Excellent opportunity available for persons in this position to learn and determine initial and continuing eligibility and administer benefits for multiple public assistance programs for the community through interactive interviewing. Former Florida Governor Jeb Bush has a new title: Republican ambassador to Latino voters.

Fluent in Spanish and married to a Mexican-born woman, Bush has spent much of his career wooing and winning Latino support for the Republican Party -- for his own two successful gubernatorial campaigns and twice for his older brother’s winning presidential bids.

Now, after four years of divisive immigration battles sparking protests among Latino communities, Bush is trying to do for his party what he did for himself and his family.

The 57-year-old Bush, now a senior adviser at Barclays Plc, is leading what he calls a “center-right” campaign to rebuild a fractured relationship between his party and Latino voters, the fastest growing U.S. minority according to the Census Bureau.

The newly formed Hispanic Leadership Network -- supported by former President George W. Bush and a team of allies -- aims to shift the Republican Party toward a so-called big-tent philosophy after a midterm campaign cycle featuring anti-illegal immigration rhetoric from Tea Party-backed candidates.

“There are many Latino Republicans who have been committed to this party that have stopped voting,” said Leslie Sanchez, a former Bush aide involved with the network. “This shifts the conversation.”

Inaugural Event

The group -- an offshoot of the American Action Network, one of the wealthiest Republican organizations channeling money into political campaigns -- is holding its inaugural event in Coral Gables, Florida.

Republican lawmakers, including newly elected Florida Governor Rick Scott, veteran party leaders and Latino strategists, mingled last night in the open-air courtyard of the historic Biltmore Hotel, as Jeb Bush gave interviews in Spanish.

“Without an active participation of the most dynamic, growing part of what will be the governing coalition in our country, without the active involvement of Hispanics, we will not be the governing philosophy of our country,” Bush told the crowd.

Today, participants at the gathering included National Republican Senatorial Committee Chairman John Cornyn of Texas and former Minnesota Governor Tim Pawlenty, potential Republican candidate for president in 2012. The conference is sponsored by companies including Google Inc., AT&T Inc., Altria Group Inc. and Oracle Corp.

Former President Bush

Jeb Bush’s brother, former President Bush, spoke to the group in a video address today.

“There’s a lot of common ground to be achieved between Republicans and people who are of Hispanic origin,” the former president said.

The group aims to build support for the party in the run-up to the 2012 presidential elections. A number of states with large Latino populations -- including Florida, Nevada and Colorado -- may prove critical battlegrounds in the race.

Although Hispanic Republicans in Florida, Nevada and New Mexico won high-profile races in November’s elections, Democrats largely won the Latino vote in other states by big margins, polling shows.

Sixty percent of Latino voters supported Democratic candidates in 2010 House races, according to the Pew Hispanic Center, while 38 percent supported Republicans.

40 Percent of Vote

“I don’t think 40 percent of the Hispanic vote can be our ceiling if we plan to impact our nation in the coming decades,” Bush wrote in an opinion page article published Jan. 9 by the Miami Herald.

President Barack Obama won 67 percent of the Hispanic vote in the 2008 election while his Republican opponent, Senator John McCain of Arizona, won 31 percent, according to exit polls. In the 2004 race, Democratic Senator John Kerry of Massachusetts won 53 percent of the Hispanic vote, while George W. Bush got 44 percent -- a record for a Republican presidential candidate, the polls found.

The question for Jeb Bush and his co-chairman, former U.S. Commerce Secretary Carlos Gutierrez, is whether they can persuade many in their own party to join the effort.

“The only Republicans that I think get it when it comes to Hispanics are the Bush brothers,” said Fernand Amandi, managing partner of Miami-based Bendixen and Associates Inc., a Democratic-leaning political consulting firm that specializes in Hispanic outreach. “That’s about where it starts and ends in my judgment.”

Out of Step

Jeb Bush has found himself out of step with much of his party on immigration-related issues. He has urged Congress to take up a comprehensive revision of immigration laws, a proposal opposed by Republican congressional leaders, and said he opposed an Arizona law requiring police to check the citizenship of suspected illegal immigrants.

Hispanic Republican leaders, including former Florida Representative Lincoln Diaz-Balart, said Congress should overhaul immigration laws and pass the “Dream Act,” a proposal to let some children of illegal immigrants gain legal status if they attend college or serve in the military.

Cornyn and other Senate Republicans blocked consideration of the Dream Act in December. Cornyn said he voted not to take up the bill because he feared Democrats would use a vote on the measure to “bludgeon” Republicans politically.

Pawlenty, the only potential Republican 2012 presidential candidate who attended the conference, also said he didn’t support the legislation. Republicans can appeal to Hispanic voters with a broader economic message, he said.

‘Incomplete and Presumptuous’

“It’s incomplete and presumptuous for people to say the only issue the Latino community cares about is the immigration issue,” Pawlenty said. “Not every conversation has to be focused just on that. It has to be part of a broader message.”

Former House Speaker Newt Gingrich of Georgia, who aides said was delivering a video address to the meeting, founded a bilingual website in 2009 aimed at promoting conservative values and Latino heritage. That site, named the Americano, recently held its own conference in Washington.

Since Republicans rejected President George W. Bush’s comprehensive immigration plan in 2007, the party has taken a harder line against illegal immigration.

“The debate about immigration has been radicalized and made into this anti-Latino, anti-Hispanic campaign,” said Manuel Pastor, a professor of geography and American studies and ethnicity at the University of Southern California in Los Angeles. “Those kinds of statements really strike a chord that’s much deeper in the Latino community than some Republicans have realized.”

Reid’s Re-Election

Latino voters turned out in Nevada for Senate Majority Leader Harry Reid last year after his Republican opponent, Sharron Angle, ran a campaign ad the Latino community criticized as racially biased. Reid won more than 90 percent of the Latino vote in his re-election victory, according to polls by Seattle- based research center Latino Decisions.

In California, Latinos gave 64 percent of their vote to Democrat Jerry Brown as he won the governor’s race over Republican Meg Whitman, the former CEO of EBay Inc., who got 31 percent of the Latino vote, according to exit polls. In late September, it was revealed Whitman had employed a housekeeper who was in the country illegally and who Whitman subsequently fired. Whitman later said she believed the housekeeper should be deported.

“Republicans think that they have an image problem but they really actually have a policy problem,” Pastor said. “It’s hard to convince someone to vote for you when you are threatening to deport their grandmother.”

New statistics from the Department of Public Social Services reveal that illegal aliens and their families in Los Angeles County collected over $37 million in welfare and food stamp allocations in November 2007 – up $3 million dollars from September, announced Los Angeles County Supervisor Michael D. Antonovich. Twenty five percent of the all welfare and food stamps benefits is going directly to the children of illegal aliens. He even got one taxpayer-funded Latin Community group to pay for his CELLPHONE! So he can stay in touch with his family.



The illegal alien's name is Ruben. And that car upholstery shop has a "phantom workforce" to supplement its legally employed workforce, which is all they report for tax purposes. Ruben's brother also works there.



Here's how he gets paid: If the shop charges a customer $1500 to re-upholster car seats, and it only takes Ruben 3 hours to do it, he gets HALF. So he gets paid about $250 per hour. And both Ruben and the shop are quite happy with their arrangement.



I reported it, giving the name and location of the shop, to my Democrat federal senator's office, asking them to investigate and prosecute. But they ignored my request... which is typical of most Democrats and many Republicans in Congress. For they are deliberately turning a blind eye to it.



This is far from an isolated example. Illegals are not only stealing high-paying skilled blue-collar type jobs, but also many illegals own their own businesses [construction, home improvement, landscaping, auto repair, roofing, paving, janitorial services, housekeeping, etc., etc.].



Next time you're in Home Depot or Lowes, look for illegals there getting supplies for their plumbing jobs, etc.



I have a friend who tried starting a janitorial services business. But he gave up after a few months, telling me he couldn't compete with illegals paying their illegal employees $3 an hour.



Another illegal near me was selling used cars with open titles, parking them at a shopping center with "for sale" signs on anywhere from one to three cars at a time. And he was selling them quickly. Every week I saw different cars. But I reported it to my state's motor vehicle department, and about a month later they towed his cars away and warned the shopping center to not let anyone sell cars there.



In Pelosi's state she has allowed them to bankrupt over 100 hospitals and to render California's infrastructure virtually gasping for its breath.

Debate: Let's Stop Welcoming Undocumented Immigrants

There are two questions to consider when deciding whether to stop welcoming illegal aliens. First, do we even need the flow of labor that illegal immigration represents? And second, whatever immigration policy we do adopt, can it be enforced if we make it easy to live here illegally, as we do now?

The answer to both questions is No.

There is no economic need for foreign labor, legal or illegal. There are an estimated 12 million illegal aliens in the United States, with perhaps 7 million of them in the labor market either working or actively looking for work. But contrary to myths about "jobs Americans won't do," there is no major job category that is dominated by these illegal workers. The Census Bureau groups all jobs in the country into 473 categories, and in 2003-2004, only three small categories had even the tiniest majority of immigrant workers, legal and illegal. The large majority of America's taxi drivers, housekeepers, janitors, dishwashers, landscapers and construction laborers are native-born Americans.

More generally, the supporters of illegal immigration claim that low-skilled labor is a precious resource, like oil, and because we're running out of it at home, we have to import it from abroad. This, too, is false. On the contrary, immigration (legal and illegal) is actually crowding low-skilled Americans out of the labor market altogether. During the first half of this decade, the highest five-year period of immigration in our history, the percentage of working-age, native-born Americans without a high school degree who were in the labor force fell from 59 percent to 56 percent, and for those with only a high school degree, participation in the labor force fell from 78 percent to 75 percent. And American teenagers (aged 15 to 17) took an even bigger hit, seeing their labor force participation fall from 30 percent in 2000 to 24 percent in 2005.

Apart from the specifics of policy, we need to consider how to enforce whatever path we decide on. And here again, welcoming illegal immigrants is a mistake. The key to enforcement of immigration laws is not simply arresting and deporting violators, though that must continue, and even increase. At least as important is making life as an illegal alien as difficult and unattractive as possible, in order to dissuade new illegal settlers and persuade those already here to give up and go back home. The result would be not a magical disappearance of all illegal aliens but rather a reduction in their numbers over time, allowing American businesses  and even the illegals themselves  an opportunity to adjust to the new reality.

We have been pursuing the precise opposite of this strategy for a long time. Our welcome for illegal immigrants has included driver's licenses, in-state tuition subsidies, mortgages, bank accounts and even de facto permission to work on fake or stolen Social Security numbers. It's a wonder we don't have more illegal aliens than we do.

America has a wonderful tradition of welcoming newcomers. We admit more than one million legal immigrants every year, almost as many as all other countries combined. But immigration policy should put Americans first. Enforcing current immigration laws does just that.

Your editorial states that an enforcement-minded approach to preventing illegal immigration “mocks American values,” but the opposite is true. In fact, enforcing the current laws against illegal immigration is consistent with the ultimate American value — the rule of law.

And doing so will reduce taxpayer costs for health care, education, social services and criminal justice. And it could open up the seven million jobs currently held by illegal immigrants for American workers and legal immigrants.

Why the new jobs go to immigrants

Wall Street cheered and stock prices rose when the US Labor Department announced last Friday that employers had expanded their payrolls by 262,000 positions in February.

But it wasn't entirely good news. The statisticians also indicated that the share of the adult population holding jobs had slipped slightly from January to 62.3 percent. That's now two full percentage points below the level in the brief recession that began in March 2001.

Why the apparent contradiction? Reasons abound: population growth, rising retirements. But one factor that gets little attention is immigration.

In the past four years, the number of immigrants into the US, legal and illegal, has closely matched the number of new jobs. That suggests newcomers have, in effect, snapped up all of the new jobs.

"There has been no net job gain for natives," says Andrew Sum, an economist at Northeastern University.

In the US, President Bush calls for giving millions of illegal immigrants a kind of guest-worker status as a legal path to US citizenship. So far, no specific legislation to implement his suggestion has been put before Congress.

Meanwhile, US border patrols spend millions of dollars a year trying to keep illegals out. And yet, they keep coming, evidently little discouraged by recession or the 9/11 attacks. In the past four years alone, the number of immigrants ran some 2.5 million to 3 million, of which about half were illegal.

They come for jobs, of course. And the Bush administration makes barely any effort to enforce current law. In 2003, a total of 13 employers were fined for hiring undocumented employees.

In fact, neither Republicans nor Democrats have promoted enforcement of immigration law prohibiting the hiring of illegal immigrants, says Mr. Sum, head of Northeastern's Center for Labor Market Studies.

What employers really want in many cases by hiring immigrants is to hold down wage costs, experts say.

A report about the work lives of recent Mexican immigrants in seven cities across the United States suggests that they typically traded jobs in Mexico for the prospect of work here, despite serious bouts of unemployment, job instability and poor wages.

The report, released Tuesday by the Pew Hispanic Center, was based on surveys of nearly 5,000 Mexicans, most of them here illegally.

Those surveyed were seeking identity documents at Mexican consulates in New York, Atlanta and Raleigh, N.C., where recent arrivals have gravitated toward construction, hotel and restaurant jobs, and in Dallas, Chicago, Los Angeles, and Fresno, Calif., where they have been more likely to work in agriculture and manufacturing.

Unlike the stereotype of jobless Mexicans heading north, most of the immigrants had been employed in Mexico, the report found.

Once in the United States, they soon found that their illegal status was no barrier to being hired here. And though the jobs they landed, typically with help from relatives, were often unstable and their median earnings only $300 a week, that was enough to keep drawing newcomers because wages here far exceeded those in Mexico.

"We're getting a peek at a segment of the U.S. labor force that is large, that is growing by illegal migration, and that is bringing an entirely new set of issues into the U.S. labor market," said Rakesh Kochhar, associate director for research at the Pew Hispanic Center and author of the study.

The report suggested that policies intended to reduce migration pressures by improving the Mexican economy would have to look beyond employment to wages and perceptions of opportunity.

The survey found that the most recent to arrive were more likely to have worked in construction or commerce, rather than agriculture, in Mexico. Only 5 percent had been unemployed there; they were "drawn not from the fringes, but from the heart of Mexico's labor force," the report said.

After a difficult transition in their first six months in the United States about 15 percent of the respondents said they did not work during that time the rate of unemployment plummeted, to an average of 5 percent.

But in one of the most striking findings, 38 percent reported an unemployment spell lasting a month or more in the previous year, regardless of their location, legal status or length of time in the United States.

"These are workers with no safety net," Mr. Kochhar said. "The long run implication is a generation of workers without health or pension benefits, without any meaningful asset accumulation."

On the other hand, Mr. Kochhar and Roberto Suro, director of the Pew Hispanic Center, said the flexibility of this work force was a boon to certain industries like home construction, an important part of the nation's economic growth since the last recession.

Among respondents to the survey, those who settled in Atlanta and Dallas were the best off, with 56 percent in each city receiving a weekly wage higher than the $300 a week median. The worst off were in Fresno, where more than half of the survey respondents worked in agriculture and 60 percent reported earning less than $300 a week. The lowest wages were reported by women, people who spoke little or no English, and those without identification.



To some scholars of immigration, the report underlines the lack of incentives for employers to turn to a guest worker program like the one proposed by President Bush because their needs are met cheaply by illegal workers and all without paperwork or long term commitment.

Guest workers might instead appeal to corporations like Wal Mart, the scholars said, where service jobs are now the target of union organizing drives.

"You can't plausibly argue that immigrant dominated sectors have a labor shortage," said Robert Courtney Smith, a sociologist and author of "Mexican New York: Transnational Lives of New Immigrants." Instead, he said, the report and evidence of falling wages among Mexican immigrants over time point to an oversupply of vulnerable workers competing with each other.

But Brendan Flanagan, a spokesman for the National Restaurant Association, which supports a guest worker program, disagreed. "In many places it is difficult to fill jobs with domestic workers," Mr. Flanagan said. "We've seen a simple lack of applicants, regardless of what wage is offered."

Although the survey, conducted from July 2004 to January 2005, was not random or weighted to represent all Mexican immigrants, it offers a close look at a usually elusive population.

Those surveyed were not questioned directly about their immigration status, but they were asked whether they had any photo identification issued by a government agency in the United States. Slightly more than half over all, and 75 percent in New York, said they did not.

The migration is part of a historic restructuring of the Mexican economy comparable to America's industrial revolution, said Kathleen Newland, director of the Migration Policy Institute, a research organization based in Washington.

The institute released its own report on Tuesday, arguing that border enforcement efforts have failed. Workplace enforcement, which has been neglected, would be a crucial part of making a guest worker program successful.

For now, Mexicans keep arriving illegally.

"It doesn't matter if it's winter," said Ricardo Cortes, 23, a construction worker waiting for a friend outside the Mexican consulate in New York on Tuesday. "People are still coming because there's no money over there."

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.

It is that policy alone which conflicts with SB 1070: Arizona wants to enforce the law; the Obama administration does not. Reasonable minds can differ on whether that conflict puts Arizona in violation of the Constitution's Supremacy Clause.

But what is indisputable is that the failure of the federal government to openly acknowledge the real ground for its opposition to SB 1070 has rendered incoherent not just its own public arguments against the law, but the judicial ruling which largely rubber stamps those arguments as well.

The Arizona statute affirms the power of a local police officer or sheriff's deputy to inquire into someone's immigration status, if the officer has reasonable suspicion that the person is in the country illegally, and if doing so is practicable. Under SB 1070, such an inquiry may occur only during a lawful stop to investigate a non-immigration offense.

Both the Justice Department and U.S. District Judge Susan Bolton, in striking down most of SB 1070, couched their opposition to the statute exclusively in terms of its effect on legal, as opposed to illegal, aliens. SB 1070, Judge Bolton wrote, would impermissibly burden legal immigrants already in the country by subjecting them to unwarranted immigration checks.

There are two problems with this line of argument: First, it ignores the fact that Congress has already anticipated and approved precisely the sort of local immigration inquiries that Judge Bolton now finds unconstitutional. Second, the argument would make all immigration enforcement impossible.

In 1996, Congress banned so-called sanctuary policies, by which cities and states prohibit their employees from working with federal immigration authorities regarding illegal aliens. It was in the federal interest, Congress declared, that local and federal authorities cooperate in the "apprehension, detention or removal of [illegal] aliens."

In pursuance of that mandate, the federal government operates an immigration clearinghouse, the Law Enforcement Support Center (LESC), to provide just the sort of immigration-status information to local and state law-enforcement officials that SB 1070 seeks.

It is therefore absurd to now claim, as Judge Bolton and the Obama Administration do, that such local inquiries conflict with the federal immigration scheme. It is even more absurd to argue that the risk that a legal alien will be questioned about his immigration status makes the alleged conflict unconstitutional.

Any immigration enforcement carries the possibility that a legal alien or U.S. citizen will be stopped and questioned. The only way to guarantee that legal aliens are never asked to present their immigration papers is to suspend immigration enforcement entirely. (The same possibility of stopping innocent people for questioning applies to law enforcement generally; that possibility has never been held to invalidate the police investigative power.)

If Congress intended to create such a blanket ban on asking legal aliens for proof of legal residency, it could have revoked the 1952 law requiring aliens to carry their certificate of alien registration. Such a requirement makes sense only on the assumption that legal aliens will upon occasion be asked to prove their legal status.

Such unpersuasive reasoning suggests that something else is going on. That something is the fact that SB 1070 would have put the Obama administration in the uncomfortable position of repeatedly telling Arizona's law enforcement officers that it is not interested in detaining or deporting the illegal aliens that they have encountered in the course of their duties; the law, in other words, would have exposed the administration's de facto amnesty policy.

And SB 1070 would have shown that immigration-law enforcement can work simply by creating a deterrent to illegal entry and presence. Even before it went into operation, the Arizona law was already inducing illegal aliens to leave the state, according to news reports.

Illegal aliens are virtually absent from the Justice Department's brief or from Judge Bolton's opinion. Despite this studied avoidance, it's time to have a public debate about how much immigration enforcement this country wants and which enforcement policies--the administration's or Arizona's -- best represent the public will.

Obama Administration Challenges Arizona E-Verify Law

The Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus Curiae Brief). Called the “Legal Arizona Workers Act,” the law requires all employers in Arizona to use E-Verify and provides that the business licenses of those who hire illegal workers shall be repealed. From the date of enactment, the Chamber of Commerce and other special interest groups have been trying to undo it, attacking it through a failed ballot initiative and also through a lawsuit. Now the Chamber is asking the United States Supreme Court to hear the case (Chamber of Commerce v. Candelaria), and the Obama Administration is weighing in against the law.

To date, Arizona’s E-Verify law has been upheld by all lower courts, including the Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as an exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice Department, however, disagrees. Acting Solicitor General Neal Katyal said in his filing with the Supreme Court that the lower courts were wrong to uphold the statute because federal immigration law expressly preempts any state law imposing sanctions on employers hiring illegal immigrants. Mr. Katyal argues that this is not a licensing law, but “a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction.” (Solicitor General's Amicus Curiae Brief, p. 10). This is the administration’s first court challenge to a state’s authority to act against illegal immigration, and could be a preview of the battle brewing over Arizona’s recent illegal immigration crackdown through SB 1070.

Napolitano has made no comment on the Department of Justice’s decision to challenge the 2007 law, but federal officials said that she has taken an active part in the debate over whether to do so. (Politico, May 28, 2010). As Governor of Arizona, Napolitano said she believed the state law was valid and became a defendant in the many lawsuits against it. (Id.).

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.



The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Bill To Let “Exemplary” Illegal Immigrants Become U.S. Citizens

A United States congressman dedicated to fighting harmful anti-immigrant legislation has introduced a bill to change a decades-old federal law so that “exemplary” illegal aliens can obtain American citizenship.

California Democrat Joe Baca actually wants to amend the 1952 Immigration and Nationality Act so that underage illegal immigrants can become U.S. citizens. To qualify they must somehow prove that they are “exemplary” by providing academic transcripts, demonstrating an understanding of United States history, government and civics and proving that they are of good moral character.

Like most open borders advocates, Baca, who represents Southern California’s San Bernardino County in the U.S. House, claims it’s a way of helping innocent young people brought to America by no choice of their own as children. It’s simply wrong to have policies that “unfairly punish” them, Baca proclaims in a press release announcing his bill this week.

The measure is called People Resolved to Obtain Understanding of Democracy (PROUD) Act and it was also introduced in the previous congress as part of a larger immigration reform bill. It got more than 100 cosponsors but failed to make it past the House Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law. With Republicans in control of the House, the PROUD Act probably won’t survive but Baca is determined to help illegal aliens.

Under his measure, illegal immigrants who complete grades 6 through 12 in a U.S. school can forgo the current naturalization exam to obtain citizenship. They must provide proof of “essential civic knowledge” and be in “good moral standing within the community.” This will motivate all students to “do their best and stay out of trouble,” Baca assures. It will also put our most responsible and successful immigrant students on a “streamlined path for citizenship.”

After all, the congressman reminds us that America is the land of opportunity and we are blessed to live in a nation where people of diverse backgrounds can come together as one. His legislation will increase the number of high-skilled, citizen workers which will boost economic recovery by creating additional tax revenue. How can you beat that?

Arizona, in the Classroom

Last week’s memorial service in Tucson, which began with a blessing by a professor of Yaqui Indian and Mexican heritage, showcased Arizona’s rich diversity as well as the love and tolerance of many of its citizens.

Unfortunately there is another Arizona, one where its state government all too often promotes discord and intolerance. This was painfully clear in the state’s immigration law, which empowers the police to demand the papers of suspected illegal immigrants. And it is painfully clear in a new education law that injects nativist fears directly into the public school classroom.

The law, which took effect Dec. 31, bans any courses or classes that “promote resentment toward a race or class of people” or “advocate ethnic solidarity instead of the treatment of pupils as individuals.” Arizona’s new attorney general, Tom Horne, immediately used it to declare illegal a Mexican-American ethnic-studies program in the Tucson Unified School District.

Mr. Horne, who wrote the law when he was superintendent of public instruction, accused the program of “brainwashing” Latino students, of teaching “ethnic chauvinism” because it uses works by authors critical of the United States’ historical relationship with Latin America and its past treatment of Latinos. He has not gone after similar programs for black, Asian or American Indian students.

It’s hard to object to the portions of the law that discourage the overthrow of the government. But Mr. Horne goes way overboard in trying keep high school students from studying works like Paulo Freire’s “Pedagogy of the Oppressed,” a classic educational text, or any effort to deepen students’ understanding of history, and their place in the world. Tucson school officials say that far from stoking teenage resentment, the program has helped students keep their grades up and stay in school.

The school district has been put in a bind: shut the program down or lose state financing. Eleven teachers have sued to block the law. The school board, regrettably, did not join the lawsuit.

Educators and parents across the state should resist this effort to clamp down on education. Justice demands it. And even this ill-considered law suggests that Mr. Horne has badly overreached. One passage reads: “Nothing in this section shall be construed to restrict or prohibit the instruction of the Holocaust, any other instance of genocide, or the historical oppression of a particular group of people based on ethnicity, race or class.”

Arizona was rightly criticized in the 1980s and early 90’s when it refused to join the nation in declaring Martin Luther King’s Birthday a holiday. It finally agreed in 1992, and the whole country has since traveled closer toward racial harmony. Arizona’s political leaders shame themselves and their citizens when they preach and promote the opposite.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third nation neutral arbitration of disputes concerning immigration laws and their enforcement." WHO IS THE MEXICAN FASCIST PARTY of LA RAZA?

The National Council of La Raza (NCLR) is not only one of the wealthiest and most politically powerful militant organizations in the country, it is also notoriously racist and subversive. The group's name, "La Raza," means "The Race," by which they are referring to ethnic Mexicans, or more broadly to "hispanics" or "latinos." And it is quite clear from their decades of vitriolic rhetoric — both spoken and written — that the La Raza activists are trying to engender not only race consciousness amongst hispanic U.S. citizens and Mexican migrants, but also racial militancy and animosity toward "Gringo America."

The NCLR grew out of the La Raza Unida (The Race United) Party and the Southwest Council of La Raza in the late 1960s and early 1970s. The key leaders were Marxist-Leninist followers of Fidel Castro and Che Guevarra.

In 1970, the California Senate Fact-Finding Subcommittee on Un-American Activities said this about La Raza Unida: "Its president is Maclovio Barraza. Mr. Barraza has been identified by the Subversive Activities Control Board as a member of the Communist Party, and presides over the Council which recently received a grant of $1,300,000 from the Ford Foundation."

Maclovio Barraza was the NCLR Board of Directors' founding Chairperson, and the NCLR continues to honor this hardcore Marxist by awarding the Moclavio Barraza Award to its top activist each year.

One of the early founders of La Raza was Professor Jose Angel Gutierrez, whose violent, extremist rhetoric has caused NCLR some public relations problems. Back in 1969, Gutierrez said: "We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him." He has continued to promote the same hateful "reconquista" ideology ever since. But that didn't stop NCLR from bestowing on him their "Hero Award" in 1994.

The radical student group MEChA (Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closely allied for several decades, is even more explicitly and militantly, having adopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," which translated means: "For the Race, Everything; Outside the Race, Nothing."

MEChA's founding documents and literature are replete with appeals to "La Raza de Bronce" (The Bronze Race) and condemnation of the "brutal gringo." MEChA, as its name suggests, is also a leading promoter of the radical "reconquista" (reconquest) movement, a plan of to take over the states of California, Arizona, New Mexico, Colorado, and Texas — a region they refer to as "Aztlan" — which they claim was stolen from the "Aztecan" peoples. NCLR provides major financial support to MEChA and many of NCLR's leaders were MEChA leaders in their college days.

NCLR: Agents for the Government of Mexico?

Especially troubling is NCLR's leading role in the Fundacion Solidaridad Mexicano Americana (Foundation for Mexican-American Solidarity, FSMA), an organization founded and funded by the government of Mexico and directed by the Mexican Ministry of Foreign Affairs and Ministry of Public Education. Both of these ministries have been engaged in efforts aimed at demanding full political rights for illegal aliens in the U.S. and indoctrinating America's Hispanic population in radical, racist La Raza ideology.

Top members of La Raza, MALDEF, the National Immigration Forum and other leading immigration activist organizations also serve on the Council of the FSMA. As such, they are acting as agents for a foreign power that is actively seeking to influence our national, state, and local laws and policies, in ways that are inimical to the interests of our nation and our citizens. Giffords's border district symbolizes the heat of Arizona politics

DOUGLAS, ARIZ. - The congresswoman's grueling path to reelection took her from her Tucson base across the barren high desert, through an empty expanse of tumbleweed and mesquite trees, to this dusty town at the Mexican border that has come to symbolize the tinderbox of Arizona politics.
Rep. Gabrielle Giffords returned here on a sweltering day last June to gather footage for her campaign advertisements. A moderate Democrat in a classic swing district, she walked a main street where American flags hang outside shoe stores and barber shops. A voice-over emphasized her strengths: independence . . . courage. . . integrity.
The camera rolling, a man stormed out of the Gadsden Hotel, a historic landmark. He screamed that Giffords was about to get "thrown out" of office, creating such a scene that police intervened.
"He began viciously, verbally attacking Gabby," said Jason Ralston, Giffords's Washington-based consultant directing the action. "I've never seen anything like it."
The man channeled his anger toward Giffords, but this was about much more than a lone congresswoman. He seemed to give voice to the long-simmering frustrations and passions in southern Arizona that boiled over during Giffords's hard-fought 2010 campaign.
Pitched emotions - centered on the issues of immigration, health care and the economy - have fueled an atmosphere here that encourages vitriol, according to interviews with more than two dozen state political leaders and residents. An anti-Washington sentiment has flourished as people blame their elected leaders, not just for failing to fix problems but for passing laws that only add to the mess.
The atmosphere created a sense of foreboding long before the Jan. 8 massacre at a Tucson strip mall where Giffords was meeting with constituents. Since the shootings, the co-founder of the Tucson Tea Party has endured death threats and hate mail that required law enforcement assistance, including a verbal threat made Saturday at a community gathering that included one of the shooting survivors.
A new Facebook page - Tea Party Tucson Massacre - has cropped up, blaming the tea party for the deaths of the six people, including a 9-year-old girl. On Friday, a new image appeared on the site mocking the tactics of Republican Sarah Palin, the former Alaska governor and vice-presidential candidate who targeted Giffords's district during the election on a map marked with cross hairs. (A Palin aide said the image was intended to represent surveyors' marks.) The image of a T-shirt on the site shows the marks plastered atop Palin's face.
Trent Humphries, the tea party leader, said that because of the rancor, he was urged to stay away from memorial services and funerals honoring the shooting victims. "The police have told me that I had better not go to any large events right now," he said. "It wouldn't be safe."
Although the accused killer, Jared L. Loughner, targeted Giffords as early as 2007, no evidence has emerged that he did so because of a specific political issue. He was a registered independent who apparently harbored anger toward the congresswoman for her answer to his question at an earlier constituent event.
But Giffords's district offers a case study of problems that have driven much of Arizona's politics to a boiling point. The 8th District is fiercely independent, much like its congresswoman, who mucked horse stalls as a child and rides motorcycles without a helmet. The Gunfight at the O.K. Corral took place midway between Tucson and the border at Tombstone, now a tourist trap - "The Town Too Tough to Die" - that resembles a Hollywood lot for some Wild West flick.
The immigration debate has raged here for years. Last March, an illegal immigrant allegedly shot and killed a prominent rancher, Robert Krentz, on his land outside of Douglas. The slaying provided some of the momentum for the state's immigration law last summer.

But some residents here said they have not felt the same urgency from their elected officials in Washington, who are too distant to see the impact that illegal immigration has on local crime rates, joblessness and overstretched public services.
"A lot of us are mad at Washington," said Julius "Mac" Maklary, 73, as he watched a football game Saturday in a smoke-filled American Legion lodge. He said he voted for Giffords but is still not satisfied with government. "Everybody got reelected, but what are they doing now? We've still got the same problems. We still have all these drug problems and illegal immigrants coming across," he said.
As she campaigned for reelection, Giffords knew immigration would be a huge constituent issue, her aides say. She emphasized border security but came under heated criticism for not backing a state effort to more aggressively identify and deport illegal immigrants.
But her top aides said they were taken aback when gun rhetoric escalated during the campaign.
"There was a lot of hostility and gun talk," said Rodd McLeod, Giffords's campaign manager. "And when you are campaigning, you are publicly advertising where you are going to be."
In August 2009, as the health-care debate ratcheted up, a protester brought a gun to one of Giffords's "Congress on Your Corner" events at a supermarket in Douglas. The man reportedly shouted disparaging words at Giffords and drew the attention of police after he dropped his firearm.
After Jesse Kelly won the Republican primary in the 8th District, the tea party-backed candidate held a gun-shooting fundraiser. An ad promoting the event said: "Get on Target for Victory in November. Help remove Gabrielle Giffords from office. Shoot a fully automatic M16 with Jesse Kelly."
Kelly declined interview requests.
Giffords was not the only Arizona Democrat in Congress who felt threatened during the past year. In April, Rep. Raul M. Grijalva and his staff received multiple death threats and felt forced to temporarily shut his district offices in Tucson and the border town of Yuma. At that time, Giffords tried to appeal to Arizonans, saying, "Such acts only make it more difficult for us to resolve our differences. . . . Resorting to vandalism and threats to express political viewpoints is unacceptable."
Winning the district was a top priority for both parties, and in the campaign's final weeks, the sheer volume of anti-Giffords campaigning was inescapable, residents said.
Street signs saying "Giffords FORCED Obamacare on YOU" popped up at major intersections. Talk radio personality Garret Lewis devoted his three-hour show each day to Giffords, calling her a "puppet" of then-House Speaker Nancy Pelosi (D-Calif.) and accusing the Arizonan of "masquerading as a border conservative." At debates, angry spectators booed and shouted over Giffords and Kelly so loudly that the candidates sometimes could not be heard.
Thomas J. Volgy, a former Tucson mayor who teaches political science at the University of Arizona, said state politics was radically different when he was running for office two decades ago. During his 1987 mayoral race, Volgy, a Democrat, was expected to lose to the Republican incumbent, Schuyler Lininger. But things shifted in Volgy's favor after the state's GOP leadership denounced him for being a naturalized citizen.
It backfired. Volgy went from being down five percentage points to winning by between eight and nine points.
"Being negative and personal didn't work. People didn't like it," Volgy said. "Now we are in an era where people do nothing but denounce public officials for being scum and slime. It's hard for some people to differentiate between the good guys and the bad guys."

Judge questions Justice Department's lawsuit against Arizona immigration law

A federal appellate judge expressed deep skepticism Monday about the Justice Department's lawsuit over Arizona's new immigration law, leaving uncertain the Obama administration's chances of stopping the law from taking effect.
Judge John T. Noonan Jr. grilled administration lawyers at a hearing before the U.S. Court of Appeals for the 9th Circuit. He took aim at the core of the Justice Department's argument: that the Arizona statute is "preempted" by federal law and is especially troublesome because it requires mandatory immigration status checks in certain circumstances.
"I've read your brief, I've read the District Court opinion, I've heard your interchange with my two colleagues, and I don't understand your argument," Noonan told deputy solicitor general Edwin S. Kneedler. "We are dependent as a court on counsel being responsive. . . . You keep saying the problem is that a state officer is told to do something. That's not a matter of preemption. . . . I would think the proper thing to do is to concede that this is a point where you don't have an argument."
"With respect, I do believe we have an argument," Kneedler responded.
The interchange came at a hearing on the Justice Department's efforts to overturn the Arizona law, which empowers police to question people they suspect of being in the country illegally and has triggered a fierce national debate. A federal judge in Phoenix issued an injunction in July that blocked the law's most contested provisions from taking effect. Arizona appealed, leading to Monday's hearing.
With Noonan, an appointee of President Ronald Reagan, so bluntly stating his views, the government's chances of getting the injunction upheld may rest with two other 9th Circuit judges. One, Carlos T. Bea, is also a Republican appointee, while Judge Richard A. Paez is a Democratic appointee.
In addition, Bea and Paez are both of Hispanic descent. It is Hispanics who are most upset about the Arizona law, signed in April by Gov. Jan Brewer (R).
Bea and Paez questioned lawyers from both sides during Monday's argument, and their positions on the case seemed unclear.
The Justice Department lawsuit, filed in July, ratcheted up the political and legal debate over the nation's estimated 12 million illegal immigrants, with Republicans condemning the administration and civil rights groups praising the lawsuit.
Talk of illegal immigration has receded somewhat in the run-up to Tuesday's midterm elections, especially compared with the economy, but it has been a key factor in a number of races. Monday's argument, which Brewer attended, shone an even brighter light on the issue.
Brewer has vowed to take the case to the U.S. Supreme Court, and legal experts say the case likely will wind up before the high court within several years.
Government attorneys won the first round in July when U.S. District Judge Susan R. Bolton, seated in Phoenix, put on hold provisions of the law that would require police to check immigration status if they stop someone while enforcing other laws, allow for warrantless arrests of suspected illegal immigrants and criminalize the failure of legal immigrants to carry their registration papers.
Lawyers for both sides made arguments Monday similar to those they have advanced for months. Kneedler, a widely respect appellate lawyer, said the Arizona statute is "preempted" by federal law because immigration enforcement is solely a federal prerogative.
"This is an extraordinary state statute," Kneedler told the judges, saying that provisions such as the criminalization of failure to carry registration papers "are clearly preempted. . . . First of all, it's a direct regulation of immigration."
Arizona's lawyer, John J. Bouma, defended the law's constitutionality and said Arizona felt compelled to pass it because of "a federal government that has been unable or unwilling to solve" the problem of illegal immigration.
Civil rights groups have said the law targets Hispanics, but Bouma, a leading Phoenix lawyer, objected to that characterization. "When you look at this statute, the intent is to deal with illegal aliens," he said. "Arizona has a long and proud tradition of a Hispanic population, and nobody is trying to take away from that."

PHOENIX – The state senator in Arizona who wrote the nation's toughest law against illegal immigrants said Tuesday he's collecting support across the country from legislators to challenge automatic U.S. citizenship to the children of illegal immigrants.

Arizona state Sen. Russell Pearce's target is the 14th Amendment, but it is unclear how the state lawmaker can or will influence a federal statue.

"This is a battle of epic proportions," Pearce said Tuesday during a news conference at the Arizona Capitol. "We've allowed the hijacking of the 14th Amendment."

Pearce declined to say how the legislation will differ from similar measures that have been introduced in each two-year congressional session since 2005. None of them made it out of committee.

He and another Arizona lawmaker did argue that wording in the amendment that guarantees citizenship to people born in the U.S. who are "subject to the jurisdiction" of this country does not apply to the children of illegal immigrants because such families don't owe sole allegiance to the U.S.

The efforts by Pearce and the other lawmakers come amid calls to change the U.S. Constitution's 14th Amendment. Supporters cite costs to taxpayers for services provided to illegal immigrants and their children.

Changing the Constitution is difficult.

It requires approval by two-thirds majorities in both chambers of Congress, an impossibility now because Democrats have the majority in both houses and most oppose such a measure. Even if Republicans gain power in November and legislation is passed, an amendment would still need to be ratified by three-fourths of the states.

Paul Bender, a constitutional law professor at Arizona State University, said if the lawmakers focus their argument on the "subject to jurisdiction" wording, they won't get very far because the founders only meant it to apply to the children of foreign diplomats born in the U.S.

"If the British ambassador and his wife have a child in the U.S., that child is not a citizen because he is not subject to the jurisdiction of the U.S. We cannot put him in jail, we cannot even give him a parking ticket," Bender said.

The 14th Amendment "could have easily have said you're a citizen if you owe your allegiance, but our Constitution doesn't say that," he said. "It says if you're born here, and you're not a diplomat's child, then you become a citizen, and that's the way its been for 100 years."



Carlos Galindo-Elvira, vice president of Valle del Sol, a Phoenix group that provides social services to community members and advocates for immigrants, said Pearce's interpretation of the amendment is an effort to "legitimize bullying babies."

He also questioned why lawmakers would focus on this issue rather than the country's economic woes and high unemployment rate. "All it does is split the country," he said.

Pennsylvania state Rep. Daryl Metcalfe, the founder of a national group of legislators critical of illegal immigration, said the 14th Amendment "greatly incentives foreign invaders to violate our border and our laws." He had a news conference Tuesday in Harrisburg, Pa., on the multistate endeavor.

The effort could run afoul of the language in the 14th Amendment and lead to a court battle over the constitutionality of the law. But Metcalfe said providing birthright citizenship to children of illegal immigrants is an "ongoing distortion and twisting" of the amendment.

Metcalfe's office said lawmakers in at least 12 other states besides Arizona and Pennsylvania said they were making their own announcements about working on the citizenship legislation. Those other states: Alabama, Delaware, Idaho, Indiana, Michigan, Mississippi, Montana, Nebraska, New Hampshire, Oklahoma, Texas and Utah.

Pearce was the main sponsor of a tough new Arizona law that would require police enforcing other laws to question people about their immigration status if there's reason to suspect they're in the U.S. illegally. It was to go into effect this summer, but a judge put on hold key provisions pending the resolution of a legal challenge.

Pearce also was the chief sponsor of a 2007 state law targeting employers who knowingly hire illegal immigrants.

Arizona Gov. Jan Brewer, who signed the 2010 law and who is championing the state's legal defense of it against a court challenge mounted by the U.S. Justice Department, was noncommittal when asked whether lawmakers should approve legislation on citizenship.

However, Brewer said she was "always concerned" by the possibility of involving the state in a court fight. "No one wants to be in court. No one wants to be fighting the federal government," she said.
