CHARGES of RACISM for CRITICISM of ILLEGAL IMMIGRATION IS NO SUBSTITUTE for EFFECTIVE BORDER ENFORCEMENT

I was surprised by some of the reactions to my original blog piece, last week on Arizona's efforts to curb illegal immigration. Some even indicated they were surprised that the Huffington Post printed my article. Wow! Have we become that polarized?
From a constitutional law standpoint, let's try to tone down the rhetoric a bit. I concede that the Legislature and Governor of Arizona, in their desperation to stem illegal immigration from Mexico, may have overstepped the boundary of their authority under our constitution.
I have not forgotten Article 6, the "Supremacy Clause" of our Constitution. It states that:
"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding. "
The 1956 U.S. Supreme Court case, Pennsylvania vs. Nelson, suggest that the Arizona legislation, making it a crime to be in the state without having obtained lawful entry into the U.S and authorizing State police to demand proof of citizenship for persons they had "reasonable suspicion" to believe were illegal aliens, may be"pre-empted" by existing federal law. "Preemption" can be either express or implied. Consequently, this means that any federal law, even a regulation or federal agency dealing with illegal immigration is supreme and preempts any conflicting State law.
This could be the basis of a successful legal challenge to the recently enacted Arizona law.
However, my original article was not about constitutional legality, but about sensible and rational public policy. From the various placards, signs and speeches protesting the Arizona legislation illegal immigration appears to be implicitly elevated as a worthwhile pursuit that all Arizonans and American citizens at large should compassionately understand and support. This is where I part company with so many of my friends on the "liberal left".
Current federal law mandates legal immigrants to carry proof of their residency status in the United States at all times. The issue of "racial profiling" would not arise as a matter of concern if persons who are likely to be the subject of such profiling had been not been able to enter the country illegally in the first place. Arizona, desperate to find a way to discover, identify and deport such persons has enacted a law that runs the risk of "racial profiling" the group of persons they seek to detect as suspect illegal immigrants.
That someone may have entered Arizona illegally "to get a job to feed their family", "to obtain medical care for their wife or child", or simply "in pursuit of a better life and educational opportunities for his family", are all worthwhile objectives. Many American citizens can compassionately understand such motivations. However humanistic their reasons may be to illegally enter into the United States, they do nothing to extinguish such illegality.
In various communities throughout our own country there have been heart wrenching instances where a father, out of desperation, has unsuccessfully attempted to rob a bank or a consumer products place of business because he had no money to feed his hungry children, pay his rent or pay his home mortgage. His act, while compassionately understandable, nevertheless is illegal. His conduct broke the law and put other innocent persons at risk. So it is with illegal immigration from Mexico "in search of a better life", "to earn money to send back to one's family," "to obtain medical care for a child or wife," and so on. They too are all are worthwhile objectives. But, entry into the United States in pursuit of such objectives is not merely "undocumented conduct;" it is an illegal breach of the United States border.
A naturalized citizen wrote a letter to the New York Times, published on Saturday May 1, 2010. The writer said,
As a naturalized citizen who waited five years to obtain a green card and then another four years to become a citizen (with all the expense and paperwork involved), I see no reason to condone illegal immigration.

If we, as American citizens, illegally entered Australia, Canada, Britain or any other country, we could hardly object to being asked for our papers, nor be surprised to be deported forthwith if we didn't have them. Has everyone lost sight of the meaning of the word "illegal"?
A repetitive theme of the placards carried by demonstrators this past weekend protesting Arizona's new law is "Legalization Now for All Illegal Immigrants". i.e., urging de facto amnesty for everyone in the country illegally.
I restate my original position: All of the protest is misdirected and at the wrong parties. As Ross Douthat, columnist for the New York Times, wrote, "If you don't like what Arizona just did, the answer isn't to scream "fascist!" It's to demand that the federal government do its job, so that we can have the immigration system that both Americans and immigrants deserve."
As an African-American I have experienced and witnessed racial discrimination and racial profiling. Now, however I perceive the establishment of a new race relations paradigm: a flawed immigration public policy becomes immune from criticism when such criticism challenges the effort to legitimize illegal immigration from Mexico. (9.5% current national unemployment and 18% or higher unemployment in many African-American and Hispanic communities.) Just where are additional jobs supposed to come from to enable our new illegal "legalized" immigrants to become self-sustaining tax paying members in our respective communities?

That most illegal immigrants or "undocumented" persons in Arizona are persons with various shades of brown skin, does not make challenges to their illegal immigration "racist". Often such charges of racism are invoked as a substitute for dispassionate analysis of the serious issue being confronted. Charges of racism directed toward those who want an end to illegal immigration is no substitute for immediate effective closing of our border with Mexico. Having said this, however, I do not challenge or dismiss the observation of Frank Rich in his recent Op Ed piece in this past Sunday's New York Times.
To be angry about illegal immigration is hardly tantamount to being a bigot. But the Arizona law expressing that anger is bigoted, and in a very particular way. The law dovetails seamlessly with the national "Take Back America" crusade that has attended the rise of Barack Obama and the accelerating demographic shift our first African-American president represents.

The crowd that wants Latinos to show their papers if there's a "reasonable suspicion" of illegality is often the same crowd still demanding that the president produce a document proving his own citizenship.
To the "Take Back America" right, the illegitimate Obama is Illegal Alien No.1".
Is this what a national discussion of our illegal immigration public policy is supposed to read and sound like in our newly acclaimed "post-racial America"? Is this indicative of what we have become, in this second decade of the 21st century, following our election of the first African-American as the 44th President of the United States? ZOGBY INTERNATIONAL POLL - 2002 MAJORITY OF MEXICAN POPULATION BELIEVES THE SOUTHWEST TERRITORY OF THE U.S. RIGHTFULLY BELONGS TO MEXICO! Americans and Mexicans have widely divergent views of border issues, according to a new poll by Zogby International.
Zogby found that a large majority of the Mexican population believes the southwest territory of the U.S. rightfully belongs to Mexico, and that Mexicans should have the right to enter the U.S. without first obtaining U.S. permission. By contrast, Zogby's survey of Americans conducted within a few days of the Mexican poll shows a large majority supports reducing immigration levels and wants the military deployed along the border to protect the U.S. from illegal immigration. Zogby's poll found that 58 percent of Mexicans agree with the statement, "the territory of the United States' Southwest rightfully belongs to Mexico." Only 28 percent disagree, and 14 percent are unsure. A similar majority, 57 percent, agree with the statement, "Mexicans should have the right to enter the U.S. without U.S. permission," while 35 percent disagree. Seven percent are unsure. The survey has a margin of error of 3.5 percent. The Mexico portion of the survey was conducted in Spanish between May 25 and May 26 among 801 adults chosen at random throughout Mexico. The poll was commissioned by Americans for Immigration Control, Inc. (AIC), which advocates increased restrictions on immigration. "There is obviously a large and significant gap between the attitudes of Americans and Mexicans," said Robert Goldsborough, AIC president. "While most Americans want immigration reduced, most Mexicans think they don't even need permission to enter our country. The poll clearly shows there is less common ground for immigration negotiations between Mexico and the U.S. than the leaders think. Support for a porous border and a loose migration policy occurs only on the Mexican side, not in the U.S." Zogby's survey of American attitudes found wide majorities of Americans also oppose amnesty for illegal aliens. The U.S. portion of the survey was conducted of 1,015 likely voters in the U.S. from May 28 to May 30. It found that 65 percent disagree with the statement, "foreigners residing illegally in the U.S. should be given amnesty." Just 26 percent of likely voters support amnesty for illegals, while 9 percent are unsure. A large majority, 58 percent, agree that the U.S. should "admit fewer immigrants each year." Only 6 percent want "more immigrants each year," and 30 percent want to "keep immigration at the current annual levels." The single largest majority in the entire poll was found among Americans supporting use of the military to guard the border. Fully 68 percent of those surveyed agree with the statement, "the U.S. should deploy military troops on the border as a temporary measure to help the U.S. Border Patrol curb illegal immigration." Only 28 percent disagree, and 3 percent are unsure.

WASHINGTON (AP) - The Obama administration on Friday urged the Supreme Court to prevent Arizona from enforcing a law that punishes businesses that employ illegal immigrants, arguing that federal immigration law trumps state efforts.

The administration's views, contained in a new filing at the high court, are similar to concerns President Barack Obama has expressed about a new Arizona law that cracks down on illegal immigrants.

When it takes effect July 29, the new law will require police enforcing any other law to examine immigration status if there is reasonable suspicion a person is in the country illegally.

Obama and other administration officials have illegal immigration is an issue that must have a national solution rather than being addressed on a piecemeal basis by the states. The Obama administration is contemplating a court challenge to the new law. Justice Department officials met face-to-face with Attorney General Terry Goddard and aides to Republican Gov. Jan Brewer to elicit information from state officials regarding the Obama administration's concerns about the new law.

In asking the Supreme Court to take the employer sanctions case, the Obama administration said federal immigration law expressly pre-empts any state law imposing sanctions on employers hiring illegal immigrants. The administration added that if Arizona businesses knowingly use illegal immigrants, the businesses can have any of their state licenses suspended or revoked.

Lower courts have said that the Arizona law is not pre-empted by the federal law. That should be reversed, acting Solicitor General Neal Katyal said in the Supreme Court filing.

The Arizona law disrupts "a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," Katyal wrote.

Phoenix attorney Julie Pace, representing the trade associations that are challenging the Arizona law, called the Obama administration's position "good news that the federal government has gone on record supporting the legal challenge to the constitutionality" of the Arizona law.

With the support of 70 percent of its citizens, Arizona has ordered sheriffs and police to secure the border and remove illegal aliens, half a million of whom now reside there.
Arizona acted because the U.S. government has abdicated its constitutional duty to protect the states from invasion and refuses to enforce America's immigration laws.
"We in Arizona have been more than patient waiting for Washington to act," said Gov. Jan Brewer. "But decades of inaction and misguided policy have created an unacceptable situation."
We have a crisis in Arizona because we have a failed state in Washington.
What is the response of Barack Obama, who took an oath to see to it that federal laws are faithfully executed?
He is siding with the law-breakers. He is pandering to the ethnic lobbies. He is not berating a Mexican regime that aids and abets this invasion of the country of which he is commander in chief. Instead, he attacks the government of Arizona for trying to fill a gaping hole in law enforcement left by his own dereliction of duty.
He has denounced Arizona as "misguided." He has called on the Justice Department to ensure that Arizona's sheriffs and police do not violate anyone's civil rights. But he has said nothing about the rights of the people of Arizona who must deal with the costs of having hundreds of thousands of lawbreakers in their midst.
How's that for Andrew Jackson-style leadership?
Obama has done everything but his duty to enforce the law.
Undeniably, making it a state as well as a federal crime to be in this country illegally, and requiring police to check the immigration status of anyone they have a "reasonable suspicion" is here illegally, is tough and burdensome. But what choice did Arizona have?
The state has a fiscal crisis caused in part by the burden of providing schooling and social welfare for illegals and their families, who consume far more in services than they pay in taxes and who continue to pour in. Even John McCain is now calling for 3,000 troops on the border.
Police officers and a prominent rancher have been murdered. There have been kidnappings believed to be tied to the Mexican drug cartels. There are nightly high-speed chases through the barrios where innocent people are constantly at risk.
If Arizona does not get control of the border and stop the invasion, U.S. citizens will stop coming to Arizona and will begin to depart, as they are already fleeing California.

A country that cannot control its borders isn't really a country anymore, Ronald Reagan reminded us.

What we are talking about here is the Balkanization and breakup of a nation into ethnic enclaves. A country that cannot control its borders isn't really a country anymore, Ronald Reagan reminded us.
The tasks that Arizonans are themselves undertaking are ones that belong by right, the Constitution and federal law to the Border Patrol, Immigration and Customs Enforcement, and Homeland Security.
Arizona has been compelled to assume the feds' role because the feds won't do their job. And for that dereliction of duty the buck stops on the desk of the president of the United States.
Why is Obama paralyzed? Why does he not enforce the law, even if he dislikes it, by punishing the businessmen who hire illegals and by sending the 12 million to 20 million illegals back home? President Eisenhower did it. Why won't he?

Because he is politically correct. Because he owes a big debt to the Hispanic lobby that helped deliver two-thirds of that vote in 2008. Though most citizens of Hispanic descent in Arizona want the border protected and the laws enforced, the Hispanic lobby demands that the law be changed.
Fair enough. But the nation rose up as one to reject the "path-to-citizenship" -- i.e., amnesty -- that the 2007 plan of George W. Bush, McCain, Hillary Clinton and Barack Obama envisioned.
Al Sharpton threatens to go to Phoenix and march in the streets against the new Arizona law. Let him go.

JOBS? NO LEGAL NEED APPLY HERE!

Let us see how many African-Americans, who are today frozen out of the 8 million jobs held by illegal aliens that might otherwise go to them or their children, will march to defend an invasion for which they are themselves paying the heaviest price.
Last year, while Americans were losing a net of 5 million jobs, the U.S. government -- Bush and Obama both -- issued 1,131,000 green cards to legal immigrants to come and take the jobs that did open up, a flood of immigrants equaled in only four other years in our history.
What are we doing to our own people?
Whose country is this, anyway?
America today has an establishment that, because it does not like the immigration laws, countenances and condones wholesale violation of those laws.
Nevertheless, under those laws, the U.S. government is obligated to deport illegal aliens and punish businesses that knowingly hire them.
This is not an option. It is an obligation.

Arizona Leads the Way Against Illegal Immigration

If you’ve been following the news from Arizona in recent days, you’ve probably heard that the state’s Republican governor, Jan Brewer, has just signed into law a “racist” bill that will punish Hispanics, stamp out civil rights, create a police state – and trample on the Constitution for good measure. You also may have heard that the Arizona law will “undermine basic notions of fairness,” at least according to President Obama, who has called the law “misguided” and ordered the Justice Department to find some way to challenge its standing.
Apocalyptic rhetoric notwithstanding, the Arizona law is not at all controversial in substance. All it does is deputize state police to determine whether people are in the country legally and to question them if there is reasonable suspicion that they’re not. Of course, that function should properly be handled by the federal government. But because the government has made so little effort to enforce immigration laws, border states that bear the brunt of illegal immigration – an estimated 460,000 illegal immigrants call Arizona home – have been forced to take action on their own terms.
The concept behind the immigration law is straightforward: If you enforce laws against illegal immigration, you will have less of it. That was also the idea behind Arizona’s Legal Arizona Workers Act, which required the state’s employers to verify the immigration status of new hires using the federal government’s E-Verify program. Businesses eager to avoid the burdens of verification and pro-illegal immigration groups also opposed that measure, filing suit to prevent its passage, but emerging evidence seems to suggest that it had the desired effect: Since being implemented in January 2008, the LAWA has resulted in a substantial decrease of illegal immigration.
The new law seeks to continue that progress. It does so mostly by making state crimes what are already federal crimes. For instance, the Arizona law makes it a crime to be in the country illegally – in other words, it enforces the national law. The Arizona law also requires police to question people about their immigration status if they have reasonable cause to suspect that they’re illegal immigrants. To prevent abuse or racial discrimination, the law also includes provisions banning racial profiling, and the measure itself has nothing to do with race or ethnicity, as the bill’s foes claim. Still, given that the majority of the state’s illegal immigrants are from neighboring Mexico, it is inevitable that the majority of those targeted by the law will be Hispanic. That says more about the demographics of illegal immigration than the allegedly discriminatory agenda of Arizona authorities.
Concerns about the abuse of civil liberties are similarly overblown. The Arizona law will require anyone arrested for a crime to have their immigration status established before their release. In theory, this should already be the law of the land; but so-called “sanctuary city” laws enacted by cities and municipalities across the country have prevented police from enforcing immigration laws. Such laws certainly benefit felons who escape deportation. How they profit the country at large is less apparent. The Arizona law also requires residents to carry ID or immigration registration documents at all times. That too is reasonable. A valid ID is already required to qualify for government and public assistance programs available to citizens and requiring one form of valid ID – whether a drivers license a government-issue ID — hardly marks the onset of Nazi Germany. Indeed, no less than President Obama has previously expressed support for a national ID card.
While some have criticized Arizona for taking the initiative against illegal immigration, it’s hard to find fault with the state’s sense of urgency. Last month’s murder of Arizona cattle rancher Rob Krentz was just example of the crime problem that unchecked illegal immigration has helped create and the problems its poses for American justice. Although Kentz was known for providing illegals with food and water, police found tracks at the murder scene leading to the Mexican border. They made no arrests in the case. In that climate of lawlessness, the state cannot be blamed for passing a law that may help offer a solution. Moreover, with the Obama administration and Congressional Democrats threatening to take up immigration reform – that is, amnesty for the 11-million plus illegal immigrants in this country unmatched by serious enforcement measures going forward – states like Arizona are left with a choice of doing something to combat the problem or leaving it to the federal government to make it worse.

With the support of 70 percent of its citizens, Arizona has ordered sheriffs and police to secure the border and remove illegal aliens, half a million of whom now reside there.
Arizona acted because the U.S. government has abdicated its constitutional duty to protect the states from invasion and refuses to enforce America's immigration laws.
"We in Arizona have been more than patient waiting for Washington to act," said Gov. Jan Brewer. "But decades of inaction and misguided policy have created an unacceptable situation."
We have a crisis in Arizona because we have a failed state in Washington.
What is the response of Barack Obama, who took an oath to see to it that federal laws are faithfully executed?

Obama has done everything but his duty to enforce the law.
Undeniably, making it a state as well as a federal crime to be in this country illegally, and requiring police to check the immigration status of anyone they have a "reasonable suspicion" is here illegally, is tough and burdensome. But what choice did Arizona have?
The state has a fiscal crisis caused in part by the burden of providing schooling and social welfare for illegals and their families, who consume far more in services than they pay in taxes and who continue to pour in. Even John McCain is now calling for 3,000 troops on the border.
Police officers and a prominent rancher have been murdered. There have been kidnappings believed to be tied to the Mexican drug cartels. There are nightly high-speed chases through the barrios where innocent people are constantly at risk.
If Arizona does not get control of the border and stop the invasion, U.S. citizens will stop coming to Arizona and will begin to depart, as they are already fleeing California.

An Alabama employment agency that sent 70 laborers and construction workers to job sites in that state in the aftermath of Hurricane Katrina says the men were sent home after just two weeks on the job by employers who told them "the Mexicans had arrived" and were willing to work for less. Linda Swope, who operates Complete Employment Services Inc. in Mobile, Ala., told The Washington Times last week that the workers -- whom she described as U.S. citizens, residents of Alabama and predominantly black -- had been "urgently requested" by contractors hired to rebuild and clear devastated areas of the state, but were told to leave three job sites when the foreign workers showed up. "After Katrina, our company had 70 workers on the job the first day, but the companies decided they didn't need them anymore because the Mexicans had arrived," Mrs. Swope said. "I assure you it is not true that Americans don't want to work. "We had been told that 270 jobs might be available, and we could have filled every one of them with men from this area, most of whom lost their jobs because of the hurricane," she said. "When we told the guys they would not be needed, they actually cried ... and we cried with them. This is a shame." Mrs. Swope said employment agencies throughout Alabama, Louisiana and Mississippi faced similar problems, when thousands of men from Mexico and several Central and South American countries -- many in crowded buses and trucks -- came into the three states after Katrina, looking for employment and willing to work for less money. The number of foreign workers who flooded the area after the hurricane has been estimated at more than 30,000. Many of them have been identified by law-enforcement authorities and others as illegal aliens. The Gulf Coast Latin American Association noted in a report that whether those workers will remain after the cleanup work is completed is not clear, but the longer those jobs last, the more likely it is that the workers will settle permanently. After Hurricane Andrew hit southeastern Florida in 1992, the association said, the construction boom attracted large numbers of Hispanic immigrants to several areas, including Homestead, Fla., where the Latino population doubled during the 1990s. Many of the illegal aliens came into the Gulf Coast states not only from south of the border but also from California, Arizona and Texas, responding to the demand for workers. U.S. Border Patrol officials in the three states have reported an increase in the number of illegals apprehended. Some of the migrants who did get jobs in the Gulf states also were mistreated, records show. Two class-action lawsuits are pending in federal court in New Orleans in which thousands of migrant workers said they never were paid, although many worked 12-hour shifts, seven days a week and were required to remove toxic contamination from hurricane-ravaged buildings. Some of the named companies were working on contracts from the Federal Emergency Management Agency (FEMA) and other government agencies. Government estimates put at 400,000 the number of jobs lost in the Gulf region as a result of Katrina, which displaced more than 1.5 million people, and many of those workers left the area to seek employment elsewhere because available construction, laborer and cleanup jobs in Alabama, Louisiana and Mississippi had been filled by foreign workers, including illegal aliens. President Bush last week signed the Katrina Emergency Assistance Act of 2006, which extended for 13 weeks unemployment compensation benefits to more than 140,000 residents of the Gulf states who were displaced from their jobs by Katrina. Their benefits, funded by FEMA, had expired March 4. Would-be employers in Alabama, Louisiana and Mississippi, awash in cleanup and reconstruction jobs, faced little in the way of legal problems in hiring the illegal aliens after Katrina because the Department of Homeland Security temporarily suspended the sanctioning of employers who hired workers unable to document their citizenship. Mr. Bush also had suspended the Davis-Bacon Act, which requires local contractors to pay "prevailing" wages, in the areas hit by Katrina to encourage reconstruction and cleanup. "The men we sent to jobs in Alabama were local fellows looking for work, men who needed jobs," Mrs. Swope said.
"After driving 50 miles to the work sites where they had been promised $10 an hour, they discovered the employers had found substitutes who were willing to work for less."

At this week's summit, failed reforms under Fox should be the issue, not US actions.

At the parleys this week with his US and Canadian counterparts in Cancún, Mexican President Vicente Fox will press for more opportunities for his countrymen north of the Rio Grande. Specifically, he will argue for additional visas for Mexicans to enter the United States and Canada, the expansion of guest-worker schemes, and the "regularization" of illegal immigrants who reside throughout the continent. In a recent interview with CNN, the Mexican chief executive excoriated as "undemocratic" the extension of a wall on the US-Mexico border and called for the "orderly, safe, and legal" northbound flow of Mexicans, many of whom come from his home state of Guanajuato. Mexican legislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of the Senate Committee on Foreign Relations for North America, recently emphasized that the solution to the "structural phenomenon" of unlawful migration lies not with "walls or militarization" but with "understanding, cooperation, and joint responsibility." Such rhetoric would be more convincing if Mexican officials were making a good faith effort to uplift the 50 percent of their 106 million people who live in poverty. To his credit, Fox's "Opportunities" initiative has improved slightly the plight of the poorest of the poor. Still, neither he nor Mexico's lawmakers have advanced measures that would spur sustained growth, improve the quality of the workforce, curb unemployment, and obviate the flight of Mexicans abroad. Indeed, Mexico's leaders have turned hypocrisy from an art form into an exact science as they shirk their obligations to fellow citizens, while decrying efforts by the US senators and representatives to crack down on illegal immigration at the border and the workplace. What are some examples of this failure of responsibility? • When oil revenues are excluded, Mexico raises the equivalent of only 9 percent of its gross domestic product in taxes - a figure roughly equivalent to that of Haiti and far below the level of major Latin American nations. Not only is Mexico's collection rate ridiculously low, its fiscal regime is riddled with loopholes and exemptions, giving rise to widespread evasion. Congress has rebuffed efforts to reform the system. Insufficient revenues mean that Mexico spends relatively little on two key elements of social mobility: Education commands just 5.3 percent of its GDP and healthcare only 6.10 percent, according to the World Bank's last comparative study. • A venal, "come-back-tomorrow" bureaucracy explains the 58 days it takes to open a business in Mexico compared with three days in Canada, five days in the US, nine days in Jamaica, and 27 days in Chile. Mexico's private sector estimates that 34 percent of the firms in the country made "extra official" payments to functionaries and legislators in 2004. These bribes totaled $11.2 billion and equaled 12 percent of GDP. • Transparency International, a nongovernmental organization, placed Mexico in a tie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyed for corruption. • Economic competition is constrained by the presence of inefficient, overstaffed state oil and electricity monopolies, as well as a small number of private corporations - closely linked to government big shots - that control telecommunications, television, food processing, transportation, construction, and cement. Politicians who talk about, much less propose, trust-busting measures are as rare as a snowfall in the Sonoran Desert. Geography, self-interests, and humanitarian concerns require North America's neighbors to cooperate on myriad issues, not the least of which is immigration. However, Mexico's power brokers have failed to make the difficult decisions necessary to use their nation's bountiful wealth to benefit the masses. Washington and Ottawa have every right to insist that Mexico's pampered elite act responsibly, rather than expecting US and Canadian taxpayers to shoulder burdens Mexico should assume.

Long-Term Unemployment: No Help For The 99ers

This week Congress will consider legislation to reauthorize extended unemployment benefits for the rest of the year. It's going to be an epic fight: Republicans in the Senate will likely do everything they can to stand in the way of a bill projected to add $123 billion to the deficit, forcing Dem leadership to round up a supermajority for a last-minute Friday vote before Congress adjourns for its Memorial Day recess.

Too bad the jobs crisis, in a big way, has already left this bill in the dust. Hundreds of thousands of people have exhausted their extended unemployment benefits. In some states, laid-off workers can receive checks for 99 weeks -- and that's all they're going to get. This bill isn't for the "99ers" and there's no proposal on deck to give them additional weeks of benefits.

"What's frustrating is that our government doesn't seem to think this is an important issue," said Christy Blake, a 35-year-old mother of two in Fruitland, Md. "We didn't put ourselves here. It wasn't our choice. I have been diligently looking for work."

Blake told HuffPost she received her last biweekly $618 unemployment check in February. She said she lost her job as an accounting associate with the city of Fruitland in September 2008 (jobless Marylanders can get 73 weeks of benefits). She said she's three months behind on rent and has no idea how she'll pay the $205.63 electric bill that came with a May 28 cutoff warning. She said she's applied for jobs at Walmart, Target and McDonald's without any luck. She has no idea what to do.

Meanwhile, members of Congress are losing their appetite even for renewing existing benefits. Several members of the House and Senate have flirted with the idea that unemployment checks make people too lazy to look for work. Most recently, Rep. Kathy Dahlkemper (D-Pa.) told the Washington Post that businesses in her district wanted to start hiring but were getting few applicants because Congress had given the unemployed so many weeks of benefits.

"Now, whether that's true or not, I'm still trying to decipher," said Dahlkemper. "But I think it's something we really need to look at."

Blake is concerned about the situation: "I think it really stinks," she said. "It's beyond stinking."

More than a million people will probably be in Blake's boat by the end of the year. She's one of 19,000 in Maryland to have exhausted all available benefits, according to the state's labor department. As of last week, 65,400 people had exhausted benefits in New York -- up from 57,000 at the end of April. In Michigan, it's 34,900. In Illinois, 22,000. In Pennsylvania, 35,200. In California, 110,609. In Florida, the number had climbed to 130,000 before May and currently stands at 193,000.

People who've been out of work for longer than six months constitute 45.9 percent of the total unemployed. Those out of work at least a year make up 23 percent.

Only two-thirds of the country's 15.3 million unemployed receive benefits when they lose their jobs in the first place. Dean Baker, co-director of the progressive Center for Economic and Policy Research, said that while he supported extending benefits in principle, "It's a bit hard to push an argument that the benefits should be extended when so many people are getting nothing."

Some families ineligible for unemployment benefits can get on welfare, formally known as Temporary Assistance for Needy Families. The total number of TANF caseloads has risen to 4.6 million as of December after a steady monthly increase from 4.1 million the previous year. Policy experts say the program serves far fewer families than it should.

Pamela Robinette of Philadelphia told HuffPost she lost her job as an administrative assistant in April 2008 and received her final unemployment check in March. She can't turn to TANF -- her children are grown. "If I'm kicked out of my apartment, I can always live in my car," she said.

Robinette said she thought she could move in with her mother in Texas -- but her sister and daughter are already there. "I'm 53 years old -- to move back in with mommy after all this time, it's degrading," she said. "I think the American government is screwing its citizens."

After a Tuesday vote, the House will send the measure to the Senate, where Democrats will need to file a time-consuming cloture motion to proceed to a final vote at the end of the week. Aside from unemployment benefits, the bill includes tax breaks for individuals and businesses and $2.5 billion to extend a jobs subsidy program through 2010 that will have funded 185,000 jobs through September (Republicans are targeting the program; Democrats didn't stand up for it when they had a chance to extend its funding in March).

An enterprising layoff victim in California garnered more than 20,000 signatures for a petition demanding Congress give the long-term jobless additional weeks of benefits, but few members of the House or Senate have indicated that they support the idea.

FAIR Slams Administration and Congressional Leadership for Rejecting Permanent Reauthorization of E-Verify

(Washington, D.C. October 8, 2009 ) House-Senate conferees finalizing the Homeland Security Appropriations bill, yesterday, undermined the long-term security of American workers by removing language that would have made the E-Verify program permanent. Instead, the conference agreement limits reauthorization to just three years.
E-Verify is the nation’s essential worksite verification tool that allows employers to voluntarily determine whether workers are legally authorized to work in the U.S. by electronically verifying their Social Security numbers. Over 140,000 employers are using the system, 1000 are joining each week, and according to the Department of Homeland Security, E-Verify has a 99.6 percent accuracy rate.
The decision to extend E-Verify for only three years is further evidence of the Obama administration's and the congressional leadership's effort to raise a smokescreen while it dismantles all effective controls against illegal immigration, charged the Federation for American Immigration Reform (FAIR).
Conferees also stripped other safeguards in the Senate bill that were intended to protect American workers from losing jobs to illegal aliens. These provisions included a requirement that federal contractors use E-Verify to determine the employment eligibility of new and existing employees working on federal contracts, and language to prevent the repeal of a rule that required employers to take action upon the receipt of "no-match" letters, issued to employers whose workers' Social Security data cannot be confirmed. A third provision would have ensured all employers can use E-Verify to determine employment eligibility of existing workers in addition to new hires.
"A three-year extension of E-Verify was the bare minimum this administration and the congressional leadership could support and still make any credible claim that they are prepared to enforce U.S. immigration laws," said Dan Stein, president of FAIR. "All that would have been required to make E-Verify a permanent federal program is for conferees to have adopted provisions that were already part of the Senate bill. The fact that they did not speaks volumes about the priorities of this Congress and the Obama administration."
"Unfortunately, at a time when American workers most need the full commitment of their government to protect their jobs, what they got was a half-hearted gesture. E-Verify is the real meat and potatoes of worksite enforcement and dries up the jobs magnet which is the reason illegal aliens come and the reason they stay. The program offers a meaningful solution to our immigration crisis and needs a permanent reauthorization, not a temporary stay of execution. The Obama administration and congressional leaders demonstrated, once again, that their goal is to minimize the enforcement of laws against illegal immigration," concluded Stein.

Tina Griego, journalist for the Denver Rocky Mountain News wrote a column titled, 'Mexican Visitor's Lament' -- 10/25/07.
She interviewed Mexican journalist Evangelina Hernandez while visiting Denver last week. Hernandez said, 'They (The illegal aliens) pay rent, buy groceries, buy clothes...What Happens to your country's economy if 20 million people go away?' That's a good question - it deserves an answer. Denver Public Schools would not suffer a 67 percent drop-out/flunk-out rate because of thousands of illegal alien students speaking 41 different languages. At least 200,000 vehicles would vanish from our gridlocked cities in Colorado. Denver 's four percent unemployment rate would vanish as our working poor would gain jobs at a living wage. In Florida, 1.5 million illegals would return the Sunshine State back to America, the rule of law, and English. In Chicago, Illinois, 2.1 million illegals would free up hospitals, schools, prisons and highways for a safer, cleaner and more crime-free experience. If 20 million illegal aliens returned 'home' the U.S. Economy would return to the rule of law. Employers would hire legal American citizens at a living wage. Everyone would pay their fair share of taxes because they wouldn't be working off the books. That would result in an additional $401 Billion in IRS income taxes collected annually, and an equal amount for local, state and city coffers. No more push '1' for Spanish or '2' for English. No more confusion in American schools that now must contend with over 100 languages that degrade the educational system for American kids. Our overcrowded schools would lose more than two million illegal alien kids at a cost of billions in ESL and free breakfasts and lunches. We would lose 500,000 illegal criminal alien inmates at a cost of more than $1.6 billion annually. New statistics from the Department of Public Social Services reveal that illegal aliens and their families in Los Angeles County collected over $37 million in welfare and food stamp allocations in November 2007 – up $3 million dollars from September, announced Los Angeles County Supervisor Michael D. Antonovich. Twenty five percent of the all welfare and food stamps benefits is going directly to the children of illegal aliens. Dear Senator Frist:

There is a huge amount of propaganda and myths circulating about illegal aliens, particularly illegal Mexican, Salvadorian, Guatemalan and Honduran aliens.

#1. Illegal aliens generally do NOT want US citizenship. Americans are very vain thinking that everybody in the world wants to be a US citizen. Mexicans, and other nationalities want to remain citizens of their home countries while obtaining the benefits offered by the United States such as employment, medical care, instate tuition, government subsidized housing and free education for their offspring. Their main attraction is employment and their loyalty usually remains at home. They want benefits earned and subsidized by middle class Americans. What illegal aliens want are benefits of American residence without paying the price.

#2. There are no jobs that Americans won't do. Illegal aliens are doing jobs that Americans can't take and still support their families. Illegal aliens take low wage jobs, live dozens in a single residence home, share expenses and send money to their home country. There are no jobs that Americans won't do for a decent wage.

#3. Every person who illegally entered this nation left a home. They are NOT homeless and they are NOT Americans. Some left jobs in their home countries. They come to send money to their real home as evidenced by the more than 20 billion dollars sent out of the country each year by illegal aliens. These illegal aliens knowingly and willfully entered this nation in violation of the law and therefore assumed the risk of detection and deportation. Those who brought their alien children assumed the responsibility and risk on behalf of their children.

#4. Illegal aliens are NOT critical to the economy. Illegal aliens constitute less than 5% of the workforce. However, they reduce wages and benefits for lawful US residents.

The attack on the Twin Towers in 2001 was cheered and applauded all across Mexico. Today Mexican school children are taught that the US stole California, Arizona, New Mexico and Texas. If you don't believe it, check out some Mexican textbooks written for their school children.

#9. Although some illegal aliens enter this country for a better life, there are 6 billion people on this planet. At least 1 billion of those live on less than one dollar a day. If wanting a better life is a valid excuse to break the law and sneak into America, then let's allow those one billion to come to America and we'll turn the USA into a Third World nation overnight. ZAPATA, TEX. -- Falcon Lake is famous for its monster bass and for the maniacal obsession of the fishermen who come from all over Texas -- and the world -- to stalk them. Now this remote reservoir that straddles the international boundary is known for something else: pirates.
In the past month, crews of outlaws in a small armada of banged-up skiffs and high-powered bass boats launched from the Mexican shore have ambushed bass anglers from the Texas side innocently casting their plastic worms over favorite spots. The buccaneers have struck in Mexican waters but within sight of the Texas shore.
Dressed in black, the pirates brandish automatic weapons, carry radio cellphones and board the anglers' boats. They demand weapons or drugs from their captives, but finding neither, seem satisfied with taking $400 or $500 as booty, according to law enforcement officials and victims' accounts.
There is a saying about not messing with Texas, and the idea that criminals are preying on American anglers is raising already-high temperatures along the southwest border. Answering calls for help, President Obama last week ordered 1,200 National Guard troops to the region.
The pirates claim to be "federales," or police, but instead are brigands -- with the letter "Z" tattooed on their necks and arms -- from the notorious drug cartel Los Zetas. The Zetas are on a rampage of killing and extortion along the Mexican border as they fight gun and grenade battles against the military and the rival Gulf Cartel.
"Within the last month, with all the feuding going on over there, the dope smuggling has dropped off and it is starving them. This water is Zeta central. They controlled the whole lake. They distributed everything. Now they're desperate and diversifying," said Jose E. Gonzalez, the second in command of the Border Patrol's Zapata station, which operates an around-the-clock maritime patrol.
At least three armed robberies have been reported in Mexican waters. The Texas Department of Public Safety put out a warning for people to stay on the U.S. side. On Memorial Day weekend, when 200 bass boats would usually be in town, only two dozen were seen at county ramps Friday afternoon.
One group of pirates was savvy enough to demand the memory chip from an angler's camera, lest they be identified. Another fisherman told authorities that armed men came roaring toward him. "I saw 'em, and I saw they were machine guns. They were that close, they were 15 yards away from me," San Antonio bass chaser Richard Drake told a local television station. "I was scared."
'Some bad boys out there'
Last week, Border Patrol agents tried to follow a Mexican boat filled with men wearing ski masks, but it was too fast for the agents and entered Mexican waters, where U.S. law enforcement is forbidden.
Olga Juliana Elizondo, the mayor of Nueva Guerrero, Mexico, said ranchers are harassed on their land, motorboats have disappeared, vehicles have been stolen and tourists have fled. "We hope this ends soon," she said.
"We've all heard about the pirates, and we're all sticking to the American side of the lake, because those are some bad boys out there," said Dwayne Deets, a fisherman from Houston who was sliding $50,000 worth of cream-colored bass boat, bristling with sonar and GPS electronics, down a ramp in Zapata.
Deets said Texans loved fishing the Mexican side. It is legal to carry a loaded firearm in a boat in Texas, but it is illegal to bring ammunition or weapons into Mexico. "I just pray no one gets killed out there," he said.
The International Falcon Reservoir was born in the early 1950s, when engineers erected a dam on the Rio Grande, flooding the banks and inundating towns on both sides. The 98,960-surface-acre impoundment stretches 60 miles and provides for irrigation, power, flood control and recreation in the area.
"Until this started, we fished everywhere, and we never cared about the border, Texas to Mexico. But now? No. Hardly anybody is fishing the Mexico side of the lake," said Tom Bendele, who with his brother owns the Falcon Lake Tackle shop in Zapata, now serving as the de facto intel center on all things piratical.
Out on the water, with a reporter in tow, Tom Bendele pointed out the picket line of 14 large concrete beacons that mark the international boundary. Some are swimming distance from the Texas shore; others are miles out in the middle of the lake.
Bendele ventured up the Rio Salado cove on the Mexican side, where two of the acts of piracy occurred. Around the bend, the steeple of the church in Old Guerrero is now mostly underwater. The shoreline is lonely mesquite brush, dotted by rough fish camps used by Mexicans who string gill nets along their side of the lake, hauling up tilapia, carp and bass.
Though illegal in the United States, the Mexican netters often cross into the Texas side to fish, playing an endless hide-and-seek with Texas game wardens.
Bendele cut off his engine, and the boat rocked in the cove. "You could see how it would be easy to get jumped in here," he said. "Notice you don't see any Americans."
'They watch us'
Out on the water with the U.S. Border Patrol, roaring right down the international boundary line but careful never to cross into Mexico, Gonzalez and a crew pointed out spot after spot where they have intercepted tons of marijuana crossing the lake.

"We're telling folks that right now, Mexico is not safe. Don't cross, because we can't go over and help you. It's just an imaginary line, but it's a line I can't cross," said Jake Cawthon, a Texas game warden. He said that anyone fishing the Mexican side these days has "got to have one hand on their fishing pole and the other on their boat keys, ready to haul back home."

Foes and Supporters of New Immigration Law Gather in Arizona

PHOENIX — Two sides of the immigration debate converged here Saturday: a throng of several thousand marching for five miles opposed to Arizona’s new immigration law, and several thousand nearly filling a nearby stadium in the evening in support of it.
Organizers said the timing was coincidental, with both sides taking advantage of a holiday weekend to bring out the masses. But the gatherings encapsulated in a single day the passions surrounding the national immigration debate, recharged by the new law, which will expand the state’s role in immigration enforcement.
Both demonstrations made a point of waving a large number of American flags and issuing pleas for a national overhaul of immigration law, but they offered a jarring study in how polarized the debate has become here.
The demonstrators against the law were mostly Latino, with young people and families making up a large share. They played drums, whistled and chanted and gave speeches in Spanish and English denouncing the perceived racism behind the law. Many carried posters or wore T-shirts with the message: “Do I look illegal?”
At the rally in favor of the law, which began with the pledge of allegiance and the national anthem, any mention of Mexico or supporters of the law brought lusty boos — a video clip of President Felipe Calderón of Mexico especially fired up the crowd, which was mostly white and middle-aged or older. Placards like “Illegals out of the U.S.A.” were typical, though speaker after speaker ridiculed the idea that the crowd was racist.
Far more attended the earlier rally opposed to the law, which included a five-mile march to the Capitol in withering heat. It was one of the largest since Gov. Jan Brewer signed the law April 23.
Some were citizens, like Armando Diaz, 33, a mechanic born and raised here who believes the law has helped spread anti-Latino fervor in the state.
“This is not what Arizona is about, hate,” Mr. Diaz said as he neared the capitol, where people fled for what little shade they could find. “But that is what this law is about.”
The later rally, at sundown, was organized by Tea Party groups from St. Louis and Dallas who said they decided to take the lead and support the state against a wave of boycotts protesting the law, some by cities like San Francisco and Seattle.
“We are doing this to crush any boycott against the free market,” said Tina Loudon, a Tea Party member from St. Louis who helped organize the rally. “Arizona has a sovereign right to enforce immigration laws on the books.”
The law — barring any successful legal challenges — will take effect July 29. It would allow the police to check the immigration status of people they suspect are illegal immigrants when they have been stopped for another reason. It also makes it a state crime, not just a federal one, to not carry immigration papers.
Advocates see it as a tool for law enforcement to weed out illegal immigrants, while five lawsuits filed against it call it an infringement on federal authority and suggest that Latino citizens and legal residents will be swept up for questioning.
On another front, the governor and attorney general are disputing who will defend the state against the legal challenges and possible litigation by the United States Justice Department.
Ms. Brewer, a Republican, said Friday she had removed the state’s attorney general, a Democrat and vocal opponent of the law, from defending it, accusing him of colluding with the Justice Department as it nears a decision on whether to challenge the law in court.
But the matter remained in dispute on Saturday, as the attorney general, Terry Goddard, a Democrat and potential challenger in her re-election bid, said in an e-mail message that he was “definitely defending the state” in legal challenges to the law.
Ms. Brewer said she took action after Mr. Goddard met Friday with Justice Department lawyers, who then met with her legal advisers.
Justice Department officials said they routinely meet with a state’s attorney general and governor when considering legal action against their state.
“We continue to have concerns that the law drives a wedge between law enforcement and the communities they serve, and are examining it to see what options are available to the federal government,” said Tracy Schmaler, a department spokeswoman.
The United States attorney general, Eric H. Holder Jr., has said he worries that the law may intrude on federal authority and lead to racial profiling.
Protest rallies were also held Saturday at the state capitols in Texas and Oregon, as well as in San Francisco, according to The Associated Press.
At the Arizona demonstrations, opinions could not be further apart.
Mireya Chavez Cerna, 43, an illegal immigrant who works as a maid, marched with her 9-year-old son, who was born in the United States and wore a shirt reading “Made in America.”
She denounced the climate of fear in the state and said immigrants like her could not abide the wait of a decade or more for a legal visa while their families grow hungry.
“Do you think we would risk losing our lives crossing the border if we didn’t have a need to come here for a better life?” she said. Supporters of the law “don’t know,” she added. “They don’t understand. They don’t live in Mexico. They don’t know how it is.”
But Ann Hyde, a radiological technologist from Chandler, said she grew frustrated at supporters being tarred as prejudiced or worse.
“We are not racists,” she said. “This law is about respecting the laws of the nation and the economic impact of illegal immigration, which is enormous. My state is broke and they cost us with spending on schools, hospitals and other services.”
Though violent crime is declining in Arizona, as in most other states, and illegal immigration is down at the border, speakers played up crimes that illegal immigrants have been charged with over the years, including shooting of police officers.
“One is too many,” said Mark Spencer, the chairman of a union representing rank-and-file police officers in Phoenix.

Illegal Aliens Committing Identity Fraud, Theft to Sneak Past E-Verify
A recently released report has revealed that illegal aliens are using fraudulent methods to obtain employment with employers who are enrolled in E-Verify – the online, electronically operated system that allows employers to confirm that their new hires have established their authorization to work in the United States. The report was conducted by Westat, a Maryland-based social science research firm under contract with the federal government. According to Westat, approximately half of illegal aliens run through E-Verify are inaccurately found to be work authorized, primarily due to identity theft. (Report, December 2009).
The Westat report identified four ways that illegal aliens can obtain employment despite being screened through E-Verify: (1) obtaining valid identification documents by using fraudulent “breeder” documents; (2) using altered or counterfeit documents; (3) buying, borrowing, or stealing valid documents; and (4) looking for alternative employment where employers (a) do not check documents or (b) will provide employees with fraudulent documents containing information for workers with employment authorization. (Report, December 2009). However, the federal agency tasked with administering E-Verify – U.S. Citizenship and Immigration Services (USCIS) – is already taking numerous steps in order to fight identity fraud and theft.
The most notable of these steps is expanding the E-Verify “Photo Tool.” The Photo Tool, which was launched by the Bush Administration in September 2007, allows employers to view photographs of workers presenting green cards and employment authorization documents. (USCIS News Release, September 25, 2007). By matching a photograph in the E-Verify program with the identification a worker presents, an employer can confirm that the document has not been altered. In Fiscal Year 2010, USCIS is adding U.S. passport photographs to the Photo Tool and is working to add visa photographs. USCIS also notes that it is “close to announcing a pilot agreement with a state to add its driver’s license data, which could be a first step before adding its driver’s license photographs.”
• Other important actions USCIS is taking to fight identity fraud and theft include:
• Expanding the number of behaviors that USCIS monitors for misuse of E-Verify;
• Increasing the amount of compliance assistance that USCIS provides to employers enrolled in E-Verify;
• Creating mechanisms for locking Social Security Numbers (SSNs) detected in possible identity fraud; and
• Deploying a self-check function to allow individuals to check their E-Verify response before they are hired, which could also allow individuals to lock and unlock their SSNs for E-Verify responses. (USCIS Synopsis, January 28, 2010).
While acknowledging that some illegal aliens are successfully gaming the system, the Westat report still resoundingly endorses the E-Verify program. It indicates that E-Verify has properly denied employment to hundreds of thousands of illegal aliens. (Report, December 2009). In addition, USCIS points out that it’s likely that the program “deters many unauthorized workers from even applying for jobs with participating employers.” (USCIS Synopsis, January 28, 2010). The report indicates that 96 percent of all E-Verify initial responses were consistent with the person’s work authorization status. With respect to work authorized individuals, over 99 percent were initially confirmed through E-Verify. In addition, 95.2 percent of employers participating in E-Verify reported that they were satisfied with the program overall. Finally, the report notes that E-Verify reduces discrimination against foreign-born workers in the hiring process and that USCIS has taken steps to strengthen protections for workers’ privacy and civil rights. (Report, December 2009).
Despite these facts, well-known amnesty proponent Sen. Chuck Schumer (D-NY) blasted E-Verify, calling the report “a wake-up call to anyone who thinks E-Verify is an effective remedy to stop the hiring of illegal immigrants.” (The Associated Press, February 25, 2010). However, USCIS describes E-Verify as the “best available tool to help employers determine whether their employees are authorized to work in the United States.” (USCIS Synopsis, January 28, 2010). And as Mark Krikorian of the Center for Immigration Studies points out, “in the old, paper-based system, 100 percent of illegal aliens are approved.” The fact that E-Verify has properly prevented hundreds of thousands of illegal aliens from obtaining employment in the United States, Krikorian observes, “is real progress.” (The Corner, February 25, 2010).

I am so sick and tired of people using the sales tax defense for illegals. Sales tax in Sacramento is 8.75%. I make $600 a week in gross wages. I bring home $488 a week. Thats $448 a month in taxes which equals 18.6% in taxes I pay. Not to mention I also pay sales tax on everything I buy. Lets say an illegal brings home $2000 a month and all that money is used to buy taxable products (which in real life it is not), that equals $175 he pays in sales tax a month. WHile I pay $488 in payroll taxes a month PLUS the sales tax I pay. Me = $488, ILLEGAL=$175. Does this seem fair to you? On top of all this, I do not qualify for government funded anything and have NEVER been on government funded anything including unemployment. So not only do they get to keep more of their money, they get to spend more of mine in the form of government subsidies. And even if they use a stolen SSN, they are allowed by law to claim 9 exemptions, therefore have little to no payroll taxes taken out of their paycheck. What happened to things being equal? WHy is it that the people who work hard everyday are the ones being abused. Most of the time I feel like a donkey going to work everyday with a whip cracked at my back and some illegal shouting vamanos while a bunch of illegals and their children get their free food, medical, housing from my sweat and blood. Its not fair. Equality for all I say. Like Obama says everyone needs to pay their fair share.
