NOGALES, Ariz. — Undocumented immigrants who
decide to leave the United States because of
increasing enforcement and decreasing job
prospects now face one more obstacle: the threat of
arrest and deportation by border officers inspecting
outbound traffic.

Bonnie Arellano, a spokeswoman for U.S. Customs
and Border Protection, said that when illegal
immigrants are detected trying to leave the country,
they are not just ushered across the line. Instead,
they are processed and formally removed.

The consequences of an arrest can be harsh: Those
deported for unauthorized presence in the U.S. may
be barred for 10 years from seeking legal immigrant
papers. In addition, a later arrest for illegal entry
may be prosecuted criminally.

Although the scrutiny was designed to catch
smugglers delivering currency and firearms to
Mexican cartels, immigrants with otherwise clean
records sometimes get caught in that net, said
Guadalupe Ramirez, director at the Nogales port.
Port inspectors use discretion in deciding whether a
person should be allowed to accept voluntary
removal, he said.

"The whole idea is there are going to be
consequences now for people who come into the
United States with the sole purpose of doing illegal
activity," Ramirez said. "Our job tells us if we find
somebody at a port coming or going that is in
violation of our laws, we are going to document it."

Arizona's immigration law would have required
police to question the immigration status of anyone
stopped for another suspected offense if there was a
"reasonable suspicion" the person was in the U.S.
illegally. District Judge Susan Bolton ruled last week
that key portions of the law could not go into effect.

For the past year, border officials have conducted
round-the-clock screening of southbound traffic
out of the USA. Some advocates for immigrants say
the policy deters illegal immigrants from leaving,
even though that's the government's goal.

"It demonstrates the inconsistency and
contradictions within our laws," said Isabel Garcia,
co-chairwoman of Derechos Humanos, an
immigrant rights group in Tucson. "Instead of
permitting people who want to leave, we punish
them in this fashion."

Even some groups dedicated to border security and
immigration controls are critical of the policy.
William Gheen, president of Americans for Legal
Immigration, last week called on the government to
adopt a "safe passage" program. "We are asking the
Obama administration to designate border
checkpoints ... illegal immigrants can use to leave
the U.S. without fear."

The Obama administration — in an effort to intercept
weapons and cartel money — set up the full-time
southbound checkpoints.

"On a weekly basis, we make multiple seizures and
pick up people who have warrants for rape, child
molestation and murder," Ramirez said.

Immigrant groups criticize fingerprint initiative

DENVER — The federal government is rapidly expanding a program to identify illegal immigrants using fingerprints from arrests, drawing opposition from local authorities and advocates who argue the initiative amounts to an excessive dragnet.

The program has gotten less attention than Arizona's new immigration law, but it may end up having a bigger impact because of its potential to round up and deport so many immigrants nationwide.

The San Francisco sheriff wanted nothing to do with the program, and the City Council in Washington, D.C., blocked use of the fingerprint plan in the nation's capital. Colorado is the latest to debate the program, called Secure Communities, and immigrant groups have begun to speak up, telling the governor in a letter last week that the initiative will make crime victims reluctant to cooperate with police "due to fear of being drawn into the immigration regime."

Under the program, the fingerprints of everyone who is booked into jail for any crime are run against FBI criminal history records and Department of Homeland Security immigration records to determine who is in the country illegally and whether they've been arrested previously. Most jurisdictions are not included in the program, but Immigration and Customs Enforcement has been expanding the initiative.

Since 2007, 467 jurisdictions in 26 states have joined. ICE has said it plans to have it in every jail in the country by 2013. Secure Communities is currently being phased into the places where the government sees as having the greatest need for it based on population estimates of illegal immigrants and crime statistics.

Since everyone arrested would be screened, the program could easily deport more people than Arizona's new law, said Sunita Patel, an attorney who filed a lawsuit in New York against the federal government on behalf of a group worried about the program. Patel said that because illegal immigrants could be referred to ICE at the point of arrest, even before a conviction, the program can create an incentive for profiling and create a pipeline to deport more people.

"It has the potential to revolutionize immigration enforcement," said Patel.

Patel filed the lawsuit on behalf of the National Day Laborer Organizing Network, which is concerned the program could soon come to New York. The lawsuit seeks, among other things, statistical information about who has been deported as a result of the program and what they were arrested for.

Supporters of the program argue it is helping identify dangerous criminals that would otherwise go undetected. Since Oct. 27, 2008 through the end of May, almost 2.6 million people have been screened with Secure Communities. Of those, almost 35,000 were identified as illegal immigrants previously arrested or convicted for the most serious crimes, including murder and rape, ICE said Thursday. More than 205,000 who were identified as illegal immigrants had arrest records for less serious crimes.

In Ohio, Butler County Sheriff Rick Jones praised the program, which was implemented in his jurisdiction earlier this month.

"It's really a heaven-sent for us," Jones said. He said the program helps solve the problem police often have of not knowing whether someone they arrested has a criminal history and is in the country illegally.

"I don't want them in my community," Jones said. "I've got enough homegrown criminals here."

Carl Rusnok, an ICE spokesman, said Secure Communities is a way for law enforcement to identify illegal immigrants after their arrest at no additional cost to local jurisdictions. Jones agreed.

"We arrest these people anyway," he said. "All it does is help us deport people who shouldn't be here."

Rusnok said ICE created the program after Congress directed the agency to improve the way it identifies and deports illegal immigrants with criminal backgrounds. ICE has gotten $550 million for the program since 2008, Rusnok said.

Rusnok said the only place he knows of that has requested not to be a part of Secure Communities is San Francisco, which began the program June 8. Eileen Hirst, the chief of staff for San Francisco Sheriff Michael Hennessey, said it happened "without our input or approval."

Hirst said the sheriff thought Secure Communities cast too wide a net and worried that it would sweep up U.S. citizens and minor offenders, such as people who commit traffic infractions but miss their court hearings. Hirst also said the program goes against San Francisco's sanctuary city policy that calls for authorities to only report foreign-born suspects booked for felonies.

"Now, we're reporting every single individual who comes into our custody and gets fingerprinted," Hirst said.

California Attorney General Jerry Brown denied Hennessey's request to opt out. Brown said that prior to Secure Communities, illegal immigrants with criminal histories were often released before their status was discovered.

This month, Washington, D.C., police decided not to pursue the program because the City Council introduced a bill that would prohibit authorities from sharing arrest data with ICE out of concern for immigrants' civil rights. Matthew Bromeland, special assistant to the police chief, said police wanted the program and were talking with ICE about how address concerns from immigrant advocates before the bill forced them to halt negotiations.

Colorado officials became interested in the program after an illegal immigrant from Guatemala with a long criminal record was accused of causing a car crash at a suburban Denver ice-cream shop, killing two women in a truck and a 3-year-old inside the store. Authorities say the illegal immigrant, Francis M. Hernandez, stayed off ICE's radar because he conned police with 12 aliases and two different dates of birth.

A task-force assembled after the crash recommended Secure Communities as a solution.

Evan Dreyer, a spokesman for Colorado Gov. Bill Ritter, said Ritter recognizes that other states have had issues with the program and he wants to take time to consider the concerns raised by immigrant rights groups before deciding "how or if to move forward."

The Colorado Immigrant Rights Coalition said in its letter to the governor that the Secure Communities is "inherently flawed and should not be implemented." CIRC said one of its main concerns is that in cases of domestic violence, where both parties may be taken into custody while authorities investigate a case, victims may feel reluctant to report a crime out of fear that their illegal status will be discovered.

ICE maintains that only suspects arrested for crimes — and not the people reporting them — will be screened for their legal status.

Leaked Agency Memo Reveals Intent to Grant Amnesty by Regulation
An official memo surfaced last week revealing the Administration’s intent to circumvent Congress on immigration policy and grant amnesty administratively. In the memo, entitled “Administrative Alternatives to Comprehensive Immigration Reform,” senior officials at U.S. Citizenship and Immigration Services (USCIS) offered Director Alejandro Mayorkas a variety of ways to “reduce the threat of removal for certain individuals present in the United States without authorization” and extend benefits and protections to many individuals and groups until amnesty is granted. For illegal aliens who have been apprehended, USCIS officials recommend strategically issuing Notices to Appear (NTAs). NTAs essentially mark the action by which Homeland Security initiates a deportation proceeding. Homeland Security files the NTA with the immigration court, advising the alien of the nature of the proceedings, the alleged immigration law violations, and the consequences of failing to appear at the hearing. In the memo, USCIS officials recommend issuing NTAs to illegal aliens if the illegal alien is likely to find a loophole through during the removal process through which he/she will be granted permission to stay. However, “where no relief [for an illegal alien] exists in removal,” USCIS could simply not issue an NTA.

For illegal aliens already in deportation proceedings, these USCIS officials recommend granting “deferred enforcement,” essentially a decision by Homeland Security to not enforce a deportation order. “This,” the officials write, “would permit individuals for whom relief may become available in the future to live and work in the U.S. without fear of removal.” Generally, individuals who receive deferred enforcement also receive authorization to work in the United States.

Another option set forth in the memo is expanding the use of humanitarian parole. As the memo notes, USCIS has the discretionary authority to grant humanitarian parole for admission to the U.S. on a case-by-case basis. USCIS may grant humanitarian parole to an individual outside or inside the U.S., the latter commonly called “parole in place.” By expanding the use of parole in place, the officials argue “USCIS can eliminate the need for qualified recipients to return to their home country for consular processing” and avoid the three and ten-year bars to re-entry that usually apply to illegal aliens once they have left the country.

The memo also suggests that USCIS re-examine whether illegal aliens who leave the country but have applied for legal status should in fact be subject to the three and ten-year bars to re-entry that usually apply to illegal aliens. They remarkably suggest that “reexamining past interpretations of terms such as ‘departure’” could leave to a different outcome. The memo also suggests loosening the definition of “extreme hardship,” the basis by which USCIS may grant waivers of the three and ten-year bars.

Reaction to the USCIS memo was swift and negative. Senator Grassley (R-IA) remarked, “The document provides an additional basis for our concerns that the administration will go to great lengths to circumvent Congress and unilaterally execute a back-door amnesty plan.” (Politico, July 30, 2010). Ranking Member of the House Judiciary Committee Lamar Smith said the Obama Administration was “conspiring to implement amnesty without any Congressional action.”

In an apparent effort to backpedal, USCIS spokesman Christopher Bentley told reporters that the agency would not comment on details of the memo, which he described as an internal draft that "should not be equated with official action or policy of the Department. We continue to maintain that comprehensive bipartisan legislation, coupled with smart, effective enforcement, is the only solution to our nation's immigration challenges." In an e-mail, he added: the Obama administration "will not grant deferred action or humanitarian parole to the nation's entire illegal immigrant population." (ProPublica, July 30, 2010).

In an interview with FOX News on Friday, White House Press Secretary Robert Gibbs tried to minimize the USCIS memo. "The White House doesn't support amnesty and I think people that support comprehensive immigration reform don't support amnesty either,” said Gibbs. “What we need to do again is try to figure out how we're going to secure borders, deal with those that are here, but do it in a comprehensive way and do it at a federal level, because as frustrated as Arizonans are, and we understand that we can't have a patchwork of immigration laws throughout each of the 50 states." Nebraska town: Is illegal immigration crackdown worth the cost?
Facing costly legal battles with civil rights organizations, the city council in Fremont, Nebraska, may halt a law prohibiting businesses from hiring illegal immigrants.

The city council of Fremont, Nebraska (pop. 25,000), is expected to decide Tuesday whether to delay enforcement of a new illegal immigration law because of legal challenges by civil rights groups. The ordinance, which would prohibit businesses from hiring and landlords from renting to illegal immigrants, was approved by voters June 21 and is scheduled to go into effect on Thursday.
Immigration experts say the case could be a useful barometer of public sentiment and could provide indications of the mood of courts in the wake of scores of such laws being introduced in several states after Arizona’s tough immigration law passed in April. That law, pending a federal injunction, is also due to take effect Thursday.
Historically, such laws have not survived. A similar law was struck down in Hazelton, Pa., in 2006, and the US Supreme Court struck down a Nebraska state law in 1923 that restricted foreign-language education because it violated the 14th Amendment, points out Robert Langran, a political scientist at Villanova University. [Editor's note: The original gave the wrong year that the Supreme Court struck down the Nebraska law.]
In the Nebraska case, the American Civil Liberties Union (ACLU) and the Mexican American Legal Defense and Educational Fund (MALDEF) are suing, claiming the ordinance amounts to discrimination.
The law would subject landlords who knowingly rent to illegal immigrants could to $100 fines, and would require employers to check a federal online system to determine whether a person is permitted to work in the US.
In addition, it would require people to apply for a $5 City Hall permit before renting property. Those who said they were citizens would get a permit without having to provide evidence of their legal status. Those who said they were not citizens would still receive permits, but their legal status would be checked. If their status was found wanting, they would be forced to resolve it or leave the property.
Fremont appears to be leaning away from a court fight for cost reasons – officials have estimated that implementing the ordinance, including legal fees, would average $1 million per year.
Legal experts say that sets a bad precedent.
“City Councils should not suspend ordinances just because they might be expensive,” says Jessica Levinson, adjunct professor of law at Loyola Law School. “The voters have spoken, and passed this ordinance. Regardless of the merits (or constitutionality) of this particular ordinance, it would set a bad trend if elected bodies start to fail to implement newly passed initiatives,” she says.
Robert Stern, president of the Center for Governmental studies, agrees. “I have problems with this action by the council since the ordinance was adopted as an initiative measure by the voters,” he says. “The council should have opposed the measure when it was on the ballot,” he says.

“Good public policy involves weighing all the costs and benefits of enacting legislation," says Mary Giovagnoli of the American Immigration Council's Immigration Policy Center. "While Fremont may be motivated in this case to suspend the law because of the fear of litigation costs, there are numerous other costs to consider," she says, "including the loss of revenue to the town when people leave, stop supporting local businesses and paying taxes, as well as the psychological impact when a town goes down the road of driving people away."

House Passes Border Security Funding Bill
Approximately 24 hours before Arizona’s new immigration enforcement law was scheduled to take effect, the House passed a supplemental spending bill which would appropriate an additional $701 million for increased border security measures along the southern border. (H.R. 5875). The bill was passed by a voice vote after being fast tracked through the House by motions to suspend normal rules of floor debate and amendments. This bill appropriates more funding for Border and Customs Protection Officers, Border Patrol agents, operation bases and fencing infrastructure, and expanded activities and operations of ICE and the Department of Justice along the southern border including:

$208.4 million for 1,200 additional Border Patrol agents to be deployed between ports of entry along the Southwest border;
$201 million for Justice Department programs and the temporary deployment of personnel to high-crime areas;
$136 million to add 500 additional officers at ports of entry along the Southwest Border and deploy additional canine teams;
$50 million for Operation Stonegarden grants to support local law enforcement activities on the border;
$35.5 million for improved tactical communications on the Southwest border, three permanent Border Patrol forward operating bases and a surge in investigations designed to prevent corruption among CBP officers and agent;
$32 million to procure two additional CBP unmanned aerial detection systems; and
$30 million to hire additional Immigration and Customs Enforcement agents.
The House had previously included these border appropriations in the FY 2010 Supplemental Appropriations Act, but they were stripped out of the final version in the Senate. A spokesman for Senator John McCain clarified that he supports the funding for border security but believes it must be paid for.

H.R. 5875 now travels to the Senate, but it is unclear whether Democratic Leadership will take it up during the one week that remains before the Senate leaves for August recess. Congressman Hal Rogers, the ranking Republican on the Homeland Security Appropriations Subcommittee, is planning to offer a border security package to the FY2011 Homeland Security Appropriations Bill that is fully offset with spending cuts. VIRGINIA POLICE CAN ASK ABOUT IMMIGRATION STATUS - Must Make Obama Mad!

Cuccinelli: Va. police can ask about immigration status
Updated, 5:29 p.m.: Law enforcement officials in Virginia can inquire into immigration status of those they stop or arrest--just as they can under a controversial new immigration law in Arizona--Virginia Attorney General Ken Cuccinelli has ruled in an official legal opinion.

Written in response to a request for legal advice from Del. Bob Marshall (R-Prince William), Cuccinelli ruled that police officers and other legal authorities can look into the immigration status of anyone stopped or arrested.

A 2008 Virginia law requires that law enforcement check the immigration status of anyone taken into custody on suspicion of having committed a separate crime. Cuccinelli's opinion could expand such inquiries to those who have been legally stopped by law enforcement, for instance those pulled over for a traffic violation or at a police checkpoint.

Cuccinelli writes in the July 30 opinion that while local law enforcement have the ability to arrest those they suspect of committing criminal violations of immigration laws but not those they believe have violated civil immigration statutes. But he says inquiring into status is different than arresting for a violation and that law enforcement can inquire. While it is a crime to illegally cross the border, many other immigration violations are civil offense, like overstaying a valid visa.

"Virginia law enforcement officers have the authority to make the same inquiries as those contemplated by the new Arizona law. So long as the officers have the requisite level of suspicion to believe that a violation of the law has occurred, the officers may detain and briefly question a person they suspect has committed a federal crime," he writes.

In Virginia, official opinions of the attorney general are considered law unless a judge disagrees with the legal analysis after an opinion has been challenged in court.

Cuccinelli's opinion is legal guidance for local law enforcement and does not require them to act. But those on both sides of the decision believe that it provides law enforcement the legal authority to begin checking the status of immigrants immediately, if they wish.

The opinion is sure to widen a debate over illegal immigration in Virginia, where activists have said they wish to enact similar legislation to that adopted in Arizona. A federal judge has blocked key provisions of the Arizona law, including a provision that requires law enforcement to inquire about immigration status of those they have a "reasonable suspicion" might be in the country illegally. Cuccinelli filed an amicus brief supporting Arizona's position over that state's law.

Cuccinelli's opinion was criticized by Claire Guthrie Gastanaga, a former chief deputy attorney general of Virginia and advocate for pro-immigration organizations.

"The Attorney General has done Virginians a disservice by crafting a result oriented 'activist judge' opinion that seeks to serve his personal political agenda rather than objectively interpret the law. The opinion closely tracks the advocacy position that the AG took in his amicus brief in the Arizona case -- a position rejected by the federal judge. The Attorney General's stance largely mirrors the position of advocates for organizations, like [the Federation of American Immigration Reform], seeking to reduce or prohibit all immigration," she said in a statement.

FAIR representatives have been working with Virginia activists who want to adopt a law mirroring Arizona's.

Arizona was once tolerant of illegal immigrants. What happened?
Analysts suggest it was a perfect storm of demographic shifts, a scary criminal element, the recession and a new governor.

Arizona has made a name for itself as the state with the harshest policies against illegal immigration. But as few as six years ago, this border state was among the nation's most welcoming of illegal immigrants.

Back then, its two Republican U.S. senators and one of its congressmen were among the strongest advocates of legalizing millions of illegal residents in the country. Mexico was the state's largest trading partner, and the governor boasted of her warm relationships with counterparts across the border. Both political parties courted the Latino vote.

Now the state government is fighting an order by a federal judge who last week stayed key parts of a law, SB 1070, designed to drive illegal immigrants from Arizona.

How did things change so quickly?

"The perfect storm occurred," said Mesa Mayor Scott Smith. "There was a combination of demographic changes, the introduction of a criminal element that didn't used to be here and the drop in the economy, which has put everyone on edge."

Now just about every prominent Republican here, including Sens. Jon Kyl and John McCain, backs SB 1070 and opposes legalization for illegal immigrants. Mexican governors refuse to set foot on Arizona soil. SB 1070 author Russell Pearce, a lawmaker formerly dismissed by many as an extremist, is poised to become president of the state Senate.

"The anger is palpable and measurable by candidates for office," said Stan Barnes, a former Republican state senator and veteran lobbyist. "Anyone who wants to hold elected office here will first be questioned on it."

The state captured the national spotlight in April, when Gov. Jan Brewer, a Republican, signed the law, which requires police to determine the status of anyone they lawfully stop and also suspect is an illegal immigrant. It also made it a state crime to lack immigration papers.

Brewer said it was necessary to protect residents against drug cartels that smuggle immigrants across Arizona's southern border. Civil rights groups alleged the law would lead to wide-scale racial profiling.

SB 1070 polls well in Arizona, winning approval ratings between 55% and 70%. It has garnered majority support in national polls too, and legislators in more than 20 states have vowed to introduce versions.

But SB 1070 wasn't Arizona's first legislative assault on illegal immigration. Since 2004, Arizona legislators have passed measures that restricted illegal immigrants from receiving in-state tuition, made English the official language and dissolved any business that repeatedly hired illegal immigrants.

At the same time, the Republican Party in Arizona has moved to the right on all sorts of issues. Susan Gerard, a former GOP state senator who also worked for former Democratic Gov. Janet Napolitano, was one of more than a dozen Republican moderates in the Legislature at the start of the decade. Now, she said, there are none.

"The Republican Party in Arizona, and really throughout the country, has taken giant leaps to the right," Gerard said.

About 8% of Arizona's population is made up of illegal immigrants, nearly all from Mexico, according to the Pew Hispanic Center. (Thirty percent of state residents are Latino.) Though the growth of that population has slowed somewhat in the last few years, the center estimates that about 500,000 illegal immigrants live in the state, up from about 90,000 in 1990.

The population increased after the federal government stepped up enforcement along the California border, slowing illegal crossings with more agents and a massive fence. That pushed traffic east — to the mountains and deserts of Arizona.

The boom in construction in Arizona also brought illegal immigrants, changing the makeup of cities and creating unease among longtime residents.

Smith, the mayor of Mesa, said the mostly conservative residents in his city started to express frustration with the number of day laborers, with the amount of Spanish being spoken and with immigrants working jobs traditionally held by high school students at fast-food restaurants and elsewhere.

"You have whole neighborhoods that have transitioned into primarily Hispanic," Smith said. "Whether right or wrong, people saw things were changing."

There is also widespread fear of crime coming to the state from Mexico, especially as a drug war rages to the south. Arizona has actually become safer since illegal immigrants started streaming in in the late 1990s. Phoenix is one of the safest cities in the nation, and crime has not increased along the border either.

Still, there has been a series of unnerving incidents not reflected in the statistics — gun battles between drug cartels on the interstates, "drop houses" in Phoenix where traffickers hold undocumented migrants for ransom and, in March, the slaying of rancher Robert Krentz on his property in southern Arizona. Footprints from the scene led across the border to Mexico.

The smuggling-related incidents coincided with an economic decline that fueled anger among native-born Arizonans. "Historically, illegal immigration always comes up as an issue when the economy starts to tank," said Lisa Magana, a political science professor at Arizona State University.

But one factor influencing the state in profound ways was President Obama's decision to name Napolitano his secretary of Homeland Security.

Barnes, the Republican lobbyist, said the popular Democratic governor had "a dampening effect on activism on illegal immigration issues." But in January 2009, Brewer, who had been secretary of state, succeeded Napolitano.

"If Janet Napolitano were still governor, 1070 would not be law," Barnes said. "Because she's not governor and Jan Brewer is governor, 1070 is law, and now the earthquake is being felt nationwide and worldwide."

Indeed, Pearce, who could not be reached for comment, had pushed measures similar to SB 1070 as far back as 2004. Napolitano vetoed those efforts.

Another lawmaker's bills, designed to ban a Mexican American studies program in the Tucson school system, had also failed. But this year Brewer signed such a bill into law.

Pearce, meanwhile, is proposing more legislation — to prevent the U.S.-born children of illegal immigrants from becoming citizens and checking the immigration status of parents of children in public schools.

Amnesty is on the horizon. Open and transparent government be damned—full speed ahead. Barack Obama is throwing overboard his commitment to “an unprecedented level of openness in Government” as he pursues his ultimate goal of “fundamentally transforming the United States of America.”

An internal draft memo to Alejandro N. Mayorkas, director of the U.S. Citizenship and Immigration Services (USCIS), from four staff members advises him that the USCIS, under certain provisions of the “Immigration and Nationality Act,” may, among other remedies, “develop and implement a registration program for individuals who are unlawfully present in the U.S.”

Call me a cock-eyed cynic, but I’d bet the boat that their “registration program” includes registering the “individuals” as Democrats.
National Review posted the memo on its web site Thursday in conjunction with an article by Robert VerBruggen. According to VerBruggen:
“In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security head Janet Napolitano. “Since the senators first wrote to the president more than a month ago, we have not been reassured that the plans are just rumors, and we have every reason to believe that the memo is legitimate,” a Grassley spokesman tells NR. (NR contacted DHS, but a spokesman did not have a comment on the record.)”
Obama’s four oarsmen at USCIS call their proposed agency course correction “administrative relief options” to accomplish “meaningful immigration reform without legislation.” Think of it as transforming the U.S. into a nation of men and not laws.
Article I of the U.S. Constitution calls it legislating without a license. Followers of the Constitution can see it as amnesty by a closed and dictatorial executive branch that treats the Constitution as an obsolete opinion.
Current federal law enacted by Congress, otherwise known as the legislative branch of government, prohibits “registration” of “illegal entrants” who are “present” in the United States. Title 8 U.S.C. Sec. 1182(a)(6)(A)(i) addresses “classes of aliens ineligible for visas or admission.” It states:
“In general an alien present in the United States without being admitted or paroled, or who arrives in the United States at any time or place other than as designated by the Attorney General, is inadmissible.”
The last time we checked, the Attorney General hadn’t “designated” holes in the fence or tunnels between Mexico and the U.S. as ports of entry. But who can keep up with Eric Holder’s latest frivolities? He’s been preoccupied suing Arizona for doing the feds’ immigration enforcement job.
Making the “inadmissible” “admissible” without validly enacted law is not the job of USCIS. It’s for a job for Congress to do, if its members are sufficiently self-destructive to ignore the will of a majority of Americans.
According to Rasmussen Reports, July 30, 2010, “66% of Mainstream voters want individual states to enforce immigration law.” According to NumbersUSA.com: “Recent polls reveal that 62% favor better control of the borders over amnesty and even 45% of liberals oppose amnesty.”
Taking note of public opinion is probably why the USCIS course-correctors admit that their “administrative alternatives” “would likely be controversial, not to mention expensive.”
After the memo was disclosed, USCIS issued a no comment “comment” in response to the leaked memo.
Internal draft memos do not and should not be equated with official action or policy of the Department. We will not comment on notional, pre-decisional memos. As a matter of good government, U.S. Citizenship and Immigration Services (USCIS) will discuss just about every issue that comes within the purview of the immigration system. We continue to maintain that comprehensive bipartisan legislation, coupled with smart, effective enforcement, is the only solution to our nation’s immigration challenges.
Internal memoranda help us do the thinking that leads to important changes; some of them are adopted and others are rejected. Our goal is to implement policies wisely and well to strengthen all aspects of our mission. The choices we have made so far have strengthened both the enforcement and services sides of USCIS — nobody should mistake deliberation and exchange of ideas for final decisions. To be clear, DHS will not grant deferred action or humanitarian parole to the nation’s entire illegal immigrant population.
Rest assured Americans, we haven’t caught them with their course set for Amnestyville, yet. They’re still just a bunch of thinkers bouncing some ideas off the asylum walls.
Did you catch the pregnant admission? They “will not grant deferred action or humanitarian parole to the nation’s entire illegal immigrant population.” That would be sooo transparent.
Just a few thousand here and a few million there, unless Congress takes control of the legislative helm and the President begins obeying the Constitution instead of flouting it.

Thoughts on the LA RAZA Invasion
We know Dick Lamm as the former Governor of Colorado. In that context his thoughts are particularly poignant. Last week there was an immigration overpopulation conference in Washington, DC, filled to capacity by many of America's finest minds and leaders. A brilliant college professor by the name of Victor Hansen Davis talked about his latest book, "Mexifornia," explaining how immigration - both legal and illegal was destroying the entire state of California. He said it would march across the country until it destroyed all vestiges of The American Dream.

Moments later, former Colorado Governor Richard D. Lamm stood up and gave a stunning speech on how to destroy America. The audience sat spellbound as he described eight methods for the destruction of the United States. He said, "If you believe that America is too smug, too self-satisfied, too rich, then let's destroy! America. It is not that hard to do. No nation in history has survived the ravages of time. Arnold Toynbee observed that all great civilizations rise and fall and that 'An autopsy of history would show that all great nations commit suicide.'"

"Here is how they do it," Lamm said: "First, to destroy America, turn America into a bilingual or multi-lingual and bicultural country." History shows that no nation can survive the tension, conflict, and antagonism of two or more competing languages and cultures. It is a blessing for an individual to be bilingual; however, it is a curse for a society to be bilingual. The historical scholar, Seymour Lipset, put it this way: "The histories of bilingual and bi-cultural societies that do not assimilate are histories of turmoil, tension, and
tragedy." Canada, Belgium, Malaysia, and Lebanon all face crises of national existence in which minorities press for autonomy, if not independence. Pakistan and Cyprus have divided. Nigeria suppressed an ethnic rebellion. France faces difficulties with Basques, Bretons, and Corsicans."

Lamm went on: Second, to destroy America, "Invent 'multiculturalism' and encourage immigrants to maintain their culture. I would make it an article of belief that all cultures are equal. That there are no cultural differences. I would make it an article of faith that the Black and Hispanic dropout rates are due solely to prejudice and
discrimination by the majority. Every other explanation is out of bounds.

Third, "We could make the United States an 'Hispanic Quebec' without much effort. The key is to celebrate diversity rather than unity. As Benjamin Schwarz said in the Atlantic Monthly recently: "The apparent success of our own multiethnic and multicultural experiment might have been achieved not by tolerance but by hegemony. Without the dominance that once dictated ethnocentricity and what it meant to be an American, we! are left with only tolerance and pluralism to hold us together." Lamm said, "I would encourage all immigrants to keep their own language and culture. I would replace the melting pot metaphor with the salad bowl metaphor. It is important to ensure that we have
various cultural subgroups living in America enforcing their differences rather than as Americans, emphasizing their similarities."

"Fourth, I would make our fastest growing demographic group the least educated. I would add a second underclass, unassimilated, undereducated, and antagonistic to our population. I would have this second underclass have a 50% dropout rate from high school."

"My fifth point for destroying America would be to get big foundations and business to give these efforts lots of money. I would invest in ethnic identity, and I would establish the cult of 'Victimology.' I would get all minorities to think that their lack of success was the fault of the majority. I would start a grievance industry blaming all
minority failure on the majority population."

"My sixth plan for America's downfall would include dual citizenship, and promote divided loyalties. I would celebrate diversity over unity. I would stress differences rather than similarities. Diverse people worldwide are mostly engaged in hating each other - that is, when they are not killing each other. A diverse, peaceful, or stable society is against most historical precedent. People undervalue the unity it takes to keep a nation together. Look at the ancient Greeks. The Greeks believed that they belonged to the same race; they possessed a common language and literature; and they worshipped the same gods. All Greece took part in the Olympic games. A common enemy, Persia, threatened their liberty. Yet all these bonds were not strong enough to overcome two factors: local patriotism and geographical conditions that nurtured political divisions. Greece fell. "E. Pluribus Unum" -- From many, one. In that historical reality, if we put the emphasis on the 'pluribus' instead of the 'Unum,' we will balkanize America as surely as Kosovo."

"Next to last, I would place all subjects off limits; make it taboo to talk about anything against the cult of 'diversity.' I would find a word similar to 'heretic' in the 16th century - that stopped discussion and paralyzed thinking. Words like 'racist' or 'xenophobe' halt discussion and debate. Having made America a bilingual/bicultural country, having established multi-culturism, having the large foundations fund the! doctrine of 'Victimology,' I would next make it impossible to enforce our immigration laws. I would develop a mantra: That because immigration has been good for America, it must always be good. I would make every individual immigrant symmetric and ignore the cumulative impact of millions of them."

In the last minute of his speech, Governor Lamm wiped his brow. Profound silence followed. Finally he said,. "Lastly, I would censor Victor Hanson Davis's book "Mexifornia." His book is dangerous. It exposes the plan to destroy America. If you feel America. deserves to be destroyed, don't read that book."

There was no applause. A chilling fear quietly rose like an ominous cloud above every attendee at the conference Every American in that room knew that everything Lamm enumerated was proceeding methodically, quietly, darkly, yet pervasively across the United States today.

Discussion is being suppressed. Over 100 languages are ripping the foundation of our educational system and national cohesiveness. Even barbaric cultures that practice female genital mutilation are growing as we celebrate 'diversity.' American jobs are vanishing into the Third World as corporations create a Third World in America - take note of California and other states - to date, ten million illegal aliens and growing fast. It is reminiscent of George Orwell's book "1984." In that story, three slogans are engraved in the Ministry of Truth building: "War is peace," "Freedom is slavery," and "Ignorance is strength."

Governor Lamm walked back to his seat. It dawned on everyone at the conference that our nation and the future of this great democracy is deeply in trouble and worsening fast. If we don't get this immigration monster stopped within three years, it will rage like a California wildfire and destroy everything in its path, especially The American Dream.

Banned: The American Flag on Cinco de Mayo

When 200 hispanic students skipped school last week and marched through downtown Morgan Hill, California chanting "Si se puede" intermixed with "We want respect," none were banned from school attendance on their return.
When five students, one of them an American from latino roots, wore American flags to school as a sign of patriotic speech, they were labeled incendiary. They were instructed to turn their shirts inside-out so as to cover up the American flag. And when they refused to surrender their first amendment right to expression, they were given unexcused absences.
Assistant Principal Miguel Rodriguez called the flag draped wardrobe "incendiary" because the students had chosen to worn them on May 5, popularly known as Cinco de Mayo. (A date that "celebrates" Mexico's defeat of the French in a single battle, in a war that Mexico eventually lost.)
The school's administration went further in claiming the five students were attempting "to start a fight" and "adding fuel to the fire."
Latino parents chimed in and chided the five students (one of which is of Mexican ethnic heritage) saying, "we're all offended by it."
One parent, Teresa Casillas, claimed her hispanic children were upset by the behavior of the boys wearing the flagged shirts, calling it disrespectful.
Yet for all the outcry, not an ounce of proof has erupted that the boys made any actions of provocation--except wear the shirts on Cinco De Mayo.
One of the more ignorant utterances by one of the hispanic student protestors summed up the stupidity best, "It's disrespectful to do it on Cinco de Mayo," said Jessica Cortez, a Live Oak sophomore. "They can be a patriot on some other day. Not that specific day."
And so this is what the argument has been reduced to.
I mean, you do understand don't you that Cinco de Mayo is not even celebrated en masse by Mexicans?
Yet the militant, belligerent, children of latinos living in Morgan Hill are exhibiting symptoms of a problem that is widespread. Raw naked entitlement that not only flouts the laws, but has now led to the limiting of the most legitimate expression whose freedom should always be protected: patriotism.
It was bad enough that the Obama administration went on a systematic campaign to discredit the recent right of the state of Arizona to reinforce federal guidelines for immigration. It was bad enough that the lies were widely told, and never retracted by news agencies that should have known better.

IT WAS WORSE WHEN TENS OF THOUSANDS OF ILLEGALS MARCHED ON DOWNTOWN STREETS WITHOUT ANY FEAR TO DEMAND SOCIALIZED REDISTRIBUTION OF RIGHTS TO THOSE WHO ARE NOT CITIZENS AND WHO DISRESPECT THE LAWS OF OUR NATION TO EVEN BOTHER THEMSELVES WITH TRYING TO CORRECT COURSE.

It was worse when tens of thousands of illegals marched on downtown streets without any fear to demand socialized redistribution of rights to those who are not citizens and who disrespect the laws of our nation to even bother themselves with trying to correct course.
Normally, I'm exceedingly compassionate to all people groups who wish to get to America. After all, if they wish to change their identity, support the values of our nation, and identify with the cause of what is true, just, and good, then they should in fact be ideal candidates for American citizenship.
Constantly we are told by media, and "immigration rights activists" (read that: open border apologists) that America is a big enough nation to be able to handle a significant increase in immigration. This is a notion I'm not totally in disagreement with.
Yet there is nothing unconstitutional, unlawful, immoral, or even unkind about asking those who come to politely walk to the end of the fence, be prepared to identify who they are, and state the lawful basis they have for coming through our border gate.
The actions of the 200 students of Morgan Hill marching on the streets of their village though repulsive in it's intent, is a constitutionally protected expression.
So were the actions of five students, one of whom is a child of hispanics, to wear American Flag shirts, shorts, caps, and sneakers if they so wish.
It may be the expression du jour to blame America for the ills of all that goes wrong in the world. Pardon me if I don't.
Principal Boden and Assistant Principal Rodriguez should be fired from Live Oak High School in Morgan Hill, California.
The school board could do so easily.
And if they needed to be politically correct about what they call it, merely label it a permanent unexcused absence.

Matters reached their Alice-in-Wonderland apotheosis when Sen. Dianne Feinstein of California was shown arguing that illegal immigrants are good . . . 'citizens.' Said Feinstein: "They pay taxes, their children are Americans, they go to schools, they're good citizens and they're needed." This was in line with the fait accompli argument advanced by La Raza representative Janet Murguia. She referred to what she estimated as the 11-12 million illegal aliens in the country as "people are working in backbreaking work that nobody else wants to do in this country. We need to . . . understand that they are already part of this country." "They're doing work others won't do" has become the mantra of pro-immigration advocates. Others, such as National Review's Rich Lowry, say that argument is is easily refuted on logical and economic grounds. The morning's other guest was CNN's Lou Dobbs. On outsourcing and trade, I find that Dobbs' populism verges on demagoguery. But here, he was, if you'll excuse the expression . . . en fuego. Guest host Campbell Brown acknowledged that Dobbs has made immigration his issue: "you own it." Dobbs: "You cannot reform immigration if you cannot control immigration. And you cannot control immigration unless you control and secure your own borders. The rest of this is obfuscation and sham." Dobbs denied Campbell's assertion that Congress is doing just that, addressing border security: "If you would like to tell me how they're doing it? They're adding no border patrol. I was talking to Gov. Bill Richardson of NM last night. He was promised 269 border patrolmen this year - he has seen none of them." When Campbell plumped for one of the guest-worker programs, Dobbs fired back: "The 'comprehensive solution' is utter nonsense. It's language that means nothing. The fact is that we don't know how many illegal immigrants are in this country. The estimates range from 11 million to 20 million. . . . [11 million] is being commonly used because it suits the convenience of the agendas of the various parties. Bear Stearns did a study last year in which they extrapolated as many as 20 million illegal immigrants. . . It means a shift of 6-10 congressional seats based on those numbers alone." Brown then let her true MSM colors show with a softball question to Murguia implying that opposition to illegal immigration is veiled racism: "What are the racial undertones to this debate for many people? Is that something that worries you?" Murguia was only too happy to be worried, alleging that there are "racial undertones, anti-ethnic overtones." That's when Dobbs got off perhaps his best line of the morning. "The National Council of La Raza is talking about race? La Raza - what does that mean? It means 'the race'!"

ZOGBY INTERNATIONAL POLL - 2002 MAJORITY OF MEXICAN POPULATION BELIEVES THE SOUTHWEST TERRITORY OF THE U.S. RIGHTFULLY BELONGS TO MEXICO! Americans and Mexicans have widely divergent views of border issues, according to a new poll by Zogby International.
Zogby found that a large majority of the Mexican population believes the southwest territory of the U.S. rightfully belongs to Mexico, and that Mexicans should have the right to enter the U.S. without first obtaining U.S. permission. By contrast, Zogby's survey of Americans conducted within a few days of the Mexican poll shows a large majority supports reducing immigration levels and wants the military deployed along the border to protect the U.S. from illegal immigration. Zogby's poll found that 58 percent of Mexicans agree with the statement, "the territory of the United States' Southwest rightfully belongs to Mexico." Only 28 percent disagree, and 14 percent are unsure. A similar majority, 57 percent, agree with the statement, "Mexicans should have the right to enter the U.S. without U.S. permission," while 35 percent disagree. Seven percent are unsure. The survey has a margin of error of 3.5 percent. The Mexico portion of the survey was conducted in Spanish between May 25 and May 26 among 801 adults chosen at random throughout Mexico. The poll was commissioned by Americans for Immigration Control, Inc. (AIC), which advocates increased restrictions on immigration. "There is obviously a large and significant gap between the attitudes of Americans and Mexicans," said Robert Goldsborough, AIC president. "While most Americans want immigration reduced, most Mexicans think they don't even need permission to enter our country. The poll clearly shows there is less common ground for immigration negotiations between Mexico and the U.S. than the leaders think. Support for a porous border and a loose migration policy occurs only on the Mexican side, not in the U.S." Zogby's survey of American attitudes found wide majorities of Americans also oppose amnesty for illegal aliens. The U.S. portion of the survey was conducted of 1,015 likely voters in the U.S. from May 28 to May 30. It found that 65 percent disagree with the statement, "foreigners residing illegally in the U.S. should be given amnesty." Just 26 percent of likely voters support amnesty for illegals, while 9 percent are unsure. A large majority, 58 percent, agree that the U.S. should "admit fewer immigrants each year." Only 6 percent want "more immigrants each year," and 30 percent want to "keep immigration at the current annual levels." The single largest majority in the entire poll was found among Americans supporting use of the military to guard the border. Fully 68 percent of those surveyed agree with the statement, "the U.S. should deploy military troops on the border as a temporary measure to help the U.S. Border Patrol curb illegal immigration." Only 28 percent disagree, and 3 percent are unsure.

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.
Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.

THE EXORBITANT FIGURE DOES NOT INCLUDE THE ENORMOUS COST OF EDUCATING, MEDICALLY TREATING, OR INCARCERATING ILLEGALS ALIENS. THIS COSTS THE COUNTY AN ADDITIONAL ONE BILLION DOLLARS.

The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars.
Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.
His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

With the recent ruling by US District Judge Susan Bolton, a Clinton appointee, blocking the most contentious parts of Arizona law SB1070, we learn two things: One, that the federal government cannot be forced to enforce federal law, regardless of the fact that the law has been brought to legislation by the constitutional process, and two, that today, opportunistic political ideologues who have schemed their ways to power have all but extinguished good government in the United States of America; government that should be exclusively engaged in serving the best interests of the American people.

To be fair, Judge Bolton’s ruling does not end the issue, not by a long shot. In fact, there is a very good chance that the case surrounding Arizona law SB1070 will make it – and in an expedited manner – to the US Supreme Court. This actually bodes well for the American citizen primarily because today the US Supreme Court has a balance that actually gives an edge – even if ever so slightly – to the US Constitution and, thus, the American people. Yes, we do have our “elected officials,” those we elect to office, to execute government and administer the services it has been authorized to provide, but, truth be told, once the political class gets “inside the beltway,” or within the confines of the many State Houses, they routinely abdicate their duty to their constituents and their responsibilities to the federal and state constitutions, only to take up the causes of their political parties and the cause of their political survival: re-election.

In reality, we have, on the one hand, a gaggle of professional politicians doing what’s best for the political class, special interests groups and like-minded ideologues and on the other a coven of political provocateurs who serve, exclusively, the agenda of their ideological addictions. Sequestered in the true minority of the halls of elected office are true citizen statesmen who champion the American philosophy while adhering to the limitations placed on government as set forth by the Framers of the United States Constitution.

This lopsided mix of professional politicians, political provocateurs and – in the minority – true statesmen, leaves the American citizenry with no effective constitutional government to execute the laws of the land. Unless executing the laws of the land serves the best interests of the professional politicians and political provocateurs, we are all – including the true statesmen – held hostage to the whim of a political class, corrupted by the illusion of power. We have seen the execution of this tyranny over government, not only in this administration, but in past administrations from both sides of the aisle, in the issues of entitlement programs, special interest group bailouts, the institutionalization of class warfare (in both a racial and financial context), and, more recently, the governmental encroachment into the healthcare insurance industry, the politically correct and self-enriching green energy movement, the Gulf oil spill response, immigration and border security.

With regard to the issue of Arizona’s SB1070, a letter writer to The Washington Times points out that Article I, Section 10 of the US Constitution states:

“No State shall, without the Consent of Congress...engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”

Of course, the answer, from a constitutional viewpoint – as well as a common sense viewpoint – is yes. But common sense and the US Constitution stand as casualties in the ideological and opportunistic “revolution” that Progressives and the professional politicians have waged against our nation. What we refer to as the federal government today, refuses to execute good government in order to protect the citizens of Arizona while using the full forces of the offices they have assumed to interfere with the Arizona government’s attempts to safeguard its own citizenry; a right reserved for each and every state government in the US Constitution and the many state constitutions.

When elections empower men with the ability to selectively enforce laws, our nation has ceased operating as a Constitutional Republic. When elections empower ideologues and provocateurs to pit citizen against citizen through the divisive and destructive employment of race-based politics, we have ceased to be a government of the people, by the people and for the people. When professional politicians can feed from the taxpayer-filled public trough until their greedy bellies burst, we have ceased being the home of the free and the champions of liberty.

And so we arrive at this brutally accurate reality; that our government is not a government of laws, as John Adams and the Framers insisted that it should be, but a government of men; corrupt, selfish and egotistical men. The political class in America has unwittingly facilitated the agenda of the Progressive movement in marching toward a Democratic Socialist system of government, where democracy – which each and every Framer and Founder warned against – is celebrated as the Constitutional Republican form of government falls victim to constitutional illiteracy.

This morning my wife, Nancy, a veracious defender of the Charters of Freedom and the American philosophy, opined in a most serious tone that our Constitutional Republic is today held captive by an Oligarchy. Even the most elementary understanding of our Charters of Freedom, the Constitutional Republican system of government and the many other systems of government prove her to be correct. We the People have allowed the many professional politicians and provocateurs to establish an Oligarchy in the United States of America; a shadow government of elitist ideologues who raid the treasury to bribe the elite and the narcissistic and apathetic alike, in order to maintain the illusion of power.

I keep using the term “illusion of power” because the power that the professional politicians and ideological provocateurs have over the American people is just that: an illusion. The true power lies with the American people through the power of the ballot. We still have the ability to expunge the professional politicians and ideological provocateurs from the seats of power, through the power of the vote. We still have the power to make our peace with the next generation by righting the wrong we have perpetrated on our country in allowing nefarious men and women to attain power; in allowing for the establishment of this Progressive and opportunistic Oligarchy that stands in place of our Constitutional Republican system of government. We can make it right. We have the power.

Many believe that the second American Revolution has already begun in the quest of this noble goal through the rise of a great awakening of the American people – the Tea Party movement. This movement is awakening the American citizenry to their constitutional obligation to provide educated and meaningful governmental oversight; to provide a proper stewardship for the Charters of Freedom so that we might pass the inalienable rights to Life, Liberty and the pursuit of Happiness to future generations. Truth be told, those average Americans who stand against the tyranny of today’s Oligarchs are – along with those who serve in the US military – the true patriots of our time.

In a soon to be released documentary addressing Black conservatism in America, titled, Runaway Slave, Pastor C.L. Bryant discusses the gifts of liberty and opportunity; gifts guaranteed in the Charters of Freedom to all men and women. He also talks about the slavery that tyranny affords; tyranny employed by today’s Oligarchs, professional politicians and provocateurs. Pastor Bryant is quoted as saying:

In Mexico's Nuevo Laredo, drug cartels dictate media coverage

NUEVO LAREDO, MEXICO -- Two weeks ago, Mexican soldiers clashed here with drug cartel gangsters in running gun battles that lasted five hours. The outlaws hijacked vehicles, including a bus, for use as barricades and battering rams. Terrified residents scrambled for safety. At least a dozen people were killed, including bystanders. Children were wounded in the crossfire.
Not a single word about it appeared in the local news media.
Nuevo Laredo has three television news channels, four daily newspapers and at least five radio stations that broadcast news, but every outlet ignored the biggest story of the year. Nuevo Laredo is not an isolated village but the busiest city along the U.S.-Mexico border, a vital U.S. trade partner with a population of 360,000, professional sports teams, universities and an international airport.
Fearing for their lives and the safety of their families, journalists are adhering to a near-complete news blackout, under strict orders of drug smuggling organizations and their enforcers, who dictate -- via daily telephone calls, e-mails and news releases -- what can and cannot be printed or aired.
"We are under their complete control," said a veteran reporter, who spoke on the condition of anonymity. Editors and managers of news organizations who agreed to speak with The Washington Post insisted that the interviews take place away from their offices, at back tables in empty bars. "The cartels have eyes and ears inside our company," one editor said.
On Friday night, assailants tossed a grenade at the front door of the Televisa affiliate in Nuevo Laredo. The blast shattered windows but caused no injuries. The television station did not report on the attack, and neither did its competitors.
In the 400-mile arc along the South Texas border, millions of Mexicans live without news of the spectacular violence swirling around them.
"The chaos, the disintegration we are seeing in the Mexican media as the drug war continues is without precedent," said Rosental Alves, director of the Knight Center for Journalism in the Americas at the University of Texas at Austin.
Information war
The news blackout extends to government officials. In Nuevo Laredo, the mayor mysteriously disappears for days and refuses to discuss drug violence. The military general who presides over the soldiers patrolling the city does not hold news conferences, issue statements or answer questions from the media. Neither do local representatives of the federal police and prosecutors.
"Intimidation and coercion have been taken to an extreme level. This drug war is also a war of information. The cartels are now telling reporters what they can and cannot print, and the drug organizations themselves are the content providers," said Carlos Lauria, the Latin America director of the Committee to Protect Journalists. "The Mexican government cannot lose this fight over information. It is at the very center of democracy."
Lauria said Mexico is one of the most dangerous countries for a reporter to work in. More than 30 journalists have been killed or have disappeared since President Felipe Calderón launched his U.S.-backed offensive against organized crime in December 2006. More than 25,000 Mexicans have died.
Last Monday, four journalists were kidnapped after they covered a protest at a penitentiary where the warden allegedly armed inmates and allowed them to leave the prison at night to carry out assassinations, including a massacre last month of 17 young people attending a party in a nearby town.
In its newspaper Wednesday, the Milenio news organization reported that its abducted cameraman contacted his editor Monday evening and said the lives of the kidnapped journalists depended on the television station broadcasting raw video posted on a Web site called Blog del Narco, which showed masked gunmen interrogating local police officers. The national news network broadcast the three unedited videos.
Milenio said the kidnappers "were unhappy with our coverage" about the prison. The federal police chief said Saturday that the journalists were snatched under orders of Joaquín "El Chapo" Guzmán, leader of the Sinaloa cartel. The four have been released.
After the gun battles two weeks ago, the U.S. Consulate in Nuevo Laredo warned Americans in the city to remain indoors. Authorities at the Interior Ministry in faraway Mexico City later issued a statement saying 12 people were killed: nine suspects, two civilians and one soldier. Twenty-one people, including three children, were wounded, authorities said.
But journalists in Nuevo Laredo who went to the scene of the street battles said that 20 or 30, possibly more, people might have been killed but that they had no way to check. The ordinary work of reporters in conflict zones -- going to the hospital and morgue, attending funerals, talking with widows -- is impossible in Nuevo Laredo. Witnesses told reporters that Mexican soldiers shot gang members lying wounded on the ground, but this could not be confirmed.
"We live in a world of rumors now," said Emilio Girón Fernández Jáuregui, president of the Nuevo Laredo Chamber of Commerce. His wife and daughter sort through Facebook and Twitter feeds for information about which routes are safe and where gunfire is occurring, but Fernández said many of the postings are pranks, or worse, "designed to increase the fear, the panic."

After ignoring the story about the gun battles, the newspaper La Tarde printed gruesome photographs on its front page of four bodies left at the city's bull ring July 25. Alongside the corpses were their executed pets, a small brown dog draped on one man's bloody chest, a white cat in the hand of another.
Rambling placards, called "narco-messages," left with the bodies tied one of the dead to a grenade attack that killed one and injured more than a dozen at a soccer field.
Journalists in Nuevo Laredo and other cities under siege say crime reporters typically receive word from colleagues and intermediaries, who they suspect are employed by the cartels, about what is safe to publish and what is not. Until recently, Nuevo Laredo and surrounding cities were relatively calm compared with other parts of Mexico, but war has broken out here between the Gulf cartel and its former enforcers, the Zetas, as they vie for the billion-dollar smuggling routes into the United States, the world's largest consumer of illegal drugs.
"They are very vicious, these Zetas, and there are times when there's an official Zeta press release, an e-mail or a sheet of paper, that they want published," said Diana Fuentes, editor of the Laredo Morning Times in Texas, whose reporters work in Mexico. "The criminal organizations have their representatives in the press."
In the absence of professional news gathering, citizens post on Twitter and Facebook, but these efforts have quickly become corrupted, as users spread rumors and lies, along with solid information. "Please confirm!" begs a tweeter about news of a gunfight that turned out to be the grenade attack at the Televisa station. "Is it safe or not?!?!"

Border Deployment Will Take Weeks

SAN DIEGO — No boots were seen tromping in the desert sand on Sunday. No commanders were heard barking out orders to their troops. The National Guard, which officials had announced would turn out en masse along the United States-Mexico border over the weekend for sentry duty, was nowhere to be found.
(WE’RE TOO BUSY FIGHTING OVER THERE TO PROTECT BIG BUSH SAUDI INTERESTS AGAINST SADDAM AND CAN’T EVEN PROTECT OUR OWN BORDERS!!!)
It turns out it will take weeks longer to select, screen and train the 1,200 National Guard troops the Obama administration had said would be deployed on Aug. 1 along the border from California to Texas.
Administration officials explained that the announced date was always a starting point, the beginning of the process of deployment and not the day camouflaged soldiers would begin amassing at the boundary line with their automatic weapons, high-powered binoculars and filled-up canteens. As a sign that things have gotten under way, Jack Harrison, a National Guard spokesman, said Sunday night that about 140 troops have begun working in recent weeks on the "command and control" of the mission.
“Full deployment will take place over succeeding weeks,” Janet Napolitano, the secretary of homeland security, said in an interview. “It won’t be 100 percent showing up all of a sudden.”

Once they arrive in the weeks and months to come, the troops will do what the thousands deployed during the Bush administration did: aid Border Patrol agents but not carry out direct law enforcement functions, Gen. Craig McKinley, chief of the National Guard Bureau at the Pentagon, said at a recent briefing. Instead of capturing migrants and traffickers, the troops will serve as lookouts, assess intelligence and carry out other support roles, General McKinley said. They will join several hundred National Guard troops already there helping to stop drug trafficking.
Having the additional boots at the border — divvied up in Arizona, California, New Mexico and Texas — will free up the federal law enforcement officials who are focused on drugs and illegal immigration, Ms. Napolitano said. The yearlong supplemental staffing will give the administration time to hire additional civilian personnel, she said.
Of course, there is a political dimension to the deployment, which comes as the Obama administration faces fierce criticism, particularly in Arizona, for not doing enough to seal off the borders from illegal immigrants and drug smugglers.
“It’s for show,” said Tony Payan, a political science professor at the University of Texas at El Paso who studies the border. “It’s the kind of climate we live in today, using war lingo, military jargon, using the National Guard, it seems like we’re being more effective, being serious. It sounds impressive, but it’s just 1,200 people.”
Doris Meissner, a fellow at the Migration Policy Institute and an immigration commissioner in the Clinton administration, said the number of border guards, no matter how high or which agency they belonged to, would never truly solve the problem of illegal immigration.
“During my time, 10,000 Border Patrol agents was considered the magic number,” she said. “Then it became 20,000. If it grew to 25,000 or 35,000 or even 50,000, that would be marginally better, no doubt. But illegal immigration is an economic issue. It’s a market phenomenon. Legislation that deals with the problem as a whole is the only real solution.”

Jay Ahern, former commissioner of Customs and Border Protection, said he was not surprised that Aug. 1 came without any visible troops.
“You don’t just turn a switch and have this happen overnight,” said Mr. Ahern, who was involved in Operation Jump Start, President George W. Bush’s deployment of thousands of National Guard troops to the border from 2006 to 2008. “And these are not going to be people visible at our points of entry. They will be in remote areas and in support roles.”

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.
