ICE Re-Arrests Illegal Alien Charged With Raping Disabled Person After ‘Sanctuary’ Court Releases Him, Denies Detainer
After a court in “sanctuary” city Boston released an illegal alien charged with rape back into the community and denied an Immigration and Customs Enforcement (ICE) detainer request, ICE arrested the Haitian suspect previously apprehended by local police.
“Disturbingly and despite our filing an immigration detainer, this individual was released back into the community by the criminal court,” Enforcement and Removal Operations (ERO) Boston Field Office Director Todd M. Lyons said in a statement announcing the arrest on Wednesday.
The illegal alien was first detained when he tried to break into the U.S. at the Texas border, according to the ICE timeline:
December 2022: The 31-year-old Haitian national arrived at the port of entry in Brownsville, Texas, where he was deemed inadmissible and issued a notice to appear before an immigration judge with the Department of Justice (DOJ) Executive Office for Immigration Review (EOIR) in Boston.
September 2023: Boston police arrested him for rape and indecent assault and battery on a developmentally disabled person, after which ERO Boston lodged an immigration detainer with the Dorchester District Court seeking his custody.
November 2023: The sanctuary city court denied the immigration detainer and released the illegal alien rape suspect from a Boston jail, pending the resolution of his criminal charges in a local criminal court.
January 9, 2023: ERO Boston officers arrested him, after learning of his release and presence within their jurisdiction.
The illegal alien charged with rape will now remain in ICE custody pending an upcoming hearing before a Department of Justice (DOJ) immigration judge. Following adjudication of his local criminal charges, ERO Boston will then seek his removal from the United States.

Republican Senators Warn Against Immigration Deal
Sens. Mike Braun (R-IN), Marsha Blackburn (R-TN), and Tim Scott (R-SC) on Breitbart News Saturday warned against the bipartisan immigration deal, believing it would do nothing to stem the migrant crisis at the southern border.
Sen. James Lankford (R-OK) and congressional Democrats have struck an immigration framework that Breitbart News has detailed would only reward illegal immigration and encourage more foreign graduates to take jobs from American graduates.
An agreed border deal would:
1) Increase green cards by 50,000/year
2) Award work permits for adult children of H-1B holders
3) Give mmediate work permits to every illegal alien released from custody
4) Assign taxpayer funded lawyers to certain UACs and mentally incompetent aliens
5) Increase expulsion authority for a limited number of days ONLY if encounters exceed 5k/day over a seven day period
6) Restrict parole for those who enter without authorization between ports of entry
On Breitbart News Saturday, Blackburn, Braun, and Scott said that the immigration deal would not fix the migrant crisis.
Braun said the border deal “does nothing to fix” the border crisis.
He continued, “If it were H.R. 2, I think that would be something that would probably make sense. If it’s something else, you’re just baselining it at a level that Democrats would probably be happy with in terms of number of crossings.”
“Those are the ruses, the tricks that have been used by the establishment politicians for decades. We can’t fall for it,” the Hoosier senator said.
Blackburn said about the border deal, “I have said all along I cannot support anything that would make illegal entry legal. And that is what we see some of the Democrats really pushing for — they’re trying to find ways to make illegal immigration legal.”
“Matt, you cannot talk about border security without talking about fixing asylum, fixing the parole issue, not with the president waiving hundreds of thousands of people into the country every year,” Blackburn, a Senate Judiciary Committee member, said.
Scott, who just endorsed Trump at a rally in New Hampshire, said that the migrant crisis is “the greatest invasion across our southern border in American history.”
He said, “Don’t negotiate around the edges, the thing that’s missing is confidence and what President Trump brings to the table in negotiating about border security.”
“We want someone at the helm that the American people say, I trust what he says about the border. That brings confidence and that’s what we need in Washington,” Scott added.

John Fetterman Changes Political Identity as He Fights Democrats on Border
Democratic Senator John Fetterman's shedding of the "progressive" label he once proudly espoused is partially due to some liberals' views on immigration and the southern border.
The senator from Pennsylvania defeated Republican challenger Dr. Mehmet Oz by a five-point margin in the 2022 election. In that election and the years leading up to it, including during his failed 2016 Senate bid, Fetterman defined himself as a progressive and backed Senator Bernie Sanders as the Democratic Party's presidential nominee that same year. He has shied away from the designation as of late.
Fetterman has recently become more outspoken about issues like the U.S.-Mexico border and the war in Gaza, saying he's no longer a progressive but "just a regular Democrat." He has sounded an alarm on the situation down south, exacerbated by a monthly record of 300,000 migrants being processed in December, according to data released by U.S. Customs and Border Protection.
"There is a crisis," Fetterman told the New York Post last week, referencing the December influx of migrants. "We have a crisis at our border, and it can't be controversial that we should have a secure border."
He added: "That's larger than the population of Pittsburgh...That's [Pennsylvania's] second largest city—and that's one month."
Newsweek reached out to Fetterman via email for comment.
The first-term senator campaigned on being a progressive, yet said it's not him but others whose positions have changed, adding that President Joe Biden and his administration are aware of the need for "comprehensive" solutions.
Democratic-run cities like New York, which have been inundated with migrant arrivals for nearly two years, should be supported financially at the federal level, Fetterman said.
"I don't understand why it's it controversial to say we need a secure border," Fetterman told CNN's Jake Tapper on Friday. "I've been really clear—in fact, that was weaponized against me by Republicans in my race, that I'm very much a strong supporter of immigration. My wife's family, there's an origin story about that."
Last month, the senator received scrutiny for mentioning his wife, Gisele Barreto Fetterman, in relation to the border. Gisele, born in Rio de Janeiro, Brazil, came to the United States with her family as an undocumented immigrant at age 7. She was an illegal immigrant until she received her green card in 2004 and became a U.S. citizen five years later.
Gisele was widely praised for being not just a good wife but a campaign surrogate when Fetterman suffered a stroke in the months preceding his election with Oz.
"I think two things can be true at the same time: You can be very supportive of immigration, but we also need to have a secure border," the senator told Tapper. "We want to provide the American Dream for any migrant, but it seems very difficult when you have 300,000 people showing up encountered at our border to do that.
"I think we need to do a reset and work together to develop a new comprehensive solution."
As conservatives, including Donald Trump Jr., have commended Fetterman for speaking out regarding the border and the Middle East, Fetterman has experienced a dwindling of support among young liberals—more of whom sympathize with Palestine than Israel, according to a New York Times/Siena College poll of 1,680 Pennsylvania self-identified registered voters conducted between January 4 and 8.
Only 28 percent of those aged 18-34 have a favorable view of Fetterman, according to the poll. In contrast, 45 percent had an unfavorable view of the senator, with 27 percent saying they hadn't heard enough to answer.

Spanning across generations, Americans have done extraordinary things during uncertain times. My father’s genealogy is rich with such memoirs. My grandfather’s long service in the Army included WWII, and my father completed over 20 years in the Army. Perhaps the remnants of their DNA combined with growing up on military bases contributed to my deep commitment to our Constitution, our heritage, and the people who sacrificed so much.
Consequently, I am angered that Americans are being conditioned to loathe our shared history and the very people who made our modern country possible. Even our founding documents have been labeled potentially harmful. Make no mistake: these actions are happening because of unscrupulous politicians, bureaucrats, and others who are intentionally destroying our nation’s heritage to obtain greater power, control, and wealth.
In place of the constitutional republic gifted to us by our founders, these charlatans promote “their” democracy. Even though our founders rejected direct democracy because it leads to tyranny through mob rule, our elites have managed to convince Americans otherwise. As a result, in pursuit of their democracy, our political class has amassed unsustainable national debt and created an enormous welfare state. While declaring unity, our democracy cheerleaders encourage racial animosity. One way is by falsely claiming white supremacy as our country’s greatest threat. To combat their perceived scourge of heritage America, they forced DIE and other race-based initiatives. They supported violent aggression by BLM and ANTIFA while vigorously pursuing and prosecuting Trump-supporters. At the same time, they hid evidence of J6 defendants’ innocence and conspired to persecute their political rivals. They improperly used government agencies to monitor Catholic churches and parental groups. They used federal money to coerce social media to inhibit free speech and abused their government positions to intimidate much of the public into taking an experimental injection. They justified their unconstitutional actions under the banner of promoting their democracy. Furthermore, in defending their democracy, they weaponized government by asserting national security.
Their democracy has also advanced the invasion taking place at our southern border. In F.Y. 2023, an astonishing 2.5 million illegals, that we know about, illegally gained entry to the U.S. Using various means, the Biden administration enabled the assault. One way was refusing to uphold its constitutional duty to protect states from invasion as required by Article IV, section 4 of the U.S. Constitution and U.S. immigration laws. For example, at Eagle Pass, Texas, the Biden administration directed the U.S. Border Patrol to cut razor wire so that illegals could enter. Absent help from the federal government, and because Article 1, section 10 of the Constitution gives states power to protect themselves if invaded, Texas gave its police authority to arrest illegals. In response, the Biden administration sued Texas for doing the job Biden refuses to do.

Moreover, complex international syndicates use these children to get single adult males through Border Patrol thanks to a Biden policy that puts pressure on border agents to release, within 72 hours of apprehension, “families,” including adult males with young children. Once released into the U.S., these children are smuggled back across the border to be repurposed for further trafficking. Despite these known problems, the Biden administration ended a Trump-era pilot program that did DNA testing of children with adults crossing the border illegally. It was reported that approximately 30 percent of these children were not related to the adults accompanying them.

Because government has been weaponized, even speaking out is risky. Nevertheless, we must not be afraid to counter their lies with facts, particularly among the youth. Most of all, we must not be ashamed of or apologize for our ancestors’ legacy. Rather, in response to their incessant hate of heritage America, put on the full armor of God and emulate Esther of the Bible, who stood firm against a powerful government employee devising evil laws to eliminate his enemies. For such a time as this, we too must hold firm against those that want to replace our constitutional republic with tyranny in the guise of “their” democracy.

Angel Mom Josephine Dunn ripped into Department of Homeland Security (DHS) Secretary Alejandro Mayorkas on Thursday, saying he is “partially responsible” for her 26-year-old daughter, Ashley Marie, being poisoned by fentanyl.
During Thursday’s House Homeland Security Committee hearing, Dunn testified to lawmakers about her daughter, Ashley, who died from fentanyl poisoning in May 2021, the day after her son’s fifth birthday.
Mayorkas was invited to testify at the hearing and meet with Dunn as well as Angel Mom Tammy Nobles. On behalf of her 20-year-old daughter Kayla Hamilton, Nobles is suing President Joe Biden’s administration for releasing an illegal alien MS-13 Gang member into the United States, who is charged with murdering and raping Hamilton.

“In my humble opinion, Mr. Mayorkas’s border policy is partially responsible for my daughter’s death,” Dunn said:
His wide-open border policy allows massive quantities of poisonous fentanyl into our country. Arizona is the fentanyl superhighway into the United States. I personally feel Mr. Mayorkas is responsible for opening that border to allow more than ten million border crossings since February of 2021, which supports most of the illegal fentanyl into this country. This weapon of mass destruction has killed over 100,000 Americans on our soil for two years in a row. Under Secretary Mayorkas’s leadership, or lack thereof, fentanyl is an invasion. Dunn said Americans deserve to live in a nation “free of fentanyl,” which starts with Mayorkas closing the southern border through fierce enforcement of federal law to prevent drug trafficking as well as illegal immigration.
“My family is broken. My heart is broken, and [Mayorkas] couldn’t even be here to listen to me today,” Dunn said. “Whatever he is doing that is more important than facing me today, I don’t know what that could be. Our country deserves a secure border. Our country deserves to feel safe.”
“We need to close the fentanyl superhighway. We need to close the border,” Dunn said.
Dunn revealed that she was testifying on behalf of her daughter on what would have been her 29th birthday, slamming Mayorkas for not having the decency to face her.
“Today is my daughter’s 29th birthday. I would have rather been home with my poor husband grieving her today,” Dunn said. “I didn’t need to be here today. So whatever he’s doing, I hope it’s more important than that.”
In Biden’s first two years in office, more than 200,000 Americans died from drug overdoses and poisonings — the overwhelming majority of which involved fentanyl. Put another way, drugs and fentanyl have killed 70 times as many Americans in 2021 and 2022 than those who died in the September 11, 2001, Islamic terrorist attacks.

Cygnal Poll: Republicans Should ‘Tap into’ Voter Anger over Illegal Migration
Republican candidates should recognize that 70 percent of swing-voting independents “strongly” or “somewhat” favor the deportation of illegal migrants, according to a poll by Cygnal released Tuesday.
“This new national data shows just how voters view an unsecure border and the subsequent illegal immigration as a crisis, one that they believe is not being addressed by the Biden Administration,” said Brent Buchanan, president of the Cygnal polling firm. He continued:
Republican candidates at all levels would be wise to tap into this sentiment and contrast themselves with a sheepish bench of Democrats who have largely let the issue fester to a boiling point no locality can afford to further ignore because it’s impacting voters day-to-day lives.
The detailed results from the January 11-12 poll of 2,000 likely voters show that 61 percent of Republican supporters “strongly” support deportations.

Forty percent of independents, and 21 percent of Democrats, blacks, and Biden’s 2020 voters “strongly” favor deportations.
The “strongly” opinions are more important than “somewhat” opinions because they are the most likely to determine how a person votes.
The survey showed that 50 percent of all Democrats favor deportations of illegals — 21 percent “strongly,” and 29 percent “somewhat.”

Many other polls show rising public opposition to legal and illegal migration amid President Joe Biden’s business-backed, easy-migration border policy.
The poll comes as Republican leaders in the Senate intensify their push to reach a border deal with Democrats, despite Democrats’ record of using legal and illegal methods to extract millions of poor and desperate migrants from poor countries. Many Democrats — and some Republicans — want the draft deal so they can minimize the visibility of Biden’s aggressive migration policy during the 2024 presidential campaign.
Support for deportations is weaker among some groups: Roughly 33 percent among women, 5 percent among women younger than 55, 34 percent among voters who vote in presidential elections, and 28 percent among “swing voters.” An additional 32 percent of “swing voters” say they “somewhat” support deportation.
Federal Appeals Court Reverses Position, Allows Texas Floating Barrier to Remain
EAGLE PASS, Texas — The State of Texas secured a rehearing before the U.S. Court of Appeals for the Fifth Circuit that will allow the floating buoy barrier installed in the Rio Grande to remain in place until the full court hears the case. The en banc court hearing will take place in May 2024 and reverses a prior ruling ordering the state to remove the barrier system.
In December 2023, the Fifth Circuit panel issued a split 2-1 ruling affirming the Biden administration’s Department of Justice argument that the buoys posed a threat to public safety and blocked navigation in the Rio Grande. As reported by Breitbart Texas, the decision of the appeals court at the time upheld a lower court injunction that instructed the state to remove the 1000-foot floating barrier within ten days.
Texas Governor Greg Abbott issued a statement promising constituents he and Attorney General Ken Paxton would be filing the request for a full court hearing on the matter and expressed his willingness to take the case to the U.S. Supreme Court if necessary.
The barrier, installed at a busy migrant crossing point near Eagle Pass, Texas, in July 2023, is a product manufactured by the Cochrane USA corporation. Abbott announced the installation of the floating barrier system in 2023 as he signed a host of border security bills in Austin. The project quickly came under fire by open-border protesters unhappy with the installation of the buoys and Governor Abbott’s enhanced border security efforts under Operation Lone Star.
Wednesday’s ruling issued by the Fifth Circuit is a part of several legal battles between the state and the Biden Administration over steps Texas is taking to reduce migrant crossings at its border with Mexico. The announcement of the ruling by the Texas Attorney General comes on the heels of another potential legal battle between the Biden Administration and Paxton over the recent seizure of Shelby Park in Eagle Pass by the Texas Military Department.
As a result of last week’s seizure of the border park adjacent to the Rio Grande, the Biden administration’s Department of Homeland Security issued Paxton a cease-and-desist letter claiming the Border Patrol’s right to enter the park to perform official duties had been unlawfully impeded by the move. The letter demanded the state to remove temporary gates from the park’s entrance and allow the Border Patrol full access by the end of the day on Wednesday or face legal action.
As reported by Breitbart Texas, Paxton responded to the letter by sending correspondence to the Department of Homeland Security refuting the legal issues contained in the cease-and-desist letter and vowing to stand firm on the State’s seizure and conditions for entry into the area by the Border Patrol.
That issue, as well as another federal court case regarding the Border Patrol’s right to cut or move concertina wire installed along the border, remains unresolved.
