SCOTUS Inexplicably Re-Opens Texas Border Fence to Flood of Illegal Immigrants With 2-Paragrah Decision

Without explanation, the U.S. Supreme Court ruled Monday to allow the Biden Administration to cut the razor-wire fence Texas had installed to slow the tide of illegal aliens flooding into the country.

With the help of Trump Appointee Justice Amy Comey Barrett and Bush-appointed Chief Justice John Roberts, the ideologically-driven leftist justices achieved a 5-4 victory, granting Biden’s emergency appeal to vacate a lower-court decision allowing Texas to prevent Biden-directed border agents from cutting the concertina wire fence the state had installed.

“Most of the razor wire is deployed in the Shelby Park area of Eagle Pass. It is owned by the city but was recently seized by the State of Texas,” Fox News explains, noting that Texas is engaged in an ongoing battle to protect the state and nation from Pres. Biden’s open-borders policies that have encouraged and allowed historic illegal immigration:

“In court papers, the Biden administration argued that the wire impedes Border Patrol agents from reaching migrants as they cross the river and that, in any case, federal immigration laws trumps Texas' own efforts to stem the flow of migrants into the country.”

Not a single Supreme Court justice provided the reasoning behind his or her vote.

The entirety of Supreme Court order consists of the following two paragraphs:

“The application to vacate injunction presented to Justice Alito and by him referred to the Court is granted. The December 19, 2023 order of the United States Court of Appeals for the Fifth Circuit, case No. 23-50869, is vacated.

“Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would deny the application to vacate injunction.”

While bound to follow the orders of the Biden Administration, U.S. border agents are staunchly against the Biden Administration’s efforts to re-open the fence, according to National Border Patrol Council Pres. Brandon Judd. The Council is official union of U.S. Border Patrol agents.

‘Conservative’ Supreme Court justices side with leftists to keep the border open

A country without a border is not a country, especially when that country hands out benefits like candy on Halloween to the people who enter illegally. Nevertheless, since the day he took office, Biden has opened America’s southern border through a combination of openly illegal activity and devious readings of laws and regulations. Texas, which has borne the brunt of this conduct, finally started pushing back. But now, the Supreme Court has indicated that the federal government may indeed be able to destroy the border, effectively destroying America.

The saga began when the State of Texas put concertina wire barriers at Eagle Pass, the most vulnerable part of the border through which hundreds of illegal aliens have been streaming daily, devastating the local border communities. The Biden government promptly sued to stop Texas’s efforts to maintain its own sovereignty.

Put another way, the Biden administration desperately wants our country to be inundated by millions of people who have no loyalty to America, no education (or even literacy), no money, no sponsors, and no respect for the law. Moreover, it’s entirely comfortable with the reality that the open border allows in cartels, drug traffickers, sex traffickers, child traffickers, garden-variety criminals, spies, and terrorists.

Both the trial court and the Fifth Circuit held that Texas was within its rights to act and that it hadn’t violated either laws or regulations. The corollary is that the federal government does not have the right to storm in and clear away the concertina wire Texas set up on its side of the border. The Fifth Circuit, in a comprehensive decision, issued an injunction stopping the federal government from interfering with Texas’s efforts to keep illegal aliens from flooding its state. The Biden Department of Justice promptly turned to the Supreme Court, asking it to reverse the Fifth Circuit’s decision. That matter has yet to be heard.

However, the DOJ also asked the Supreme Court for an order staying the injunction; that is, it asked the Supreme Court to void temporarily the Fifth Circuit’s order. In essence, the request asked the Supreme Court to say that, pending final review of the issue, the Biden government can re-open the border at Eagle Pass, once again allowing millions of illegal aliens to stream into America.

Before I get to what the Supreme Court did, one of the things you must understand about injunctions and stay requests is that the Court has to examine who will be hurt more pending a final decision: The person engaged in the contested activity or the person seeking to stop the contested activity. (That is, where do the benefits and burdens lie when maintaining the status quo.) In addition, the court must consider, on this first, superficial review, which party is more likely to win at the end of the day. Stay orders usually favor that party.

With that in mind, yesterday, the Supreme Court issued an order granting the Biden administration’s stay request. It’s concluded that there’s less harm from letting millions of people pour illegally into America while it decides the case than there is from keeping them out of America. It also may have indicated that it believes the merits lie with the Biden administration.

Given that the court ostensibly has a six to three “conservative” majority, who were the two “conservative” justices who sided with the order? That would be Chief Justice John Roberts and Justice Amy Coney Barrett. Justices Thomas, Alito, Gorsuch, and Kavanaugh voted against the stay. So, what gives?

Well, the order was one sentence without analysis, so we don’t know what reasoning drove the order. However, I have my own dark, paranoid theories (totally unsupported by any facts) about what happened. I’ve long thought that the Deep State has dirt on Roberts, and I think that Barrett is scared. Kavanaugh was gelded and will do whatever he’s told including siding with conservatives when that position is ineffectual.

As I said, nothing in the way of hard facts supports my ideas. They’re just my way of explaining away ostensibly conservative justices who, with rare exceptions, reliably favor Democrat policies or issue holdings that have the practical effect of benefitting Democrats.

Meanwhile, my baseless theories aside, the Supreme Court has said that it’s fine for the federal government to ignore the law, which is the ultimate assault on our Constitution. And the invasion of America continues unabated.


Illegal aliens are killing Colorado’s second-largest hospital

Unlike conservatives, who tend to be linear, simplistic thinkers, in part because conservativism is about clarity and clarity leads to an Occam’s Razor simplicity, leftists are more Machiavellian, hatching ideas that achieve multiple goals. That’s the case with illegal immigration: It adds probable Democrat voters (both legal and illegal), plumps up the census numbers for more representatives in the House, provides gardeners and housecleaners…and their numbers help break the system, which is the Cloward-Piven strategy to pave the way for full socialism. If the fate of Denver Health Medical Care is anything to go by, the Cloward-Piven plan is working.

Here’s what you need to know to appreciate the import of what’s happening to Denver Health. First, Colorado is a sanctuary state. Second, Denver Health is the largest hospital in Denver and the second largest in Colorado. It’s also one of only five Level I Trauma Centers in the whole state. With that in mind, here’s the story.

The Denver Post is reporting (hat tip: Legal Insurrection) that Denver Health is near the breaking point and that it cannot survive more illegal aliens. According to the report, it ended 2022 with a $35 million deficit. Although the books aren’t quite closed on 2023, the deficit was even worse last year. The only reason the hospital survived was because it got $20 million from the state, Kaiser Permanente Colorado, and private donors.

Overall, in 2023, the hospital failed to receive payment for $136 million in services provided. This amount included the gap between what the hospital charged Medicare versus what Medicare actually paid. Unfortunately for Denver Health, fewer than 15% of its patients have private insurance, which pays a greater percentage of the fee charged than Medicare does.

Because Denver Health is a public hospital, its CEO, Donna Lynne, spelled out the hospital’s dire financial state in a public appearance before the Denver City Council’s finance and government committee. The most interesting part of the statement, aside from the overall economic problems the hospital is facing, is the role of Biden’s open border:

In the last year, 8,000 migrants who came to Denver from Central America made about 20,000 visits to the health system, for needs including dental emergencies, mental health counseling and childbirth, Lynne said. The state and federal governments aren’t reimbursing the cost of those visits, which runs into the millions, she said.

“While I have tremendous compassion for what’s going on, it’s heartbreaking, it’s going to break Denver Health,” she said.

The city estimated more than 36,000 migrants have arrived since December 2022, and about half have decided to stay. Most are fleeing a humanitarian crisis in Venezuela.

As a general matter, our medical system is financially unsustainable. There are four major problems:

Insurance. Medical insurance was originally meant to cover emergency costs. Now, it covers everything. It’s simply a cost-shifting device. Therefore, it seriously perverts the marketplace.

In a free market, the buyer and seller find a mutually agreeable price for goods and services. However, private insurance breaks that bond. The buyer doesn’t care about the price, and the seller is engaged in a price negotiation with a company that doesn’t care about the service and, moreover, that has enormous heft. This three-way system also adds huge management costs, with entire departments in hospitals and full staff in doctor’s offices dedicated to trying to wring money from insurance companies.

To offset the fact that most insurance companies impose discounts on bills, medical providers keep raising their fees. Thus, in a free market, if they felt their service was worth $100, they’d charge $100, and the patient would pay. However, in an insurance-driven market, to get $100, they charge $200. These artificially inflated fees—which sometimes get paid in full—pervert the marketplace.

Government programs. These programs have the same pernicious effect as private insurance, only worse. For hospitals and doctors to get $100, they must charge $1,000. The perversion is even greater.

Pharmaceutical companies. Do I need to say anything about drug costs? The only thing I’ll add is that when countries with socialized medicine boast about how cheaply they sell important drugs to their citizens, remember that they’re able to do that because the same companies offset those losses by charging more in America. The money for research and development, advertising, and profits must come from somewhere.

The change in medical care. Medical care used to be a doctor, a black bag, and herbal medicines and procedures that, if they didn’t kill you, would leave you weaker. Later, care was simple but effective surgeries and miracle drugs. Now, medicine is a money-driven technological science. The technological investment in even the most pared-down doctor’s office is enormous. When you get to hospitals that must keep up with the latest machines for tests and procedures, the cost is almost incomprehensible. And again, someone has to pay.

If you add to all these economic burdens the cost of caring for millions of people who have no right to be in America, and who know that they’ll get treated for free, this fragile system cannot hold. It will collapse. And that’s what Richard Cloward and Frances Fox Piven dreamed of all along: They wanted to break the system and force socialism.


Study: More than 7-in-10 California Immigrant

More than 7-in-10 households headed by immigrants in the state of California are on taxpayer-funded welfare, a new study reveals.

The latest Census Bureau data analyzed by the Center for Immigration Studies (CIS) finds that about 72 percent of households headed by noncitizens and immigrants use one or more forms of taxpayer-funded welfare programs in California — the number one immigrant-receiving state in the U.S.

Meanwhile, only about 35 percent of households headed by native-born Americans use welfare in California.

All four states with the largest foreign-born populations, including California, have extremely high use of welfare by immigrant households. In Texas, for example, nearly 70 percent of households headed by immigrants use taxpayer-funded welfare. Meanwhile, only about 35 percent of native-born households in Texas are on welfare.

In New York and Florida, a majority of households headed by immigrants and noncitizens are on welfare. Overall, about 63 percent of immigrant households use welfare while only 35 percent of native-born households use welfare.

President Trump’s administration is looking to soon implement a policy that protects American taxpayers’ dollars from funding the mass importation of welfare-dependent foreign nationals by enforcing a “public charge” rule whereby legal immigrants would be less likely to secure a permanent residency in the U.S. if they have used any forms of welfare in the past, including using Obamacare, food stamps, and public housing.

The immigration controls would be a boon for American taxpayers in the form of an annual $57.4 billion tax cut — the amount taxpayers spend every year on paying for the welfare, crime, and schooling costs of the country’s mass importation of 1.5 million new, mostly low-skilled legal immigrants.

As Breitbart News reported, the majority of the more than 1.5 million foreign nationals entering the country every year use about 57 percent more food stamps than the average native-born American household. Overall, immigrant households consume 33 percent more cash welfare than American citizen households and 44 percent more in Medicaid dollars. This straining of public services by a booming 44 million foreign-born population translates to the average immigrant household costing American taxpayers $6,234 in federal welfare.

Try the reality that illegal immigrants are routinely given free public housing by the U.S., based on the fact that they are uneducated, unskilled, and largely unemployable. Those are the criteria, and now importing poverty has never been easier. Shockingly, this comes as millions of poor Americans are out in the cold awaiting that housing that the original law was intended to help.
