Just over half, 54 percent, say it is important that they change to assimilate into society, yet about two-thirds, 66 percent, say Latinos should maintain their distinct culture.

For years, Brian Sandoval has been a rising Republican star, a trailblazer touted as a symbol of the party's increasing diversity.

Square-jawed and handsome, he was elected Nevada's first Latino attorney general, showcased at the 2004 Republican National Convention and appointed the state's first Latino federal judge.

Now, as the GOP nominee for governor, Sandoval has come to symbolize something else: a tension within the Republican Party between efforts to attract Latinos and actions that repel members of the nation's fastest-growing minority group.

Across the country, GOP candidates have vigorously supported Arizona's tough new immigration law and, in some cases, gone further by supporting a rewrite of the Constitution to deny citizenship to the U.S.-born children of those here illegally. (Sandoval opposes that effort.)

The tough talk has rallied conservatives and drawn support from independents and even some Democrats frustrated with the current patchwork of state and federal immigration laws.

But the stance has also alienated Latinos who feel they are once again being scapegoated by a party with a history of harsh rhetoric and a penchant for backing policies — making English the official language, denying public services to illegal immigrants — that many consider punitive.

"It's always the same thing," said Victor Chicas, 43, a Las Vegas restaurant worker and naturalized citizen, who came nearly 20 years ago from El Salvador. "Blame the immigrants."

When Sandoval, 47, left the bench last year and launched his gubernatorial bid, Otto Merida was an avid supporter. A Republican and head of the Las Vegas-based Latin Chamber of Commerce, Merida even wrote Sandoval a $500 check.

But Merida has since switched his allegiance, embracing Sandoval's Democratic opponent, Rory Reid. The reason: the Arizona law.

Battling for the GOP nomination, Sandoval endorsed the measure and came out against driver's licenses for illegal immigrants as part of a rightward shift that left Merida and other Latinos angry and confused. Reid opposes the law, which requires police to determine the status of people they stop and suspect are illegal immigrants.

"People are using this issue just to get votes," said Merida, who emphasized that he was speaking personally and not for the chamber. "They're dividing this country and creating friction at a time we need to be more united than ever."

Sandoval said some interpret the law differently than he does. "I see it as Arizona's effort to get its arms around a very extreme public safety problem and the inability of the federal government to secure the borders," he said.

"I've been very straightforward with everybody in this state with regard to my positions," Sandoval said, shrugging off the anger among some Latinos. "If I'm fortunate to be elected, I'll continue to work with the Hispanic community."

The political stakes are considerable, not just in Nevada but throughout the country. From 2000 to 2008, Latino registration grew 54% nationally and turnout rose 64%, according to America's Voice, an immigration advocacy group.

The concentration of Latino voters, who have trended more Democratic over the last several years, is also significant. Several states, including Nevada, Colorado and Arizona, have grown more competitive in presidential elections as the Latino population swelled. Texas, now solidly Republican, is expected to join that list over the next few years.

In the short-term, a hard line on immigration can be good politics. Sandoval knocked off a sitting governor in the GOP primary, the first time that happened in Nevada. (It helped that incumbent Jim Gibbons was greatly weakened by personal scandal.) Sandoval is a strong favorite to win in November. Arizona Gov. Jan Brewer, a Republican whose reelection chances had been considered iffy, cruised to her party's nomination after signing the Arizona bill into law. She, too, is favored in November.

"Short-term it's an obvious benefit because the vast majority in the country favor doing something," said Matthew Dowd, President Bush's chief strategist in his 2004 reelection campaign. "In their mind, the federal government has abdicated its responsibility on immigration and proven incompetent."

But Dowd, who has worked for years to broaden the GOP appeal to Latinos, worries about the longer-term consequences. "It could feed that already existing perception that Hispanics have of Republicans, that they're intolerant and insensitive," Dowd said.

The textbook case is California's Proposition 187, the 1994 measure that sought to deny public education and other benefits to illegal immigrants and helped boost Gov. Pete Wilson to reelection. A majority of Latinos initially supported the initiative. However, by the end of an angry campaign, more than 3 in 4 Latinos voted against the initiative, which was approved but later found unconstitutional.

More significantly, Latinos were politically energized as never before. Voter registration soared and their antagonism toward the GOP helped make California one of the most Democratic states in the country.

"I've always said Pete Wilson did more for our cause of getting Latinos to naturalize and vote than all of our efforts in the political-engagement world combined," said Arturo Vargas, head of the National Assn. of Latino Elected and Appointed Officials.

Some reject comparisons to Proposition 187, saying Democrats have their own problem with Latinos after promising and failing to deliver comprehensive immigration reform. An Associated Press- Univision poll released last month found just 43% of Latinos surveyed felt President Obama had adequately addressed their needs. (His 57% approval rating, however, was much better than among other groups.)

"Right now, the Republicans are being more negative than they should be," said Lionel Sosa, a GOP strategist in San Antonio. "But the Democrats are just sitting on their butts."

Here in Nevada, strategists for both parties see the Latino vote as crucial in the governor's race as well as in the contest between Senate Majority Leader Harry Reid, Rory's father, and Republican Sharron Angle, a former state legislator. Latinos are about 12% of the electorate.

Sandoval has taken to the Spanish-language airwaves to trumpet the historic nature of his candidacy. Otherwise, he says, his message is the same wherever he goes. "Latino voters have the same concerns as all the other voters in our state," he said. "They're concerned about education, they're concerned about working and jobs and diversifying our economy."

But some Latinos can't get past Sandoval's support for the Arizona law, which they say unfairly targets those with brown skin. (Sandoval said he would not try to enact such a law in Nevada because police tell him it is not needed.)

He compounded the upset with an off-air comment during an Univision interview, reportedly stating his children wouldn't be stopped by Arizona police because they "don't look Hispanic."

Sandoval says he does not recall making the remark, which was not broadcast, but nevertheless expressed his regrets. By then, however, the damage was done.

"A Latino person like that comes to get our vote? Why?" said Manny Barajas, 59, a waiter on the Las Vegas Strip. "As soon as he says that, to me he is dead."

Chicas, the server at a casino steakhouse, was more measured but no less adamant: "What we need is results, for someone to say, 'Here's a problem. How can we solve it?' Not to blame a specific group or race."

He plans to vote for Rory Reid.

Mexicans Say Amnesty Will Boost Illegal Immigration

If President Obama keeps his promise of giving the nation’s 12 million illegal aliens amnesty it will encourage more Mexicans to enter the United States, according to residents of the struggling Latin American country who are undoubtedly rooting for the commander-in-chief’s plan.
The majority of illegal immigrants in the U.S. are from Mexico therefore the president’s reprieve project will greatly affect that nation. Two-thirds of Mexicans say they know someone living in the United States and around one-third have an immediate member of their household or close relative living in the U.S.
A majority of those residing south of the border say legalizing their undocumented countrymen will inspire more Mexicans to head north, according to a recent survey conducted by an internationally known polling and market research company. A vast majority of Mexicans with a relative in the United States said a legalization program would make people they know more likely to go to America illegally.
The results of the survey were made public this week by a research organization dedicated to studying the economic, social, fiscal and demographic impacts of immigration in the U.S. It reveals that nearly one-third of Mexican residents (nearly 40 million people) would like to live in the U.S. and if there was an amnesty a large number would come illegally with the hope of qualifying for a future exoneration.
An amnesty, therefore, would stimulate more illegal immigration which is the last thing this country needs. Furthermore, rewarding those who have violated our nation’s laws with coveted U.S. residency and possibly citizenship demeans the system, especially for those who follow the appropriate steps to come lawfully.
It’s bad enough that U.S. taxpayers annually dish out billions of dollars to educate, medically treat and incarcerate illegal aliens who are, in many cases, depleting local governments. Los Angeles County alone spends more than $1 billion a year, including $48 million a month in welfare costs, to provide services for illegal aliens. The crisis is hardly limited to border states, which have traditionally been the most impacted. Georgia’s skyrocketing illegal population costs taxpayers nearly $2 billion a year.

Study: Illegal alien population may be as high as 38 million A new report finds the Homeland Security Department "grossly underestimates" the number of illegal aliens living in the U.S. Homeland Security's Office of Immigration Studies released a report August 31 that estimates the number of illegal aliens residing in the U.S. is between 8 and 12 million. But the group Californians for Population Stabilization, or CAPS, has unveiled a report estimating the illegal population is actually between 20 and 38 million. Four experts, all of whom contributed to the study prepared by CAPS, discussed their findings at a news conference at the National Press Club in Washington Wednesday. James Walsh, a former associate general counsel of the Immigration and Naturalization Service, said he is "appalled" that the Bush administration, lawyers on the Senate Judiciary Committee, and every Democratic presidential candidate, with the exception of Joe Biden, have no problem with sanctuary cities for illegal aliens. "Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. Walsh said his analysis indicating there are 38 million illegal aliens in the U.S. was calculated using the conservative estimate of three illegal immigrants entering the U.S. for each one apprehended. According to Walsh, "In the United States, immigration is in a state of anarchy -- not chaos, but anarchy."

Trying Times Ahead: The Prospect of 60 Million Californians

Recently, the California Department of Finance projected that there will be some 60 million people living in the state by 2050. At present there are 36 million. The numbers in themselves are frightening enough, but what I find terrifying is the bland assumption that a two-thirds increase in population is inevitable and that the main problem will be creating the infrastructure necessary to house, feed, educate, transport and govern all those people. To me, the main problem is how to keep them from showing up in the first place. Somehow the numbers in themselves don’t really suggest the sobering weight of this projection. To say that for every three Californians now there will be five in 2050 doesn’t capture the scale of change. If you said that for every three houses now there will be five in 2050, or for every three cars, ditto, you might be getting a little closer to the visceral feel of the thing. But when it comes to houses and cars, California is a land of loaves and fishes, always multiplying in the most unexpected ways. To live in the state is to live with unrelenting change, whether you like it or not, and it has been that way for decades. But this population increase will mean more than filling up San Bernardino, Riverside and Kern Counties and paving the entire midsection of the state and creating impromptu day-schools and conference centers in stopped traffic. We tend to talk about humans as if they were interchangeable — as if the Californian of 1957 were somehow equivalent to the Californian of 2007. But today’s Californian consumes far more, if you consider consumption in its broadest sense. Draw pictures of those two Californians to the scale of their consumption, and the present-day resident would dwarf his ancestor. There’s a chance that a mid-21st-century Californian will look back in horror at the enormous consumption footprint of someone living in the state right now. That sense of horror would be good news — a sign that the coming generations had taken to heart that the way we live now, even in its current dimensions, is unsustainable. The trouble, of course, is that a population projection like this one more or less takes it for granted that not much will have changed by 2050. Otherwise, there wouldn’t be 60 million people in the state. 60 million Californians by mid-century Riverside will become the second most populous county behind Los Angeles and Latinos the dominant ethnic group, study says.By Maria L. La Ganga and Sara LinTimes Staff Writers July 10, 2007 Over the next half-century, California's population will explode by nearly 75%, and Riverside will surpass its bigger neighbors to become the second most populous county after Los Angeles, according to state Department of Finance projections released Monday. California will near the 60-million mark in 2050, the study found, raising questions about how the state will look and function and where all the people and their cars will go. Dueling visions pit the iconic California building block of ranch house, big yard and two-car garage against more dense, high-rise development. But whether sprawl or skyscrapers win the day, the Golden State will probably be a far different and more complex place than it is today, as people live longer and Latinos become the dominant ethnic group, eclipsing all others combined. Some critics forecast disaster if gridlock and environmental impacts are not averted. Others see a possible economic boon, particularly for retailers and service industries with an eye on the state as a burgeoning market. "It's opportunity with baggage," said Jack Kyser, chief economist for the Los Angeles County Economic Development Corp., in "a country masquerading as a state." Other demographers argue that the huge population increase the state predicts will occur only if officials complete major improvements to roads and other public infrastructure. Without that investment, they say, some Californians would flee the state. If the finance department's calculations hold, California's population will rise from 34.1 million in 2000 to 59.5 million at the mid-century point, about the same number of people as Italy has today. And its projected growth rate in those 50 years will outstrip the national rate — nearly 75% compared with less than 50% projected by the federal government. That could translate to increased political clout in Washington, D.C. Southern California's population is projected to grow at a rate of more than 60%, according to the new state figures, reaching 31.6 million by mid-century. That's an increase of 12.1 million over just seven counties. L.A. County alone will top 13 million by 2050, an increase of almost 3.5 million residents. And Riverside County — long among the fastest-growing in the state — will triple in population to 4.7 million by mid-century. Riverside County will add 3.1 million people, according to the new state figures, eclipsing Orange and San Diego to become the second most populous in the state. With less expensive housing than the coast, Riverside County has grown by more than 472,000 residents since 2000, according to state estimates. USC Professor Genevieve Giuliano, an expert on land use and transportation, would probably agree. Such massive growth, if it occurs, she said, will require huge investment in the state's highways, schools, and energy and sewer systems at a "very formidable cost." If those things aren't built, Giuliano questioned whether the projected population increases will occur. "Sooner or later, the region will not be competitive and the growth is not going to happen," she said. If major problems like traffic congestion and housing costs aren't addressed, Giuliano warned, the middle class is going to exit California, leaving behind very high-income and very low-income residents. I.E. MILLIONS OF ILLITERATE MEXICANS. The Department of Finance releases long-term population projections every three years. Between the last two reports, number crunchers have taken a more detailed look at California's statistics and taken into account the likelihood that people will live longer, said chief demographer Mary Heim. The result? The latest numbers figure the state will be much more crowded than earlier estimates (by nearly 5 million) and that it will take a bit longer than previously thought for Latinos to become the majority of California's population: 2042, not 2038. 75% OF THE GROWTH WILL BE LATINO The figures show that the majority of California's growth will be in the Latino population, said Dowell Myers, a professor of urban planning and demography at USC, adding that "68% of the growth this decade will be Latino, 75% next and 80% after that." That should be a wake-up call for voting Californians, Myers said, pointing out a critical disparity. Though the state's growth is young and Latino, the majority of voters will be older and white — at least for the next decade. "The future of the state is Latino growth," Myers said. "We'd sure better invest in them and get them up to speed. Older white voters don't see it that way. Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Anchor Babies Grab One Quarter of Welfare Dollars in LA Co

The anchor baby scam has proven lucrative for illegal aliens in Los Angeles County, at considerable cost to our own poor and downtrodden legal citizenry.

The numbers show that more than $50 million in CalWORKS benefits and food stamps for January went to children born in the United States whose parents are in the country without documentation. This represents approximately 23 percent of the total benefits under the state welfare and food stamp programs, Antonovich said.

"When you add this to $350 million for public safety and nearly $500 million for health care, the total cost for illegal immigrants to county taxpayers far exceeds $1 billion a year -- not including the millions of dollars for education," Antonovich said.

I love children and I'm all for compassion -- smart, teach-them-to-fish compassion. But when laws, the Constitution, and enforcement allow illegal aliens (the operative word here being "illegal") to insinuate themselves into our nation and bleed us of our precious financial resources, then laws, the Constitution and enforcement need to be changed.

County Spends $600 Mil On Welfare For Illegal Immigrants

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.
Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.
The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars.
Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.
His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

Border Sweeps in North Reach Miles Into U.S.By NINA BERNSTEIN
ROCHESTER — The Lake Shore Limited runs between Chicago and New York City without crossing the Canadian border. But when it stops at Amtrak stations in western New York State, armed Border Patrol agents routinely board the train, question passengers about their citizenship and take away noncitizens who cannot produce satisfactory immigration papers.

“Are you a U.S. citizen?” agents asked one recent morning, moving through a Rochester-bound train full of dozing passengers at a station outside Buffalo. “What country were you born in?”

When the answer came back, “the U.S.,” they moved on. But Ruth Fernandez, 60, a naturalized citizen born in Ecuador, was asked for identification. And though she was only traveling home to New York City from her sister’s in Ohio, she had made sure to carry her American passport. On earlier trips, she said, agents had photographed her, and taken away a nervous Hispanic man.

He was one of hundreds of passengers taken to detention each year from domestic trains and buses along the nation’s northern border. The little-publicized transportation checks are the result of the Border Patrol’s growth since 9/11, fueled by Congressional antiterrorism spending and an expanding definition of border jurisdiction. In the Rochester area, where the border is miles away in the middle of Lake Ontario, the patrol arrested 2,788 passengers from October 2005 through last September.

The checks are “a vital component to our overall border security efforts” to prevent terrorism and illegal entry, said Rafael Lemaitre, a spokesman for United States Customs and Border Protection. He said that the patrol had jurisdiction to enforce immigration laws within 100 miles of the border, and that one mission was preventing smugglers and human traffickers from exploiting inland transit hubs.

The patrol says that answering agents’ questions is voluntary, part of a “consensual and nonintrusive conversation” Some passengers agree, though they are not told that they can keep silent. But others, from immigration lawyers and university officials to American-born travelers startled by an agent’s flashlight in their eyes, say the practice is coercive, unconstitutional and tainted by racial profiling.

The Lake Shore Limited route is a journey across the spectrum of public attitudes toward illegal immigrants — from cities where they have been accepted and often treated as future citizens, to places where they are seen as lawbreakers the federal government is doing too little to expel.

The journey also highlights conflicting enforcement policies. Immigration authorities, vowing to concentrate resources on deporting immigrants with serious criminal convictions, have recently been halting the deportation of students who were brought to the country as children without papers — a group the Obama administration favors for legalization.

But some of the same kinds of students are being jailed by the patrol, like a Taiwan-born Ph.D. candidate who had excelled in New York City public schools since age 11. Two days after he gave a paper on Chaucer at a conference in Chicago last year, he was taken from his train seat and strip-searched at a detention center in Batavia, N.Y., facing deportation for an expired visa.

For some, the patrol’s practices evoke the same fears as a new immigration law in Arizona — that anyone, anytime, can be interrogated without cause.

The federal government is authorized to do just that at places where people enter and leave the country, and at a “reasonable distance” from the border. But as the patrol expands and tries to raise falling arrest numbers, critics say, the concept of the border is becoming more fluid, eroding Constitutional limits on search and seizure. And unlike Arizona’s law, the change is happening without public debate.

“It’s turned into a police state on the northern border,” said Cary M. Jensen, director of international services for the University of Rochester, whose foreign students, scholars and parents have been questioned and jailed, often because the patrol did not recognize their legal status. “It’s essentially become an internal document check.”

Domestic transportation checks are not mentioned in a report on the northern border strategy that Customs and Border Protection delivered last year to Congress, which has more than doubled the patrol since 2006, to 2,212 agents, with plans to double it again soon. The data available suggests that such stops account for as many as half the reported 6,000 arrests a year.

In Rochester, the Border Patrol station opened in 2004, with four agents to screen passengers of a new ferry from Toronto. The ferry went bankrupt, but the unit has since grown tenfold; its agents have one of the highest arrest rates on the northern border — 1,040 people in the 2008 fiscal year, 95 percent of them from buses and trains — though officials say numbers have fallen as word of the patrols reached immigrant communities.

“Our mission is to defend the homeland, primarily against terrorists and terrorist weapons,” said Thomas Pocorobba Jr., the agent in charge of the Rochester station, one of 55 between Washington State and Maine. “We still do our traditional mission, which is to enforce the nation’s immigration laws.”

Legal scholars say the government’s border authority, which extends to fixed checkpoints intercepting cross-border traffic, cannot be broadly applied to roving patrols in a swath of territory. But such authority is not needed to ask questions if people can refuse to answer. The patrol does not track how many people decline, Mr. Pocorobba said.

Asked if agents could question people in Times Square, which like most of the nation’s population centers is within 100 miles of international waters, Mr. Pocorobba replied, “Technically, we can, but we don’t.” He added, “Our job is strictly cross-border.”

Lawyers challenging the stops in several deportation cases questioned the rationale that they were aimed at border traffic. Government data obtained in litigation shows that at least three-quarters of those arrested since 2006 had been in the country more than a year.

Though many Americans may welcome such arrests, the patrol’s costly expansion was based on a bipartisan consensus about border security, not interior enforcement to sweep up farmworkers and students, said Nancy Morawetz, who directs the immigration rights clinic at New York University.

One case she is challenging involves a Nassau County high school graduate taken from the Lake Shore Limited in Rochester in 2007. The government says the graduate, then 21, voluntarily produced a Guatemalan passport and could not prove she was in the country legally. A database later showed she had an expired visitor’s visa.

Unlike a criminal arrest, such detentions come with few due process protections. The woman was held at a county jail, then transferred across the country while her mother, a house cleaner, and a high school teacher tried to reach her. The woman first saw an immigration judge more than three weeks after her arrest. He halved the $10,000 bail set by the patrol, and she was eventually released at night at a rural Texas gas station.

“I was shocked,” said the teacher, Susanne Marcus, who said her former student had been awarded a $2,000 college scholarship.

Another challenge is pending in the 2009 train arrest of the Taiwan-born doctoral student, who had to answer the agent after being singled out for intense questioning because of his “Asian appearance,” he said. His account was corroborated in an affidavit filed this month by another passenger.

Similar complaints have been made by others, including a Chicago couple who encountered the patrol on a train to Poughkeepsie, N.Y., for the woman’s graduation from Vassar College.

“At least in Arizona, you have to be doing something wrong to be stopped,” said the woman, a citizen of Chinese-American descent who said her Mexican boyfriend was sleeping when an agent started questioning him. “Here, you’re sitting on the train asleep and if you don’t look like a U.S. citizen, it’s ‘Wake up!’ ”

Mr. Pocorobba denied that agents used racial profiling; the proof, he said, was that those arrested had come from 96 countries. Agents say they often act on suspicion, prompted by a passenger’s demeanor. Of those detained, most were in the country illegally — including the Mexican, 24, who admitted that he had sneaked across the southern border at 16 to find his father. Others were supposed to be carrying their papers, like a Pakistani college student detained for two weeks before authorities confirmed that he was a legal resident.

Some American-born passengers welcome the patrol. “It makes me feel safe,” volunteered Katie Miller, 34, who was riding Amtrak to New York from Ohio. “I don’t mind being monitored.”

To others, it evokes travel through the old Communist bloc. “I was actually woken up with a flashlight in my face,” recalled Mike Santomauro, 27, a law student who encountered the patrol in April, at 2 a.m. on a train in Rochester.

Across the aisle, he said, six agents grilled a student with a computer who had only an electronic version of his immigration documents. Through the window, Mr. Santomauro said, he could see three black passengers, standing with arms raised beside a Border Patrol van.

“As a citizen I’m offended,” he said. But he added, “To say I didn’t want to answer didn’t seem a viable option.”
