Feinstein's 'private bills' help constituents avoid deportation

WASHINGTON — On the morning of Jan. 28, federal agents knocked on Shirley Tan's door, showed her a deportation letter and then put her in handcuffs.

"I was put into a van with two men in yellow jumpsuits and chains and searched like a criminal in a way I have only seen on television and in the movies," said Tan, 44, a housewife and mother from Pacifica.

But today Tan is still in the United States, and she says there's only one reason why: "the great compassion" of California Democratic Sen. Dianne Feinstein.

People seeking to get around U.S. immigration laws have found a good friend in the state's senior senator, who is going to unusual lengths to help her constituents avoid deportation.

Feinstein, a member of the Judiciary Committee, is the Senate's leader in using "private bills" as a way to keep people in the country who otherwise would have been forced to leave.

Private bills are relatively rare: Only 35 are pending in the Senate this year; 14 of them -- or 40 percent -- bear Feinstein's name. Thirteen of Feinstein's bills date back to previous sessions of Congress but were reintroduced this year.

The bills usually fail because of their narrow appeal, but deportation procedures are oftentimes put on hold when a member of Congress introduces a private bill.

When Feinstein offered a bill on behalf of Tan, her deportation was delayed until 2011.

Feinstein said her private bills are aimed at helping families or individuals who face "exceptional" circumstances.

"These are people who, if sent back to their home countries, would face enormous hardship," she said. "These individuals have no criminal backgrounds, they're financially secure, they pay their taxes, their children excel in school. They've truly embraced the American dream."

She acknowledged that private relief bills seldom pass "and many of my colleagues in the Senate have a policy never to introduce them." But she added: "My staff and I have thoroughly reviewed these cases and believe they merit such extraordinary relief as a private bill."

California's senators take drastically different approaches to private legislation. While Feinstein leads the Senate in private bills, Democrat Barbara Boxer has not introduced a single private bill since joining the Senate in 1993.

"Senator Boxer believes the most effective way to help her constituents is through great casework," said her spokesman, Zachary Coile. "Our caseworkers in California do an exceptional job of helping constituents resolve their problems."

The practice of introducing private bills has always raised questions of special treatment, said Jan Ting, who teaches immigration law at Temple University Law School in Philadelphia and who served as assistant commissioner at the Immigration and Naturalization Service in the early 1990s. But whenever a member of Congress took an interest in a case, he said, it prompted an immediate internal review.

"That was enough to put a sticker on the file. ... Our sense was that, well gosh, we owe it to Congress, who controls our funding, to at least see how the private bill plays out," Ting said.

But he said congressional leaders look disapprovingly at private bills, "as kind of clogging up the works."

"They don't feel that that's how immigration matters should be handled," Ting said. "And if you let too many private bills actually pass, you will then be deluged with private bills." But even if they don't pass, Ting said, "they work to focus attention on the case."

Only 36 private bills were approved and signed into law from 1995 until 2007, according to the Congressional Research Service. In a report to Congress, the research service said that private bills "warrant careful consideration" because they're "a special form of relief allowing the circumvention of the public laws" governing immigration.

For many members of Congress, private bills fell out of favor in the 1970s, after Abscam and a series of other corruption scandals involving payoffs for the sponsorship of private bills. Ting said that private bills then "were thought to be one more manifestation of the fruits of corruption."

Tan said she believes Feinstein lent her a sympathetic ear because her deportation would have resulted in the breakup of her family.

"The main reason is she doesn't want families to be torn apart, and a mom shouldn't be taken away from her American-born children," said Tan.

Feinstein has defended her private bills in speeches on the Senate floor.

She asked her colleagues to provide permanent resident status to Joseph Gabra and his wife, Sharon Kamel, Egyptian nationals living with their four children in Camarillo. Feinstein said they entered the U.S. in 1998 on tourist visas and immediately filed for political asylum based on religious persecution. She said the couple would "endure immense and unfair hardship" if forced to leave the country.

The couple fled Egypt because they had been targeted for their involvement in the Coptic Christian Church in Egypt. Gabra was employed from 1990-98 by the Coptic Catholic Diocese Church as an accountant and project coordinator. He was responsible for building community facilities such as religious schools, among other things. His wife was employed as the director for training in the human resources department of the Coptic Church.

Feinstein asked the Senate to approve a private bill for Esidronio Arreola-Saucedo, Maria Elna Cobian Arreola and their children, Nayely and Cindy, all living in the Fresno area. She said the family has lived in the U.S. for more than 20 years and faced deportation because of "grievous errors committed by their previous counsel," who has since been disbarred.

And the senator introduced legislation to help Robert Liang and his wife, Alice Liang, of San Bruno, who entered the U.S. more than 25 years ago as tourists and overstayed the terms of their temporary visas. Robert Liang is a foreign national and refugee from Laos, while his wife is a citizen of Taiwan. They sought to change their immigration status in 1993, but the INS did not act on their application until five years later. An immigration judge said their request likely would have been approved if it had been acted on in a timely manner, before immigration laws changed in 1996.

In Tan's case, Feinstein intervened after federal courts denied her bid for asylum. After living in the U.S. for more than 20 years, Tan faced deportation back to her native Philippines. She said the law discriminates against her because she is a lesbian and cannot be sponsored for citizenship by her longtime partner, Jaylynn Mercado.

Tan pressed her case before the Senate Judiciary Committee in June, telling members of Congress that she merely wants to keep her family, which includes a pair of 12-year-old twins, together.

"We have a home together," she said. "Jay has a great job. We have a mortgage, a pension, friends and a community. We have everything together and it would be impossible to re-establish elsewhere."

In an interview, Tan said she is happy to be one of Feinstein's constituents.

"I'm just thankful and I feel so lucky that I was given a private bill by my senator, " Tan said. "Because if not for her, I would have been deported. It's only a senator that can do that."

A U.S. Senator, who recently lost a powerful committee chairmanship amid a corruption scandal, leads the Senate in using “private bills” to keep illegal immigrants in her district from being deported.

Democrat Dianne Feinstein, a member of the Senate Judiciary Committee, is the lawmaker who most abuses the rarely used method to block the deportations of illegal aliens in her northern California district. Private bills are seldom introduced because, unlike public bills, they only benefit specified individuals and are therefore viewed as special treatment susceptible to fraud.

Feinstein, a former San Francisco mayor elected to the U.S. Senate in 1992, has introduced 40% of this year’s private bills, according to a news report that highlights several of the illegal aliens that the senator has helped evade deportation. The most recent is a Philippine woman ordered to leave the country after two decades. Feinstein intervened after federal courts denied the woman’s request for asylum.

The senator has also helped a deported family of Egyptians that overstayed its U.S. tourist visa by more than a decade, a Mexican family that has lived in her district illegally for 20 years and an Asian couple that entered the country more than 25 years ago as tourists and never left. Feinstein claims her private bills help families or individuals, like these, who face “exceptional” circumstances because they would encounter “enormous hardship” if sent back to their home countries.

Feinstein, who is among the wealthiest members of Congress with a net worth of $42.6 million, is no stranger to scandal. A few months ago she was forced to resign as chair of a powerful military construction committee after reports that for years she abused her position to award her husband’s companies billions of dollars in government contracts.

A few years ago Feinstein introduced a delusional law to give 1.5 million illegal immigrant farm workers and their relatives United States citizenship by granting them immediate legal residency. Feinstein and several lawmakers who joined her in the failed bid claimed the measure was necessary to provide a labor pool for the country's multi billion-dollar agriculture industry.

Texas Sheriff Released Illegal Alien Jihadist After Arrest

The Jordanian who vowed jihad against Americans before trying to blow up a Texas high rise was living in the United States illegally even though he had been arrested by a local law enforcement agency that neglected to refer him for deportation.

In yet another shameful example of how illegal alien sanctuaries across the U.S. enable dangerous felons, a local law enforcement agency with a don’t-ask-don’t-tell immigration policy freed a would-be terrorist after an arrest. In similar cases nationwide local police departments have permitted dozens of illegal immigrants to commit violent crimes—including murder and rape—against innocent Americans by releasing them instead of deporting them.

In this case the FBI intercepted the bombing of a 60-story office building in downtown Dallas. The Jordanian illegal alien (Hosam Maher Husein Smadi) who nearly pulled it off lived in a little Texas town called Italy, located in Ellis county about 45 miles south of Dallas. Earlier in the month, Smadi had been arrested by the Ellis County Sheriff for not having a driver’s license or insurance. He paid a small fine and continued plotting his terrorist attack.

In conversations with FBI agents posing as al-Qaeda operatives, Smadi pledged allegiance to Osama bin Laden, said he came to the U.S. to wage jihad (holy war) against Americans and told agents he was targeting military recruitment centers but eventually settled on financial institutions because security was more lenient. Late last week he was arrested for trying to detonate explosives loaded inside a sports utility vehicle he had parked outside a Dallas skyscraper.

Smadi has been charged with attempting to use a weapon of mass destruction. He first caught the attention of the FBI’s Joint Terrorism Task Force as a member of an online group of extremists. Smadi stood out based on his “vehement intention to actually conduct terror attacks in the United States,” according to the FBI arrest affidavit. In numerous communications with undercover agents, he repeatedly made clear his intention to commit violent acts of terrorism in the name of Islam.

In the detailed affidavit, federal agents outline Smadi’s specific plans and reveal his mindset by listing radical statements he made to undercover FBI employees who are native Arabic speakers. Smadi repeatedly confirms his loyalty to Osama bin Laden, refers to Jews as dogs and vows to target everything that helps America in its war with Arabs.

Americans should wonder how this jihadist entered the U.S., what government agency failed to detect his presence and why wasn’t he intercepted by the small local sheriff department that arrested him just days before he tried bombing a building?

Criminals Deported Unescorted On Commercial Flights

Public safety is frequently risked by federal immigration authorities who deport illegal immigrants with criminal records by putting them on commercial flights unescorted.

Many of the illegal aliens have been convicted of serious crimes in U.S. courts and some are sex offenders or pedophiles yet the feds send them home on planes full of unsuspecting passengers without a law enforcement officer. Often the unescorted deportees cause disruptions and in some cases they have escaped, according to a Houston newspaper that reported the rather astounding story this week.

Officially, the agency that conducts the deportations, Immigration and Customs Enforcement (ICE), refuses to comment on the matter or provide official statistics but fed up agents have furnished documents and testimony that should alarm everyone who boards a commercial flight.

Of the tens of thousand of illegal immigrants deported on commercial airlines in the last few years, more than 75% flew unescorted. Among them was a man convicted of sexually assaulting a 14-year-old girl, another who molested an 11-year-old-girl and was described by his probation officer as a “pedophile” and numerous other offenders.

Additionally, two Peruvians who ICE officers say “have never been seen again” escaped from the airport in Houston instead of boarding their commercial flight to Lima and an unescorted Guatemalan man had to be restrained by civilians on a flight from Miami to Guatemala City.

Airlines are not notified that convicted criminals are flying unescorted because “they pose no risk,” according to the official ICE explanation furnished to the newspaper. However, the union vice president for agents in Detention and Removal Operations assures that putting criminal illegal aliens on commercial flights is “an absolute risk to public safety.”

U.S. Spends $26 Million On Spanish Census Forms

In an unprecedented effort to reach out to illegal immigrants, the U.S. government will spend $26 million to send Spanish-language census questionnaires directly to homes for the first time in the decennial count’s history.

In past years, participants could request special forms in several languages—including Spanish, Chinese, Korean and Vietnamese—but this will mark the first time that the government sends to entire regions census questionnaires in a language other than English.

More than 13 million bilingual (Spanish and English) forms will be distributed to neighborhoods with high concentrations of Latinos. More than one-fourth of them will be mailed in California with the highest concentration going to Los Angeles County. The South Florida city of Miami will also get a substantial amount of bilingual census forms in 2010 and so will Houston Texas and portions of Utah.

The costly language outreach is part of an effort to accurately count a population that traditionally has been difficult to pin down, according to the Obama Administration. In other words, illegal aliens who have violated federal law and aren’t exactly jumping at the chance to have contact with government authorities.

The nation’s powerful La Raza movement is undoubtedly thrilled that Uncle Sam is catering to the illegal population in the U.S., which is mostly Mexican and Central American. Latino rights advocates point out that, sending forms in their native language will win over the trust of immigrants who are especially suspicious of the government amid heightened immigration raids and deportations.

In fact, earlier this year the U.S. Census Bureau's deputy director (Preston Jay Waite) demanded that federal agents cease immigration raids during the 2010 count so the government can get an accurate tally of people in the country illegally. A California Senator (Democrat Barbara Boxer) also tried to block immigration enforcement during the census count by sneaking an amendment to a spending bill a few months ago.

That was viewed as a shameless effort to gain additional Congressional seats since counting illegal immigrants will undoubtedly give states—such as California, Arizona, Texas and Florida—with large undocumented populations additional seats in the House of Representatives after 2010.

At least one federal lawmaker from California, Republican Congressman Duncan Hunter, opposes the unprecedented mailings of bilingual forms, pointing out that taxpayers should not have to carry the additional expense of providing the special questionnaires.

Local communities across the country are taking advantage of a federal program, called 287(g), to train law enforcement officers in illegal immigration enforcement techniques. And it's working. These newly trained police officers are shutting down illegal alien crime and helping to deport illegal alien criminals out of the country.
What is the Obama administration's response to the success of this program? Homeland Security Secretary Janet Napolitano decided to implement "reforms" to weaken it as part of her comprehensive "review" of all border security policies. Judicial Watch, of course, wants to know everything about how and why this incomprehensible decision was made, which is why we filed a Freedom of Information Act (FOIA) lawsuit against the Department of Homeland Security (DHS) last week.
Here's what we're after:
• The new standardized Memorandum of Agreement used to enter into 287(g) partnerships, as announced by Secretary Napolitano on July 10, 2009, as well as any documents containing information on the development of the agreement;
• All new 287(g) agreements entered into with law enforcement agencies;
• All documents concerning the decision to standardize the Memorandum of Agreement and/or create new 287(g) agreements;
• Media and congressional notification plans concerning 287(g);

Dianne Feinstein has also been WELLS FARGO and BANK of AMERICA’S advocate in Washington. She’s taken big money from the banksters that caused the foreclosure debacle that in turn became highly profitable. Feinstein helped them do it! Agency Plans for Visa Push by Residents Made Legal

Although President Obama has put off an immigration overhaul until next year, the federal agency in charge of approving visas is planning ahead for the possibility of giving legal status to millions of illegal immigrants, the agency’s director said Thursday.
“We are under way to prepare for that,” Alejandro Mayorkas, the director of the agency, the United States Citizenship and Immigration Services, said in an interview. Mr. Obama has told immigration officials that a legalization program would be part of legislation the White House would propose, said Mr. Mayorkas, who became director in August. The agency’s goal, he said, is to be ready to expand rapidly to handle the gigantic increase in visa applications it would face if the legislation, known as comprehensive immigration reform, passed Congress.
The citizenship agency faces a difficult balancing act, preparing for a potential workload bigger than any it has faced, based on legislation in early stages of discussion that is fiercely opposed by many lawmakers in Congress. Also, the agency must work to reduce backlogs and delays that have hampered its performance.
There are no official estimates of the number of illegal immigrants who would apply for legal documents. The Pew Hispanic Center and the Center for Immigration Studies, two research groups in Washington, estimate that at least 10.8 million illegal immigrants live in this country. But a large number of those would not be eligible for legal status for many reasons, including past immigration violations.
Currently, the citizenship agency can handle applications from about six million immigrants a year, Mr. Mayorkas said, including the time-consuming collection of fingerprints and other biometric identity information. Under some plans for legalization, the agency might receive that many applications in a few weeks.
An example of the planning, Mr. Mayorkas said, is an effort to improve the agency’s ability to receive applications via postal mail at secure reception points known as lockboxes. The agency currently receives about 65 percent of applications through lockboxes, which is more efficient than receiving them through local offices. The agency is trying to move quickly to receive all applications through lockboxes.
One idea calls for illegal immigrants to start the legalization process by verifying their presence in the United States through a simple registration form mailed to a lockbox, according to officials familiar with the planning.
As part of the planning, Homeland Security Secretary Janet Napolitano, Mr. Mayorkas and other officials have held meetings around the country in recent weeks to gather suggestions from the public for the overhaul.
The Obama administration’s planning contrasts with that of the Bush administration, which also supported a legalization program. Some opponents of President Bush’s proposal, which was defeated in Congress in 2007, cited the immigration agencies’ lack of preparation.
Some lawmakers who oppose the overhaul have questioned whether the planning was a good use of limited resources. “There is a risk to national security that they will take their eyes off background checks of immigrants,” said Representative Steve King of Iowa, the senior Republican on the House immigration subcommittee, “while they are busy setting up for legislation that has not been introduced in any way, shape or form.”

Another victory for American workers in Arizona. Yesterday, the Ninth Circuit Court of Appeals upheld the get-tough employer sanctions law in the state. The law hits employers who knowingly hire illegal aliens with strict penalties and in some cases even strips businesses of their licenses. A lower court upheld the same law in February. But open-borders and amnesty groups along with the business lobby are considering yet another appeal.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third nation neutral arbitration of ....disputes concerning immigration laws and their enforcement." We’ll have the story.
Last year, Prince William County, Virginia passed an initiative to allow local police to check the immigration status of anyone in police custody. The county recently held its first immigration training session for local police officers. We’ll have a look inside the training.
Mexican President Felipe Calderon is in New York today on the first leg his five day tour across America to meddle in immigration issues in the United States. This is his first visit to the U.S. since he became President in 2006, but he will not meet with President Bush or any of the presidential candidates, who he has accused of spewing anti immigrant rhetoric.
