DOJ: Google Destroyed Chats It Was Required to Save During Antitrust Investigation

The DOJ says Google destroyed chat messages it was required to save during an antitrust investigation. According to a filing, “Amazingly, Google’s daily spoliation continued until this week. When the United States indicated that it would file this motion — following months of conferral — Google finally committed to ‘permanently set to history on’ and thus preserve its employees’ chat messages.”

Google “systematically destroyed an entire category of written communications every 24 hours,” in violation of federal rules seeking to keep chats potentially relevant to litigation, the DOJ said in a filing.

“The Federal Rules of Civil Procedure required Google to suspend its auto-delete practices in mid-2019, when the company reasonably anticipated this litigation. Google did not,” the DOJ said.

“Instead, as described above, Google abdicated its burden to individual custodians to preserve potentially relevant chats,” the DOJ added. “Few, if any, document custodians did so. That is, few custodians, if any, manually changed, on a chat-by-chat basis, the history default from off to on.”

As a result, the tech giant “systematically destroyed” potentially relevant written communication “every 24 hours,” the DOJ affirmed in its filing.

Moreover, investigators also claim that Google “falsely” told the U.S. government it had “put a legal hold in place” that “suspends auto-deletion.”

The DOJ said that “at every turn, Google reaffirmed that it was preserving and searching all potentially relevant written communications.”

“Amazingly, Google’s daily spoliation continued until this week,” the DOJ added. “When the United States indicated that it would file this motion — following months of conferral — Google finally committed to ‘permanently set to history on’ and thus preserve its employees’ chat messages.”

A Google spokesperson told CNBC company officials “strongly refute the DOJ’s claims.”

“Our teams have conscientiously worked for years to respond to inquiries and litigation. In fact, we have produced over 4 million documents in this case alone, and millions more to regulators around the world,” the spokesperson said.

This is not the first time the issue of Google chats has come up in antitrust litigation.

In Epic Games’ antitrust litigation against Google, the video game company submitted exhibits that appeared to show Google employees suggesting chats were a safer place to have sensitive conversations, CNBC noted.

For example, one exhibit in that case showed an employee saying, “Since it’s a sensitive topic, I prefer to discuss offline or over hangout” — in reference to Google’s chat product in question.

Trail of Funding for AI ‘Machine Learning Fairness’ Leads to Leftist Billionaires Omidyar, Hoffman, Soros

This week we examined the field of Machine Learning Fairness, which seeks to imprint AI programs with leftist assumptions and priorities. Following the money behind the leading organizations of ML Fairness leads to some familiar funding sources, including leftist billionaires Pierre Omidyar, George Soros, and Reid Hoffman.

One of the most well-funded efforts to control AI is the Ethics and Governance of AI Initiative, a joint project of the MIT Media Lab and Harvard University’s Berkman Klein Center for Media & Society.

By 2017, the initiative had raised $26 million from various sources that played a prominent role in pushing the “disinformation” panic, including Pierre Omidyar’s Luminate, the Knight Foundation, and the notoriously leftist tech bro Reid Hoffman, whose sinister election-influencing activities have been well documented.

Both the MIT Media Lab and the Berkman Klein Center were heavily involved in the disinformation panic, and have been involved in controversies. Joi Ito, the president of the MIT lab, had to resign in 2019 after it was revealed that the organization accepted donations from Jeffrey Epstein.

The Berkman Klein Center, meanwhile, was for years the pulpit of Dr. Joan Donovan, a partisan Democrat who used the disinformation panic to cast doubt on the Hunter Biden “laptop from hell” story.

The priorities of the Ethics and Governance of AI Initiative are similarly leftist — it aims to bring the values of ESG and wokeness to AI. Its mission statement is to “ensure that technologies of automation and machine learning are researched, developed, and deployed in a way which vindicates social values of fairness, human autonomy, and justice.”

In 2017, the Initiative hosted an “AI and Inclusion” summit with financial support from George Soros’ Open Society Foundations and others. In 2019, it gave out six-figure sum awards to projects aimed at stopping the use of AI to “spread disinformation.” Clearly, the priorities of the MIT Media Lab and the Berkman Klein Center are the same as ever.

Another organization to keep an eye on is the AI Now Institute, which is backed by Lumiate, an Omidyar organization, as well as the Ford and MacArthur foundations.

The AI Now Institute was perhaps the first organization to make ML Fairness its sole focus, and its priorities are predictably woke: making sure AIs don’t get too effective in fields like criminal background checks, and making sure it gets very effective at promoting leftist causes like the Green New Deal.

The co-founder of the AI Now Institute, Meredith Whittaker, worked at Google for several years before moving to the FTC under Biden and then the Signal Foundation.

In 2019, when Google established an external “AI Ethics” council that included Heritage Foundation president Kay Coles James, Whittaker led a collective hissy fit by Google employees opposed to the mainstream conservative’s presence on the council. In her comments, Whittaker seemed to indicate that the inclusion of any conservative viewpoints in the oversight of AI or its use in policy would be a problem.

“See systems deployed to aide ICE in targeting immigrants, to aid the Military in drone strikes, or to enhance worker control. Thus, in ensuring we are ‘ethical’ in our pursuit of AI dominance, we need to include and amplify the perspectives of those most at risk,” said Whittaker. Her efforts ultimately led to the AI Ethics council being shut down.

The MacArthur Foundation, an enormously wealthy leftist private foundation with an endowment of approximately $7 billion, is also throwing its money around in the field of ML Fairness.

MacArthur is a major contributor to the Center for Democracy and Technology (CDT), a nonprofit founded in the 1990s that in recent years has focused on fueling the Russiagate and “disinformation” panics. The CDT has also opposed efforts by red states to give users more power to challenge Big Tech censorship decisions in the courts.

The CDT is now spending an increasing amount of time investigating the uses and misuses of AI, with a stated goal of using the technology to “address deep-seated cultural bias that contributes to systemic inequality.” The CDT’s priorities are familiarly woke. “Equity”, the leftist codeword for equality of outcomes, must be at the center of AI programs according to the CDT.

MacArthur is also a major backer of the nonprofit Code for Science & Society (CSS), which backs the Algorithmic Justice League and the Distributed AI Research Institute, both of which also seek to turn AI to leftist causes. MacArthur gave over $1 million to CSS in 2021 and 2022. A quick dig through CSS’s website finds other familiar sources of funding: George Soros’ Open Society Foundations, the Omidyar Network, and the Chan Zuckerberg Initiative.

Everywhere we look in the field of “Machine Learning Fairness” or “AI ethics,” the picture is the same: leftist billionaires and foundations pouring millions of dollars into efforts to control AI, either to stop “disinformation” or promote leftist “equity” efforts. Those who want to avoid a future governed by woke AI should keep an eye on these initiatives.

Dear YouTube Censors,

I am the author interviewed on February 22 by Dr. Anthony Harper, White House Correspondent for the Intermountain Christian News, which you removed from YouTube because of alleged “misinformation” claiming that voting irregularities during the 2020 election altered the result. You went further in your censorial zeal by holding Dr. Harper responsible for my alleged sins, imposing a 90-day ban on his broadcasts and threatening him with permanent removal if he has the temerity to disagree with your censorship publicly.

The subject of our interview was my book Final Battle: The Next Election Could Be the Last, whose descriptions of voting irregularities and attempts by the Democrat Party to make cheating in elections easier you want to keep from the voting public.

By suppressing my interview with Dr. Harper, you have effectively suppressed my research and observations about this most serious of matters, and have done so without explanation except the vague unsupported claim that my challenge to an election result must be suppressed. Since you provide no specific evidence to refute my claim, you are also arguing that any challenge to an election result is off-limits and needs to be suppressed.

Since you claim to be willing to hear appeals to your decisions, kindly respond to these requests.

• Provide me with concrete evidence for your claim that irregularities in the presidential election of 2020 did not affect the election result. Please answer the specific analyses and claims made in Dinesh D’Souza’s recent book 2000 Mules and Mollie Hemingway’s book Rigged: How the Media, Big Tech and the Democrats Seized Our Elections. And of course, please address the claims made in my book Final Battle: The Next Election Could Be the Last, which you have so far chosen to suppress rather than answer.

• Please explain why YouTube has not censored and punished Rep. Jamie Raskin and his Democrat colleagues who went into the well of the House in January 2017 to challenge the legitimacy of the Trump election and call for the decertification of Trump Electors. Such challenges to the legitimacy of a presidential election were mounted by Democrats in every election that a Republican won since 1980.

• Since your decisions to censor opinions regarding the legitimacy of elections have been so arbitrary, so ungrounded in obvious facts and so politically biased in favor of the Democrats, please tell me why anyone should treat you as a legitimate arbiter of what is “misinformation” and what is not.
