WASHINGTON — A draft of a White House immigration
proposal obtained by USA TODAY would allow illegal immigrants to become legal
permanent residents within eight years.
The plan
also would provide for more security funding and require business owners to
check the immigration status of new hires within four years. In addition, the nation's 11 million illegal immigrants could apply for a
newly created "Lawful Prospective Immigrant" visa, under the bill
being written by the White House.
The draft was obtained from an Obama administration
official who said it was being distributed to various agencies. The official
requested anonymity because he was not authorized to release the proposal
publicly.
The bill is being developed as members in both chambers
of Congress are drafting their own immigration bills. Last month, four
Republican senators joined with four Democratic senators to announce their
agreement on the general outlines of an immigration plan. In the House, a
bipartisan group of representatives has been negotiating an immigration
proposal for years and are writing their own bill.
In his first term, Obama often deferred to Congress on
drafting and advancing major legislation, including the Affordable Care Act. He
has openly supported the efforts in Congress to move immigration legislation,
and just this week met with Democratic senators to discuss their proposals.
But two weeks ago in Las Vegas, while outlining his
immigration plans, Obama made clear that he would not wait too long for
Congress to get moving.
"If Congress is unable to move forward in a timely
fashion, I will send up a bill based on my proposal and insist that they vote
on it right away," he said.
White House spokesman Clark Stevens said Saturday that
the administration continues to support the bipartisan efforts ongoing in
Congress.
"The president has made clear the principles upon
which he believes any common-sense immigration reform effort should be
based," Stevens said. "We continue to work in support of a bipartisan
effort, and while the president has made clear he will move forward if Congress
fails to act, progress continues to be made and the administration has not
prepared a final bill to submit."
According to the White House draft, people would need to
pass a criminal background check, submit biometric information and pay fees to
qualify for the new visa. If approved, they would be allowed to legally reside
in the U.S., work and leave the country for short periods of time.
Illegal immigrants would be disqualified from the program
if they were convicted of a crime that led to a prison term of at least one
year, three or more different crimes that resulted in a total of 90 days in
jail, or if they committed any offense abroad that "if committed in the
United States would render the alien inadmissible or removable from the United
States."
People currently in federal custody or facing deportation
proceedings also could be allowed to apply for the Lawful Prospective Immigrant
visa. Application forms and instructions would be provided in "the most
common languages spoken by persons in the United States," but the application
and all supporting evidence submitted to the federal government would have to
be in English.
They would also be given a new identification card to
show as proof of their legal status in the country.
The immigrants could then apply for legal permanent
residence, commonly known as a green card, within eight years if they learn
English and "the history and government of the United States" and pay
back taxes. That would then clear the path for them to apply for U.S.
citizenship.
To combat fraud, the draft proposes a new Social Security
card be developed that is "fraud-resistant, tamper-resistant and
wear-resistant." The Social Security Administration would be required to
issue the new cards within two years.
A major requirement for many Republicans is enhanced border
security. The bill calls for an unspecified increase in the Border Patrol,
allows the Department of Homeland Security to expand technological improvements
along the border and adds 140 new immigration judges to process the heavy flow
of people who violate immigration laws.
It also orders U.S. Customs and Border Protection (CBP)
to study whether a land-border crossing fee should be implemented to help
offset border security costs. The draft also proposes raising many inspection
fees that border-crossers already pay.
The draft bill proposes a new plan to allow Homeland
Security to "accept donations" from citizens, businesses and local
and state governments to improve ports of entry and security features along the
border. And it would require CBP to begin collecting statistics on deaths along
the border and report them quarterly.
The
draft also expands the E-Verify program that checks the immigration status of
people seeking new jobs. Businesses with more than 1,000 employees must begin
using the system within two years, businesses with more than 250 employees
within three years and all businesses within four years.
Homeland Security, working with the U.S. departments of
Labor and Agriculture, the attorney general and other agencies, would engage in
a $40 million-a-year program to educate business owners and workers about the
program.
Homeland Security also would be required to submit a
report within 18 months showing how the worker verification system is working,
and specifically explain how it is affecting the nation's agriculture industry,
which relies heavily on illegal immigrant workers.
The draft obtained by USA TODAY does not include sections
that would alter the nation's legal immigration system to adjust the future
flow of legal immigrants, which is expected to be a critical component of any
immigration overhaul.

Obama Administration Challenges
Arizona E-Verify Law
The
Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who
hire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus
Curiae Brief).
Called the “Legal Arizona Workers Act,” the law requires all employers in
Arizona to use E-Verify and provides that the business licenses of those who
hire illegal workers shall be repealed. From the date of enactment, the
Chamber of Commerce and other special interest groups have been trying to undo
it, attacking it through a failed ballot initiative and also through a lawsuit.
Now the Chamber is asking the United States Supreme Court to hear the case (Chamber
of Commerce v. Candelaria), and the Obama Administration is weighing in
against the law.
To
date, Arizona’s E-Verify law has been upheld by all lower courts, including the
Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as
an exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice
Department, however, disagrees. Acting Solicitor General Neal Katyal said in
his filing with the Supreme Court that the lower courts were wrong to uphold
the statute because federal immigration law expressly preempts any state law
imposing sanctions on employers hiring illegal immigrants. Mr.
Katyal argues that this is not a licensing law, but “a statute that prohibits
the hiring of unauthorized aliens and uses suspension and revocation of all
state-issued licenses as its ultimate sanction.” (Solicitor General's Amicus
Curiae Brief,
p. 10). This is the administration’s first court challenge to a state’s
authority to act against illegal immigration, and could be a preview of the
battle brewing over Arizona’s recent illegal immigration crackdown through SB
1070.
Napolitano
has made no comment on the Department of Justice’s decision to challenge the
2007 law, but federal officials said that she has taken an active part in the
debate over whether to do so. (Politico, May 28, 2010).
As Governor of Arizona, Napolitano said she believed the state law was valid
and became a defendant in the many lawsuits against it. (Id.).

dropped precipitously under President Obama, according to figures released
Wednesday. Criminal arrests, administrative arrests, indictments and
convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal
2009.
The figures show that Mr. Obama has made good on his pledge to shift
enforcement away from going after illegal immigrant workers themselves - but at
the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican
who compiled the numbers from the Department of Homeland Security's U.S.
Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican
on the House Judiciary Committee, said a period of economic turmoil is the
wrong time to be cutting enforcement and letting illegal immigrants take jobs
that Americans otherwise would hold.

If job
creation is the goal, make E-Verify mandatory

In a speech delivered during a campaign fundraising trip to Texas last month,
President Obama called for Congress to approve comprehensive immigration
reform, also known as "amnesty." Meanwhile, the president and his
administration claim that putting unemployed Americans back to work is their
No. 1 priority.
But these two goals cannot be met simultaneously. The president cannot say on
one hand that he wants to create jobs and on the other that he wants to
legalize millions of illegal immigrants.
Amnesty prevents Americans
from getting jobs, since millions of illegal immigrants will become eligible to
work legally in the United States. The president's proposal to legalize
millions of illegal immigrants means more competition for American workers who
are in need of jobs.
Look at history to see how amnesty has played out in the past. In 1986,
Congress legalized about 3 million illegal immigrants. It didn't fix the
problem; it only made it worse. Today, there are more than 11 million illegal
immigrants in the U.S., and 7 million people work here illegally. At the same
time, 26 million Americans are unemployed or have given up looking for work.
It is inexcusable that Americans and legal workers have to compete with illegal
immigrants for scarce jobs. Rather than reward lawbreakers, we should put
American workers first.
Fortunately, there is a free, quick and easy tool available to preserve jobs
for legal workers: E-Verify. But the program is currently voluntary. Congress
has the opportunity to expand E-Verify so more job opportunities are made
available to unemployed Americans. There is no other legislation that can be
enacted that will create more jobs -- maybe millions more -- for American
workers.
Created in the Illegal Immigration Reform and Immigrant Responsibility Act of
1996, E-Verify is a Web-based system that allows employers to electronically
verify the work eligibility of newly hired employees.
Under E-Verify, the Social Security numbers of new hires are checked against
Social Security Administration and Department of Homeland Security records to
weed out fraudulent numbers and help ensure that new hires are legally
authorized to work in the U.S.
Even though E-Verify is not mandatory, more than 250,000 businesses willingly
use E-Verify and 1,300 new businesses sign up each week. Individuals eligible
to work receive immediate confirmation 99.5 percent of the time.
Unlike amnesty, E-Verify has received overwhelming bipartisan support since its
creation as a pilot program in 1996. It was extended in 2002, 2008 and 2010. In
2008, the House passed a standalone five-year extension of E-Verify by a vote
of 407-2. And in 2009, the Senate passed a permanent E-Verify extension by
voice vote.
Part of the success of E-Verify is that participating employers are happy with
the results. Outside evaluations have found that the vast majority of employers
using E-Verify believe it to be an effective and reliable tool for checking the
legal status of their employees.
And E-Verify recently received an exceptionally high overall customer
satisfaction score -- 82 out of 100 on the American Customer Satisfaction Index
scale. That is well above the overall federal government satisfaction index of
69.
The American people also support E-Verify. A May 2011 Rasmussen poll found that
82 percent of likely voters think businesses should be required to use the
federal government's E-Verify system to determine if a potential employee is in
the country legally.
And a 2010 Zogby poll of minorities commissioned
by the Center for Immigration Studies found that 88 percent of likely minority
voters polled support reducing the illegal immigrant population over time by
enforcing existing immigration laws, such as requiring employers to verify the
legal status of their workers.
With millions of citizens and legal workers looking for work, it is important
that we promote policies that increase job opportunities for Americans and
legal immigrants. Amnesty undermines this goal, but making E-Verify mandatory
helps achieve it.
As long as opportunities for illegal employment exist, the incentive to enter
the United States illegally or to overstay visas will continue.
If job creation is the president's
priority, then he should push Congress to pass mandatory E-Verify legislation.
We cannot sit and hope that businesses hire only legal workers; hope is not a
strategy. E-Verify is our best tool for reducing the jobs magnet and creating
more jobs for American workers.

Much
more can be done on immigration before election

We could open up millions of jobs for
unemployed American workers by requiring all U.S. employers to use E-Verify.
Last year, the House Judiciary Committee approved a bipartisan bill that does
just that, the Legal Workforce Act.
E-Verify is a Web-based program that quickly identifies
illegal immigrants in the workforce and protects jobs for legal workers by
checking the Social Security numbers of new hires. The program is free, quick
and easy to use. It only takes about a minute to run a newly hired employee
through E-Verify and persons eligible to work here are immediately confirmed
99.5 percent of the time. More than 375,000 employers already use E-Verify, and
2,200 new businesses sign up each week.
Considering
its track record, it’s no surprise that a recent poll found 82 percent of
Americans surveyed support the expansion of E-Verify. And with 13 million
Americans unemployed and 7 million illegal immigrants working here, now is the
time to expand this popular program.
We
could also boost job creation and improve our economy by allowing the United
States to retain some of the world’s best and brightest foreign graduates of
American universities. Foreign students receive nearly 4 out of every 10
master’s degrees awarded in science, technology, engineering and math (STEM)
fields and about the same percentage of all doctorates. These students have the
potential to come up with an invention that could save thousands of lives or
jump-start a whole new industry. They also have the ability to start a company
that could provide jobs to tens of thousands of American workers.
Unfortunately,
our immigration system does not always put American interests first — we select
only 5 percent of our immigrants based on the skills and education they bring
to the United States. Our immigration laws should not force the country to
forfeit retaining some of the most talented students from around the world. We
should make tweaks to our immigration system to allow more of the top foreign graduates
of American universities to stay and work here.
Our
immigration system should also better protect our country and citizens from
foreign nationals who wish to do us harm. Recent events underscore the need to
strengthen and improve visa security; we know terrorists use loopholes and
weaknesses in our immigration system to enter the United States. In fact, all
of the 9/11 terrorists entered the country legally on visas. And terrorists
will continue coming to the United States legally if we do not improve and
tighten our visa security process.
The
Secure Visas Act, approved by the House Judiciary Committee last year, helps
prevent terrorists from obtaining U.S. visas by expanding the number of visa
security units overseas to areas designated as “highest risk” for terror
threats. Visa security units ensure that thorough background checks are
conducted on all visa applicants, not just a select few. The bill also allows
U.S. officials to expedite the removal of terrorists who are in the United
States on a visa. Visa security is critical to America’s national security.
The
safety of all Americans could be further enhanced by enacting the Keep Our
Communities Safe Act that was approved by the House Judiciary Committee last
year. This bill is designed to prevent dangerous criminal immigrants from being
released into our communities.
Recent
Supreme Court decisions have ruled that under current law, illegal and criminal
immigrants cannot be detained for more than six months when they cannot be
removed to their home country in the near future. Because some countries refuse
to take back their criminal immigrants, federal authorities have had no choice
but to release thousands of dangerous criminal immigrants into our
neighborhoods.
Tragically,
there have been at least eight preventable deaths because of this loophole. We
cannot continue to let dangerous criminal immigrants slip through the cracks of
our legal justice system. We have a responsibility to make sure the laws of
this land protect Americans rather than endanger them. The Keep Our Communities
Safe Act provides a legislative remedy to this problem by allowing dangerous
criminal immigrants to be detained beyond six months if they cannot be
deported.
Election
Day might be just five months away, but that shouldn’t stop Congress from doing
its job now. Congress still has an opportunity to work across party lines and
take up immigration bills that will help put Americans back to work and make
our country safer.

The Obama administration
hailed the February jobs report, released by the Labor Department’s Bureau of
Labor Statistics (BLS) Friday morning, although the 227,000 net new jobs made
only a slight dent in the army of nearly 13 million unemployed in America,
including 5.5 million unemployed for more than six months.
At this rate of net job
creation, and with 125,000 people entering the job market each month, it would
require 130 months—nearly 11 years—to put all those currently unemployed back
to work. That is without taking into account future economic shocks from the US
and world financial system.

Amnesty’: A Republican Chides Obama
To the Editor:
Your July 13
editorial “The Forgetful Mr. Smith” took a sentence
in a letter several colleagues and I sent to the Clinton administration out of
context, so you didn’t give your readers the whole story.
This letter
requested that the Immigration and Naturalization Service issue guidelines for
removal proceedings in the most sympathetic cases: those that involve legal —
not illegal — immigrants who committed a single minor crime but have been
law-abiding residents ever since.
While this
authority is justifiable when used responsibly on a case-by-case basis, it’s
clear that the Obama administration plans to abuse it. In recent years,
Congress has defeated amnesty for illegal immigrants several times, but this
has not stopped President Obama from trying to implement a backdoor amnesty.
Over the last year, the Obama administration has ignored the will of Congress
and the American people by using executive branch authority to allow illegal
immigrants to remain living and working in the United States.
That is why I
have introduced a bill to prevent the Obama administration from
abusing this power. The Obama administration should not pick and choose which
laws it will enforce. Congress must put a halt to this administrative amnesty.

WASHINGTON — A draft of a White House immigration
proposal obtained by USA TODAY would allow illegal immigrants to become legal
permanent residents within eight years.
The plan
also would provide for more security funding and require business owners to
check the immigration status of new hires within four years. In addition, the nation's 11 million illegal immigrants could apply for a
newly created "Lawful Prospective Immigrant" visa, under the bill
being written by the White House.
The draft was obtained from an Obama administration
official who said it was being distributed to various agencies. The official
requested anonymity because he was not authorized to release the proposal
publicly.
The bill is being developed as members in both chambers
of Congress are drafting their own immigration bills. Last month, four
Republican senators joined with four Democratic senators to announce their
agreement on the general outlines of an immigration plan. In the House, a
bipartisan group of representatives has been negotiating an immigration
proposal for years and are writing their own bill.
In his first term, Obama often deferred to Congress on
drafting and advancing major legislation, including the Affordable Care Act. He
has openly supported the efforts in Congress to move immigration legislation,
and just this week met with Democratic senators to discuss their proposals.
But two weeks ago in Las Vegas, while outlining his
immigration plans, Obama made clear that he would not wait too long for
Congress to get moving.
"If Congress is unable to move forward in a timely
fashion, I will send up a bill based on my proposal and insist that they vote
on it right away," he said.
White House spokesman Clark Stevens said Saturday that
the administration continues to support the bipartisan efforts ongoing in
Congress.
"The president has made clear the principles upon
which he believes any common-sense immigration reform effort should be
based," Stevens said. "We continue to work in support of a bipartisan
effort, and while the president has made clear he will move forward if Congress
fails to act, progress continues to be made and the administration has not
prepared a final bill to submit."
According to the White House draft, people would need to
pass a criminal background check, submit biometric information and pay fees to
qualify for the new visa. If approved, they would be allowed to legally reside
in the U.S., work and leave the country for short periods of time.
Illegal immigrants would be disqualified from the program
if they were convicted of a crime that led to a prison term of at least one
year, three or more different crimes that resulted in a total of 90 days in
jail, or if they committed any offense abroad that "if committed in the
United States would render the alien inadmissible or removable from the United
States."
People currently in federal custody or facing deportation
proceedings also could be allowed to apply for the Lawful Prospective Immigrant
visa. Application forms and instructions would be provided in "the most
common languages spoken by persons in the United States," but the application
and all supporting evidence submitted to the federal government would have to
be in English.
They would also be given a new identification card to
show as proof of their legal status in the country.
The immigrants could then apply for legal permanent
residence, commonly known as a green card, within eight years if they learn
English and "the history and government of the United States" and pay
back taxes. That would then clear the path for them to apply for U.S.
citizenship.
To combat fraud, the draft proposes a new Social Security
card be developed that is "fraud-resistant, tamper-resistant and
wear-resistant." The Social Security Administration would be required to
issue the new cards within two years.
A major requirement for many Republicans is enhanced border
security. The bill calls for an unspecified increase in the Border Patrol,
allows the Department of Homeland Security to expand technological improvements
along the border and adds 140 new immigration judges to process the heavy flow
of people who violate immigration laws.
It also orders U.S. Customs and Border Protection (CBP)
to study whether a land-border crossing fee should be implemented to help
offset border security costs. The draft also proposes raising many inspection
fees that border-crossers already pay.
The draft bill proposes a new plan to allow Homeland
Security to "accept donations" from citizens, businesses and local
and state governments to improve ports of entry and security features along the
border. And it would require CBP to begin collecting statistics on deaths along
the border and report them quarterly.
The
draft also expands the E-Verify program that checks the immigration status of
people seeking new jobs. Businesses with more than 1,000 employees must begin
using the system within two years, businesses with more than 250 employees
within three years and all businesses within four years.
Homeland Security, working with the U.S. departments of
Labor and Agriculture, the attorney general and other agencies, would engage in
a $40 million-a-year program to educate business owners and workers about the
program.
Homeland Security also would be required to submit a
report within 18 months showing how the worker verification system is working,
and specifically explain how it is affecting the nation's agriculture industry,
which relies heavily on illegal immigrant workers.
The draft obtained by USA TODAY does not include sections
that would alter the nation's legal immigration system to adjust the future
flow of legal immigrants, which is expected to be a critical component of any
immigration overhaul.

Obama Administration Challenges
Arizona E-Verify Law
The
Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who
hire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus
Curiae Brief).
Called the “Legal Arizona Workers Act,” the law requires all employers in
Arizona to use E-Verify and provides that the business licenses of those who
hire illegal workers shall be repealed. From the date of enactment, the
Chamber of Commerce and other special interest groups have been trying to undo
it, attacking it through a failed ballot initiative and also through a lawsuit.
Now the Chamber is asking the United States Supreme Court to hear the case (Chamber
of Commerce v. Candelaria), and the Obama Administration is weighing in
against the law.
To
date, Arizona’s E-Verify law has been upheld by all lower courts, including the
Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as
an exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice
Department, however, disagrees. Acting Solicitor General Neal Katyal said in
his filing with the Supreme Court that the lower courts were wrong to uphold
the statute because federal immigration law expressly preempts any state law
imposing sanctions on employers hiring illegal immigrants. Mr.
Katyal argues that this is not a licensing law, but “a statute that prohibits
the hiring of unauthorized aliens and uses suspension and revocation of all
state-issued licenses as its ultimate sanction.” (Solicitor General's Amicus
Curiae Brief,
p. 10). This is the administration’s first court challenge to a state’s
authority to act against illegal immigration, and could be a preview of the
battle brewing over Arizona’s recent illegal immigration crackdown through SB
1070.
Napolitano
has made no comment on the Department of Justice’s decision to challenge the
2007 law, but federal officials said that she has taken an active part in the
debate over whether to do so. (Politico, May 28, 2010).
As Governor of Arizona, Napolitano said she believed the state law was valid
and became a defendant in the many lawsuits against it. (Id.).

Obama soft on illegals enforcement
Arrests of illegal immigrant workers have
dropped precipitously under President Obama, according to figures released
Wednesday. Criminal arrests, administrative arrests, indictments and
convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal
2009.
The figures show that Mr. Obama has made good on his pledge to shift
enforcement away from going after illegal immigrant workers themselves - but at
the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican
who compiled the numbers from the Department of Homeland Security's U.S.
Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican
on the House Judiciary Committee, said a period of economic turmoil is the
wrong time to be cutting enforcement and letting illegal immigrants take jobs
that Americans otherwise would hold.

If job
creation is the goal, make E-Verify mandatory

In a speech delivered during a campaign fundraising trip to Texas last month,
President Obama called for Congress to approve comprehensive immigration
reform, also known as "amnesty." Meanwhile, the president and his
administration claim that putting unemployed Americans back to work is their
No. 1 priority.
But these two goals cannot be met simultaneously. The president cannot say on
one hand that he wants to create jobs and on the other that he wants to
legalize millions of illegal immigrants.
Amnesty prevents Americans
from getting jobs, since millions of illegal immigrants will become eligible to
work legally in the United States. The president's proposal to legalize
millions of illegal immigrants means more competition for American workers who
are in need of jobs.
Look at history to see how amnesty has played out in the past. In 1986,
Congress legalized about 3 million illegal immigrants. It didn't fix the
problem; it only made it worse. Today, there are more than 11 million illegal
immigrants in the U.S., and 7 million people work here illegally. At the same
time, 26 million Americans are unemployed or have given up looking for work.
It is inexcusable that Americans and legal workers have to compete with illegal
immigrants for scarce jobs. Rather than reward lawbreakers, we should put
American workers first.
Fortunately, there is a free, quick and easy tool available to preserve jobs
for legal workers: E-Verify. But the program is currently voluntary. Congress
has the opportunity to expand E-Verify so more job opportunities are made
available to unemployed Americans. There is no other legislation that can be
enacted that will create more jobs -- maybe millions more -- for American
workers.
Created in the Illegal Immigration Reform and Immigrant Responsibility Act of
1996, E-Verify is a Web-based system that allows employers to electronically
verify the work eligibility of newly hired employees.
Under E-Verify, the Social Security numbers of new hires are checked against
Social Security Administration and Department of Homeland Security records to
weed out fraudulent numbers and help ensure that new hires are legally
authorized to work in the U.S.
Even though E-Verify is not mandatory, more than 250,000 businesses willingly
use E-Verify and 1,300 new businesses sign up each week. Individuals eligible
to work receive immediate confirmation 99.5 percent of the time.
Unlike amnesty, E-Verify has received overwhelming bipartisan support since its
creation as a pilot program in 1996. It was extended in 2002, 2008 and 2010. In
2008, the House passed a standalone five-year extension of E-Verify by a vote
of 407-2. And in 2009, the Senate passed a permanent E-Verify extension by
voice vote.
Part of the success of E-Verify is that participating employers are happy with
the results. Outside evaluations have found that the vast majority of employers
using E-Verify believe it to be an effective and reliable tool for checking the
legal status of their employees.
And E-Verify recently received an exceptionally high overall customer
satisfaction score -- 82 out of 100 on the American Customer Satisfaction Index
scale. That is well above the overall federal government satisfaction index of
69.
The American people also support E-Verify. A May 2011 Rasmussen poll found that
82 percent of likely voters think businesses should be required to use the
federal government's E-Verify system to determine if a potential employee is in
the country legally.
And a 2010 Zogby poll of minorities commissioned
by the Center for Immigration Studies found that 88 percent of likely minority
voters polled support reducing the illegal immigrant population over time by
enforcing existing immigration laws, such as requiring employers to verify the
legal status of their workers.
With millions of citizens and legal workers looking for work, it is important
that we promote policies that increase job opportunities for Americans and
legal immigrants. Amnesty undermines this goal, but making E-Verify mandatory
helps achieve it.
As long as opportunities for illegal employment exist, the incentive to enter
the United States illegally or to overstay visas will continue.
If job creation is the president's
priority, then he should push Congress to pass mandatory E-Verify legislation.
We cannot sit and hope that businesses hire only legal workers; hope is not a
strategy. E-Verify is our best tool for reducing the jobs magnet and creating
more jobs for American workers.

Much
more can be done on immigration before election

Congress
doesn’t have to wait until Election Day to respond to what the American people
care about. Poll after poll shows that the American people are overwhelmingly
concerned about jobs and the economy. They also consider national security an
important issue. By making some changes to our immigration system, Congress can
take action now to address the issues Americans care about the most.
We could open up millions of jobs for
unemployed American workers by requiring all U.S. employers to use E-Verify.
Last year, the House Judiciary Committee approved a bipartisan bill that does
just that, the Legal Workforce Act.
E-Verify is a Web-based program that quickly identifies
illegal immigrants in the workforce and protects jobs for legal workers by
checking the Social Security numbers of new hires. The program is free, quick
and easy to use. It only takes about a minute to run a newly hired employee
through E-Verify and persons eligible to work here are immediately confirmed
99.5 percent of the time. More than 375,000 employers already use E-Verify, and
2,200 new businesses sign up each week.
Considering
its track record, it’s no surprise that a recent poll found 82 percent of
Americans surveyed support the expansion of E-Verify. And with 13 million
Americans unemployed and 7 million illegal immigrants working here, now is the
time to expand this popular program.
We
could also boost job creation and improve our economy by allowing the United
States to retain some of the world’s best and brightest foreign graduates of
American universities. Foreign students receive nearly 4 out of every 10
master’s degrees awarded in science, technology, engineering and math (STEM)
fields and about the same percentage of all doctorates. These students have the
potential to come up with an invention that could save thousands of lives or
jump-start a whole new industry. They also have the ability to start a company
that could provide jobs to tens of thousands of American workers.
Unfortunately,
our immigration system does not always put American interests first — we select
only 5 percent of our immigrants based on the skills and education they bring
to the United States. Our immigration laws should not force the country to
forfeit retaining some of the most talented students from around the world. We
should make tweaks to our immigration system to allow more of the top foreign graduates
of American universities to stay and work here.
Our
immigration system should also better protect our country and citizens from
foreign nationals who wish to do us harm. Recent events underscore the need to
strengthen and improve visa security; we know terrorists use loopholes and
weaknesses in our immigration system to enter the United States. In fact, all
of the 9/11 terrorists entered the country legally on visas. And terrorists
will continue coming to the United States legally if we do not improve and
tighten our visa security process.
The
Secure Visas Act, approved by the House Judiciary Committee last year, helps
prevent terrorists from obtaining U.S. visas by expanding the number of visa
security units overseas to areas designated as “highest risk” for terror
threats. Visa security units ensure that thorough background checks are
conducted on all visa applicants, not just a select few. The bill also allows
U.S. officials to expedite the removal of terrorists who are in the United
States on a visa. Visa security is critical to America’s national security.
The
safety of all Americans could be further enhanced by enacting the Keep Our
Communities Safe Act that was approved by the House Judiciary Committee last
year. This bill is designed to prevent dangerous criminal immigrants from being
released into our communities.
Recent
Supreme Court decisions have ruled that under current law, illegal and criminal
immigrants cannot be detained for more than six months when they cannot be
removed to their home country in the near future. Because some countries refuse
to take back their criminal immigrants, federal authorities have had no choice
but to release thousands of dangerous criminal immigrants into our
neighborhoods.
Tragically,
there have been at least eight preventable deaths because of this loophole. We
cannot continue to let dangerous criminal immigrants slip through the cracks of
our legal justice system. We have a responsibility to make sure the laws of
this land protect Americans rather than endanger them. The Keep Our Communities
Safe Act provides a legislative remedy to this problem by allowing dangerous
criminal immigrants to be detained beyond six months if they cannot be
deported.
Election
Day might be just five months away, but that shouldn’t stop Congress from doing
its job now. Congress still has an opportunity to work across party lines and
take up immigration bills that will help put Americans back to work and make
our country safer.

Obama hails jobs report despite
nearly 13 million unemployed

The Obama administration
hailed the February jobs report, released by the Labor Department’s Bureau of
Labor Statistics (BLS) Friday morning, although the 227,000 net new jobs made
only a slight dent in the army of nearly 13 million unemployed in America,
including 5.5 million unemployed for more than six months.
At this rate of net job
creation, and with 125,000 people entering the job market each month, it would
require 130 months—nearly 11 years—to put all those currently unemployed back
to work. That is without taking into account future economic shocks from the US
and world financial system.

‘Backdoor
Amnesty’: A Republican Chides Obama
To the Editor:
Your July 13
editorial “The Forgetful Mr. Smith” took a sentence
in a letter several colleagues and I sent to the Clinton administration out of
context, so you didn’t give your readers the whole story.
This letter
requested that the Immigration and Naturalization Service issue guidelines for
removal proceedings in the most sympathetic cases: those that involve legal —
not illegal — immigrants who committed a single minor crime but have been
law-abiding residents ever since.
While this
authority is justifiable when used responsibly on a case-by-case basis, it’s
clear that the Obama administration plans to abuse it. In recent years,
Congress has defeated amnesty for illegal immigrants several times, but this
has not stopped President Obama from trying to implement a backdoor amnesty.
Over the last year, the Obama administration has ignored the will of Congress
and the American people by using executive branch authority to allow illegal
immigrants to remain living and working in the United States.
That is why I
have introduced a bill to prevent the Obama administration from
abusing this power. The Obama administration should not pick and choose which
laws it will enforce. Congress must put a halt to this administrative amnesty.
