ALABAMA SENATE DEBATES SURRENDER TO LA RAZA SUPREMMACY - JOBS GO TO ILLEGALS FIRST - LEGALS GET TO PAY FOR THEIR WELFARE and CRIMET TIDAL WAVE

Alabama Senate to Debate Weakening HB 56

Today, the Alabama Senate is expected to take up HB 658, legislation that would substantially weaken HB 56, the state's immigration enforcement law adopted just last year. If passed, HB 658 would limit the circumstances under which local law enforcement officers check immigration status, weaken the penalties for knowingly hiring illegal aliens, eliminate the prohibition on renting apartments to an individual a landlord knows is an illegal alien, eliminate the ability of citizens to bring an action against a law enforcement agency's sanctuary policy or practice, and eliminate the requirement that schools collect immigration data on their students for inclusion in state reports. (See HB 658 as engrossed; FAIR Legislative Update, Apr. 9, 2012)
HB 658, authored by Rep. Micky Hammon (also the House author of HB 56), was introduced on April 5th and has quickly traveled through the state legislature. It passed the Alabama House, with amendments, April 19th by a 64-34 vote and has since cleared the Senate Judiciary Committee by a vote of 7-3.
The Senate vote to revise HB 56 is expected despite the fact that the United States Supreme Court is currently reviewing many of the same provisions found in Arizona SB 1070. During the oral arguments on SB 1070 at the Supreme Court last week, many of the Justices indicated they would uphold at least parts, if not all of, of SB 1070. In fact, their comments on the constitutionality of SB 1070 were so direct, Alabama Attorney General Luther Strange has since recommended to the State legislature that it hold off on amending HB 56 until the Supreme Court issues its ruling on SB 1070. (The Birmingham News, April 27, 2012) That ruling is expected in June.

LA RAZA SEN. SCHUMER HISPANDERING TO ILLEGALS LIKE AN OBAMAnite

Sen. Schumer Engages in Political Theater Prior to SB 1070 Hearing

In an attempt to discredit Arizona's immigration enforcement law the day before the U.S. Supreme Court was scheduled to hear oral arguments on it, Senator Chuck Schumer (D-NY) convened a hearing of the Senate Judiciary's Immigration Subcommittee to examine the "constitutionality and prudence" of state and local immigration enforcement laws. (See Sen. Schumer Letter, Feb. 23, 2012)
Sen. Schumer, who chairs the Subcommittee, wasted no time before speaking out against the Arizona legislation, SB 1070. Calling it "counterproductive and unconstitutional," he threatened to introduce a bill that would prohibit state and local police from enforcing immigration laws unless they are doing so pursuant to an explicit agreement with the federal government and are trained and supervised by federal officials. (Bloomberg Government Transcript, Apr. 24, 2012) Current law specifically provides that an agreement is not required for state and local officers to assist in the identification, apprehension, detention, or removal of illegal aliens. (INA § 287(g)(10); 8 U.S.C. 1357(g)(10))
Sen. Dick Durbin (D-IL), the only other Member of the Subcommittee to attend the hearing, echoed Schumer's opposition to the law, and used the hearing as a platform for his failed DREAM Act. As an aide held up enlarged photographs of illegal alien minors that would qualify for amnesty under the DREAM Act, Sen. Durbin declared that it "is wrong and counterproductive to criminalize people because of their [immigration] status." (Bloomberg Government Transcript, Apr. 24, 2012) He then argued that the several illegal alien minors whose photos he showcased would be deported if SB 1070 were allowed to go into effect.
Former President of the Arizona State Senate and author of SB 1070 Russell Pearce was the only witness invited to speak in support of the law. Underscoring the need for his legislation, Pearce told Sens. Schumer and Durbin that illegal immigration costs Arizonans billions annually. That figure, he told them, "is just to educate, medicate, and incarcerate and… don't reflect the cost of crimes committed by those here illegally or jobs lost." He also reminded them that several of the 9/11 hijackers were in the country illegally, emphasizing the connection between enforcement of immigration laws and terrorist threats. "Four of the five leaders of the 9/11 attack were in violation of our immigration laws and had contact with law enforcement and were not arrested. The failure to enforce the immigration laws was instrumental in the deaths of nearly 3,000 people on that tragic day in America," he said.
Republicans on the Subcommittee boycotted the hearing, telling reporters it was merely a political stunt. "I will not participate in today's hearing because it is strictly political theater," said Sen. Jon Kyl (R-AZ), who serves on the Subcommittee. He continued, "The timing of the hearing just one day ahead of the Supreme Court's review of the law suggests that its purpose is either to influence the court's decision or to garner publicity."

SENATE PASSES BILL to INCREASE U VISAS - AMERICA: NO LEGAL NEED APPLY!

Senate Passes Bill to Increase U Visas

The U.S. Senate passed Thursday the Violence Against Women Reauthorization Act (VAWA), S. 1925, a bill that contained provisions that would increase the number of U visas by tens of thousands. (See how Senators voted here) S. 1925, introduced by Senate Judiciary Chair Pat Leahy (D-VT), accomplishes this by increasing the number granted annually from 10,000 (the current ceiling) to 15,000, until all unused U visas since 2006 are recaptured. (S. 1925 at § 805)
Congress created the U nonimmigrant visa in 2000 to allow aliens who have suffered substantial physical or mental abuse as a victim of domestic violence, rape, or certain other crimes to obtain temporary legal status if they help law enforcement prosecute those crimes. (INA § 101(a)(15)(U); see also FAIR Legislative Update, Feb. 6, 2012) An alien can obtain a U visa regardless of legal status, remain in the country for four-years at a time, receive work authorization, and become eligible for a green card after three years. (INA § 214(p); USCIS Website on U visas)
Senators Kay Bailey Hutchison (R-TX) and Charles Grassley (R-IA) introduced a substitute amendment to the bill that would have stricken the U visa provisions, but it did not garner the 60 votes necessary to pass. (See S.Amdt.2095; see also vote on amendment)
Representative Sandy Adams (R-FL) has introduced H.R. 4970 in the House, a VAWA Reauthorization bill mirroring Sen. Hutchison and Grassley's alternative legislation. Rep. Adams reportedly told The Hill that the Judiciary Committee (of which she is a member) is likely to markup that legislation the week of May 7 and the full House may vote on it as soon as the week of May 14. (The Hill, Apr. 25, 2012)

OBAMA LA RAZA ICE FINDS 16,500 NEW VOTERS... ILLEGALS SAVED FROM DEPORTATION

ICE Ignores 16,500 Deportation Cases

ICE officials suspended over 16,500 pending illegal alien deportation cases last week. (FOX News Latino, April 25, 2012) This is the latest development in the Obama Administration's review of the nation's pending 300,000 immigration cases in an effort to grant amnesty to those not fitting its enforcement "priorities." (See FAIR Morton Memos Summary, Jan. 2012)
The Administration has made clear that it intends to suspend these cases indefinitely unless the alien is subsequently convicted of a crime meeting its priorities. (Id.) Moreover, it is estimated that the Administration grants work authorization to 90 percent of the illegal aliens whose cases it closes. (See Judiciary Committee Press Release, Apr. 25, 2012)
According to ICE, already 2,700 of the suspended cases have been permanently shelved. (Washington Post, Apr. 24, 2012) Moreover, statements by ICE officials indicate that many of these cases meet specific criteria found in Director John Morton's prosecutorial discretion memos and in the failed DREAM Act, such as college enrollment, longstanding unlawful presence, and arrival in the U.S. as a minor. (Id.; See FAIR DREAM Act Summary, Nov. 12, 2010; see also FAIR Morton Memos Summary, Jan. 2012)

Barack Obama vs Americans (legals) and his LA RAZA PARTY BASE of ILLEGALS

Supreme Court Offers Hope for True Immigration Reformers

The United States Supreme Court heard oral arguments Wednesday in the Obama Justice Department's (DOJ) lawsuit to enjoin key provisions of Arizona's SB 1070, which it heard on appeal from the 9th Circuit. Questions posed by the eight Justices hearing arguments in the case (Justice Elena Kagan recused herself) indicated the high court may well be on its way to upholding the legislation.
In particular, the Justices expressed skepticism over the Obama Administration's argument that its enforcement priorities preempt SB 1070. For example, Justice Antonin Scalia asked U.S. Solicitor General Donald Verrilli, who was arguing the case for the DOJ, whether he knew of any cases in which the basis of preemption is the "Attorney General's enforcement discretion" and called such "an extraordinary basis for saying that the state is preempted."(See Oral Argument Transcript, pp. 58-59, Apr. 25, 2012) When Solicitor General Verrilli responded that Arizona's criminalization of a failure to comply with federal registration laws was what's "extraordinary," Justice Scalia replied that such is already a crime under federal law and that Arizona was not doing anything beyond what the law already requires. (Id.; see also 8 U.S.C. §§ 1304, 1306)
Even Justice Sonia Sotomayor, who was appointed to the Supreme Court by President Obama, stated that the Administration's arguments were "not selling well." (Transcriptat p. 55) Asking for Solicitor General Verrilli to offer another argument, she asserted, "Frankly…it's not that [SB 1070 is] forcing you to change your enforcement priorities. You don't have to take the person into custody. So what's left or your argument?" (Id.)
The Court also appeared to dismiss Solicitor General Verrilli's argument that federal law preempts SB 1070 because it would interfere with the national government's ability to forge and maintain relationships with other countries. In response to this argument, Justice Kennedy responded, "So you're saying the [federal] government has a legitimate interest in not enforcing its laws?" (Transcript at p. 63) A few moments later, Scalia incredulously asked the Solicitor General, "So we have to enforce our laws in a manner that will please Mexico?" (Id. at 69)
Finally, the Justices questioned the Administration's desire to enforce U.S. immigration law. Mid-hearing, Chief Justice John Roberts commented to Solicitor General Verrilli, "It seems to me that the federal government just doesn't want to know who is here illegally or not." (Id. at 49-50)
At issue before the Supreme Court were four sections of SB 1070:
  • Section 2: Requires state and local law enforcement officers, during a lawful stop, arrest or detention, to inquire about immigration status if the officer has reasonable suspicion to believe the individual is an illegal alien.
  • Section 3: Provides that it is a violation of state law for an illegal alien to be in violation of the federal alien registration statutes.
  • Section 5: Creates a misdemeanor offense that prohibits illegal aliens from applying for work, soliciting work in public places, or performing work in Arizona.
  • Section 6: Authorizes state and local police officers to conduct a warrantless arrest of an individual if the officer has probable cause to believe the person has committed a removable offense.
All four of these sections were enjoined by the Federal District Court for the District of Arizona. The 9th Circuit Court of Appeals then upheld that injunction. (See FAIR Legislative Update, Apr. 23, 2012)
Although Justice Elena Kagan recused herself from the case, five Justices must still decide in favor of the legislation, or certain provisions of it, for them to take effect. A four-four split would result in the 9th Circuit Court of Appeals' injunction being upheld. The Court is expected to issue its opinion in June.

White House loosens border rules for 2012 elections

The Daily Caller
06/20/2011 | Updated: 7:31 PM 06/20/2011

President Barack Obama’s administration is quietly offering a quasi-amnesty for hundreds of thousands of illegal immigrants aiming to win reelection by mobilizing a wave of new Hispanic voters without alienating the populous at large, say supporters of stronger immigration law enforcement.

The new rules were quietly announced Friday with a new memo from top officials at the US Immigration and Customs Enforcement (ICE) agency. The “prosecutorial discretion” memo says officials need not enforce immigration laws if illegal immigrants are enrolled in an education center or if their relatives have volunteered for the US military.

“They’re pushing the [immigration] agents to be even more lax, to go further in not enforcing the law,” said Kris Kobach, Kansas’ secretary of state. “At a time when millions of Americans are unemployed and looking for work, this is more bad news coming from the Obama administration… [if the administration] really cared about putting Americans back to work, it would be vigorously enforcing the law,” he said.

“We think it is an excellent step,” said Laura Vasquez, at the Hispanic-advocacy group, La Raza, which pushed for the policies, and which is working with other groups to register Hispanics to vote in 2012. “What’s very important is how the prosecutorial discretion memo is implemented” on the streets, she said.

The Hispanic vote could be crucial in the 2012 election, because the Obama campaign hopes to offset its declining poll ratings by registering new Hispanic voters in crucial swing states, such as Virginia and North Carolina.

To boost the Hispanic vote, the administration has enlisted support from Hispanic media figures, appointed an experienced Hispanic political operative to run the political side of the Obama reelection campaign, and has maintained close ties to Hispanic advocacy groups, including La Raza. For example, La Raza’s former senior vice president and lobbyist, Cecilia Munoz, was hired by the Obama administration as director of intergovernmental affairs in 2009.

On Friday, officials at ICE announced several new administrative changes to immigration enforcement.

The primary document was the six-page “prosecutorial discretion” memo, which provided new reasons for officials to not deport illegal immigrants.

Illegal Alien Activists: Changes to deportation program not enough

BY CINDY CARCAMO
THE ORANGE COUNTY REGISTER

Immigration officials addressed criticism of a federal deportation program by making changes that would protect crime victims and witnesses, but immigrant rights activists say the efforts are "cosmetic" and contend the whole program should be dismantled.

Secure Communities is a federal program that allows local enforcement agencies to tap into federal data of people they arrest to check for immigration violations. The program is part of a national effort to identify and deport people who are in the country illegally and suspected of or convicted for committing crimes.

The program launched in Orange County on March 16 of last year. From the program's inception through April 30, more than 77,000 immigrants convicted of crimes, including more than 28,000 convicted of aggravated felony offenses like murder, rape and the sexual abuse of children, were removed from the United States after they were identified through the program, according to Immigration and Customs Enforcement officials.

Read more about the program's local launch.

Secure Communities has come under fire in recent months, with some state officials trying to opt out of it, according to stateline.org and other news reports. Governors from New York, Illinois, and Massachusetts want to end their participation on the grounds that very few of the people being deported have been convicted of serious criminal offenses.

Activists say they're concerned that the program silences victims and witnesses who have become reluctant to report crimes because they're afraid of deportation.

Immigration officials on Friday announced more protections for crime victims and witnesses after the complaints that the program did not distinguish enough between minor offenders and serious criminals, according to news reports.

Some of the changes include new guidelines, which give prosecutors more discretion on who they decide to detain and deport. Other guidelines include additional law enforcement training and instructing officers not to deport people who are crime victims or witnesses in criminal cases.

"Secure Communities is a critical tool for law enforcement agencies working to protect the citizens and communities they serve," said ICE Director John Morton in a written statement released Friday. "However, we need to do a better job of ensuring that the program is more focused on targeting those that pose the biggest risk to communities..."

Immigration organizations called the changes insulting.

"With the utter invisibility of any comprehensive immigration reform on the horizon, mere tweaks to the deportation machine are worse than insufficient, they are insulting,'' said Angelica Salas, executive director of Coalition for Humane Immigrant Rights of Los Angeles. "It is time to flip the switch, turn out the lights on S-Comm and await the outcome of DHS' own Inspector-General's investigation into the genesis and mutation of this misguided monster.''

ICE is instituting additional training to ensure that law enforcement officers understand the goals and priorities of the program.

Interesting, she says a state cannot force employers to check if employees they are hiring are illegal. Thankfully the court ruled 5-3 supporting law. LA RAZA SUPREMACIST HILDA SOLIS, SEC. OF DEPT OF LABOR.

Michelle Malkin

LA RAZA HILDA SOLIS - The U.S. Department of Illegal Alien Labor

President Obama's Labor Secretary Hilda Solis is supposed to represent American workers. What you need to know is that this longtime open--borders sympathizer has always had a rather radical definition of "American." At a Latino voter registration project conference in Los Angeles many years ago, Solis asserted to thunderous applause, "We are all Americans, whether you are legalized or not."

That's right. The woman in charge of enforcing our employment laws doesn't give a hoot about our immigration laws ---- or about the fundamental distinction between those who followed the rules in pursuit of the American dream and those who didn't.

Labor Secretary Pledges Help For Illegal Workers

Last Updated: Tue, 06/22/2010 - 11:00am

Two months after the Department of Labor launched a special program to assist and protect illegal immigrants in the U.S. the Obama cabinet official who heads the agency is personally encouraging undocumented workers to report employers that don’t pay them fairly.

In a Spanish-language public service announcement, Labor Secretary Hilda Solis assures that “every worker in America has a right to be paid fairly, whether documented or not.” Illegal aliens who are not getting fair wages are encouraged to call a new hotline set up by the agency on a new “Podemos Ayudar” (We Can Help) web page designed to administer worker protection laws and ensure that employees are properly paid “regardless of immigration status.”

In the short video, also posted in English, Solis tells illegal immigrants that it’s a “serious problem” when workers in this country are not paid fairly and that all workers have the right to receive their salary regardless of immigration status. She encourages those who are not to call the new hotline and assures it’s free and confidential. “Podemos ayudar,” (we can help), Solis guarantees at the end of the brief segment.

The Labor Secretary’s new message is part of a campaign launched a few months ago to help illegal immigrant workers in the U.S., who she refers to as “vulnerable” and “underpaid.” At least 1,000 new field investigators have been deployed to reach out to Latino laborers in areas with large numbers of illegal alien employees and the agency will focus on enforcing labor and wage laws in industries that typically hire lots of illegal aliens without reporting anyone to federal immigration authorities.

For a government agency to protect law breakers in this fashion may seem unbelievable but not if you consider the source. A Former California congresswoman, Solis has close ties to the influential La Raza movement that advocates open borders and rights for illegal immigrants. She made the protection of undocumented workers a major priority upon being named Labor Secretary, assuring illegal aliens that “if you work in this country, you are protected by our laws.”

"While the declining job market in the United States may be discouraging some would-be border crossers, a flow of illegal aliens continues unabated, with many entering the United States as drug-smuggling "mules."

Obama's 'Hispanicazation' of America

Monday, January 10, 2011 08:28 AM

By: James Walsh

Casting a shadow on economic recovery efforts in the United States is the cost of illegal immigration that consumes U.S. taxpayer dollars for education, healthcare, social welfare benefits, and criminal justice. Illegal aliens (or more politically correct, "undocumented immigrants") with ties to Mexican drug cartels are contributing to death and destruction on U.S. lands along the southern border.

While the declining job market in the United States may be discouraging some would-be border crossers, a flow of illegal aliens continues unabated, with many entering the United States as drug-smuggling "mules."

Increasingly vicious foot soldiers of the Mexican drug cartels are taking control of U.S. lands along the border, especially since U.S. Border Patrol units have been reassigned, some to offices 60 to 80 miles inland.

The U.S. Department of the Interior, Bureau of Land Management (BLM) early last year posted signs warning citizens to avoid Interstate 8 between Casa Grande and Gila Bend, Ariz., because of criminal activity in the area, an area that includes protected natural areas precious to the nation.

In reaction to public outrage over the signs, the BLM removed the offensive wording in October 2010, replacing it with the following: Visitor Information Update--Active Federal Law Enforcement Patrol Area.

As the liberal news media, far-left Democrats, and labor unions push for the "Hispanicazation" of U.S. culture, U.S. Department of Homeland Security Secretary Janet Napolitano says the U.S. border has never been more secure.

Perhaps she is basing this on the reduced number of apprehensions, which result, of course, from reassigning Border Patrol agents inland.

In a recent New York Times article, Nicholas Kristof criticized U.S. citizens for not speaking a foreign language and suggested that "Every child in the United States should learn Spanish." He concluded that as the United States increasingly integrates economically with Latin America, Spanish will be crucial for the United States.

For decades, the liberal left has argued that Latin America is essential for U.S. business and trade. Kristof states that Latin America "is finally getting its act together" but fails to mention the Obama administration's $2 billion loan of U.S. taxpayer money in 2009 to Brazil's Petrobras oil company for deep off-shore oil drilling. Obama confidant George Soros, through the Soros Fund Management LLC, until recently owned millions of dollars of Petrobras stock.

Kristof suggests that one day Spanish-speaking Americans will be part of daily life in the United States and that workmen such as mechanics will be able to communicate easily with Spanish-speaking customers.

He fails to explain why these customers will not be speaking English. After all, the ability to speak, read, and write English remains a requirement for U.S. citizenship.

President Barack Obama gives lip service to increasing border control resources with limited funding and personnel. Many officials, including the governors of Texas and Arizona, are skeptical regarding the Obama administration's resolve. They resent that the United States is being blamed for the killing fields on both sides of the Mexico-U.S. Border.

For instance, U.S. Secretary of State Hillary Clinton in March 2009, during her first official visit to Mexico, placed the blame for the Mexican drug cartels' vicious murders on the United States.

In Mexico City, she announced that the U.S. appetite for illegal drugs and the easy acquisition of guns from the United States by Mexicans are the root causes of the Mexican crime wave. "Blame America" has become the global agenda of the Democratic Party.

The Obama administration's plan to resolve the immigration chaos is to offer amnesty to all comers. President Obama re-affirms his support of a "pathway to citizenship" (amnesty) for illegal aliens in 2011.

The administration, however, has announced no plans to control the influx of future waves of illegal aliens or their skyrocketing costs to the nation. The administration, which condones U.S. sanctuary cities and states, has no plans to file charges against them for violations of federal immigration law. Nor does the administration seem concerned about the environmental impact that illegal aliens have on the ecology of the United States.

Many national forests, parks, monuments, wilderness areas, and wildlife refuges -- once the pride of the nation -- are serving today as marijuana fields for illegal alien gangs.

Former Democratic Speaker of the House Nancy Pelosi reportedly said to a gathering of illegal aliens in California in 2009 that U.S. immigration laws were "un-American," suggesting that they need not be obeyed. Concerned citizens can only trust that the new speaker of the House, John Boehner, as part of congressional oversight of federal agencies, will demand enforcement of existing immigration laws.

When will President Obama recognize that illegal immigration is slowing economic recovery? Can he resolve the chaos while still appeasing his Hispanic base?

To maintain his populist aura, the president is in the habit of saying one thing to one audience and the opposite to another.

One Obama apologist explained, "Campaign rhetoric is one thing," suggesting that governing is another. The deliberate Hispanicazation of the United States to secure a block of votes is quite another.

*

THE ENTIRE REASON THE BORDERS ARE LEFT OPEN IS TO CUT WAGES!

"We could cut unemployment in half simply by reclaiming the jobs taken by illegal workers," said Representative Lamar Smith of Texas, co-chairman of the Reclaim American Jobs Caucus. "President Obama is on the wrong side of the American people on immigration. The president should support policies that help citizens and legal immigrants find the jobs they need and deserve rather than fail to enforce immigration laws."

True to form, she said it was illegal to make employers e-verify citizen status of new hires.

Interesting, she says a state cannot force employers to check if employees they are hiring are illegal. Thankfully the court ruled 5-3 supporting law. But now we know for sure just how extreme far left Obama's choice was. We cannot afford Obama to get another term, or you can bet this country will be overrun by illegals. I don't want this country to be poor and corrupt like Mexico, which it will if illegals overrun the country.
