Why Does Craigslist Encourage Indiscriminate Flagging?

For the past few days, someone has been flagging almost every posting off of the Orlando politics board -- including this one. Flagging valid postings is something that annoys virtually all Craigslist users in almost every category. And yet it would be such a simple and easy thing to stop. All Craigslist needs to do is demand that everyone who wants to flag a post must have an account connected to a phone number -- just as they do for those who post on the political message boards. Anyone who flags valid postings would then be automatically banned from flagging any more postings. Are the people at Craigslist just too stupid to come up with that solution? Probably not. That means that they actually encourage indiscriminate flagging. But why? I have no idea. But I do know that it makes for an easy way for Craigslist to internally censor political material while at the same time providing the illusion that, depending upon your perspective, it's either "evil liberal posters" or "evil conservative posters" who are attempting to censor material. By allowing indiscriminate flagging that could easily be prevented, Craigslist itself begins to look rather guilty.

Message From California: “American Citizens Need Not Apply”

The United States is ordered by a “government of the people, by the people, for the people…”
But in modern-day California, it’s not so obvious any longer which “people” the government is allegedly serving.
Let’s go back to September of 2010. In the midst of the Golden State’s contest for a new Governor, a woman named Nicky Diaz Santillan held a press conference in Los Angeles – along with her famous Attorney Gloria Allred – and announced that she was suing Republican gubernatorial nominee Meg Whitman.
Santillan, we were to learn, had been a live-in housekeeper for the Whitman family between 2000 and 2009. After she was fired from that position she decided to do what Californians often do, and she sued her former employer for “emotional and financial abuse.”
Ms. Santillan happened also to be an illegal alien -a fact she revealed at her press conference -and had stolen an American citizen’s Social Security number so as to falsify documents and to portray herself as a citizen, when she was seeking employment with Whitman.
It was quite a spectacle, that strange September day in California. Seated behind the microphones and in front of the cameras of the American media, flanked by an American Attorney who had accessed the American judicial system to sue an American citizen named Meg Whitman, sat an illegal alien named Nicky Diaz Santillan.
Nobody dared to ask questions about the fact that Ms. Santillan’s presence in California was a violation of federal law. And nobody said a word about her admission to the crime of identity theft. It was all about the alleged “abuse” done to her by the American Meg Whitman.
In fact, California’s top law enforcement agent at that time – Attorney General Jerry Brown – had nothing to say about illegal immigration and identity theft either. Brown was the Democrat nominee for Governor, and he was polling behind Whitman. So rather than address the apparent crimes and confessions, Brown instead joined the chorus of critics claiming that Whitman had been “insensitive” for ending Ms. Santillan’s employment.
Shortly after that press conference, Brown began to poll ahead of Whitman. On Election Day in November, Brown trounced Whitman by nearly fourteen percentage points.
In California, trying to uphold the law with illegal aliens can be a very costly thing. Yet the political benefits of allowing illegal aliens to live above the “government of the people” can be enormous.
After the election, California was rocked by another bizarre event. At Fresno State University, one of California’s largest tax-payer funded schools, the campus newspaper revealed that their student body president Pedro Ramirez was an illegal alien.
Whether Ramirez was “outed,” or he “arranged to be outed,” is not quite clear. But after the news broke, Ramirez set out on a well orchestrated series of international media interviews (he rapidly became the “guest of choice” at “CNN En Espanol”) and a speaking tour to promote the federal “Dream Act” amnesty legislation. He flew up and down the state of California, and even paid a visit to Washington, D.C. to “lobby Congress” on behalf of illegal immigrants.
Ramirez’ presence in California was a violation of federal law, yes. But once again, California government officials didn’t dare ask the obvious questions: How does he pass through security check points at airports? Does he have an American passport? Does he have a California Driver’s License? How did he obtain these documents? Was identity theft involved?
It’s a “government of the people,” sure. But what does this mean any longer in California?
Not only does California ignore definitions of “crime” and “punishment” in cases involving illegal aliens, it is now about to legislate preferential treatment for illegal aliens which, de facto, will put U.S. citizens at a disadvtange. With a budget deficit of somewhere between $10 and $15 billion – a deficit that is expected to swell to about $25 billion by the middle of 2012 – California is cutting back on funding for everything from highway maintenance to K-12 education.
But – alas! – the California legislature has nonetheless found money in the coffers to fund special college and university grants intended specifically for illegal alien students (Americans need not apply). It’s called the “California DREAM Act,” and it’s sailing quite smoothly through the legislature right now.
In the 21st Century, it’s difficult to imagine that tax-payer funded college scholarship programs designated for “citizens and legal residents only” would be met with favor anywhere in America. But in modern-day California – a state that will probably be asking for an “Obama bailout” in the near future - tax-payer funds set aside “for illegal aliens only” is quite acceptable.
Yes, it’s true - the United States is ordered by a “government of the people, by the people, for the people…” But in our 31st state, it’s a government that is “for” just about anyone – except the American Citizen.

Living the American dream, with a gang twist
Some members of Florencia 13, one of L.A.'s largest gangs, live a suburban, settled lifestyle with good jobs. But they are proud of their ties to the gang, which they call 'the neighborhood.'

In a working-class neighborhood east of the Los Angeles city limits, Roberto Becerra ducked under the eave of the Spanish-tile roof he recently rebuilt for his mother and stepped into the RV parked in the driveway.

He's been working on the camper for months now. New carpeting. A TV on a swivel. Little houseplants on the bookshelves, tied to the wall so they don't fall over. The thing's got some years on it; the sunset-style paint job screams 1970s. "But it's coming along," he said, brushing his hand along the new drapes.

Becerra's is a thoroughly suburban American life. Sort of.

He's nuts about hockey and Oktoberfest. He works as a foreman on high-end construction sites. He's got a kid on the way, and when he has time he jots a few words in a baby book. When asked to describe his reaction when he learned of the pregnancy, he wrote: "Daddy told every one of his employees."

Look closer, though, and you'll find a curious key chain hanging from a nail on one wall of the house. It's the hand of a skeleton, the fingers contorted to form the letter "F."

There's another "F" next to Becerra's right eye. Another on the hockey jersey he bought his girlfriend recently. Another on the bill of the hard hat he wears at work -- reminders, everywhere, of his allegiance to one of the largest and most confounding gangs in the metropolis: Florencia 13.

In recent years, Florencia has been subjected to mass arrests and one of the largest federal indictments of a California street gang. The Los Angeles County district attorney's office set aside a prosecutor to exclusively handle homicides committed on Florencia's turf.

Once gangs evolve into full-fledged criminal enterprises, authorities often saddle them with court injunctions that limit their movements and activities. Florencia has three such injunctions.

But according to law enforcement officials and gang members, Florencia has grown ever more powerful and influential, subsuming smaller gangs and staying ahead of the police by diversifying its criminal pursuits.

According to gang members, Florencia now has 46 active "cliques" and as many as 7,000 members.

Other large gangs -- such as 18th Street and Mara Salvatrucha, which rival or exceed Florencia's size -- are composed of loosely affiliated cliques scattered across a wide area. But most of Florencia is clustered in a contiguous area that now includes not just Florence-Firestone, its historical domain, but Huntington Park, Bell, Walnut Park and stretches of South L.A. and Watts.

The cluster is five miles wide and as deep as three miles -- where a single gang is dominant, where kids can often be heard shouting "F-1-3!" That scope presents law enforcement with a daunting challenge, because the gang has become virtually synonymous with the community itself, particularly among Latino men.

"They are so deeply rooted," said Adan Torres, a veteran Los Angeles County sheriff's detective who has devoted much of his career to policing Florencia. "You can't go on any block without encountering one of them. . . . The homeowners are former gangbangers who made it, but now their kids are gangbanging. It's a cycle."

Indeed, many are born into it.

When Sonny Ontiveros was a boy, both of his parents were sent to prison; his father was killed there, and his mother served 15 years for robbery. Ontiveros, now 34 and a father of five who works the graveyard shift as a machine operator, said that he was, in effect, raised by Florencia -- "the only familia I ever had."

Florencia has become both a menacing street gang and a way of life. In that void, there are hundreds of veteranos like Roberto Becerra -- proud, unapologetic members of Florencia, yet seemingly uninvolved in the gang's criminal enterprises.

Becerra is known to all as Flaco, the nickname he has scrawled on the ceiling of his otherwise spotless RV. He lives a content, uncluttered life in an odd netherworld, a 43-year-old man with "TOWN DRUNK" tattooed across his knuckles and two hands clasped in prayer etched on his chest, a gang member with a day job and a business card.

Born in the '50s

Borrowing its name from East Florence Avenue, Florencia began in the 1950s as a neighborhood protector near Roosevelt Park, a bustling, diverse enclave of bungalow-style housing built to serve the workers at the nearby factories. It was a time of fedoras and zoot suits, of car clubs and doo-wop music like that Paragons tune, which was adopted as the gang's theme song.

But in the ensuing years, Florencia moved into increasingly serious criminal enterprises, particularly after becoming an ally of the Mexican Mafia, a powerful prison-based "supergang" that shapes much of the state's gang activity.

Authorities say several ranking members of Florencia are also members of the Mexican Mafia. "La Eme," they say, has assisted Florencia's efforts to control the flow of drugs into a sizable chunk of L.A. It has also made Florencia famously disciplined. Members are expected to stay in top physical condition; that way, if they're arrested, they can assist in maintaining control of the prison yards, according to those familiar with the gang.

Authorities say the gang also does a thriving business in identity theft and is responsible for much of the area's bootleg DVDs.

'I don't claim'

Late one Saturday, police drew their guns and raced to surround a tiny house in South L.A., part of a sweep of suspected Florencia members. Inside, officers found red beans cooking on the stove. On one wall was a needlepoint sign that read: "Love grows happy hearts."

They also found Cesar "Demon" Ortiz, 31, an alleged Florencia member with a history of drug, theft and assault charges.

"Who do you claim?" Officer Matt Ensley asked him, street vernacular for asking someone's gang affiliation. "I don't claim," Ortiz said.

Ensley looked under his T-shirt, where the word "FLORENCIA" was tattooed in block letters. "You got it on your stomach!" Ensley said.

"Yeah. But I don't walk around without my shirt on," Ortiz replied sheepishly. He told the officers he'd gone straight since prison, that he was a father now, not a gang member.

"I just got mixed up with the wrong people," Ortiz said.

"But you got the name 'Demon,' " Ensley said.

"I didn't pick it."

"But you had to earn it."

"Yeah."

Sweeps are commonplace in Florencia strongholds -- and enormously controversial.

Major investigations have sent scores of ranking Florencia members to prison in recent years, including a 2007 indictment of 102 men linked to the gang -- an action described at the time by federal officials as "the largest gang takedown in American history."

Police acknowledge that a small percentage of documented Florencia members commit the majority of the gang's serious crimes, but they make no apologies for the crackdown.

"We've gotten the main players, the most violent players, out of the game," said Torres, the sheriff's detective. "In 10 years, there is going to be a major difference."

A distinct clientele

In Florencia strongholds, many argue that young Latino men are treated harshly and unfairly -- and that the area needs jobs, better schools and youth programs, not intensive suppression.

The gang, for instance, has long held carwashes to raise money for one another; when somebody dies, the gang often pays for funeral costs. That tradition has faded because the injunctions' strictest provisions prohibit gang members from associating in public. Gang members also contend that the police crackdown has hamstrung them -- leaving them unable to defend and protect their neighborhoods.

One recent afternoon, Rene "Scrappy" Suarez Jr., 22, strolled along Pacific Avenue, in Huntington Park. The stores there are forthright about their clientele. One sells boots adorned with an image of Jesus Malverde, a legendary bandit who has become a folk "saint" among some drug traffickers. When Suarez entered another store and inquired about jeans, the saleswoman -- knowing that most Florencianos wear their pants as baggy as possible -- offered him a size-46 waist for his 32-inch frame.

Suarez said he began selling crack for Florencia at the age of 12, with a Beretta pistol in his waistband. He later became a "gunner" -- "more muscle than hustle," he said -- because it was a "more valuable trade."

More recently, Suarez says he's put the criminal life behind him and has been instrumental in developing an "understanding" between Florencia and 18th Street, a traditional rival -- something the police were never able to do, he is quick to point out.

After leaving one store, Suarez spied a piece of graffiti on a lamppost left by someone from another neighborhood. It was, he said, an affront from an outside gang that would never have occurred if Florencia had been left to its own devices to patrol the neighborhood.

"If there was any illegal business going on in this neighborhood, it was coming from us," he said. "Nobody did anything -- robbing a liquor store, nothing -- without us. It was tightly run, with pride. . . . . If you're going to harm my neighborhood, I'm going to harm you."

'It's who you are'

No matter how much pressure is applied to Florencia, men like Roberto "Flaco" Becerra, who act not as criminals but as elders and mentors, will continue to be the tendons connecting the gang with the community itself.

There is a Flaco, it seems, in every Latino gang in L.A.; it means "skinny" in Spanish. This Flaco was an excellent student, but his interest waned toward the end of high school. He was arrested for the first time as a teenager, for shoplifting magazines, and left school shortly before graduation. The gang -- he calls it "the neighborhood" -- came calling about the same time. He was brought in with a traditional 13-second beating that left him with a busted lip and a broken rib. It was, he said, simply what you did.

"It just happens," he said. "It's just your neighborhood. It's who you are."

His parallel lives began.

He began working on construction sites and was soon asked to run portions of the jobs. Today he is something akin to a superintendent, with 20 employees on several sites, most in the Hollywood area.

He is entrusted to hand out paychecks to his employees on Fridays -- and entrusted to count the 13 seconds when a new member is "courted" into the gang with a beating: "One one thousand, two one thousand . . . "

Concerns Over Illegal Immigration Becoming Mainstream

Once upon a time opposition to illegal immigration was championed by a few special interest groups and outspoken leaders like Tom Tancredo and Sheriff Joe Arpaio. Not so anymore. Regular sheriffs like Arizona’s Paul Babeu of Pinal County and Larry Dever of Cochise County are speaking up loudly about their frustrations dealing with it.
The Obama administration gets credit for mainstreaming the issue. Obama moved the country backwards on fixing the problem by suing Arizona over SB 1070 and decreasing funding for enforcement. One federal prosecutor in Texas refuses to prosecute illegal immigrants until they have been arrested seven times. He will not prosecute them with a felony until they have been caught 14 times. Even more egregiously, he does not prosecute coyotes smuggling fewer than six illegal immigrants. These policies are in place throughout Texas.
All the progress Arizona has made the past few years reducing illegal immigration and associated crime due to the efforts of Sheriff Arpaio, Senator Russell Pearce and former Maricopa County Attorney Andrew Thomas is now being eroded. The Border Patrol reports that 219,300 illegal immigrants were apprehended coming through the Tucson Sector last year. But as many as 350,000 to 400,000 were not caught, with many heading north through Sheriff Babeu’s Pinal County. It is a bad time to be decreasing enforcement efforts. According to Sheriff Dever, illegal immigration is getting worse. "The bottom line is the people we’re battling are much more sinister and much more aggressive, much more determined than they have ever been,” Dever said on NPR. “When they used to run away, now they want to fight." The Yuma Sector is the only sector along the border that has “operational control” over its 126-mile section of the more than 3,000-mile border with Mexico.
More than 50% of illegal immigrants enter the country through the Tucson sector. Arizona is hit harder by illegal immigration than any other state in the country. The Bureau of Land Management recently posted signs 70 miles north of the border in Sheriff Babeu’s Pinal County warning citizens to stay out of certain areas due to the drug cartels and coyotes. The violence on the border has moved north, with much of it taking place 20-40 miles north of the border. Pinal County has become the number one pass through county in the nation for drug and human trafficking. Sheriff Babeu says that parts of Arizona are now controlled by the drug cartels, a $40 billion dollar industry. He laments, “The criminals have taken over our country, and our government has become our enemy.”
Obama’s Homeland Security Secretary Janet Napolitano, formerly governor of Arizona, brazenly declared last year that the border “is as secure as it ever has been.” The Border Patrol is circulating a PowerPoint presentation showing that illegal immigration has decreased. But their chart cherry picks which years and figures to compare. Sheriff Dever objects to the skewed presentation, “Don’t drink the Kool-Aid and buy into 'this border is secure' nonsense.” Dever resigned from the governmental Alliance to Combat Transnational Threats organization in February, calling it a charade. Sheriff Babeu accuses the federal government of trying to brainwash the American people by saying the border is safe and secure, in order to “lull us into a false sense of security.”
Outrageously, the federal government is instructing the Border Patrol to arrest fewer illegal immigrants, as part of a “catch and release” scheme. This selective enforcement is apparently being done so the Obama administration can boast that apprehensions of illegal immigrants have gone down while Obama has been in office. Sheriff Dever was so furious he testified to Congress last month about the practice. He is concerned the Obama administration is protecting illegal immigrants from prosecution, allowing many to get away with commit heinous crimes.
To fix our broken borders, Sheriff Babeu would like the 10-point border security plan proposed by Arizona’s Senator Jon Kyl implemented. It calls for 6,000 armed soldiers deployed along the border for up to two years, 3,000 of them located in Arizona. A double-barrier fence would be completed in key areas, along 700 miles of the 2,000-mile border. Currently, there are numerous miles along the border where there is no fence, or it is easily passed through. Another key component of the plan would fully fund and enforce Operation Streamline in Arizona’s two Border Patrol sectors, which puts illegal border crossers behind bars for 60 days.
Both Sheriffs Babeu and Dever have been named as defendants in the Obama administration’s lawsuit against Arizona over SB 1070, as well as in lawsuits filed by the ACLU and other radical activists. The ACLU has filed lawsuits against every Sheriff and County Attorney in Arizona. The organization has forced Babeu and Dever to form a Border Sheriffs’ legal defense fund to assist them in defending the lawsuits. Sheriff Dever calls the Ninth Circuit Court of Appeals decision in May upholding the gutting of SB 1070 “judicially-imposed amnesty.” “We get frustrated and disheartened when the White House, which has failed to secure the border for generations, sues us for trying to fill the legal vacuum.”
The Obama administration is using the race card to try and convince the courts to strike down SB 1070 – even though there is language in SB 1070 specifically prohibiting racial profiling. Sheriff Dever finds the accusations ridiculous that law enforcement is profiling illegal immigrants based on their race. In an article for the New York Times entitled “Abandoned at the Border,” Sheriff Dever wrote, “It’s not really what they look like as much as what they do that concerns me. Among other things, they generally run off into the desert when they see our officers approach. Citizens and legal residents don’t normally do that… In Cochise County, my deputies and I often have to travel many miles to respond to a resident’s call for assistance. The last thing we have time to do is harass law-abiding people.”
The liberal Obama administration has revealed its desperation by resorting to the race card to defeat common sense policies on illegal immigration. Lacking any substantive arguments to refute reality, they resort to emotion. Even worse, unlike Sheriffs Dever and Babeu who formed a private legal defense fund to spare taxpayers the expense of defending their counties from the lawsuits, Obama is using our money to fund his race-baiting lawsuit. Obama has gone too far by preventing regular sheriffs from doing their job.

Acting quietly, below the radar of U.S. public opinion and without congressional approval, the Obama administration is implementing a key policy objective of the Security and Prosperity Partnership of North America, or SPP, to erase the border with Mexico and Canada.
The administration is acting under a State Department-declared policy initiative described in a March 23 fact sheet titled "United States-Mexico Partnership: A New Border Vision."
"Mexico and the United States have a shared interest in creating a 21st century border that promotes the security and prosperity of both countries," the State Department declared. "The U.S. and Mexican governments have launched a range of initiatives that challenge the traditional view of 'hold the line' and are developing a framework for a new vision of 21st century border management."

The Obama administration will sue Arizona for trying to help Washington enforce federal immigration laws, but flatly rejects the notion of suing sanctuary cities that blatantly defy those same laws. That announcement two weeks ago revealed the hypocrisy and utter contempt for the rule of law rampant in Eric Holder’s Justice Department.
It was the latest example of the Department letting partisan politics, rather than the interests of justice and the impartial enforcement of the law, drive its legal decisions. In this instance, it both threatens national security and undermines public confidence in our legal system.
Holder’s refusal to sue sanctuary cities is an abrogation of his responsibility as the nation’s chief federal law enforcement officer. Unlike Arizona, many of these cities have policies that violate federal law.
The Obama administration claims Arizona’s law will “disrupt federal immigration enforcement.” But the only thing it could possibly disrupt is federal non-enforcement. As the elections approach, Holder’s suit may help gin up enthusiasm among the president’s more radical political allies, such as La Raza. But using the law enforcement powers of the federal government to achieve political ends is a dangerous abuse of power.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

US bankers cash in despite phony pay restraint

The executive pay regulations announced Thursday by the Obama administration’s “pay czar” and the Federal Reserve represent a cynical attempt to placate public outrage over Wall Street bonuses while allowing the financial speculators to continue awarding themselves multi-million-dollar compensation packages.
According to the report issued by the Treasury Department’s special master for compensation, Kenneth Feinberg, at least 66 of the 138 bank and corporation executives under his jurisdiction will receive government-approved compensation packages totaling more than $1 million a year.
The average pay for all 138 executives is $2.5 million a year. All of them work for seven companies bailed out with tens of billions in taxpayer dollars: Bank of America, Citigroup, AIG, General Motors, Chrysler, GMAC and Chrysler Financial.
General Motors’ CEO Fritz Henderson will see his 2009 compensation more than double from 2008, to $5.5 million. Meanwhile, under the forced bankruptcy of the company at the hands of the Obama administration, GM workers have suffered mass layoffs and deep cuts in pay and benefits.
Feinberg’s report, and a second document issued by the Federal Reserve calling for vague new principles to guide compensation packages at the banks regulated by the Fed, have been presented by both supporters and opponents in official circles as a serious check on the self-enrichment of the financial elite.
The Wall Street Journal published an editorial denouncing the measures as the end of “what used to be known as American capitalism.”
The Obama administration was happy to be accused of being anti-Wall Street. It gave the president a chance to adopt a populist pose and present himself as sharing the outrage over bankers’ salaries felt by working people.
“I’ve always believed that our system of free enterprise works best when it rewards hard work,” Obama said Thursday at the White House. “But it does offend our values when executives of big financial firms—firms that are struggling—pay themselves huge bonuses even as they continue to rely on taxpayer assistance to stay afloat.”
This rhetoric is 180 degrees at odds with reality. The Obama administration made available up to $23.7 trillion in loans, guarantees and direct cash infusions to the big financial institutions. Its number one priority has been to rescue these institutions, which play a central role in the world capitalist system and serve as the principal guardians of the wealth of the ruling elite.
Obama commissioned the Feinberg report to provide political cover as the economic crisis deepens. American society is heading into an unprecedented social and political crisis—beginning with a winter in which foreclosures, evictions, utility shutoffs and spreading homelessness will unfold against the backdrop of record bonuses on Wall Street.
The White House is also supplying a bit of rhetorical ammunition to its liberal defenders, such as the Nation magazine. They are increasingly being discredited by their praise for the “progressive” character of the new administration, even as Obama betrays all of his election-year promises and, in all essentials, continues the policies of Bush and the Republicans—wars in Iraq and Afghanistan, bailouts for the wealthy, wage and benefit cuts for workers, attacks on democratic rights.
Obama’s comment about the “free enterprise system” rewarding “hard work” has been echoed by media apologists and spokesmen for the bankers, who are bemoaning the supposed chilling effects of the token restraints on pay.
A worried New York Times wrote: “Pay experts said the plan, which emerged Wednesday, could lead to the departure of the very executives needed to return the firms to health, a prerequisite to repaying taxpayer support.”
Neither from the White House nor in the press is there any examination of what these individuals have done—what heroic labor they have performed—that is worth incomes in the seven, eight and even nine digits.
These financial parasites produce no real value. On the contrary, these are people who are largely responsible for the greatest financial collapse since the 1930s, one in which their personal greed and recklessness played a significant role.
What does an investment banker do? Judge from the quarterly reports filed by Goldman Sachs and JPMorgan Chase, which have repaid their cash injections from the Troubled Asset Relief Program and are therefore exempt from even the token limits set by Feinberg. The two banks earned bumper profits and set aside near-record sums for bonuses, not by funding startup ventures and small businesses, as the mythology of “free enterprise” would suggest. Their profits came almost entirely from speculation—gambling on the price swings of currencies, stocks and bonds.
The proper fate of many of these gentlemen would be criminal investigation and prosecution, and the forfeiture of their personal fortunes to contribute to providing relief to the millions of people whose lives have been devastated by the economic consequences of their actions.
The Times noted, in its account of the Federal Reserve plan to regulate bank salaries, “The officials emphasized that the plan was not intended to make pay packages more socially equitable but was part of a broader effort by the Fed to shore up the stability of the banking system.”
Why should reducing social inequality be ruled out as a goal of public policy? The spectacle of individual bankers and CEOs raking in incomes greater than those of 500, 1,000 or even 10,000 working people is not only an outrage, it is a symptom of a deeply diseased and reactionary social order.
As the Times account demonstrates, to the extent that the new regulations have any substance, beyond their public relations value, their purpose is to curb the speculative excesses of a few bank executives in the larger interests of the financial aristocracy as a whole.
The working class has no interest in supporting Obama’s fig leaf of pay restraint for the banks—which will be cited as justification for even more draconian attacks on the wages and benefits of workers. The working class must fight not for a “reformed” capitalism, but the abolition of the profit system and the reorganization of economic life to serve the needs of the vast majority of humanity, those who work for a living.
This means the building of an independent political movement of the working class, based on a socialist and internationalist program, to establish a rationally planned and democratically controlled world socialist economy.

The past week has seen a number of worried commentaries from liberal supporters of Obama on the state of social and political relations in the United States.
Among the columnists who have written along similar lines are Frank Rich, Paul Krugman and Bob Herbert of the New York Times, and Katrina vanden Heuvel of the Nation.
All of these writers proceed from a fact of American life that is becoming impossible to deny: the sharp divergence in the fortunes of the banks and investors, on the one hand, and the broad mass of the population, on the other. The Wall Street giants, the very firms that precipitated the financial crisis, are doing better than ever. They are planning record bonuses while unemployment continues to soar and wages are declining at a rate not seen in decades.
The proliferation of these columns is itself an indication of the depth of social tensions and the level of popular disillusionment with the Obama administration. Sensing the anger that is building up, the authors write as advisers to the administration: How can this opposition be contained?
Herbert (“Safety Nets for the Rich,” October 20), adopts a populist tone, complaining, “Even as tens of millions of working Americans are struggling to hang onto their jobs and keep a roof over their families’ heads, the wise guys on Wall Street are licking their fat-cat chops over yet another round of obscene multibillion-dollar bonuses—this time thanks to the bailout billions that were sent their way by Uncle Sam, with very little in the way of strings attached.”
Rich (“Goldman Can You Spare a Dime,” October 18) refers to the projected 2009 bonuses of $23 billion at Goldman Sachs as compared to the $200 million the bank is allocating to its own education foundation. He likens this to the dimes handed out by Standard Oil’s John D. Rockefeller at the beginning of the 20th century.
Both Herbert and Rich urge that stronger measures be taken, with the former advocating the break-up of Goldman Sachs and the latter expressing hope for a revival of Teddy Roosevelt-style trust busting.

Vanden Heuvel (“Happy Days?” October 16) is perhaps the most explicit in stating this position. “There is a growing danger that the public face of the Obama administration’s response to this Great Recession is the Bank Bailout,” she writes. “There is a real threat to the possibility and promise of the Obama administration.”
Her advice to Obama is to adopt more of a left tone. “The administration needs to switch this frame.” Following “a multi-trillion-dollar giveaway to get Big Banks back on track for billion dollar bonuses,” she writes, “It’s time for the Obama administration to act with equal boldness on behalf of regular folks.”
The central aim of these figures is to prevent workers from drawing broader conclusions about the nature of the government and the two-party system. They are engaged in a deliberate cover-up. From the beginning, the administration has been, and could only be, a government of the financial and corporate elite. The administration’s actions are determined by the class interests it represents.
On Wednesday, the Obama administration revealed that it is planning on imposing cuts in executive pay at seven companies with substantial bailout funds. The plan has the air of preemptive damage-control in the advance of bonus announcements later this year—the sort of measure that will be hailed by Obama’s liberal supporters. The steps will do nothing to address the social crisis of the working class, and the small number of executives affected will still receive compensation hundreds times that of the average worker.
In their various criticisms and complaints, what all these writers refuse to discuss is the “great unmentionable” of American politics: socialism. Unwilling to address the objective basis for the social and economic crisis and broach the only real alternative, their commentaries remain utterly banal. In the end, they are reduced to making moral appeals to the banks and pleading with Obama.
Michael Moore’s recent film, Capitalism: A Love Story, is made of the same stuff. After presenting a portrait of the crisis confronting millions of working people, Moore ends his film by calling for the replacement of capitalism not with socialism, but “democracy.”
He holds up Franklin Roosevelt and New Deal reformism as the ideal of democracy from the past, and pseudo-populists like Democratic Congresswoman Marcy Kaptur, as well as Obama himself, as its incarnations in the present. (In a recent column, Moore pleads with those who are angered by Obama’s policies: “Don’t abandon the best hope we’ve had in our lifetime for change.”)
The avarice of the financial elite, the blatant inequity of record bank bonuses and declining wages, along with the participation of the Obama administration in this process, are invariably presented as misfortunes.
However, the contrast between depression conditions facing the majority of the population and windfalls for the wealthy is a contradiction only in appearance. They are two sides of the same process. It is through a sharp attack on living standards, jobs, wages and social programs that the financial elite is seeking to safeguard its wealth.
This, in turn, is inextricably linked to the private ownership of the corporations and banks and the subordination of the economy to profit and the interests of the wealthy—that is, to capitalism.
This proscription of socialism has a history. American liberalism long ago compromised itself by wholeheartedly embracing post-war anti-communism, which was the means through which it lined up behind the global ambitions of American imperialism. With the full support of the trade unions, socialists and militants were driven out of the labor movement.
The rejection of socialism was bound up with the rejection of class as the fundamental category of social analysis. Politics based on race, gender, sexual orientation and other identities was elevated in its stead, and became the principal foundation of the Democratic Party and the preoccupation of the broad milieu of “left” petty-bourgeois groups.
The absolute exclusion of a socialist and class analysis has helped lend American politics—and media commentary—its particularly impoverished character. And it has left the working class without a viable perspective to defend its interests.
The past year, however, has not passed in vain. Broad sections of the working class are drawing certain conclusions. The ideological edifice of capitalism has been discredited in the eyes of millions of workers, who are rapidly losing confidence in the market and all official political institutions.
The immense class anger over the social crisis and disillusionment with the Obama administration have not yet taken an open political form. They will, however, and as this happens, the great principles of the socialist movement will experience a powerful revival in the working class—in opposition to the Democratic Party and its liberal supporters.
It is on these principles that the Socialist Equality Party, and only the Socialist Equality Party, is based.

Safety Nets for the Rich

The headlines that ran side by side on the front page of Saturday’s New York Times summed up, inadvertently, the terrible fix that we’ve allowed our country to fall into.
The lead headline, in the upper right-hand corner, said: “U.S. Deficit Rises to $1.4 Trillion; Biggest Since ’45.”
The headline next to it said: “Bailout Helps Revive Banks, And Bonuses.”
We’ve spent the last few decades shoveling money at the rich like there was no tomorrow. We abandoned the poor, put an economic stranglehold on the middle class and all but bankrupted the federal government — while giving the banks and megacorporations and the rest of the swells at the top of the economic pyramid just about everything they’ve wanted.
And we still don’t seem to have learned the proper lessons. We’ve allowed so many people to fall into the terrible abyss of unemployment that no one — not the Obama administration, not the labor unions and most certainly no one in the Republican Party — has a clue about how to put them back to work.
Meanwhile, Wall Street is living it up. I’m amazed at how passive the population has remained in the face of this sustained outrage.

Nevermind that the economy remains deeply troubled. As The Times pointed out on Saturday, much of Wall Street “is minting money.”
Call it déjà voodoo. I wrote a column that ran three days before Christmas in 2007 that focused on the deeply disturbing disconnect between Wall Streeters harvesting a record crop of bonuses — billions on top of billions — while working families were having a very hard time making ends meet.
We would later learn that December 2007 was the very month that the Great Recession began. I wrote in that column: “Even as the Wall Streeters are high-fiving and ordering up record shipments of Champagne and caviar, the American dream is on life support.”
So we had an orgy of bonuses just as the recession was taking hold and now another orgy (with taxpayers as the enablers) that is nothing short of an arrogantly pointed finger in the eye of everyone who suffered, and continues to suffer, in this downturn.
Whether P.T. Barnum actually said it or not, there is a sucker born every minute. American taxpayers might want to take a look in the mirror. If the epithet fits...
We need to make some fundamental changes in the way we do things in this country. The gamblers and con artists of the financial sector, the very same clowns who did so much to bring the economy down in the first place, are howling self-righteously over the prospect of regulations aimed at curbing the worst aspects of their excessively risky behavior and preventing them from causing yet another economic meltdown.
We should be going even further. We’ve institutionalized the idea that there are firms that are too big to fail and, therefore, “we, the people” are obliged to see that they don’t — even if that means bankrupting the national treasury and undermining the living standards of ordinary people. What sense does that make?
If some company is too big to fail, then it’s too big to exist. Break it up.
Why should the general public have to constantly worry that a misstep by the high-wire artists at Goldman Sachs (to take the most obvious example) would put the entire economy in peril? These financial acrobats get the extraordinary benefits of their outlandish risk-taking — multimillion-dollar paychecks, homes the size of castles — but the public has to be there to absorb the worst of the pain when they take a terrible fall.
Enough! Goldman Sachs is thriving while the combined rates of unemployment and underemployment are creeping toward a mind-boggling 20 percent. Two-thirds of all the income gains from the years 2002 to 2007 — two-thirds! — went to the top 1 percent of Americans.
We cannot continue transferring the nation’s wealth to those at the apex of the economic pyramid — which is what we have been doing for the past three decades or so — while hoping that someday, maybe, the benefits of that transfer will trickle down in the form of steady employment and improved living standards for the many millions of families struggling to make it from day to day.
That money is never going to trickle down. It’s a fairy tale. We’re crazy to continue believing it.

Atlanta homeless shelters strain under economic crisis

As the economic crisis deepens, Atlanta, Georgia, emergency providers are straining to accommodate more than 7,000 homeless people, including many newly homeless families.
Along with rising unemployment and a growing number of home foreclosures across the US, the homeless population is swelling far beyond the capacity of emergency facilities. Urban centers have felt the impact most sharply, with service organizations facing budget cuts at the same time that thousands are thrust into poverty and foreclosure.
According to an October 12 report in the Atlanta Journal-Constitution, Atlanta’s Salvation Army cannot open a nearly completed homeless shelter for families because of a lack of funds. Similarly, the city’s Midtown Assistance Center, an agency providing emergency financial assistance, announced in August that it had spent twice its monthly $24,000 budget on aid in the month of July. The agency assists employed workers and those in job training who do not receive public assistance.
Another area service provider, MUST Ministries, reported that it aided 29,000 people last year, and requests for assistance are up 25 percent this year. Annette Lee, MUST Ministries’ resource development coordinator, commented to the Journal-Constitution of September 29: “It’s no longer just hourly wage workers. These are professionals—from bankers to people with masters and PhD’s…. We are seeing more and more people who are above the poverty line.”
Metro Atlanta has lost nearly 143,000 payroll jobs in the past year, according to the most recent Labor Department figures, and well over a quarter million workers are unemployed in the city. Foreclosure filings have surged, with more than 97,000 foreclosure notices served in the metro area so far this year, up from the already high 79,400 in 2008.
According to Census Bureau data released in September, nearly 26,000 metro Atlanta families fell below the poverty line in 2008—before the sharp economic decline of 2009—representing an increase of 19 percent over 2007.
The Metro Atlanta Task Force for the Homeless, a large walk-in shelter downtown, is now serving more than 700 people each night and anticipating far higher numbers as the weather turns colder. The Task Force is often the only emergency shelter open to men, after other city shelters fill with families.
According to employees, the shelter has come under attack from a local business group, Central Atlanta Progress (CAP), which wants the agency closed. The Task Force filed a lawsuit in July against CAP and members of city government on charges of harassment and interference. According to the lawsuit, the city refused to issue certifications to the Task Force that would have allowed the group to obtain government funds, despite the agency’s compliance with city requirements.
The shelter has also had its water shut off by the city twice in the past year without explanation. CAP officials have publicly expressed the opinion that the shelter breeds crime and encourages laziness among the homeless population. In September, the city petitioned to have the Task Force’s lawsuit dismissed. That petition was denied by Fulton County Superior Court.
According to Anita Beaty, director of the Task Force, more than three-quarters of the people who sleep at the shelter earn a living during the day, but not enough to afford rent in the city.
“Atlanta has been trying to hide poverty so they attack us for keeping poverty out front,” shelter employee Troy Harris told the Journal-Constitution. “If the city was doing what it says it is doing in placing people in housing, we wouldn’t have 700 people a night in here. We are the visible truth of Atlanta.”
Atlanta’s political establishment has taken several measures over the past decade to push out the poorest layers of the population and gentrify the downtown area. In the mid-1990s, in preparation for hosting the Olympics, the city initiated a systematic destruction of public housing.
The first city to open public housing units to the poor in the 1930s, Atlanta now bears the distinction of being the first city to have all of them closed down. In the past 15 years, the city has torn down some 15,000 units in 32 housing projects. According to a 2007 study by the Georgia Institute of Technology, as the number of units was halved and replaced by mixed-income communities, only one third of displaced residents were able to resettle.
As part of the same broad strategy of gentrification, beginning in 2003 Atlanta Mayor Shirley Franklin issued a series of orders banning such acts as donating food to the homeless on downtown streets, soliciting donations and sleeping in public areas. Atlanta police, posing as tourists, have staged a series of undercover street sweeps, arresting dozens of homeless people for asking for money.
The policies in Atlanta are not unique. Virtually all major cities in the US have put in place measures to criminalize homelessness and push shelters, clinics and other services outside of the downtown areas. As the economic crisis deepens, those pushed out of their jobs and homes will come under increasing attack, as the ruling establishment seeks to obscure the social realities.
In July, the National Coalition for the Homeless issued a report on this trend throughout the country. A survey of 235 cities found that one-third have ordinances in place banning “camping” in public areas, and 30 percent banned “sitting/lying” in public areas. Nearly half of all cities surveyed had bans on “loitering” and begging.
