Reid Promises Immigration Vote After Election

Senator Harry Reid, the Democratic majority leader fighting to hold his seat in Nevada, said on a taped television appearance on Sunday he planned to bring legislation that would create a path for some illegal immigrants to gain legal status to a vote in the post-election session of Congress.

The move may thrust the issue of immigration into the heart of the political debate in the hours leading to Tuesday’s midterm elections.

Mr. Reid announced his intentions on Univision’s “Al Punto,” a Spanish-language political talk show. His appearance was a pitch to Nevada’s Hispanic voters as he fights for re-election against Sharron Angle, a Tea Party-backed Republican with whom he is essentially tied in polls. Immigration is a dominant issue in the Nevada Senate race. And Hispanics, who turned out in droves to help elect President Obama in 2008, could give an edge to Mr. Reid.
The legislation, called the Dream Act, would grant conditional legal status to illegal immigrant students who arrived in the United States before they were 16 years old, have been here for at least five years and who graduate from high school in the United States and complete two years of college or military service.

“I have the right to bring that up any time I want; that’s why I brought it up the first time. I am a believer in our needing to do something,” Mr. Reid said in the interview, which was taped Thursday in Las Vegas.

Mr. Reid said he would bring the measure to the floor in the lame-duck session regardless of the election’s outcomes.

To pass, the measure would require some Republican support, which seems unlikely. A previous version of the Dream Act failed to overcome a Republican-led filibuster in the Senate in 2007. The measure was attached to a defense authorization bill in September 2010 but Republicans (with one Democrat) blocked the legislation.

“I just need a handful of Republicans, Mr. Reid said. “I would settle for two or three Republicans to join with me on the Dream Act and comprehensive immigration reform, but they have not been willing to step forward.”

Mr. Reid echoed Mr. Obama in placing part of the responsibility over a stalled overhaul of immigration laws on Senator John McCain. Mr. McCain, the Arizona Republican, had been a leading proponent of an immigration overhaul with former Democratic Senator Edward M. Kennedy.

“As a result of his unwillingness to help, we have not had a single Republican offer to help us with comprehensive immigration reform,” Mr. Reid said of Mr. McCain. “The system is broken and all they want to do is demagogue the issue.”

Recently, an ad for Ms. Angle characterized Mr. Reid as “the best friend an illegal alien ever had,” a label Mr. Reid said was “totally without fact our foundation.”

Asked about his re-election campaign, Mr. Reid said it was “doing just fine.” He added that it was “pretty clear” that Democrats would hold on to the Senate after the election.

“How many the numbers will be, we’ll have to decide that on Nov. 3, but we feel comfortable,” Mr. Reid said.

Judge questions Justice Department's lawsuit against Arizona immigration law

A federal appellate judge expressed deep skepticism Monday about the Justice Department's lawsuit over Arizona's new immigration law, leaving uncertain the Obama administration's chances of stopping the law from taking effect.
Judge John T. Noonan Jr. grilled administration lawyers at a hearing before the U.S. Court of Appeals for the 9th Circuit. He took aim at the core of the Justice Department's argument: that the Arizona statute is "preempted" by federal law and is especially troublesome because it requires mandatory immigration status checks in certain circumstances.
"I've read your brief, I've read the District Court opinion, I've heard your interchange with my two colleagues, and I don't understand your argument," Noonan told deputy solicitor general Edwin S. Kneedler. "We are dependent as a court on counsel being responsive. . . . You keep saying the problem is that a state officer is told to do something. That's not a matter of preemption. . . . I would think the proper thing to do is to concede that this is a point where you don't have an argument."
"With respect, I do believe we have an argument," Kneedler responded.
The interchange came at a hearing on the Justice Department's efforts to overturn the Arizona law, which empowers police to question people they suspect of being in the country illegally and has triggered a fierce national debate. A federal judge in Phoenix issued an injunction in July that blocked the law's most contested provisions from taking effect. Arizona appealed, leading to Monday's hearing.
With Noonan, an appointee of President Ronald Reagan, so bluntly stating his views, the government's chances of getting the injunction upheld may rest with two other 9th Circuit judges. One, Carlos T. Bea, is also a Republican appointee, while Judge Richard A. Paez is a Democratic appointee.
In addition, Bea and Paez are both of Hispanic descent. It is Hispanics who are most upset about the Arizona law, signed in April by Gov. Jan Brewer (R).
Bea and Paez questioned lawyers from both sides during Monday's argument, and their positions on the case seemed unclear.
The Justice Department lawsuit, filed in July, ratcheted up the political and legal debate over the nation's estimated 12 million illegal immigrants, with Republicans condemning the administration and civil rights groups praising the lawsuit.
Talk of illegal immigration has receded somewhat in the run-up to Tuesday's midterm elections, especially compared with the economy, but it has been a key factor in a number of races. Monday's argument, which Brewer attended, shone an even brighter light on the issue.
Brewer has vowed to take the case to the U.S. Supreme Court, and legal experts say the case likely will wind up before the high court within several years.
Government attorneys won the first round in July when U.S. District Judge Susan R. Bolton, seated in Phoenix, put on hold provisions of the law that would require police to check immigration status if they stop someone while enforcing other laws, allow for warrantless arrests of suspected illegal immigrants and criminalize the failure of legal immigrants to carry their registration papers.
Lawyers for both sides made arguments Monday similar to those they have advanced for months. Kneedler, a widely respect appellate lawyer, said the Arizona statute is "preempted" by federal law because immigration enforcement is solely a federal prerogative.
"This is an extraordinary state statute," Kneedler told the judges, saying that provisions such as the criminalization of failure to carry registration papers "are clearly preempted. . . . First of all, it's a direct regulation of immigration."
Arizona's lawyer, John J. Bouma, defended the law's constitutionality and said Arizona felt compelled to pass it because of "a federal government that has been unable or unwilling to solve" the problem of illegal immigration.
Civil rights groups have said the law targets Hispanics, but Bouma, a leading Phoenix lawyer, objected to that characterization. "When you look at this statute, the intent is to deal with illegal aliens," he said. "Arizona has a long and proud tradition of a Hispanic population, and nobody is trying to take away from that."

Illegal Aliens Want Sanctuary Policies In Writing

Lawmakers and police in a major U.S. city have reassured illegal immigrants that they’re protected under longtime sanctuary policies amid demands from open borders advocates that the measures be formalized in writing.
A group of Latino activists, clergy and civil rights leaders took to the street this week to command Baltimore officials to further solidify the city’s measures to shield illegal aliens from federal authorities. Like many law enforcement agencies across the nation, Baltimore Police bans its officers from inquiring about suspects’ immigration status.
Now emboldened illegal immigrants want the policy in writing to reduce crime and help bridge the gap between officers and immigrants after the recent murders of three Hispanic men in the area. The most recent victim, a Honduran, was clubbed and beaten with a wooden stake by a mentally disturbed teen who professed to hate “Mexicans.” Illegal immigrants are more prone to cooperate in these sorts of police investigations if the department has a written don’t-ask-don’t-tell immigration policy, their advocates say.
But Baltimore Police Chief Frederick Bealefeld asserts that a written policy is unnecessary because his officers never ask about immigration status as per the citywide sanctuary measures. In the three years he’s served as department head, Bealefeld says he hasn’t heard “one utterance on enforcement of immigration laws.” For their part, city officials assure residents that they should trust police to focus on fighting violent crime, not enforcing immigration laws.
This week a Maryland legislator threw a wrench in Baltimore’s sanctuary public relations campaign by announcing a proposed bill that will give citizens the power to sue public officials who violate federal immigration laws. If the measure passes, citizens can file complaints against public officials in circuit court and, if convicted, the official could be booted from office or face criminal charges.

US election campaign ends amid deepening economic crisis

The campaign for the midterm US election Tuesday is coming to an end under the shadow of an intractable and deepening economic crisis and the evident inability of the Obama administration to develop any policies to overcome it.
All 435 seats in the House of Representatives, 36 of the 100 seats in the Senate and governorships in 39 of the 50 states are at stake. The Democratic Party, which holds a 59-41 edge in the Senate and a 255-178 edge in the House, is expected to lose a significant number of seats in both houses, with media projections of a Republican takeover of the House but not the Senate.
These predictions are highly uncertain, however, since the exact scale of a Democratic Party defeat depends on the turnout, particularly among those groups, such as youth and minorities, who voted in huge numbers for Barack Obama in 2008.
Moreover, there is an enormous degree of manipulation in the media speculation about an impending “wave” election that would return the Republicans to power after two elections, in 2006 and 2008, in which they were repudiated massively by the American people and lost control first of Congress and then the White House.
The media coverage, particularly the incessant promotion of Tea Party elements as the supposed harbingers of a major shift in public opinion to the right, seems to be directed towards producing the desired result: a Republican takeover of at least the House of Representatives.
Careful examination of the opinion polls suggests a more cautious projection, with some 20 to 25 House Democratic incumbents significantly trailing their Republican opponents, little over half the 39 seats required to deliver a majority to the Republican Party.
The outcome for both House and Senate could come down to the counting and recounting of ballots for dozens of closely contested seats, with the inevitable appeals for court intervention to include or exclude ballots.
This is an increasing trend in American politics. The vote on November 2 comes ten years after the stolen election of 2000, when right-wing elements in the Republican Party, the military, the media and the US Supreme Court stepped in to suppress the counting of ballots in Florida and award the White House to George W. Bush.
If the Democratic Party does contrive to lose control of the House and/or Senate, it is fundamentally because of the widespread and justified sense of betrayal among working-class voters. The greatest disillusionment comes over the refusal of Obama and the Democrats to take any serious action to deal with the growth of mass unemployment, the explosive increase in foreclosures and evictions, and the spread of poverty on a scale not seen since the Great Depression.
In the election campaign that is concluding, the Democrats and Republicans have sought to conceal the objective realities of the capitalist crisis amid a barrage of media manipulation, distortion and mudslinging, fueled by an unprecedented outpouring of corporate cash.
More than $4 billion have been expended for and against the candidates of both parties, with the population bombarded with attack ads, smears and diversions whose effect is to deepen the alienation of the people from both parties and the entire electoral charade.
The election campaigns of the two big business parties have entirely avoided such critical issues as the war in Afghanistan, the continued US occupation of Iraq, the environmental catastrophe in the Gulf of Mexico brought about by BP, and the intensified assault on the democratic rights of the American people carried out in the name of fighting “terrorism.”
If the Republican Party is expected to make political gains, it is not because of any growth in popular support for its right-wing program of tax cuts for the wealthy, the slashing of spending on Social Security and Medicare, deregulation of business and increased militarism.
Pre-election polls have consistently shown that the Republican Party is even more despised than the Democrats, and that increasing numbers want an alternative to the existing political system. Nor is there any great upsurge of support for the Tea Party, an ersatz “movement” largely bankrolled by a handful of ultra-right billionaires.
The Republicans will profit from the failure of the Obama administration because the two-party system keeps the working class effectively disenfranchised, with official politics limited to the alternation in office of two right-wing, pro-Wall Street parties.
The Republican candidates have denounced the Obama administration for its failure to address the rising tide of joblessness. Obama and the Democrats have responded that their opponents want to turn the clock back to the policies of the Bush administration, which created the conditions for the Wall Street crash of September-October 2008.
The truth is that neither party has any solution to the crisis of American and world capitalism. The trillion-dollar bailout of Wall Street, begun under Bush and continued by Obama, temporarily stabilized the financial system and enabled the banks and hedge funds to reap huge profits and restore their outlandish CEO salaries and bonuses, but did not resolve the crisis.
Capitalist governments all over the world have followed the same course, borrowing huge sums to prop up the banks and investment houses. Now they are all engaged in efforts to make the working class pay for the bailout through wage cutting, the elimination of jobs, and drastic austerity policies aimed at dismantling what remains of the welfare state.
These austerity policies do not and cannot offer a way out of the crisis, since they are predicated on slashing domestic consumption, and consumer spending generates the bulk of economic activity. Nor can all the countries engaged in world trade simultaneously increase their exports and reduce their imports.
Instead, the slashing of labor costs to gain a competitive advantage for export industries results in a race to the bottom and the driving down of wage levels to the lowest common denominator.
Even the United States, the largest national economy, is subject to the dictates of the world market. This subordination to global forces is expressed in the steady decline in the value of the American dollar, which threatens to trigger a global crisis of confidence in the US currency and in US financial assets generally.
In the past month, the American dollar has for the first time in history fallen to below par against both the Canadian and Australian dollars, and to well below a 1-1 ratio with the Swiss franc. The dollar’s value against the yen has fallen to a 15-year low, and it now requires $1.40 to buy a single euro.
Under these conditions, the next US Congress, whether controlled by the Democrats or Republicans, or shared between them, will be compelled to embark on radical austerity policies. This is likely to be accompanied by a rise in interest rates at the hands of the Federal Reserve, carried out to defend the value of the dollar. Such a move will have a drastic impact on economic activity.
The stage has been set for austerity measures by Obama’s appointment of a bipartisan panel on the federal deficit, which is to report back to the White House and Congress December 1. The panel is expected to recommend some combination of increased consumption taxes, such as a national sales tax, and major cuts in benefit programs like Social Security, Medicare and Medicaid.
In his final appeals to the electorate, President Obama again signaled a turn to the right by his administration following Tuesday’s vote. He pledged in his Saturday radio address to “seek out common ground” with his Republican opponents. “There are some practical steps we can take right away,” he said, “not Democratic or Republican ideas, but proposals that have traditionally been supported by both parties.”
Under conditions where the US ruling class and both its parties are moving ever further to the right, and the American working people are moving to the left, a political break with the existing structure is the only way forward. The working class must make a decisive break with the two-party system and build an independent mass socialist party of its own.
In the struggles of the working class that erupt after the elections—against the destruction of jobs, living standards and democratic rights, and against imperialist war—the necessity for an independent political alternative will be directly posed before millions. The critical question is the building of the Socialist Equality Party to provide the necessary program and leadership.

Jose Herria emigrated illegally from Mexico to Stockton, Calif., in 1997 to work as a fruit picker. He brought with him his wife, Felipa, and three children, 19, 12 and 8 – all illegals. When Felipa gave birth to her fourth child, daughter Flor, the family had what is referred to as an "anchor baby" – an American citizen by birth who provided the entire Silverio clan a ticket to remain in the U.S. permanently. But Flor was born premature, spent three months in the neonatal incubator and cost the San Joaquin Hospital more than $300,000. Meanwhile, oldest daughter Lourdes married an illegal alien gave birth to a daughter, too. Her name is Esmeralda. And Felipa had yet another child, Cristian. The two Silverio anchor babies generate $1,000 per month in public welfare funding for the family. Flor gets $600 a month for asthma. Healthy Cristian gets $400. While the Silverios earned $18,000 last year picking fruit, they picked up another $12,000 for their two "anchor babies." While President Bush says the U.S. needs more "cheap labor" from south of the border to do jobs Americans aren't willing to do, the case of the Silverios shows there are indeed uncalculated costs involved in the importation of such labor – public support and uninsured medical costs. In fact, the increasing number of illegal aliens coming into the United States is forcing the closure of hospitals, spreading previously vanquished diseases and threatening to destroy America's prized health-care system, says a report in the spring issue of the Journal of American Physicians and Surgeons. "The influx of illegal aliens has serious hidden medical consequences," writes Madeleine Pelner Cosman, author of the report. "We judge reality primarily by what we see. But what we do not see can be more dangerous, more expensive, and more deadly than what is seen." According to her study, 84 California hospitals are closing their doors as a direct result of the rising number of illegal aliens and their non-reimbursed tax on the system. "Anchor babies," the author writes, "born to illegal aliens instantly qualify as citizens for welfare benefits and have caused enormous rises in Medicaid costs and stipends under Supplemental Security Income and Disability Income." In addition, the report says, "many illegal aliens harbor fatal diseases that American medicine fought and vanquished long ago, such as drug-resistant tuberculosis, malaria, leprosy, plague, polio, dengue, and Chagas disease." While politicians often mention there are 43 million without health insurance in this country, the report estimates that at least 25 percent of those are illegal immigrants. The figure could be as high as 50 percent. Not being insured does not mean they don't get medical care. Under the Emergency Medical Treatment and Active Labor Act of 1985, hospitals are obligated to treat the uninsured without reimbursement. "Government imposes viciously stiff fines and penalties on any physician and any hospital refusing to treat any patient that a zealous prosecutor deems an emergency patient, even though the hospital or physician screened and declared the patient's illness or injury non-emergency," says the report. "But government pays neither hospital nor physician for treatments. In addition to the fiscal attack on medical facilities and personnel, EMTALA is a handy truncheon with which to pummel politically unpopular physicians by falsely accusing them of violating EMTALA." According to the report, between 1993 and 2003, 60 California hospitals closed because half their services became unpaid. Another 24 California hospitals verge on closure, the author writes. "American hospitals welcome 'anchor babies,'" says the report. "Illegal alien women come to the hospital in labor and drop their little anchors, each of whom pulls its illegal alien mother, father, and siblings into permanent residency simply by being born within our borders. Anchor babies are citizens, and instantly qualify for public welfare aid: Between 300,000 and 350,000 anchor babies annually become citizens because of the Fourteenth Amendment to the U.S. Constitution: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside." Among the organizations directing illegal aliens into America's medical systems, according to the report, are the Ford Foundation-funded Mexican American Legal Defense and Education Fund, the National Immigration Law Center, the American Immigration Lawyers Association, the American Bar Association's Commission on Immigration Policy, Practice, and Pro Bono, the Immigrant Legal Resource Center, the National Council of La Raza, George Soros's Open Society Institute, the Migration Policy Institute, the National Network for Immigration and Refugee Rights and the Southern Poverty Law Center. Because drug addiction and alcoholism are classified as diseases and disabilities, the fiscal toll on the health-care system rises.

As the mainstream media focuses on a study that reveals a sharp decline in the nation’s illegal immigrant population, monthly welfare payments to children of undocumented aliens increased to $52 million in one U.S. county alone.
The hoopla surrounding last week’s news that the annual flow of illegal immigrants into the U.S. dropped by two-thirds in the past decade overlooked an important matter; the cost of educating, incarcerating and medically treating illegal aliens hasn’t decreased along with it, but rather skyrocketed to the tune of tens of billions of dollars annually.

THIS FIGURE DOES NOT INCLUDE EXTRA MILLIONS PAID FOR ANCHOR BABIES

Those figures don’t even include the extra millions that local municipalities dish out on welfare payments to the U.S.-born children of illegal immigrants, commonly known as anchor babies. In Los Angeles County alone that figure increased by nearly $4 million in the last year, sticking taxpayers with a whopping $52 million tab to provide illegal immigrants’ offspring with food stamps and other welfare benefits for just one month.
That means the nation’s most populous county, in the midst of a dire financial crisis, will spend more than $600 million this year to provide families headed by illegal immigrants with welfare benefits. In each of the past two years Los Angeles County taxpayers have spent about half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants. Additionally, the county spends $550 million on public safety and nearly $500 million on healthcare for illegal aliens.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from L.A. County’s Department of Social Services. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare perks that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children.

With the recent controversy over adding verification to the health care reform bill prohibiting illegal aliens from participating in a government plan, it is a good time to question why so many from neighboring countries, and all over the world, want to come to America.

The most obvious answer is that we reward lawbreakers with jobs, free emergency room health care, and free education (not to mention other benefits that can be obtained by cheating the system with false documentation). They are able to find employers who have no moral qualms about hiring them and breaking the laws of our country. As if it couldn’t get any better, the cherry on top is that we have a President who is continuously making appearances on Spanish Language Programs and promising viewers “Comprehensive Immigration Reform” (read: amnesty) as early as next year.

In the new video, The Greener Grass, immigration experts explain why so many are willing to cross the border and overstay visas to remain in our country. Many of these illegal aliens cannot receive the benefits and good treatment they do in America in their home countries. The truth is that the United States cannot accept every person in the world who is worse off than the average American. The rate at which we currently accept foreigners is already detrimental to the quality of life of our citizens.


Many foreign governments have little problem with their citizens illegally living in America—it means less benefits they have to pay, fewer jobs they have to provide, and more money their country receives from their citizens residing in America. It is estimated that $23 billion is sent back to Mexico each year from Mexicans living in America. Worldwide, $300 billion is sent home from foreigners working in America.

Taking all of this into account, how can this change? Our President and many leaders in Congress insist on continuing to provide taxpayer funded benefits to illegal aliens while promising them citizenship next year.

Just as Americans have done in the past few weeks, we must contact our elected officials and let them know that we do not want to encourage illegal immigration by offering illegal aliens incentives to break our laws. We must remind President Obama and Congress that we are paying attention. Please watch this video and keep the pressure on!
