One-out-of-six working Americans (16%) consider themselves to be among the working poor.
A new Rasmussen Reports telephone survey of employed adults finds that 65% of employed adults still consider themselves part of the socio-economic "middle class." Another 15% consider themselves part of the upper middle class and four percent (4%) consider themselves wealthy.

House Immigration Subcommittee Holds Hearing on HALT Act
On Tuesday, the House Judiciary’s Subcommittee on Immigration Policy and Enforcement held a hearing on H.R. 2497, the “Hinder the Administration’s Legalization Temptation” or “HALT” Act. The HALT Act, introduced by Judiciary Chairman Rep. Lamar Smith (R-TX), would suspend President Obama’s use of “prosecutorial discretion”—the ability of the executive branch to decline to enforce immigration law against individuals—by preventing him from:
Granting deferred action, parole, or extended voluntary departure to illegal aliens other than those being tried for a crime or acting as a witness at trial, those needed for significant law enforcement or national security purposes, or those whose life is imminently threatened (§§2(b), 2(f));
Waiving the three and ten year bars to admission for aliens who have been illegally present in the U.S. (§2(a));
Cancelling the removal and adjusting the status of illegal aliens ordered deported (§2(c));
Designating additional countries as qualifying for Temporary Protected Status (TPS) (§2(d)); and
Granting work authorization to illegal aliens (§§2(e), 2(g)).

Rep. Smith outlined the need for the HALT Act’s  restriction of the Obama Administration’s use of prosecutorial discretion in his opening statement. “What had once been rumor fueled by leaked administration memos is now official Department of Homeland Security (DHS) policy as of last month,” he said referencing two June 17th, 2011 memos issued by ICE Director, John Morton, authorizing ICE personnel to decline to enforce immigration laws against certain classes of illegal aliens, such as those who would qualify for amnesty under the failed DREAM Act. (See FAIR’s Legislative Update, June 27, 2011) “Unfortunately, the ICE memos make clear that DHS plans not to use but to abuse these [prosecutorial discretion] powers. If the Obama Administration has its way, millions of illegal immigrants will be able to live and work legally in the United States. This unilateral decision will saddle American communities with the costs of providing education and medical care to illegal immigrants.”
Several witnesses testifying before the Subcommittee agreed with Rep. Smith’s call for limiting the Administration’s authority, expressing concern that the President is bypassing Congress. Senator David Vitter (R-LA), author of the Senate version of the HALT Act (S.1380), asserted in his written testimony: “In 1996, Congress clearly limited the Administration’s parole authority to be used ‘only on a case-by-case basis for urgent humanitarian reasons or significant public benefit. However, these memos make clear that DHS plans to abuse these powers to grant mass legalization without any Congressional authorization.” (Testimony of Sen. David Vitter, July 26, 2011) Likewise, Jessica Vaughan, Director of Policy Studies at the Center for Immigration Studies, stated that forms of relief granted through the use of prosecutorial discretion is “designed to be used for exceptionally compelling cases, and were not intended as a way for the President, his appointees, or government staff to bypass Congress and its unique authority to make immigration law.” (Testimony of Jessica Vaughan, July 26, 2011)
Chris Crane, President of a national ICE union representing roughly 7,000 employees, also testified in support of the HALT Act, describing the problems caused by the latest string of Morton memos. “The purpose of this policy is to prohibit officers and agents from arresting individuals from certain groups... From an enforcement standpoint, the biggest dilemma facing officers and agents in the field may be how to apply the policy to the hundreds of thousands of aliens encountered each year.” (Testimony of Chris Crane, July 26, 2011) Last summer, the union Crane represents issued a vote of no-confidence in ICE Director John Morton, and former Assistant Director of the ICE Office of Detention and Policy and Planning, Phyllis Coven. (See FAIR Legislative Update, Aug. 9, 2010)
Margaret Stock, the only witness who opposed the HALT Act, alleged, “Our immigration system is dysfunctional and irrational, and the situation only promises to get worse without comprehensive action by Congress.” (Testimony of Margaret Stock, July 26, 2011) “Our nation’s ever more complex and restrictive legal immigration system makes it nearly impossible for most people to immigrate to the United States legally, and provides no means for people to enter or stay in the United States legally in many compelling circumstances,” she added. (Id.) Ms. Stock, an adjunct professor and retired army colonel, also testified before the Senate Judiciary Committee in support of the DREAM Act last month.

Obama soft on illegals enforcement




Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

With G.O.P.’s Ear, Rubio Pushes Dream Act Proposal


MIAMI — When Senator Marco Rubio first floated his compromise version of the Dream Act — the bill, now stalled, that would grant some students in the United States illegally a path to citizenship — the chances of reviving the politically charged issue in Congress seemed as dim as the chances of snuffing out attack ads on the campaign trail.

On Thursday, Speaker John A. Boehner said as much, calling it “difficult at best” to take up the issue in the House, where Republicans are pushing for greater border security, not more forgiving laws. But Mr. Boehner did not close the door, saying “there is always hope” and adding that Mr. Rubio had spoken to him about his proposal.

“I found it of interest,” Mr. Boehner said. “But the problem with this issue is that we are operating in a very hostile political environment.”

Recognizing that his proposal was never going to be an easy sell for either Republicans or Democrats, Mr. Rubio said in an interview this week that he was moving forward with his plan to give students a chance to study and work here legally, albeit temporarily. The senator said he and his staff had been speaking with Democrats, conservative Republicans in and out of Congress, immigration advocates and the students themselves.

The plan seeks to assuage concerns on all sides, Mr. Rubio added; it cannot serve as a lure to illegal immigrants but must offer eligible students genuine relief.

“I don’t want to be unrealistically optimistic about it,” he said, but added, “I have not been discouraged by anybody in my party.”

The compromise would grant students who are the children of illegal immigrants a new kind of nonimmigrant visa that would let them live in this country legally for a period of time. They could work, drive and pay taxes. He would also grant nonimmigrant visas to the graduates of colleges and trade schools, enabling them to stay here and work.

The proposal would not grant them green cards, giving them permanent residency, which sets it apart from the original Dream Act. With their nonimmigrant visas, they could seek green cards in the traditional way, either through marriage, family or an employer. But they could remain in this country legally during that process.

Left with few options, many students and activists said that they were open to Mr. Rubio’s compromise but that they would wait to see the complete bill.

Gaby Pacheco, an immigrant activist for United We Dream, who recently met with Senator Rubio, said the students were tired of waiting for Congress and wanted to break the logjam. She said Mr. Rubio was taking a serious approach to the problem.

“We need a starting point,” she said “Right now with the way the country is so polarized and anti-immigrant, if a Republican starts talking about it and is able to bring his party into the dialogue, we need to listen to that and give them the opportunity.”

Mr. Rubio said that he was still working on the details and that he hoped to introduce a bill once he had lined up enough support.

The Dream Act passed the House in 2010 but failed in the Senate. Last year, Senator Richard J. Durbin, the Illinois Democrat who sponsored the bill, modified it to address some Republican concerns, but it has not attracted much party support.

Most Republicans view the bill as a form of “amnesty” to people who have broken the law and as a lure to undocumented immigrants.

Mr. Rubio, a potential vice-presidential contender and a Florida Cuban-American, said he was working to garner support from fellow conservatives. The issue is important to many Hispanics in the country, a group of swing voters that has largely decried Mitt Romney’s position on how to handle illegal immigrants.

“I am cautiously optimistic that we are going to have very significant support among Republicans,” Mr. Rubio said.

Senator Durbin has expressed a willingness to consider the senator’s proposal. Most Democrats said they were waiting to see the details and whether Republicans would back the plan.

Cheryl Little, a prominent immigration advocate and lawyer in Miami, said she was pleasantly surprised when Mr. Rubio called her a few weeks ago to seek her opinion.

Ms. Little would prefer something permanent for the dreamers, and not a succession of temporary visas, but she said Mr. Rubio was the lone Republican in Congress trying to address the issue.

“It’s hard to believe they will budge,” she said of Republicans, given the election year. “But we are pushing everybody we can to try to do something to move this forward. I don’t care if it’s a Republican, a Democrat or an independent. If they have a good idea, and it’s got legs, we are going to support it.”

Meanwhile, Ms. Little and other activists are pressuring President Obama to expand a discretionary provision already granted to the Department of Homeland Security that delays deportation of these students and allows them to work. That permission is currently given on a case by case basis.

“The administration should do what they have the authority to do, and do so now,” Ms. Little said.

A White House official who was not authorized to speak publicly said President Obama “is using all the administrative tools he has” and that he supported the Dream Act.

But the official added, “There is no magic wand. This requires action by Congress.”

Senator Rubio shrugged off criticism that his plan is a political ploy to attract Hispanics and not a serious legislative effort to help students here illegally.

“Taking something like this on politically has just as many pitfalls as it has advantages,” he said.

Border hawks warn Mitt Romney not to soften immigration stance

Immigration hawks are warning Mitt Romney, the presumptive Republican nominee, not to moderate the hard-line stances on border security and deportation that he took during the GOP primary.

Conservatives who focus on an anti-illegal immigration message are worried that Romney will move toward the political center in the general election election campaign after he suggested the GOP develop a “Republican DREAM Act.”

"Any reversal on these positions would destroy his credibility, alienate conservative American voters who outnumber Latino voters, and exert the same pressures on Mitt Romney that destroyed John McCain and Rick Perry's campaigns," said William Gheen, the head of the anti-illegal immigration group ALIPAC. "Not only would a Romney shift on immigration hurt him among Americans concerned about illegal immigration but it would signal that he cannot be trusted on any issue or topic whatsoever."

Romney, took a hard line on immigration during the GOP primary and said he would veto the “DREAM Act,” which in its current incarnation would allow some illegal immigrants a path to citizenship. But he said at a private fundraiser last weekend that his campaign was “doomed” if he didn’t improve his standing with Hispanic voters. Romney did not detail policy specifics of a “Republican DREAM Act” and avoided discussing those comments when asked about them on Friday in Arizona.

Former Rep. Tom Tancredo (R-Colo.), a longtime anti-immigration activist, said he was unsurprised that Romney seemed to be signaling a shift.

“It should be expected with him,” Tancredo told The Hill. “It’s not as if he’s a guy with a deep philosophical commitment one way or the other ... there’s nothing you can count on including any philosophical roadmap for his presidency. I don’t have any idea what he’ll do, and I’m not sure he does.”

Tancredo said that any version of the DREAM Act is “simply wrong.”

Romney will spend Monday campaigning with Sen. Marco Rubio (R-Fla.), who is working on introducing his own version of the “DREAM Act” this summer that would give some illegal immigrants permanent residency rather than a pathway to citizenship. Many consider Rubio a top contender to be Romney's choice for vice president.

Romney also recently added former Republican National Committee Chairman Ed Gillespie, a centrist on immigration, as a senior adviser in his campaign.

Latinos are the fastest growing voting bloc in the country, doubling as a percentage of total voters in the 20 years between 1988 and 2008. Roughly 9.7 million Latino voters turned out in 2008 – 7.4 percent of the total – and they supported President Obama by a ratio of 2:1.

Romney's campaign and the Republican National Committee have launched efforts to win over Latino voters. Romney put out a statement on Friday arguing that Obama “has brought hard times to Hispanics in America.”

Other top Republicans said they though Romney had boxed himself in on immigration and would be perceived as a flip-flopper if he tried to move toward the center.

“Anything that you say and do in public or in your pajamas lives forever in cyberspace,” said Rep. Steve King (R-Iowa.). “'Etch-a-sketch' is an archaic concept that cannot exist in the modern social media world so I don’t think that that actually could work and I don’t think that’s what’s going to be applied.”

King joked that Gillespie isn’t “completely reformed yet” when asked about his views on immigration, and pointed out that Romney had stressed his border hawk bona fides numerous times in Iowa, a key swing state in the presidential race.

“Iowans are going to want to the hear solid, consistent immigration policy that Mitt Romney has delivered for five or more years in Iowa,” he said.

When asked if he was trying to box in Romney on the issue, King laughed.

“I know what I heard and so does cyberspace,” he said.

Romney’s campaign declined to comment for this story.

Kansas Secretary of State Kris Kobach (R), an informal adviser to the Romney campaign who co-wrote Arizona's controversial immigration law, predicted Romney would stick with his previous positions on border control.

“Governor Romney and the Romney team remain firmly opposed to amnesty,” he told The Hill earlier this week. “I’m not getting any sense he’s changing his positions. He’s staked them out in the [presidential] debates with considerable specificity. He said the Arizona bill should be a model. He said the concept of self-deportation should be one that’s used. I hadn’t heard at all he’s moving and I doubt he will.”

Kobach said that Romney’s “DREAM Act” comments didn’t concern him — but said any support of a bill that changed the status of illegal immigrants is beyond the pale for him.

“I would not be amenable to any status adjustment for illegal aliens,” he said. “Any status adjustment to illegal aliens would be amnesty — I would not be in favor of any of that,” he said.

Tancredo expressed hope that Kobach could convince Romney to hold his position on the DREAM Act and keep up the rhetoric he used during the primary, but doubted he would.

“If I were in his camp I’d counsel him to stand firm on it because I think it’s a winning political issue, but I don’t know if there’s anyone high the campaign that will advise him that,” he said. “My guess is Gillespie’s voice will be louder than Kris Kobach’s."

With the support of 70 percent of its citizens, Arizona has ordered sheriffs and police to secure the border and remove illegal aliens, half a million of whom now reside there.

Arizona acted because the U.S. government has abdicated its constitutional duty to protect the states from invasion and refuses to enforce America's immigration laws.

"We in Arizona have been more than patient waiting for Washington to act," said Gov. Jan Brewer. "But decades of inaction and misguided policy have created an unacceptable situation."

We have a crisis in Arizona because we have a failed state in Washington.

What is the response of Barack Obama, who took an oath to see to it that federal laws are faithfully executed?

He is siding with the law-breakers. He is pandering to the ethnic lobbies. He is not berating a Mexican regime that aids and abets this invasion of the country of which he is commander in chief. Instead, he attacks the government of Arizona for trying to fill a gaping hole in law enforcement left by his own dereliction of duty.

He has denounced Arizona as "misguided." He has called on the Justice Department to ensure that Arizona's sheriffs and police do not violate anyone's civil rights. But he has said nothing about the rights of the people of Arizona who must deal with the costs of having hundreds of thousands of lawbreakers in their midst.

How's that for Andrew Jackson-style leadership?

Obama has done everything but his duty to enforce the law.

Undeniably, making it a state as well as a federal crime to be in this country illegally, and requiring police to check the immigration status of anyone they have a "reasonable suspicion" is here illegally, is tough and burdensome. But what choice did Arizona have?

The state has a fiscal crisis caused in part by the burden of providing schooling and social welfare for illegals and their families, who consume far more in services than they pay in taxes and who continue to pour in. Even John McCain is now calling for 3,000 troops on the border.

Police officers and a prominent rancher have been murdered. There have been kidnappings believed to be tied to the Mexican drug cartels. There are nightly high-speed chases through the barrios where innocent people are constantly at risk.

If Arizona does not get control of the border and stop the invasion, U.S. citizens will stop coming to Arizona and will begin to depart, as they are already fleeing California.

Arizona has been compelled to assume the feds' role because the feds won't do their job. And for that dereliction of duty the buck stops on the desk of the president of the United States.

Why is Obama paralyzed? Why does he not enforce the law, even if he dislikes it, by punishing the businessmen who hire illegals and by sending the 12 million to 20 million illegals back home? President Eisenhower did it. Why won't he?

Let us see how many African-Americans, who are today frozen out of the 8 million jobs held by illegal aliens that might otherwise go to them or their children, will march to defend an invasion for which they are themselves paying the heaviest price.

Last year, while Americans were losing a net of 5 million jobs, the U.S. government -- Bush and Obama both -- issued 1,131,000 green cards to legal immigrants to come and take the jobs that did open up, a flood of immigrants equaled in only four other years in our history.

What are we doing to our own people?

Whose country is this, anyway?

America today has an establishment that, because it does not like the immigration laws, countenances and condones wholesale violation of those laws.

Nevertheless, under those laws, the U.S. government is obligated to deport illegal aliens and punish businesses that knowingly hire them.

The Administration's Phantom Immigration Enforcement Policy

According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.

Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”

Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.

“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”

If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.

According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.

The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.

While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.

In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.

As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.

As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Black America vs. Obama?

"The Disappearing Black Middle Class" ran the headline over the Chicago Sun-Times story. And the statistics from the Economic Policy Institute were indeed sobering.

In 2007, best year of the Bush era, white households had a median net worth of $134,280, compared with $13,450 for black households.

By 2009, the median net worth for white households had fallen 24 percent to $97,860. For black households, it had plummeted 83 percent to $2,170, a near wipeout.

As Algernon Austin of EPI's Program on Race, Ethnicity and the Economy put it, "In 2009, for every dollar of wealth the average white household had, black households had two cents."

One explanation for this surely is the wave of foreclosures on subprime mortgages, a large share of which were held by African-Americans.

But while unemployment among white men has surged in the Great Recession, among black men it has hit 16 percent, the highest level since the Department of Labor began to keep records in 1972.

Ominously, things are likely to get worse, because Bill Clinton's assertion, "The era of big government is over!" is today palpably true.

Not only in Wisconsin, Ohio and New Jersey, run by Republicans, is this so, but in liberal mega-states like New York and California. There, Govs. Andrew Cuomo and Jerry Brown run the show, and government payrolls are also being slashed and government pensions pared back.

From Greece to Portugal to Ireland to Italy, an age of austerity has begun. And now that age is about to begin in Barack Obama's Washington.

Why should this adversely affect black America?

Because not only are African-Americans disproportionately the beneficiaries of federal programs, from the Earned Income Tax Credit to aid for education and student loans, they are even more over-represented in the federal workforce than they are on state payrolls.

Though 10 percent of the U.S. civilian labor force, African-Americans are 18 percent of U.S. government workers. They are 25 percent of the employees at Treasury and Veterans Affairs, 31 percent of the State Department, 37 percent of Department of Education employees and 38 percent of Housing and Urban Development. They are 42 percent of the Equal Employment Opportunity Commission and Pension Benefit Guaranty Corp., 55 percent of the employees at the Government Printing Office and 82 percent at the Court Services and Offender Supervision Agency.

When the Obama administration suggested shutting down Fannie Mae and Freddie Mac, the mortgage giants whose losses of $150 billion have had to be made up by taxpayers, The Washington Post warned, in a story headlined, "Winding Down Fannie and Freddie Could Put Minority Careers at Risk," that 44 percent of Fannie employees and 50 percent of Freddie's were persons of color.

In Washington, D.C., we have also seen the result of government cuts on African-American leaders who had to approve those cuts.

When Mayor Adrian Fenty stood behind schools chancellor Michelle Rhee, who fired hundreds of teachers, most of them African-American, the wards east of the Anacostia cut him dead. In 2010, Fenty was thrown out by many of the black voters who elected him.

Not only are African-Americans over-represented among government employees, these jobs are the backbone of the black middle class. For federal pay and benefits in recent years have far outstripped those of the private sector.

From 2000 to 2010, the number of federal employees earning over $150,000 increased tenfold. That number doubled in the first two years alone of the Obama administration. The average pay of federal civil servants in 2009, after benefits were factored in, was $123,000, twice the average pay and benefits of $61,000 in the private sector.

Indeed, because of the salaries and benefits that District of Columbia and federal employees receive, Washington is first among all metropolitan areas in per-capita income. And the three congressional districts north and west of the city in Maryland and Virginia are among the top 10 in the nation in average income.

The half-century since the Great Society was launched in the mid-1960s have been the salad days of the government sector. No segment of the population has benefited more than black America.

But with the U.S. government running its third deficit of 10 percent of gross domestic product, and Obama talking of cutting $4 trillion from future spending, those days are over. And as black America benefited immensely from the Great Society, so it is likely to hurt most as the cuts come.

Already, black voices are beginning to blame the black president whom fate has chosen to preside over the downsizing.

Obama, says Princeton professor Cornell West, "lacks backbone." He is a "black mascot of Wall Street and a black puppet of corporate plutocrats. ... I don't think in good conscience I could tell anybody to vote for Barack Obama."

Incredibly, the question must be asked.

Is this Democratic administration about to go to war with its base? Is black America souring on Barack Obama?

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.

Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.

“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.

Rep. Charles Gonzalez (D-Texas) raised doubts about the reporting, noting that the study itself said it was based on inconclusive data and that it was “impossible to provide precise numbers” on how many people who were registered to vote in the state were not citizens.

Gonzalez asked Gessler, a former prosecutor, if he would have pursued a court case on such evidence.

Gessler responded that the goal of the study was to expose voter registration issues and pursue administrative avenues to resolve them.

“We don’t have a screen for citizenship on the front end when people register to vote,” he said.

Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.

Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.

“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.

When U.S. Air Force veteran Marcos Miranda had his identity stolen, he went from being a valued customer and employee to a government statistic — one of thousands of identity theft victims caught up each year in the crackdown on illegal immigrants.

Identity theft has been a growing worry in the United States, but a rise in federal prosecutions of immigrants offers a new wrinkle on the problem. As better systems are developed for verifying employment, illegal immigrants are assuming the names and government-issued ID numbers of Americans like Miranda to thwart detection at workplaces, get driver's licenses and obtain credit.

Miranda first learned someone else was using his identity in 2000 when he was arrested on a warrant for unpaid traffic tickets at the border after a visit to relatives in Mexico. The 24-year-old Texas man was released after paying a $340 fine for violations he never incurred. Although his money was eventually returned, his nightmare was just beginning.

The most common start to identity theft is for the perpetrator get hold of someone's Social Security number, which is part of the system used to record people's earnings for federal retirement benefits. Once a person takes a job in the U.S., the first thing his employer will likely ask for is his or her Social Security number.

In Miranda's case, that's why he has gotten repeated letters from the federal tax officials demanding thousands of dollars in back taxes for wages paid to someone using his name and Social Security number to work at a pork slaughterhouse in Holton, Kansas. Miranda watched his once-high credit rating plummet as creditors reported unpaid bills incurred by others.

"Even though I am Hispanic, I am against illegal immigration," Miranda said. "Even though a lot of them come to work, there are always bad apples. (Identity theft) has really made my perspective ... negative about immigration."

A Mexican national accused of stealing Miranda's identity pleaded guilty last month to one count of using fraudulent documents in a plea deal with federal prosecutors. Joel Rojas-Morales, 27, will be sentenced in March.

"That way he knows crime doesn't pay in America. Maybe in Mexico it does. But here, it may take some time, but the long arm of the law catches up to you," Miranda said.

Chris Joseph, the defense attorney representing Rojas-Morales, is sympathetic to identity theft victims like Miranda.

"I have no reason to doubt that is absolutely true. There is no question he is a victim of identity theft," Joseph said.

An illegal immigration link to identity theft

A massive sweep at Swift meat-processing plants this week could lead officials to 'document rings.'

The latest roundup of illegal immigrants caught working in the US with fraudulent identifications - the largest single such work-site action ever - raises new questions about a link between illegal immigration and the growing problem of identity theft.

Federal raids Tuesday at six meat-processing plants owned by Swift & Co. in six states resulted in the arrests of 1,282 people for immigration violation - with 65 also charged with identify theft or other criminal charges.

The investigation is continuing, say officials with US Immigration and Customs Enforcement (ICE), with the hope that some of the newly arrested workers will lead law officers to "document rings" that provided the stolen identities. The 10-month operation began in February, when ICE learned that "large numbers" of undocumented immigrants might be using Social Security numbers assigned to US citizens.

"We believe that the genuine identities of possibly hundreds of US citizens are being stolen or hijacked by criminal organizations and sold to illegal aliens in order to gain unlawful employment in this country," said Julie Myers, ICE assistant secretary. She called it "a disturbing front in the war against illegal immigration."

The fraudulent document business has long been a thorn in the side of immigration officials, making it hard for them to crack down on companies for knowingly hiring illegal workers. Indeed, even as ICE agents conducted Tuesday's raids at the Swift plants, a joint task force in Arizona - made up of state, federal, and local law- enforcement officials - was arresting 12 suspects and seized numerous fake drivers' licenses, resident alien cards, Social Security cards, and vehicle titles.

Metropolitan Phoenix, a major immigrant-smuggling hub, has become a place where the false ID business is thriving, law-enforcement officers say. They estimate that 1,000 to 1,500 "coyotes," or smugglers, stash thousands of undocumented immigrants in drop houses throughout the valley, where they wait until false identification and transportation can be arranged to places as far away as Seattle and Miami.

"I would say that 90 percent of the transactions dealing with the sale of human cargo, those smuggled across the [Arizona] border, occur right here," Angel Rascon-Rubio, an ICE special agent, testified at a federal court hearing last year.

The Phoenix area is ideal for smugglers, officials say, because it is fairly easy to reach from Mexico but far enough from the border to avoid border patrol enforcement. It has broad access to the rest of the country via air and car. Moreover, the large Hispanic neighborhoods provide cover for drop houses and new immigrants.

On one of Phoenix's quiet residential streets lined with stucco tract homes live two men who came to the US illegally but gained legal status - along with some 3 million others - under the federal 1986 amnesty program. David and Raul, who will give only first names, are in the business of helping newly arrived illegal immigrants acquire fake documents.

They are not part of an organized crime family, they say - just part of a network of established immigrants who help others attain what they've achieved. They are, in effect, the go-betweens from those who bring the immigrants and those who make the fake ID papers - a service they say they provide for free.

"A coyote will call and say, 'Does your boss need more workers?' or 'Can you help get this person some papers?' " says David, whose main job is as a landscaper. "It's easy. I'll have a number for a [document] guy and call him. We'll meet at the major intersection out here, say, in half an hour. I give him $50 or $100, whatever he's asking, a photo of the person, and a name," he adds. "About 45 minutes later, he'll call me to come meet him on the same corner with the papers - a Social Security card and a green card."

If that won't work, David adds, he drives to the nearest Food City, a chain that specializes in Hispanic goods. There, he says, he just asks around. "There are even guys there who'll hand you business cards - they're in the business of providing fake documents."

Raul, who works in construction, says it's not uncommon to get a call from a coyote in the morning and, by afternoon, have jobs and fake documents for the newly arrived illegals. The two won't tell how many illegal immigrants they help, but say they get called at least weekly.

All of the arrests at the Swift plants Tuesday targeted illegal immigrants who held actual - not fake - Social Security numbers. Many businesses that make use of immigrant labor participate in a national test program for employers called Basic Pilot, an online system to verify employees' Social Security numbers.

But the fake-documents manufacturers are wise to this, say David and Raul. In Arizona, they assign Social Security numbers that begin with 601 - numbers the government apparently assigns people from Arizona. Employers then don't readily recognize a fake document, and, the men say, it takes at least a year for the government to recognize a duplicate number. That means the illegal immigrant can work in the US for up to a year before being sent home.

Arizona Gov. Janet Napolitano set up an Arizona Fraudulent Identification Task Force in July 2005 as part of a crackdown on crime related to illegal immigration. Since then, the task force has focused in part on fraudulent documents. In doing so, it has issued more than 100 search warrants resulting in 178 defendants charged with 1,400 crimes, says Leesa Morrison, director of the Arizona Department of Liquor Licenses and Control.

"Most astounding," adds Ms. Morrison, "is that in this short period our undercover agents have purchased over 1,000 fraudulent immigration documents. What's frightening is that [they] are able to purchase a three-pack - a driver's license, a Social Security card, and a permanent-resident card - for about $160 on the street."

Crossing the ID border

Americans learned last week they can no longer look the other way when someone else hires an illegal worker. A federal raid on six Swift & Co. meatpacking plants in the US nabbed more than 1,250 "undocumented" migrants - and dozens were charged with using the IDs of real people, perhaps even of children.

The usual practice for many of the estimated 12 million illegal migrants living in the US has been to buy fake IDs with made-up numbers and names. But organized rings in at least 10 cities now sell authentic-looking Social Security cards and some 26 other types of IDs with real names.

These IDs make it even more difficult for employers to reject illegal workers - if employers even bother to check. Such forgery has reached an "epidemic," say federal officials, with illegal migrants and their handlers now violating both the privacy rights and economic rights of innocent Americans.

In one case, a man named Jason Smith found he owed $12,000 in back taxes because an illegal immigrant used his Social Security number to work at a chicken plant for three years.

To avoid detection, fake-ID rings often use a child's identity. Usually, only when the children reach 18 would they find out they have a record of bad credit or other financial complication. One Mexico-based ring's reach is so "breathtaking," a federal judge stated in one case, that it hits "at the heart of the sovereignty of the United States."

Most identity theft is done to steal money, not work in someone's name. But with about 1 in 30 Americans now having their financial identities stolen each year, and with illegal migrants making up nearly 1 in 20 workers, a dangerous link has been made between two massive violations of law. Government is cracking down on ID theft, but both states and Congress have only begun to come to grips with illegal migration - despite the threat of terrorists using fake IDs to hide in the US.

A federal system that allows employers to check Social Security IDs is flawed because it cannot detect cases where migrants use legitimate names and numbers. (Swift & Co. uses the system, but only a fraction of companies do.)

Even if this system is improved, ID thieves may find new ways around it. And expanding a guest-worker program for Mexicans may only be compromised by other ways of forging documents; in addition, that program may never be large enough to curb the flow of illegal migration.

Another offered solution - "earned amnesty" - would be difficult if illegals simply buy fake records to claim they've been in the US for years. And amnesty is hardly a reward to give those who knowingly commit the felony of identity theft.

Congress recently boosted border enforcement and raised fines on employers who hire illegals. Both measures are good first steps and need to be pursued effectively for years. Companies need to raise wages high enough to attract legal workers, while law enforcement needs to show a consistent record of cracking down on employers who knowingly hire illegals.

No one's true identity can ever be stolen. But Americans need to know that both their financial and border security are not at risk.


*The fake ID business: some previous busts

April 2005: In Florida, immigration agents arrested 52, including several state Department of Motor Vehicles officials, alleged to be part of a scheme to make and sell fake driver's licenses and hazmat licenses to more than 2,000 illegal immigrants. The same month, other sweeps revealed fraudulent license schemes in Michigan and Maryland.

May 2005: In Mississippi, Cedric Carpenter and Lamont Ranson pleaded guilty to conspiring to sell fake documents to members of Abu Sayyaf, a Philippines-based Islamist terrorist group.

February 2006: A lieutenant in the Mexican-based Castorena family organization, a fraudulent document outfit that controls cells in 33 states, was sentenced in Denver to 11 years in prison. More than 50 members of this international counterfeit operation have been prosecuted in Denver alone. Its leader, Pedro Castorena-Ibarra, was arrested in June by Mexican officers and is awaiting extradition to the US.

March 2006: Agents busted seven counterfeit-document labs in Los Angeles and charged 11 people with supplying fraudulent immigration and identity documents.

June 2006: In Boston, immigration agents arrested nine people accused of running a phony document ring. They seized document-forging tools and six computers at five homes. The sweeps led to the arrests of 13 undocumented Brazilian and Guatemalan nationals.
