JOE BIDEN'S ILLEGALS FIRST! - Judicial Watch Sues Biden Administration for Records of Illegal Alien Who Ran Over and Killed U.S. Citizen

During his State-of-the-State address in February, Governor Abbott made securing the border an emergency item. The designation allows the Texas Legislature to prioritize bills related to this and pass them more quickly. The governor asked the legislature to create a ten-year-minimum sentence for anyone caught smuggling in Texas. He also asked the Legislature to enhance the penalty for operating stash houses to a third-degree felony.

(CNSNews.com) -- A government watchdog group, Judicial Watch, is suing the Justice Department and State Department for extradition records of illegal alien Saul Chavez, who ran over and killed a U.S. citizen in 2011 but was then released from the Cook County Sheriff's Office and fled to Mexico.  Chavez was extradited to the U.S. in December 2022.

The American killed by Chavez was William "Denny" McCann, the brother of Judicial Watch client Brian McCann.

“Denny McCann was killed by an illegal alien with a prior felony – and then that criminal was released and fled to Mexico as a result of Chicago’s lawless and deadly sanctuary policies,” said Judicial Watch President Tom Fitton in a press release.

“And to make matters worse, the Biden administration is unlawfully hiding records about why it took over a decade to extradite from Mexico this murderous criminal," Fitton added.

In the lawsuit, filed with the U.S. District Court for the District of Columbia on March 15, 2023, it states, "In June 2011, Saul Chavez ran over and killed William 'Denny' McCann, brother of Judicial Watch client Brian McCann. At the time, Chavez was an unlawfully present criminal alien and had just completed a two-year term of probation for a 2009 DUI conviction.

"Chavez was charged with felony aggravated driving under the influence but was released by the Cook County Sheriff's Office in November 2011 despite an U.S. Immigration and Customs Enforcement (ICE) detainer. Chavez subsequently fled to Mexico, where he has been living since."

The extradition occurred on Dec. 9, 2022. On Feb. 1, 2023, Judicial Watch sent a Freedom of Information Act (FOIA) request to the Department of Justice, which referred it to the FBI.

The FBI then replied that it was denying the FOIA request because releasing records "concerning a third-party individual would constitute a clearly unwarranted invasion of personal privacy, and could reasonably be expected to constitute an unwarranted invasion of personal privacy."

Following a FOIA request to the State Department, Judicial Watch was told it could not respond because of "unusual circumstances." Judicial Watch was seeking extradition records and any "correspondence between the Office of the Legal Adviser and the U.S. Department of Justice, state and federal authorities in the U.S.,” as well as “copies of court records of the legal proceedings” and “committal documents, such as the extradition order, affidavit of waiver, legal briefs and hearing transcript, decision memo to the Secretary of State or to his or her Deputy, and the surrender warrant.”

Because State and DOJ denied the FOIA requests, Judicial Watch filed the lawsuit.

Back in July 2015 the brother of the victim, Brian McCann, testified before the U.S. Senate Judiciary Committee in a hearing entitled, “Oversight of the Administration’s Misdirected Immigration Enforcement Policies: Examining the Impact on Public Safety and Honoring the Victims.”

"Denny was crossing Kedzie Avenue on a marked crosswalk four years ago and was violently struck by a drunk driver who dragged Denny under his car for a block in an attempt to flee before Denny died," testified Brian McCann. "The family was notified by the Chicago Police and the killer was placed into custody and charged with aggravated DUI causing death.

"Two days later ICE issued a detainer because the young man was an illegal alien with a prior felony," said McCann. "The family was assured by the Cook County prosecutor that the defendant would not be allowed to post bail and be released."

Toni Preckwinkle, president of the Cook County Board of Commissioners.
Toni Preckwinkle, president of the Cook County Board of Commissioners.

He continued, "Three months later the Cook County Board passed the ordinance that effectively requires the sheriff to ignore detainers. During the intervening weeks after Denny’s violent death, Cook County President Toni Preckwinkle and former mayoral candidate and Commissioner Jesus Garcia pushed for the ordinance and rammed it through on September 7, 2011. Two months later the killer made bail and absconded to Mexico."

McCann recently said, “My family and I continue to seek justice for Denny. Now that he has been extradited from Mexico, we are one step closer. But, we still want to know: what took so long? With the help of Judicial Watch, we hope to find out."

In its press release on the McCann case, Judicial Watch noted that in a March 2021 lawsuit against the San Francisco Sheriff's sanctuary policy, it uncovered "that over 2,400 criminal illegal aliens were released under the department’s policy on communications with Immigration and Customs Enforcement (ICE) about criminal illegal aliens in the Sheriff’s custody."

Lawsuit: ‘Modern-Day Slavery’ Scheme Trafficked Foreign H-2A Visa Workers into Georgia Farm Jobs

A criminal network, along with a Georgia farm, is accused in a class action lawsuit of operating a labor trafficking scheme that federal prosecutors have called “modern-day slavery” that used the H-2A visa program to import foreign workers and force them into United States farm jobs.

The lawsuit, brought by three of the foreign H-2A visa workers who were allegedly trafficked, accuses Maria Leticia Patricio — the matriarch of what the Justice Department is calling the Patricio transnational criminal organization — and her associates Enrique Duque Tovar, Jose Carmen Duque Tovar, as well as Georgia-based MBR Farms of operating and being complicit in a $200 million labor trafficking scheme that started in at least 2015.

According to the lawsuit, Patricio and her associates recruited foreign nationals through the H-2A visa program that allows U.S. farms to hire an unlimited number of foreign workers every year for American agricultural jobs. As Breitbart News has chronicled, the program is often used to replace Americans and preserve the low cost of farm labor.

Among other claims, the lawsuit alleges that Patricio and her associates of requiring foreign H-2A visa workers to pay exorbitant fees to travel to the U.S., withholding their wages once they started work at MBR Farms, forcing them to live in squalor, and threatening them with deportation and violence if they called authorities.

The lawsuit alleges:

Upon arrival in Georgia, the Plaintiffs and other class members were housed in a motel. The motel appeared abandoned, with broken windows, dirty rooms, unkempt beds, and no hot water. They each shared a room with multiple other workers. The Plaintiffs and other class members each stayed in the motel for the first part of their stay in Georgia, some for only three days, but others for up to one month. [Emphasis added]

After moving out of the motel, the Plaintiffs and other class members were housed in four trailers in a small trailer park. One of the four trailers was empty. The trailers were also dirty and run down with no air conditioning or heat, and holes in the floor. The roofs leaked when it rained. There were rats and cockroaches. Each trailer housed between 15–18 workers, with only a single bathroom. Some of the trailers had no beds, so the workers were forced to sleep on the floor. In other trailers, the workers slept in bunk beds.
[Emphasis added]

The Traffickers threatened or conspired to threaten the Plaintiffs and other class members with significant debt to prevent the Plaintiffs and other class members from leaving the Traffickers’ employment, in that the Traffickers would require the Plaintiffs and other class members to pay a certain amount of money to Traffickers to be released from the contract. Because the Traffickers did not pay the Plaintiffs and other class members all their earned wages, and because Plaintiffs and other class members had to pay for travel and recruitment expenses, Plaintiffs and other class members had little or no money while in Georgia. [Emphasis added]

Patricio and her associates “reaped more than $200 million from the illegal scheme,” the lawsuit claims, and allegedly laundered the money “through cash purchases of land, homes, vehicles, and businesses; through cash purchases of cashier’s checks; and by funneling millions of dollars through cash deposits made at the Seminole Hard Rock Hotel and Casino in Tampa, Florida.”

Meanwhile, MBR Farms is accused of conspiring with Patricio and her associates.

The class action lawsuit is the second to be brought against the Patricio transnational criminal organization for the alleged labor trafficking scheme.

In November 2021, as Breitbart News reported, 24 individuals were indicted by a federal grand jury for the scheme which prosecutors called “modern-day slavery.” Many of those indicted in the federal case are illegal aliens.

The case is Hernandez v. Patricio, No. 5:23-cv-00023 in the United States District Court for the Southern District of Georgia.

Cornyn: ‘4.8 million’ Migrants Have ‘Been Ushered Into’ the United States Under Biden

By Andrew R. Arthur

If nearly five million aliens have poured over the border since Joe Biden took office, as Sen. Cornyn alleged and Mayorkas did not deny, the deleterious effects of the administration’s border fecklessness will be felt every day for years to come.

While Biden has vowed to flood the U.S. labor market with more foreign workers to compete against Americans for jobs, he has shied away from questions on whether he will eliminate tariffs on foreign imports that were imposed by Trump. Such elimination of tariffs would be a boon to multinational corporations that offshore their production and jobs overseas only to import their products back into the U.S. market, often with no penalties for doing so.

The Border: 10,000 Apprehensions in 48 Hours

And those are just the people who got caught.

20

What was once known as the Southern border of the United States is essentially nonexistent in this time of Biden regime misrule, and so it was no surprise Wednesday when Border Patrol Chief Raul Ortiz tweeted some figures showing just how bad the border area has become:

Past 48 Hours…

– 10,070 Apprehensions

– 52 lbs. of Fentanyl

– 38 lbs. of Ecstasy

– 11 lbs. of Meth

– 11 lbs. of Cocaine

– $48,000 Seized

– 20 Firearms

– 5 Stolen Vehicles Recovered

– 5 Sex Offenders

– 4 Warrants

– 1 Gang Member

Significant numbers for just 2 days!

Indeed, and it was just business as usual for the border, although Ortiz didn’t mention the terrorists. It came to light last October that up to that point in 2022, the Border Patrol had caught at least 98 people at the border who are on terror watchlists. There is no indication that they’ve stopped coming since then. Terrorists can see what’s happening at the border as much as anyone else can; why shouldn’t they take advantage of the mess Old Joe has made? And those 98, of course, were just the ones who got caught.

Fox News reported that “the number of migrant encounters at the U.S. southern border climbed to a record more than 227,000 during the month of September and more than 2.3 million for fiscal year 2022, according to data from U.S. Customs and Border Protection.” That data also shows that “there were 20 known or suspected terrorists arrested at the southern border in September, bringing the total terror watchlist arrests at the border for the fiscal year 2022 to 98. The number of terror watchlist arrests at the border for the last five years combined was 26.”

What did Old Joe and his handlers say about this? Nothing, of course, because they weren’t challenged by the sycophantic Leftist propagandists we call “journalists.” And the administration had every reason to stonewall any inquiry, as nothing demonstrated the catastrophe that is the Biden regime’s handling of the border crisis more vividly than the entry of known terrorists into the United States.

The terror risk involved in the open border has long been known. U.S. Customs and Border Protection reported as far back as Feb. 3, 2021 that “Yuma Sector Border Patrol agents arrested a group of 11 Iranian citizens who illegally crossed the border into the United States….Yuma Sector agents apprehended eight Iranian nationals in FY2020, compared to just 14 from all other border patrol sectors combined. So far in FY2021, Yuma Sector agents have apprehend [sic] 14 nationals from Iran.”

Rep. John Katko (R-N.Y.) asserted in March 2021 that “individuals that they have on the watchlist for terrorism are now starting to exploit the southern border. We need to wake up.”

Then in August 2021, former Border Patrol chief Rodney Scott warned that the Southern border was “a national security crisis,” with “TSDBs at a level we have never seen before. That’s a real threat.” In October, he said on Fox News that “we have terrorist threats we can’t get into in this type of a forum but they are real.”

Yes, they are, and they’re entirely Biden’s handlers’ fault. Former Customs and Border Protection Commissioner Mark Morgan said Monday that border agents are “demoralized” with the border “wide open.” He added that “every aspect of our public health, safety, national security is being jeopardized.” Over 7,000 migrants cross the border every day as it is, and once Title 42, a Trump administration attempt to control the wave of migrants, is ended as Biden’s handlers plan to do next month, that number is expected to jump to 18,000 per day.

Morgan observed that one group that is taking advantage of this is the drug cartels. “They know, because of this administration, our borders are wide open,” Morgan said. “We literally handed over operational control to the cartels. It’s way beyond the millions that have been smuggled in this country.” Not just terrorists, but drug cartels as well. The nightmare never ends.

Make no mistake: this has all been done on purpose. The Biden administration, Morgan added, “opened our borders and intentionally created and facilitated a catastrophic crisis on the southwest border that we’ve never seen in our lifetime.” Why would they do such a thing? You know the answer. Morgan explained: “Their priorities [are] to get as many illegal aliens in this country because – it’s disgusting – but because they see a perceived political benefit.”

The Left seems intent on destroying the country in pursuit of unchallenged political power within it. What kind of a country they’ll be ruling over once it is overrun with migrants and its economic power entirely outsourced or outpaced doesn’t seem to be a question that ever crosses their minds. How they’ll be able to pay for all their new welfare recipients once the American middle class is entirely taxed out of existence is also not a priority consideration for them.

The only thing that matters is gaining and securing political power indefinitely. But this might easily become a Pyrrhic victory.

NY Times: U.S. Imports Poverty as Young Migrants Make Up 44% of Poor Children

The United States, through mass illegal and legal immigration, is importing generations of poverty as the children of immigrants now account for 4-in-9 of all poor children living in the nation, the New York Times reveals.

In a report detailing vast poverty rates among the children of illegal and legal immigrants, the Times notes that “more than 40 percent of the country’s poor children are children of immigrants.”

Roughly 50 percent of those impoverished migrant youth are “anchor babies,” the term given to the U.S.-born children of illegal aliens as they are awarded birthright American citizenship despite their parents residing illegally in the nation.

The data suggests that anchor babies account for 2-in-10 poor children in the U.S.

“The solution is to stop importing poverty,” the Heritage Foundation’s Robert Rector told the Times, advocating for an overall reduction to legal immigration levels in addition to drastically cutting illegal immigration.

The Times reports

Children of immigrants, the fastest-growing group of American youths, have poverty rates more than twice those of other children. That is partly because their families earn less than native workers, but also because they face more barriers to government support. The barriers are largest for children of undocumented immigrants, but families of legal immigrants face obstacles, too. [Emphasis added]

“The more welfare that immigrants use, the more difficult it becomes to afford anti-poverty initiatives for the native-born,” said Steven A. Camarota of the Center for Immigration Studies, a group that seeks to sharply reduce immigration. [Emphasis added]

Fully 44 percent of poor children have an immigrant parent, according to research by Ms. Acevedo-Garcia, the Urban Institute, and UnidosUS, a Latino advocacy group. Nearly a fifth of poor children have an undocumented parent. [Emphasis added]

Camarota’s research for the Center for Immigration Studies has routinely found widespread taxpayer-funded welfare use among illegal and legal immigrants.

In 2019, for example, Camarota found that immigrant-headed households use nearly twice as much welfare as households headed by native-born Americans. Whereas 63 percent of households headed by immigrants, both illegal and legal, use some form of public welfare, just 35 percent of native-born households used welfare.

Chart via the Center for Immigration Studies

Likewise, in 2021, Camarota again discovered that the majority of immigrant-headed households were using some form of welfare at much higher rates than native-born Americans. While 31 percent of immigrant-headed households are on food stamps, for instance, fewer than 20 percent of native-born households use the program.

Though economist George Borjas has called the U.S. immigration system “the largest anti-poverty program in the world” at the expense of America’s working and middle class, President Joe Biden’s administration has lowered standards to ensure welfare-dependent foreign nationals can secure green cards.

In 2022, the foreign-born population hit nearly 47 million — the largest immigrant population ever recorded by the Census Bureau. Further research shows that the nation’s overall immigration levels are driving 80 percent of all population growth.

Since 1970, the nation’s foreign-born population has quintupled and since 1980, it has tripled in size. In 1990, the foreign-born population was just half of what it is today — with 1-in-7 U.S. residents having been born outside of the country.

The majority of new arrivals come through the nation’s legal immigration system, which gives out about a million green cards annually as well as more than a million temporary work visas to take blue-collar jobs that would otherwise go to working and lower-middle class Americans.

At current legal immigration levels, the Census Bureau projects that about 1-in-6 U.S. residents will be foreign-born by 2060, with the foreign-born population hitting a record 69 million.

Josh Hawley: Biden’s ‘Concierge Service’ for Illegal Aliens Comes at Expense of Americans’ Jobs, Wages

TOPSHOT - Migrants are processed by United States border patrol agents seen from the Mexican side of the US-Mexico border in Ciudad Juarez, Chihuahua state, Mexico, on March 29, 2023. - About 200,000 people try to cross the border from Mexico into the United States each month, most of them …

President Joe Biden’s “concierge service” for illegal aliens comes at the expense of Americans’ jobs and wages, Sen. Josh Hawley (R-MO) said this week.

In a letter to Department of Homeland Security (DHS) Secretary Alejandro Mayorkas, Hawley blasted the administration’s migrant mobile app — known as CBP One — that has released more than 30,000 foreign nationals into the United States since early January by allowing them to schedule appointments at the southern border.

Specifically, the migrant mobile app allows foreign nationals who are pregnant, mentally ill, elderly, disabled, homeless, or crime victims living in Mexico to schedule appointments at the border for release into the U.S. interior.

Hawley writes that the migrant mobile app is in effect “like making a restaurant reservation” and will have dire effects on Americans’ jobs and wages:

Under your leadership, the Department is marketing a new phone app, called CBP One, that allows unauthorized migrants to reserve a time to cross the border, like making a restaurant reservation. How convenient. I gather the app is meant to expedite asylum claims, or so your Department’s promotional material says. But I noticed you said nothing about asylum when I asked you at the hearing. And the Texas Monthly has recently reported that “[a]t no point does the app ask users ‘Are you seeking asylum?’” Worse, when migrants show up at the border to enter the country, they “are given no interviews and asked no questions about vulnerabilities they listed in the app or about why they’re seeking asylum in the U.S.—they’re simply released into the country on official parole.” [Emphasis added]

I imagine there are plenty of Americans who would appreciate this level of service from their government. Your choice to spend untold sums of taxpayer money—you said you had no idea what it cost—on concierge service for illegals is baffling. It is also revealing. It demonstrates your priorities: open borders, no matter the cost to Americans; no matter the jobs lost, the wages lost, the drugs flooding our schools. [Emphasis added]

Hawley calls the migrant mobile app “a full-on institutionalization of an open border and the abuse” of U.S. asylum laws, pressing Mayorkas to disclose how many foreign nationals have used the app since its inception, how many are expected to use the app after border controls end in May, and if the app will be updated to ask applicants if they have legitimate asylum claims.

The tech companies involved in the migrant mobile app’s creation, Hawley writes, should also be disclosed to the public and Congress along with the taxpayer costs associated with the app.

Biden’s expansive Catch and Release network at the border is pumping hundreds of thousands of foreign workers, often illegal, into working- and middle-class American jobs. At the same time, fewer Americans are working.

As Breitbart News reported, at the end of 2022, there were nearly two million fewer native-born Americans working compared to the same time in 2019, while two million foreign-born workers have been added to the workforce compared to the same time period.

In particular, the decline in the labor participation rate among working-class native-born Americans has dropped to 70.3 percent at the end of last year compared to 71.4 percent in 2019, 74.8 percent in 2006, and 76.4 percent in 2000.

Working-class native-born American men, those without a bachelor’s degree between 25 to 54 years old, had only an 83.7 percent labor participation rate at the end of 2022 — declining consistently since the year 2000.

The Biden administration has largely ignored efforts to get native-born Americans back into the workforce, instead adding millions of foreign workers to the labor market which adds downward pressure, particularly for working-class Americans in terms of finding jobs and securing higher wages.

Sometimes they are family members or love interests of top leaders. Other times they killed their way to the top. This is the case for the currently jailed Melissa “La China” Calderon Ojeda — former leader of a Sinaloa Cartel hit squad. Man Kidnapped in Texas Home, Taken to Mexico by Cartel Gunmen, Remains Missing

The fate of a Texas man remains unknown after a team of cartel gunmen took him out of a house in Laredo, Texas, and crossed him into the Mexican border city of Nuevo Laredo, Tamaulipas. The victim reportedly bragged about stealing $50,000 from the Cartel Del Noreste faction of Los Zetas.

The kidnapping took place on March 24 shortly after midnight when a team of three hooded gunmen stormed a house in the 3400 block of Queretaro Street in Laredo. According to court documents filed in federal court, the gunmen took a victim named of Erick Tadeo Ramirez at gunpoint and placed him inside a blue four-door Dodge Ram pickup. The gunmen drove straight to one of the international ports of entry and ran through the barriers and forced their way into Mexico. The victim tried to climb out of the truck but federal authorities at the bridge were unable to do anything to stop the gunmen from taking him into Mexico.

Hours later, the victim’s sister and girlfriend called the police to report him missing. The next day, the FBI went to the house where the kidnapping took place and spoke with two witnesses who confirmed the kidnapping. The witnesses claimed to have heard the victim arguing with a woman on the phone over him stealing $50,000 from the Cartel Del Noreste faction of Los Zetas. The victim claimed that he wasn’t afraid because he was in Texas. Less than two hours later, the gunmen stormed the house.

Authorities identified Jonathan Cavriales as one of the alleged kidnappers through the vehicle that the gunmen used to cross the victim into Mexico. On March 27, Cavriales tried to cross back into Texas but federal authorities arrested him. During an interview, he reportedly said he drove the vehicle and with three other gunmen kidnapped Ramirez. Court documents say the man reported he “was aware that the victim had stolen approximately $50,000 from Cartel Del Noreste.”

Earlier this week, Cavriales went before U.S. Magistrate Judge Diana Song Quiroga who denied him bond on the charge of kidnapping.

The victim has not been found and the other suspected gunmen remain at large.

WHY HASN'T JOE BIDEN BEEN CHARGED????

Houston Teacher Charged with Smuggling Migrants near Border in Texas

4:56

HOUSTON, Texas — A Houston Independent School District teacher is facing multiple felony charges related to an incident near the Texas border where police say he attempted to smuggle four migrants into the U.S. interior. Police in Kinney County say they stopped Brandon Alexis Gracia for a traffic violation near Eagle Pass, Texas, early last week and found migrants attempting to hide inside the vehicle.

Kinney County Sheriff Brad Coe told Fox 26 Houston that police stopped Gracia for a traffic violation near the Mexican border in Eagle Pass. Inside the vehicle police found four people ducking down to try and avoid detection. Del Rio Sector Border Patrol agents arrived and identified the four people — two men and two women — as migrants who were illegally present in the United States, Coe stated.

“The individuals were in the backseat laying down trying to conceal themselves,” Sheriff Coe explained.

During processing, deputies from the Kenny County Sheriff’s Office found an identification card from Patrick Henry Middle School, Fox 26 reported. Houston Federation of Teachers Union officials confirmed to the local Fox affiliate that Gracia worked in HISD but was not a member of the union. HISD also confirmed the human smuggling suspect’s employment as a teacher.

“What we’re gathering is he was contacted on social media, wanted to make some quick money, came to the border and picked up at a pre-determined location, and was headed back to Houston,” the Texas border county sheriff explained. He said smuggling groups make promises of payments between $1,000 and $5,000 per person smuggled. He said the payments are often not paid.

Fox 26 reported:

“He’s looking at state jail time. He could get up to six to eight years for all this. Best I can tell this is his first time. We are catching some that have no criminal history, never been in trouble before in their life, and they’ve hit a point in life where they think they need money bad enough that they’re going to try this. So we need to turn the economy around. We need to educate people, and we need to find the source,” Sheriff Coe adds.

He says last year alone his deputies arrested 741 people who were treating other people as cargo, and smuggling them into the U.S. for money.

“The year prior to that was 169, and we thought we had really put a dent in it. Then 2022 came around and showed us how wrong we were,” explains the sheriff who says some smugglers believe they’re helping non-U.S. residents out of a bad situation, but he points out once the immigrants are out of that person’s vehicle, and out of their possession, they often end up trafficked and in worse situations than they were originally escaping.

A high percentage of human smuggling drivers arrested in Kinney County are from the Houston area, Sheriff Coe told Fox 26 earlier this month. The sheriff said that of the nearly 100 people arrested on human smuggling charges in February, 40 percent came from the Houston area. He again blamed social media recruitment.

In March, Breitbart Texas interviewed Governor Greg Abbott regarding human smuggling from the Texas border into the U.S. interior.

“To me, this is shocking,” Abbott began in the interview.” Texans are going on to Twitter or Tik Tok or whatever the case may be, and seeing advertisements by the cartels offering to pay them money to pick up illegal immigrants and transport them elsewhere in the state of Texas.”

“And that’s a crime,” the governor continued. “But either it’s not being enforced or the punishment is not serious enough. So I want to mandatory ten years behind bars for anyone who is caught smuggling somebody in Texas.”

Finally, if human smuggling or stash house operations occur in an area under a disaster declaration, the governor asked for enhanced penalties.
