Wisconsin's Waukesha killer gets sentenced, but justice has not been served
Darrell Brookes, who mowed down a Christmas/Thanksgiving parade full of people in a car attack in Waukesha, Wisconsin on Nov. 21, 2021, has been sentenced to six consecutive life sentences for homicidally driving into the crowds and killing six.
The sentence following the announcement of a guilty verdict on all counts was announced on Wednesday, Nov. 16, 2022. Additionally, he received hundreds of years of sentences (17.5 years each) for running over and seriously injuring 61 other persons at the parade.
The judge, Jennifer Dorow, who presided over the proceedings that lasted approximately one month explained in detail the reasoning behind her decision to apply the maximum sentences upon Brooks for his criminal deeds which, in her remarks, she defined as “evil.” She particularly was at pains to emphasize that his psychological problems were not sufficient either to have allowed for a plea of guilty by reason of insanity nor for mitigating the maximum allowed sentences which she applied.
The focus for rejecting any complaint about the sentencing based on Brooks’ mental health was four reports by four different forensic psychologists who argued that while Brooks had a personality disorder, it was not of a kind to override his responsibility for the homicidal use of his mother’s red SUV in mowing down so many innocent people. Judge Dorow made a point of reading from the reports of the psychologists to emphasize that her conclusion was not that merely of herself as a sensitive jurist, but that of professionals who specialize in criminal psychology who had clearly and unanimously declared his responsibility for the attacks despite certain psychological issues that afflict or dominate areas of his life.
Brooks’ calm, cool, and collected behavior after his rage-filled assault on the loving, happy parade-goers was evidence that he was in his right mind and that that mind is evil. After completing his rampage, he tried to divest himself of his identity and get away. He threw away the jacket he was wearing, re-arranged his hair, and in his haste to get away from the SUV, left his cell phone behind. His clear attempt to distance himself from the SUV and get away was calm and collected, and he asked several people if he could use their phones to make a telephone call. He was not distraught, emotional, or incoherent. He wanted to call his mother to ask her to call an Uber to ride out in. Finally, he asked a homeowner if he could make a call, and the man allowed him to come in and make the call. Brooks was relatively calm and collected, and the pleasant man even gave him a sandwich and a jacket to put on since it was a cold Wisconsin night.
But the man grew suspicious when he saw many police cars driving by and told the police that this unusual “guest” (Brooks had lost his shoes as he rushed to get away from his vehicular weapon) was in front of his house. When the police arrived, they told Brooks to lie down on the ground so they could cuff him and take him into custody.
There was no resistance. He lay on the ground, and they cuffed him and took him in.
His behavior was calm, cool, and collected – not deranged.
Therefore, the judge’s summary justification for assigning the maximum sentence to Brooks was a beautiful and mighty summary of his responsibility and culpability.
The suffering and devastation of his actions was clearly delineated, and his very ability to serve as his own attorney with some very cogent legal arguments was used by her to reveal his guilt and moral responsibility. Hearing the judge, it was clear that he cannot escape the worst possible punishment that can be given and that assigning such punishment of multiple consecutive life sentences is the proper remedy for the victims and serves the interest and demands of justice as far as possible under Wisconsin law..
Yet, despite the logic and exquisite eloquence of the judge’s presentation, this writer and perhaps millions of others felt let down and bereft. Seeing Brooks’ Bible open before him and his claim to walk with Jesus Christ was a devilish reminder that the perfect wisdom and articulate reasoning of Judge Dorow is not really complete.
Wisconsin has eschewed the death penalty since 1853 and despite Wisconsin’s shift towards a more conservative political philosophy in recent years, the state still did not restore the death penalty in 2006, despite a referendum that favored that change.
In this year’s election, Sen. Ron Johnson barely defeated the radical leftist Mandela Barnes. The closeness of that race may indicate a swing back to that state’s progressive/socialist period when Robert La Follette was a governor and senator from that state and ran for president on the Progressive Party line in 1924.
Following the George Floyd riots, the long, detailed justification by the judge for throwing the book at Brooks may have been motivated not mainly by judicial probity but also by a desire to pander to the tide of leftism that is rising in Wisconsin and elsewhere. Her long discourse about his responsibility and guilt cannot satisfy people like myself who believe that the death penalty is a righteous, biblically sanctioned punishment. Although Wisconsin has no death penalty, that repudiation of it is unbiblical and unjust. Jesus said, “You shall not murder, You shall not commit adultery, You shall not steal, You shall not bear false witness, (Matthew 19:18) And when Jesus was dying on the cross, and was disparaged by the murderer who was alongside him, the thief on the other cross rebuked the murderer. He said, “Do you not fear God, since you are under the same sentence of condemnation? And we indeed justly, for we are receiving the due reward of our deeds; but this man has done nothing wrong.” [my italics]
Reading four reports by forensic psychologists justifying multiple life sentences is a beautiful academic exercise by the judge, but the court’s inability to give the just punishment remains disheartening.
However, she may be trying to head off those on the left who may think that multiple consecutive sentences are not sufficiently compassionate regarding a black criminal who has been oppressed and abused by “the system.” In that respect only, her analysis and rationale may be soothing and needed.

University claims a student scalp for Black Lives Matter
I reported previously that Hardin-Simmons University (HSU) expelled or otherwise forced out a student for a Tik-Tok video that said about Black Lives Matter essentially what New York's new Mayor, Eric Adams, said about it earlier this year. "I thought Black lives mattered. Where are all those who stated Black lives matter? Then go do an analysis of who was killed or shot last night. I was up all night speaking to my commanders in the Bronx and Brooklyn. The victims were Black. Many of the shooters were Black.” BLM leader Hawk Newsome's reply was call Adams a racial slur and a "white man in blackface," the typical response of a race hustler who has no facts to support his argument.
HSU now faces a bleak future not only because of sharply declining enrollments, but also other unrelated issues for which its faculty issued a "no confidence" vote for President Eric Bruntmyer. The Sandefer family, which is to HSU what the Cornell family is to Cornell University, proclaimed that it literally wouldn't want to be caught dead on HSU's campus. The American Council of Trustees and Alumni has meanwhile expressed multiple concerns about HSU's governance. None of this, except possibly the declining enrollments, is related to the BLM controversy but the latter is ample reason for high school seniors to shun HSU in the absence of corrective actions including repudiation of BLM and a public apology to the student involved.
Did HSU Violate FERPA?
I am phrasing this as a genuine question because I am not qualified to give legal advice on anything, let alone what constitutes a violation of the Family Educational Rights and Privacy Act. Page 45 of a FERPA training presentation from HSU's own web site says (emphasis is mine), "Institutions may disclose education records without written consent of students to the following: The public regarding the final results of an institutional disciplinary proceeding so long as the student has been determined to be the alleged perpetrator of a crime of violence or non-forcible sex offense." Condemnation of BLM is not any crime, so this is not applicable.
Campus Reform reports, however, "The university made a public statement confirming that the student is no longer enrolled at the school" and added, "Citing privacy concerns, Bruntmyer stated that he could not disclose the disciplinary actions that were taken against [the student] but can confirm that she is 'no longer enrolled at Hardin Simmons University.'" Bruntmyer's video stipulates that he knows HSU must comply with Federal law (e.g. FERPA). He then said almost in the same breath that he can confirm that the student is no longer enrolled in HSU which comes across to me (my perception, you are free to agree or disagree) as a very explicit disclosure of what happened.
Did HSU Violate its Own Code of Conduct?
There are even questions as to whether disciplinary action against this student violated HSU's own Code of Conduct. The only loophole seems to consist of "some speech is nonetheless inconsistent with the Golden Rule found in Matthew 7:12, and students are encouraged to live by this higher standard rooted in our Christian faith and heritage." First, whether the speech is inconsistent with the Golden Rule is a matter of subjective opinion and second, the rule says "encouraged" and not "required."
"Off-Campus Freedom of Students" adds, "College and university students are both citizens and members of the academic community. As citizens of the United States, students will enjoy the same freedom of speech, peaceful assembly, and right of petition that other citizens enjoy; and, as members of the academic community, they are subject to the obligations that accrue to them by virtue of this membership. Faculty members and administrative officials should ensure that institutional powers are not employed which inhibit such intellectual and personal development of students as is often promoted by their exercise of the rights of citizenship both on and off campus." This section adds that unlawful behavior is not protected, but this is not an issue here.
If HSU can expel or otherwise force out a student for an accurate condemnation of Black Lives Matter, and publicly shame the student involved, it can do the same to any student who says something with which HSU administrators disagree. Intelligent people avoid dogs that are known for biting without provocation.
If high school seniors in Texas want a college with a Baptist religious environment, this map of Texas State University shows multiple Baptist churches very close to and even on the campus. There is a Baptist student center on campus. The Texas State Baptist Student Ministry (BSM) is right on campus. Texas State's tuition is less than $12,000 a year versus more than $30,000 for HSU. You also don't have to worry about being "canceled" by "woke" University administrators at Texas State because, according to the ACLU, "Restrictions on speech by public colleges and universities amount to government censorship, in violation of the Constitution." Add to this financial talk show host Dave Ramsey's opinion of expensive private colleges in general—and Ramsey is himself apparently a Baptist Christian—and you have very strong arguments for choosing community colleges and/or Texas State over HSU and indeed other private universities.
Were HSU's Actions Christian?
People throughout history have claimed to speak for God, Jesus, Allah, and so on to justify some very bad behavior such as the Inquisition, witch trials, the Thirty Years War and, more recently, terrorism in the Middle East and Central Asia. Patriarch Kirill of the Russian Orthodox Church says God is on Vladimir Putin's side. Rabbi Eric Yoffie of the Union of American Hebrew Congregations found somewhere in Judaism a "religious obligation" to vote for enemies of the Second Amendment. The behavior of the reverends Al Sharpton and Jeremiah Wright, and minister Louis Farrakhan, speak for themselves, as does that of the Westboro Baptist Church.
Prospective HSU applicants might therefore want to listen to Alpha & Omega Ministries' take on Hardin-Simmons and also Black Lives Matter, which is very different from Dr. Bruntmyer's. This video calls HSU an "allegedly Christian university," and the backlash on HSU's Facebook page is highly instructive as well. The fact that I cannot find even one comment that supports the university's actions does not mean there aren't any among the eight hundred or so there, but the reaction was overwhelmingly negative.
HSU Backed the Wrong Horse Big Time
Not only was what the student, and Mayor Adams, said about BLM accurate, BLM also meets the Anti-Defamation League's and International Holocaust Remembrance Alliance's definition of an anti-Semitic organization; one that denies the right of Israel to exist. BLM has, at its highest levels (e.g. Patrisse Cullors) promoted Rasmea Odeh, a Popular Front for the Liberation of Palestine terrorist who murdered two Jews with a bomb. BLM refers to convicted cop killer Joanne Chesimard, aka Assata Shakur, as "Mama Assata." BLM has also condoned looting and rioting. We do not need to associate ourselves with something like BLM to denounce segregation, discrimination, civil rights violations, and similar conduct that has been neither legally nor socially acceptable in our country for more than fifty years.
"Cancel culture" is simply the latest incarnation of McCarthyism, under which people's lives and careers could be ruined with a mere accusation of affiliation with Communism. Today's "cancelers" call you a racist instead and demand that you be fired or expelled. This homegrown cancer must be called out and eradicated from our society wherever it appears.

This past week New Orleans reclaimed the title of America’s deadliest city after seeing murders jump 141% over the last couple of years. In New Orleans, the murder rate is a staggering 52 per 100,000 people. That compares to the national average of 6.9, the highest it’s been in a quarter century, and the 50 per 100,000 in Venezuela, the most dangerous country in the world.

During the summer of 2020, BLM and Antifa wrought violence and did billions of dollars in damage across America. The Democrat left supported those riots and raised money to bail out the perpetrators no matter what they had done. Our media, of course, supported the rioters too; they love nothing better than exacerbating an already-explosive situation. The media do not investigate the obvious possibility that the rioters were recruited and paid to do what they do. Ask one of them why they are rioting and you will get a blank look. They may be doing it for a paycheck, not principles or ideology.

But due to a ton of negative black disparities showing up in the data, the mainstream media pursues a policy of silence on the issue, turning it as a result into a taboo topic.
‘These figures are even more glaring when one considers pet-ownership rates. If blacks owned pets at rates double their own population, their cruelty offense-rates would be less of a concern. But this is not the case. White ownership rates have been shown to be double, even triple, that of blacks, meaning the latter’s propensity for animal cruelty is actually far higher than what’s showing in the FBI’s figures.

As for interracial violence generally, blacks disproportionately commit it. Between 2012 and 2015, there were 631,830 violent interracial victimizations, excluding homicide, between blacks
and whites, according to the Bureau of Justice Statistics. Blacks, who make up 13 percent of the U.S. population, committed 85.5 percent of those victimizations, or 540,360 felonious assaults on
whites, while whites, 61 percent of the population, committed 14.4 percent, or 91,470 felonious assaults on blacks. Regarding threats to blacks from the police, a police officer is 18.5 times more likely to be killed by a black male than an unarmed black male is to be killed by a police officer.
Anti-cop activist Shaun King says that his involvement in the campaign around the Jazmine Barnes murder was not driven by reports that a white man had killed the seven-year-old girl, who was gunned down in Houston on December 30. According to Barnes’s mother and 15-year-old sister, the white driver of a pickup truck had pulled up next to the family’s car before opening fire. The accusation set off a frenzy of hate-crime allegations and blanket coverage by the New York Times. King offered a $100,000 reward to anyone who located the suspect.
As it turned out, Jazmine Barnes was killed by two black men, who opened fire on her mother’s car because they thought that they were targeting enemies of their gang. King passed along a tip about the real killers to the Houston police, and now says that he merely “internalized the pain of the family and tried to search as if it were my own child who was killed.” Race, in other words, had nothing to do with his activism.
It’s worth remembering, though, the many other black children who have been victims of drive-by shootings without leading King to launch a national crusade.
A sampling: in March 2015, a six-year-old boy was killed in a drive-by shooting on West Florissant Avenue in St. Louis, as Black Lives Matter protesters were converging on the Ferguson, Missouri, Police Department to demand the resignation of the entire department. In August 2015, a nine-year-old girl was killed by a bullet from a drive-by shooting in Ferguson while doing her homework in her bedroom, blocks from the Black Lives Matter rioting thoroughfare. Five children were shot in Cleveland over the 2015 Fourth of July weekend. A seven-year-old boy was killed in Chicago that same weekend by a bullet intended for his father. In Cincinnati, in July 2015, a four-year-old girl was shot in the head and a six-year-old girl was left paralyzed and partially blind from two separate drive-by shootings. In Cleveland, three children five and younger were killed in September 2015, leading the black police chief to break down in tears and ask why the community only protests shootings of blacks when the perpetrator is a cop. In November 2015, a nine-year-old in Chicago was lured into an alley and killed by his father’s gang enemies; the father refused to cooperate with the police. All told, ten children under the age of ten were killed in Baltimore in 2015; twelve victims were between the age of ten and seventeen.
In 2016, a three-year-old girl in Baltimore was partially paralyzed by a drive-by shooting. In Chicago in 2016, two dozen children under the age of 12 were shot in drive-bys, including a three-year-old boy mowed down on Father’s Day 2016 who is now paralyzed for life and a ten-year-old boy shot in August; his pancreas, intestines, kidney, and spleen were torn apart. A Jacksonville 22-month-old was shot to death by a passing car last June. In September, three men killed three-year-old Azalya Anderson in a drive-by in Sacramento, and a week before Christmas in Bridgeport, a 12-year-old boy was shot and killed on his way home from the candy store in a drive-by shooting.
Why did King let these shootings of black children go by without responding as he did to Jazmine Barnes’s murder? Could it be because the perpetrators were black? You could end all white shootings of black children tomorrow and it would have zero effect on the death rate of black children by homicide, because such white-on-black shootings are extremely rare. Moral abominations, like the 2015 Charleston church massacre by white supremacist Dylann Roof, are aberrations that belong to the outermost lunatic fringe of American society. The country’s revulsion at the Charleston carnage was immediate and universal, resulting in a movement to banish the Confederate flag, embraced by Roof as a white supremacist symbol, from official sites.
If Shaun King and other Black Lives Matter activists really want to save black children from the trauma of urban violence, they should put their efforts into rebuilding inner-city culture—above all, by revalorizing a married father as the best gift a mother can give her child. Fantasies about white violence against “black bodies” are a distraction from what is actually happening on American streets.

Walter Williams tackles the elephant in the room on crime
Dr. Williams is a well known conservative economist and longtime John Olin Chair faculty at George Mason University in eastern Virginia, author of 12 books and syndicated columnist. In the past, he has been substitute host on the Rush Limbaugh radio program. He is almost like family to me, and I have benefited from his essays and books over the years. This past week, I saw and read his essay on disparities in crime rates among races that was picked up by Military in its October 2019 issue. What got Dr. Williams going was the article by Matthew DeLisi of Iowa State U and John Paul Wright of the U of Cincinnati titled "What Criminologists Don't Say and Why."
Dr. Williams confirms that the writers are right about the liberal tilt of criminologists — "If criminologists have the guts to even talk about a race-crime connection, it's behind closed doors and in guarded language. Any discussion about race and crime ... can mean the end of one's professional career."
Dr. Williams points out teen black-on-white predatory behavior — chronicled in detail by many, particularly Colin Flaherty, whose investigative reports appear frequently (more than 100) at American Thinker — cannot be reported, mentioned, or considered by the media, politicians, criminologists, commentators, politicians, even law enforcement people without risking being called racist, the easy epithet used to enforce a ban on talking about the realities of racial disparities in crime and the increasingly violent nature of black violence against whites — the knockout game, polar bear hunting, flash mob violence against people and property.
Referencing the Wright and DeLisi report, Dr. Williams comments on another reality: that the rate of black homicide and armed robbery as well as other violent crimes are as is as much as 15–30 times more than whites, for example, and he points out the silliness of criminologists' claims that mass incarceration rather than criminality has decimated the black community. He favorably quotes Wright and DeLisi when they say, "What they [criminals] did, in reality was to prey on their neighbors."
Dr. Williams returns to a theme he has explored many times before in this essay and commentary when he points out that the black family of the past was two parents and stable, even back to days of slavery, and that the black community was moral and law-abiding. "The strong character of black people is responsible for the great progress made from emancipation to today. ... [T]oday's conduct among black youth wouldn't have been tolerated yesteryear."
My regret is there aren't enough Walter Williams and Thomas Sowell types to engage the nutty attitudes of liberal chatterbox experts.

Darrell Brooks Receives Life in Prison for Killing 6 Victims in Waukesha Christmas Parade Massacre
Darrell Brooks, 40, received six consecutive life sentences without the possibility of parole on Wednesday for driving an SUV through a crowd at the Waukesha, Wisconsin, Christmas parade last year, killing six victims and injuring 61 others.
The aspiring rap artist was convicted on October 26 on six counts of first-degree intentional homicide and 61 counts of reckless endangerment, bond jumping, and battery for a total of 76 charges.
When Waukesha County Judge Jennifer R. Dorow handed down each life sentence, reading the names of each victim, the courtroom applauded. He was also sentenced to 17.5 years in prison on each endangerment count.
Before being sentenced, Brooks was removed to another courtroom to participate via video because he had become disruptive during the hearing, the Associated Press (AP) reported.
Dorow condemned Brooks’ actions before reading the sentence.
“Frankly, Mr. Brooks, no one is safe from you,” she told him directly. “This community can only be safe if you are behind bars for the rest of your life. … You left a path of destruction, chaos, death, injury, and panic as you drove seven or so blocks through the Christmas parade.”
Brooks, who chose to represent himself in the trial, claimed that he had a history of mental health issues and experienced a difficult childhood while growing up. He then later apologized to the victims’ families.
Dorow dismissed Brooks’ claims that he was mentally ill, noting that four psychologists who had evaluated him earlier diagnosed him with an anti-social personality disorder but no mental illness.
“It is my opinion that mental health issues did not cause him to do what he did on Nov. 21, 2021, and frankly didn’t play a role,” Dorow said on Wednesday “It is very clear to me that he understands the difference between right and wrong and he simply chooses to ignore his conscience. He is fueled by anger and rage.”

On Tuesday, prosecutors asked the judge to give Brooks the maximum sentence for all the convictions he received last month.
“He deserves the absolute maximum sentence on all counts, consecutive,” Waukesha County District Attorney Susan Opper told Dorow via CNN.
Opper continued:
You saw the videos. This wasn’t him plowing into one large group of fifty people at one time and hitting them. It was linear. He hit one, kept going. Hit two, kept going. Hit three, kept going. All the way down the street. That’s consecutive sentences, your honor. That’s intentional, willful, volitional conduct that warrants consecutive sentences stacked one on top of the other just as he stacked victims up as he drove down the road in complete disregard for any other person whatsoever.
Before he used an SUV to drive through Christmas parade-goers in downtown Waukesha — located about 16 miles west of Milwaukee — on November 21, 2022, Brooks had gotten into a fight with his ex-girlfriend.
He never explained his motive for his homicidal actions during the trial.
Brooks’ trial was full of disruptions due to his frequent outbursts, which forced Dorow to remove him from the courtroom multiple times, where he would participate via video.
During a pre-trial hearing in August, Brooks was removed from the court after launching a verbal tirade toward Dorow, Breitbart News reported.
Then in October, before the prosecution team was about to read Brooks’ lengthy criminal history, he slammed his hands on the table in front of him and started to stare down Dorow in a menacing manner. The judge paused the trial due to his behavior.
I need to take a break. This man right now is having a stare-down with me. It’s very disrespectful. He pounded his fist. Frankly, it makes me scared,” Dorow told the court at the time.
The victims who were killed by Brooks in the massacre last year include Jackson Sparks, 8; Jane Kulich, 51; Tamara Durand, 52; Lee Owen, 71; Virginia Sorenson, 79; and Wilhelm Hospel, 81.
Wisconsin does not have the death penalty.
