But temporary decision is really just the beginning of the court fight

Washington, D.C. (January 25, 2024) – A Center for Immigration Studies analysis highlights this week’s Supreme Court order vacating an injunction imposed by the Fifth Circuit in DHS v. Texas. The case, brought by the state of Texas, sought to stop Biden’s CBP from destroying portions of a 29-mile section of concertina-wire (“c-wire”) barriers erected by the state along the Rio Grande to deter illegal migrants. Two of the Court’s conservatives — Chief Justice John Roberts and Justice Amy Coney Barrett — joined the three liberal justices in that decision, but their order hardly settles the matter. In fact, given the unresolved factual and legal issues in this case, it’s really just begun.

“Texas’s legal effort to stop Biden’s CBP from destroying its property is far from over,” said Andrew Arthur, the Center’s fellow in law and policy and author of the analysis. “It will now go back to the Fifth Circuit to address Texas’s legal arguments in full.”

This conflict over whether the federal government or Texas is responsible for the enforcement of the border began in March 2021, when Texas Gov. Greg Abbott launched “Operation Lone Star,” a state effort to respond to the massive wave of migrants pouring across the border unleashed by Joe Biden’s reversal of his predecessor’s successful border deterrence policies. Under the initiative, Texas deployed state troopers and National Guard troops to monitor and respond to illegal border crossings.

It came to a head with the end of Title 42 on May 11, when the Texas Department of Public Safety (DPS) and Texas Military Department (TMD) began installing concertina wire barriers on the Texas side of the river to prevent smugglers and illegal entrants from crossing into populated areas where they could disappear before arrest. Customs and Border Protection (CBP) was apparently grateful for the help, except along 29 miles of the border in Maverick County, where agents began removing the c-wire in September, encouraging migrants to enter the country. The case has been making its way through the courts ever since.

Texas State Attorney General Ken Paxton issued a statement in response to the SCOTUS ruling, characterizing the Court’s order as “temporary” and stating, “The destruction of Texas’s border barriers will not help enforce the law or keep American citizens safe. This fight is not over, and I look forward to defending our state’s sovereignty.”

Arthur commented, “There are a lot of news cameras on the border; every time CBP rips out that wire, it will be seen by the public, and show voters how little interest the Biden administration has in enforcing the law.”

Pro-migration Republican senators are trying to revive the border giveaway plan amid GOP splits, establishment finger-pointing, and growing public opposition.

The establishment backlash on Thursday morning came after the Wednesday admission by Republican Leader Sen. Mitch McConnell that GOP voters and swing voters are increasingly alarmed by President Joe Biden’s ruthless pro-migration economic policy.

“Anger and confusion on Hill as Trump appears to have blown up delicate compromise on immigration — and with it, aid to Ukraine and Israel,” said a tweet from Manu Raju, CNN’s reporter on Capitol Hill.

“Reading the confusion coming from the leader from the border bill puts a lot of question marks in my mind about where we’re going from here,” said Sen. Mitt Romney (R-UT), who later insisted to CNN that everything is back on track:

The ambiguity that was around for the last few hours has been clarified for all of us. [McConnell] is fully behind the border bill, fully behind the support for Ukraine, and is not going to let political considerations of any campaign stand in the way of his support … Leader McConnell removed any question about his support. He said he is fully supportive of the border bill as he indicated for the last several weeks.

Democrats bitterly blamed Donald Trump for the breakdown. “We don’t live in a world today in which one person inside the Republican Party holds so much power that they could stop a bipartisan bill,” said Sen. Chris Murphy (D-CT), the Democrats’ chief negotiator. “I’m just gonna keep my head down — I’m working with [Republican] partners who want to deal,” he added.

The Thursday breakdown followed reports from Wednesday evening. “MCCONNELL told a closed meeting of Senate Republicans Wed[nesday afternoon] that the politics of the border has flipped for R[epublicans]s and cast doubt on linking Ukraine and border,” Punchbowl News reported early Wednesday evening. The report added:

McConnell referred to [Donald] Trump as “the nominee” and noted the former president wants to run his 2024 campaign centered on immigration. And the GOP leader said, “We don’t want to do anything to undermine him.”

McConnell’s comments were ambiguous but important, said Chris Chmielenski, president of the Immigration Accountability Project.

McConnell’s deputy has already said that McConnell will only back the bill if it is approved by more than half of the 49-member caucus, meaning, by a large bloc of the roughly 20 Senators who do not care much about the issue, said Chmielenski.

So McConnell’s ambiguity gives that Republican bloc tacit permission to spotlight the hostile polls when they oppose the giveaway, he said:

That’s the dynamics that changed yesterday. Prior to yesterday afternoon’s meeting, he was whipping hard in favor of the bill that doesn’t exist. Now he’s saying, “Do whatever you’d like.”

This zig-zag policy is rational for McConnell, said Chmielenski:

It allows him to say privately to his donors, “Listen, I want open borders, I want to expand legal immigration, illegal immigration, all of the above, let’s bring in more.” But at the same time, he can go to the Republican base [via media outlets], and say, “Yeah, listen — I didn’t say that I’m in favor of this” without saying [publicly] that he’s opposed to it.

“It’s hard to say what leadership is thinking.” said Sen. J.D. Vance (R-OH).“There’s a chance that [McConnell is] signaling to Democrats that they have to budge a whole lot more than they have so far … [and] there’s a chance that he sees the political writing on the wall, that the package just doesn’t have a great future.”

But a careful read shows how McConnell’s top deputies on Thursday morning were also being evasive and ambiguous as they tried to zig-zag between vital donors and irreplaceable voters.

“I think, for now at least, there’s still an attempt being made to try and reach a conclusion that would satisfy a lot of Republicans,” Senate Minority Whip John Thune (R-S.D.) told reporters on Thursday. “We’re at a critical moment and we’ve got to drive hard to get this done [and] if we can’t get there, then we’ll go to plan B.”

“What he was talking about was what he saw as sort of the political challenges of moving forward,” said Sen. John Cornyn (R-TX). “He wasn’t waving a white flag on border security at all.”

Sen. James Lankford (R-OK), who serves as McConnell’s chief negotiator, also took an ambiguous line in interviews. “He’s not making any recommendation, he’s not backing away from this,” Lankford said.

“I think he was laying out the politics — I definitely didn’t get that he was backing away at all.”

The angriest pushback came from the GOP’s strongest supporters of the more-migration bill.

Sen. Mike Rounds (R-SD) declared he is “personally fully engaged in both the border and getting [funding for] Ukraine and Israel together.”

“That’s like parallel universe shit,” responded Sen. Thom Tillis (R-NC) when he was asked about Republican opposition to the deal. Tillis is one of the strongest advocates for the deal, partly because it would allow the federal government to import an extra 700,000 no-rights, low-wage workers and renters via the “parole” loophole in the border.

In reality, leaked reports suggest that the border deal will accelerate the government-managed flow of illegal migrants into Americans’ workplaces. The deal will also boost funding for government programs that move migrants from South America into U.S. cities and also spend more taxpayer dollars to house, feed, train, and hide migrants throughout the 2024 election.

The leaked descriptions of the bill do not include any significant curbs on illegal or illegal migration. Instead, the bill would allow many more migrants to be imported for low-wage jobs that would otherwise go to Americans for decent wages.

The bill also includes new incentives for foreign college graduates to take jobs for low wages at Fortune 500 companies. Those imported graduates push many young American graduates off the first rung of a career ladder.

Many advocates for more migration blamed Donald Trump, not migration’s damaging impact on American citizens.

“Anything that interrupts that negotiation I think would be tragic. … I hope no one is trying to take this away for campaign purposes,” said Sen. Todd Young (R-IN).

“This is down to a political decision for Republicans as to whether they want to solve this problem or whether they want to keep it available for Trump to use it as a wedge,” Democrat Murphy said.

“The American people are suffering as a result of what’s happening at the border,” Romney told reporters. “Someone running for president not to try and get the problem solved. as opposed to saying, hey, save that problem. Don’t solve it. Let me take credit for solving it later.”

Lobbyists are looking for alternative ways to preserve their government-imported supply of workers, renters, and consumers.

“This moment was inevitable,” tweeted Andrea Flores, a top lobbyist for investors at FWD.us who profit from more migration:

Even when Trump’s own policies were part of this deal, it wasn’t enough. It’s time for Democrats to identify their own solutions at the border and help Biden focus on developing a federal response to the migrant crisis in cities.

Democrats need to stop letting Trump determine the policy solutions in this moment, because once again – eliminating parole and bringing back Title 42- will make the border worse. Dems have better solutions than the ones comprising this deal, they just have to start selling them

Biden’s borders policies are now the top issue in U.S. politics, according to a January 17-18 poll for Harvard University. The poll reported that 57 percent of the voters said, “I miss Donald Trump’s policies on the economy, immigration, and crime.”

Alex Marlow: Biden Administration Staging an ‘Insurrection’ of the U.S. Through Continued Efforts to Keep Border Open

Breitbart News editor-in-chief Alex Marlow told former U.S. Assistant Secretary of the Treasury for Public Affairs Monica Crowley the Biden administration is creating an “insurrection” of the United States through its continued effort to keep the border open and allow illegal immigration.

Crowley asked Marlow to react to the Biden administration going “all the way to the Supreme Court to pressure the states to allow the federal government policy of a wide-open border and the illegal immigrant invasion to continue,” to which the Breitbart editor-in-chief said, “This is an insurrection that’s being allowed by our federal government.”

Marlow was speaking to the former U.S. Assistant Secretary of the Treasury for Public Affairs during a recent episode on The Monica Crowley Podcast.

“It is allowing millions upon millions of people who either themselves or their progeny will vote for Democrats,” Marlow continued. “It is creating imbalance in our country for people who are not even Americans.”

“Many of them have no intention of being Americans,” he added. “A lot of them are economic migrants.”

“It is a deliberate effort to undermine American sovereignty, American values,” Marlow affirmed. “There is nothing worse in America right now than this. I have a chapter in ‘Breaking Biden‘ where I describe America as a sanctuary country. That’s how were treating it.”

“That is Joe Biden’s America, and the fact that the Supreme Court is codifying it should outrage every single person, regardless of your political stripes,” the editor-in-chief added.

Crowley noted that time will tell, as the ruling “does still have to go through the circuit, then probably back up to the Supreme Court.”

“It’s not totally over yet,” she said. “So we will see how the process unfolds. But for the time being, the states now have no recourse.”

“It’s entirely possible that Texas will just ignore this Supreme Court ruling the way the Biden administration ignores Supreme Court rulings on things like student loan forgiveness,” Crowley added.

As Breitbart News reported, a divided Supreme Court issued a stay on Monday allowing Biden administration agents to open Texas’ border barrier, blocking an appeals court ruling that favored Texas in the ongoing fight between the Biden administration’s open border policies and Texas’ attempts to secure the border.

Two Republican-appointed justices joined the Democrats in a five-to-four vote on this temporary stay as litigation continues in the lower court.

News of Dex’s death due to an accidental fentanyl overdose comes one day after Rick Harrison, one of the chief talents on Pawn Stars, revealed that his 39-year-old son, Adam, died from a fentanyl overdose, which he blamed on the border crisis.

“The fentanyl crisis in this country must be taken more seriously. It seems it is just flowing over the borders and nothing is being done about it. We must do better,” he said.

The annual death toll from fentanyl poisoning among Americans now equals the annual death toll of American soldiers in World War II. But Biden has made no effort to deter the Chinese from poisoning Americans citizens by, for example, ending the subsidies we provide to their economy or revoking China’s Most Favored Nation trade status, or closing all the Confucius Institutes in our universities set up to steal our technologies. So they want billions and billions in assistance to foreign countries, such as Ukraine, which is not a NATO country, but a big hog wallow for the U.S. foreign policy consulting establishment, nearly all Democrats, drawing lots of "contracts," if not losing track of the money entirely, as a top Ukrainian official admitted, but they refuse to lift a finger to halt Joe Biden's open-borders policies, which have created untold misery on city streets as migrants are dumped, human trafficking networks are empowered, cartels are growing so rich they are driving Mexicans out of their homes, families are being separated and broken up and kids sold into slavery based on Biden's immigration incentives, migrants are dying en route through dangerous crossings, illegal alien crime is growing, and Democrat-led cities are seeing their budgets blown out and vital police and fire services cut.

A word about the elections down Mexico way

Mexicans elect a new president every six years.  So it occasionally happens that the U.S. and Mexico have elections on the same year. Such is 2024, when voters in both countries will get to choose a new president and Congress.

Former U.S. ambassador to Mexico Earl Anthony Wayne has expressed some concerns about democracy south of the border. This is what he wrote:

AMLO has been very critical of the Supreme Court and other autonomous institutions that were created over the years as Mexico was building its democracy. However, AMLO has not had the two-thirds majority in both houses of Congress needed to approve the constitutional reforms he would like to see. His attempted reforms have sparked very large counter demonstrations and been rebuffed by Mexico’s courts, but he has persisted in his calls for constitutional change.

During AMLO’s six-year tenure, the independent global indexes on democracy and related issues, including corruption and rule of law, have reported deterioration and backsliding in the quality of Mexico’s democracy. The 2023 World Justice Project’s Rule of Law Index, for example, tracks a decline in Mexico’s rule of law score during AMLO’s term and currently ranks Mexico at 116 out of the 142 countries measured. Thus, the outcome of the Mexico’s elections could be very important for the strength of Mexico’s democratic institutions.

Not surprisingly, many in Mexico see the 2024 elections as a test for maintaining the strength of its democracy – echoing themes being heard in the U.S. election campaign.

Interesting.  I learned this week that Mexicans are planning a huge march nationwide to protect their democracy from what they see as AMLO's overreach.  

At the moment, AMLO’s candidate, Claudia Sheinbaum, looks like an easy winner in the upcoming election.  She is leading against opposition candidate, Senator Xóchitl Gálvez, by a strong margin.  One of these two ladies will be the next president of Mexico and it looks like it will be Claudia.

The real threat to democracy is that AMLO doesn't go away.  I am not saying that he stays as president but rather does not leave the stage.  His candidate Sheinbaum looks more and more like a puppet of AMLO.  She is a well-educated woman but does not have the personality to match AMLO's political skills.

At some point, likely President Sheinbaum may have to lock AMLO in the closet and prove to Mexicans that she is in charge.  It will be tough.

Jim Jordan Subpoenas Xavier Becerra for Details on Criminals, Gang Members Posing as Migrant Children

House Judiciary Committee Chairman Jim Jordan (R-OH) has subpoenaed Health and Human Services (HHS) Secretary Xavier Becerra for information on the agency’s handling of criminals and gang members posing as Unaccompanied Alien Children (UACs) in the hopes of being released into the United States.

On Tuesday, Jordan announced that he subpoenaed Becerra, suggesting that HHS has been less than forthcoming regarding how the agency handles UACs who are discovered to be criminals and gang members.

HHS oversees the UAC program, in which children arriving at the U.S.-Mexico border are briefly taken into Department of Homeland Security (DHS) custody before being transferred to HHS custody, where they are eventually placed with an adult sponsor — the majority of whom are not their biological parents.

According to Jordan, the Judiciary Committee has asked repeatedly since June of last year for all information from HHS regarding where UACs are placed, the vetting process for adult sponsors, and what the agency does when a UAC is found to be a criminal or gang member.

HHS, Jordan alleges, has been unable to disclose the total number of UACs that the agency has placed in the custody of a known sex offender or the number of adult sponsors who have been rejected for being a convicted criminal, including a convicted murderer.

From Fiscal Year 2021 through Fiscal Year 2023, more than 370,000 UACs have been released into the U.S. interior by Biden’s DHS. The majority of UACs, 61 to 66 percent, are males, while 69 percent to 72 percent are 15 to 18-years-old.

As Breitbart News has chronicled, Becerra has been unable to guarantee that 100 percent of adult sponsors’ homes are inspected before a UAC is placed in their care — a requirement for many pet adoption programs, Rep. Debbie Lesko (R-AZ) previously noted.

Last year, the New York Times released a bombshell report suggesting that more than 85,000 UACs released into the U.S. interior had been lost in the system after being sent to live with adult sponsors — most of whom were not their biological parents — by HHS.

HHS losing contact with these UACs coincides with a boom in labor trafficking among migrant children. The labor trafficking pipeline has gotten so out of hand that the Department of Labor Inspector General has opened an investigation into the Biden administration’s handling of the issue.
