immigrant adults have a college degree, compared to 30 percent of native-born adults.[9]

The education levels of illegal aliens are lower than those of legal immigrants. Half of all adult illegal immigrants lack a high school degree.[10] Among Latin American and Mexican immigrants, 60 percent lack a high school degree and only 7 percent have a college degree. By contrast, among native-born workers in the U.S., only 6 percent have failed to complete high school degrees and nearly a third have a college degree.[11]

Decline in Immigrant Wages ...IT'S ALL ABOUT KEEPING WAGES DEPRESSED!

Over the last 40 years the education level of new immigrants has fallen relative to the native population. As the relative education levels of immigrants have declined, so has their earning capacity compared to the general U.S. population. Immigrants arriving in the U.S. around 1960 had wages, at the time of entry, that were just 13 percent less than natives’. In 1965, the nation’s immigration law was dramatically changed, and from 1990 on, illegal immigration surged. The result was a decline in the relative skill levels of new immigrants. By 1998, new immigrants had an average entry wage that was 34 percent less than natives.’[12] Because of their lower education levels, illegal immigrants’ wages would have been even lower.

The low-wage status of recent illegal immigrants can be illustrated by the wages of recent immigrants from Mexico, a majority of whom have entered the U.S. illegally. In 2000, the median weekly wage of a first-generation Mexican immigrant was $323. This was 54 percent of the corresponding wage for non-Hispanic whites in the general population.[13]

Historically, the relative wages of recent immigrants have risen after entry as immigrants gained experience in the labor market. For example, immigrants who arrived in the U.S. in the 1960s and 1970s saw their relative wages rise by 10 percentage points compared to natives’ wages during their first 20 years in the country. But in recent years, this modest catch up effect has diminished.

Welfare may be defined as means-tested aid programs: these programs provide cash, non-cash, and social service assistance that is limited to low-income households. The major means-tested programs include Food Stamps, Temporary Assistance to Needy Families, public housing, the earned income credit, and Medicaid. Historically, recent immigrants were less likely to receive welfare than native-born Americans. But over the last thirty years, this historic pattern has reversed. As the relative education levels of immigrants fell, their tendency to receive welfare benefits increased. By the late 1990s immigrant households were fifty percent more likely to receive means-tested aid than native-born households.[15] Moreover, immigrants appear to assimilate into welfare use. The longer immigrants live in the U.S., the more likely they are to use welfare.[16]

A large part, but not all, of immigrants’ higher welfare use is explained by their low education levels. Welfare use also varies by immigrants’ national origin. For example, in the late 1990s, 5.6 percent of immigrants from India received means-tested benefits; among Mexican immigrants the figure was 34.1 percent; and for immigrants from the Dominican Republic the figure was 54.9 percent.[17] Ethnic differences in the propensity to receive welfare that appear among first-generation immigrants persist strongly in the second generation.[18] The relatively high use of welfare among Mexicans has significant implications for current proposals to grant amnesty to illegal immigrants.

Some 80 percent of illegal immigrants come from Mexico and Latin America.[19] (See Chart 1) Historically, Hispanics in America have had very high levels of welfare use. Chart 2 shows receipt of aid from major welfare programs by different ethnic groups in 1999; the programs covered are Medicaid, Food Stamps, public housing, Temporary Assistance to Needy Families, General Assistance, and Supplemental Security Income.[20] As the chart shows, Hispanics were almost three times more likely to receive welfare than non-Hispanic whites. In addition, among families that received aid, the cost of the aid received was 40 percent higher for Hispanics than for non-Hispanic whites.[21] Putting together the greater probability of receiving welfare with the greater cost of welfare per family means that, on average, Hispanic families received four times more welfare per family than white non-Hispanics.

Part, but not all, of this high level of welfare use by Hispanics can be explained by background factors such as family structure.[22] It seems likely that, if Hispanic illegal immigrants are given permanent residence and citizenship, they and their children will likely assimilate into the culture of high welfare use that characterizes Hispanics in the U.S. This would impose significant costs on taxpayers and society as a whole.

Welfare use can also be measured by immigration status. In general, immigrant households are about fifty percent more likely to use welfare than native-born households.[23] Immigrants with less education are more likely to use welfare. (See Chart 3)

The potential welfare costs of low-skill immigration and amnesty for current illegal immigrants can be assessed by looking at the welfare utilization rates for current low-skill immigrants. As Chart 4 shows, immigrants without a high school degree (both lawful and unlawful) are two-and-a-half times more likely to use welfare than native-born individuals.[24] This underscores the high potential welfare costs of giving amnesty to illegal immigrants.

1. All categories of high school dropouts have a high utilization of welfare. Immigrants who have less than a high school degree are slightly more likely to use welfare than native-born dropouts. Legal immigrants who are high school dropouts are slightly more likely to use welfare than native-born dropouts.[25] Illegal immigrant dropouts, however, are less likely to use welfare than native-born dropouts mainly because they are ineligible for many welfare programs. With amnesty, current illegal immigrants’ welfare use would likely rise to the level of lawful immigrants with similar education levels.

Illegal Immigration and Poverty

1. According to the Pew Hispanic Center, 4.7 million children of illegal immigrant parents currently live in the U.S.[26] Some 37 percent of these children are poor.[27] While children of illegal immigrant parents comprise around 6 percent of all children in the U.S., they are 11.8 percent of all poor children.[28]

This high level of child poverty among illegal immigrants in the U.S. is, in part, due to low education levels and low wages. It is also linked to the decline in marriage among Hispanics in the U.S. Within this group, 45 percent of children are born out-of-wedlock.[29] (See Table 1.) Among foreign-born Hispanics the rate is 42.3 percent.[30] By contrast, the out-of-wedlock birth rate for non-Hispanic whites is 23.4 percent.[31] The birth rate for Hispanic teens is higher than for black teens.[32] While the out-of-wedlock birth rate for blacks has remained flat for the last decade, it has risen steadily for Hispanics.[33] These figures are important because, as noted, some 80 percent of illegal aliens come from Mexico and Latin America.[34]

In general, children born and raised outside of marriage are seven times more likely to live in poverty than children born and raised by married couples. Children born out-of-wedlock are also more likely to be on welfare, to have lower educational achievement, to have emotional problems, to abuse drugs and alcohol, and to become involved in crime.[35]

5. Poverty is also more common among adult illegal immigrants, who are twice as likely to be poor as are native-born adults. Some 27 percent of all adult illegal immigrants are poor, compared to 13 percent of native-born adults.[36]
Economic and Social Assimilation of Illegal Immigrant OffspringOne important question is the future economic status of the children and grandchildren of current illegal immigrants, assuming those offspring remain in the U.S. While we obviously do not have data on future economic status, we may obtain a strong indication of future outcomes by examining the educational attainment of offspring of recent Mexican immigrants. Some 57 percent of current illegal immigrants come from Mexico, and about half of Mexicans currently in the U.S. are here illegally.[37]

First-generation Mexican immigrants are individuals born in Mexico who have entered the U.S. In 2000, some 70 percent of first-generation Mexican immigrants (both legal and illegal) lacked a high school degree. Second-generation Mexicans may be defined as individuals born in the U.S. who have at least one parent born in Mexico. Second-generation Mexican immigrants (individuals born in the U.S. who have at least one parent born in Mexico) have greatly improved educational outcomes but still fall well short of the general U.S. population. Some 25 percent of second-generation Mexicans in the U.S. fail to complete high school. By contrast, the high school drop out rate is 8.6 percent among non-Hispanic whites and 17.2 percent among blacks. Critically, the educational attainment of third-generation Mexicans (those of Mexican ancestry with both parents born in the U.S.) improves little relative to the second generation. Some 21 percent of third-generation Mexicans are high school drop outs.[38] Similarly, the rate of college attendance among second-generation Mexicans is lower than for black Americans and about two-thirds of the level for non-Hispanic whites; moreover, college attendance does not improve in the third generation.[39]

These data indicate that the offspring of illegal Hispanic immigrants are likely to have lower rates of educational attainment and higher rates of school failure compared to the non-Hispanic U.S. population. High rates of school failure coupled with high rates of out-of-wedlock childbearing are strong predictors of future poverty and welfare dependence.

Immigration and Crime

Historically, immigrant populations have had lower crime rates than native-born populations. For example, in 1991, the overall crime and incarceration rate for non-citizens was slightly lower than for citizens.[40]

On the other hand, the crime rate among Hispanics in the U.S. is high. Age-specific incarceration rates (prisoners per 100,000 residents in the same age group in the general population) among Hispanics in federal and state prisons are two to two-and-a-half times higher than among non-Hispanic whites.[41] Relatively little of this difference appears to be due to immigration violations.[42]

Illegal immigrants are overwhelmingly Hispanic. It is possible that, over time, Hispanic immigrants and their children may assimilate the higher crime rates that characterize the low-income Hispanic population in the U.S. as a whole.[43] If this were to occur, then policies that would give illegal immigrants permanent residence through amnesty, as well as policies which would permit a continuing influx of hundreds of thousands of illegal immigrants each year, would increase crime in the long term.

The Fiscal Impact of Immigration

One important question is the fiscal impact of immigration (both legal and illegal). Policymakers must ensure that the interaction of welfare and immigration policy does not expand the welfare-dependent popula_tion, which would hinder rather than help immi_grants and impose large costs on American society. This means that immigrants should be net contributors to government: the taxes they pay should exceed the cost of the benefits they receive.

In calculating the fiscal impact of an individual or family, it is necessary to distinguish between public goods and private goods. Public goods do not require additional spending to accommodate new residents.[44] The clearest examples of government public goods are national defense and medical and scientific research. The entry of millions of immigrants will not raise costs or diminish the value of these public goods to the general population.

Other government services are private goods; use of these by one person precludes or limits use by another. Government private goods include direct personal benefits such as welfare, Social Security benefits, Medicare, and education. Other government private goods are “congestible” goods.[45] These are services that must be expanded in proportion to the population. Government congestible goods include police and fire protection, roads and sewers, parks, libraries, and courts. If these services do not expand as the population expands, there will be a decrease in the quality of service.
An individual makes a positive fiscal contribution when his total taxes paid exceed the direct benefits and congestible goods received by himself and his family.[46]

The Fiscal Impact of Low Skill Immigration

The 1997 New Americans study by the National Academy of Sciences (NAS) examined the fiscal impact of immigration.[47] It found that, within in a single year, the fiscal impact of foreign-born households was negative in the two states studied, New Jersey and California.[48] Measured over the course of a lifetime, the fiscal impact of first-generation immigrants nationwide was also slightly negative.[49] However, when the future earnings and taxes paid by the offspring of the immigrant were counted, the long-term fiscal impact was positive. One commonly cited figure from the report is that the net present value (NPV) of the fiscal impact of the average recent immigrant and his descendents is $83,000.[50]

There are five important caveats about the NAS longitudinal study and its conclusion that in the long term the fiscal impact of immigration is positive. First, the study applies to all recent immigration, not just illegal immigration. Second, the finding that the long-term fiscal impact of immigration is positive applies to the population of immigrants as a whole, not to low-skill immigrants alone. Third, the $83,000 figure is based on the predicted earnings, tax payments, and benefits of an immigrant’s descendents over the next 300 years.[51] Fourth, the study does not take into account the growth in out-of-wedlock childbearing among the foreign-born population, which will increase future welfare costs and limit the upward mobility of future generations. Fifth, the assumed educational attainment of the children, grandchildren, and great grandchildren of immigrants who are high school dropouts or high school graduates seems unreasonably high given the actual attainment of the offspring of recent Mexican and Hispanic immigrants.[52]

The NAS study’s 300-year time horizon is highly problematic. Three hundred years ago, the United States did not even exist and British colonists had barely reached the Appalachian Mountains. We cannot reasonably estimate what taxes and benefits will be even 30 years from now, let alone 300.
The NAS study assumes that most people’s descendents will eventually regress to the social and economic mean, and thus may make a positive fiscal contribution, if the time horizon is long enough. With similar methods, it seems likely that out-of-wedlock childbearing could be found to have a net positive fiscal value as long as assumed future earnings are projected out 500 or 600 years.

Slight variations to NAS’s assumptions used by NAS greatly affect the projected outcomes. For example, limiting the time horizon to 50 years and raising the assumed interest rate from 3 percent to 4 percent drops the NPV of the average immigrant from around $80,000 to $8,000.[53] Critically, the NAS projections assumed very large tax increases and benefits cuts would begin in 2016 to prevent the federal deficit from rising further relative to GDP. This assumption makes it far easier for future generations to be scored as fiscal contributors. If these large tax hikes and benefit cuts do not occur, then the long-term positive fiscal value of immigration evaporates.[54] Moreover, if future tax hikes and benefit cuts do occur, the exact nature of those changes would likely have a large impact on the findings; this issue is not explored in the NAS study.

Critically, the estimated net fiscal impact of the whole immigrant population has little bearing on the fiscal impact of illegal immigrants, who are primarily low-skilled. As noted, at least 50 percent of illegal immigrants do not have a high school degree. As the NAS report states, “[S]ome groups of immigrants bring net fiscal benefits to natives and others impose net fiscal costs [I]mmigrants with certain characteristics, such as the elderly and those with little education, may be quite costly.”[55]
The NAS report shows that the long-term fiscal impact of immigrants varies dramatically according to the education level of the immigrant. The fiscal impact of immigrants with some college education is positive. The fiscal impact of immigrants with a high school degree varies according to the time horizon used. The fiscal impact of immigrants without a high school degree is negative: benefits received will exceed taxes paid. The net present value of the future fiscal impact of immigrants without a high school degree is negative even when the assumed earnings and taxes of descendents over the next 300 years are included in the calculation.[56]

A final point is that the NAS study’s estimates assume that low skill immigration does not reduce the wages of native-born low-skill workers. If low-skill immigration does, in fact, reduce the wages of native-born labor, this would reduce taxes paid and increase welfare expenditures for that group. The fiscal, social, and political implications could be quite large.

The Cost of Amnesty

Federal and state governments currently spend over $500 billion per year on means-tested welfare benefits.[57] Illegal aliens are ineligible for most federal welfare benefits but can receive some assistance through programs such as Medicaid, In addition, native-born children of illegal immigrant parents are citizens and are eligible for all relevant federal welfare benefits.

Granting amnesty to illegal aliens would have two opposing fiscal effects. On the one hand, it may raise wages and taxes paid by broadening the labor market individuals compete in; it would also increase tax compliance and tax receipts as more work would be performed “on the books,”[58] On the other hand, amnesty would greatly increase the receipt of welfare, government benefits, and social services. Because illegal immigrant households tend to be low-skill and low-wage, the cost to government could be considerable.

The Center for Immigration Studies (CIS) has performed a thorough study of the federal fiscal impacts of amnesty.[59] This study found that illegal immigrant households have low education levels and low wages and currently pay little in taxes. Illegal immigrant households also receive lower levels of federal government benefits. Nonetheless, the study also found that, on average, illegal immigrant families received more in federal benefits than they paid in taxes.[60]

Granting amnesty would render illegal immigrants eligible for federal benefit programs. The CIS study estimated the additional taxes that would be paid and the additional government costs that would occur as a result of amnesty. It assumed that welfare utilization and tax payment among current illegal immigrants would rise to equal the levels among legally-admitted immigrants of similar national, educational, and demographic backgrounds. If all illegal immigrants were granted amnesty, federal tax payments would increase by some $3,000 per household, but federal benefits and social services would increase by $8,000 per household. Total federal welfare benefits would reach around $9,500 per household, or $35 billion per year total. The study estimates that the net cost to the federal government of granting amnesty to some 3.8 million illegal alien households would be around $5,000 per household, for a total federal fiscal cost of $19 billion per year.[61]
Amnesty and the Hagel/Martinez Bill

Senators Mel Martinez (R-FL) and Chuck Hagel (R-NE) have proposed a compromise immigration plan to offer amnesty and citizenship to current illegal aliens (S.2611). This plan would offer amnesty and citizenship to between 60 and 85 percent of the nation’s current 11.9 million illegal immigrants.
Under the plan, illegal immigrants who have been in the U.S. five years or more (60 percent of the total) would be granted immediate amnesty. Illegal immigrants who have been in the country between two and five years (25 percent of the total) would travel to one of 16 “ports of entry” where they would receive work permits that would bestow permanent residence and allow the bearers to become citizens. Overall, the plan is likely to grant citizenship to 85 percent of the current illegal alien population, or some 9 to 10 million individuals.

As noted, illegal aliens in the U.S. have very low education levels: at least half lack a high school education and a third have less than a ninth grade education. Illegal immigrants earn low wages similar to the wages of other low-skill workers in the economy. This means they are prone to poverty and welfare dependence.

Illegal immigrants are currently ineligible for most federal welfare benefits. Granting citizenship would provide eligibility to welfare programs such as the Earned Income Credit, Food Stamps, Medicaid, and Temporary Assistance to Needy Families. This would greatly increase welfare costs. The added government costs can be estimated by assessing government benefits and tax payments among current illegal immigrants compared to government benefits and tax payments among legal immigrants of similar national and educational backgrounds. This comparison shows that granting citizenship to 85 percent of current illegal immigrants would increase net federal fiscal costs by some $16 billion per year. Granting citizenship to 60 percent of current illegal immigrants would increase welfare costs by some $11.4 billion per year.[62]

These costs would not occur immediately. The Hagel/Martinez plan imposes a prospective six-year waiting period prior to granting legal permanent residence to illegal immigrants. Individuals would wait another five years after receiving permanent residence before becoming citizens. Thus, much of the cost of the plan might be delayed; however, once millions of individuals are put on the path to citizenship there would be enormous (and probably irresistible) political pressure to grant them the same benefits that are available to the general population quickly, rather than enforce a long delay.
In addition, the cost estimates presented above are based on a static analysis that assumes that amnesty will not alter behavior. In reality, illegal immigrants are likely to have significantly more children once they are permanently settled in the U.S. These children will increase welfare costs and child poverty further.

Family Chain Migration

The impact and cost of the Hagel/Martinez amendment would extend well beyond the ten million or so individuals initially granted amnesty. When an individual is granted citizenship, he is given the unrestricted right to bring his spouse, minor children, and parents into the country. Each of these individuals would have the right to become a citizen after he or she has lived in the country five years. Thus, each individual granted amnesty under the Hagel/Martinez bill could bring five or more additional immigrants, all of whom could become citizens.

As noted, many of the individuals who would be granted amnesty under the amendment have families abroad. Illegal immigrants granted permanent residence would have the immediate right to bring spouses and minor children into the country. Once here, the spouses and children would receive government services and have the right to become citizens. The total number of foreign-born persons who would ultimately be granted citizenship under Hagel/Martinez could be far more than 10 million, and if so, government costs would swell far above the $16 billion figure given above.

But the fiscal problem gets worse; when an illegal immigrant has obtained citizenship through the amnesty process, he or she would have the right to bring his or her parents in the U.S. as permanent lawful residents. (Currently one-tenth of the annual flow of legal immigrants to the U.S. are parents of recent immigrants who have naturalized.) If ten million current illegal immigrants were granted amnesty and citizenship under Hagel/Martinez, as many as twenty million foreign born parents would be given the right to immigrate to the U.S. Once in the U.S., the immigrant parents would receive social services and government funded medical care, much of it paid for through the Medicaid disproportionate share program.

These immigrant parents coming to the U.S. would also be eligible to apply for citizenship themselves. On attaining citizenship, most would become eligible for benefits from the Supplemental Security Income (SSI) and Medicaid programs, at an average cost of over $18,000 per person per year. While it is true that the language requirements of the citizenship test would serve as a barrier to immigrant parents becoming citizens, the tests are not very difficult and the financial rewards of citizenship would be very great. If only ten percent of the parents of those receiving amnesty under Hagel/Martinez became citizens and enrolled in SSI and Medicaid, the extra costs to government would be over $30 billion per year.

Obviously, these costs would not begin for some time, but the long-term potential of amnesty to raise government spending is quite real.

While no one can predict how many spouses, children, and parents of the beneficiaries of amnesty would enter the country, the pool of those who could enter is enormous, and the potential long-term government costs would be staggering.

Granting Amnesty is Likely to Further Increase Illegal Immigration

The Immigration Reform and Control Act (IRCA) of 1986 granted amnesty to 2.7 million illegal aliens. The primary purpose of the act was to decrease the number of illegal immigrants by limiting their inflow and by legalizing the status of illegal immigrants already here.[63] In fact, the act did nothing to stem the tide of illegal entry. The number of illegal aliens entering the country increased five fold from around 140,000 per year in the 1980s to 700,000 per year today.
Illegal entries increased dramatically shortly after IRCA went into effect. It seems plausible that the prospect of future amnesty and citizenship served as a magnet to draw even more illegal immigrants into the country. After all, if the nation granted amnesty once why wouldn’t it do so again?
The Hagel/Martinez legislation would repeat IRCA on a much larger scale. This time, nine to ten million illegal immigrants would be granted amnesty. As with IRCA, the bill promises to reduce future illegal entry but contains little policy that would actually accomplish this. The granting of amnesty to 10 million illegal immigrants is likely to serve as a magnet pulling even greater numbers of aliens into the country in the future.

If enacted, the legislation would spur further increases in the future flow of low-skill migrants. This in turn would increase poverty in America, enlarge the welfare state, and increase social and political tensions.

Permanent “Guest Worker” Program

Finally, the Hagel/Martinez bill would issue 325,000 new visas per year to “guest workers.” The number of visas available could increase by 20 percent annually, reaching two million per year within ten years. By 2017, the guest worker program would have admitted some eight million new workers. Illegal aliens who have been in the country for less than two years would be eligible to become guest workers and would probably be the primary recipients of these supposedly temporary (H2C) visas. Recipients of these visas could bring spouses and children into the country immediately, increasing the number of entrants over ten years well above eight million. Because nearly all of the guest workers and their families would within a few years become eligible for government welfare and other services, the fiscal costs from the program could rival those stemming from the direct amnesty provisions of the bill.

On the surface, individuals in the guest worker program would be limited to a six-year stay in the U.S. But they would have the option to convert to legal permanent residence (LPR) after four years. This would make them permanent residents with the right to naturalize. In addition, all children born to guest workers would automatically become U.S. citizens. This would make it very unlikely that the parent would ever be forced to leave the country.

As structured, the Hagel/Martinez guest worker program could, within a decade, double the inflow of legal permanent immigrants into the U.S. Many or most of these immigrants would be low-skill and would thus impose fiscal costs on U.S. taxpayers. It is true that while many employers would benefit from additional low-skill laborers; however, if such laborers are granted citizenship and permanent residence, their employment is likely to generate negative externalities that impose costs on the rest of society. A guest worker program that, in fact, provides permanent residence and citizenship would not be beneficial to the nation’s finances.
Policy Implications
Immigration to the U.S. is a privilege, not a right. Immigrants should be net contributors to the government and society and should not be a fiscal burden on the native-born. While highly educated immigrants, on average, make positive fiscal contributions, the overall fiscal impact of low-skill immigrants is negative.
Over the last 20 years, around 10 million individuals without a high school degree have entered the United States. Many of these also have a high probability of out-of-wedlock childbearing, a key predictor of poverty and welfare dependence. Unless U.S. immigration policy is changed, these trends are likely to continue. Granting amnesty to current illegal immigrants exacerbates the problem.
Sound immigration policy should be based on two principles. The first is respect for the rule of law. American citizens should determine who is allowed to enter the country, to become a citizen, and to vote in our elections. Lax border enforcement and the non-enforcement of laws against employing illegal immigrants have encouraged over 10 million individuals to enter the country unlawfully. Past and pending amnesties reward this behavior. Under the current system, decisions about who will live in the U.S. and who will become a citizen tend to be made unilaterally by foreigners. Hagel/Martinez would further undermine the rule of law and put the U.S. on the path of uncontrolled immigration punctuated by recurring amnesties.

Second, recognizing the fact that low-skill immigrants are likely to be a fiscal burden on society, government should increase the average skill and education levels of incoming immigrants. Currently, the average skill level of immigrants is significantly reduced by two factors: largely uncontrolled border crossings and the high priority on kinship ties in the issuance of permanent residence visas. Only 7.6 percent of individuals granted visas for permanent entry into the U.S. are selected on the basis of their educational attainment and skills.[64] To the increase the skill levels of future immigrants, the U.S. should stop the inflow of illegal immigrants, reduce the number of family reunification visas, and increase the number of employment- and skill-based visas.

Five specific policies follow from these principles:

The influx of illegal immigrants should be stopped by rigorous border security programs and strong programs to prevent employers from employing illegals.

Amnesty and citizenship should not be given to current illegal immigrants. Amnesty has negative fiscal consequences and is manifestly unfair to those who have waited for years to enter the country lawfully. Amnesty would also serve as a magnet, drawing even more future illegal immigration.

Any guest worker program should grant temporary, not permanent, residence and should not be a pathway to citizenship. A guest worker program should not disproportionately swell the ranks of low-skill workers.

Children born to parents who are illegal immigrants or to future guest workers should not be given citizenship status. Granting citizenship automatically confers welfare eligibility and makes it unlikely the parent will ever leave the U.S.[65]

The legal immigration system grants lawful permanent residence to some 950,000 persons each year. This system should be altered to substantially increase the proportion of new entrants with high levels of education and skills in demand by U.S. firms. Under current law, foreign-born parents and siblings of naturalized citizens are given preference for entry visas. The current visa allotments for family members (other than spouses and minor children) should be eliminated, and quotas for employment- and skill-based entry increased proportionately.

Hospitals Are Worried About Cut in Fund for the Uninsured


President Obama’s health care law is putting new strains on some of the nation’s most hard-pressed hospitals, by cutting aid they use to pay for emergency care for illegal immigrants, which they have long been required to provide.
The federal government has been spending $20 billion annually to reimburse these hospitals — most in poor urban and rural areas — for treating more than their share of the uninsured, including illegal immigrants. The health care law will eventually cut that money in half, based on the premise that fewer people will lack insurance after the law takes effect.

But the estimated 11 million people now living illegally in the United States are not covered by the health care law. Its sponsors, seeking to sidestep the contentious debate overimmigration, excluded them from the law’s benefits.
As a result, so-called safety-net hospitals said the cuts would deal a severe blow to their finances.
The hospitals are coming under this pressure because many of their uninsured patients are illegal immigrants, and because their large pools of uninsured or poorly insured patients are not expected to be reduced significantly under the Affordable Care Act, even as federal aid shrinks.
The hospitals range from prominent public ones, like Bellevue Hospital Center in Manhattan, to neighborhood mainstays like Lutheran Medical Center in Brooklyn and Scripps Mercy Hospital in San Diego. They include small rural outposts like Othello Community Hospital in Washington State, which receives a steady flow of farmworkers who live in the country illegally.
No matter where they are, all hospitals are obliged under federal law to treat anyone who arrives at the emergency room, regardless of their immigration status.

“That’s the 800-pound gorilla in the room, and not just in New York — in Texas, in California, in Florida,” Lutheran’s chief executive, Wendy Z. Goldstein, said.
Lutheran Medical Center is in the Sunset Park neighborhood, where low-wage earning Chinese and Latino communities converge near an expressway. Hospitals are not allowed to record patients’ immigration status, but Ms. Goldstein estimated that 20 percent of its patients were what she called “the undocumented — not only uninsured, but uninsurable.”
She said Congressional staff members acknowledged that the health care law would scale back the money that helps pay for emergency care for such patients, but were reluctant to tackle the issue.
“I was told in Washington that they understand that this is a problem, but immigration is just too hot to touch,” she said.
The Affordable Care Act sets up state exchanges to reduce the cost of commercial health insurance, but people must prove citizenship or legal immigration status to take part. They must show similar documentation to apply for Medicaid benefits that are expanded under the law.
The act did call for increasing a little-known national network of 1,200 community health centers that provide primary care to the needy, regardless of their immigration status. But that plan, which could potentially steer more of the uninsured away from costly hospital care, was curtailed by Congressional budget cuts last year.
That leaves hospitals like Lutheran, which is nonprofit and has run a string of such primary care centers for 40 years, facing cuts at both ends.

On a recent weekday in Lutheran’s emergency room, a Chinese mother of two stared sadly through the porthole of an isolation unit. The woman had active tuberculosis and needed surgery to drain fluid from one lung, said Josh Liu, a patient liaison.
The disease had been discovered during a checkup at one of Lutheran’s primary care centers, where the sliding scale fee starts at $15. But the woman, an illegal immigrant, had no way to pay for the surgery
Another patient, a gaunt 44-year-old man from Ecuador, had been in New York eight years, installing wood floors, one in Rockefeller Center. The man had been afraid to seek care because he feared deportation. Finally, the pain in his stomach was too much to bear.
Dr. Daniel J. Giaccio, leading the residents on their rounds, used the notches on the man’s worn belt to underscore his diagnosis, severe B-12 deficiency anemia. The woodworker had lost 30 pounds in a month, and his hands and feet were numb. Reversing the damage could take months.
“This is a severe case of sensory loss,” Dr. Giaccio said. “Usually we pick it up much sooner.”
In some states, including New York, hospitals caring for illegal immigrants in life-threatening situations can seek payment case by case, from a program known as emergency Medicaid. But the program has many restrictions and will not make up for the cuts in the $20 billion pool, hospital executives said.
Groups that favor more restrictive immigration policies said they agreed that the cuts in the $20 billion fund were a burden. They said hospitals obviously had a duty to provide emergency care for everybody, including illegal immigrants.
“I kind of like living in a society where we don’t let people die on the steps of the emergency room,” said Mark Krikorian, the executive director of one such group, the Center for Immigration Studies in Washington.
But he said the answer lay in enforcing laws, so that illegal immigrants leave the country, not in extending health coverage.
“There is no ideal resolution to the problem, other than reducing the illegal population,” he said. “Incorporating illegal immigrants into health exchanges or directly taxpayer-funded health care legitimizes their presence.”

The Obama administration said the Affordable Care Act supported safety-net hospitals in other ways, pointing to measures that raise payments for primary care and give bonuses for improvements in quality.
“We are taking important steps to make health care more affordable and accessible for millions of Americans,” Erin Shields Britt, a spokeswoman for the Department of Health and Human Services, said in an e-mail. “Health reform isn’t the place to fix our broken immigration system.”
With illegal immigration an issue in the presidential campaign, many politicians continue to steer clear of addressing the cuts.
Hospitals in New York State now receive $2.84 billion of the nation’s $20 billion in so-called disproportionate share hospital payments.
Those payments start shrinking in 2014 under the law, and drop to $10 billion by 2019.
“It is a difficult time to really advocate around this issue, because there is so much antipathy against new immigrants,” said Alan Aviles, president and chief executive of the Health and Hospitals Corporation.
The corporation runs New York City’s public hospitals, which treated 480,000 uninsured patients last year, an estimated 40 percent of them illegal immigrants. The same worries haunt tiny Othello Community Hospital, in Washington state’s rural Adams County, where it is the only hospital for miles around.
Last year, the state began requiring that participants in a basic health plan prove that they are citizens or legal residents.
As a consequence, 4,000 out of the 4,400 patients at the nearby primary care center, mostly immigrant farmworkers, lost their coverage, leaving Othello more financially vulnerable when those people need emergency care.
In Central California, Harry Foster, director of the Family HealthCare Network, another primary care center, called the Affordable Care Act “a double-edged sword.”
Many low-wage earning citizens now lack employer-sponsored health insurance, and the health care industry is already competing for those who will gain coverage through the law. But no one is competing to treat those it leaves out, he said.
“We will receive more and more of those patients,” he said, estimating that 40 percent of the area’s residents were illegal immigrant farmworkers. “But financially, we can’t take on all the uninsured patients in the area, to the exclusion of all the others, and survive.”
In many ways Lutheran, a century-old hospital that refurbished a defunct factory to serve as its hub in the 1960s, has been a prototype of the law’s new model: coordinating primary and preventive care to improve health outcomes while curbing costs. Yet it stands to lose $25 million from the cuts.
“This is an unintended consequence of the law,” said Ms. Goldstein, the hospital’s chief executive. “But so far, nobody is doing anything to resolve it.”

But Flor was born premature, spent three months in the neonatal incubator and cost the San Joaquin Hospital more than $300,000. Meanwhile, oldest daughter Lourdes married an illegal alien gave birth to a daughter, too. Her name is Esmeralda. And Felipa had yet another child, Cristian. The two Silverio anchor babies generate $1,000 per month in public welfare funding for the family. Flor gets $600 a month for asthma. Healthy Cristian gets $400. While the Silverios earned $18,000 last year picking fruit, they picked up another $12,000 for their two "anchor babies." While President Bush says the U.S. needs more "cheap labor" from south of the border to do jobs Americans aren't willing to do, the case of the Silverios shows there are indeed uncalculated costs involved in the importation of such labor – public support and uninsured medical costs. In fact, the increasing number of illegal aliens coming into the United States is forcing the closure of hospitals, spreading previously vanquished diseases and threatening to destroy America's prized health-care system, says a report in the spring issue of the Journal of American Physicians and Surgeons. "The influx of illegal aliens has serious hidden medical consequences," writes Madeleine Pelner Cosman, author of the report. "We judge reality primarily by what we see. But what we do not see can be more dangerous, more expensive, and more deadly than what is seen." According to her study, 84 California hospitals are closing their doors as a direct result of the rising number of illegal aliens and their non-reimbursed tax on the system. "Anchor babies," the author writes, "born to illegal aliens instantly qualify as citizens for welfare benefits and have caused enormous rises in Medicaid costs and stipends under Supplemental Security Income and Disability Income." In addition, the report says, "many illegal aliens harbor fatal diseases that American medicine fought and vanquished long ago, such as drug-resistant tuberculosis, malaria, leprosy, plague, polio, dengue, and Chagas disease." While politicians often mention there are 43 million without health insurance in this country, the report estimates that at least 25 percent of those are illegal immigrants. The figure could be as high as 50 percent. Not being insured does not mean they don't get medical care. Under the Emergency Medical Treatment and Active Labor Act of 1985, hospitals are obligated to treat the uninsured without reimbursement. "Government imposes viciously stiff fines and penalties on any physician and any hospital refusing to treat any patient that a zealous prosecutor deems an emergency patient, even though the hospital or physician screened and declared the patient's illness or injury non-emergency," says the report. "But government pays neither hospital nor physician for treatments. In addition to the fiscal attack on medical facilities and personnel, EMTALA is a handy truncheon with which to pummel politically unpopular physicians by falsely accusing them of violating EMTALA." According to the report, between 1993 and 2003, 60 California hospitals closed because half their services became unpaid. Another 24 California hospitals verge on closure, the author writes. "American hospitals welcome 'anchor babies,'" says the report. "Illegal alien women come to the hospital in labor and drop their little anchors, each of whom pulls its illegal alien mother, father, and siblings into permanent residency simply by being born within our borders. Anchor babies are citizens, and instantly qualify for public welfare aid: Between 300,000 and 350,000 anchor babies annually become citizens because of the Fourteenth Amendment to the U.S. Constitution: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside." Among the organizations directing illegal aliens into America's medical systems, according to the report, are the Ford Foundation-funded Mexican American Legal Defense and Education Fund, the National Immigration Law Center, the American Immigration Lawyers Association, the American Bar Association's Commission on Immigration Policy, Practice, and Pro Bono, the Immigrant Legal Resource Center, the National Council of La Raza, George Soros's Open Society Institute, the Migration Policy Institute, the National Network for Immigration and Refugee Rights and the Southern Poverty Law Center. Because drug addiction and alcoholism are classified as diseases and disabilities, the fiscal toll on the health-care system rises.

County’s Monthly Welfare Tab For Illegal Aliens $52 Million

As the mainstream media focuses on a study that reveals a sharp decline in the nation’s illegal immigrant population, monthly welfare payments to children of undocumented aliens increased to $52 million in one U.S. county alone.

The hoopla surrounding last week’s news that the annual flow of illegal immigrants into the U.S. dropped by two-thirds in the past decade overlooked an important matter; the cost of educating, incarcerating and medically treating illegal aliens hasn’t decreased along with it, but rather skyrocketed to the tune of tens of billions of dollars annually.

THIS FIGURE DOES NOT INCLUDE EXTRA MILLIONS PAID FOR ANCHOR BABIES

Those figures don’t even include the extra millions that local municipalities dish out on welfare payments to the U.S.-born children of illegal immigrants, commonly known as anchor babies. In Los Angeles County alone that figure increased by nearly $4 million in the last year, sticking taxpayers with a whopping $52 million tab to provide illegal immigrants’ offspring with food stamps and other welfare benefits for just one month.

That means the nation’s most populous county, in the midst of a dire financial crisis, will spend more than $600 million this year to provide families headed by illegal immigrants with welfare benefits. In each of the past two years Los Angeles County taxpayers have spent about half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants. Additionally, the county spends $550 million on public safety and nearly $500 million on healthcare for illegal aliens.

About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from L.A. County’s Department of Social Services. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare perks that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children.

Congressional study shows illegal immigrants sap tax dollars

A study by the U.S. Congressional Budget Office released Tuesday backs up the view that undocumented immigrants sap more tax dollars than they provide, especially in education, health care and law enforcement.

The study pulled together reports from the past five years, using data from sources including the Pew Hispanic Center, the Rand Corp., the U.S. Department of Homeland Security and various universities. The Congressional study also incorporated facts from states, including Arizona, but its authors acknowledged there was no aggregate estimate that could be applied to the entire country.

The report says that in 1990, 90 percent of undocumented immigrants primarily were in six states: California, Florida, Illinois, New Jersey, New York and Texas.

By 2004, undocumented immigrants had increased tenfold in other states, most notably Arizona, Georgia, North Carolina and Tennessee, according to statistics from the Pew Hispanic Center.

The report estimates there are 12 million undocumented immigrants nationwide. Of those, 60 percent are uninsured and 50 percent of the children are uninsured. Again using 2004 statistics from the Pew Hispanic Center the average income of undocumented immigrants was $27,400 while Americans earned $47,800. The difference puts undocumented immigrants in a lower tax bracket, thus reducing the amount of federal and state income taxes generated.

The study also showed that while undocumented workers represented just 5 percent of state and federal service costs, their tax revenue did not offset the amount spent by government. The authors of the study stated that, "the general consensus is that unauthorized immigrants impose a net cost on state and local budgets. However, no agreement exists as to the size of, or even the best way of measuring, that cost at a national level."

In education, which the study notes is the largest single expenditure in state and local budgets, multiple states reported 20 to 40 percent higher costs educating non-English speaking students, many of whom come from the homes of undocumented immigrant parents. Using New Mexico statistics from 2004 as a model, education spending on undocumented immigrants comprised $67 million of the state's $3 billion education budget.

The study estimates there are 53.3 million school-age children in the U.S., 2 million of whom are undocumented immigrants and another 3 million who are legal citizens, but whose parents are not.

Undocumented immigrants are more likely to access emergency rooms and urgent care facilities because most do not have health care, the study said. In Arizona and other border areas, states paid nearly $190 million in health care costs for undocumented immigrants in 2000, the study reported. The amount, which the study says likely has risen since then, represented one-quarter of all uncompensated health care costs in those states that year.

While the report found that undocumented immigrants are less likely to be incarcerated than American natives, it said states still bear a large cost for the legal process. Based on a report from the U.S./Mexico Border Counties Coalition from 2001, counties from the four states that border Mexico spent more than $108 million on law enforcement activities involving undocumented immigrants. San Diego County in California spent nearly half of that, with more than $50 million going into law enforcement activities involving undocumented immigrants.

Study Looks at Babies Born to Illegal Immigrants


About 340,000 of the 4.3 million babies born in the United States in 2008 — or 8 percent — had at least one parent who was an illegal immigrant, according to a study published Wednesday by the Pew Hispanic Center, a nonpartisan research group in Washington.

Because they were born in this country, the babies of illegal immigrants are United States citizens. In all in 2008, four million children who were American citizens had at least one parent who was in the country illegally, the Pew study found.

Children of illegal immigrants make up 7 percent of all people in the country younger than 18 years old, according to the study, which is based on March 2009 census figures, the most recent data on immigrant families. Nearly four out of five of those children — 79 percent —are American citizens because they were born here.

About 85 percent of the parents who are illegal immigrants are Hispanic, the Pew Center reported.

The Pew study comes as lawmakers in Washington have been debating whether to consider changing the 14th Amendment of the Constitution, which grants citizenship to anyone born in the United States. The controversy erupted after Senator Lindsey Graham, Republican of South Carolina, said in July that he might offer an amendment to revoke birthright citizenship for the American-born children of illegal immigrants.

Mr. Graham’s comments touched a nerve with many Americans, who called in to talk shows to question whether the children of immigrants who have violated the law by remaining in the United States should be granted citizenship. But it was less clear that there was strong support for altering the Constitution to address the problem.

A nationwide survey in June by the Pew Research Center for the People and the Press, a group affiliated with the Hispanic Center, found that 56 percent of those polled opposed changing the 14th Amendment, while 41 percent supported it.

The study by the Pew Hispanic Center casts light on an issue raised by Mr. Graham that prompted the current debate. In an interview with Fox News last month, Mr. Graham said that many illegal immigrants were crossing the border to have babies in this country to gain citizenship for their children. “They come here to drop a child,” Mr. Graham said.

The Pew figures showed that over 80 percent of mothers in the country illegally had been here for more than a year, and that more than half had been in the country for five years or more, said Jeffrey S. Passel, senior demographer at the Pew Hispanic Center and the co-author of the study, along with Paul Taylor, the center’s director.

“The combination of the growing undocumented population through 2007, with more staying in the country longer, creates a situation where we have seen increasing numbers of these births over the last six or seven years,” Mr. Passel said. “Because the immigrants are staying here, this is a young population, and they get married and form families.”
Republican leaders and conservatives have been divided over Mr. Graham’s proposal for a constitutional amendment.

But Mr. Krikorian, a conservative, does not favor an immediate effort to amend the citizenship clause of the Constitution. He said he wants to see tougher enforcement to reduce the number of illegal immigrants in the country.

“The point is to shrink the illegal population and prevent new illegals from coming in,” he said, “before it’s appropriate to have the constitutional debate.”

Mexico Promotes Free U.S. Healthcare For Illegal Immigrants

Time to wake up people! With unemployment at 12% and the state going broke, our tax dollars are going to pay for healthcare for hundreds of thousands of illegal aliens. To the tune of over a billion dollars a year!

Mexico's government operates programs in about a dozen American cities that refers its nationals--living in the U.S. illegally--to publicly funded health centers where they can get free medical care without being turned over to immigration authorities.
The program is called Ventanillas de Salud (Health Windows) in Spanish and its mission is to help illegal immigrants find U.S. hospitals, clinics and other government programs where they can get free services without being deported for violating federal immigration laws.

Chicago, Houston, Los Angeles, San Diego and Indiana are among the cities where Mexican consulates operate the health referral system which annually costs U.S. taxpayers billions of dollars. In Los Angeles County alone, illegal immigrants cost taxpayers nearly $440 million in health services annually and a whopping $1.1 billion statewide.

The Mexican consul in Los Angeles proudly announced that nearly 300,000 Mexicans in the area have benefited from his government's health referral program, which he says actually saves the county money by encouraging immigrants to seek preventive care rather than waiting for more expensive emergency treatment.

The Southern California operation promises to assess "consulate clients" for eligibility to government-funded health insurance and other primary care services and offers free legal assistance to those who are denied coverage. Its goal is to improve access to health services for immigrants of Mexican origin by formalizing a health education, medical home referral and insurance enrollment program.

In Chicago, the Mexican consul's Spanish-language web site heavily promotes the Illinois Department of Health's low-cost prescription medicine program for illegal aliens and various free medical services throughout the state. It encourages all Mexicans in the area to pursue the valuable U.S. government-financed services for their entire family.

The Indiana-based program boasts that it serves thousands of "Mexican nationals" living in that state as well as Ohio, Kentucky and southern Illinois. Mexican officials claim that its highly successful pro-health program sends out a clear message to other Mexican consulates throughout the country and the world.

Although these programs facilitate people to remain in the country illegally, Mexico is working hard to expand them to all 47 U.S. consulates to better serve its nationals. In the meantime, U.S. taxpayers will keep picking up the exorbitant tab of medically treating the millions who live in the country illegally.

While the census information did not include demographic breakouts, immigration groups were quick to claim that immigrants, and particularly Latinos, accounted for much of the population growth, both here and across the country.

"Today's data, coupled with recently released Census Bureau estimates, demonstrate that the Latino population has significantly influenced how congressional seats are apportioned among the states," the Mexican American Legal Defense and Educational Fund said in a statement.

But the Federation for American Immigration Reform, which supports controlled immigration, called the population increase "enormous and unwelcome" and a further strain on the country's natural resources.

"It is increasingly clear that our immigration policies are divorced from the social, economic and environmental realities that face our nation," said its president, Dan Stein.

Latinos represent the fastest-growing demographic group in the United States as well as in Washington state. Census estimates for the 2005-2009 period released this month show the Latino population in Washington grew 41 percent since 2000.

Nationally, one-quarter of all births are to Latino mothers, compared with 19 percent in Washington state, according to state figures.
