Mexican Senators to Visit Arizona

Last week, a delegation of Mexican Senators announced that they are planning to travel to Arizona to “listen to opinions” about SB 1070, the state’s tough new immigration law. (Associated Press, May 25, 2010). The Mexican Senate has already expressed its opinion on SB 1070, as it unanimously passed a resolution urging Arizona Governor Jan Brewer to veto the legislation prior to her signing it into law. (CBS News, April 23, 2010). Some Mexican lawmakers have also urged Mexican President Calderon to cut economic ties with Arizona. (KVOA, May 18, 2010)
Mexican Senator Luis Alberto Villarreal claimed that the delegation is “not going to demonstrate” during its trip to Arizona, and added that the senators have respect for laws of other nations. Another Senator, Claudia Corichi, said that the delegation will meet with Mexican consuls to determine what actions to take if the law goes into effect July 29. (Associated Press, May 25, 2010). A number of pro-amnesty groups have filed lawsuits seeking to prevent SB 1070 from taking effect as scheduled. (See FAIR’s Legislative Update, May 10, 2010).

Immigration law ignites fear in Arizona
A new state law requires public workers to report illegal immigrants who apply for benefits they aren't entitled to. The attorney general will decide the law's scope.

Cristina, an illegal immigrant living in South Tucson, recently went to a government office to sign up her children for a state-run Medicaid program.

The boy and girl, ages 7 and 3, respectively, are U.S. citizens and entitled to the benefits. But Cristina, who spoke on condition her last name not be used, was fearful. She'd heard of a new state law requiring public workers to alert Immigration and Customs Enforcement when illegal immigrants apply for benefits they are not legally entitled to.

So when workers asked Cristina, 32, for identification, she fled. She now says she has no way to treat her daughter's liver problems or her son's asthma and impacted tooth.

Cristina, a single mother and part-time house cleaner, is even reluctant to take her children to a hospital emergency room. "I feel so alone," she said.

The new law has terrified the immigrant community here, leading to agonized discussions at schools, churches and community meetings about whether it is safe to get government help in Arizona. The author of the law, state Sen. Russell Pearce, is happy about that.

"I have a hard time having compassion for criminals," Pearce said. "It's about time people started being afraid."

Pearce contends that a large number of illegal immigrants improperly receive public benefits, and his law makes it a misdemeanor for a public worker to fail to report one. The law also allows citizens to sue public agencies if they believe immigrants are receiving improper benefits.

"I want the law enforced," he said. "Every time you pass something it becomes a toothless tiger." He acknowledged that his bill is not supposed to apply to people like Cristina's children, who are legally entitled to federal benefits.

The law took effect in late November, and it is not yet clear what government services it applies to. Some fear it could mean libraries and fire stations are obligated to report illegal immigrants, an interpretation Pearce said is silly.

He said the bill applies only to a range of welfare, Medicaid and other government aid programs that are not already guaranteed to illegal immigrants under federal law.

But many Arizonans are awaiting an opinion from the state's attorney general on the law's scope and which government workers are obligated to report illegal immigrants.

Critics of the law say it creates fear and uncertainty over a problem that doesn't exist.

"It's already the law in Arizona that we cannot give benefits to people who are in the country illegally," said Ken Strobeck, executive director of the Arizona League of Cities and Towns, which unsuccessfully sued to halt the law's implementation.

Experts on both sides of the immigration debate agree that illegal immigrants rarely receive government benefits illegally. Many economists have found that immigrants pay for benefits they receive through taxes, though some studies show a net loss to government.

The main cost to taxpayers comes from the use of public schools or emergency medical care -- benefits guaranteed illegal immigrants under federal law.

Also, children of illegal immigrants who are U.S. citizens are eligible for the same benefits as those of any other citizen, such as food stamps.

"There's not much that Arizona can do about it," said Steven A. Camarota, research director at the Center for Immigration Studies in Washington, which favors restrictions on immigration. "The only solution is for us to have fewer illegals and fewer U.S.-born children" of illegal immigrants, he added.

Camarota estimated that families headed by illegal immigrants receive public assistance at about the same rate as families of native-born citizens who lack a high school education. A 2002 study by the Urban Institute found that illegal-immigrant families used benefits at a far lower rate than native-born ones -- for example, 11% of illegal-immigrant families in Los Angeles County used food stamps, compared with 33% of low-income native-born ones.

Randy Capps, who worked on the Urban Institute study and is now at the Migration Policy Institute, said illegal immigrants shy away from government aid. "When you're in an anti-immigrant, hostile environment, like in Arizona, the message is clear that you put yourself at risk with any contact with the government," Capps said.

In 2004, Pearce, a Republican, helped write a ballot initiative that required state workers to report illegal immigrants who receive benefits. But Arizona Atty. Gen. Terry Goddard, a Democrat, interpreted the measure narrowly so the law applied to only a couple of obscure programs.

This year, as the state struggled to address its budget deficit, Pearce inserted language in the budget bill reiterating those requirements. Many immigrant advocates and local officials were unaware of the move until the law took effect. Its impact was swift.

Jennifer Allen, executive director of the Border Action Network here, said the group has been swamped with calls from terrified parents, like Cristina, fearful of seeking benefits for their U.S. citizen children.

"It's sent a shock wave of fear through immigrant communities," Allen said.

The state Department of Economic Services, which administers welfare benefits, has referred to federal authorities more than 750 people who applied for benefits without proof of legal residency. Officials at ICE have not said whether they have taken action on those cases, but stressed that their priorities in deportations lie with violent criminals.

On a recent morning, a group of immigrants sat in the modest offices of the Border Action Network, sharing stories of fearful trips to apply for benefits. Sofia Machado, an English teacher and volunteer at the group, said one of her neighbors had been deported after seeking Medicaid for her U.S.-born children.

Just as Machado finished telling the story, her cellphone rang. The caller's daughter was three months pregnant and had started bleeding, but the caller feared taking her to the hospital. Machado tried to reassure the caller that hospitals should not be checking immigration status.

"There's a lack of information and a panicked ignorance," she said afterward. "Look at the disaster these people have created."

One woman is dead and two others were raped recently and police say each crime was committed by a different illegal immigrant. One of the sexual assaults happened just hours before the Seattle city council passed an ordinance boycotting Arizona over its new immigration law.

Gregorio Luna Luna had a history of beating up his live-in girlfriend Griselda Ocampo Meza. He was also in the U.S. illegally. On May 1, Luna Luna was deported to Mexico. Three weeks later Meza was murdered in her apartment in a violent knife attack.

Franklin County prosecutors say Luna Luna slipped past the border again and killed Meza in front of their five year old son. He's in the county jail awaiting trial.

A suspected rapist in Edmonds, Washington has been ,b>deported at least 4 times according to Snohomish County prosecutors. And an illegal immigrant just convicted of his possible 3rd strike in Whatcom county- a rape of a homeless woman- has been deported to Mexico five times.

Washington State ranks 11th in the nation in the number of illegal immigrants with an estimated 150,000. They make up 2% of the state's population, but account for 4.5% of those in Washington prisons.

Currently, over half of the individuals on the Washington State Patrol's Most Wanted List are suspected illegal immigrants. 18 of the 26 on the list are Hispanic with no place of birth identified. Most are wanted for vehicular homicide.

There are about 50,000 felony warrants currently issued in Washington State and according to a source in the U.S. Marshall's office between 30-40 percent are believed to be illegal immigrants.,/b>

Audit looks at migrant re-arrests

WASHINGTON - Some illegal immigrants are being released from prison only to be arrested on new charges despite government efforts to deport them and keep them out of the country.

The findings are part of an audit by Justice Department Inspector General Glenn Fine that suggest authorities are still struggling to deport illegal immigrants who commit crimes, even though most state and local authorities are notifying immigration authorities of the imminent release of prisoners.

Fine's office analyzed the cases of 100 immigrants who had served time in prison and found 73 of them were rearrested after being released.

On average, each immigrant was rearrested six times, ranging from traffic violations to assault.

Fine's office couldn't determine how many illegal immigrants had been rearrested overall because immigration authorities don't keep track.

If the sample was any indication, "The rate at which released criminal aliens are rearrested is extremely high," the report said.

Last year, Homeland Security's inspector general said immigration authorities expected that most of the 300,000 illegal and legal immigrants eligible to be deported would be released.

Federal officials said they would need 34,000 additional beds at a cost of $1.1 billion to detain and remove all of them.

Some Illegal Immigrants have been arrested and Re-Arrested 6 Times - Illegal Immigrants arrested for being in the United States illegally may have been charged up to six more times, for more serious crimes, after they were released by local authorities. Additionally, the number of illegal immigrants deported after being declared a felon is on the rise.

The Justice findings by department Inspector General Glenn A. Fine examined the criminal histories of 100 illegal immigrants arrested and then released by local and state authorities in 2004, the latest complete data available. Of the sample group of 100, according to the audit, 73 immigrants were later arrested a collective 429 times - on charges ranging from traffic tickets to weapons and drug charges.

The data suggest "the rate at which released criminal aliens are re-arrested is extremely high," the audit noted. The report, parts of which were redacted, was required by Congress in 2005 and looked at how local and state authorities that receive Justice Department funding are working with the Homeland Security Department.

For years, the government was forced to release thousands of illegal immigrants who were caught in the United States because of not enough jail space and other resources. But last fall, with immigration as a key election-year priority, Homeland Security declared it would detain 99 percent of non-Mexican illegal immigrants until they could be returned to their home nations. The policy generally does not apply to Mexicans, who are almost immediately returned to Mexico after being stopped by Border Patrol agents.

The Justice audit, however, only looked at immigrants who were arrested and released by local and state authorities before they could be turned over to Homeland Security to be detained or deported. In all, 752 cities, counties and states participating in the program received $287 million in 2005, the audit noted.

Five states - California, New York, Texas, Florida and Arizona - received the bulk of the money, together pulling in more than $184 million.

Assistant Attorney General Regina B. Schofield, who oversees the Office of Justice Programs that controlled the funding, declined comment on the audit, noting that it does not contain any recommendations.

A separate report by the Transactional Records Access Clearinghouse at Syracuse University showed that the number of immigrants who were deported as "aggravated felons" doubled over the last 15 years, from 10,303 in 1992 to an estimated 23,065 in 2006.

But TRAC, which obtained the data from the Justice Department's Executive Office of Immigration Review, noted concerns that some of those immigrants never committed felonies.

"An individual can be declared an aggravated felon on the basis of a conviction on misdemeanor charges such as shoplifting," the TRAC report concluded.

Senate Rejects Efforts to Secure the Border
The Senate rejected three border security amendments that were offered last week to H.R. 4899, the Emergency Supplemental Appropriations bill. (Roll Call Vote No. 165, May 27, 2010; Roll Call Vote No. 166, May 27, 2010; Roll Call Vote No. 167, May 27, 2010). (The Washington Post, May 27, 2010). These critical amendments would have used unspent stimulus funds to provide funding and personnel to address the increasing violence and illegal immigration on the U.S.-Mexico border. Democrats managed to defeat all three measures proposed by border state senators, as they each fell short of the 60 votes required to overcome objections made against the amendments.
The first amendment (S.Amdt.4214), sponsored by Senator John McCain (R-Ariz.) and cosponsored by Senators Jon Kyl (R-Ariz.), John Cornyn (R-Tex.), and Kay Bailey Hutchison (R-Tex.), would have funded the deployment of 6,000 National Guard troops to support and secure the southern border of the United States. Arguing on behalf of his amendment, McCain stated, “Deploying the National Guard is essential to securing our U.S.-Mexico border. Families living in Arizona should not suffer from the daily threats caused by illegal immigration, drug trafficking, and human smuggling. It is the Federal government’s obligation to protect all Americans by securing the borders, and deploying 6,000 National Guard is a critical first step.” (McCain Press Release, May 27, 2010).
Senators Kyl and McCain also proposed an amendment (S.Amdt.4288) that would have provided $200 million for Operation Streamline, a program to prosecute illegal border crossers rather than release them. The program has been fully implemented in Del Rio, Texas, and Yuma, Arizona, and since its inception in 2005, has dramatically reduced the number of individuals illegally crossing the border in those sectors. (Kyl Press Release, May 27, 2010).
Senator Cornyn’s amendment (S.Amdt.4202), cosponsored by Senators Kyl, Hutchison, and McCain, was a multi-agency border security measure that would have provided $3 billion for the federal, state, and local law enforcement officers who work on the frontlines of the U.S.-Mexico border. The amendment would have funded six important priorities involving border security, which include border security and technology, state and local law enforcement, southwest border taskforces, border enforcement personnel, detention and removal activities, and ports of entry. Speaking on the Senate floor in support of his amendment, Senator Cornyn said, “Our children are living in fear, but the Obama White House is living in denial…I urge my colleagues to support this amendment and help send a message to our border communities that the federal government accepts its responsibility to keep them safe.” (Cornyn Press Release, May 25, 2010).
Senator Kyl slammed the Senate’s rejection of efforts to secure the nation’s border: “On the heels of the President’s ‘announcement’ to send National Guard troops to the border, it’s unfortunate to once again see actions not matching up with words. Obama Proposes Cuts to Important Immigration Enforcement Programs
On February 1, President Obama released the details of his Fiscal Year (FY) 2011 Budget Request, which seeks to cut funding for important immigration enforcement programs. (See The President’s Budget Message, February 1, 2010). Specifically, the president’s budget would slash funding for the Secure Border Initiative; cut funding for US-VISIT; and cut 180 agents from the Border Patrol. The president’s proposed budget also proposes to merely maintain funding for the critically underfunded State Criminal Alien Assistance Program (SCAAP).
The Secure Border Initiative (SBI) “is a comprehensive, multi-year plan to help secure America’s borders” through fencing, infrastructure, and technology. (CBP Factsheet). SBI is a critical element of the larger DHS-CBP effort to increase border security, which includes construction of the border fence. Last year, Congress approved $800 million to fund SBI through FY2010. President Obama is requesting only $574 million for this program in his FY2011 budget, a $226 million cut. (FY2011 Budget Request Appendix: DHS).
US-VISIT, or United States Visitor and Immigrant Status Indicator Technology, is an entry-exit tracking program that collects information, including biometric identifiers, on foreign nationals attempting when they enter the United States. This information is then used to, among other things, determine whether foreign nationals should be denied entry and whether exiting aliens have overstayed or otherwise violated the terms of their admission. According to a Government Accountability Office (GAO) report released in November 2009, the Department of Homeland Security (DHS) does not have a unified schedule to completely implement a comprehensive exit function for US-VISIT, and it is difficult to determine when and how US-VISIT will be completed. (GAO Report, November 2009). Despite this failure to complete implementation, President Obama has proposed a $39 million cut to US-VISIT, from $374 million in FY2010 to $335 million in FY2011. (FY2011 Budget Request Appendix: DHS).
In addition, President Obama’s budget provides for a reduction of 180 Border Patrol agents. According to Acting DHS Chief Financial Officer Peggy Sherry, the administration does “not believe the 180 personnel reduction will in any way reduce the overall operating effectiveness of the Border Patrol because over the past five years, the Border Patrol has doubled in size.” Sherry continued: “A lot of the agent workforce, the substantial portion of it, has only a couple of years experience. As they become more seasoned and more mature in their jobs, their effectiveness will increase.” (See DHS Conference Call Transcript).
The administration has also requested only $330 million for SCAAP – a federal program administered through the Department of Justice that helps states pay for the incarceration of criminal aliens. (FY2011 Budget Request: DOJ). Congress recently cut the annual funding level for SCAAP from $400 million in FY2009 to $330 million in FY2010. (See FAIR’s Legislative Update, December 22, 2009). This cut drew significant criticism from border state Governors Rick Perry (R-TX) and Arnold Schwarzenegger (R-CA), yet through his request, President Obama suggests that he wants to make it permanent. (Id.).
Although President Obama’s budget is a significant barometer reflecting his policies and priorities, it represents simply a funding request to Congress. Congress has the true power to appropriate money and can choose to wholesale adopt, modify, or reject the President’s budget request. The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Senate Democrats Block DeMint’s Effort to Finish the Fence
As FAIR reported last week, Senator Jim DeMint (R-SC) introduced an amendment to the financial regulation bill (S. 3217) that would require the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border within one year. (FAIR’s Legislative Update, May 10, 2010; DeMint Press Release, May 5, 2010). DeMint attached his amendment to an amendment authored by Senator Ron Wyden (D-Ore.) that would restrict secret holds in the Senate. (Roll Call, May 13, 2010). This ensured that the Senate would have to vote on the border fence amendment before turning to Wyden’s amendment.
Senate Democrats, however, chose to block consideration of DeMint’s amendment by having Wyden withdraw his amendment. Wyden called the DeMint Amendment “very controversial,” but the very same amendment passed last year by a bipartisan 54-44 vote when Senator DeMint offered it to the FY2010 Homeland Security Appropriations bill. (Roll Call Vote No. 220, July 8, 2009). In the end, Senator DeMint offered Democrats a chance to make good on their numerous pledges to address border security, but to no avail. The Obama Administration announced today that it is extending Temporary Protected Status for illegal aliens from Nicaragua and Honduras who are living in the United States. TPS for those nations was supposed to expire in July, but the Administration is extending the deadline for two more years.

Ranking Member of the House Judiciary Committee Lamar Smith (R-Texas) spoke out against the Administration's decision.

“President Obama’s announcement of an extension of Temporary Protected Status (TPS) for illegal immigrants from Honduras and Nicaragua stretches the definition of ‘temporary.’

"Only in Washington, DC, would anyone call 11 years – and counting – ‘temporary.’ TPS has become a stealth amnesty for illegal immigrants.

"Honduras and Nicaragua have long since recovered from the hurricane damage that resulted in the granting of TPS more than a decade ago. It’s time to end this stealth amnesty program and address illegal immigration.”

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.
