DEVELOPING: Suspect in elderly Monroe Co. woman's '08 rape returned to E. Tenn.
The man accused of raping a 92 year old Monroe County woman in 2008 has finally been returned to East Tennessee.

MONROE COUNTY, Tenn. (WVLT) – The man accused of raping a 92 year old Monroe County woman in 2008 has finally been returned to East Tennessee.
The Monroe County Sheriff’s Office confirmed late Friday evening that Francisco Barbosa, 37 was booked into the Monroe County jail earlier in the day.

On March 5th, 2008, Barbosa allegedly broke into the victim’s Babcock St. home in Tellico Plains. The elderly victim told police she woke up to find a man trying to suffocate her with a pillow. She faked unconsciousness and the intruder went on to brutally beat and rape her.
Two months later, investigators named Barbosa as their lead suspect. The illegal immigrant had been in the area at the time of the rape, living with his brother and working constriction. Detectives working with the Tennessee Bureau of Investigation further connected Barbosa to the rape after matching DNA found at the crime scene to a drinking straw he had used.
Several local, state and federal law enforcement agencies so launched a manhunt for Barbosa, who had left town right after the rape. Around the same time as the DNA match, authorities located his pickup truck abandoned at a bus station in Houston, Texas. U.S. Marshals and Mexico’s Federal Police force turned up evidence he had purchased a ticket to Monterrey, Mexico and international warrants were issued for his arrest.
Barbosa remained on the run for nearly two years before US and Mexican authorities arrested him at a family member’s home in the town of San Luis on January 12th, 2010.
The extradition process was immediately started following his apprehension, and it ultimately took nearly 6 months to get him back in East Tennessee.
Barbosa was behind bars late Friday night at the Monroe County Jail. Tellico Police have charged him with Aggravated Rape and Especially Aggravated Burglary. He is being held without bond.

Madrigal's arrest and immigration record includes a staggering number of contacts with law enforcement since 1989. That's the year he was convicted of theft using a firearm in California.

He was deported a couple of times after that. Then in 1999, he was arrested for drug sales in both San Diego and San Francisco. Records show that he was deported three times that year between April and August.

He was arrested for drugs again in Stockton, Calif. in 2000. In 2002, he pleaded to third degree sexual assault in Denver. Later that year, he was deported again. And in 2003, records show he was deported three more times.

EDMONDS, Wash. – The KING 5 Investigators have learned that an illegal immigrant accused of raping a woman in Edmonds Sunday has been deported nine times. That's much more than previously reported.

Immigrations and Customs Enforcement won't comment on the case of Jose Lopez Madrigal. But KING 5 got the information through confidential sources and documents.

Larry Klein was the man who heard the alleged victim's cries for help. Police say the suspect pulled the woman off the street to a dumpster and raped her.

"I could see the back of his head. I could see his pants were down. I could see her lying on the ground. I could hear her crying, but I couldn't really see her face," said Klein.

People who live near the scene of Sunday's alleged rape wonder how it could keep happening.

"Makes you wonder, what are we doing wrong? How is he getting back in here?" said Kirby Aumick.

"It’s troubling. I mean, if this man should not have been in this country, he should have been behind bars then, really, this is a senseless tragedy," said Klein.

According to our sources, Madrigal's last contact before Sunday was around 2003. So, it's not clear how much of that time Madrigal was in this country.

Immigration and Customs Enforcement has refused to comment on the case which started making national headlines when it was learned that Madrigal had been deported several times prior to the Edmonds case.

In reviewing records and talking with confidential sources, the KING 5 Investigators learned just how extensive Madrigal’s immigration and arrest record is.

They found he was first deported in California in 1989 and since then he’s returned from his Mexican homeland and been arrested for drug crimes, a sex assault in Colorado and other offenses.

One criminal justice source says Madrigal is a "poster boy" for the federal governments ineffectiveness at keeping the most serious "criminal aliens" – illegals who commit crimes – out of the United States.

Obama Administration Challenges Arizona E-Verify Law
The Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus Curiae Brief). Called the “Legal Arizona Workers Act,” the law requires all employers in Arizona to use E-Verify and provides that the business licenses of those who hire illegal workers shall be repealed. From the date of enactment, the Chamber of Commerce and other special interest groups have been trying to undo it, attacking it through a failed ballot initiative and also through a lawsuit. Now the Chamber is asking the United States Supreme Court to hear the case (Chamber of Commerce v. Candelaria), and the Obama Administration is weighing in against the law.
To date, Arizona’s E-Verify law has been upheld by all lower courts, including the Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as an exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice Department, however, disagrees. Acting Solicitor General Neal Katyal said in his filing with the Supreme Court that the lower courts were wrong to uphold the statute because federal immigration law expressly preempts any state law imposing sanctions on employers hiring illegal immigrants. Mr. Katyal argues that this is not a licensing law, but “a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction.” (Solicitor General's Amicus Curiae Brief, p. 10). This is the administration’s first court challenge to a state’s authority to act against illegal immigration, and could be a preview of the battle brewing over Arizona’s recent illegal immigration crackdown through SB 1070.
Napolitano has made no comment on the Department of Justice’s decision to challenge the 2007 law, but federal officials said that she has taken an active part in the debate over whether to do so. (Politico, May 28, 2010). As Governor of Arizona, Napolitano said she believed the state law was valid and became a defendant in the many lawsuits against it. (Id.).

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

California Legislature In Danger Of Passing Even More Benefits for Illegal Immigrants

Because of activism on the part of California Senator Cedillo, existing California law allows for people with unlawful immigration status who have attended high school in California for 3 or more years, graduated from a California high school or attained a GED, to attend colleges and pay in-tuition rates at California Community Colleges and the California State University.

Now Senator Cedillo author of the original California "Dream Act" wants to amend it, and has introduced and passed through the Senate SB 1460 which will allow illegal aliens meeting all of the same provisions to attend Trade Schools, Adult Classes and even High School classes, while California tax payers pick up the tab.

Additionally this bill would further provide that, on and after January 1, 2011, a student attending the California State University, the California Community Colleges, or the University of California who is exempt from paying nonresident tuition under the provision described above would be eligible to receive a scholarship derived from non-state funds received, for the purpose of scholarships, by the institution at which he or she is a student.
