President Joe Biden’s pro-migration border chief will certainly face softball questions from Democratic Senators on Tuesday morning — and likely a flurry of uncoordinated, unfocused questions from cautious GOP Senators during the two-hour event.

In prior hearings, GOP Senators have been eager to demonstrate theatrical opposition against Alejandro Mayorkas’ determined welcome for at least 4 million illegal-migrant workers, consumers, and renters.

The theatrical opposition allows the GOP Senators to zig-zag between their voters’ opposition to the wage-cutting policies and their business donors’ support for the profit-boosting inflow.

The GOP side of the hearing will be led by Sen. Rand Paul (R-TN), who has pushed for policies that would allow U.S. employers to hire foreign graduates instead of young American graduates.

There are several GOP members who might push Mayorkas to reveal useful information, such as the number of migrants he plans to admit during the next year, regardless of Congress’ 1965 and 1990 immigration laws.

Title 42 stands between the U.S. and chaos at the border

Migrants have been masssing at the U.S.-Mexico border waiting for the Title 42 health program to expire on May 11. Why? Once it does, it will create an opportunity for the migrants to cross the border and get a toehold in the United States.

“There are thousands and thousands just waiting for Title 42 to end. I would say a fear is that the Biden admin has no clue just how bad it’s going to get. We can barely actively patrol the border now. When Title 42 ends, all of our resources, all of our little manpower that we do have, are going to be focused on processing. Field work will nearly cease to exist in my opinion,” a Customs and Border Patrol agent working along the southern border told the Daily Caller News Foundation.

Title 42 was established during the Trump Administration at the beginning of the COVID pandemic. Border officials can automatically refuse entry to migrants who may have been infected by the deadly virus. ​According to government statistics, ​2.5 million potential illegal immigrants have been turned away at the border.

Some border states challenged the end of the order, but that only delayed the inevitable end. And once it does end, the Department of Homeland Security estimated CBP could be expected to handle up to 14,000 illegal immigrants each day, a source told CNN.

Yet, despite that expected wave of illegals, little to nothing has been done to prepare the southern border for the surge.

“Most of the time, we are just told that Title 42 will end eventually and to be mentally prepared for the influx of migrants when it does. Regular line agents don’t seem to be offered an outline or plan as to how we will actually deal with the large numbers at the processing level,” one agent told the DCNF.

While the program can’t and shouldn’t remain in place indefinitely, right now it is protecting our southern border. Even the Biden Administration has admitted that once it expires, there will be a surge of illegals. 

So why hasn’t more been done? Agents reassigned. Temporary facilities arranged for. National Guard or other military deployed.

The federal government knows that Customs and Border Patrol and border communities can’t handle the expected wave of people crossing illegally. El Paso, which has a Democrat mayor, has already declared a state of emergency in the city because of the overwhelming demand for services that the growing illegal immigrant population requires, and the city can’t provide. And he did that while Title 42 is still in effect.

Meanwhile, the White House appears to be doing nothing to strengthen our border. When Press Secretary Karine Jean-Pierre was asked what Vice President Kamala Harris is doing to address the “root cause” of mass migration to the southern border, which is something she has been put in charge of, Jean-Pierre said, “I don’t have anything to lay out specifically on what that work looks like.”

When that wave of illegals hits the border, it will be a tidal wave that overwhelms the order and facilities along the border unless the government starts preparing now. It may be too late, but anything that can be done to better prepare is better than nothing.

Border Crisis Milestone: 2 Million Illegals Released into U.S.
Higher than the number of legal immigrants admitted
Washington, D.C. (April 18, 2023) – A new analysis by the Center for Immigration Studies reveals that the number of illegal migrants released into the United States by the Biden administration’s catch-and-release policies has now passed the 2 million mark.

The milestone of 2 million illegal-immigrant releases is calculated from publicly available data and is a conservative figure. A complete accounting of the number of releases would include certain data which the administration has hidden from the public, such as the number of migrants released by CBP’s Office of Field Operations after June 30, 2022, or aliens transferred by CBP at the Southwest border to ICE and released after that date.

An additional 1.4 million aliens have illegally entered the country after having been detected, but not apprehended, by the Border Patrol, so-called “got-aways”.

These policies have not only allowed these illegal migrants to enter the United States, but have also encouraged an untold number of additional migrants to make the dangerous journey to the Southwest border.

Andrew Arthur, the Center’s resident fellow in law and policy and author of the posting, notes that “the United States is now in unchartered waters, allowing entry to more illegal aliens than legal immigrants; in all of FY 2021 and FY2022, DHS gave out only about 1.76 million new green cards to lawful immigrants.”

Arthur continued, “As Barbara Jordan, civil rights icon and former chairwoman of President Clinton’s bipartisan U.S. Commission on Immigration Reform, said in 1994, ‘If we cannot control illegal immigration, we cannot sustain our national interest in legal immigration. Those who come here illegally, and those who hire them, will destroy the credibility of our immigration policies and their implementation. In the course of that, I fear, they will destroy our commitment to immigration itself.’ That’s exactly what’s happening in the United States today.”

President Biden’s refusal to disclose total figures on migrant releases at the Southwest border makes it difficult to get a full accounting of the number of illegal migrants who have been released into the United States. Most of the publicly available information on Biden administration’s migrant releases comes from a court order in Texas v. Biden, a case filed by the states of Texas and Missouri in April 2021 to force DHS to re-implement the Trump-era Migrant Protection Protocols (MPP better known as Remain in Mexico).

The judge in that case required DHS to file monthly reports with the court disclosing the total number of migrants released by DHS at the Southwest border. After that order was lifted, the Biden administration refused to voluntarily disclose information on the hundreds of thousands of illegal migrants released by OFO and ICE, although Border Patrol does publish monthly statistics on its Southwest border releases.
