Labor Dept. Confirms: It Will Ensure Illegal Aliens Get Paid Legal Wages in U.S. Jobs

(CNSNews.com) - The U.S. Department of Labor told CNSNews.com in a written statement on Wednesday that it will enforce the federal wage laws on behalf of anyone working in the United States “regardless of their immigration status.” The statement was in response to a written question from CNSNews.com.

The written statement backed up a video statement that Labor Secretary Hilda Solis made to CNSNews.com on Monday in which she indicated that “partnership” agreements she had signed that day with a group of Latin American countries will obligate the U.S. government to protect the working conditions for both “documented and undocumented” migrant laborers here in the United States. (See earlier story [2].)

The Labor Department’s determination to make U.S. employers treat illegal aliens taking jobs in the United States as if they were U.S citizens or legal immigrants seems to contradict the Immigration and Nationality Act. That act says “employers may hire only persons who may legally work in the United States (i.e., citizens and nationals of the U.S.) and aliens authorized to work in the U.S.” and that the U.S. government “protects U.S. citizens and aliens authorized to accept employment in the U.S. from discrimination in hiring or discharge on the basis of national origin and citizenship status.”
After being unable to get a question into Solis or another Labor Department official during a conference call the Labor Department held with reporters on Wednesday, CNSNews.com followed up with a question sent to the Labor Department via e-mail.

The question was: “Will the Department of Labor enforce existing law under the Immigration and Nationality Act that says ‘employers may hire only persons who may legally work in the United States (i.e. citizens and nationals of the U.S.) and aliens authorized to work in the U.S.?’”

A Department of Labor official responded: “The WHD [Wage and Hour Division] administers and enforces the law for all workers employed in the United States, regardless of their immigration status.”

On Monday, Labor Secretary Solis had signed “partnerships” with Costa Rica, the Dominican Republic and El Salvador to protect the rights of “migrant” workers in the United States.

During the signing ceremony, Solis said, “No matter how you got here or how long you plan to stay, you have certain rights. You have the right to be safe and in a healthy workplace and the right to a legal wage. We gather here today to strengthen our shared commitment to protect the labor rights of migrant workers in the United States. Unfortunately, due to language barriers and immigration status, migrant workers can be those that are most vulnerably abused.”

After the signing ceremony, CNSNews.com asked Solis: “Both documented and undocumented workers will be protected under U.S. labor laws?”

“It has always been the case under previous Republican as well as Democratic administrations,” Solis answered. “All we’re doing is enforcing the law and we’re allowing for other individual groups and partnerships with other consulate offices to work with us in expanding our reach in information.

What we’re trying to avoid is that vulnerable communities be abused and that there be an increase in more underground activity, economic activity that goes untapped, those monies that are being paid to workers.”

Before signing the “partnerships” with Costa Rica, the Dominican Republic and El Salvador on Monday, Solis had already signed similar partnerships to with the governments of Mexico, Nicaragua and Guatemala to protect migrant workers in the U.S. from those countries. Solis indicated on Monday that she was also “pursuing accords with governments from South East Asia and others in the Caribbean.”

Labor Secretary Pledges Help For Illegal Workers

Two months after the Department of Labor launched a special program to assist and protect illegal immigrants in the U.S. the Obama cabinet official who heads the agency is personally encouraging undocumented workers to report employers that don’t pay them fairly.

In a Spanish-language public service announcement, Labor Secretary Hilda Solis assures that “every worker in America has a right to be paid fairly, whether documented or not.” Illegal aliens who are not getting fair wages are encouraged to call a new hotline set up by the agency on a new “Podemos Ayudar” (We Can Help) web page designed to administer worker protection laws and ensure that employees are properly paid “regardless of immigration status.”

In the short video, also posted in English, Solis tells illegal immigrants that it’s a “serious problem” when workers in this country are not paid fairly and that all workers have the right to receive their salary regardless of immigration status. She encourages those who are not to call the new hotline and assures it’s free and confidential. “Podemos ayudar,” (we can help), Solis guarantees at the end of the brief segment.

The Labor Secretary’s new message is part of a campaign launched a few months ago to help illegal immigrant workers in the U.S., who she refers to as “vulnerable” and “underpaid.” At least 1,000 new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees and the agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.
For a government agency to protect law breakers in this fashion may seem unbelievable but not if you consider the source. A Former California congresswoman, Solis has close ties to the influential La Raza movement that advocates open borders and rights for illegal immigrants. She made the protection of undocumented workers a major priority upon being named Labor Secretary, assuring illegal aliens that “if you work in this country, you are protected by our laws.”

Why the new jobs go to immigrants

Wall Street cheered and stock prices rose when the US Labor Department announced last Friday that employers had expanded their payrolls by 262,000 positions in February.
But it wasn't entirely good news. The statisticians also indicated that the share of the adult population holding jobs had slipped slightly from January to 62.3 percent. That's now two full percentage points below the level in the brief recession that began in March 2001.
Why the apparent contradiction? Reasons abound: population growth, rising retirements. But one factor that gets little attention is immigration.
In the past four years, the number of immigrants into the US, legal and illegal, has closely matched the number of new jobs. That suggests newcomers have, in effect, snapped up all of the new jobs.
"There has been no net job gain for natives," says Andrew Sum, an economist at Northeastern University.
In the US, President Bush calls for giving millions of illegal immigrants a kind of guest-worker status as a legal path to US citizenship. So far, no specific legislation to implement his suggestion has been put before Congress.
Meanwhile, US border patrols spend millions of dollars a year trying to keep illegals out. And yet, they keep coming, evidently little discouraged by recession or the 9/11 attacks. In the past four years alone, the number of immigrants ran some 2.5 million to 3 million, of which about half were illegal.
They come for jobs, of course. And the Bush administration makes barely any effort to enforce current law. In 2003, a total of 13 employers were fined for hiring undocumented employees.
In fact, neither Republicans nor Democrats have promoted enforcement of immigration law prohibiting the hiring of illegal immigrants, says Mr. Sum, head of Northeastern's Center for Labor Market Studies.
What employers really want in many cases by hiring immigrants is to hold down wage costs, experts say.

A report about the work lives of recent Mexican immigrants in seven cities across the United States suggests that they typically traded jobs in Mexico for the prospect of work here, despite serious bouts of unemployment, job instability and poor wages.

The report, released Tuesday by the Pew Hispanic Center, was based on surveys of nearly 5,000 Mexicans, most of them here illegally.

Those surveyed were seeking identity documents at Mexican consulates in New York, Atlanta and Raleigh, N.C., where recent arrivals have gravitated toward construction, hotel and restaurant jobs, and in Dallas, Chicago, Los Angeles, and Fresno, Calif., where they have been more likely to work in agriculture and manufacturing.

Unlike the stereotype of jobless Mexicans heading north, most of the immigrants had been employed in Mexico, the report found.

Once in the United States, they soon found that their illegal status was no barrier to being hired here. And though the jobs they landed, typically with help from relatives, were often unstable and their median earnings only $300 a week, that was enough to keep drawing newcomers because wages here far exceeded those in Mexico.

"We're getting a peek at a segment of the U.S. labor force that is large, that is growing by illegal migration, and that is bringing an entirely new set of issues into the U.S. labor market," said Rakesh Kochhar, associate director for research at the Pew Hispanic Center and author of the study.

The report suggested that policies intended to reduce migration pressures by improving the Mexican economy would have to look beyond employment to wages and perceptions of opportunity.

The survey found that the most recent to arrive were more likely to have worked in construction or commerce, rather than agriculture, in Mexico. Only 5 percent had been unemployed there; they were "drawn not from the fringes, but from the heart of Mexico's labor force," the report said.

After a difficult transition in their first six months in the United States about 15 percent of the respondents said they did not work during that time the rate of unemployment plummeted, to an average of 5 percent.

But in one of the most striking findings, 38 percent reported an unemployment spell lasting a month or more in the previous year, regardless of their location, legal status or length of time in the United States.

"These are workers with no safety net," Mr. Kochhar said. "The long run implication is a generation of workers without health or pension benefits, without any meaningful asset accumulation."
On the other hand, Mr. Kochhar and Roberto Suro, director of the Pew Hispanic Center, said the flexibility of this work force was a boon to certain industries like home construction, an important part of the nation's economic growth since the last recession.

Among respondents to the survey, those who settled in Atlanta and Dallas were the best off, with 56 percent in each city receiving a weekly wage higher than the $300 a week median. The worst off were in Fresno, where more than half of the survey respondents worked in agriculture and 60 percent reported earning less than $300 a week. The lowest wages were reported by women, people who spoke little or no English, and those without identification.

To some scholars of immigration, the report underlines the lack of incentives for employers to turn to a guest worker program like the one proposed by President Bush because their needs are met cheaply by illegal workers and all without paperwork or long term commitment.
Guest workers might instead appeal to corporations like Wal Mart, the scholars said, where service jobs are now the target of union organizing drives.
"You can't plausibly argue that immigrant dominated sectors have a labor shortage," said Robert Courtney Smith, a sociologist and author of "Mexican New York: Transnational Lives of New Immigrants." Instead, he said, the report and evidence of falling wages among Mexican immigrants over time point to an oversupply of vulnerable workers competing with each other.
But Brendan Flanagan, a spokesman for the National Restaurant Association, which supports a guest worker program, disagreed. "In many places it is difficult to fill jobs with domestic workers," Mr. Flanagan said. "We've seen a simple lack of applicants, regardless of what wage is offered."
Although the survey, conducted from July 2004 to January 2005, was not random or weighted to represent all Mexican immigrants, it offers a close look at a usually elusive population.
Those surveyed were not questioned directly about their immigration status, but they were asked whether they had any photo identification issued by a government agency in the United States. Slightly more than half over all, and 75 percent in New York, said they did not.
The migration is part of a historic restructuring of the Mexican economy comparable to America's industrial revolution, said Kathleen Newland, director of the Migration Policy Institute, a research organization based in Washington.
The institute released its own report on Tuesday, arguing that border enforcement efforts have failed. Workplace enforcement, which has been neglected, would be a crucial part of making a guest worker program successful.
For now, Mexicans keep arriving illegally.
"It doesn't matter if it's winter," said Ricardo Cortes, 23, a construction worker waiting for a friend outside the Mexican consulate in New York on Tuesday. "People are still coming because there's no money over there."

Two enterprising Reuters reporters tracked down a few of the recently-fired illegal Chipotle restaurant workers who admitted that they committed identity theft and/or fraud to land a job at the fast-food chain. Since illegal employment and identity theft have been linked before, these confessions aren't surprising. What the fired workers told reporters next, however, is more newsworthy: Chipotle knew they were hiring illegal workers. Here's the money quote:


"Not only did some [illegal workers] get jobs with fake Social Security numbers and few questions about their immigration status, in some cases they actually told managers point-blank their papers were no good. And they often stayed on for years."

Chipotle denies the accusation, of course, but when Reuters asked Chipotle officials why they weren't mandating the use of E-Verify in all their restaurants, "[t]he company did not respond to the question." Hmmm....

With state revenues coming in below projections, huge cuts in public education loom in the US state of California, on top of billions already slashed last year.

The California state budget passed by a Democrat majority at the end of June and approved by the administration of Governor Jerry Brown cut billions of dollars from social spending, including $1.8 billion from higher education.

The budget created two tiers of additional cuts that would be triggered if estimated state revenues for the budgetary year are revised down in December. The first tier consists of $600 million in cuts to higher education and various social services. It will come into effect if revenues fall over $1 billion short. The second tier is up to $1.9 billion in cuts, with $1.5 billion from K-12 education, and is triggered if the budget is over $2 billion short.

The state’s revenues for July, the first month of the budgetary year, came in $539 million short. As a new economic downturn looms, it appears likely that both tiers of cuts will be triggered at the end of the year.

Spending for the community college system could be cut by $102 million, on top of the $400 million initially cut in this year’s budget and $129 million in delayed funding. The University of California (UC) and California State University (CSU) systems each received $650 million in cuts from the budget and will each lose $100 million more in the first tier of cuts.

The cuts implemented so far have been widely felt by teachers and students in the form of tuition hikes, program reductions, and furlough days. Over the past six years, the fees and tuition for the UC and CSU systems have risen dramatically. The precise amounts vary between different campuses, but at UC Davis, 2010 annual in-state tuition for undergraduates increased by over 25 percent, almost $3,000.

At the same time the UC system has seen an increase in the number of highly paid employees. The number of employees making over $218,000 per year increased by 12 percent in 2010, with 14 employees making over $1 million, up from 10 in 2009.

UC officials defended these raises, according to the San Francisco Chronicle, by pointing out that most of the large salaries come from private funding. However, this only highlights the declining role of public funding in the UC system and the close relations between university management and corporate executives.
Of the $22 billion annual UC budget, only 11 percent is paid by the state, with the rest coming from tuition and private funding sources. The “public” character of these institutions is now largely a fiction.
A similar phenomenon is occurring at the K-12 level. There is a two-pronged push to replace California’s public education system with charter schools. The first prong is the use of test-based measures to evaluate teachers and schools to ensure “accountability.” Any school that doesn’t perform can then be turned into a charter school. The second prong is the budget cuts, which make it impossible for schools to meet the new standards, let alone provide decent education.

The Obama administration has spearheaded such policies nation-wide: its Race to the Top Program caused a bidding war among states competing in a race to the bottom. California, having been one of the losing states in the competition, has developed variants of the same principle, like the “Parent Trigger” law, lobbied for by billionaire financier Eli Broad and other wealthy opponents of public education. The law allows a majority vote of parents with kids at a school to convert it into a charter school, a significant step on the path to privatization.

Since the beginning of the economic crisis in 2008, 30,000 teachers and 10,000 support staff have lost their jobs in California’s public schools. Class sizes have increased sharply, the school year has been shortened, “superfluous” programs like art and music have been cut, and teacher pay, benefits, and development opportunities have been slashed.

Schools that can’t find outside funding, either through serving a wealthy community or gaining corporate funding, are effectively doomed to failure and conversion into charter schools. Charter schools are not bound by the local school districts’ employment practices and are being used as a tool against teachers’ pay, benefits, and pensions.

According to charter school teachers contacted by the World Socialist Web Site—who wish to remain anonymous for fear of retaliation—long, unpaid hours outside of the classroom are regularly required. There is simply no significant support for new teachers. If they have trouble managing their classrooms they are given more work and written up if the situation doesn’t improve, eventually losing their jobs.

This stressful environment combined with lower pay explains the results of a recent study by UC Berkeley, which showed higher turnover rates in charter schools. Teachers in the Los Angeles area were three times more likely to leave their job each year if they worked at a charter school than if they worked in the Los Angeles Unified School District.

In spite of the generally poor working conditions, teachers’ unions like the United Teachers of Los Angeles (UTLA) and the California Teachers Association (CTA) have come out in support of charter schools to encourage “the use of different and innovative teaching methods.”

This anti-teacher stance flows from the unions’ reactionary role in state politics. They are completely opposed to any struggle against Governor Brown and the Democratic Party. In the last round of budget negotiations the unions supported a reactionary campaign by Brown to increase taxes largely on the poor, claiming that this was the only alternative to huge cuts.

In a flier released August 19, UTLA boasts that numerous teachers could be rehired “because of the furlough day agreement and financial sacrifice accepted by LAUSD employees.” The only reference to a struggle is the assurance that UTLA will “fight for the lowest possible number of furlough days.” In other words, they completely accept that their members will have to take effective pay cuts.
The CTA takes the same stance in practice but has learned to speak out of both sides of its mouth. Over the past year the CTA has maintained a section of their website entitled “Restore Tax Fairness” where they document the fact that poor Californians pay 11 percent of their household income in state taxes while the rich pay 7.8 percent.

The notable omission from this section is any mention that the CTA endorsed Brown’s proposed tax increases on the poor and significant new corporate tax breaks. Neither does the section include any program to “restore tax fairness.” When it comes down to action, the CTA stands firmly on the side of the corporations and the Democratic Party.

Students, teachers, and workers must oppose these attacks and wage a struggle against all their supporters, including the trade unions and the Democratic Party, one of the two parties of big business in California and nationally. A free, quality, education at all levels is one of many basic social rights that workers must fight for, on the basis of an independent socialist perspective.

Legislature in California Set to Pass a Dream Act

LOS ANGELES — The California Legislature is poised to pass a law that would allow illegal immigrants to receive state-financed aid for college. Known as the California Dream Act, the bill underscores the ways states are navigating their own way through controversial immigration issues, as the Obama administration has been unable to make headway on plans for an overhaul of immigration laws.

While the state law would do nothing to provide a path to citizenship for illegal immigrants, it would provide them with more education benefits than they have in any other state. Advocates of the legislation say it would also send a powerful message to President Obama and Congress, forcing them to reconcile a patchwork of state laws that contradict one another.

Gov. Jerry Brown, a Democrat, said during his campaign last fall that he would support such a law and signed legislation this summer that gave illegal immigrants access to privately financed state scholarships and other aid. While he has not publicly said that he would sign this second measure, Mr. Brown’s staff members have been working with legislators to amend the bill in order to trim some costs.

The Democratic-controlled Senate overwhelmingly approved the bill on Wednesday along a party-line vote. The amended bill is expected to pass the Democratic-controlled State Assembly in the next week.

Assemblyman Gil Cedillo of Los Angeles, the lead author of the bill, has persistently made an economic argument to convince his colleagues.

“We will soon have to replace one million workers who leave the work force,” Mr. Cedillo said. “Why would we cut ourselves off from students who have demonstrated since they got here that they have tremendous talent and resilience? This is a very smart decision for the state. It’s not necessarily popular or without controversy, but we have to get these students fully educated.”

The bill is particularly controversial at a time when the state is facing major budget problems and drastically cutting spending on higher education.

The legislation is expected to cost about $40 million, according to an analysis by the State Senate, about 1 percent of the state’s total $3.5 billion budget for college financial aid.

Assemblyman Tim Donnelly, a Republican who represents San Bernardino, said that he would try to organize a ballot referendum to overturn the legislation.

“The governor is coming to the folks and saying they need to pay more, and then he’s going to turn around and say we still have money to hand over to people who are in the country illegally,” Mr. Donnelly said. “That is absolutely wrong. We are saying to the world: ‘If you haven’t come to California yet illegally, come as soon you can.’ And we’re saying to the people who came legally: ‘You guys are idiots.’ ”

The law would allow illegal immigrants and out-of-state students who attended California high schools for three years or more to apply for the financial aid.

In 2001, the state passed a law allowing those same students to be eligible for in-state tuition. The University of California, California State University and community college systems now enroll roughly 40,000 such students, about 1 percent of the total enrollment.

Because they lack work visas, many of those students are still unable to secure jobs for which they may be qualified. Opponents of the state Dream Act argue that such legislation would only increase the number of college graduates without jobs.

But supporters contend that many students may get legal status while they are in school, because they have already applied for legal residency or citizenship, a process that can take decades. And they are holding out hope that the Obama administration and Congress will approve the federal Dream Act, which would give students who have graduated from college or served in the military a path to citizenship.

Ana Gomez, whose parents brought her from Mexico to the United States when she was 7 years old, graduated from the University of California, Los Angeles, in 2009 and said she was among the few in her group of friends who did not have to spend semesters away from campus to make more money to pay for tuition. Most of them relied on odd jobs that paid cash because they did not have work permits.

“People are really struggling to stay and make it through,” Ms. Gomez said. “Being able to attend and get in-state tuition is one thing, but then you have to find a way to pay for it, and it’s next to impossible. A lot of kids just get stuck in community college. This changes all of that.”

The legislation that Mr. Brown signed in July allowed illegal immigrants to apply for a pool of $80 million in state scholarships that are financed through private sources. The bill that passed Wednesday would allow them to also gain access to $40 million in grants and scholarships that are paid for by the state.

Ira Mehlman, a spokesman for the Federation for American Immigration Reform, which sued the state to overturn the law granting illegal immigrants in-state tuition, called the bill “a really stupid allocation of limited resources.”

“It certainly ranks up there as one of the most dramatic moves, but I leave it up the California Legislature to outdo themselves,” Mr. Mehlman said.

He added, “In every way possible the state is catering to illegal aliens even if it comes at the cost of other legal citizens.”

Although there has been vocal opposition to the bill, it has benefited from widespread support; the Los Angeles Chamber of Commerce, university presidents and agricultural leaders have all backed the legislation.

Former Gov. Arnold Schwarzenegger vetoed similar legislation three times while he was in office.
Public opinion on illegal immigrants has shifted sharply in the state over the last several years, said Dan Schnur, the director of the Jesse M. Unruh Institute of Politics at the University of Southern California.

“Five years ago, this was politically risky,” Mr. Schnur said. “Fifteen or 20 years ago, it would have been political suicide. But today, it is hard to see it having much of a political impact one way or another here.”

Acting quietly, below the radar of U.S. public opinion and without congressional approval, the Obama administration is implementing a key policy objective of the Security and Prosperity Partnership of North America, or SPP, to erase the border with Mexico and Canada.

The administration is acting under a State Department-declared policy initiative described in a March 23 fact sheet titled "United States-Mexico Partnership: A New Border Vision."

"Mexico and the United States have a shared interest in creating a 21st century border that promotes the security and prosperity of both countries," the State Department declared. "The U.S. and Mexican governments have launched a range of initiatives that challenge the traditional view of 'hold the line' and are developing a framework for a new vision of 21st century border management."

At the same time, CTV News in Canada has obtained a draft copy of a declaration between the U.S. and Canada entitled "Beyond the Border: A Shared Vision for Perimeter Security and Competitiveness," to be implemented by a newly created Canadian-U.S. "Beyond the Border Working Group."

The two documents strongly suggest the Obama administration is pursuing a stealth bureaucratic methodology to establish a common North American border around the continent, encompassing the U.S., Canada and Mexico, while simultaneously moving to erase the borders between the U.S. and Mexico as well as between the U.S. and Canada.

Under the Bush administration's SPP, the U.S., Mexico and Canada organized some 20 different "shadow government" bureaucratic working groups composed of agency heads and undersecretaries in the three nations. The groups span a wide range of policy areas, from e-commerce, to aviation policy, to borders and immigration, trilateral travel, transportation, energy, environment, food and agriculture, health and financial services.

WND has reported since 2006 that a blueprint published in 2005 by the Council on Foreign Relations entitled "Building a North America Community" called for the establishment of a common security perimeter around North America by 2010 to facilitate the free movement of people, trade and capital between the three nations of North America.

In his 2001 book, "Toward a North American Community," American University professor Robert Pastor, a co-chair of the CFR blue ribbon committee that authored "Building a North American Community," called for the creation of a North American Commission, a North American Parliament, and a North American Court on Trade and Investment.

The language of the documents declaring "A New Border Vision" with Mexico and Canada could easily have been lifted directly from the CFR report or Pastor's book.

The 2005 CFR report "Building a North American Community" called on page xvii of the Foreword for the "establishment by 2010 of a North American economic and security perimeter, the boundaries of which would be defined by a common external tariff and an outer security perimeter."
 
CTV News reported that the language of the draft agreement specified that "A New Border Vision" for the U.S. and Canada would involve "a perimeter approach to security, working together within, at, and away from the borders of our two countries in a way that supports economic competitiveness, job creation and prosperity, and in a partnership to enhance our security and accelerate the legitimate flow of people and goods between our two countries."

Similarly, the U.S. State Department fact sheet calling for "A New Border Vision" with Mexico specified five areas of "joint border management, co-responsibility for cross-border crime, and shared commitment to the efficient flow of legal commerce and travel," namely: enhancing public safety, securing flows of people and goods, expediting legitimate commerce and travel, engaging border communities, and setting policy.

Under "setting policy," the State Department fact sheet with Mexico called for achieving rapid policy change through "an agile inter-agency process within each country as well as a means by which both governments can easily coordinate at a bi-national level."

This provides additional support for the conclusion that the bureaucratic "working groups" established under SPP in the Bush administration will continue to operate under Obama administration.

CTV News reported that the draft declaration of "A New Border Vision" with Canada similarly also specified a cross-border policy agenda, including:

• An integrated cargo security strategy;

• A joint approach to port and border security and screening;

• Cross-border sharing of information between law enforcement agencies;

• A closer working relationship between the two militaries in the event of emergencies;

• A new level of collaboration on preventing and recovering from counter attacks.

Affirming the continuance of the working group process, the draft declaration with Canada specifies the U.S. and Canada "intend to address threats at the earliest point possible, including outside the perimeter of our two countries."

The origin of the SPP can be traced to a trilateral summit meeting in Waco, Texas, March 23, 2005, between President George W. Bush, then-Mexican President Vicente Fox and then-Canadian Prime Minister Paul Martin.

At the end of the Waco summit, the three leaders simply declared that the U.S., Mexico and Canada were now in the Security and Prosperity Partnership, without the signing of any international agreement between the three countries or the ratifying of any trilateral treaty by the U.S. Senate.
The SPP in the administration of President Bush appeared designed to replicate the steps taken in Europe over a 50-year period following the end of World War II to transform an economic agreement under the European Common Market into a full-fledged regional government, operating as the European Union, with its own currency, the euro, functioning as the sole legitimate currency in what has become known as "the eurozone."

The concern was that under the SPP, the North American Free Trade Agreement, or NAFTA, could evolve into a regional government, the North American Union, with a regional currency, the Amero, designed to replace the U.S. dollar, the Mexican peso and the Canadian dollar.
WND has reported analysts have believed the North American integration plan will proceed incrementally, largely below the radar, since the SPP was declared "dead" by one of its chief architects, American University Professor Robert A. Pastor, who for nearly 15 years has been a major proponent of building a "North American Community."

Obama’s budget and the rot of American capitalism

On Monday, the Obama administration released its proposed federal budget for fiscal year 2012. After committing trillions in federal bailouts to the banks and billionaires, the White House is demanding cuts that will devastate the working class, and particularly its poorest and most vulnerable sections.
The $1.1 trillion in cuts for the next decade proposed by the White House is to be only the starting point for further cuts, as spokesmen for both big business parties acknowledge. Senate Budget Chairman Kent Conrad, a Democrat, declared, “We’ve got to do substantially more than $1 trillion worth of deficit reduction in the next decade.” Republican House Speaker John Boehner said, “There’s no limit to the amount we’re willing to cut.”
Democrats and Republicans agree on gargantuan military spending, an uninterrupted flow of funds to the financial aristocracy, and continued tax breaks for corporate America and the wealthy. As a top White House official told the press at a background briefing on the budget, “The debate in Washington is not whether to cut or to spend. We both agree we should cut. The question is how we cut and what we cut.”
The Obama budget projects that the ten-year cumulative deficit will reach a staggering $10.4 trillion. By attempting to wring such vast sums from the hides of the population, the ruling elite is trying to set American society back to conditions not seen for generations.
Programs to be cut include not only those targeted by Obama and the Republicans in the current budget debate—home heating assistance, Pell Grants, WIC, Head Start, etc.—but the much larger entitlement programs, Social Security and Medicare, which will face cuts later in the budget process.
The social impact will be incalculable. As hundreds of thousands of people face the bitter cold of winter without heat and gas, Obama is proposing halving the grossly inadequate federal assistance that is available. As students graduate with record debt and no job prospects, the administration is proposing significant cuts in government aid. Such gross indifference to social distress is repeated in every sphere.
Significant cuts to Social Security and Medicare—which amount to denying America’s elderly their right to pensions and health care—would have an even broader impact.
Behind the “debate” in Washington and the media over the budget is a massive lie—the claim that the budget deficits are a product of excessive social spending. Obama’s budget director Jacob Lew summed up this grotesque falsification an op-ed column published in the New York Times February 6, under the headline, “The Easy Cuts Are Behind Us.” Lew claimed that the causes of the projected budget deficits were “decisions to make two large tax cuts without offsetting them and to create a Medicare prescription drug benefit without paying for it, combined with the effects of the recession…”
This list is notable for what it leaves out: the cost of two wars, in Afghanistan and Iraq, which runs into the trillions; and the bank bailouts, where more trillions in public funds were placed at the disposal of the financial aristocracy, with no questions asked. The military budget by itself accounts for the lion’s share of the ten-year deficit: more than $7 trillion of the projected $10 trillion.
Lew’s more fundamental omission, however, is the grotesque class inequality that pervades American society. The top one percent of the US population owns over one third of the country’s wealth. The greatest wealth, however, is concentrated in an even smaller layer. Indeed, the $1.1 trillion in proposed cuts—which will have a terrible impact on the lives of millions of people—is somewhat less than the combined wealth of only the 400 richest Americans.
The arguments presented by the ruling elite for the cuts are staggeringly hypocritical. As they drown in floods of cash, they insist that no money is available for workers’ most basic needs.
Workers must reject this argument out of hand. They are not responsible for the orgy of swindling and profiteering that produced the 2008 Wall Street crash and pushed the world economy into the deepest slump since the Great Depression. On the contrary, an essential feature of the speculative binge was that the share of national income received by workers has shrunk to the lowest level in nearly a century.

The revolutionary struggles in Egypt—in which protests and strikes of millions of workers and youth forced the resignation of a US-backed dictator that ruled the country for more than 30 years—point to the forms of struggle that will spread worldwide in the coming period. Mass unemployment, record inequality, and the corruption of the political system are common to Egypt and the United States, and are in fact universal. At the foundation of this system is the principle that economic life must be subordinated to private profit and the maintenance of the wealth of those who control the giant banks and corporations.
The working class can secure its interests only through the overturn of the capitalist system as a whole—that is, the reorganization of economic life to meet social need. In every aspect of its policies and of its social being, the ruling class itself makes the case for socialist revolution.

Report paints devastating portrait of conditions of US children

The Children’s Defense Fund (CDF) has released a report detailing the significant deterioration in the social conditions of children in the US since the onset of the recession. Focusing primarily on the years 2008-2010, “The State of America’s Children: 2011,” examines in depth the social calamity facing the youngest segment of society in all aspects of life.
These conditions are the result of a tremendous growth of social inequality, combined with a governmental assault on social programs in recent decades by politicians of both big-business parties. For society’s youngest members, this finds expression in the growth of poverty and hunger, attacks on education and welfare programs, and an increase in violence and abuse.
The CDF report presents stark indices in various areas of social life. To cite one example: infant mortality rates for minority children in the United States rank behind the overall infant mortality rates in countries such as Costa Rica and Thailand; low infant birth weight occurrences happen more often in the US than in Nigeria and Kazakhstan.
The report draws the conclusion that families “have become more fragile as jobs are lost, unemployment compensation has been reduced, public assistance and public health programs restrict access, housing foreclosures continue and affordable housing becomes scarcer.”
Poverty, income inequality, unemployment
The CDF report notes the tremendous growth of social inequality in America. Since the late 1970s, the incomes of the bottom 90 percent of the population have stagnated or declined, while the incomes of the top one percent in particular—the ultra-rich—have soared.
In 2008, the average income for the bottom 90 percent of US households was at its lowest level in more than a decade. In the face of this growth of poverty, however, income assistance programs have been slashed and are ill-equipped to deal with the serious rise in social need.
One in five children—or 15.5 million—officially lived in poverty in 2009. Almost half of these children, 6.9 million, live in conditions of extreme poverty, described as an annual income of less than half of the poverty level ($11,025 for a family of four).
Benefits provided by the federal block grant program TANF (Temporary Assistance to Needy Families) leave many poor families and children destitute. TANF, signed into law under the Democratic administration of Bill Clinton in 1997, replaced the federal Aid to Families with Dependent Children (AFDC) program, which was originally created as part of the New Deal in 1935.
Clinton’s pledge at the time that TANF would end “welfare as we know it” has been borne out in the form of increased poverty and suffering. According to the CDF report, in nearly two-thirds of US states, TANF benefits in 2009 were less than half the 1970 AFDC real dollar amount.
A recent Center for Budget and Policy Priorities (CBPP) report detailed the systematic erosion of the TANF program. Due to inflation, a person receiving benefits today can only purchase 58 percent of what he or she could when the program was first adopted.
The same CBPP report noted that since the onset of the 2008 recession the number of cases adopted by the program has been disproportionate to need. Whereas programs such as food stamps have increased caseloads by nearly 45 percent since 2007, TANF caseloads have risen by only about 10 percent in the same time period.
“The State of America’s Children” also shows that with general unemployment rates remaining high at more than 9 percent, youth are unemployed in record numbers. African-American youth ages 16-19 suffered the highest unemployment numbers at roughly 43 percent. Even this number is likely an underestimation, as many jobless young people go uncounted.
Child health and medical care
Among the 30 most industrially advanced countries, the United States finished second to last in terms of infant mortality rates, as well as in occurrences of low birth weight. Out of every 1,000 child births, an estimated 7 children die, a figure that places the US in the company of states in Eastern Europe with virtually collapsed economies.
Hunger and poor nutrition are cited as the leading causes of low birth weight and infant mortality. The effect this has on the quality of life for children is extensive, leading to mental defects and poor education performance, among other problems.
The unavailability of nutritious foods and/or the inability to purchase them have also led to record levels of overweight and obese children. Nearly a third of all US children are considered either overweight or obese. Black and Hispanic children ages 6 to 19 are nearly 26 percent more likely to be either overweight or obese than children overall.
The study shows that American Indian and Hispanic children are the most likely to be uninsured medically: 18.3 percent for American Indians, 17.5 for Hispanics. The concentration of these populations in Southwestern states like California and Texas cause these states to have the highest ratios of uninsured children.
Hunger and nutritional support
One in seven Americans receives food stamp benefits (SNAP). Three-quarters of these recipients are families with children. In 2009, an estimated 15.6 million children received food stamps each month, an increase of 65 percent in only a decade.
In 2010, nearly 32 million children received free or reduced price lunches through the National School Lunch Program. However, only one in nine poor children who participate in the lunch program during the school year is reached by the Summer Food Service Program.
Almost 9 million women and children participate in the Supplemental Nutrition Program for Women, Infants and Children (WIC). While the number of participants has increased by 800,000 since the start of the recession, this program is now targeted for cutbacks in state budgets across the country.
Access to quality childcare and education
About 70 percent of mothers with children under the age of six are in the workforce, but access to affordable, quality childcare and early childhood care is extremely limited. For example, in 33 states and Washington DC, the annual cost of center-based childcare for a four-year-old child is more than the annual cost of in-state tuition at a public four-year university.
Among the 30 countries studied by CDF, the US ranked 24th in overall educational achievement for 15-year-olds. One indication of the low premium government authorities place on the education of its young people is the following statistic: the US spends almost two and a half times as much per prisoner in prisons and jails across the country than per public school pupil.
Child abuse, violence and youth incarceration
According to the Children’s Defense Fund, a child is abused or neglected in America every 42 seconds, a further expression of the consequences of poverty and lack of social programs. An estimated 1,161 children enter foster care each day, remaining there for more than two years on average. In 2009, more than 29,000 youth aged out of foster care at age 18 or older.
Each night, an estimated 87,000 youth are housed in facilities ranging from community-based juvenile youth homes to long-term youth prisons. An additional 10,000 youth are in adult prisons or jails serving sentences or awaiting trial. Minority youth make up about two-thirds of the youth in the juvenile justice system.
The CDF report notes: “The 3,042 deaths of children and teens from gunfire in 2007 alone nearly equaled the total number of US combat deaths in Iraq through July 2011 (3,480).”
