U.S. County Lets Illegal Aliens Use Mexican ID

To slash deportations and arrests for traffic offenses or lacking identification, law enforcement agencies in a major U.S. county are accepting Mexican consular cards—determined by the FBI to be unreliable and highly susceptible to fraud—as valid ID.
The move comes just a few days after an Immigration and Customs Enforcement (ICE) union official told Congress that agents have been ordered not to arrest illegal aliens [1]who don’t have criminal convictions, even when they’ve been deported by a judge. Chris Crane, president of a union that represents ICE officers, revealed the mandate while testifying before the House Judiciary Subcommittee on Immigration last week, according to a news report.
The outrageous federal decree is clearly part of President Obama’s stealth amnesty plan that’s already spared thousands of illegal immigrants from removal and will surely allow many more to remain in the U.S. To further the cause, California’s Sonoma County is officially accepting the fraud-prone Mexican card known as matriculár consular ID to shield illegal aliens from federal authorities.
A coalition of influential open borders activists requested the move and authorities in the northern California county with a population of about 470,000 came through this week. They announced the new policy at a rowdy pep rally where the county’s assistant sheriff proclaimed; “today is a great day. We’re now going to accept the matriculár consular ID.” The captain of the Santa Rosa Police Department, which also patrols the area, said his officers are being trained to recognize the foreign cards and to spot “counterfeits.”
Both law enforcement officials claim the cards will reduce the number of unlicensed drivers booked [2] into jail for traffic offenses. This, in turn, will lead to fewer deportations from the jail, according to a local newspaper that covered the festive event, which it described as part victorious political rally, part community party and part tent revival.
The consular cards are controversial because the Mexican Consulate doesn’t bother verifying applicants’ identities before issuing them. That’s why the FBI and Department of Justice [3] have determined that the cards are not a reliable form of identification. Additionally, Mexico does not have a centralized database to coordinate the issuance of the cards, allowing multiple IDs to be issued under the same name and address.
Regardless, a handful of communities across the U.S. accept the cards and several more are considering it. In fact, officials in Dayton Ohio are currently exploring the possibility of allowing police to accept the Mexican ID. Last fall Durham South Carolina passed a law making the card official. When the measure was approved, a local newspaper reported that the cards are so unreliable, they’re rejected [4] by 22 of 32 Mexican states and no bank in Mexico recognizes them.

JW Victory! Court Rules MDPetitions.com Can Intervene to Keep Maryland Dream Act on the Ballot

On Thursday, we hosted a press conference (which you can watch here) in Annapolis, Maryland, to announce a major new development in the battle to stop tuition benefits and perks for illegal aliens: On October 7, 2011, the Maryland court granted JW client MDPetitions.com permission to intervene in a lawsuit that seeks to deny voters an up-or-down vote on the Maryland DREAM Act (John Doe, et al., v. Maryland State Board of Elections).

MDPetitions.com organized a highly successful petition campaign and collected twice as many signatures as is required to put the issue to a vote. Illegal aliens and the activist group Casa de Maryland challenged the petition drive in court in order to protect taxpayer dollar subsidies for the in-state college tuition rate for certain illegal aliens.

Here’s what’s at stake in this lawsuit: Our client wants voters to have the ability to eliminate taxpayer-funded tuition benefits for illegal aliens. Illegal immigration lobbyists want voters to have no direct say on the issue.

The DREAM Act was enacted by the Maryland General Assembly and signed by Governor Martin O’Malley on May 10, 2011. The law creates a new taxpayer-subsidized public benefit — the ability to pay reduced tuition rates at Maryland community colleges and public higher education institutions — for certain eligible illegal aliens. MDPetitions.com’s petition drive was perhaps the most successful in Maryland history.

Obama Backers Tied to Lobbies Raise Millions

WASHINGTON — Despite a pledge not to take money from lobbyists, President Obama has relied on prominent supporters who are active in the lobbying industry to raise millions of dollars for his re-election bid.

At least 15 of Mr. Obama’s “bundlers” — supporters who contribute their own money to his campaign and solicit it from others — are involved in lobbying for Washington consulting shops or private companies. They have raised more than $5 million so far for the campaign.

Because the bundlers are not registered as lobbyists with the Senate, the Obama campaign has managed to avoid running afoul of its self-imposed ban on taking money from lobbyists.

But registered or not, the bundlers are in many ways indistinguishable from people who fit the technical definition of a lobbyist. They glide easily through the corridors of power in Washington, with a number of them hosting Mr. Obama at fund-raisers while also visiting the White House on policy matters and official business.

As both a candidate and as president, Mr. Obama has vowed to curb what he calls the corrupting influence of lobbyists, barring them not only from contributing to his campaign but also from holding jobs in his administration. While lobbyists grouse about the rules, ethics watchdogs credit the changes with raising ethical standards in Washington.

But the prevalence of major Obama fund-raisers who also work in the lobbying arena threatens to undercut the president’s ethics push, raising questions about whether the campaign’s policies square with its on-the-ground practices, some of those same watchdogs say.

“It’s a legitimate concern,” said Craig Holman, a registered lobbyist for Public Citizen, a nonpartisan ethics group in Washington. “The campaign has to draw the line somewhere, but the reality is that the president is still relying on wealthy special interests and embracing those people in his campaign.”

Take Sally Susman. An executive at the drug-maker Pfizer, she has raised more than $500,000 for the president’s re-election and helped organize a $35,800-a-ticket dinner that Mr. Obama attended in Manhattan in June. At the same time, she leads Pfizer’s powerful lobbying shop, and she has visited the White House four times since 2009 — twice on export issues.

But under the byzantine rules that govern federal lobbying, Ms. Susman has not registered with the Senate as a lobbyist.

Nor has David L. Cohen, who oversees lobbying at the Comcast Corporation and is also a member of Mr. Obama’s exclusive $500,000 bundling club.

At a June fund-raiser in the backyard of his Philadelphia home, Mr. Cohen hosted the president and some 120 guests who paid at least $10,000 each to attend; Mr. Obama called Mr. Cohen and his wife “great friends.”

As a matter of policy, Mr. Obama’s re-election campaign goes beyond what campaign law requires by refusing contributions from any “individual registered as a federal lobbyist.” Registered lobbyists are not even allowed inside his fund-raising events, and the campaign routinely returns checks from those trying to contribute.

Republican candidates, in contrast, have placed no restrictions at all on accepting lobbyists’ money. Mitt Romney had a closed-door fund-raiser just this week in Washington at the American Trucking Associations that was expected to include many K Street lobbyists.

The Obama campaign, which raised nearly $43 million last quarter, would not specifically discuss its fund-raisers who work in lobbying. Most of the bundlers themselves also declined to comment, referring questions to the campaign.

Through interviews and public records, The New York Times identified at least 15 major fund-raisers for the Obama campaign who have been involved in different aspects of the lobbying and influence industry, representing a range of corporate interests from telecommunications and high-tech software to Wall Street finance, international commerce and pharmaceuticals.

While none of the bundlers is currently registered as a federal lobbyist, at least four of them have been in the past. And a number of the bundlers work for prominent lobbying and law firms, including Greenberg Traurig and Blank Rome.

Although Mr. Obama has helped make lobbying something of a dirty word in Washington — most firms refer to it by the euphemism of “government affairs” — that has not stopped a number of his fund-raisers from advertising their access to power brokers as they seek out clients.

Alex Heckler, for instance, runs a Florida consulting firm he founded, LSN Partners, which boasts of its ability to “win results for our clients” at the national, state and local levels and to tap into “a strong national network of lobbying firms” through its contacts with “key decision makers.”

Mr. Heckler, a noted Democratic fund-raiser in Florida who raised money for the presidential bids of Hillary Rodham Clinton and Senator John Kerry of Massachusetts, has already brought in at least $200,000 for the Obama campaign, records show. (The campaign uses only broad dollar ranges for the money raised by its bundlers, and it declined to provide more precise data.)

Likewise, Andy Spahn, owner of a government relations company in Los Angeles, tells visitors to his Web site about its “extensive relationships in Washington, D.C.,” and elsewhere in advocating for “high net-worth individuals,” corporations, nonprofit groups and others.

Mr. Spahn, who made his name doing lobbying work for DreamWorks film studio and was appointed by Mr. Obama to a presidential committee on the arts, has raised at least $500,000 for the president’s re-election.

And Michael Kempner, who has also brought in at least $500,000 for the campaign, runs a team of Washington lobbyists at his New Jersey firm, MWW Group, who, according to its promotional material, use their “important relationships with both the Democratic and Republican leadership” to wield influence for their private sector clients.

Seven of the lobbyists he employs are registered in Washington, but Mr. Kempner, the chief executive at the firm, is not.

The Obama campaign declined requests to discuss specific fund-raisers and their ties to lobbying work.

Ben LaBolt, a campaign spokesman, stressed in a statement that “the president has fought to limit the outsized influence that lobbyists have over the policy making process, passing laws that promote reform and disclosure and establishing rules ensuring that industry lobbyists can’t come into the government to oversee the industry for which they used to work.”

He said that while Republican candidates were actively raising money from special interest groups, Mr. Obama “drew a bright line” by rejecting contributions both from political action committees and from “Washington lobbyists whose job it is to influence federal policymakers.”

The disconnect between Mr. Obama’s public stance on lobbyists and his use of fund-raisers who are active in the lobbying industry rests in part on the ambiguity in the law over who must register as a federal lobbyist.

Under the Lobbying Disclosure Act, the complicated rules define lobbying in part as “active” or “direct” contacts meant to influence a public official, but they exclude “routine” contacts meant to simply gather information. The rules also take into account a variety of specific criteria, including how much time is spent advocating for a particular client, how much is paid, and which government officials are contacted.

Mr. Obama has run into political problems before over the question of who should be considered a lobbyist under his ethics restrictions.

Just weeks after the inauguration, in fact, Mr. Obama’s first pick as Health and Human Services secretary — former Senator Tom Daschle of South Dakota — came under attack for acting as a highly paid “strategic adviser” to clients looking to influence government policy but failing to register as a lobbyist. (His nomination was ultimately withdrawn.)

More controversy came last year over the White House’s informal contacts with lobbyists. The administration drew criticism over reports that White House officials were routinely sitting down with registered lobbyists at off-site locales, like a nearby Caribou Coffee shop, for meetings that would not show up on official White House visitor logs.

Some Washington lobbyists suggest that the Obama administration’s tough public stance against lobbyists has served only to discourage those active in the lobbying industry from registering as lobbyists in the Senate.

“What all this rhetoric does is to drive lobbying even further into the shadows,” said a Democratic lobbyist who works frequently with the administration but spoke on the condition of anonymity.

“Obama will not take money from registered lobbyists like me,” the lobbyist said with some bitterness, “but that doesn’t mean that he won’t take money from people who are lobbying. There’s a big difference.”

How Eisenhower solved illegal border crossings from Mexico

WASHINGTON – George W. Bush isn't the first Republican president to face a full-blown immigration crisis on the US-Mexican border.
Fifty-three years ago, when newly elected Dwight Eisenhower moved into the White House, America's southern frontier was as porous as a spaghetti sieve. As many as 3 million illegal migrants had walked and waded northward over a period of several years for jobs in California, Arizona, Texas, and points beyond.
President Eisenhower cut off this illegal traffic. He did it quickly and decisively with only 1,075 United States Border Patrol agents - less than one-tenth of today's force. The operation is still highly praised among veterans of the Border Patrol.
Although there is little to no record of this operation in Ike's official papers, one piece of historic evidence indicates how he felt. In 1951, Ike wrote a letter to Sen. William Fulbright (D) of Arkansas. The senator had just proposed that a special commission be created by Congress to examine unethical conduct by government officials who accepted gifts and favors in exchange for special treatment of private individuals.
General Eisenhower, who was gearing up for his run for the presidency, said "Amen" to Senator Fulbright's proposal. He then quoted a report in The New York Times, highlighting one paragraph that said: "The rise in illegal border-crossing by Mexican 'wetbacks' to a current rate of more than 1,000,000 cases a year has been accompanied by a curious relaxation in ethical standards extending all the way from the farmer-exploiters of this contraband labor to the highest levels of the Federal Government."
Years later, the late Herbert Brownell Jr., Eisenhower's first attorney general, said in an interview with this writer that the president had a sense of urgency about illegal immigration when he took office.
America "was faced with a breakdown in law enforcement on a very large scale," Mr. Brownell said. "When I say large scale, I mean hundreds of thousands were coming in from Mexico [every year] without restraint."
Although an on-and-off guest-worker program for Mexicans was operating at the time, farmers and ranchers in the Southwest had become dependent on an additional low-cost, docile, illegal labor force of up to 3 million, mostly Mexican, laborers.
According to the Handbook of Texas Online, published by the University of Texas at Austin and the Texas State Historical Association, this illegal workforce had a severe impact on the wages of ordinary working Americans. The Handbook Online reports that a study by the President's Commission on Migratory Labor in Texas in 1950 found that cotton growers in the Rio Grande Valley, where most illegal aliens in Texas worked, paid wages that were "approximately half" the farm wages paid elsewhere in the state.
Profits from illegal labor led to the kind of corruption that apparently worried Eisenhower. Joseph White, a retired 21-year veteran of the Border Patrol, says that in the early 1950s, some senior US officials overseeing immigration enforcement "had friends among the ranchers," and agents "did not dare" arrest their illegal workers.
Walt Edwards, who joined the Border Patrol in 1951, tells a similar story. He says: "When we caught illegal aliens on farms and ranches, the farmer or rancher would often call and complain [to officials in El Paso]. And depending on how politically connected they were, there would be political intervention. That is how we got into this mess we are in now."
Bill Chambers, who worked for a combined 33 years for the Border Patrol and the then-called US Immigration and Naturalization Service (INS), says politically powerful people are still fueling the flow of illegals.
During the 1950s, however, this "Good Old Boy" system changed under Eisenhower - if only for about 10 years.
In 1954, Ike appointed retired Gen. Joseph "Jumpin' Joe" Swing, a former West Point classmate and veteran of the 101st Airborne, as the new INS commissioner.
Influential politicians, including Sen. Lyndon B. Johnson (D) of Texas and Sen. Pat McCarran (D) of Nevada, favored open borders, and were dead set against strong border enforcement, Brownell said. But General Swing's close connections to the president shielded him - and the Border Patrol - from meddling by powerful political and corporate interests.
One of Swing's first decisive acts was to transfer certain entrenched immigration officials out of the border area to other regions of the country where their political connections with people such as Senator Johnson would have no effect.
Then on June 17, 1954, what was called "Operation Wetback" began. Because political resistance was lower in California and Arizona, the roundup of aliens began there. Some 750 agents swept northward through agricultural areas with a goal of 1,000 apprehensions a day. By the end of July, over 50,000 aliens were caught in the two states. Another 488,000, fearing arrest, had fled the country.
By mid-July, the crackdown extended northward into Utah, Nevada, and Idaho, and eastward to Texas.
By September, 80,000 had been taken into custody in Texas, and an estimated 500,000 to 700,000 illegals had left the Lone Star State voluntarily.
Unlike today, Mexicans caught in the roundup were not simply released at the border, where they could easily reenter the US. To discourage their return, Swing arranged for buses and trains to take many aliens deep within Mexico before being set free.
Tens of thousands more were put aboard two hired ships, the Emancipation and the Mercurio. The ships ferried the aliens from Port Isabel, Texas, to Vera Cruz, Mexico, more than 500 miles south.
The sea voyage was "a rough trip, and they did not like it," says Don Coppock, who worked his way up from Border Patrolman in 1941 to eventually head the Border Patrol from 1960 to 1973.
Mr. Coppock says he "cannot understand why [President] Bush let [today's] problem get away from him as it has. I guess it was his compassionate conservatism, and trying to please [Mexican President] Vincente Fox."

BORDER PATROL VETS OFFER TIPS ON CURBING ILLEGAL IMMIGRATION
One day in 1954, Border Patrol agent Walt Edwards picked up a newspaper in Big Spring, Texas, and saw some startling news. The government was launching an all-out drive to oust illegal aliens from the United States.
The orders came straight from the top, where the new president, Dwight Eisenhower, had put a former West Point classmate, Gen. Joseph Swing, in charge of immigration enforcement.
General Swing's fast-moving campaign soon secured America's borders - an accomplishment no other president has since equaled. Illegal migration had dropped 95 percent by the late 1950s.
Several retired Border Patrol agents who took part in the 1950s effort, including Mr. Edwards, say much of what Swing did could be repeated today.
"Some say we cannot send 12 million illegals now in the United States back where they came from. Of course we can!" Edwards says.
Donald Coppock, who headed the Patrol from 1960 to 1973, says that if Swing and Ike were still running immigration enforcement, "they'd be on top of this in a minute."
William Chambers, another '50s veteran, agrees. "They could do a pretty good job" sealing the border.
Edwards says: "When we start enforcing the law, these various businesses are, on their own, going to replace their [illegal] workforce with a legal workforce."
While Congress debates building a fence on the border, these veterans say other actions should have higher priority.
1. End the current practice of taking captured Mexican aliens to the border and releasing them. Instead, deport them deep into Mexico, where return to the US would be more costly.
2. Crack down hard on employers who hire illegals. Without jobs, the aliens won't come.
3. End "catch and release" for non-Mexican aliens. It is common for illegal migrants not from Mexico to be set free after their arrest if they promise to appear later before a judge. Few show up.
The Patrol veterans say enforcement could also be aided by a legalized guest- worker program that permits Mexicans to register in their country for temporary jobs in the US. Eisenhower's team ran such a program. It permitted up to 400,000 Mexicans a year to enter the US for various agriculture jobs that lasted for 12 to 52 weeks.

Immigration enforcement officials have started to cancel the deportations of thousands of immigrants they have detained, a policy they said would pare huge case backlogs in the immigration courts.

Immigration and Customs Enforcement officials said the new approach was part of a broad shift in priorities at the agency, to focus its efforts on catching and deporting immigrants who have been convicted of crimes or pose a national security threat. The policy — announced in an Aug. 20 memorandum from John Morton, the head of the agency — drew praise from immigrant advocates, who called it a common-sense strategy, and was denounced by several Republicans as evidence that the Obama administration was weakening enforcement and making it easier for illegal immigrants to remain in the country.

The change in emphasis at the immigration agency, which represents a significant break with longstanding practices, has awakened resistance among agents and detention officers on the ground, according to officials of the agency, which is known as ICE, and of the union representing those employees.

Mr. Morton’s memorandum refers to a particular group of illegal immigrants: those who have been detained in ICE operations because they did not have legal status, but who have active applications in the system to become legal residents. The memo encourages ICE officers and lawyers to use their authority to dismiss those cases, canceling the deportation proceedings, if they determine that the immigrants have no criminal records and stand a strong chance of having their residence applications approved.

The policy is intended to address a “major inefficiency” that has led to an unnecessary pileup of cases in the immigration courts, Mr. Morton said. The courts have reported at least 17,000 cases that could be eliminated from their docket if ICE dismissed deportations of immigrants, like those married to United States citizens, who were very likely to win legal status, the memo says.

To resolve that number of deportation cases, officials will have to fix persistent breakdowns in coordination between two federal agencies that oversee the nation’s overburdened and troubled immigration system, ICE officials acknowledged. On one hand, ICE enforces immigration law. Another agency, Citizenship and Immigration Services, is in charge of approving applications for immigration documents. When ICE opens a deportation case against an immigrant, it is heard in immigration court.

The courts are swamped under a backlog that reached a record in June of 247,922 cases, according to the Transactional Records Access Clearinghouse, a research group at Syracuse University that analyzes federal data. The average waiting time for cases in those courts was 459 days.

But immigration lawyers said they are currently waiting as long as two years to get a hearing date in some especially crowded immigration courts.
The new policy “is a pretty basic, common-sense thing to do,” said Helen Harnett, policy director for the National Immigrant Justice Center, a legal assistance group in Chicago. She said that if an immigrant’s application for legal residence was ultimately denied, ICE could reinstate the deportation.
“This is for people who do have a path to legalize their status,” said Mary Meg McCarthy, director of the justice center. “This does not create a new path to legalization for anyone.”

Mr. Morton’s memorandum was first reported this week in The Houston Chronicle, which found that some immigrants in Texas had already seen their deportations canceled.
ICE officials said they arrived at the policy after conferring with immigration court officials. “This is not a backdoor amnesty,” said Beth Gibson, assistant deputy director of ICE. “It is really about efficient use of docket space and smart use of everybody’s scarce resources.”

Banks Bundled Bad Debt, Bet Against It and Won

In late October 2007, as the financial markets were starting to come unglued, a Goldman Sachs trader, Jonathan M. Egol, received very good news. At 37, he was named a managing director at the firm.
Mr. Egol, a Princeton graduate, had risen to prominence inside the bank by creating mortgage-related securities, named Abacus, that were at first intended to protect Goldman from investment losses if the housing market collapsed. As the market soured, Goldman created even more of these securities, enabling it to pocket huge profits.
Goldman’s own clients who bought them, however, were less fortunate.
Pension funds and insurance companies lost billions of dollars on securities that they believed were solid investments, according to former Goldman employees with direct knowledge of the deals who asked not to be identified because they have confidentiality agreements with the firm.
Goldman was not the only firm that peddled these complex securities — known as synthetic collateralized debt obligations, or C.D.O.’s — and then made financial bets against them, called selling short in Wall Street parlance. Others that created similar securities and then bet they would fail, according to Wall Street traders, include Deutsche Bank and Morgan Stanley, as well as smaller firms like Tricadia Inc., an investment company whose parent firm was overseen by Lewis A. Sachs, who this year became a special counselor to Treasury Secretary Timothy F. Geithner.
How these disastrously performing securities were devised is now the subject of scrutiny by investigators in Congress, at the Securities and Exchange Commission and at the Financial Industry Regulatory Authority, Wall Street’s self-regulatory organization, according to people briefed on the investigations. Those involved with the inquiries declined to comment.
While the investigations are in the early phases, authorities appear to be looking at whether securities laws or rules of fair dealing were violated by firms that created and sold these mortgage-linked debt instruments and then bet against the clients who purchased them, people briefed on the matter say.
One focus of the inquiry is whether the firms creating the securities purposely helped to select especially risky mortgage-linked assets that would be most likely to crater, setting their clients up to lose billions of dollars if the housing market imploded.
Some securities packaged by Goldman and Tricadia ended up being so vulnerable that they soured within months of being created.
Goldman and other Wall Street firms maintain there is nothing improper about synthetic C.D.O.’s, saying that they typically employ many trading techniques to hedge investments and protect against losses. They add that many prudent investors often do the same. Goldman used these securities initially to offset any potential losses stemming from its positive bets on mortgage securities.
But Goldman and other firms eventually used the C.D.O.’s to place unusually large negative bets that were not mainly for hedging purposes, and investors and industry experts say that put the firms at odds with their own clients’ interests.
“The simultaneous selling of securities to customers and shorting them because they believed they were going to default is the most cynical use of credit information that I have ever seen,” said Sylvain R. Raynes, an expert in structured finance at R & R Consulting in New York. “When you buy protection against an event that you have a hand in causing, you are buying fire insurance on someone else’s house and then committing arson.”
Investment banks were not alone in reaping rich rewards by placing trades against synthetic C.D.O.’s. Some hedge funds also benefited, including Paulson & Company, according to former Goldman workers and people at other banks familiar with that firm’s trading.
Michael DuVally, a Goldman Sachs spokesman, declined to make Mr. Egol available for comment. But Mr. DuVally said many of the C.D.O.’s created by Wall Street were made to satisfy client demand for such products, which the clients thought would produce profits because they had an optimistic view of the housing market. In addition, he said that clients knew Goldman might be betting against mortgages linked to the securities, and that the buyers of synthetic mortgage C.D.O.’s were large, sophisticated investors, he said.
The creation and sale of synthetic C.D.O.’s helped make the financial crisis worse than it might otherwise have been, effectively multiplying losses by providing more securities to bet against. Some $8 billion in these securities remain on the books at American International Group, the giant insurer rescued by the government in September 2008.
From 2005 through 2007, at least $108 billion in these securities was issued, according to Dealogic, a financial data firm. And the actual volume was much higher because synthetic C.D.O.’s and other customized trades are unregulated and often not reported to any financial exchange or market.
Goldman Saw It Coming
Before the financial crisis, many investors — large American and European banks, pension funds, insurance companies and even some hedge funds — failed to recognize that overextended borrowers would default on their mortgages, and they kept increasing their investments in mortgage-related securities. As the mortgage market collapsed, they suffered steep losses.
A handful of investors and Wall Street traders, however, anticipated the crisis. In 2006, Wall Street had introduced a new index, called the ABX, that became a way to invest in the direction of mortgage securities. The index allowed traders to bet on or against pools of mortgages with different risk characteristics, just as stock indexes enable traders to bet on whether the overall stock market, or technology stocks or bank stocks, will go up or down.
Goldman, among others on Wall Street, has said since the collapse that it made big money by using the ABX to bet against the housing market. Worried about a housing bubble, top Goldman executives decided in December 2006 to change the firm’s overall stance on the mortgage market, from positive to negative, though it did not disclose that publicly.
Even before then, however, pockets of the investment bank had also started using C.D.O.’s to place bets against mortgage securities, in some cases to hedge the firm’s mortgage investments, as protection against a fall in housing prices and an increase in defaults.
Mr. Egol was a prime mover behind these securities. Beginning in 2004, with housing prices soaring and the mortgage mania in full swing, Mr. Egol began creating the deals known as Abacus. From 2004 to 2008, Goldman issued 25 Abacus deals, according to Bloomberg, with a total value of $10.9 billion.
Abacus allowed investors to bet for or against the mortgage securities that were linked to the deal. The C.D.O.’s didn’t contain actual mortgages. Instead, they consisted of credit-default swaps, a type of insurance that pays out when a borrower defaults. These swaps made it much easier to place large bets on mortgage failures.
Rather than persuading his customers to make negative bets on Abacus, Mr. Egol kept most of these wagers for his firm, said five former Goldman employees who spoke on the condition of anonymity. On occasion, he allowed some hedge funds to take some of the short trades.
Mr. Egol and Fabrice Tourre, a French trader at Goldman, were aggressive from the start in trying to make the assets in Abacus deals look better than they were, according to notes taken by a Wall Street investor during a phone call with Mr. Tourre and another Goldman employee in May 2005.
On the call, the two traders noted that they were trying to persuade analysts at Moody’s Investors Service, a credit rating agency, to assign a higher rating to one part of an Abacus C.D.O. but were having trouble, according to the investor’s notes, which were provided by a colleague who asked for anonymity because he was not authorized to release them. Goldman declined to discuss the selection of the assets in the C.D.O.’s, but a spokesman said investors could have rejected the C.D.O. if they did not like the assets.
Goldman’s bets against the performances of the Abacus C.D.O.’s were not worth much in 2005 and 2006, but they soared in value in 2007 and 2008 when the mortgage market collapsed. The trades gave Mr. Egol a higher profile at the bank, and he was among a group promoted to managing director on Oct. 24, 2007.
“Egol and Fabrice were way ahead of their time,” said one of the former Goldman workers. “They saw the writing on the wall in this market as early as 2005.” By creating the Abacus C.D.O.’s, they helped protect Goldman against losses that others would suffer.
As early as the summer of 2006, Goldman’s sales desk began marketing short bets using the ABX index to hedge funds like Paulson & Company, Magnetar and Soros Fund Management, which invests for the billionaire George Soros. John Paulson, the founder of Paulson & Company, also would later take some of the shorts from the Abacus deals, helping him profit when mortgage bonds collapsed. He declined to comment.
A Deal Gone Bad, for Some
The woeful performance of some C.D.O.’s issued by Goldman made them ideal for betting against. As of September 2007, for example, just five months after Goldman had sold a new Abacus C.D.O., the ratings on 84 percent of the mortgages underlying it had been downgraded, indicating growing concerns about borrowers’ ability to repay the loans, according to research from UBS, the big Swiss bank. Of more than 500 C.D.O.’s analyzed by UBS, only two were worse than the Abacus deal.
Goldman created other mortgage-linked C.D.O.’s that performed poorly, too. One, in October 2006, was a $800 million C.D.O. known as Hudson Mezzanine. It included credit insurance on mortgage and subprime mortgage bonds that were in the ABX index; Hudson buyers would make money if the housing market stayed healthy — but lose money if it collapsed. Goldman kept a significant amount of the financial bets against securities in Hudson, so it would profit if they failed, according to three of the former Goldman employees.
A Goldman salesman involved in Hudson said the deal was one of the earliest in which outside investors raised questions about Goldman’s incentives. “Here we are selling this, but we think the market is going the other way,” he said.
A hedge fund investor in Hudson, who spoke on the condition of anonymity, said that because Goldman was betting against the deal, he wondered whether the bank built Hudson with “bonds they really think are going to get into trouble.”
Indeed, Hudson investors suffered large losses. In March 2008, just 18 months after Goldman created that C.D.O., so many borrowers had defaulted that holders of the security paid out about $310 million to Goldman and others who had bet against it, according to correspondence sent to Hudson investors.
The Goldman salesman said that C.D.O. buyers were not misled because they were advised that Goldman was placing large bets against the securities. “We were very open with all the risks that we thought we sold. When you’re facing a tidal wave of people who want to invest, it’s hard to stop them,” he said. The salesman added that investors could have placed bets against Abacus and similar C.D.O.’s if they had wanted to.
A Goldman spokesman said the firm’s negative bets didn’t keep it from suffering losses on its mortgage assets, taking $1.7 billion in write-downs on them in 2008; but he would not say how much the bank had since earned on its short positions, which former Goldman workers say will be far more lucrative over time. For instance, Goldman profited to the tune of $1.5 billion from one series of mortgage-related trades by Mr. Egol with Wall Street rival Morgan Stanley, which had to book a steep loss, according to people at both firms.
Tetsuya Ishikawa, a salesman on several Abacus and Hudson deals, left Goldman and later published a novel, “How I Caused the Credit Crunch.” In it, he wrote that bankers deserted their clients who had bought mortgage bonds when that market collapsed: “We had moved on to hurting others in our quest for self-preservation.” Mr. Ishikawa, who now works for another financial firm in London, declined to comment on his work at Goldman.
Profits From a Collapse
Just as synthetic C.D.O.’s began growing rapidly, some Wall Street banks pushed for technical modifications governing how they worked in ways that made it possible for C.D.O.’s to expand even faster, and also tilted the playing field in favor of banks and hedge funds that bet against C.D.O.’s, according to investors.
In early 2005, a group of prominent traders met at Deutsche Bank’s office in New York and drew up a new system, called Pay as You Go. This meant the insurance for those betting against mortgages would pay out more quickly. The traders then went to the International Swaps and Derivatives Association, the group that governs trading in derivatives like C.D.O.’s. The new system was presented as a fait accompli, and adopted.
Other changes also increased the likelihood that investors would suffer losses if the mortgage market tanked. Previously, investors took losses only in certain dire “credit events,” as when the mortgages associated with the C.D.O. defaulted or their issuers went bankrupt.
But the new rules meant that C.D.O. holders would have to make payments to short sellers under less onerous outcomes, or “triggers,” like a ratings downgrade on a bond. This meant that anyone who bet against a C.D.O. could collect on the bet more easily.
“In the early deals you see none of these triggers,” said one investor who asked for anonymity to preserve relationships. “These things were built in to provide the dealers with a big payoff when something bad happened.”
Banks also set up ever more complex deals that favored those betting against C.D.O.’s. Morgan Stanley established a series of C.D.O.’s named after United States presidents (Buchanan and Jackson) with an unusual feature: short-sellers could lock in very cheap bets against mortgages, even beyond the life of the mortgage bonds. It was akin to allowing someone paying a low insurance premium for coverage on one automobile to pay the same on another one even if premiums over all had increased because of high accident rates.
At Goldman, Mr. Egol structured some Abacus deals in a way that enabled those betting on a mortgage-market collapse to multiply the value of their bets, to as much as six or seven times the face value of those C.D.O.’s. When the mortgage market tumbled, this meant bigger profits for Goldman and other short sellers — and bigger losses for other investors.
Selling Bad Debt
Other Wall Street firms also created risky mortgage-related securities that they bet against.
At Deutsche Bank, the point man on betting against the mortgage market was Greg Lippmann, a trader. Mr. Lippmann made his pitch to select hedge fund clients, arguing they should short the mortgage market. He sometimes distributed a T-shirt that read “I’m Short Your House!!!” in black and red letters.
Deutsche, which declined to comment, at the same time was selling synthetic C.D.O.’s to its clients, and those deals created more short-selling opportunities for traders like Mr. Lippmann.
Among the most aggressive C.D.O. creators was Tricadia, a management company that was a unit of Mariner Investment Group. Until he became a senior adviser to the Treasury secretary early this year, Lewis Sachs was Mariner’s vice chairman. Mr. Sachs oversaw about 20 portfolios there, including Tricadia, and its documents also show that Mr. Sachs sat atop the firm’s C.D.O. management committee.
From 2003 to 2007, Tricadia issued 14 mortgage-linked C.D.O.’s, which it called TABS. Even when the market was starting to implode, Tricadia continued to create TABS deals in early 2007 to sell to investors. The deal documents referring to conflicts of interest stated that affiliates and clients of Tricadia might place bets against the types of securities in the TABS deal.
Even so, the sales material also boasted that the mortgages linked to C.D.O.’s had historically low default rates, citing a “recently completed” study by Standard & Poor’s ratings agency — though fine print indicated that the date of the study was September 2002, almost five years earlier.
At a financial symposium in New York in September 2006, Michael Barnes, the co-head of Tricadia, described how a hedge fund could put on a negative mortgage bet by shorting assets to C.D.O. investors, according to his presentation, which was reviewed by The New York Times.
Mr. Barnes declined to comment. James E. McKee, general counsel at Tricadia, said, “Tricadia has never shorted assets into the TABS deals, and Tricadia has always acted in the best interests of its clients and investors.”
Mr. Sachs, through a spokesman at the Treasury Department, declined to comment.
Like investors in some of Goldman’s Abacus deals, buyers of some TABS experienced heavy losses. By the end of 2007, UBS research showed that two TABS deals were the eighth- and ninth-worst performing C.D.O.’s. Both had been downgraded on at least 75 percent of their associated assets within a year of being issued.
Tricadia’s hedge fund did far better, earning roughly a 50 percent return in 2007 and similar profits in 2008, in part from the short bets.

A study released Tuesday by the Congressional Budget Office (CBO) reports that the richest 1 percent of US households nearly tripled their income between 1979 and 2007 and doubled their share of the national income.
The report also concludes that the top 20 percent of US households increased its share of national income while every other quintile saw its share decline. The top 20 percent received 53 percent of income in 2007—that is, its income surpassed the income of the other 80 percent of Americans.

This documentation of the staggering growth of inequality in the US by the nonpartisan budget analysis arm of Congress highlights the conditions underlying the anti-Wall Street protests that have spread across the US and internationally. The protests have focused on social inequality and the domination of the corporations and banks over the political system and every aspect of life. The burden of this domination has become unbearable for millions of youth and workers under conditions of mass unemployment and brutal cuts in education, health care and other social necessities.
The CBO analysis, based on Internal Revenue and US Census data, closely tracks previous studies on income inequality in the US by private organizations and academic economists, but represents an official government acknowledgment of the sharp increase in inequality.

The major findings of the report include:
• Average inflation-adjusted after-tax income for the 1 percent of the population with the highest income grew by 275 percent from 1979 to 2007. Their share of national income rose from nearly 8 percent in 1979 to 17 percent in 2007.
• For the rest of the top income quintile, average real after-tax income rose by 65 percent.
• For the three-fifths of people in the middle of the income scale, the growth of after-tax real income was under 40 percent. Their share of national income declined by 2 to 3 percentage points.
• For the poorest fifth of the population, average real after-tax household income rose by only 18 percent between 1979 and 2007. Their share of national income was about 5 percent, down from 7 percent in 1979.
The CBO report attributes the increased concentration of wealth at the top primarily to changes in the private economy, including the growth of the financial sector, the increased share of wealth for the rich from capital gains, and sharply higher CEO and executive pay. However, it acknowledges that federal tax policy over the nearly thirty-year period has favored the wealthy over ordinary working people. “The equalizing effect of federal taxes was smaller” in 2007 than in 1979, as “the composition of federal revenues shifted away from progressive income taxes to less-progressive payroll taxes,” the report states.
The CBO also cites the cutting back on cash payments to lower-income Americans, such as Social Security benefits, Medicare and unemployment insurance.
The study defines household income to include so-called “transfer” payments—income from Social Security, unemployment insurance, workers’ compensation, other federal programs, state and local assistance programs, food stamps, school meals, housing and energy assistance, Medicare and Medicaid. Were these sources not included and income defined more narrowly as wages and benefits, the disparities in income would be considerably larger.
Moreover, the study ends prior to the onset of the financial crisis and recession. The past four years have seen a further widening of the social chasm as the Obama administration, on behalf of the corporate-financial elite, has carried out a right-wing program to place the burden for the crisis on the working class and intensify the assault on wages, benefits and social services.
The massive growth of social inequality over the past three decades has been the result of an unrelenting ruling class offensive against the working class. That assault has been carried out under Democratic as well as Republican administrations.
The offensive was launched in earnest with Reagan’s firing of the PATCO air traffic controllers in 1981. That was the signal for more than a decade of wage-cutting, strike-breaking, union-busting and labor frame-ups, made possible by the complicity of the trade union bureaucracy. It deliberately isolated and betrayed scores of bitter struggles in order to break the militant resistance of the working class.
The unions simultaneously adopted a corporatist policy of labor-management “partnership” to integrate themselves into the structure of corporate management and bind them even more firmly to the capitalist state. The strike weapon was abandoned and the unions transformed into business entities whose essential function is to suppress the class struggle.
This went hand-in-hand with the deindustrialization of the US and a huge growth of financial speculation, tax cuts for business and the wealthy, the deregulation of the corporations and banks, and increasingly onerous cuts in social programs.
All of these processes have been accelerated since the Wall Street crash of 2008 and ensuing bailout of the banks. The opposition of the Obama administration and the entire political establishment to any serious measures to address mass unemployment has produced a further impoverishment of broad social layers.
The spread of social misery in the midst of soaring corporate profits and CEO pay is starkly shown in the growth of poverty in US suburbs. The New York Times on Tuesday reported that the ranks of the poor living in the suburbs of US cities rose by more than half between 2000 and 2010. Two thirds of these new suburban poor dropped below the official poverty line between 2007 and 2010.
The Times article, reporting analyses of US Census data by the Brookings Institution, said the increase in poverty in the suburbs was 53 percent, compared with 26 percent in the cities.
Nationwide, 55 percent of poor people in metropolitan areas now live in the suburbs, up from 49 percent in 2000. The newspaper quoted Elizabeth Kneebone, a senior researcher at the Brookings Institution, as saying, “For the first time, more than half of the metropolitan poor live in suburban areas.”
The Detroit metro area had the highest proportion of poor people living in its suburbs at 59 percent in 2010. Cleveland was second with 57 percent.
Meanwhile, the plundering of the economy by the financial aristocracy continues. USA Today reported Wednesday that directors who sit on the corporate boards of Fortune 500 companies will see their pay increase this year by 10 percent from 2010, rising to a median figure of nearly $234,000. The CEOs and retired executives who fill these boards average about 4.3 hours a week on board work, according to a recent study by the National Association of Corporate Directors.
The CBO report on income inequality underscores the total disconnect between the Obama administration and the entire political system on the one hand and the interests and desires of the vast majority of Americans on the other. The political and media establishment is presently consumed with a debate over how much further taxes for the corporations and the rich should be cut and how much more deeply social programs for workers and poor people should be slashed.
The various right-wing policies being advanced on all sides will dramatically increase the chasm separating the top 1 percent from the broad masses of people. On the tax front, Obama and the Democrats are pushing for a bipartisan tax “reform” that would substantially reduce corporate taxes and tax rates for the wealthy.
The Republicans are calling for even more drastic cuts in taxes for the rich, with the contenders for the 2012 Republican presidential nomination advancing rival plans to eliminate entirely income taxes indexed to wealth and replace them with a “flat” tax that would cap rates at between 9 percent (Herman Cain) and 20 percent (Rick Perry). These plans are designed not only to provide a windfall for the rich, but also to undermine federal entitlement programs such as Medicare, Medicaid and Social Security.
Both parties are simultaneously proposing rival plans to slash social spending. On Tuesday, Senate Democrats called on the congressional “supercommittee” established to come up with a bipartisan proposal to reduce the federal deficit to adopt the Obama administration’s plan for $3 trillion in deficit reduction over the next decade, including $500 billion in Medicare and Medicaid cuts.

Forty six major US cities face two "lost decades" of job growth

One in eight American cities will have no growth in jobs in the two decades between 2001 and 2021, according to the latest employment report by the US Conference of Mayors. The report, released this week, outlines economic growth and employment prospects in 363 major metropolitan areas. It shows that employment conditions unlike anything seen since the Great Depression prevail in cities throughout the country.

According to the report, which was compiled for the US Conference of Mayors by IHS Global Insight, an economics consultancy, 48 major metropolitan areas will not return to their pre-recession peak employment levels until after 2021. Forty six of those cities have had net job losses between 2001 and 2011, meaning they face the prospect of two "lost decades" of job growth. In all, 166 metropolitan areas, or nearly half, lost jobs between 2001 and 2011.
Even these grim projections are based on unduly optimistic assumptions about the pace of economic growth going forward. The authors of the report expect a growth rate of 3.5 percent in the second half of this year, up significantly from the 1.8 percent rate in the first three months of 2011 and considerably higher than most economists forecast.
On the basis of such higher-than-likely economic growth, the report says job growth in 2011 will reach just 1.2 percent. This is "only a bit higher than underlying labor force growth," resulting in a negligible change in unemployment over the whole of 2011. The report adds that "only in the first half of 2014 will employment in the US match its previous peak level from early 2008."
Of the 363 major metropolitan areas, 103 currently have double-digit unemployment rates, while 33 areas have unemployment rates above 12 percent.
According to the report, the metro areas with the highest unemployment levels are those worst affected by the housing collapse and job cuts in manufacturing. The fall in the housing market, particularly in states like California, Florida and Nevada, has left record-high joblessness in its wake. At the same time, the slashing of the industrial workforce in 2008-2009 wiped out hundreds of thousands of jobs in states like Indiana, Michigan and Ohio.
The two cities that have lost the largest portion of their jobs since the start of the economic downturn are both located in Indiana, in the heart of the American "rust belt." The Elkhart-Goshen area, a center of recreation vehicle manufacturing, has lost 38,000 jobs out of an original 133,000 since 2006, a decline of nearly 30 percent.
Kokomo has lost nearly one quarter of its jobs, with the destruction of 11,000 of the 48,000 that existed in 2005. "A lot of it had to do with the downsizing of the auto industry," said Kokomo Mayor Greg Goodnight in a telephone interview. "The toughest point was 2008-2009," he said.
Chrysler operates three transmission plants and one casting plant in Kokomo, employing 4,700 people, said Goodnight. GM and Delphi also have plants in the city, each employing 1,200 people.
"In the 1970s, GM had 10,000 employees in Kokomo and Chrysler peaked at about 7,000 ten to 15 years ago," Goodnight added.

The housing slump, which is a huge factor in the loss of jobs, is only getting worse. Existing home sales fell 3.8 percent in May and were down 15.3 percent from May 2010, according to figures released Tuesday by the National Association of Realtors. Home values have fallen for nine consecutive months, dropping 7.8 percent over the past two quarters.
The Obama administration has done nothing to help homeowners avert foreclosure--one of the key factors in the housing market slump. Its foreclosure assistance scheme, the Home Affordable Modification Program, was doomed to failure because it was entirely voluntary, placing no requirements on banks or mortgage lenders.
The government set aside $46 billion in funds from the 2008 bank bailout for its mortgage modification program, but has spent only about $2 billion as a result of the banks failure to cooperate.
Manufacturing conditions are also deteriorating. The Federal Reserve Bank of New York said last week that its business conditions index fell below zero for the first time in seven months, while the Philadelphia Federal Reserve’s manufacturing index indicated the sharpest manufacturing contraction since July 2009.
The pervasive high unemployment in cities across the country has been reinforced by the austerity measures being implemented by both political parties. In the last two years, the federal, state and local governments have laid off 494,000 workers, with hundreds of thousands more layoffs to come. At the state and local levels, these layoffs have been concentrated in the areas hardest hit by the economic crisis, as falling employment has cut tax revenues most sharply and led to the deepest spending cuts.

As the mainstream media focuses on a study that reveals a sharp decline in the nation’s illegal immigrant population, monthly welfare payments to children of undocumented aliens increased to $52 million in one U.S. county alone.
The hoopla surrounding last week’s news that the annual flow of illegal immigrants into the U.S. dropped by two-thirds in the past decade overlooked an important matter; the cost of educating, incarcerating and medically treating illegal aliens hasn’t decreased along with it, but rather skyrocketed to the tune of tens of billions of dollars annually.

Those figures don’t even include the extra millions that local municipalities dish out on welfare payments to the U.S.-born children of illegal immigrants, commonly known as anchor babies. In Los Angeles County alone that figure increased by nearly $4 million in the last year, sticking taxpayers with a whopping $52 million tab to provide illegal immigrants’ offspring with food stamps and other welfare benefits for just one month.
That means the nation’s most populous county, in the midst of a dire financial crisis, will spend more than $600 million this year to provide families headed by illegal immigrants with welfare benefits. In each of the past two years Los Angeles County taxpayers have spent about half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants. Additionally, the county spends $550 million on public safety and nearly $500 million on healthcare for illegal aliens.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from L.A. County’s Department of Social Services. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare perks that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children.

The National Council of La Raza (NCLR) is not only one of the wealthiest and most politically powerful militant organizations in the country, it is also notoriously racist and subversive. The group's name, "La Raza," means "The Race," by which they are referring to ethnic Mexicans, or more broadly to "hispanics" or "latinos." And it is quite clear from their decades of vitriolic rhetoric — both spoken and written — that the La Raza activists are trying to engender not only race consciousness amongst hispanic U.S. citizens and Mexican migrants, but also racial militancy and animosity toward "Gringo America."
The NCLR grew out of the La Raza Unida (The Race United) Party and the Southwest Council of La Raza in the late 1960s and early 1970s. The key leaders were Marxist-Leninist followers of Fidel Castro and Che Guevarra.
In 1970, the California Senate Fact-Finding Subcommittee on Un-American Activities said this about La Raza Unida: "Its president is Maclovio Barraza. Mr. Barraza has been identified by the Subversive Activities Control Board as a member of the Communist Party, and presides over the Council which recently received a grant of $1,300,000 from the Ford Foundation."

Maclovio Barraza was the NCLR Board of Directors' founding Chairperson, and the NCLR continues to honor this hardcore Marxist by awarding the Moclavio Barraza Award to its top activist each year.
One of the early founders of La Raza was Professor Jose Angel Gutierrez, whose violent, extremist rhetoric has caused NCLR some public relations problems. Back in 1969, Gutierrez said: "We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him." He has continued to promote the same hateful "reconquista" ideology ever since. But that didn't stop NCLR from bestowing on him their "Hero Award" in 1994.
The radical student group MEChA (Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closely allied for several decades, is even more explicitly and militantly, having adopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," which translated means: "For the Race, Everything; Outside the Race, Nothing."
MEChA's founding documents and literature are replete with appeals to "La Raza de Bronce" (The Bronze Race) and condemnation of the "brutal gringo." MEChA, as its name suggests, is also a leading promoter of the radical "reconquista" (reconquest) movement, a plan of to take over the states of California, Arizona, New Mexico, Colorado, and Texas — a region they refer to as "Aztlan" — which they claim was stolen from the "Aztecan" peoples. NCLR provides major financial support to MEChA and many of NCLR's leaders were MEChA leaders in their college days.
NCLR: Agents for the Government of Mexico?
Especially troubling is NCLR's leading role in the Fundacion Solidaridad Mexicano Americana (Foundation for Mexican-American Solidarity, FSMA), an organization founded and funded by the government of Mexico and directed by the Mexican Ministry of Foreign Affairs and Ministry of Public Education. Both of these ministries have been engaged in efforts aimed at demanding full political rights for illegal aliens in the U.S. and indoctrinating America's Hispanic population in radical, racist La Raza ideology.
Top members of La Raza, MALDEF, the National Immigration Forum and other leading immigration activist organizations also serve on the Council of the FSMA. As such, they are acting as agents for a foreign power that is actively seeking to influence our national, state, and local laws and policies, in ways that are inimical to the interests of our nation and our citizens. NCLR and these other participating groups should be investigated by Congress to determine if they are breaking any laws, especially since these organizations and/or their affiliates not only enjoy tax-exempt status, but even receive millions of dollars from federal and state government agencies.
