Immigration Experts Claim Biden Admin Abusing the Law to Release Illegals into US
Immigration experts say that the Biden administration is skirting the immigration laws that are on the books in order to release illegal immigrants into the country.
Recently, the Heritage Foundation hosted a panel event called, “Catch, Released, and Then What?” where three different immigration experts discussed how the Biden administration handling of the border crisis is impacting the country in a negative way.
The speakers explained how the Biden Administration is abusing every loophole in the immigration system to release illegals into the country.
“When they release them they release them under two authorities, parole... which is only supposed to be used in the case of somebody who needs emergency medical treatment or is a material witness in a criminal case in the United States - but the Biden administration has paroled 1.4 million people on ca se by case basis completely outside of those parameters” said Andrew Arthur, who is a Resident Fellow in Law and Policy at the Center for Immigration Studies and was a Former Immigration Judge.
“The other way they are releasing them is under section 236a of the INA (Immigration and Nationality Act of 1952), which is the general arrest authority and release authority in federal law with respect to immigration. That only applies in the case of somebody who is arrested on a warrant - its not going to surprise you, those border patrol agents aren’t, you know, there with warrants, you asking, 'hey Simon I got your arrest warrant here.' They are completely abusing that arrest warrant authority and then releasing those people on their own recognizance” he added.
Another panelist, Tomas Homan, former Acting Director of the U.S. Immigration and Customs Enforcement and a Visiting Fellow at the Heritage Foundation’s Border Security and Immigration Center, said that the Biden administration is purposely not detaining illegal immigrants at the border.
“So nearly 9 out of 10 who claim asylum never get relief from U.S courts because they don’t qualify or they don’t show up, so then they get an order of removal."
"If you're in ICE detention and you get an order of removal you get removed 99% percent of the time but if you’re not in detention, like a family group and you get an order of removal - you leave 6% of the time. So they know what they're doing by not detaining people in an ICE bed” he said.
Homan also says that there needs to be more congressional oversight hearings regarding "Alternatives to Detention” (ATD) and the nongovernmental organizations that are working at the border.
“They need to have oversight hearings on what's going on with detention on what's going on with ATD, what’s going on with all these sole sourced contracts of the NGOs. How are all of these billions of dollars going to these NGOs that are transporting illegal aliens to the United States?”

Obama Judge Sides with Left-Wing Activists to Block Biden’s Successful Border Rule Cracking Down on False Asylum Claims
On Tuesday, an Obama-appointed judge blocked a Biden Administration rule that had successfully lowered border crossings and, simultaneously, helped crack down on immigrants seeking to cheat U.S. asylum policy.
Judge Jon Tigar of the U.S. District Court for the Northern District of California blocked the DHS-DOJ rule, established in May after the expiration of Title 42 order, which had restricted border-crossers based on public health safety concerns. By his ruling, Judge Tigar sided with the left-wing immigration activists who had sued the DOJ over the policy.
The judge gave the Justice Department 14 days to appeal his ruling, which it announced it plans to immediately do, NPR reports:
"The Justice Department disagrees with the district court's ruling today," a DOJ spokesperson wrote in a statement, calling the policy a "lawful exercise of the broad authority granted by the immigration laws."
Biden’s rule presumes immigrants are ineligible for asylum if unless they either go through proper channels to apply for asylum or attempt to obtain asylum in a country they passed through on their way to the U.S.
Judge Tigar cited the presumption of ineligibility as one reason of his reasons for blocking the Biden rule. He also deemed the traditional 30-day notice for public comment period to be inadequate, Fox News reports:
“Tigar, an Obama appointee, blocked the rule on the basis that the notice procedures put in place for the rule are insufficient under the Administrative Procedure Act, which determines how rules are enacted by federal agencies and requires certain notice-and-comment periods. The administration provided a 30-day notice period for the asylum rule, but Tigar deemed that to be insufficient because of the rule's complexity.”
10K Migrants Apprehended in One Week in Arizona Border Sector
The surge of migrant apprehensions in the Arizona desert continues as Tucson Sector agents arrested 10,000 migrants during the past week. During that period, agents also carried out 430 migrant rescues and interdicted 21 human smuggling attempts.
Tucson Sector Chief Patrol Agent John Modlin tweeted a report indicating that agents in his sector apprehended approximately 10,000 migrants during the past week. This is up from 9,000 the week before.
Modlin also reported the rescue of 430 migrants who became endangered in the relentless summer heat of the Arizona desert. In addition, the agents interdicted 21 human smuggling attempts and made 11 narcotics seizures.
In one of these rescues, agents saved the life of a 45-year-old Guatemalan female migrant who crossed the border in the Baboquivari Mountains on July 21, Modlin tweeted.
The chief reported that the woman became severely dehydrated and suffered a leg injury. Border Patrol Search, Trauma, and Rescue (BORSTAR) agents litter-carried the woman down the rigorous terrain of the mountain range to an awaiting Arizona DPS helicopter. The aircrew transported the injured woman to an area hospital for evaluation and treatment.

On July 24, agents assigned to the Ajo Station encountered a large group of 194 migrants, the chief said in another tweet. The group consisted of single adults and family units from 16 different nations.
The apprehension of 10,000 migrants indicates an upward trend in migrants entering the Tucson Sector. On July 21, Modlin tweeted a report indicating the arrest of 9,000 migrants in one week.
During the month of June, Tucson Sector agents apprehended 24,360 migrants who crossed between ports of entry. This brought the year-to-date total for the sector to 234,667 migrant apprehensions. In comparison, agents apprehended only 195,115 during the same period last year. The numbers are up significantly from the totals in FY20 and FY21.
The Tucson Sector is the only non-Texas-based southwest border sector showing increased migrant apprehensions this year over last.
The increase in Tucson Sector migrant apprehension comes as arrests in the five Texas-based sectors dropped following increased border security efforts under Governor Greg Abbott’s Operation Lone Star, Breitbart Texas reported.
“Governor Abbott launched Operation Lone Star in March 2021 to fill in the dangerous gaps created by President Biden’s reckless open border policies,” Andrew Mahaleris, press secretary to Governor Greg Abbott, told Breitbart Texas. “States like Arizona are following President Biden’s lead, allowing even more migrants to surge into our country while Texas is holding the line.”
