Long Beach gang member arrested in three cold-case murders

12:23 PM PST, January 7, 2011A Long Beach gang member newly released from prison in New York has been arrested by Long Beach police in connection with the murders of three people in 2001 and 2002, authorities said Friday.

Juan Pablo Camacho, 33, a Mexican immigrant, was arrested Dec. 29 in Plattsburgh, N.Y., by Long Beach police investigating the three cold-case murders. He was being held in New York, awaiting deportation to Mexico after serving a prison term on weapons and illegal immigration charges.

The hunt for Camacho began Oct. 14, 2001, when Long Beach police found Richard Murillo, 30, shot to death in an alley on Rose Avenue. About 8:45 p.m. that night, Carrie Waltier, 33, was found dead in the 10000 block of Pinehurst Street in South Gate.

Long Beach and L.A. County sheriff's homicide detectives quickly connected the cases and later learned the victims were a couple who had been together in the hours before their killings.

Detectives reconstructed the crime and determined Murillo had been shot and killed in the alley, but Waltier was abducted from Rose Avenue and shot to death in South Gate, where her body was dumped in the street. Physical evidence indicated that their killings were likely carried out by the same person. Investigators gathered evidence, including DNA from the scene, but eventually exhausted their leads. Advances in DNA testing and more funding for DNA work allowed detectives in 2008 to submit evidence from Waltier's murder to a private lab for testing.

The lab notified Long Beach police in October that they had obtained a positive match, which identified Camacho. As detectives sought to find Camacho, they tied him to a third killing on May 19, 2002.

In that incident, Long Beach police officers found Richard Graves, 32, shot to death in the 300 block of East Esther Street. Witnesses reported hearing gunshots moments before officers arrived.

The motives for the murders remained under investigation.

Detectives learned Camacho was in New York and secured arrest warrants to detain him upon his release from prison. He is being held in lieu of $3 million bail in Los Angeles County Jail, awaiting arraignment Jan. 12 on the three murders.

(CNSNews.com) - An assistant U.S. attorney told CNSNews.com that a federal judge will hear a criminal case later this month involving an offshoot of the Tijuana cartel that is believed to be setting up operations in the United States to recruit young Americans for drug trafficking.
The case shows that U.S. drug cartels are attempting to extend their operations into the United States.
Todd Robinson, the assistant U.S. attorney who will prosecute the alleged drug ring at the U.S. District Court of the Southern District of California, said he expects the federal judge who will hear the case on Jan. 26 to set a trial date on that day.
According to the 86-page indictment, Mexican drug cartels have rented apartments in the United States under a franchise scheme aimed at recruiting young Americans into their illicit activities, coordinating drug trafficking operations, as well as kidnapping and extortion on both sides of the southwest border.
The case to be heard stemmed from a long-term investigation dubbed “Operation Luz Verde” (green light), that began in November 2009. The probe was conducted by the multi-agency San Diego Cross Border Violence Task Force and it reportedly revealed state and federal crimes, including murder, kidnapping, firearms and drug trafficking.
Investigators used court-authorized wiretaps to capture 50,000 phone calls over a six-month period that led to a case against 43 suspects, including some Mexican police officers and top officials, such as Jesus Quinones Marquez, the director of International Liaison for the Baja California Attorney General’s Office.
In that position, Marquez is one of the primary Mexican liaison officials providing information to U.S. law enforcement officers. According to the investigation, Marquez used his position to provide the drug cartel Fernandez Sanchez Organization (FSO) with confidential law enforcement information. He also allegedly arranged the arrest of FSO rivals by Mexican authorities.
The Justice Department indictment was unsealed in late July 2010 and charges 43 defendants with taking part in a federal racketeering conspiracy (Title 18, U.S. Code, Section 1962(d)). In the complaint, the 43 alleged culprits are said to be members of the FSO, which is an offshoot of the Arellano-Felix drug trafficking ring based in Tijuana.
According to the complaint, FSO “is a transnational drug organization with integrated narcotics and enforcement operations in the United States and Mexico.”
It is described as a “powerful organization that controls drug distribution and other illegal activities in the U.S. and Mexico, and which has increasingly committed acts of violence in Tijuana, San Diego County, and the greater Los Angeles area to expand its influence.”
The hierarchy of command under the leadership of Fernando Sanchez Arellano is comprised of five distinct groups: lieutenants, underbosses, corrupt Mexican officials, crew leaders, and crew members.

According to the wiretaps and secret informants, the Fernando Sanchez Organization was operating out of a San Diego apartment it referred to as “The Office.”
The criminal complaint states that Mexican drug cartels are recruiting young Americans in an effort to keep their drug trafficking operations under the radar, including using young women as drug mules to cross from Mexico into the United States.
These “mules” allegedly were paid $100 per trip to smuggle quarter-pound loads of methamphetamine across the border.
The San Diego criminal enterprise also was recruiting members of U.S.-based Latino street gangs, both illegal immigrants and U.S. citizens, and former Mexican police officers, according to the indictment.
Most of the gang members operating in the San Diego office of the accused Mexican cartel are Latino, some illegal aliens and others U.S. citizens, according to the criminal complaint.
The investigation found that the criminal group had safe houses, distributed illicit drugs, trafficked in guns and other weapons, laundered money, committed robberies, and collected drug debts. When debtors failed to pay, they were kidnapped or targeted with execution on both sides of the southwest border.
In one instance, according to the investigation, the accused drug enterprise “placed the defaced headstone of two murder victims in the victims’ family courtyard with a threatening message” in an effort to publicize its enforcement capabilities.
During this investigation, the U.S. Department of Justice for the first time used communication towers on the U.S. side of the border to capture and monitor phone and radio communications used by Mexican drug cartels in the border area and thus were able to show that Mexican drug cartels are moving to expand their grasp into U.S. territory

Fed boss: it will take years for jobs to come back

Federal Reserve Chairman Ben Bernanke sketched a more optimistic view of the economy Friday but said the Fed's $600 billion bond-buying program is needed because unemployment will likely stay elevated for up to five more years.

Bernanke told the Senate Budget Committee that there's rising evidence that a "self-sustaining" recovery is taking hold. He said he expects stronger growth because consumers and businesses will boost spending this year.

Bernanke spoke an hour after the government released a disappointing employment report. Employers added only 103,000 jobs in December. The unemployment rate fell to 9.4 percent partly because people gave up looking for jobs. Many economists had forecast much bigger job gains and were looking for a signal that businesses were stepping up hiring.

Asked about December's 103,000 job gains, Bernanke said if the pace of hiring doesn't increase, "we're not going to see sustained declines in the unemployment rate."

The Fed chief defended the central bank's move to buy $600 billion in Treasurys through June and gave no hint that it would change its course. The bond purchases are designed to boost the economy by lowering interest rates, encouraging spending and lifting stock prices.

The program has been criticized by Republicans in Congress and some Fed officials who contend it will do little to help the economy and could hurt it by unleashing inflation and speculative buying on Wall Street. China, Germany and Brazil complained it was really a scheme to push down the value of the dollar, giving U.S. exporters a competitive edge.

The Fed chief said the threat of deflation -- a dangerous drop in prices, wages and in the values of homes and stocks -- and the potential for persistently high unemployment were sufficient reasons to launch the program.

Bernanke predicted that the overall pace of the economy will be "moderately stronger" this year. He said the Fed has seen "increased evidence that a self-sustaining recovery" is taking place.

Factories are cranking up production. The service sector is growing at its fastest pace in more than four years. Fewer people applied for unemployment benefits over the past month than in any other four-week period in more than two years.

Consumers are spending more freely, and a payroll tax cut is likely to boost their activity further. Tax cuts are also likely to lead businesses to expand and hire more.

But weakness in job growth could slow this momentum, Bernanke cautioned, especially if consumers spend less.

Bernanke said unemployment is likely to be around 8 percent two years from now.

Other threats to the economic outlook, Bernanke said, are:

-- A depressed housing market, where growth in foreclosures could push down home prices even more.

-- Deeper spending cuts and more layoffs from state and local governments.

-- Rising gasoline prices, which now top $3 a gallon.

Bernanke also argued for Congress and the White House to come up with a long-term plan to reduce the government's trillion-plus-dollar budget deficits. However, he warned them not to slash spending or boost taxes now because the economy is too fragile.

President Barack Obama's debt commission at the end of last year failed to reach a consensus on a deficit-reduction plan. Over the coming decade, government deficits are estimated in the $10 trillion range. If Congress fails to come up with a reduction plan, the economy could be hurt, Bernanke said. Big deficits could force investors to demand more returns on government loans and interest rates could soar.

Sen. Jeff Sessions of Alabama, the highest ranking Republican on the committee and a fiscal conservative, expressed concern that the Fed's bond-buying program could spur inflation. And he wondered whether the Fed was simply printing money to cover the nation's deficits.

Bernanke countered that the program won't expand the amount of money in circulation in a significant way because banks aren't lending the money.

It's not a situation "where the Fed is dumping money into the economy," he said.

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.
It is that policy alone which conflicts with SB 1070: Arizona wants to enforce the law; the Obama administration does not. Reasonable minds can differ on whether that conflict puts Arizona in violation of the Constitution's Supremacy Clause.
But what is indisputable is that the failure of the federal government to openly acknowledge the real ground for its opposition to SB 1070 has rendered incoherent not just its own public arguments against the law, but the judicial ruling which largely rubber stamps those arguments as well.
The Arizona statute affirms the power of a local police officer or sheriff's deputy to inquire into someone's immigration status, if the officer has reasonable suspicion that the person is in the country illegally, and if doing so is practicable. Under SB 1070, such an inquiry may occur only during a lawful stop to investigate a non-immigration offense.
Both the Justice Department and U.S. District Judge Susan Bolton, in striking down most of SB 1070, couched their opposition to the statute exclusively in terms of its effect on legal, as opposed to illegal, aliens. SB 1070, Judge Bolton wrote, would impermissibly burden legal immigrants already in the country by subjecting them to unwarranted immigration checks.
There are two problems with this line of argument: First, it ignores the fact that Congress has already anticipated and approved precisely the sort of local immigration inquiries that Judge Bolton now finds unconstitutional. Second, the argument would make all immigration enforcement impossible.
In 1996, Congress banned so-called sanctuary policies, by which cities and states prohibit their employees from working with federal immigration authorities regarding illegal aliens. It was in the federal interest, Congress declared, that local and federal authorities cooperate in the "apprehension, detention or removal of [illegal] aliens."
In pursuance of that mandate, the federal government operates an immigration clearinghouse, the Law Enforcement Support Center (LESC), to provide just the sort of immigration-status information to local and state law-enforcement officials that SB 1070 seeks.
It is therefore absurd to now claim, as Judge Bolton and the Obama Administration do, that such local inquiries conflict with the federal immigration scheme. It is even more absurd to argue that the risk that a legal alien will be questioned about his immigration status makes the alleged conflict unconstitutional.
Any immigration enforcement carries the possibility that a legal alien or U.S. citizen will be stopped and questioned. The only way to guarantee that legal aliens are never asked to present their immigration papers is to suspend immigration enforcement entirely. (The same possibility of stopping innocent people for questioning applies to law enforcement generally; that possibility has never been held to invalidate the police investigative power.)
If Congress intended to create such a blanket ban on asking legal aliens for proof of legal residency, it could have revoked the 1952 law requiring aliens to carry their certificate of alien registration. Such a requirement makes sense only on the assumption that legal aliens will upon occasion be asked to prove their legal status.
Such unpersuasive reasoning suggests that something else is going on. That something is the fact that SB 1070 would have put the Obama administration in the uncomfortable position of repeatedly telling Arizona's law enforcement officers that it is not interested in detaining or deporting the illegal aliens that they have encountered in the course of their duties; the law, in other words, would have exposed the administration's de facto amnesty policy.
And SB 1070 would have shown that immigration-law enforcement can work simply by creating a deterrent to illegal entry and presence. Even before it went into operation, the Arizona law was already inducing illegal aliens to leave the state, according to news reports.
Illegal aliens are virtually absent from the Justice Department's brief or from Judge Bolton's opinion. Despite this studied avoidance, it's time to have a public debate about how much immigration enforcement this country wants and which enforcement policies--the administration's or Arizona's -- best represent the public will.

Obama Administration Challenges Arizona E-Verify Law
The Obama administration has asked the Supreme Court to strike down a 2007 Arizona law that punishes employers who hire illegal aliens, a law enacted by then-Governor Janet Napolitano. (Solicitor General's Amicus Curiae Brief). Called the “Legal Arizona Workers Act,” the law requires all employers in Arizona to use E-Verify and provides that the business licenses of those who hire illegal workers shall be repealed. From the date of enactment, the Chamber of Commerce and other special interest groups have been trying to undo it, attacking it through a failed ballot initiative and also through a lawsuit. Now the Chamber is asking the United States Supreme Court to hear the case (Chamber of Commerce v. Candelaria), and the Obama Administration is weighing in against the law.
To date, Arizona’s E-Verify law has been upheld by all lower courts, including the Ninth Circuit Court of Appeals. The Ninth Circuit, in particular, viewed it as an exercise of a state’s traditional power to regulate businesses. (San Francisco Chronicle, June 2, 2010). Obama’s Justice Department, however, disagrees. Acting Solicitor General Neal Katyal said in his filing with the Supreme Court that the lower courts were wrong to uphold the statute because federal immigration law expressly preempts any state law imposing sanctions on employers hiring illegal immigrants. Mr. Katyal argues that this is not a licensing law, but “a statute that prohibits the hiring of unauthorized aliens and uses suspension and revocation of all state-issued licenses as its ultimate sanction.” (Solicitor General's Amicus Curiae Brief, p. 10). This is the administration’s first court challenge to a state’s authority to act against illegal immigration, and could be a preview of the battle brewing over Arizona’s recent illegal immigration crackdown through SB 1070.
Napolitano has made no comment on the Department of Justice’s decision to challenge the 2007 law, but federal officials said that she has taken an active part in the debate over whether to do so. (Politico, May 28, 2010). As Governor of Arizona, Napolitano said she believed the state law was valid and became a defendant in the many lawsuits against it. (Id.).

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Looking back over the last 10 years, it's hard not to feel as W.H. Auden did one dreary September day in 1939:



"I sit in one of the dives

On Fifty-second Street

Uncertain and afraid

As the clever hopes expire

Of a low dishonest decade."



Still, if we're looking for a literary progenitor for the era now past, it would not be Auden but Herman Melville's "The Confidence-Man," for these were the years of the great con and the sweeping swindle. From Bernie Ebbers and WorldCom to Jeff Skilling and the Enron boys, to Bernie Madoff's Ponzi scheme, to the bait-and-switch that Bush and Cheney used to take the country into war, this was the decade of deception.

No deceit was more malevolently corrosive than the fiction that this was a period of expansive prosperity in which significant numbers of our people were able to share in the American dream of financial security. All the triumphalist rhetoric emanating from Wall Street and the White House notwithstanding, this was -- materially speaking -- a disastrous decade for U.S. families.

For the first time since World War II, according to the departments of Commerce and Labor, an average American's net worth actually fell -- by a whopping 13%. By way of comparison, and to demonstrate just how anomalous such a decline is, consider that net worth grew 44% in the 1990s; 35% in the 1980s; 12% in the 1970s (even with the Carter administration's "stagflation"); 25% in the 1960s; and 26% in the 1950s.

The employment picture was no better. Though the U.S. population has grown by 35 million since 2000, employment has increased just 0.5% over the last 10 years. For the first time since the federal government began keeping such statistics, the number of private sector jobs actually declined. (In both the 1980s and 1990s, employment grew by 20%, and in the 1960s it climbed by 31%.)

Meanwhile, as the private sector's flight from its pension obligations became virtually general, tens of millions of Americans were compelled to trust their retirements to the equity markets through 401(k) accounts. It was a bonanza for Wall Street, which raked in commissions and fees, and a disaster for working families, because the decade ended without any gains in the stock averages.

A tiny minority of insiders and the privileged, on the other hand, did very well for themselves. According to economists Emmanuel Saez of Berkeley and Thomas Piketty of the Paris School of Economics, the highest-earning 0.1% of Americans accounted for 8.2% of the country's total pretax income. That's the highest concentration of wealth since 1917.

Former Clinton administration Secretary of Labor Robert Reich recently pointed out that all these factors combined to play a major, but largely unrecognized, role in the current financial crisis. Even though most American families had two working adults throughout the last decade, many had to borrow simply to maintain their standard of living. People maxed out their credit cards and tapped their home's equity -- something that proved catastrophic when the value of houses collapsed.

With incomes and employment stagnant, families had nowhere to turn. Not so employers. While most lacked the managerial creativity to grow their businesses, they found a way to keep profits up by laying off huge numbers of people and simply working those who remained -- too frightened to protest -- harder. That accounts for the striking productivity gains recorded over the past several quarters. The sputtering economic recovery now underway essentially is a 21st century version of the old-fashioned speedup.

Why the new jobs go to immigrants

Wall Street cheered and stock prices rose when the US Labor Department announced last Friday that employers had expanded their payrolls by 262,000 positions in February.
But it wasn't entirely good news. The statisticians also indicated that the share of the adult population holding jobs had slipped slightly from January to 62.3 percent. That's now two full percentage points below the level in the brief recession that began in March 2001.
Why the apparent contradiction? Reasons abound: population growth, rising retirements. But one factor that gets little attention is immigration.
In the past four years, the number of immigrants into the US, legal and illegal, has closely matched the number of new jobs. That suggests newcomers have, in effect, snapped up all of the new jobs.
"There has been no net job gain for natives," says Andrew Sum, an economist at Northeastern University.
In the US, President Bush calls for giving millions of illegal immigrants a kind of guest-worker status as a legal path to US citizenship. So far, no specific legislation to implement his suggestion has been put before Congress.
Meanwhile, US border patrols spend millions of dollars a year trying to keep illegals out. And yet, they keep coming, evidently little discouraged by recession or the 9/11 attacks. In the past four years alone, the number of immigrants ran some 2.5 million to 3 million, of which about half were illegal.
They come for jobs, of course. And the Bush administration makes barely any effort to enforce current law. In 2003, a total of 13 employers were fined for hiring undocumented employees.
In fact, neither Republicans nor Democrats have promoted enforcement of immigration law prohibiting the hiring of illegal immigrants, says Mr. Sum, head of Northeastern's Center for Labor Market Studies.
What employers really want in many cases by hiring immigrants is to hold down wage costs, experts say.

A report about the work lives of recent Mexican immigrants in seven cities across the United States suggests that they typically traded jobs in Mexico for the prospect of work here, despite serious bouts of unemployment, job instability and poor wages.
The report, released Tuesday by the Pew Hispanic Center, was based on surveys of nearly 5,000 Mexicans, most of them here illegally.
Those surveyed were seeking identity documents at Mexican consulates in New York, Atlanta and Raleigh, N.C., where recent arrivals have gravitated toward construction, hotel and restaurant jobs, and in Dallas, Chicago, Los Angeles, and Fresno, Calif., where they have been more likely to work in agriculture and manufacturing.
Unlike the stereotype of jobless Mexicans heading north, most of the immigrants had been employed in Mexico, the report found.
Once in the United States, they soon found that their illegal status was no barrier to being hired here. And though the jobs they landed, typically with help from relatives, were often unstable and their median earnings only $300 a week, that was enough to keep drawing newcomers because wages here far exceeded those in Mexico.
"We're getting a peek at a segment of the U.S. labor force that is large, that is growing by illegal migration, and that is bringing an entirely new set of issues into the U.S. labor market," said Rakesh Kochhar, associate director for research at the Pew Hispanic Center and author of the study.
The report suggested that policies intended to reduce migration pressures by improving the Mexican economy would have to look beyond employment to wages and perceptions of opportunity.
The survey found that the most recent to arrive were more likely to have worked in construction or commerce, rather than agriculture, in Mexico. Only 5 percent had been unemployed there; they were "drawn not from the fringes, but from the heart of Mexico's labor force," the report said.
After a difficult transition in their first six months in the United States about 15 percent of the respondents said they did not work during that time the rate of unemployment plummeted, to an average of 5 percent.
But in one of the most striking findings, 38 percent reported an unemployment spell lasting a month or more in the previous year, regardless of their location, legal status or length of time in the United States.
"These are workers with no safety net," Mr. Kochhar said. "The long run implication is a generation of workers without health or pension benefits, without any meaningful asset accumulation."
On the other hand, Mr. Kochhar and Roberto Suro, director of the Pew Hispanic Center, said the flexibility of this work force was a boon to certain industries like home construction, an important part of the nation's economic growth since the last recession.
Among respondents to the survey, those who settled in Atlanta and Dallas were the best off, with 56 percent in each city receiving a weekly wage higher than the $300 a week median. The worst off were in Fresno, where more than half of the survey respondents worked in agriculture and 60 percent reported earning less than $300 a week. The lowest wages were reported by women, people who spoke little or no English, and those without identification.

To some scholars of immigration, the report underlines the lack of incentives for employers to turn to a guest worker program like the one proposed by President Bush because their needs are met cheaply by illegal workers and all without paperwork or long term commitment.
Guest workers might instead appeal to corporations like Wal Mart, the scholars said, where service jobs are now the target of union organizing drives.
"You can't plausibly argue that immigrant dominated sectors have a labor shortage," said Robert Courtney Smith, a sociologist and author of "Mexican New York: Transnational Lives of New Immigrants." Instead, he said, the report and evidence of falling wages among Mexican immigrants over time point to an oversupply of vulnerable workers competing with each other.
But Brendan Flanagan, a spokesman for the National Restaurant Association, which supports a guest worker program, disagreed. "In many places it is difficult to fill jobs with domestic workers," Mr. Flanagan said. "We've seen a simple lack of applicants, regardless of what wage is offered."
Although the survey, conducted from July 2004 to January 2005, was not random or weighted to represent all Mexican immigrants, it offers a close look at a usually elusive population.
Those surveyed were not questioned directly about their immigration status, but they were asked whether they had any photo identification issued by a government agency in the United States. Slightly more than half over all, and 75 percent in New York, said they did not.
The migration is part of a historic restructuring of the Mexican economy comparable to America's industrial revolution, said Kathleen Newland, director of the Migration Policy Institute, a research organization based in Washington.
The institute released its own report on Tuesday, arguing that border enforcement efforts have failed. Workplace enforcement, which has been neglected, would be a crucial part of making a guest worker program successful.
For now, Mexicans keep arriving illegally.
"It doesn't matter if it's winter," said Ricardo Cortes, 23, a construction worker waiting for a friend outside the Mexican consulate in New York on Tuesday. "People are still coming because there's no money over there."

NEW YORK (MarketWatch) — Rep. Michele Bachmann, the Republican from Minnesota, has made it official. She’s calling for a repeal of the Dodd-Frank Act, the regulatory overhaul enacted this summer that administration officials called “financial reform.”

Bachmann’s cause is not unlike the symbolic vote Republicans are pressing for to repeal the health care law. Dodd-Frank is probably here to stay.
Before you laugh, consider this: what if she succeeds? See Political Watch blog post on Bachmann announcement.
Surely, a repeal would have real effects. It would eliminate rules on capital requirements, bank trading, investments in hedge funds and private equity and the creation of a clearinghouse for derivatives.
But most of those new rules haven’t been written, much less enacted. Some, including provisions of the so-called “Volcker Rule” won’t be in place for as many as 12 years.

Another leg of Dodd-Frank, the systemic risk council of regulators, hasn’t exactly been burdened with work. The group, which includes securities and banking regulators, is mainly charged with deciding when too-big-to-fail institutions should be unwound and how.
And the biggest part of the rule, which Bachmann called an abuse of power, was the Consumer Financial Protection Bureau. That agency is being built by the Treasury Department and Elizabeth Warren, but other than a few meetings, hasn’t offered much direction to the banking industry.
That’s why repealing Dodd-Frank wouldn’t shake up finance. Instead, the Republicans will squeeze regulators through budgets and hearings to keep rule-making friendly to banks.
Depending on your ideological point of view the pinch will either roll back an abuse of power or pay off the banking lobby that fought the law with millions in donations and influence.
Repeal? Better to let it be, but make it ineffective.

1. Senator Christopher Dodd (D-CT): This marks two years in a row for Senator Dodd, who made the 2008 "Ten Most Corrupt" list for his corrupt relationship with Fannie Mae and Freddie Mac and for accepting preferential treatment and loan terms from Countrywide Financial, a scandal which still dogs him. In 2009, the scandals kept coming for the Connecticut Democrat. In 2009, Judicial Watch filed a Senate ethics complaint against Dodd for undervaluing on his Senate Financial Disclosure forms a property he owns in Ireland. Judicial Watch's complaint forced Dodd to amend the forms. However, press reports suggest the property to this day remains undervalued. Judicial Watch also alleges in the complaint that Dodd obtained a sweetheart deal for the property in exchange for his assistance in obtaining a presidential pardon (during the Clinton administration) and other favors for a long-time friend and business associate. The false financial disclosure forms were part of the cover-up. Dodd remains the head the Senate Banking Committee.

2. Senator John Ensign (R-NV): A number of scandals popped up in 2009 involving public officials who conducted illicit affairs, and then attempted to cover them up with hush payments and favors, an obvious abuse of power.
3. Rep. Barney Frank (D-MA): Judicial Watch is investigating a $12 million TARP cash injection provided to the Boston-based OneUnited Bank at the urging of Massachusetts Rep. Barney Frank. As reported in the January 22, 2009, edition of the Wall Street Journal, the Treasury Department indicated it would only provide funds to healthy banks to jump-start lending. Not only was OneUnited Bank in massive financial turmoil, but it was also "under attack from its regulators for allegations of poor lending practices and executive-pay abuses, including owning a Porsche for its executives' use." Rep. Frank admitted he spoke to a "federal regulator," and Treasury granted the funds. (The bank continues to flounder despite Frank's intervention for federal dollars.) Moreover, Judicial Watch uncovered documents in 2009 that showed that members of Congress for years were aware that Fannie Mae and Freddie Mac were playing fast and loose with accounting issues, risk assessment issues and executive compensation issues, even as liberals led by Rep. Frank continued to block attempts to rein in the two Government Sponsored Enterprises (GSEs). For example, during a hearing on September 10, 2003 , before the House Committee on Financial Services considering a Bush administration proposal to further regulate Fannie and Freddie, Rep. Frank stated: "I want to begin by saying that I am glad to consider the legislation, but I do not think we are facing any kind of a crisis. That is, in my view, the two Government Sponsored Enterprises we are talking about here, Fannie Mae and Freddie Mac, are not in a crisis. We have recently had an accounting problem with Freddie Mac that has led to people being dismissed, as appears to be appropriate. I do not think at this point there is a problem with a threat to the Treasury." Frank received $42,350 in campaign contributions from Fannie Mae and Freddie Mac between 1989 and 2008. Frank also engaged in a relationship with a Fannie Mae Executive while servi ng on the House Banking Committee, which has jurisdiction over Fannie Mae and Freddie Mac.

He also faces allegations that he improperly used his influence to maintain ownership of highly coveted rent-controlled apartments in Harlem, and misused his congressional office to fundraise for his private Rangel Center by preserving a tax loophole for an oil drilling company in exchange for funding. On top of all that, Rangel recently amended his financial disclosure reports, which doubled his reported wealth. (He somehow "forgot" about $1 million in assets.) And what did h e do when the House Ethics Committee started looking into all of this? He apparently resorted to making "campaign contributions" to dig his way out of trouble. According to WCBS TV, a New York CBS affiliate: "The reigning member of Congress' top tax committee is apparently 'wrangling' other politicos to get him out of his own financial and tax troubles...Since ethics probes began last year the 79-year-old congressman has given campaign donations to 119 members of Congress, including three of the five Democrats on the House Ethics Committee who are charged with investigating him." Charlie Rangel should not be allowed to remain in Congress, let alone serve as Chairman of the powerful House Ways and Means Committee, and he knows it. That's why he felt the need to disburse campaign contributions to Ethics Committee members and other congressional colleagues.
