Supreme Court to Consider Arizona's Get-Tough Illegal Immigration Law

Against the expressed wishes of Obama White House lawyers, the United States Supreme Court has agreed to resolve the Obama Department of Justice's lawsuit against the State of Arizona over its get-tough illegal immigration law (SB 1070). The decision comes just weeks after the High Court announced it would take on a lawsuit over the constitutionality of Obamacare, setting the stage for two extremely contentious legal battles in the middle of a heated presidential election year.

According to Bloomberg:
The U.S. Supreme Court said it will consider reviving the trailblazing Arizona law that would use local police and prosecutors to crack down on illegal immigration.

Already set to rule on President Barack Obama's health-care law by the middle of next year, the justices today added another high-profile case that has implications for similar laws around the country and for the 2012 elections.
(On April 11, the U.S. Court of Appeals for the Ninth Circuit upheld an injunction against the enforcement of some of the law's provisions, prompting the State of Arizona to petition the U.S. Supreme Court to hear the case.)

Back in September, Judicial Watch filed an amicus curiae (friend of the court) brief with the U.S. Supreme Court on behalf of our client, the Arizona State Legislature, which is now a defendant in the lawsuit in support of the Supreme Court petition. And as I said in a press statement at the time, "We hope the Supreme Court accepts the State of Arizona's petition, protects the rule of law and upholds the rights of the States to protect its citizens."

Well, we're one step closer.

The State of Arizona will now have the opportunity to demonstrate that SB 1070 is completely consistent with federal law. As the Legislature argued in its court filing:



The Legislature invoked its well established police powers in crafting SB 1070, for the purpose of protecting the people of Arizona. Rather than welcoming the Legislature's enactment, the United States sued Arizona.

Contrary to the view of the United States, not every state action related to aliens is preempted by federal law…Only the determination of who should or should not be admitted into the country, and the conditions under which that person may remain, is the regulation of immigration.

Accordingly, the Legislature enacted SB 1070 in reliance on the principle that it had authority to utilize well-established police powers in areas touching on immigration…

I expect the Supreme Court Justices who hear this case will ignore the political scheming and conniving by the Obama administration and will instead look purely at what the law dictates. And if they do, they will see that SB 1070 is a commonsense and constitutional response to the significant problems Arizona faces as a border state on an uncontrolled border.

As former Arizona State Senate President Russell Pearce, the author of SB 1070, has stated:
States have an inherent duty under law and the Constitution to protect their citizens from those who break our laws. I pray the Supreme Court honors states' inherent authority and right under the police powers and supports Arizona in the protection of our state from the Obama administration, who has sided with foreign governments against our state and our citizens. The Obama administration's attack on our state's sovereign right to defend itself from the illegal alien invasion is unconscionable.
Former Senator Pearce also noted that the enacted provisions of SB 1070 have already helped reduce crime significantly and have led to a mass exodus of illegal aliens from the State of Arizona. So not only is SB 1070 lawful, it's also effective. Let's hope the Supreme Court overturns the lower court's moratorium and SB 1070 (along with similar state laws also under attack) can be put into full force!

Obama's 'Hispanicazation' of America

Casting a shadow on economic recovery efforts in the United States is the cost of illegal immigration that consumes U.S. taxpayer dollars for education, healthcare, social welfare benefits, and criminal justice. Illegal aliens (or more politically correct, “undocumented immigrants”) with ties to Mexican drug cartels are contributing to death and destruction on U.S. lands along the southern border.

While the declining job market in the United States may be discouraging some would-be border crossers, a flow of illegal aliens continues unabated, with many entering the United States as drug-smuggling “mules.”

Increasingly vicious foot soldiers of the Mexican drug cartels are taking control of U.S. lands along the border, especially since U.S. Border Patrol units have been reassigned, some to offices 60 to 80 miles inland.

The U.S. Department of the Interior, Bureau of Land Management (BLM) early last year posted signs warning citizens to avoid Interstate 8 between Casa Grande and Gila Bend, Ariz., because of criminal activity in the area, an area that includes protected natural areas precious to the nation.

In reaction to public outrage over the signs, the BLM removed the offensive wording in October 2010, replacing it with the following: Visitor Information Update—Active Federal Law Enforcement Patrol Area.

As the liberal news media, far-left Democrats, and labor unions push for the “Hispanicazation” of U.S. culture, U.S. Department of Homeland Security Secretary Janet Napolitano says the U.S. border has never been more secure.

Perhaps she is basing this on the reduced number of apprehensions, which result, of course, from reassigning Border Patrol agents inland.

In a recent New York Times article, Nicholas Kristof criticized U.S. citizens for not speaking a foreign language and suggested that “Every child in the United States should learn Spanish.” He concluded that as the United States increasingly integrates economically with Latin America, Spanish will be crucial for the United States.

For decades, the liberal left has argued that Latin America is essential for U.S. business and trade. Kristof states that Latin America “is finally getting its act together” but fails to mention the Obama administration’s $2 billion loan of U.S. taxpayer money in 2009 to Brazil’s Petrobras oil company for deep off-shore oil drilling. Obama confidant George Soros, through the Soros Fund Management LLC, until recently owned millions of dollars of Petrobras stock.

Kristof suggests that one day Spanish-speaking Americans will be part of daily life in the United States and that workmen such as mechanics will be able to communicate easily with Spanish-speaking customers.

He fails to explain why these customers will not be speaking English. After all, the ability to speak, read, and write English remains a requirement for U.S. citizenship.

President Barack Obama gives lip service to increasing border control resources with limited funding and personnel. Many officials, including the governors of Texas and Arizona, are skeptical regarding the Obama administration’s resolve. They resent that the United States is being blamed for the killing fields on both sides of the Mexico-U.S. Border.

For instance, U.S. Secretary of State Hillary Clinton in March 2009, during her first official visit to Mexico, placed the blame for the Mexican drug cartels’ vicious murders on the United States.

In Mexico City, she announced that the U.S. appetite for illegal drugs and the easy acquisition of guns from the United States by Mexicans are the root causes of the Mexican crime wave. “Blame America” has become the global agenda of the Democratic Party.

The Obama administration’s plan to resolve the immigration chaos is to offer amnesty to all comers. President Obama re-affirms his support of a “pathway to citizenship” (amnesty) for illegal aliens in 2011.

The administration, however, has announced no plans to control the influx of future waves of illegal aliens or their skyrocketing costs to the nation. The administration, which condones U.S. sanctuary cities and states, has no plans to file charges against them for violations of federal immigration law. Nor does the administration seem concerned about the environmental impact that illegal aliens have on the ecology of the United States.

Many national forests, parks, monuments, wilderness areas, and wildlife refuges — once the pride of the nation — are serving today as marijuana fields for illegal alien gangs.

Former Democratic Speaker of the House Nancy Pelosi reportedly said to a gathering of illegal aliens in California in 2009 that U.S. immigration laws were “un-American,” suggesting that they need not be obeyed. Concerned citizens can only trust that the new speaker of the House, John Boehner, as part of congressional oversight of federal agencies, will demand enforcement of existing immigration laws.

When will President Obama recognize that illegal immigration is slowing economic recovery? Can he resolve the chaos while still appeasing his Hispanic base?

To maintain his populist aura, the president is in the habit of saying one thing to one audience and the opposite to another.

One Obama apologist explained, “Campaign rhetoric is one thing,” suggesting that governing is another. The deliberate Hispanicazation of the United States to secure a block of votes is quite another.

US, Mexico seize more than $80 million during Operation Holiday Hoax
International enforcement effort targets sale, importation of counterfeit and pirated goods


WASHINGTON – U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI) announced the seizure of more than 327,000 counterfeit items with a manufacturer's suggested retail price worth an estimated $76.8 million as part of an ICE HSI-led National Intellectual Property Rights Coordination Center (IPR Center) operation. The center continues to track down those who are selling counterfeit and pirated products this holiday season.
During the six-week operation, coined Operation Holiday Hoax II, the IPR Center and its partners, including U.S. Customs and Border Protection (CBP), the U.S. Postal Inspection Service, the Consumer Product Safety Commission, and the Government of Mexico, along with state and local law enforcement worked with trademark holders to target stores, flea markets and swap meets involved in the importation, distribution and selling of counterfeit and pirated products in 66 cities across the United States; in Seoul, South Korea; and in 55 Mexican cities. Additionally, CBP officers conducted inspections and seized counterfeit merchandise at various U.S. ports of entry, which led to subsequent investigations and enforcement actions by ICE HSI special agents. In each U.S. operation, the trademark holders verified the seized products were counterfeit or pirated.
"Counterfeiting remains a significant problem that demands strong enforcement efforts both here and abroad," said ICE Director John Morton. "This year's success during Operation Holiday Hoax was as a result of the close partnership with the governments of Mexico and South Korea, and I'd like to thank them for their continued assistance in this fight. Together, we've dealt a significant blow to counterfeiters worldwide while making a positive impact on American jobs here at home."
"These actions prevent illegal merchandise from reaching the retail market in Mexico, hence protecting legally established businesses from the underground economy and illegal commerce," said Tax Administration Service of Mexico (SAT) Director Alfredo Gutierrez. "SAT will continue to support joint strategies to leverage our detection capabilities of international criminal networks."
"U.S. Customs and Border Protection facilitates about $2 trillion in legitimate trade annually while enforcing U.S. trade laws that protect the economy, and the health and the safety of the American people," said CBP Commissioner Alan D. Bersin. "This important work is accomplished through close partnerships with the trade community, other government agencies and foreign governments."
Between Nov. 1 and Dec. 16, ICE HSI special agents and law enforcement officers seized counterfeit products in the United States, including toys, cell phones and chargers, handbags, DVDs, perfume, integrated circuits, wallets, computer software, and sports jerseys. Thirty-three people were arrested and charged with trafficking in counterfeit goods.
As part of this operation, SAT – assisted by the local and federal police forces and the Office of the Attorney General – carried out its operations between Nov. 1 and Dec. 9, conducting 845 inspections at main ports of entry, executing 160 search warrants in Mexico, and seizing 23.8 million pieces of counterfeit items, including cigarettes, tools, DVDs, toys, electronics, cell phone accessories and 10 tons of clothing that were illegally introduced into Mexico. The estimated value of these seized items is $7.1 million in U.S. currency, which is the equivalent to 96.7 million pesos. No arrests were made in connection with Mexico's portion of the operation.
This is the second iteration of Operation Holiday Hoax. The first netted more than $26 million worth of counterfeit goods when it was conducted in December 2009.

Citing these statistics, Smith has introduced legislation that would allow Homeland Security’s ICE to keep criminal illegal aliens in custody longer than the current six-month period established by the U.S. Supreme Court.

The result, Smith said, [3] are thousands of criminal illegal immigrants being released in the United States.

“In 2006, the Department of Homeland Security Inspector General reported [4]that thousands of criminal immigrants with final orders of removal were being released into our streets because some countries frustrate the removal process,” Smith stated in his prepared remarks at the hearing.

Smith said the IG found that nearly 134,000 immigrants with final orders of removal instead had been released into U.S. communities from 2001 to 2004. The IG report also found that these illegal immigrants were unlikely to ever be repatriated because of the unwillingness of their home country to provide necessary travel documents.

“As of June 2004, more than 133,662 illegal aliens with or pending final orders of removal had been apprehended and released into the U.S. and who are unlikely to ever be repatriated if ordered removed because of the unwillingness of their country of origin to provide the documents necessary for repatriation,” the report states.

The 2006 report also says:  “Currently, (Detention and Removal Operations) is unable to ensure the departure from the U.S. of all removable aliens. Of the 774,112 illegal aliens apprehended during the past three years, 280,987 (36%) were released largely due to a lack of personnel, bed space, and funding needed to detain illegal aliens while their immigration status is being adjudicated. This presents significant risks due to the inability of Customs and Border Patrol (CBP) and ICE to verify the identity, country-of-origin, and terrorist or criminal affiliation of many of the aliens being released.”

Although the 2006 IG report detailed the release of both criminal and non-criminal illegal immigrants, it did not break down those numbers. At the hearing, Smith distributed a spreadsheet on more recently released aliens that ICE had provided to his office.

This spreadsheet lists the number of “non-criminal” and “convicted criminal” illegal immigrants released by ICE in fiscals years 2009, 2010, and year-to-date 2011 under the rules of the Zadvydas v. Davis [5] Supreme Court decision.

The ICE statistics show that the agency released 3,847 convicted criminal aliens in 2009; 3,882 in 2010; and 1,012 so far in 2011.

The data also show the citizenship country of the convicted criminal and non-criminal illegal immigrant. For example, in FY2009, 74 convicted criminal illegal immigrants from Somalia were released in the United States. Somalia is one of the 10 countries the U.S. government has designated “countries of interest” because of believed ties to terrorism.

Another 79 convicted criminal illegal immigrants from Somalia were released in 2010, according to the data.

According to the ICE spreadsheet, 36 convicted criminal illegal immigrants from the Sudan were released. Sudan is one of four countries the U.S. State Department considers a state sponsor of terror.

Smith cited cases in which a released immigrant shot a New York trooper, and another in which a released immigrant shot and killed Ft. Meyer police officer Andrew Widman, who left behind a wife and three children.

Gary Mead, executive associate director of enforcement and removal operations at ICE, told a House Judiciary subcommittee in testimony that illegal immigrants have been released who had committed crimes, “including, but not limited to, arson, assault, property damage, extortion, forgery or fraud, homicide, kidnapping, weapons offenses, embezzlement, controlled substance offenses, and sexual offenses.”

But, Mead said, part of ICE’s mission is “assuring that aliens released on orders of supervision comply with the conditions of their release.”

Mead also said that procedures are in place that allow for a longer detention by order of an immigration judge, if the individual is deemed “especially dangerous” based on a “mental condition or personality disorder and behavior associated with the disorder” to “ensure the safety of the public.”

Rep. Zoe Lofgren (D-Calif.), a member of the subcommittee, spoke out against Smith's bill.

“The Supreme Court has twice warned of the serious constitutional concerns that would be presented if our immigration laws authorized the indefinite and possibly permanent detention of civil immigrant detainees,” Lofgren said at the hearing. “In Zadvydas v. Davis [the first Supreme Court case that did not include consideration for illegal immigrants], the court said that ‘freedom from imprisonment--from government custody, detention or other forms of physical restraint--lies at the heart of the liberty that [the due process] clause protects.’”

Ahilan T. Arulanantham, deputy legal director with the American Civil Liberties Union of Southern California, said Smith’s bill would cause the incarceration of immigrants who would otherwise help the economy.

“Creating a vast new federal detention authority, as the legislation under consideration is guaranteed to do, would result in the unnecessary detention of thousands more individuals who would otherwise contribute to the economy, serve their communities and support their families, which often include U.S. citizen children and spouses,” Arulanantham said in a statement.

“This legislation is desperately needed,” Smith said. “There is no excuse for needlessly placing American lives at risk.”

DHS Secretary Janet Napolitano has stated [7] numerous times over the course of her tenure that removing criminal aliens was a priority of the Obama administration, including in November 2009 when she introduced the Secure Communities initiative.

“Secure Communities provides our local partners with an effective tool to identify and remove dangerous criminal aliens who pose a threat to public safety,” Napolitano said. “We will continue to expand these partnerships to provide a force multiplier for ICE's immigration enforcement efforts across the country.

Chief Who Supports Sanctuary Policies Gets Top ICE Job

In a laughable move, the Obama Administration has appointed a police chief who supports illegal alien sanctuary policies to oversee an immigration enforcement program that requires a partnership between federal and local authorities.

The new director for the U.S. Immigration and Customs Enforcement’s Office of State and Local Coordination is Harold Hurtt, an outspoken critic of immigration enforcement on the local level. As police chief in two different cities with huge illegal alien populations—Phoenix and Houston—Hurtt enforced don’t-ask-don’t-tell immigration measures that prevented officers from inquiring about a suspects’ legal status in the U.S.

In his new post, Hurtt will get $180,000 a year to supervise outreach and communication between federal immigration officials and local law enforcement agencies. In essence, he is charged with strengthening the collaboration between local police and federal immigration officials in an effort to combat a crisis that has rocked practically every major U.S. city and many small municipalities.

Homeland Security officials are promoting Hurtt as “a respected member of the law enforcement community” who will be an “invaluable asset to ICE’s outreach and coordination efforts.” The reality is that he opposes immigration enforcement and as police chief protected the most violent of criminals. Hurtt has even testified before Congress that local police should not assist with immigration enforcement.

His pro-immigration policies enabled illegal immigrants with extensive criminal histories to murder two police officers and seriously injure another while he was chief in Phoenix and later in Houston. Judicial Watch filed a lawsuit against Hurtt on behalf of the deceased Houston officer’s wife for implementing the sanctuary policies that led to her husband’s death.

In the 2007 incident, Officer Rodney Johnson was brutally shot by a previously deported illegal immigrant during a traffic stop. The illegal alien, Juan Quintero, had an extensive criminal record and had been deported three years earlier for molesting a child. The Mexican national had also been in trouble for driving while intoxicated, driving with a suspended license and for failing to stop and provide information after an automobile accident. When Johnson arrested him, Quintero shot him four times in the back of the head with a 9 millimeter handgun concealed in the waistband of his pants.

Washington (CNSNews.com) – An illegal alien apprehended by the U.S. Customs and Border Protection agency during the last fiscal year had an estimated 84 percent chance of never being prosecuted, according to figures compiled by the office of Rep. John Culberson (R-Texas).

Culberson submitted the figures for the record during a hearing Wednesday of the House Appropriations subcommittee on homeland security.



Of 447,731 illegal aliens apprehended by the U.S. Border Patrol during fiscal year 2010 (which ended last September), only 73,263 (16.4 percent) were prosecuted, according to the submitted data. That means that 374,468 illegal aliens that were taken into custody (83.6 percent) were never prosecuted

HOW MANY ILLEGAL CRIMINALS ARE ON THE PROWL?

There are currently over 400,000 unaccounted for illegal alien criminals with outstanding deportation orders. Those are just the ones apprehended. At least one fourth of these are hard core criminals. Nobody knows how many more there are, but they are numerous and roaming your neighborhoods, preying on you and your family. Many of these heinous crimes are against children. How many children are being molested, raped, and murdered by illegal aliens? Nobody knows for sure but the numbers are staggering. To give you some idea of the prevalence of the crime, peruse the ICE Public Information News Releases.

While there are numerous reports of individual sexual predators such as Mexican Sex Offender and Six-Time Deportee in ICE Custody or Man Deported Following Conviction For Molesting 6-year-old, you will see many reports of multiple child predators being caught and deported. In case you are interested, that is 250 illegal alien child molesters. And that is just the tip of the iceberg.

When we talk about the costs to secure our borders, we need to ask "How many crimes against children is acceptable collateral damage?" Isn't that what it is all about? Cheap lettuce versus molested, raped and murdered children - a cost/benefit tradeoff.

Occasionally, the Federal Government decides to actually do something about some of the more violent illegal alien criminals - after they are already here and have committed mayhem! Operation Predator evolved out of ICE's mission to find and deport illegal aliens with the more heinous criminal records. The majority of the arrests under Operation Predator - roughly 85% - involved foreign nationals in this country whose child sex crimes made them removable from the United States. By matching immigration databases with state Megan's law directories, ICE agents have arrested more than 1,800 registered sex offenders.

Digressing for a moment, what the hell was a convicted, illegal alien sex offender even doing out of jail or not immediately deported – even if 63% do come right back - let alone roaming around the neighborhoods while on a registry! Has the judicial system in this country gone insane?

In any case, Operation Predator began on July 9, 2003, and resulted in 6,085 child predator arrests throughout the country - an average of roughly 250 arrests per month and eight arrests per day. While arrests have been made in every state, the most have occurred in these states: Arizona (207), California (1,578), Florida (255), Illinois (282), Michigan (153), Minnesota (190), New Jersey (423), New York (367), Oregon (148) and Texas (545).

While Operation Predator was a noble effort and ICE is to be commended, it only made a small dent in the criminal activity and number of horrific crimes being committed by illegal alien child sexual predators.

It is worth noting that some pedophile statistics report that each pedophile molests average of 148 children. If so, that could be as many as 900,580 victims from just the 6,085 illegal alien predators that were caught. Regardless, how many children being molested is acceptable collateral damage?

While it is a fact that most illegal aliens are law abiding, except for breaking immigration laws, it is also a fact that a significant percentage of illegal aliens have no respect for the rule of law and our legal customs. Many come with anti-American attitudes and philosophies that are totally alien to our culture, a subject addressed later in this paper. The end result is an ever-growing lawlessness among large portions of the illegal alien communities. It only makes sense that illegal alien criminals come to the United States - this is where the money is and our jails are a whole lot nicer than what they have in their home countries.

As previously noted, this report does not go into the property crimes being committed by illegal aliens. However, like the activities of other equal opportunity criminals, many property crimes are drug related, an activity that many illegal aliens, especially illegal alien gangs, are involved in. While violent crimes against one's person are the most serious, if your identity or car is stolen by an illegal alien you won't be too happy about it.

As a small example of property crimes, in 2003, according to the Arizona Department of Motor Vehicles, 57,600 cars were stolen in Phoenix alone. The owner losses are estimated to exceed $864 million. Most of the stolen cars ended up in Mexico and were never recovered. How many of those cars were stolen by illegal alien criminals versus resident criminals is unknown but you can rest assured that illegal aliens had a large part of it..

Twice Convicted Illegal Alien Had Fed Work Permit

The drunken illegal immigrant who killed a nun in Virginia last month was not only released by federal authorities after previous arrests, he was issued a special Homeland Security work permit after two criminal convictions.

Just when you thought that government negligence had plateaued in the tragic incident, several news reports reveal that it gets worst. It turns out that the illegal alien from Bolivia (Carlos Montano) somehow obtained a special federal work permit—issued by the Department of Homeland Security—while he was awaiting deportation for previous offenses.

Montano already had two drunken driving convictions yet federal authorities released him on his own recognizance while he awaited a removal hearing. In the interim the illegal alien, intoxicated and with an expired license, swerved over a median in Prince William County and slammed into a vehicle carrying three Catholic nuns. One died and two were critically injured.

Montano’s federal employment authorization card, known as an I-766 permit, was discovered only because Virginia authorities revealed that he used it to obtain a state identification card. Because of the Montano case, Virginia no longer accepts the federal card as proof of legal presence for those seeking state IDs or licenses from the Department of Motor Vehicles.

Incredibly, the government regularly issues work permits to illegal immigrants who are scheduled to be deported for criminal conduct. In a letter to the Department of Homeland Security, Prince William County’s police chief diplomatically requests that the “glaring gap in DHS policy” be “reconsidered” and “corrected.”

2. 68% of all housed inmates in California prison's are illegal latinos costing the state approximately 14 billion per year to keep locked up.

3 47 % of all child molestation cases last year were from illegal aliens. The most common method of killing was bludgeoning, followed by stabbing. Caucasians were more likely to become victims of sexual homicide committed by illegal immigrants. Hispanics were second, and African Americans were third."

5. Schurman-Kauflin states that the illegal alien population includes 240,000 sex offenders – a "conservative estimate," she says. She goes on to say, "This translates to 93 sex offenders and 12 serial sexual offenders coming across U.S. borders illegally per day." She points out the 1,500 offenders in her study had a total of 5,999 victims, an average of four victims for each sex offender and says, "This places the estimate for victimization numbers around 960,000 for the 88 months examined in this study."

6. The Schurman-Kauflin study noted that "Nearly 63% of the offenders had been deported on another offense prior to the sex crime." Note the word "deported," something that often comes up when we are talking about the crimes committed by illegal aliens. That means they were once removed from the country but came back in again to commit the crime! In this case, lack of any serious border security allowed the additional crime to happen – an additional 82,473 sex crimes – per year!

7. "Illegal immigrants who commit sex crimes first cross the U.S. border illegally. Then they gradually commit worse crimes and are continually released back into society or deported. Those who were deported simply returned illegally again. Only 2% of the offenders in this study has no history of criminal behavior, beyond crossing the border illegally. There is a clear pattern of criminal escalation. From misdemeanors such as assault or DUI, to drug offenses, illegal immigrants who commit sex crimes break U.S. laws repeatedly. They are highly mobile, work in low skilled jobs with their hands, use drugs and alcohol, are generally promiscuous, have little family stability, and choose victims who are easy to attack. Their attacks are particularly brutal, and they use a hands-on method of controlling and/or killing their victims."

9, "Recently an outbreak of hepatitis traced to Chi-Chi's Mexican restaurant, in Pennsylvania was inexplicably traced to contaminated green onions, not the most obvious cause, undocumented food workers who harbored Hepatitis. For the most part, Hepatitis is a blood-borne, not a food-borne disease. The Hepatitis outbreak infected over 650 individuals, caused 9,000 Americans to undergo immune globulin shots, and killed 4 people.
If Americans found out restaurants can commonly infect their customers from food workers, it would be a serious blow to the restaurant industry. Better blame the green onions. Let's concede the onions, grown in Mexico, were contaminated from fecal material containing Hepatitis. Did all the green onions imported from Mexico end up in one single restaurant? There were no other outbreaks of Hepatitis anywhere elsewhere from green onions. There were 13 mexican restaurant workers who had Hepatitis. They were the likely source of the transmitted infection.

All these diseases and pathogens, and a plethora of others that are not endemic to the US, are being brought in by unscreened illegal aliens who then spread them to an unsuspecting population. These diseases will give you something to think about the next time you are eating at a restaurant with the grunt work being done by illegal aliens who didn't have medical screening before preparing and handling your food.

10. However, the direct cost of educating the children of illegal aliens is somewhere between $29 and $35 BILLION dollars a year. You can add in another billion or two for the costs of supplemental feeding programs and other welfare benefits administered through the schools but which are off the "education costs" in the school budgets.

Most illegal aliens are working in lower paying jobs are often sharing houses and apartments with other families. Most pay little or no state or federal income taxes and, because they have low incomes and frugal lifestyles, they pay little sales taxes as well. The local and state taxes illegal aliens pay, comes no where near paying for the education costs of their children. The difference is picked up by the tax paying public. Since many localities fund public schools through real estate taxes, this often means escalating taxes which put an enormous burden on elderly home owners living on fixed incomes.

An article in the San Francisco Chronicle stated that Mexicans living in the U.S. send between $6 and $8 billion back to their families every year, making them the third-biggest legitimate force in the Mexican economy, after oil and tourism. Additionally, US taxpayers pay for all the direct and indirect costs of "housing" the Mexican illegal aliens. In essence, it's an unofficial form of foreign aide. Mexico isn't about to control its borders, since Mexicans fleeing their country for work in the U.S. send plenty of money back to their own country.

While the $6-8 billion number is often quoted, a fairly recent story in The Brownsville Herald, Banks seek stake in billions sent home, notes that some estimates place the amount of dollars going south in 2006 will be $45 Billion, which was up from an estimated $30 Billion in 2004.

Regardless of the amount, all that money is leaving the US economy and not creating additional job opportunities here. Additionally, all that money represents jobs Americans used to have.

13. "All the research suggests that the reason illegal aliens create large fiscal [deficits] for the country is not their legal status, but rather their educational attainment. Sixty percent of illegals are thought not to have even a high school education, another twenty percent, a high school education only. All the research suggests that people with relatively little education make relatively little money in the modern American economy ...[As] a consequence, they tend to pay relatively little in taxes, even if they are legal and on the books.
At the same time, [these individuals] tend to use a fair amount in public services, reflecting their lower incomes. I estimate illegals pay about $16 billion a year to the Federal Government in taxes ... the difference between what they pay in taxes and use in services is about $10 billion. So right now the net drain on the Federal Government alone from illegal families is about $10 billion. If we began to legalize [these individuals] and they began to pay taxes and use services like legal immigrants with the same level of education, the net fiscal drain would roughly triple to nearly $30 billion."

14. The United States currently has one of the lowest rates of TB in the world. Mexico has 10 times the rate and killing over 400,000 in mexico each year.

15. Chagas Disease (American Trypanosomiasis), endemic to South and Central America, is spread by infected triatomine bugs, known as the "kissing bugs," that bite people. It was unknown in the United States until fairly recently. It is now estimated that between 100,000 and 500,000 people in the US have Chagas Disease. Who is infected? Mostly illegal aliens.

Since Chagas Disease is basically unknown outside of the illegal alien community most doctors won't recognize it and the blood supply just started being screened for it. Most cases of Chagas Disease that occur in patients other than illegal aliens are thought to be contracted from tainted blood – blood sold by illegal aliens with Chagas Disease before the blood supply started being tested for it as of August of 2006.

16. HIV The number of illegal Mexican and Central American immigrants with HIV or AIDS is unknown, mostly because researchers rarely ask about immigration status. However, it is known that the rate of HIV infection among Latino women in California is about twice the rate of white women. At one free California health clinic, all of the women that had HIV or AIDS were Mexican or Central American "immigrants."

17. To make matters worse, in excess of 7,000 new cases of leprosy have been diagnosed in the U.S. in the past three years. As the “Silent Invasion” report concludes, “illegal alien immigrants from Brazil and up through Mexico have fueled the resurgence into the United States.”

18. Malaria was eradicated from the USA in the 1940s but recently there were outbreaks in southern California, New Jersey, New York City, and Houston. Additionally, Malaria tainted blood has been discovered in the blood supply donated by latinos.

19. In 2006 , 21,807 of the 39,537 people, 54.3%, arrested on DUI charges in california. were Hispanic.

20. How many hit and run accidents are there and what is the participation of illegal aliens? As reported by Deadly Roads, as of December 29, there were 1,544 killed and 105,078 injured in hit and run accidents in 2006 in the state of california.

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.
