The Sinking Lifeboat: Uncontrolled Immigration and the U.S. Health Care System in 2009
Executive Summary
America’s health care system is in crisis: Costs and insurance premiums are skyrocketing and the number of the uninsured is rising rapidly as millions of Americans have lost their jobs. Providers are reducing staffing and services and increasing rates, and hospitals are closing or facing bankruptcy. Into this deteriorating situation, the Obama Administration is boldly striding in an effort to extend medical insurance more widely to the uninsured. A key issue is the cost of the expansion, and that cost will be greatly influenced by the amount of coverage that becomes available to immigrants, including illegal aliens and their children—a sizable portion of the uninsured.
The President and members of Congress have spoken extensively about the crisis in health care, but what they have ignored is the role immigration has played in driving up the number of uninsured and the rising cost of health care for native-born Americans.
As states grapple with current budget deficits, they are cutting their health care budgets to try to make ends meet. But they are limited by current legislation from making certain cutbacks in emergency medical care that would ease some of the strain that is caused by the high level of immigrant usage, especially by illegal aliens.
What is most frustrating to the public, federal state and local governments refuse to collect the information that would expose just how expensive health care to immigrants actually is, and how the quality and availability of health care to American citizens is suffering because of it.
Research data described in this report substantiate the following facts:
• Between 1989 and 2007, immigrants and their U.S.-born children accounted for 71 percent of the increase in the uninsured.
• Today, more than one out of every four uninsured U.S. residents is an immigrant.
• There are 14.5 million immigrants and their U.S.-born children without health insurance, 32 percent of the uninsured.
• The foreign-born make up 27 percent of the uninsured population in the U.S.
• 48 percent of immigrants and their children are either uninsured or depend on Medicaid.
• Approximately 65 percent of illegal aliens in the U.S. are uninsured.
• In some hospitals, as much as two-thirds of total operating costs are for uncompensated care for illegal aliens.
• 425,000 births a year in the U.S.—more than 1 in every 10 births—is to an illegal alien mother.
• Although a national total of annual unreimbursed medical expenses for illegal aliens is not available, it is likely that those costs are more than $10.5 billion.
Federal laws requiring hospitals to treat anyone who enters an emergency room regardless of ability to pay have created an unfunded mandate. States and localities may not deny emergency care to the uninsured regardless of immigration status. The problem of emergency care has grown to enormous proportions because the lack of enforcement of federal laws against illegal immigration has led to a pool of 13 million illegal aliens in the U.S.—and state and local taxpayers are being forced to foot the bill. Although immigration law enforcement is a federal responsibility, most hospitals receive little or no reimbursement for the care to immigrants that the federal government mandates that they provide. Although there was legislation passed in 2005 to reimburse hospitals that provide emergency care for illegal aliens, the funds appropriated proved to be woefully inadequate, and that appropriation has since expired.
• Lack of insurance leads many immigrants to use hospital emergency departments—the most expensive source of health care—as their primary care provider. This leads to overcrowded conditions for citizens who seek emergency care. Nationwide, emergency room visits increased by 36 percent from 1996 to 2006. The problem has become so out of control that Mexican ambulance companies are being allowed to drive uninsured patients across the U.S. border to receive free treatment.1
• Many illegal aliens are taking advantage of legislation that requires emergency rooms to treat all patients, regardless of ability or intent to pay for the treatment. The cost of uncompensated care to taxpayers and insured patients continues to rise. Uncompensated costs has caused some hospitals to reduce staff, increase rates, cut back services, and close maternity wards and trauma centers.
The escalating burden incurred by hospitals and other health facilities for the uncompensated treatment of aliens is driven both by rampant illegal immigration and a legal immigration system that allows large numbers of foreigners to gain legal residence despite the fact that they are unlikely to be working in jobs with health care coverage or have personal resources sufficient to pay for health services. They are currently ineligible for Medicaid for the first five years after admission, so they, like illegal aliens, may resort to using emergency rooms. Furthermore, the sponsorship requirement for legal immigrants—intended to prevent immigrants from being a burden on the American taxpayer—is simply not enforced by the federal government.
The federal government had been providing a limited reimbursement of the outlays caused by uncompensated medical services provided to illegal aliens. Under Section 1011 of the Medicare Modernization Act (MMA), $1 billion was appropriated for distribution over the four-year period ending in fiscal year 2008. However, the $250 million annual distribution has not come close to meeting the costs, as will be shown.
There is no current effort to reauthorize funds for the reimbursement of uncompensated care. The plan of the Obama Administration and the congressional leadership is to cover illegal aliens under a taxpayer funded health care plan. In its present form, the proposed health care reform legislation has no provisions that will prevent illegal aliens access to taxpayer funded health care. Congress so far has rejected provisions that would prevent those in the country illegally from being covered at public expense.
Reversing the escalating burden of uncompensated health care for immigrants and illegal aliens will necessitate true immigration reform. That will include:
• enforcing laws against illegal immigration
• reimbursing states and localities for the costs of failures in federal immigration policy, but conditioned on cooperation with federal efforts to combat illegal immigration;
• identifying foreign users of publicly funded medical treatment (and their immigration status);
• establishing guarantees of medical insurance prior to admission to the country;
• clarifying existing federal emergency service laws regarding the termination of a hospital’s obligation for continuing care after the provision of emergency treatment to stabilize the patient.
It will also require a change in public officials’ mindset: Instead of shifting the burden to local taxpayers (often to those least able to pay when confronted with rising insurance premiums and medical bills), lawmakers must squarely face the consequences of immigration policy decisions. Our immigration system must be made consistent with U.S. national needs and priorities.
Yet quite the opposite is occurring. At a time when the country is struggling to provide affordable care to millions of uninsured citizens, President Obama’s priorities include the permanent incorporation of the millions of illegal aliens currently in the country through an amnesty that he terms a “pathway to citizenship.”

Backsliding on National Security: The Immigration Connection

Executive Summary
In a public relations campaign that evokes the image of Orwellian “newspeak,” the Department of Homeland Security has announced a long list of accomplishments in improving national security while at the same time it has adopted a number of measures that represent a significant backsliding on national security. If only the rhetoric is heard, the public may think its safety is in good hands. If, however, recent actions concerning the illegal alien population and the flow of foreign nationals into and out of the country are examined, a very different picture emerges.
The areas in which rhetoric and action widely diverge include:
• A willingness to abandon progress on implementation of a secure identification system based on state-issued driver’s licenses using national standards for verification of “breeder” documents and electronic exchange of information among the states and the federal government.
• Restriction of federal-local cooperation in the apprehension of foreigners illegally in the country.
• Abandonment of a system to discourage further illegal immigration based on curtailing job opportunities for those in the country illegally.
• Pursuit of an amnesty for foreigners illegally in the country which will work at cross-purpose to efforts to gain greater border control by deterring illegal immigration.
While talking toughness on national security, the Obama Administration appears to give a higher priority to its relationship with narrow political interest groups that it courted in the last election than to reducing the nation’s exposure to the threat of international terrorism. And, while President Obama’s efforts to assure foreigners around the globe that Americans are their friends is commendable, it is no substitute for enhanced homeland security.
If the Obama Administration were seriously interested in advancing national security, it would:
• Reverse course and welcome the assistance of local jurisdictions that aggressively identify illegal aliens for deportation.
• Push for the E-Verify system to be adopted as a national requirement for all employers and all workers. In the meantime, implementation of the “no-match” letter screening system would represent a significant deterrent to the mass illegal immigration that compromises border security.
• Withdraw support for an amnesty for illegal aliens and, thereby, convey the message abroad that the United States is serious about enforcing its immigration laws.
• Rapidly pursue implementation of a comprehensive electronic database that matches entry and departure of foreign visitors, and expand the special tracking database for students to include all long-term visitors.
• Reverse the recent expansion of the Visa Waiver Program that allows the entry of nationals of 35 countries to enter without consular screening and gradually eliminate it.
• Tighten the criteria for admission of nationals of countries with active terrorist organizations in the refugee and asylum programs.

Virtual Fence Plagued by Technical Failures and Delays; Now Faces Budget Cuts
The future of the virtual fence is uncertain in the face of a new threat of slashed funding coupled with ongoing performance issues and implementation delays. The $6.7 billion virtual fence project was started in 2005 as a component of the Secure Border Initiative (SBInet), and consists of cameras, ground sensors, and radar aimed at stopping illegal immigrants, drug smugglers, and terrorists on our southern border. (USA Today, February 4, 2010). The program has shown little success over the years and is now in serious jeopardy following Department of Homeland Security (DHS) Secretary Janet Napolitano’s January decision to order a reassessment of the entire initiative and the president’s proposal for a significant cut in funding. (The Washington Times, February 4, 2010). President Obama’s recently released budget proposes a $225 million cut in border security funding for the virtual fence program. (USA Today, February 4, 2010; For more information on Obama’s proposed cuts to immigration enforcement programs see FAIR’s Legislative Update, February 9, 2010).
Since its inception, the virtual fence has been plagued with technical failures that continue to delay its completion. Boeing Corporation was contracted in 2006 to implement a series of nine security towers equipped with night vision cameras, radar and sensors, along with a variety of communications systems and software to monitor activities along large stretches of the border. The technology was supposed to have been in place by June 2007, but the software system failed to distribute the information gathered by the detection devices. But as one problem was solved, others arose, including a radar system that confused vegetation for humans in inclement weather and cameras that were too slow to respond. (The Hill, February 10, 2010). In February 2008, the Government Accountability Office (GAO) reported to Congress that the virtual fence had fallen short of expectations as it failed to meet the goals and strategic needs of U.S. Customs and Border Protection (CBP). (GAO Report, February 2008; See FAIR’s Analysis, April 2008).
This January, Boeing was supposed to turn over the first permanent segment of virtual fence to Border Patrol for testing, but that has been delayed by problems with the video recording equipment. (The Washington Times, February 4, 2010). After three years and over a billion dollars, Boeing is still working on the first 28 miles of the surveillance system. (CBS News, January 10, 2010). With 1,972 miles to go, the virtual fence is not expected to be completed until 2014 at the earliest.
As a result, on January 8, Napolitano ordered a reassessment of the whole project, saying that the delays are unacceptable and the government must consider more efficient and economical options. (The Washington Times, February 4, 2010). She stated, "Americans need border security now - not 10 years down the road." Id. A few weeks later, President Obama proposed cutting the funding for SBInet. To date, American taxpayers have spent more than a billion dollars on a virtual fence that has yet to become a reality.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Mexico weighs options as lawlessness continues to grip Ciudad Juarez

CIUDAD JUAREZ, MEXICO -- Senior Mexican officials have begun a sweeping review of the military's two-year occupation of this dangerous border city, concluding that the U.S.-backed deployment of thousands of soldiers against drug traffickers has failed to control the violence and crime, according to officials in both countries.
The multi-agency review, which has not been made public, represents a "serious reassessment" of President Felipe Calderón's anti-narcotics strategy and reflects growing alarm that Juarez, across from El Paso, has descended into lawlessness, U.S. officials familiar with the process said.
The war on Mexico's powerful drug cartels has been the defining policy of Calderón's administration, involving unprecedented cooperation with American political and law enforcement authorities. Failure in a high-profile battleground such as Ciudad Juarez would represent a major defeat for Calderón and for U.S. officials determined to curb the multibillion dollar flow of drugs across the border.
"There is an almost unanimous consensus in the city that the strategy hasn't worked," said Hugo Almada, a sociology professor at the Autonomous University of Juarez who earlier this month organized a peace march of more than 3,000 people.
"The most terrifying question that everyone asks is, 'If the army comes in and can't control the situation, what happens to us now?' " Almada said.
Calderón declared Juarez the "tip of the spear" in the fight against the ultra-violent drug cartels, and it is here that the Mexican president has most militarized the fight. Calderón sent 10,000 soldiers and federal agents into the city of 1.3 million to bolster the local police and replace corrupt or incompetent elements. This month, for the first time in Mexico, the government distributed German-made assault rifles that fire up to 750 rounds a minute to hundreds of newly trained municipal police officers, also the first to receive urban combat training by the army.
But criminal outfits fighting over Juarez have overwhelmed even military authorities in this crucial port of entry into the world's largest market for illegal narcotics. With more than 2,500 homicides, Juarez accounts for more than one-third of the 6,000 drug-related murders in Mexico this year; since April, when a surge of federal troops brought a brief lull in the death toll, the city has resumed a pace of eight to 10 murders a day. The violence has also spilled over into the suburban neighborhoods of El Paso.
In a macabre daily ritual, assassins now appear to time their killings so that they get play on the afternoon and evening television news shows, according to Jaime Torres, a spokesman on public security for the Juarez government and former news director.
The city estimates that the violence has created 7,000 orphans and displaced 100,000 people, many of whom have fled across the Rio Grande to Texas. Most of the members of the business and political elite of Juarez, including the mayor, now either sleep or maintain a second home in El Paso. The chief human rights advocate also retreated across the river.
Well-known prosecutors, professors, attorneys, doctors, executives and journalists have been assassinated. Victims also include a growing number of small-shop owners because extortion is rampant; earlier this week an elderly woman selling burritos at a busy intersection near the tourist zone was shot dead. Police counted 36 shell casings at the scene.
A switch to 'soft power'
Mexican officials will weigh why the military has failed to stem the violence -- and what new options may be available. The soldiers have proved to be a blunt instrument; they lack experience handling criminal investigations and frequently have been accused of human rights abuses. Calderón has said the military will return to its barracks when federal and local police officers are ready, but reforms have moved slowly and may be years away, U.S. and Mexican officials caution.
There is now widespread debate over the way forward in Juarez, with some officials and civic leaders proposing additional troops, and others a complete withdrawal. The head of the powerful business organization that represents the local assembly factories, or maquiladoras, recently called for the United Nations to send blue-helmeted peacekeeping soldiers to Juarez.
The new U.S. ambassador to Mexico, Carlos Pascual, abruptly canceled a fact-finding trip to Juarez this month after learning of the Mexican government's policy review. U.S. officials said they are waiting to learn whether the discussions will lead to a shift in Calderón's military-led strategy, which has come under fire even from members of his own party.
The United States backed that strategy under the 2007 Merida Initiative, signed by President George W. Bush. The bulk of the $1.4 billion aid package funds Black Hawk and Bell 412 helicopters, CASA CN-235 surveillance planes, police training and inspection equipment.
But with the three-year initiative due to expire next year, U.S. officials have indicated that they plan to move from military assistance to a "softer" approach focusing on issues such as institution building, judicial reform and support programs aimed at impoverished youths like those who are recruited by the thousands into criminal gangs. Two-thirds of those killed violently in Juarez are between 14 and 24 years old.
"It's more sustainable. A helicopter at best is going to have a 25-year life, but a human being in Mexico has a 75-year life expectancy," said John Feeley, the deputy chief of mission at the U.S. Embassy in Mexico. "If you can get to the children, you are not just giving assistance, you are contributing in the development of a person, of the society."
Calderón has resisted calls to alter his military strategy, saying it would be tantamount to surrender. But a growing chorus of civic leaders and lawmakers here has urged the government to focus on the roots of drug trafficking rather than efforts to eradicate the cartel leaders, who draw their power from billions of dollars in drug sales in the United States.
Ciudad Juarez Mayor José Reyes Ferriz said he recently requested an emergency "intervention" from the federal government to boost social services. He said the Mexican government is prepared to spend $100 million to curb unemployment and improve opportunities for disadvantaged youths here.
"We have convinced the federal government that it is necessary," Reyes said of an effort that Mexican officials call "a social surge."
The U.S. State Department also plans to contribute to Juarez programs, American officials said.
On the urban frontlines
Despite the military buildup, law enforcement in Juarez has become a dangerous, frustrating and increasingly futile endeavor for the thousands of soldiers and police who chase traffickers and their surrogates through the shantytowns that grow out of the city sprawl.
One evening this month, a police convoy of a half-dozen trucks set out from the station house in Delicias, a poor district on the west side of the city. Masked officers sporting black, bulletproof vests and assault rifles stood in the backs of the trucks, which climbed into the hills overlooking the lights of Juarez and El Paso.
Every few hundreds yards, the convoy halted. Officers fanned out to grab and interrogate young men deemed suspicious. The officers sniffed their fingers for traces of marijuana or another drug, agua celeste, or heavenly water, a cheap, blue industrial solvent.
"They didn't do anything! They were just playing in the street!" shouted an elderly woman as police forced six boys, one of whom said he was 12, to stand spread-eagle beside a police truck while officers frisked them.
A call came over the radio, and the convoy suddenly sped off. The trucks raced downhill, screeching through the curving streets, until they arrived at a busy intersection across from a gas station. A bullet-riddled police truck stood on the side of the road, its front wheels on the curb. The pavement was littered with glass and flooded with water and radiator fluid.
A Delicias commander had been ambushed, shot in the leg after stopping to get gas, police said. Two more officers in the city were attacked in the same night.
Thirty Juarez police officers have been killed this year; most were hunted down in their homes, according to police officials. Asked if the municipal police had sufficient resources, David Rivera Bretón, a retired general who heads the force, replied: "I think that question should be directed to other people."
"At the end of the day, the Mexican state, the rule of law, has to prevail," Bretón said in an interview. "The good guys have to win."
When the army descended on Juarez in March 2008, the soldiers were greeted as heroes. Calderón added another 5,000 troops in late March of this year, and the murder rate dropped into double digits for each month; on some days not a single killing was recorded, a fact that made newspaper headlines. Local police even said the cartels had been driven out like "cockroaches" in the light of day.
Then, in June, the murder rate shot up 307 percent, and it has continued to rise. Bretón says the cartels, rather than being driven out, "went into hiding."
"They slowed down their activities," he said. "Later, they figured out what we were doing, how we were going about this, and, logically, they adjusted. We have to adjust as well."

Drive from the bottom of California to San Francisco and you will find numerous towns entirely overrun with illegals and not hear English anywhere! Where in the United States is it not overrun with illegals?

Enforcement Plays Key Role in Declining Illegal Alien Population

Last week, the Department of Homeland Security (DHS) released an estimate of the illegal alien population residing in the United States as of January 2009. According to the new report, the illegal alien population dropped seven percent, from 11.6 million in January 2008 to 10.8 million in January 2009. (DHS Report, January 2010). While anti-enforcement advocates claim that the decrease has been brought about entirely by the recent economic downturn, there is strong evidence indicating that stepped-up enforcement of our immigration laws is a significant force behind the reduction.
Following the defeat of amnesty legislation in 2007, the Bush Administration – which had previously been lobbying hard for passage of an amnesty – announced “a package of initiatives” aimed at “significantly strengthen[ing] our hand with respect to immigration enforcement.” Specifically, former DHS Secretary Michael Chertoff indicated that the administration was planning to ramp up worksite enforcement and allocate resources toward strengthening electronic employee verification through E-Verify. (DHS Press Release, August 10, 2007). The Bush Administration also significantly increased the fenced portion of the U.S. border in 2007 and more than doubled the number of detention beds used to hold aliens to over 30,000. (CIS Report, July 2008).
These expanded enforcement efforts produced striking results. Immigration and Customs Enforcement made 863 criminal arrests and 4,077 administrative arrests in 2007—more than five times the number ICE arrested in 2004. These numbers grew even more in 2008, to 1,103 criminal arrests and 5,184 administrative arrests. (ICE Fact Sheet, April 30, 2009). The number of businesses screening workers through E-Verify also exploded. In 2007, just 16,000 employers were enrolled in E-Verify. That number jumped to 66,000 in 2008 (DHS Leadership Journal, May 21, 2008), and is now at more than 184,000. (DHS E-Verify Fact Sheet, February 3, 2010).
States also increased their enforcement of immigration laws in 2007 and 2008 by expanding participation in the 287(g) program. Prior to 2007, just seven state and local law enforcement agencies had entered into agreements with ICE to participate in 287(g) – the federal program that allows ICE agents to train state and local police officers in the enforcement of federal immigration law. (ICE Fiscal Year 2007 Annual Report). At the end of 2008, ICE had expanded the program to a total of 67 local law enforcement agencies. (ICE Fiscal Year 2008 Annual Report).
As a consequence of these increased enforcement efforts, the number of aliens removed from the United States increased dramatically in 2007 and 2008. In 2004, 203,000 foreign nationals were formally removed from the United States. (DHS Annual Report, November 2005). This number increased to more than 319,000 in 2007 (DHS Annual Report, December 2008) and rose even further, to nearly 359,000, in 2008. (DHS Annual Report, July 2009).
Moreover, the deterrence created by increased enforcement, combined with the recession, encouraged more illegal aliens to leave the U.S. and discouraged illegal aliens from coming to the U.S. in the first place. In fact, the number of southwest border apprehensions dropped from 1,171,428 in 2005 (DHS Annual Report, May 2006) to 705,022 (DHS Annual Report, July 2009) in 2008. FAIR Media Director Ira Mehlman commented on the new DHS numbers: “Whether jobs dry up because the government is doing enforcement or because of the recession, illegal aliens react in a rational manner: They either will not come or they’ll go home. New statistics from the Department of Public Social Services reveal that illegal aliens and their families in Los Angeles County collected over $37 million in welfare and food stamp allocations in November 2007 – up $3 million dollars from September, announced Los Angeles County Supervisor Michael D. Antonovich. Twenty five percent of the all welfare and food stamps benefits is going directly to the children of illegal aliens. Illegals collected over $20 million in welfare assistance for November 2007 and over $16 million in monthly food stamp allocations for a projected annual cost of $444 million. “This new information shows an alarming increase in the devastating impact Illegal immigration continues to have on Los Angeles County taxpayers,” said Antonovich. “With $220 million for public safety, $400 million for healthcare, and $444 million in welfare allocations, the total cost for illegal immigrants to County taxpayers far exceeds $1 billion a year – not including the millions of dollars for education.”

Study: Illegal alien population may be as high as 38 million A new report finds the Homeland Security Department "grossly underestimates" the number of illegal aliens living in the U.S. Homeland Security's Office of Immigration Studies released a report August 31 that estimates the number of illegal aliens residing in the U.S. is between 8 and 12 million. But the group Californians for Population Stabilization, or CAPS, has unveiled a report estimating the illegal population is actually between 20 and 38 million. Four experts, all of whom contributed to the study prepared by CAPS, discussed their findings at a news conference at the National Press Club in Washington Wednesday. James Walsh, a former associate general counsel of the Immigration and Naturalization Service, said he is "appalled" that the Bush administration, lawyers on the Senate Judiciary Committee, and every Democratic presidential candidate, with the exception of Joe Biden, have no problem with sanctuary cities for illegal aliens. "Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. Walsh said his analysis indicating there are 38 million illegal aliens in the U.S. was calculated using the conservative estimate of three illegal immigrants entering the U.S. for each one apprehended. According to Walsh, "In the United States, immigration is in a state of anarchy -- not chaos, but anarchy."

FAIR Legislative Update February 16, 2010Reid Jobs Bill Gives Tax Breaks for Hiring Illegal Workers
Senate Majority Leader Harry Reid (D-NV) unveiled his jobs bill last week that proposes tax exemptions and tax credits for employers who hire and retain workers—regardless of their immigration status. Senator Reid introduced his bill, entitled the “Hiring Incentives to Restore Employment Act,” immediately after shelving a more extensive bill authored by Senators Max Baucus (D-MT) and Chuck Grassley (R-IA), the Chair and Ranking Member of the Finance Committee. In doing so, Reid said he wanted to focus clearly on the “jobs message” he thought the Senate should be sending to the American people. (Roll Call, Feb. 16, 2010).
The Reid bill has two primary tax provisions that are intended to spur employment. The first would exempt employers from payroll taxes for new employees hired before January 1, 2011. (§101) A qualifying employer is virtually any employer except government bodies, although an exception is created for colleges and universities. To be a qualifying employee, the worker must:
(1) Begin employment with a qualified employer after February 3, 2010, but before year end;
(2) Sign an affidavit stating that he/she was not employed for more than 40 hours during the 60-day period prior to beginning employment with the qualified employer;
(3) Not displace another of the qualified employer’s workers; and
(4) Not be a relative, broadly defined, of the employer. (See §101)
Nowhere in Section 101, however, is there a requirement that the individual be legal. Nor does the language require that the employer use E-Verify to verify work authorization. The language appears to allow employers to receive tax breaks for hiring illegal workers or for importing foreign workers.
The second major tax provision of the bill provides employers with a $1,000 tax credit for each “retained worker” hired in 2010. (§102) To qualify as a “retained worker,” the individual must:
(1) Meet the definition of a qualified employee under §101 (see above);
(2) Be employed during the taxable year;
(3) Be employed by the employer for no less than 52 consecutive weeks; and
(4) Maintain wages at a certain threshold during the 52-week period.
Like Section 101, this tax credit does not require the employee to be legal or require that the employer use E-Verify to establish the employee’s work authorization.
Action on the Reid Jobs Bill is expected next week and Senate sources have told FAIR that the Senate Majority leader has already taken steps to block amendments to the bill. Stay tuned to FAIR for more information as the Reid Jobs Bill moves forward.

Immigration law ignites fear in Arizona
A new state law requires public workers to report illegal immigrants who apply for benefits they aren't entitled to. The attorney general will decide the law's scope.

Cristina, an illegal immigrant living in South Tucson, recently went to a government office to sign up her children for a state-run Medicaid program.

The boy and girl, ages 7 and 3, respectively, are U.S. citizens and entitled to the benefits. But Cristina, who spoke on condition her last name not be used, was fearful. She'd heard of a new state law requiring public workers to alert Immigration and Customs Enforcement when illegal immigrants apply for benefits they are not legally entitled to.

So when workers asked Cristina, 32, for identification, she fled. She now says she has no way to treat her daughter's liver problems or her son's asthma and impacted tooth.

Cristina, a single mother and part-time house cleaner, is even reluctant to take her children to a hospital emergency room. "I feel so alone," she said.

The new law has terrified the immigrant community here, leading to agonized discussions at schools, churches and community meetings about whether it is safe to get government help in Arizona. The author of the law, state Sen. Russell Pearce, is happy about that.

"I have a hard time having compassion for criminals," Pearce said. "It's about time people started being afraid."

Pearce contends that a large number of illegal immigrants improperly receive public benefits, and his law makes it a misdemeanor for a public worker to fail to report one. The law also allows citizens to sue public agencies if they believe immigrants are receiving improper benefits.

"I want the law enforced," he said. "Every time you pass something it becomes a toothless tiger." He acknowledged that his bill is not supposed to apply to people like Cristina's children, who are legally entitled to federal benefits.

The law took effect in late November, and it is not yet clear what government services it applies to. Some fear it could mean libraries and fire stations are obligated to report illegal immigrants, an interpretation Pearce said is silly.

He said the bill applies only to a range of welfare, Medicaid and other government aid programs that are not already guaranteed to illegal immigrants under federal law.

But many Arizonans are awaiting an opinion from the state's attorney general on the law's scope and which government workers are obligated to report illegal immigrants.

Critics of the law say it creates fear and uncertainty over a problem that doesn't exist.

"It's already the law in Arizona that we cannot give benefits to people who are in the country illegally," said Ken Strobeck, executive director of the Arizona League of Cities and Towns, which unsuccessfully sued to halt the law's implementation.

Experts on both sides of the immigration debate agree that illegal immigrants rarely receive government benefits illegally. Many economists have found that immigrants pay for benefits they receive through taxes, though some studies show a net loss to government.

The main cost to taxpayers comes from the use of public schools or emergency medical care -- benefits guaranteed illegal immigrants under federal law.

Also, children of illegal immigrants who are U.S. citizens are eligible for the same benefits as those of any other citizen, such as food stamps.

"There's not much that Arizona can do about it," said Steven A. Camarota, research director at the Center for Immigration Studies in Washington, which favors restrictions on immigration. "The only solution is for us to have fewer illegals and fewer U.S.-born children" of illegal immigrants, he added.

Camarota estimated that families headed by illegal immigrants receive public assistance at about the same rate as families of native-born citizens who lack a high school education. A 2002 study by the Urban Institute found that illegal-immigrant families used benefits at a far lower rate than native-born ones -- for example, 11% of illegal-immigrant families in Los Angeles County used food stamps, compared with 33% of low-income native-born ones.

Randy Capps, who worked on the Urban Institute study and is now at the Migration Policy Institute, said illegal immigrants shy away from government aid. "When you're in an anti-immigrant, hostile environment, like in Arizona, the message is clear that you put yourself at risk with any contact with the government," Capps said.

In 2004, Pearce, a Republican, helped write a ballot initiative that required state workers to report illegal immigrants who receive benefits. But Arizona Atty. Gen. Terry Goddard, a Democrat, interpreted the measure narrowly so the law applied to only a couple of obscure programs.

This year, as the state struggled to address its budget deficit, Pearce inserted language in the budget bill reiterating those requirements. Many immigrant advocates and local officials were unaware of the move until the law took effect. Its impact was swift.

Jennifer Allen, executive director of the Border Action Network here, said the group has been swamped with calls from terrified parents, like Cristina, fearful of seeking benefits for their U.S. citizen children.

"It's sent a shock wave of fear through immigrant communities," Allen said.

The state Department of Economic Services, which administers welfare benefits, has referred to federal authorities more than 750 people who applied for benefits without proof of legal residency. Officials at ICE have not said whether they have taken action on those cases, but stressed that their priorities in deportations lie with violent criminals.

On a recent morning, a group of immigrants sat in the modest offices of the Border Action Network, sharing stories of fearful trips to apply for benefits. Sofia Machado, an English teacher and volunteer at the group, said one of her neighbors had been deported after seeking Medicaid for her U.S.-born children.

Just as Machado finished telling the story, her cellphone rang. The caller's daughter was three months pregnant and had started bleeding, but the caller feared taking her to the hospital. Machado tried to reassure the caller that hospitals should not be checking immigration status.

"There's a lack of information and a panicked ignorance," she said afterward. "Look at the disaster these people have created."

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

A Santa Clarita councilman's shout-out at a recent anti-illegal immigration rally that he is a "proud racist" has ignited an angry war of words in a suburban community over whether the longtime civic leader is a hatemonger who should be driven from office or a patriot unafraid to speak out for fellow Americans.

Bob Kellar, a veteran councilman and two-time mayor, said his words have been taken out of context, but he declined to offer an apology at a City Council meeting Tuesday night.

But the remark, which was posted in a video on You Tube and quickly spread across the blogosphere, has set off a firestorm. As protesters carrying signs milled outside the council meeting, dozens of Santa Clarita residents jumped on the issue. Many applauded Kellar when he strode into the meeting.

"They are invading us, and colonizing us . . . and we taxpayers are footing the bill for them," lifelong Santa Clarita resident and Minutemen member Robert Crooks, 59, said of undocumented workers. For the last five years, Crooks said, he has volunteered as a sentry on the U.S.-Mexico border in Tecate, keeping watch for border-hoppers.

Bruce McFarland, a political organizer and 32-year resident of the Santa Clarita Valley, called Kellar "an embarrassment" and urged the council to censure him, which elicited boos and expletives from the audience.

The controversy stems from a Jan. 16 anti-immigration rally in Santa Clarita; Kellar spoke and referred to a statement by former President Theodore Roosevelt that the United States has a place for only one flag and one language.

Kellar said those remarks caused some people to accuse him of being racist, to which he replied: If believing in America causes people to think he's a racist, "then I'm a proud racist."

Roger Gitlin, founder of the Santa Clarita Valley Independent Minutemen, who helped organize the anti-immigration rally, defended Kellar's remarks as "rhetorical hyperbole."

"He got a little ahead of himself in words," Gitlin said. "But in no shape or form is Bob Kellar a racist. . . . He is tired of political correctness. Nobody hates anybody. We just want the rule of law."

At least two supporters were overcome with tears as they stood at the podium and praised the councilman. One speaker called him a "caring and compassionate leader"; others extolled him as "a patriot" and a "great American."

The support for Kellar, a U.S. Army veteran who served 25 years with the Los Angeles Police Department, focused attention on the simmering tensions over the effect of illegal immigration in this predominantly white and largely conservative northern Los Angeles County city.

Population statistics published by the city for 2008 show that close to 70% of Santa Clarita's population of 177,045 is white. But a large influx of immigrants from a variety of countries in recent years is making the city more multiethnic. More than a quarter, or 27%, of Santa Clarita's population is Latino, according to city officials.

Friction over undocumented immigrants settling and working in the city is not new. In a written response published Tuesday in a local newspaper, Kellar outlined some of the local complaints he has fielded over the years about "the illegals and the impacts they have on our society."

"Forty people living in one house and destroying our neighborhood and quality of life, emergency rooms with standing room only and no one speaking English, day laborers standing all over our streets taking a toll on our businesses and traffic," Kellar wrote. "That describes some of the issues on a local basis."

In 1997, Santa Clarita adopted an ordinance banning day laborers from soliciting work on the street, but it was suspended after a U.S. District Court ruling in 2000. Four years later, Kellar asked city staff to research the possibility of creating a day laborer work center, but no facility was ever created.

Many residents who defended Kellar's "proud racist" remark said they would crack down harder and wished undocumented immigrants would leave the city and country. Several blamed them for an upswing in crime and for drug- trafficking.

"Illegals are here at the expense of our community," said Santa Clarita Valley businessman Larry Rasmussen. "I agree with Bob. Our nation is a nation of laws."

The few residents who spoke out against Kellar at Tuesday's meeting accused the councilman of spreading hatred. Some called Kellar's remarks "disgraceful" and suggested that the councilman at least apologize. Kellar told reporters he had no regrets over his remarks.

Racial Hate Feeds a Gang War’s Senseless Killing

LOS ANGELES, Jan. 16 — The Latino gang members were looking for a black person, any black person, to shoot, the police said, and they found one. Cheryl Green, perched near her scooter chatting with friends, was shot dead in a spray of bullets that left several other young people injured.
She was 14, an eighth grader who loved junk food and watching Court TV with her mother and had recently written a poem beginning: “I am black and beautiful. I wonder how I will be living in the future.”
“I never thought something like this could happen here in L.A.,” said her mother, Charlene Lovett, fighting tears.
Cheryl’s killing last month, which the police said followed a confrontation between the gang members and a black man, stands out in a wave of bias-related attacks and incidents in a city that promotes its diversity as much as frets over it.
Ethnic and racial tension comes to Los Angeles as regularly as the Santa Ana winds. Race-related fights afflict school campuses and jails, and two major riots, in 1965 and 1992, are hardly forgotten. But civil rights advocates say that the violence grew at an alarming rate last year, continuing a trend of more Latino versus black confrontations and prompting street demonstrations and long discussions on talk-radio programs and in community meetings.
Much of the violence springs from rivalries between black and Latino gangs, especially in neighborhoods where the black population has been declining and the Latino population surging. A 14 percent increase in gang crime last year, at a time when overall violent crime was down, has been attributed in good measure to the interracial conflict.
This month, the authorities reported that crimes in the city motivated by racial, religious or sexual orientation discrimination had increased 34 percent in 2005 over the previous year. Statistics for 2006 have not yet been compiled.
Rabbi Allen Freehling, executive director of the Los Angeles Human Relations Commission, a group created after the 1965 riots, said the recent growth in hate crimes reflected a failure by government and community leaders to prepare residents for socioeconomic changes in many neighborhoods, “and therefore people have a tendency to lash out, out of desperation.”
In November, three Latino gang members received sentences of life in federal prison for crimes that included the murder of two black men — one waiting for a bus, another searching for a parking spot — and assaults on others in a conspiracy to intimidate black residents of a northeast Los Angeles neighborhood.
In another case, a twist on past racial dramas, 10 black youths, some of whom prosecutors say had connections to a gang, are on trial for what prosecutors contend was a racially motivated attack in neighboring Long Beach on three young white women who were visiting a haunted house on Halloween. Long Beach also experienced an increase in hate crimes in 2005.
But even with the alarm caused by the recent increase in bias crimes, Constance L. Rice, a veteran civil rights lawyer, said that, considering Los Angeles’s diversity, race relations remained relatively calm and were even marked by many examples of groups getting along.
Still, in several corners of the city, particularly where poverty is high and demographics are shifting, tensions have been flaring.
“You don’t find entire segments of the city against one another,” Ms. Rice said, “but in the hot spots and areas of friction you find it is because the demographics are in transition and there is an assertion of power by one group or the other and you get friction.”
In Harbor Gateway, the neighborhood where Cheryl Green was killed, tension had grown so severe that blacks and Latinos formed a dividing line on a street that both sides understood never to cross and a small market was unofficially declared off-limits to blacks. Ms. Lovett had warned her children not to go near the line, 206th Street, but Cheryl had ridden her scooter near it to talk to friends when she was shot.
Neighbors said the dominant 204th Street gang, which is Latino, had harassed blacks and Latinos alike and effectively kept the groups divided, though language and cultural differences also have contributed to segregation.
“We wave hello, but I cannot really talk to blacks because my English is limited and I don’t want to mess with the gang,” said Armando Lopez, speaking in Spanish, who lives near where Cheryl was shot.
A man who described himself as a former member of the 204th Street gang said black gang members had shot or assaulted Latinos, too, and explained the violence as a deadly tit-for-tat.
“They shot a Mexican guy right around the corner from here and nobody protested or said anything,” said the man, who asked that his name not be used for fear of retaliation. He referred to neighborhood speculation that Cheryl’s killing was in retaliation for the killing of Arturo Mercado, a Latino shot to death in the neighborhood a week before Cheryl in what the police call an unexplained shooting.
The violence in that neighborhood and others has prompted a flurry of announcements by Mayor Antonio R. Villaraigosa and police officials promising a renewed crackdown on gangs, particularly those responsible for hate-related crimes. Mr. Villaraigosa plans to meet Friday with Robert S. Mueller III, the director of the Federal Bureau of Investigation, about expanding its assistance in investigating gang and hate-related violence; the agency has been working with the police on such investigations in the San Fernando Valley, where gang violence has increased the most.
Chief William J. Bratton has said the Police Department would soon issue a most-wanted list of the city’s 10 to 20 worst gangs, with those most active in hate crimes likely to land on it.
“It’s to say, ‘We’re coming after you,’ ” Mr. Bratton said.
A city-financed report by Ms. Rice released Friday said Los Angeles needed a “Marshall plan” to address gang violence in light of a growth in gang membership and a lack of a comprehensive strategy to curb the problem.
Despite the spike in hate crimes in 2005, the total number of bias-related incidents in Los Angeles, 333 in a city of 3.8 million people, was down from peaks in violent crime in the mid-1990s and just after the Sept. 11 attacks.
Cheryl Green’s killing particularly alarmed community and civil rights advocates because of her age and the indication that the neighborhood’s long history of racial violence was continuing. Two Latino gang members have been charged with murder in the case. With the district attorney having filed a formal allegation that the men were motivated by hate, they could be eligible for the death penalty or life in prison without parole if convicted.

NOT HISPANDERING OBMAMA OR McAMNESTY......And why do they listen to the advice they get? Or why don’t they seek out better counsel in the first place? Here’s a prominent example from this summer. As she has every year for as long as I can remember, Sen. Dianne Feinstein predicted that without an immigrant guest worker program, crops would rot in the field and California would suffer untold billions of dollars of losses. Is there no one on Feinstein’s staff to whisper in her ear: “Senator, we’ve used this one for over a decade. No one is listening because nothing is rotting”? What’s possible is that everyone has warned Feinstein but since she is old and crotchety, she doesn’t listenand since the people around her would like to keep their jobs, they’ve stopped bucking her. Or there’s presidential aspirant John McCain. Why would he risk further infuriating potential conservative Republican supporters by naming well-known reconquista Juan Hernandez as his “Hispanic Outreach Director”? No one performs the function of reaching out to Hispanics more slavishly than McCain himself, as his Senate voting record conclusively proves. Finally, in the strangest case of all, we have Hillary Clinton’s appointment of Los Angeles Mayor Antonio Villaraigosa as co-chairman of her national campaign. That Clinton, a woman who suffered through the humiliation of her husband’s tryst with Monica Lewinsky, could choose a man whose personal life makes Bill Clinton look like a saint defies all logic...desperate as she may be for the coveted Hispanic vote. But, as we’ll see when we examine the facts, there’s no conceivable way that Villaraigosa could have been an asset to her. Villaraigosa has been in the headlines these past few days as he hosted Mexican president Felipe Calderon who wound up his five-city tour in my now-unrecognizable hometown. [Mexican President Calderon Meets With LA Mayor Villaraigosa, By Greg Risling, Associated Press, February 14, 2008] Maybe Villaraigosa caught a break in his personal life considering that Calderon’s visit fell on St. Valentine’s Day. Since the women in his life aren’t speaking to him —both wife Corina and former mistress Telemundo reporter Mirthala Salinas [Picture and video here] —how else would Villaraigosa spend the day traditionally reserved for lovers if not billing and cooing with Calderon? La señora Villaraigosa filed for divorce after her husband’s tawdry affair became public. And Telemundo transferred Salinas, after suspending her for two-months, to its Inland Empire bureau in the California hellhole known as Riverside. If you have been to Riverside lately, you know how cruel Salinas’ punishment was. Not surprisingly, she is reported to have quit. When it comes to extramarital philandering, Villaraigosa is a multiple offender. In 1994, while combing California allegedly “researching” the viability of his political career, Villaraigosa and married family friend Marta Reyes were instead shacked up in a Silver Lake motel. To make the story even more distasteful, at the time his wife Corina was home recovering from cancer surgery. Corina soon discovered Villaraigosa’s affair—and foolishly forgave him, only to suffer another day. (All the dirt is dished here.) Villaraigosa is whatever name you would give to someone whose ethical standards don’t even reach the level of your garden-variety lounge lizard. Okay, so this is Hollywood. Shameless sexmarital infidelity phony names on registrations at cheap motels lies compounded by bigger lieswhat else is new? But that’s the most amazing thing: despite repeated open demonstrations of moral turpitude that should force him “into the shadows” forever, Villaraigosa became one of Clinton’s prominent spokesmen. How is it possible? Any rational person would expect that, given Clinton’s experiences with her cheating husband, the mere mention of Villaraigosa’s name would make her vomit. Under no circumstances should Clinton want to be in the same room with the depraved Mechista. That’s not what happened. In Clinton’s pandering effort to appeal to Hispanic voters, no cad is too unworthy to represent her. With the wheels now apparently coming off of Clinton’s campaign, might Villaraigosa’s role in Iowa where she finished a distant third to Barack Obama have been the beginning of the end for her? The political pros and cons of the Clinton-Villaraigosa connection never added up for Hillary. In New Hampshire, where Villaraigosa first stumped for Clinton, he had no impact. The state, which Clinton won, has almost no Hispanics (about 2 percent according to the U.S. Census Bureau). Therefore, Villaraigosa probably couldn’t have helped her—especially when you factor in the prevailing statewide attitudes towards Californians. As someone who has spent a good deal of time in New Hampshire, I can report that most Granite State residents view us as people with whom they have no connection. They’re aware that Los Angeles exists but it is unlikely that, even if you put an airline ticket in their hands, they’d have much interest in visiting. Who in New Hampshire then would take seriously anything a Mexican mayor from Los Angeles would have to say? Even though Clinton won the primary, she demonstrated poor judgment by letting Villaraigosa represent her. On to Iowa, where Clinton’s vulnerability first surfaced, and a different story played out. Illegal immigration in Iowa is important. In recent years, the state’s alien population has risen rapidly. And voters are angry about it. Illegal immigrants took well paying jobs in the meat packing industry away from Iowans where, in many cases, several generations had worked in the factories before aliens were recruited at drastically lower pay. Villaraigosa to the rescue? Not hardly. Like New Hampshire, Iowans view Californians with suspiciontoo much glitz and glamour. To confirm Iowans apprehensions, Villaraigosa arrived on the Clinton campaign trail fresh off an Aspen, CO. skiing vacation. Iowans don’t associate snow with the high-life. To them, it’s what they shovel off their driveways all too often on winter mornings. Having a $400 haircut (Villaraigosa and John Edwards have the same stylist) is a negative in Iowa. Clinton finished a distant third behind Barack Obama. How much Villaraigosa’s high profile appearances on her behalf set Clinton back can’t be quantified. But, as in New Hampshire, Villaraigosa’s endorsement provided no readily apparent upside. One could argue that Villaraigosa, who made several supportive appearances on Clinton’s behalf, was an asset in her successful California primary victory. But—an important distinction—Villaraigosa lives in California. That’s a lot different than traveling half way across the country to do Clinton’s bidding. Bad behavior does have its consequences, however. Two years ago, after Villaraigosa won the mayoral election, his name was bandied about as a likely candidate for governor in 2010 when Arnold Schwarzenegger terms out. Some speculated that he might pursue a U.S. Senate seat if and when Barbara Boxer or Feinstein mercifully retires. All that talk is over. In fact, Villaraigosa may have trouble keeping his current job when he runs for re-election in 2009. Walter Moore, a lawyer and Republican mayoral candidate in 2005, notes that Villaraigosa’s out of state trips are an express violation of the Los Angeles City Charter that requires the mayor and each city council member to “devote their entire time to duties related to their offices” Moore, who will challenge Villaraigosa again, further observes that the charter forbids the mayor from accepting “compensation . . . for his services" other than city salary and benefits. Moore wonders who picked up the tab for Villaraigosa’s expenses. Summing up the strange and curious case of Villaraigosa and Clinton: the only logical conclusion is that thoughtless pursuit of the Hispanic vote doesn’t pay off—and has the unintended negative consequence of damaging candidates with voters of all races. ................

New statistics from the Department of Public Social Services reveal that illegal aliens and their families in Los Angeles County collected over $37 million in welfare and food stamp allocations in November 2007 – up $3 million dollars from September, announced Los Angeles County Supervisor Michael D. Antonovich. Twenty five percent of the all welfare and food stamps benefits is going directly to the children of illegal aliens. As it stands, 44,000 Americans die on our nation’s highways annually. Half that number stems from drunken drivers. U.S. Congressman Steve King reports that 13 American suffer death from drunken driving Mexicans each day. Alcoholism runs rampant in Mexican culture. They suffer the most DUI arrests. Mexicans set the benchmark for animal cruelty. Mexicans love dog fighting, bullfighting, cock fighting and horse tripping. Those blood sports play in every arena and backyard in Mexico . They expand into America as more Mexicans arrive. They also engage in “steer-tailing” where the rider yanks the animal’s tail in an attempt to flip it to the ground. In horse tripping, they run the animals at full gallop around a ring, then, use ropes to trip them at full speed. It’s a death sentence as the horses break their legs, teeth, shoulders and necks—all to the delight of the cheering Mexican fans. As La Raza confirms, Mexicans maintain the most racist society in North America . “For the Hispanic race, everything; for anyone outside the race, nothing!” Guadalupe Loaeza, a journalist, said, “Mexican society is fundamentally racist and classist. The color of your skin is a key that either opens or shuts doors. The lighter your skin, the more doors open to you.” Corruption becomes a mechanism by which Mexico operates. Corruption remains systemic. The Washington Post wrote, “ Mexico is considered one of the most corrupt countries in the hemisphere.” They feature drug cartels, sex slave trade, people smuggling, car theft cartels, real estate scam cartels, murder for money and, you must bribe your mail man to get your mail. "As you listen to the news about the student protests over illegal immigration, there are some things that you should be aware of: I am in charge of the English-as-a-second-language department at a large southern California high school which is designated a Title 1 school, meaning that its students average lower socioeconomic and income levels. Most of the schools you are hearing about, South Gate High, Bell Gardens, Huntington Park, etc., where these students are protesting, are also Title 1 schools. Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll -- but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK) I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK) I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK) I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears. Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

Illegal aliens seen eroding vote

Illegal aliens are eroding the integrity of U.S. elections, and will continue to do so without tighter voting laws, several members of Congress testified at a hearing on Capitol Hill yesterday.

"There is a very real possibility that noncitizens have affected the outcomes of elections in the past, and will in the future," said Rep. Brian P. Bilbray, California Republican, before a House Judiciary Committee on voting irregularities and election deception.

With more than 20 million foreign-born residents in the United States who are not U.S. citizens, including at least 12 million illegal aliens, the potential for noncitizen voting is a growing concern, Mr. Bilbray said.

Rep. Steve King, Iowa Republican, said illegal aliens in many states can easily acquire driver's licenses, making it easy for them to register to vote, especially states with "motor-voter" laws.

"With many states making driver's licenses available to legal noncitizens and illegal aliens, it is probable voter rolls contain large numbers of noncitizens and illegal aliens," Mr. King said.

But several Democrats said the intimidation of immigrant voters -- not the voting of illegal aliens -- is the biggest election-reform priority.

"Election intimidation and deception have become an unfortunate aspect of recent federal elections, threatening to undermine Americans' confidence in a democratic government," said Rep. John Conyers Jr., Michigan Democrat and chairman of the House Judiciary Committee.

"Our goal is to protect every citizen's constitutional right to vote, and to thwart any future attempts to disenfranchise eligible voters through fraud, deception and intimidation."

Sen. Benjamin L. Cardin, Maryland Democrat, accused Republicans of distributing fraudulent "official Democratic voter guides" during his 2006 re-election bid in an attempt to confuse black voters to vote for his Republican challenger.

"It is time for Congress to once again take action to stop the latest reprehensible tactics that are being used against African-American voters," Mr. Cardin said.

In response to voter-intimidation cases, Sen. Barack Obama, Illinois Democrat, earlier this year introduced the Deceptive Practices and Voter Intimidation Act, which would impose penalties on people or groups found guilty of intimidating voters.

As for ID issues, Mr. Bilbray said the new REAL ID law, which will require states to verify proof of citizenship before issuing driver's licenses and voter identification cards, will greatly help combat fraudulent voting.

"Many people tend to think that the photo ID requirement would suppress voting, but there has never been evidence to support that assertion," Mr. Bilbray said. "Much to the contrary -- evidence shows that anti-fraud provisions increase voter turnout."

Mr. Bilbray added that more than a 100 democracies worldwide require voters to show photo IDs, including Mexico.

Earlier this month, the Bush administration delayed the start date for the REAL ID law from May 11, 2008, to Dec. 31, 2009.

As immigration rights leaders assess gains and losses since rallies last spring, they turn their focus to the recruitment of 1 million new voters.

Has the immigrant rights movement fizzled?
At a national Latino conference that drew hundreds to downtown Los Angeles last week, movement leaders emphatically said no.
Although Congress has stalled action on broad immigration reform and Labor Day marches failed to mobilize wide support, activists said they were only now beginning to roll out the next stage of their battle: a massive effort to produce 1 million new Latino voters and U.S. citizens.

"Now is not march time," Antonio Gonzalez, president of the Southwest Voter Registration Education Project in Los Angeles, said Saturday. "We're mobilizing voters. That's the big deal."But immigration control advocates say the marches last spring doomed activists' efforts by alienating most Americans and strengthening support for stronger border control and opposition to legalization."The mass sea of illegal aliens bearing foreign flags and hostile placards really produced a pronounced backlash, from which they've never recovered," said John Keeley, spokesman for the Washington-based Center for Immigration Studies. The movement's fate is in question just months after hundreds of thousands of immigrants and their supporters startled the nation by pouring into the streets to protest a House bill that would criminalize undocumented immigrants and those who support them. Buoyed by their success, they helped push the U.S. Senate to pass a landmark bill increasing visas and offering legalization to many of the nation's estimated 11 million undocumented immigrants.Since then, some activists acknowledge, their ranks have become demoralized as congressional action on the issue stalled over the summer and recent marches have fallen flat.In Los Angeles, for instance, police estimated that only about 1,500 people turned out for a Labor Day weekend rally that organizers had predicted would draw as many as 50,000. And Cecilia Munoz, a vice president of the National Council of La Raza, said some immigrants were reluctant to risk their jobs to march because the likelihood of legalization and other reform does not appear imminent."A lot of people feel a loss," immigrant activist Oscar Garcon said Saturday at the National Latino Congreso, which was billed as the most comprehensive gathering of Latino leaders in nearly 30 years. "They say, 'We demonstrated, we came out by the millions, but what did we change?' "But he and others said a movement cannot fairly be measured by the size of its marches or its early setbacks, and some experts agree.Louis DeSipio, a UC Irvine associate professor of political science and Chicano/Latino studies, said it was premature to dismiss prospects for broad immigration reform.He said such aims could take years to achieve. The 1986 amnesty for illegal immigrants, for instance, took a decade to pass and did so abruptly, just as most members of Congress thought the provision dead.DeSipio said movements cannot be built from marches alone."It's good they've moved away from the marches," he said. "Marches can get people's attention, but it doesn't necessarily get a higher percentage of the community involved in civic participation. That's what things like get-out-the-vote and voter registration drives do."DeSipio said the ferment over immigration could in time lead to a surge in Latino voters similar to the one after the 1994 passage of Proposition 187. The measure would have denied health benefits to undocumented immigrants had it not been overturned in the courts. The number of legal residents who became U.S. citizens increased from 434,000 in 1994 to more than 1 million in 1996; and Latino registered voters in California increased from 1.6 million in 1996 to 1.9 million in 2000, according to the National Assn. of Latino Elected and Appointed Officials Educational Fund in Los Angeles.Activists argue that some preliminary data offer evidence of another surge. According to U.S. immigration statistics, the number of citizenship applications increased by 41.5% in May over last year, a far larger increase than in previous periods."This is one of many issues, and it's going to take time, but it will come," said Cristina Basurto, 32, a member of Women of Earth, a social justice organization, who attended a small rally after the conference Saturday near downtown. "I think people still have it in their hearts and still want to fight for what they believe in."The number of new Latino voters grew by 35,000 in Los Angeles County from March to August, helping to boost their share of the electorate from 20% to 24% over last year, according to an analysis of Los Angeles County registrar-recorder data by the Latino officials' organization. Marcelo Gaete, the organization's senior program director, said his staff used a surname dictionary to determine how many of the county's new voters were Latino. Keeley, however, said the political landscape proves his point: A get-tough stand on immigration is a winning political message. In Pennsylvania, for instance, he said Republican Sen. Rick Santorum is rapidly closing what had been a double-digit deficit in the polls in his race against his Democratic challenger, state Treasurer Robert Casey Jr., by campaigning with a tough immigration message. He also said congressional hearings on immigration and local town halls during the summer recess have convinced many legislators that constituents see border control as a top priority. As a result, he said, "the chances are less than zero" of winning legalization this year. Some Latino activists, including UC Riverside ethnic studies department Chairman Armando Navarro, agree that the movement for immigrant rights has lost steam. He said internal squabbling, a lack of leadership and a failure to organize immigrants for long-term political change had squandered their gains of the spring. DeSipio and others, however, said activists had already scored a significant victory by so far stopping the House bill, especially the provision that would criminalize undocumented immigrants and those who aid them, from becoming law. Elements of that bill, including border enforcement measures, however, may still pass. Now, activists say, they are gearing up to launch what they envision will be a long-term effort to mobilize Latino voters for elections this November and, more important, in 2008.Two organizations — the Service Employees International Union and the Southwest Voter Registration Education Project — have raised $7 million for national voter registration and get-out-the-vote efforts. The National Assn. of Latino Elected and Appointed Officials plans to include 150,000 voter registration cards in La Opinion later this month and help sponsor another major workshop at the L.A. Convention Center to help immigrants apply for citizenship. A July workshop produced about 1,300 completed new citizenship applications, Gaete said. Spanish-language radio DJs, who helped turn masses out for marches, have also begun to actively promote voter registration and citizenship efforts. Renan Almendarez "El Cucuy" Coello took his "Votos por America" campaign to 10 cities over two weeks last month. DeSipio cautioned, however, that it was easier to register voters than to get them out to the polls."There's certainly the potential there," he said, "but it will require sustained investment and a lot of hard work."

Hispanic Voters Enjoy New Clout With Democrats

WASHINGTON, June 9 — Helped by the fight over immigration, Democrats seeking their party’s presidential nomination are moving to court Hispanic voters like never before, as a string of early primary states with sizable Hispanic voting blocs prompt candidates to hire outreach consultants, start Spanish-language Web sites and campaign vigorously before Hispanic audiences.
The battle for Hispanic voters is a result of the decision by several states with large Hispanic populations to move their presidential primaries to early 2008, including California, Florida and New York. Roughly two-thirds of the nation’s Hispanic residents live in nine of the states that will hold Democratic primaries or caucuses on or before Feb. 5.
Strategists say the influence of Hispanic voters is likely to be amplified next year because of an unusually intense response in many Hispanic communities to immigration policy. Conservative Republicans, with the help of some left-leaning Democrats, teamed up to derail an immigration bill in the Senate on Thursday that would have provided a path to citizenship for illegal immigrants.
It is in the new early primary states where Democrats hope the outreach efforts bear fruit. In the last presidential election, Hispanic voters accounted for a significant part of the overall Democratic primary electorate in California (16 percent), New York (11 percent), Arizona (17 percent) and Florida (9 percent), all states that will hold primaries by Feb 5.
